Canada plans vaccine record for outside travel (AP) Canada’s immigration minister says fully vaccinated Canadians will soon be able to get a government document that will certify their COVID-19 vaccine history for the purpose of international travel. The document, expected to be ready by the fall, will be digital, with an option for those who cannot or do not want a digital certificate. Immigration Minister Marco Mendicino says it will include data on the type of vaccines received, the dates and the location.
A Spy For An Eye (CNN) Meng Wanzhou, the CFO of Chinese tech giant Huawei and daughter of the company’s billionaire founder, was arrested on December 1, 2018, in Canada over allegations Huawei violated U.S. sanctions against Iran. She has been held under house arrest in Vancouver and still faces extradition to the U.S. At the time, it was feared her case threatened to ramp up tensions between the U.S. and China. Sure enough, almost immediately after Meng’s arrest, two Canadian businessmen, Michael Spavor and Michael Kovrig, were detained in Beijing and charged with espionage. Spavor was a Beijing-based businessman who regularly traveled to North Korea. Kovrig is a former Canadian diplomat who worked for the International Crisis Group. Chinese officials have never disclosed any evidence against Spavor or Kovrig, or information relating to their trials, which were held behind closed doors in March. On Wednesday, over two years after being arrested, a Chinese court said Spavor had been found guilty of spying and illegally providing state secrets to foreign countries; he was sentenced to 11 years in prison. The court also said Spavor would be deported, but didn’t specify whether it would be before or after he served his prison sentence. Kovrig was accused of “stealing sensitive information and intelligence through contacts in China since 2017,” but authorities have yet to announce Kovrig’s verdict or sentencing.
Northwest sizzles as heat wave hits many parts of US (AP) Volunteers and county employees set up cots and stacked hundreds of bottles of water in an air-conditioned cooling center in a vacant building in Portland, Oregon, one of many such places being set up as the Northwest sees another stretch of sizzling temperatures. Scorching weather also hit other parts of the country this week. The weather service said heat advisories and warnings would be in effect from the Midwest to the Northeast and mid-Atlantic through at least Friday. In Portland, tempertures neared 100 degrees Fahrenheit (37.8 Celsius) on Wednesday and the mercury could soar past the century mark Thursday and Friday. Authorities trying to provide relief to vulnerable people are mindful of a record-shattering heat wave earlier this summer that killed hundreds in the Pacific Northwest.
California requires vaccines, tests for teachers and staff (AP) California will become the first state in the nation to require all teachers and school staff to get vaccinated or undergo weekly COVID-19 testing, as schools return from summer break amid growing concerns about the highly contagious delta variant, Gov. Gavin Newsom announced Wednesday. The new requirement affects California’s 320,000 public school teachers and tens of thousands of others—from cafeteria employees to cleaners and even school volunteers. Newsom had already issued a mask mandate that applies to teachers and students but until Wednesday had left the decision of whether to require vaccines up to local districts.
Cuban diaspora sends medicines to alleviate dire shortages (Reuters) Wheeling two trolleys piled high with medical supplies, Marilys Colarte waits at Madrid airport to take her precious cargo to Cuba, where vital medicines are running low. Colarte is part of a growing international network of volunteers from the Cuban diaspora who have been transporting tonnes of aid to the Caribbean island in recent months. Built under the late revolutionary leader Fidel Castro, Cuba’s universal public healthcare system is one of his revolution’s most treasured achievements but a deep economic crisis has seen shortages of medicines and other basic goods. The government largely blames U.S sanctions while its critics blame the inefficient state-run economy. Last month the shortages, along with power outages and a lack of civil liberties, prompted rare mass street protests. One of the measures the Cuban government took in response to the unrest was to allow travellers to bring in medicine, food and sanitary products without paying import duties. In the two weeks following that move, travellers brought in 112 tonnes of such goods via Havana international airport, Cuban customs said. Volunteers welcomed that move but said its impact was limited given the few flights operating to Cuba after the government restricted them due to the COVID-19 outbreak.
Chaotic start to Castillo’s presidency (Washington Post) At his swearing-in ceremony on the 200th anniversary of Peruvian independence last month, Peru’s first campesino president condemned the “racial regime” imposed by the conquistadors that continues to divide Latin American societies today. The leftist president, a 51-year-old former schoolteacher from rural Peru, insisted it was time to “break with colonial symbols.” But now, just two weeks into his historic presidency, Castillo’s inexperience, and his appointment to senior government positions of Marxist hard-liners, some implicated in criminality, have left this country that went through three presidents in one month last year once again on the brink of a political meltdown. The trigger came the day after Castillo’s inauguration, when he appointed 42-year-old Guido Bellido, a confrontational congressman from his Free Peru party, as prime minister, a position for which even many on the left say he is unfit. Bellido is the target of a criminal investigation for allegedly “defending terrorism” with social media posts sympathetic to the Shining Path, the Maoist extremists who killed at least 28,000 Peruvians. President Joe Biden’s administration slapped Belarus with new sanctions Monday, the anniversary of last year’s election in Belarus that was denounced by the opposition as rigged. The new U.S. sanctions target Belarus’ giant potash producer that has been a top revenue earner for the country, the Belarusian National Olympic Committee and 15 private companies with ties to Belarusian authorities. Foreign Ministry spokesman Anatoly Glaz on Wednesday denounced the U.S. action as “blatant and openly hostile” and announced the decision to rescind an earlier agreement for the appointment of Julie Fisher as the U.S. ambassador to the country.

