Google is (still) losing the spam wars to zombie news-brands

Even Google admits – grudgingly – that it is losing the spam wars. The explosive proliferation of botshit has supercharged the sleazy "search engine optimization" business, such that results to common queries are 50% Google ads to spam sites, and 50% links to spam sites that tricked Google into a high rank (without paying for an ad):

It's nice that Google has finally stopped gaslighting the rest of us with claims that its search was still the same bedrock utility that so many of us relied upon as a key piece of internet infrastructure. This not only feels wildly wrong, it is empirically, provably false:

Not only that, but we know why Google search sucks. Memos released as part of the DOJ's antitrust case against Google reveal that the company deliberately chose to worsen search quality to increase the number of queries you'd have to make (and the number of ads you'd have to see) to find a decent result:

Google's antitrust case turns on the idea that the company bought its way to dominance, spending the some of the billions it extracted from advertisers and publishers to buy the default position on every platform, so that no one ever tried another search engine, which meant that no one would invest in another search engine, either.
Google's tacit defense is that its monopoly billions only incidentally fund these kind of anticompetitive deals. Mostly, Google says, it uses its billions to build the greatest search engine, ad platform, mobile OS, etc that the public could dream of. Only a company as big as Google (says Google) can afford to fund the R&D and security to keep its platform useful for the rest of us.
That's the "monopolistic bargain" – let the monopolist become a dictator, and they will be a benevolent dictator. Shriven of "wasteful competition," the monopolist can split their profits with the public by funding public goods and the public interest.
Google has clearly reneged on that bargain. A company experiencing the dramatic security failures and declining quality should be pouring everything it has to righting the ship. Instead, Google repeatedly blew tens of billions of dollars on stock buybacks while doing mass layoffs:

Google wormed its way into so many corners of our lives that its enshittification keeps erupting in odd places, like ordering takeout food:

Back in February, Housefresh – a rigorous review site for home air purifiers – published a viral, damning account of how Google had allowed itself to be overrun by spammers who purport to provide reviews of air purifiers, but who do little to no testing and often employ AI chatbots to write automated garbage:

In the months since, Housefresh's Gisele Navarro has continued to fight for the survival of her high-quality air purifier review site, and has received many tips from insiders at the spam-farms and Google, all of which she recounts in a followup essay:

One of the worst offenders in spam wars is Dotdash Meredith, a content-farm that "publishes" multiple websites that recycle parts of each others' content in order to climb to the top search slots for lucrative product review spots, which can be monetized via affiliate links.
A Dotdash Meredith insider told Navarro that the company uses a tactic called "keyword swarming" to push high-quality independent sites off the top of Google and replace them with its own garbage reviews. When Dotdash Meredith finds an independent site that occupies the top results for a lucrative Google result, they "swarm a smaller site’s foothold on one or two articles by essentially publishing 10 articles [on the topic] and beefing up [Dotdash Meredith sites’] authority."
Dotdash Meredith has keyword swarmed a large number of topics. from air purifiers to slow cookers to posture correctors for back-pain:

The company isn't shy about this. Its own shareholder communications boast about it. What's more, it has competition.
Take Forbes, an actual news-site, which has a whole shadow-empire of web-pages reviewing products for puppies, dogs, kittens and cats, all of which link to high affiliate-fee-generating pet insurance products. These reviews are not good, but they are treasured by Google's algorithm, which views them as a part of Forbes's legitimate news-publishing operation and lets them draft on Forbes's authority.
This side-hustle for Forbes comes at a cost for the rest of us, though. The reviewers who actually put in the hard work to figure out which pet products are worth your money (and which ones are bad, defective or dangerous) are crowded off the front page of Google and eventually disappear, leaving behind nothing but semi-automated SEO garbage from Forbes:

There's a name for this: "site reputation abuse." That's when a site perverts its current – or past – practice of publishing high-quality materials to trick Google into giving the site a high ranking. Think of how Deadspin's private equity grifter owners turned it into a site full of casino affiliate spam:

Money is one of the many sites whose air purifier reviews Google gives preference to, despite the fact that they do no testing. According to Google, Money is also a reliable source of information on reprogramming your garage-door opener, buying a paint-sprayer, etc:

All of this is made ten million times worse by AI, which can spray out superficially plausible botshit in superhuman quantities, letting spammers produce thousands of variations on their shitty reviews, flooding the zone with bullshit in classic Steve Bannon style:

As Gizmodo, Sports Illustrated and USA Today have learned the hard way, AI can't write factual news pieces. But it can pump out bullshit written for the express purpose of drafting on the good work human journalists have done and tricking Google – the search engine 90% of us rely on – into upranking bullshit at the expense of high-quality information.
A variety of AI service bureaux have popped up to provide AI botshit as a service to news brands. While Navarro doesn't say so, I'm willing to bet that for news bosses, outsourcing your botshit scams to a third party is considered an excellent way of avoiding your journalists' wrath. The biggest botshit-as-a-service company is ASR Group (which also uses the alias Advon Commerce).
Advon claims that its botshit is, in fact, written by humans. But Advon's employees' Linkedin profiles tell a different story, boasting of their mastery of AI tools in the industrial-scale production of botshit:

Now, none of this is particularly sophisticated. It doesn't take much discernment to spot when a site is engaged in "site reputation abuse." Presumably, the 12,000 googlers the company fired last year could have been employed to check the top review keyword results manually every couple of days and permaban any site caught cheating this way.
Instead, Google is has announced a change in policy: starting May 5, the company will downrank any site caught engaged in site reputation abuse. However, the company takes a very narrow view of site reputation abuse, limiting punishments to sites that employ third parties to generate or uprank their botshit. Companies that produce their botshit in-house are seemingly not covered by this policy.
As Navarro writes, some sites – like Forbes – have prepared for May 5 by blocking their botshit sections from Google's crawler. This can't be their permanent strategy, though – either they'll have to kill the section or bring it in-house to comply with Google's rules. Bringing things in house isn't that hard: US News and World Report is advertising for an SEO editor who will publish 70-80 posts per month, doubtless each one a masterpiece of high-quality, carefully researched material of great value to Google's users:

As Navarro points out, Google is palpably reluctant to target the largest, best-funded spammers. Its March 2024 update kicked many garbage AI sites out of the index – but only small bottom-feeders, not large, once-respected publications that have been colonized by private equity spam-farmers.
All of this comes at a price, and it's only incidentally paid by legitimate sites like Housefresh. The real price is borne by all of us, who are funneled by the 90%-market-share search engine into "review" sites that push low quality, high-price products. Housefresh's top budget air purifier costs $79. That's hundreds of dollars cheaper than the "budget" pick at other sites, who largely perform no original research.
Google search has a problem. AI botshit is dominating Google's search results, and it's not just in product reviews. Searches for infrastructure code samples are dominated by botshit code generated by Pulumi AI, whose chatbot hallucinates nonexistence AWS features:

This is hugely consequential: when these "hallucinations" slip through into production code, they create huge vulnerabilities for widespread malicious exploitation:

We've put all our eggs in Google's basket, and Google's dropped the basket – but it doesn't matter because they can spend $20b/year bribing Apple to make sure no one ever tries a rival search engine on Ios or Safari:

Google's response – laying off core developers, outsourcing to low-waged territories with weak labor protections and spending billions on stock buybacks – presents a picture of a company that is too big to care:

I have about $275 worth of baby stuff in my cart that is *essential* for his first week of life. I also have about $140 worth of return credits on my Amazon account! The rest of the stuff I'm saving for people in my family who offer to buy something for baby, but if I don't have it for a while, it's fine.
I will order the stroller in a couple weeks when I have his other stuff organized in the closet, but for now I'm just ordering the car seat + base to have in the trunk ICE before 36 weeks.
Our guests check out on Wednesday, the 1st. We paid off 75% of our rent this month, and we are a new listing so we had to price it on the lower end. Very happy with that! When we signed our 13m lease, it came with 2 free months of rent and we put it towards January + February so that we can not worry at all about finances before/after he arrives. Then the last week of March there is Miami's biggest concert event of the year in our area (Ultra) and we will probably make like ~2.5-3x the rent for that week alone.
July + August we will probably spend in NY + take a mini family trip if I feel up for it. I'm thinking the PNW + maybe Vancouver. Or Toronto/Quebec if I'd like to make it a shorter trip.
Eeeek, I'm excited!!! Yes, it will be a hard year because bringing life into the world and sustaining it is hard. It's not supposed to be easy. But I have my village, my dream home, emotional support from several people, my husband and I have an amazing, local marriage therapist (she is so sweet, she said she would visit me in hospital after I recounted how sad I was when we were all alone with no one for Sky's birth because no visitors were allowed).
Kevin and I have a few really wonderful companies and when I am ready to step more out of my "mom" role and my kids are more independent, I know that I will do big things as a Birth Worker, on my own. I will fulfill *my* professional dreams. But this dream of having kids relatively young and staying home with them while they are under 3/4 yo is my life's greatest dream and this may be my last time experiencing it from the start. I want to soak it all in and not try to be a jack of all trades, so to speak.

