Okay so I have been asked to cast an eye over SB197 in the WV legislature, which is a new bill introduced to both add a new section to WV law as well as amend an existing section about child neglect and abuse, to see what potential issues I see.
TLDR: this is not only really dangerous from a standpoint of people being trans publicly, since one of the big editions is making being trans a display of obscene material and punishable by law, particularly within school grounds, but I am also seeing a lot of parental rights additions that make me REALLY SCARED of how trans kids are going to be treated in WV. I’m going to go thru it section by section and break down why each section frightens me, so hopefully this is educational for folks.
My creds: I worked in family law as an attorney for three years, I was affiliated with a public defenders office for that same amount of time working primarily with juvenile offenders, and I am still an attorney even if I haven’t worked in those fields for the last six months. Plus I’m trans. And I love WV and wanted to live there. So.
WEST VIRGINIA'S FUN NEW SHITSHOW HORROR HOUSE TIME.
The new section (formally titled §18-5-29, Obscene matter in public schools prohibited [I will be calling it the Obscenity section]) is about 700 words of absolute garbage. Essentially what it distills down to is the following.
Section A: prohibiting anything they label as “obscene matter” in or within 2500 feet of any public school library, classroom, building, or other facility under the supervision of the state board of education and requiring that any school officials or personnel who become aware of the material remove it from school grounds. “Obscene matter” is currently defined in §61-8A-1 of the WV code, pretty fuckin broadly (unconstitutionally so in my opinion but ~that’s me~). So basically anything an “average person applying contemporary community standards would find taken as a whole appeals to the prurient interest or is pandered to a prurient interest” (basically, anything ~unwholesome~), anything that an “average person applying community standards” would find depicts sexually explicit conduct in a “patently offensive way,” or anything that a reasonable person would find “taken as a whole, lacks serious literary, artistic, scientific or political value” which basically means E V E R Y THING.
Section B. This is the one that scares the shit out of me tbqh, cause this is folding in the amendment section I mentioned earlier to another part of the WV code specifically relating to child abuse and neglect. This section mandates that any “school officials or school personnel while engaged in a professional capacity or activity” shall be found to be a “custodian of children” under WV law. This basically makes EVERYONE a mandatory reporter, which like…most professionals already are, but at the same time this is EXPLICITLY MAKING ANYONE WHO WORKS IN THE SCHOOL IN ANY CAPACITY (see: any school officials or school personnel) mandatory reporters regarding “obscene matter.” So if an adult working at the school even SUSPECTS that a child has been exposed to “obscene material “while in any public school facility (unclear from the phrasing if the exposure happened on school property, or if the professional just learns about it there) and they decide not to report it (or they “fail to make a TIMELY report” when there’s no real definition of what timely means) then they can be prosecuted for a misdemeanor and imprisoned.
Section C. The state superintendent is going to establish a procedure to file complaints alleging violations of subsection A. If they find that a violation occurred, they will TELL THE COPS THAT IT HAPPENED.
Section D. No government funds (state or federal) can be used to develop or operate programs “designed to promote or encourage sexual activity, whether homosexual or heterosexual” or “to distribute or aid in distribution of any legally obscene materials” within 2500 feet of a school building or facility. Which, woof. We could unpack everything about that one, but it’ll be most of the review.
Section E. If an adult is found to have committed a felony under the child neglect statute related back to this one (if they’re found to have neglected kids by allowing them to view or possess “obscene material” is my understanding, this bill isn’t written that well) then they will be subject to penalties set forth in a felony, which I’m guessing (on average) is at least a year in jail and a thousand dollar fine, from what I’ve seen of WV felony statutes.
Section F. THIS IS THE OTHER REALLY SCARY ONE TO ME FROM A LEGAL STANDPOINT. “Any student or parent, guardian, or custodian on behalf of a student shall have civil cause of action against a county board, public charter school, state board” if the entity caused or was negligent in allowing a violation of the preceding sections, basically if they let anything slide PARENTS CAN SUE THE SCHOOL which like…if you’re talkin about a trans kid who is not out to their parents, they’re found to have “obscene material” (fanfiction?? Fanfiction could qualify here??? Risque art that isn’t even definitionally pornography?? A book abut transitioning that they’re hiding from their parents???) the school is mandated to not only out this kid to their parents, but the parents can then sue the school if the school DOESN’T OUT THE CHILD. Just spinning a hypothetical here but I hate this.