12th July 1834 saw the death in Hawaii of Botanist, David Douglas.
As promised last month a more detailed account of this not so well known Scot.
David Douglas was born in the village of Scone on June 25, 1799, just north of Perth he is much better known in the US state of Oregon, where their state tree “The Douglas Fir” is named after him Douglas was the son of stonemason John Douglas and Jean Drummond. He attended local schools, and by the time he was eleven, he was working as a gardener for local landowners, the Earl of Mansfield and Sir Robert Preston.
While working at the Botanical Garden in Glasgow, he became acquainted with the garden’s curator, Stewart Murray, and British botanist Sir William Jackson Hooker. Douglas attended Hooker’s lectures and had access to private libraries. Hooker later described him as a person of “great activity, singular abstemiousness, and energetic zeal.”
In 1823, on Hooker’s recommendation, the Royal Horticultural Society chose Douglas as a botanical collector. The Society intended to send Douglas to China, but arrangements fell through so he ended up going to eastern North America. In 1824, he found passage on a Hudson’s Bay Company vessel, the William and Ann, and arrived in Fort Vancouver on the Columbia River on April 7, 1825. Among his duties were keeping a journal of his activities and collecting seeds and plant specimens that might be useful as horticultural plants in England. Douglas visited North America four times, three times to the Pacific Northwest and California to look for plants, particularly fruit trees, forest trees, and oaks.
On his 1826 trip to present-day Oregon, Douglas took careful notes on the local vegetation as he traveled up the Willamette Valley. On September 30, he recorded one of the earliest descriptions of the Indian use of fire: “Most parts of the country burned; only on little patches in the valleys and on the flats near low hills that verdure is to be seen. Some of the natives tell me it is done for the purpose of urging the deer to frequent certain parts, to feed, which they leave unburned, and of course they are easily killed. Others say it is done in order that they might the better find wild honey and grasshoppers, which both serve as articles of winter food.“
In October, he traveled farther south to near present-day Roseburg on the Umpqua River, primarily to collect the cones of the sugar pine . On October 26, he described an encounter with a local man who led him to the “long-wished-for pines.” While shooting the cones out of a tall tree, which Douglas described as hanging at the tips of branches “like small sugar-loaves in a grocer’s shop,” he attracted several Natives who seemed “anything but friendly.” After a tense standoff, one man indicated that they wanted tobacco, and Douglas responded that he would oblige them if they brought him more cones. The men went in one direction, and Douglas with three cones and a twig went in another.
Douglas was interested in all aspects of the landscape, including animals. Those named in his honour range from the pigmy short-horned lizard to the Douglas squirrel ( . He shipped a number of specimens home for examination by leading scientists. Some species, such as the mountain beaver , were new to science. Douglas also reported seeing—and shooting—California condors on the Columbia River.
In 1827, Douglas traveled through the Northern Rockies and then to York Factory on Hudson Bay before returning to London. He worked on his collections until October 1829, when he again traveled to Fort Vancouver. He spent time on the California coast in 1831-1832, collecting plants and animals and making geographic observations. In 1832, on his return to the Columbia River, he made his first visit to the Hawaiian Islands. He explored the Fraser River district in 1833 and left the Northwest on October 18, 1833, for a return trip to the Hawaiian Islands and a planned return to London.
Douglas had been intrigued by Hawaii and wanted to continue collecting. Unable to get prompt transportation to England, he spent extra time in the islands. It was there, on July 12, 1834, that he met his end,apparently trampled by a bullock in a deep pit designed to capture cattle, although foul play has been suspected.
Douglas introduced more than two hundred Pacific Northwest plants home, many of them important in our gardens today, including Oregon’s red-flowering currant.
At Scone Palace, near Douglas’s birthplace, stands a magnificent Douglas-fir, grown from seed that he sent back from western North America in 1826. His introduction of Sitka spruce to Britain forms the basis of that country’s modern conifer forestry.
Douglas was a tireless botanist and natural historian whose name is honoured in more than eighty species of plants and animals. David Douglas High School in Portland is named for him, a peak in the Rockies as well as numerous plants, are also named after him.