The rest of the bill is adding in definitions to Article 8A of the WV code, which are as follows. Anything italicized is the new language that has been proposed to be added by the bill; anything NOT italicized was already in the law:
(g) "Graphic," when used with respect to a depiction of sexually explicit conduct, means that a viewer can observe any part of the genitals or pubic area of any depicted person or animal during any part of the time that the sexually explicit conduct is being depicted.
(h) "Identifiable minor" means a person: (i) who was a minor at the time the visual depiction was created, adapted, or modified; or (ii) whose image as a minor was used in creating, adapting, or modifying the visual depiction; and (iii) who is recognizable as an actual person by the person’s face, likeness, or other distinguishing characteristic, such as a unique birthmark or other recognizable feature;  and shall not be construed to require proof of the actual identity of the identifiable minor.
(i) "Indistinguishable" used with respect to a depiction, means virtually indistinguishable, in that the depiction is such that an ordinary person viewing the depiction would conclude that the depiction is of an actual minor engaged in sexually explicit conduct.
(i)(l) "Matter" means any visual, audio, or physical item, article, production transmission, publication, display, exposure, exhibition, or live performance, or reproduction thereof, including any two- or three- dimensional visual or written material, stereopticon, moving picture, slide, film, picture, drawing, not exceeding $500 video, graphic, graphic novel, or computer generated or reproduced image; or any book, not exceeding $500 magazine, newspaper or other visual or written material; or any motion picture or other pictorial representation; or any statue or other figure; or any recording, transcription, or mechanical, chemical, or electrical reproduction; or any other articles, video laser disc, computer hardware and software, or computer generated images or message recording, transcription, or object, or any public or commercial live exhibition performed for consideration or before an audience of one or more.
(j)(m) "Minor" means a an person under eighteen years of age or a person representing himself or herself to be a minor. Any prosecution under this article relating to a victim who is representing himself or herself to be a minor shall be limited to investigations being conducted or overseen by law enforcement.
And the big doozy here is this one:
(k)(n) "Obscene matter" means matter that:
(1) An average person, applying contemporary adult community standards, would find, taken as a whole, appeals to the prurient interest, is intended to appeal to the prurient interest, or is pandered to a prurient interest;
(2) An average person, applying community standards, would find depicts or describes, in a patently offensive way, sexually explicit conduct; and
(3) A reasonable person would find, taken as a whole, lacks serious literary, artistic, political, or scientific value.
(4) For the purposes of any prohibition, protection, or requirement under any and all articles and sections of the Code of West Virginia protecting children from exposure to indecent displays of a sexually explicit nature, such prohibited displays shall include, but not be limited to, any transvestite and/or transgender exposure, performances or display to any minor.
(l)(o) "Parent" includes a biological or adoptive parent, legal guardian, or legal custodian. (underlining this one for the legal side note that remember that custodian language from before??? that's where this kicks in)
(m)(p) "Person" means any adult, partnership, firm, association, corporation, or other legal entity.
(n)(q) "Sexually explicit conduct" means a ultimate definitive sexual act, normal or perverted, between persons of the same or opposite sex, actual or simulated, including genital-genital, oral-genital, anal-genital, or oral-anal sexual intercourse, sodomy, oral copulation of any kind, sexual bestiality, sexual sadism and masochism, masturbation, excretory functions and lewd exhibition of the anus, genitals or pubic area of any person, or lascivious simulated sexual intercourse where the genitals, breast, or pubic area of any person is exhibited.
okay. well.
I mean. This is all just gonna be an absolute garbage hellscape if this gets passed. THE IMPORTANT THING IS IT HAS NOT BEEN PASSED. If you live in WV, you can call folks and say that you are AGAINST the passage of SB197. Call your state or county representatives! They are the people who vote on this! If your representative is on the Judiciary Committee, so much the better, that’s where the bill is being evaluated right now!!! Here is the list of delegates on the committee! Call them!! Make a point to be upset!!! Explain why you don’t want this bill to pass!!! Keep an eye on the Committee website for the dates that the public hearings will be held on this bill, because there likely will be a public hearing people can speak at!! You CAN actually do something, it’s not the end of the world.
Even if you do not live in WV and you live NEAR WV, then 100% reach out to folks you know who live there and give them a safe space to land if they need to get out of the state!!! There are things you can do. Just….a heads up to everyone that this is on the table and it’s something they’re going to be discussing.

RR vs KKR: IPL 2024 Expected Lineup, Live Toss, 100% Prediction & Which Team Will Win?
Tumblr media
Match Preview
This coming Sunday, match number 70 of the Indian Premier League (IPL) will take place at the Barsapara Stadium in Guwahati. The event will feature the Rajasthan Royals (RR) competing against the Kolkata Knight Riders.
After securing a spot in the playoffs with 16 points, the Royals have begun to struggle at the business end of the campaign, as they have lost four matches in a row. On the other side, KKR (19 points) have already secured a top spot in the standings after a washout against the Gujarat Titans in Ahmedabad in the previous round earned them one point. This has allowed them to secure their position as the top team on the table.

RR vs KKR: Pitch Report
Barsapara Cricket Stadium
This is the thirteenth venue of the season, marking the highest number in an Indian Premier League season. With side limits of 63 metres and 60 metres and a straight boundary measuring 73 metres, this location has historically been a relatively high-scoring event. The pitch that we are playing on is made of black earth, and it is hard and rolls really well. "Certainly a surface on which a great number of runs can be scored," Deep Dasgupta and WV Raman remarked before the match between RR and PBKS, which was the last match ever played at the stadium and also the first match ever played there.
In spite of the fact that the pitch has a few fractures, it normally plays far better than it seems to. In the previous year, the team that batted first won both of these games. However, in a match between India and Australia that took place at this venue, Australia chased a massive score of 222 in the last over. This is something that teams want to accomplish because, while they are pursuing it, they are under pressure. They continued by saying, "There are a lot of runs to be had here, regardless of when you bat on the pitch."
RR chose to bat first in the match, and they ended up scoring 144/9 in 20 overs (overs). It was the pacers of PBKS who took six wickets, while the pacers themselves took two wickets. In response, Punjab was able to knock down the goal in 18.5 overs, losing five wickets in the process. There were three wickets taken by RR pacers. During the last five Twenty20 matches, the average total score has been 182 runs. Over the last five years, teams that won the toss have chosen to bowl first 61 percent of the time.

LETTERS FROM AN AMERICAN
May 10, 2021
Heather Cox Richardson
A poll today by the Associated Press (AP) and the National Opinion Research Center (NORC) shows that President Joe Biden’s administration is gaining positive traction. Sixty-three percent of Americans approve of how he is handling his job as president. Seventy-one percent approve of how he is handling the coronavirus pandemic; 62% percent approve of how he is handling health care. Fifty-seven percent approve of how he is handling the economy; 54% approve of how he is handling foreign affairs.
Fifty-four percent of Americans think the country is going in the right direction. This is the highest number since 2017, but it is split by party: 84% of Democrats like the country’s direction, while only 20% of Republicans do.
Biden’s weak spots are in immigration, where 43% approve and 54% disapprove, and gun policy, where 48% approve and 49% disapprove.
And yet, Biden’s people have been working to address the influx of migrant children; White House Secretary Jen Psaki noted last week that “At the end of March, there were more than 5,000 children in Customs and Border Protection Patrol stations. Today, that number is approximately 600…. The amount of time children spend in CBP facilities is down by 75 percent — from 131 hours at the end of March to under 30 hours now.”
The administration has backed that short-term work with a long-term initiative. Last week, Vice President Kamala Harris met virtually with Mexican President Andrés Manuel López Obrador, the leader of the left of center populist nationalist coalition party MORENA, to talk about finding ways to promote economic development to address the root causes prompting the flight of refugees from Guatemala, Honduras, El Salvador and southern Mexico. They also talked about working together to protect human rights and dismantle the criminal networks that smuggle migrants. She will travel to Guatemala and Mexico in June, where she will meet with their leaders.
Disapproval of Biden’s gun policies might well reflect a desire for a stronger stance. In April, a Morning Consult/Politico poll showed that 64% of registered voters supported stricter gun control laws. We have had an average of ten mass shootings a week in 2021, 194 in all. (A mass shooting is one in which four people are killed or wounded.)
This week, Biden will be meeting with bipartisan groups of leaders, including Representative Kevin McCarthy (R-CA) and Senator Mitch McConnell (R-KY), to begin to hammer out an infrastructure measure based on his American Jobs Plan. He will also meet with Senators John Barrasso (R-WY), Roy Blunt (R-MO), Mike Crapo (R-ID), Pat Toomey (R-PA), Roger Wicker (R-MS), and Shelley Moore Capito (R-WV), who have proposed their own $568 billion proposal without corporate tax hikes.