Nick and Lisa met in 1984. Lisa was a 29 year old hairdresser at Yakoi Hair Design in Vancouver, BC, Canada. Nick was 45-46 year old accountant director at the Bank of Montreal, and was one of Lisa's clients. The pair got married, both having been previously married before, and lived in North Vancouver.
In January 1994, Nick retired at the age of 55, after working in the field for 35 years. He was also a director of a company that traded on the Vancouver Stock Exchange. Nick's daughter later said that her father often shared details of his life and work with others.
Nick and Lisa travelled often, visiting places such as Hawaii, the Cayman Islands and the Netherlands. Nick made about $85,000 a year, which was good money. He had savings and both him and Lisa had passports from different countries.
In 1994 however, Nick and Lisa began acting strange to those around them. The two went on a trip to the Cayman Islands and in April with no warning, the two set up a bank account with $50,000 worth of stock, also drawing up wills.
Nick made a call to his daughter, who was living in Holland at the time, telling her that he wouldn't be able to call her on her birthday. Nick did not tell her where he was or really provide any explanation.
On August 10, 1994, Nick and Lisa told multiple people they were going to Trader Vic's, a popular restaurant at the Bayshore Inn in Coal Harbour. Nick was apparently going to discuss a $10 million business deal with an investor whose name and identity remains unknown to this day.
Supposedly, Nick told his business associates that this investor was sending a limo to pick up him and Lisa at their home. No one else had any information about the meeting.
However, what's strange is that no one showed up to the restaurant or cancelled. It was weird for Nick to not call and cancel if he was not planning to show. A witness came forward and in 1995 it was revealed that Nick and Lisa had been seen next door, at the Westin Bayshore's Garden Lounge, from 6:30-10:30 pm that day. Nick was reportedly wearing a jogging suit and the two were splitting a bottle of wine.
On August 11, 1994, Lisa's 39th birthday - Lisa made two calls from Nick's cell. She called her boss, and one of Nick's associates. She said they would be out of town for a couple of days. No one has ever heard from them again.
Within a week, Lisa's sister decided to go to the Masee's house and found Nick's car in the driveway. The front door was closed but unlocked. The alarm system was disabled, which Lisa's sister said was strange and not like them. The Masee's cat was inside the home, and their passports. Two zip ties were found at the entrance.
RCMP believed that Nick and Lisa were either victims of foul play, or they had orchestrated their own disappearance.
There is no evidence that supports either theory. In July 2019, Nick's children and the RCMP held a press conference asking for any information about the couple's disappearance to be brought forth. There was a reward for $50,000. Investigators believe Nick and Lisa were killed for unknown reasons.

Lisa Mo Masee was born on August 11, 1955. She is 5'6 in height and weighed 130 lbs. She is Asian with black hair and brown eyes. Her maiden name is Mo Yin HO. She speaks both English and Mandarin.
Nicholas Gerard Jacques Masee was born on January 12, 1939. He was 5'7 in height and weighed 160 lbs. He is a white male with greying blonde hair at the time of his disappearance and blue eyes. He speaks English and Dutch.
If Nick is still alive today he would be 85 years old. If Lisa is still alive today she would be turning 69 years old.

On January 18, 2023, as thousands of Peruvians were taking to the streets in Lima to denounce the spiralling political crisis in the country, Canadian Ambassador Louis Marcotte was meeting with the Peruvian Minister of Energy and Mines.
Protests have been ongoing since December [2022] [...]. Demonstrators have been met with widespread arrests and brutal violence. According to Yves Engler, since [protests began] [...] the Canadian mission has met with numerous top-level Peruvian officials in unprecedented fashion. [...] Ambassador Marcotte tweeted several photos from the meeting, using the occasion to promote mining as a benefit for communities and to express Canadian support for the upcoming Peruvian delegation who will attend the Prospectors and Developers Association of Canada’s (PDAC) annual conference in Toronto from March 5 to 8. Each year, the world’s largest mining convention draws tens of thousands of industry experts, company officials, and government representatives to talk industry trends and promote an expansion of mining -- with little concern for the consent of those most affected, including in Peru. For years, MiningWatch Canada and the Justice and Corporate Accountability Project (JCAP), alongside organizations including Red Muqui, Cooperacción, Derechos Humanos Sin Fronteras-Cusco and Derechos Humanos y Medio Ambiente DHUMA, have documented the many harms caused by industrial large-scale Canadian mining to rural communities, as well as the associated police violence that often accompanies the imposition of these projects. [...] [T]he systematic and often violent exclusion of Indigenous, peasant and rural peoples from the political economic system, as well as the legacies of land dispossession and contamination, are indeed linked to centuries of extractivism.
The ambassador’s tweet has to be taken within a context of centuries of colonial and decades of post-colonial violence against rural peoples at the behest of resource extraction. These harms are not minimal: contamination of agricultural lands and waterways around Pan American Silver’s Quiruvilca mine and the criminalization of community leaders and land dispossession due to environmental contamination at Shahuindo; violation of Indigenous self-determination and the right to a clean environment around Plateau Energy’s proposed lithium and uranium mine, sitting atop the region’s most important tropical glacier; undercutting of economic benefits for communities most affected by mining operations, and more.