As the good news from the administration is starting to filter into the media, bad news from the Trump wing of the Republican Party is also starting to get traction. On Saturday, we learned that at retreats in March and April, staff for the National Republican Congressional Committee refused to tell lawmakers how badly Trump is polling in core battleground districts, where 54% see Biden favorably while only 41% still favor Trump. Vice President Kamala Harris, the $1.9 trillion American Rescue Plan, and the $2.3 trillion American Jobs Plan are all more popular in those districts than the former president.
Indeed, it is more than a little odd that party leaders are bending over backward to tie their party to a former president who, after all, never broke 50% favorability ratings—the first time in polling history that had happened—and who lost both the White House and Congress.
Another set of data from Catalist, a voter database company in Washington, D.C., shows that the 2020 election was the most diverse ever, with Latino and Asian voters turning out in bigger numbers than ever before. Black voting increased substantially, while Asian-American and Pacific Islander voters had a decisive increase in turnout. The electorate was 72% white, down 2% from 2016 and 5% from 2008. Thirty-nine percent of Biden-Harris voters were people of color (61% were white); only 15% of Trump-Pence voters were POC (85% were white).
This demographic trend is behind the new voter suppression bills in Republican states. But the racial breakdown of the 2020 vote is not the only problem for the current Republican Party. The biggest turnout gains in 2020 were among young voters, 18 to 40 years old, who now make up 31% of voters, while those over 55 have dropped to only 44% of the electorate. Younger voters skew heavily toward the Democrats. Also notable was that women break heavily toward Democrats by a 10 point gap—79% of women of color support Democrats; 58% of white women voted for Biden-Harris—and women make up 54% of the electorate overall.
News out of the private “recount” in Arizona by Cyber Ninjas, a company without experience in election recounts and whose owner has already gone on record as believing that rigged voting machines in Arizona cost Trump victory, continues to be embarrassing as well. Although the Maricopa County Board of Supervisors, which has a Republican majority, said the count was fair and opposed a recount, sixteen Republicans in the state senate voted to give the ballots for Maricopa County, which includes Phoenix, to the company for a private recount. The count has been plagued by conspiracy theories—one observer claimed they are examining the ballots for signs of bamboo in the paper to show that tens of thousands of ballots were flown in from Asia—and it turned out that one of the people recounting the ballots had been at the January 6 riot at the Capitol. Now the “recount” is running so far behind it appears it won’t be done until August, rather than May 14 as the company promised.
State senator Paul Boyer, who voted for the “audit,” told New York Times reporter Michael Wines: “It makes us look like idiots…. Looking back, I didn’t think it would be this ridiculous. It’s embarrassing to be a state senator at this point.”
And then, this morning, the Washington Post dropped a long, investigative story by reporters Emma Brown, Aaron C. Davis, Jon Swaine, and Josh Dawsey revealing that the arguments former president Trump has grabbed to “prove” the election was stolen from him were part of a long conspiracy theory hatched in 2018 by Russell J. Ramsland, Jr., “a Republican businessman who has sold everything from Tex-Mex food in London to a wellness technology that beams light into the human bloodstream.” The story follows how Ramsland’s theories, which were debunked as “bat-s**t insane” by White House lawyers, got pumped into the media by Representative Louie Gohmert (R-TX) and Trump’s lawyer Rudy Giuliani, among others, and how Trump came to embrace them.
While Republican leaders are still standing behind those theories, and the former president, opponents of the party’s direction are pushing back not just against Trump but also against those leaders supporting him. Representative Adam Kinzinger (R-IL) tweeted this morning: “A few days before Jan 6, our GOP members had a conference call. I told Kevin [McCarthy] that his words and our party’s actions would lead to violence on January 6th. Kevin dismissively responded with ‘ok Adam, operator next question.’ And we got violence.”
Representative Liz Cheney (R-WY) has narrated a video distributed by the Republican Accountability Project recalling the violence of January 6, blaming Trump for spreading lies about the election, and reminding viewers that more than 60 lawsuits disproved his claims that the election was stolen. The video says “we are the party of Lincoln. We are not the party of QAnon” (showing an image of Jacob Chansley, the so-called “QAnon Shaman,” who wore a horned headdress during the Capitol insurrection) “or white supremacy” (showing an image of Fox News Channel personality Tucker Carlson). “We cannot embrace insurrection” (showing a picture of Georgia Republican Representative Marjorie Taylor Greene). “President Trump provoked an attack on the United States Capitol which resulted in five people dying. That is a person who does not have a role as a leader of our party going forward.” The video features an image of McCarthy standing with Trump. Cheney made it clear she was not about to shut up.
This afternoon, McCarthy released a statement calling for Cheney’s ouster as conference chair, featuring the line: “[u]nlike the left, we embrace free thought and debate.” (References to George Orwell, who famously wrote about how fascists used language to rewrite history, were all over Twitter.) McCarthy and other Trump loyalists have suggested that Cheney needs to go because she keeps talking about the past, but Allan Smith of NBC News points out that Trump himself seems to be the one who cannot stop talking about the past.

Historical Hockey in Milwaukee
These days many of us are missing sports and our usual entertainment. To help fill that gap and to share some unique parts of Milwaukee history, I will be exploring historical sports teams in Milwaukee through a short series with the help of our extensive WTMJ collection (UWM Mss 203). First up is the now-defunct ice hockey team the Milwaukee Chiefs. The footage above comes from a game played between the Chiefs and the Grand Rapids Rockets on February 7, 1954. The game was played at Panther Arena to a crowd of 3,400 and ended with an 8-8 tie. The Chiefs’ coach that season was Louis Trudel, a former NHL player and two-time Stanley Cup winner with the Chicago Blackhawks in 1934 and 1938.
Both teams were a part of the International Hockey League (IHL). The League began in 1945 and continued until the end of the 2000-01 season. The 1953-54 season had 9 teams and ended with the Cincinnati Mohawks winning the Turner Cup, the League’s championship, against the Marion Barons. In the 1990s, several teams from the IHL became affiliates of National Hockey League (NHL) teams. Over the decade, the IHL declined as NHL teams began using American Hockey League (AHL) teams as affiliates. The League folded after the 2000-01 season and six teams, including the Milwaukee Admirals and Grand Rapids Griffins, moved to the AHL, continuing the League’s legacy.
The Milwaukee Chiefs lasted two seasons in the IHL (1952-54) with a final record of 28 wins, 90 losses, and 6 ties. They were Milwaukee’s second IHL team after the Milwaukee Clarks who played one season in the League (1948-49) before moving to the Eastern Amateur Hockey League (EAHL) for one season. The Chiefs were followed in the IHL by the Falcons (1959-60 and part of the 1960-61 season) and eventually the Milwaukee Admirals. The Admirals began in 1970 as an amateur team and didn’t join the IHL until the 1977-78 season, where they stayed until the League folded and they made the move to the AHL. The team has been the NHL affiliate of the Nashville Predators since 1998. Since the move to the AHL, they have won the Calder Cup (the League’s championship trophy) once in 2004; they finished this year’s COVID-shortened season at the top of the League with a record of 41-14-5-8 (W-L-OTL-SOL).
The Grand Rapids Rockets played 6 seasons in the IHL (1950-1956), after which they moved to Huntington, WV, becoming the Huntington Hornets. They only played one season in West Virginia before folding. They ended the 1953-54 season with a 29-32-3 record, missing the playoffs as 7th in the League. The Rockets were the first IHL team for Grand Rapids, they were followed for the 1977-78 season by the Dayton/Grand Rapids Owls and the Grand Rapids Owls from 1978-80. The city was without a team until the Grand Rapids Griffins joined the League, also accompanying the Admirals to the AHL in 2001. They were affiliated with the Ottawa Senators from 1999-2002 and have been the affiliate of the Detroit Red Wings since. They have won two Calder Cups in 2013 and 2017 and ended the current season third in the Central Division with a record of 29-27-3-4.

Interesting facts about the midterm elections ...
From the Cook Political Report
--After 2018, House Democrats will represent 78 percent of all Whole Foods Market locations (up from 65 percent today), but just 27 percent of all Cracker Barrel Old Country Store locations (up from 21 percent today). Of the 43 districts Democrats flipped from Republican control, 69 percent contain a Whole Foods Market.
--2018 was the first year in history Americans elected more than 100 women to the House of Representatives: Democrats increased their ranks of women from 61 to 89 (46 percent), while Republican women fell from 23 to 13 (43 percent). There will be 36 new women in the House, the highest number in history, eclipsing the previous record of 24 elected in 1992.
--Of the 62 Democratic freshmen joining the House, 35 are women (56 percent). Of the 30 Republican freshmen joining the House, just one, Carol Miller (WV-03) will be a woman (three percent).
--When the House convenes in January, 90 percent of House Republicans will be white men, compared to just 38 percent of House Democrats. This is the widest demographic gap in history. Currently, white males are 86 percent of House Republicans and 41 percent of House Democrats.
Offered without comment. There are 50 points in the linked report.