Yet the Canadian embassy in Peru has a track record of ignoring the concerns of human rights and environmental defenders affected by Canadian mining projects in the country -- even ignoring the concerns of Canadian citizen Jennifer Moore who was detained in 2017 by Peruvian police while screening a documentary film with Quechua communities affected by Hudbay’s Constancia mine. Moore, who was subsequently banned from re-entering the country [...], is the focus of a recent report by the Justice and Corporate Accountability Project (JCAP) on the role of Canadian embassies in prioritizing the interests of Canadian mining companies at the expense of their own policies and commitments regarding the protection of human rights defenders. But it should be made clear: when the [Canadian] embassy chooses to promote mining in Peru during PDAC, it is doing so knowing the reality of what these activities mean for people who are facing ongoing threats, intimidation, and explicit state-sponsored violence.

CDA 230 isn't a gift to big tech. It's literally the only reason that tech companies don't censor on anything we write that might offend some litigious creep. Without CDA 230, there'd be no #MeToo. Hell, without CDA 230, just hosting a private message board where two friends get into serious beef could expose to you an avalanche of legal liability.
CDA 230 is the only part of a much broader, wildly unconstitutional law that survived a 1996 Supreme Court challenge. We don't spend a lot of time talking about all those other parts of the CDA, but there's actually some really cool stuff left in the bill that no one's really paid attention to:

One of those little-regarded sections of CDA 230 is part (c)(2)(b), which broadly immunizes anyone who makes a tool that helps internet users block content they don't want to see.
Enter the Knight First Amendment Institute at Columbia University and their client, Ethan Zuckerman, an internet pioneer turned academic at U Mass Amherst. Knight has filed a lawsuit on Zuckerman's behalf, seeking assurance that Zuckerman (and others) can use browser automation tools to block, unfollow, and otherwise modify the feeds Facebook delivers to its users:

If Zuckerman is successful, he will set a precedent that allows toolsmiths to provide internet users with a wide variety of automation tools that customize the information they see online. That's something that Facebook bitterly opposes.
Facebook has a long history of attacking startups and individual developers who release tools that let users customize their feed. They shut down Friendly Browser, a third-party Facebook client that blocked trackers and customized your feed:

Then in in 2021, Facebook's lawyers terrorized a software developer named Louis Barclay in retaliation for a tool called "Unfollow Everything," that autopiloted your browser to click through all the laborious steps needed to unfollow all the accounts you were subscribed to, and permanently banned Unfollow Everywhere's developer, Louis Barclay:

Now, Zuckerman is developing "Unfollow Everything 2.0," an even richer version of Barclay's tool.
This rich record of legal bullying gives Zuckerman and his lawyers at Knight something important: "standing" – the right to bring a case. They argue that a browser automation tool that helps you control your feeds is covered by CDA(c)(2)(b), and that Facebook can't legally threaten the developer of such a tool with liability for violating the Computer Fraud and Abuse Act, the Digital Millennium Copyright Act, or the other legal weapons it wields against this kind of "adversarial interoperability."
Writing for Wired, Knight First Amendment Institute at Columbia University speaks to a variety of experts – including my EFF colleague Sophia Cope – who broadly endorse the very clever legal tactic Zuckerman and Knight are bringing to the court.
I'm very excited about this myself. "Adversarial interop" – modding a product or service without permission from its maker – is hugely important to disenshittifying the internet and forestalling future attempts to reenshittify it. From third-party ink cartridges to compatible replacement parts for mobile devices to alternative clients and firmware to ad- and tracker-blockers, adversarial interop is how internet users defend themselves against unilateral changes to services and products they rely on:

Now, all that said, a court victory here won't necessarily mean that Facebook can't block interoperability tools. Facebook still has the unilateral right to terminate its users' accounts. They could kick off Zuckerman. They could kick off his lawyers from the Knight Institute. They could permanently ban any user who uses Unfollow Everything 2.0.
Obviously, that kind of nuclear option could prove very unpopular for a company that is the very definition of "too big to care." But Unfollow Everything 2.0 and the lawsuit don't exist in a vacuum. The fight against Big Tech has a lot of tactical diversity: EU regulations, antitrust investigations, state laws, tinkerers and toolsmiths like Zuckerman, and impact litigation lawyers coming up with cool legal theories.
Together, they represent a multi-front war on the very idea that four billion people should have their digital lives controlled by an unaccountable billionaire man-child whose major technological achievement was making a website where he and his creepy friends could nonconsensually rate the fuckability of their fellow Harvard undergrads.