Taliban press advance after capturing 2 major Afghan cities (AP) Afghanistan’s rapidly-advancing Taliban insurgents entered a western provincial capital, an official said Friday, hours after they captured the country’s second and third largest cities in a lightning advance just weeks before America is set to end its longest war. The seizure of Kandahar and Herat marks the biggest prizes yet for the Taliban, who have taken 12 of Afghanistan’s 34 provincial capitals as part of a weeklong blitz. While the nation’s capital, Kabul, isn’t directly under threat yet, the losses and the battles elsewhere further tighten the grip of a resurgent Taliban, who are estimated to now hold over two-thirds of the country and continue to press their offensive. With security rapidly deteriorating, the United States planned to send in 3,000 troops to help evacuate some personnel from the U.S. Embassy in Kabul. Separately, Britain said about 600 troops would be deployed on a short-term basis to support British nationals leaving the country, and Canada is sending special forces to help evacuate its embassy.
The Biologist Who Wasn’t (Foreign Policy) Chinese state media outlets are quietly removing references to a source named Wilson Edwards, a supposed Swiss biologist and U.S. coronavirus conspiracy whistleblower, after the Swiss Embassy publicly pointed out Edwards does not exist. Edwards appears to be the invention of a minor Chinese propaganda outlet, subsequently copied by others—a practice that is unfortunately common in the state media ecosystem. The fake source is part of a recent trend in Chinese state media to blame the coronavirus pandemic on a leak from Fort Detrick, the site of a key U.S. Army biological research laboratory. Those conspiracy theories have gained force in the media in recent months, partially in response to surged interest in Wuhan lab leak theories among the U.S. public and U.S. President Joe Biden endorsing further investigation. Theories that COVID-19 originated in the United States seem to have been successfully sold to much of the Chinese public; around 53 percent of those polled in March 2020 said they believed the virus was a U.S. bioweapon. During the COVID-19 Public Health Emergency, HHS has taken steps to make it easier to provide telehealth services. Telehealth — sometimes referred to as telemedicine — describes the use of 2-way communication technology for certain health care services.
We encourage health care providers to adopt and use telehealth as a way to safely provide care to your patients in appropriate situations, including: routine health care, like wellness visits; medication consultation; dermatology (skin care); eye exams; nutrition counseling; mental health counseling.

HIPAA flexibility during COVID-19
The HHS Office for Civil Rights (OCR) has issued guidance to empower health care providers to serve patients through telehealth during the national public health emergency.
HIPAA-covered health care providers may, in good faith, provide telehealth services to patients using remote communication technologies, such as commonly used apps – including FaceTime, Facebook Messenger, Google Hangouts, Zoom, or Skype – for telehealth services, even if the application does not fully comply with HIPAA rules.
However, providers should not use any platforms that are public-facing — for instance, Facebook Live, Twitch, and TikTok — to provide telehealth.

— Zillow Group co-founder and former CEO Spencer Rascoff joined the board of Palantir Technologies, a big data company backed by PayPal co-founder Peter Thiel.
The notoriously secretive Silicon Valley startup filed for an IPO this week. Journalist Alexandra Wolfe Schiff and early Palantir employee Alexander Moore, who is now a partner at 8VC, were also appointed to the board.
Rascoff, who stepped down as CEO of Zillow in early 2019, resigned from the Seattle-based real estate company’s board in April. He also stepped down from the board of Trip Advisor. Rascoff is an angel investor, co-founder of Los Angeles-based tech news venture dot.LA and working on a new stealth startup, according to a post on Twitter. Legal experts weigh in on Meng Wanzhou decision from B.C. Supreme Court

VANCOUVER — A loss in court for Huawei CFO Meng Wanzhou has prompted another round of legal arguments in her attempt to avoid extradition to the United States on fraud charges.
Associate Chief Justice Heather Holmes of the B.C. Supreme Court ruled Wednesday the charges Meng faces in America could also be a crime in Canada and the case should proceed, a decision that one legal expert says puts the rule of law above political pressures.

"If you turn a blind eye in the favour of political outcomes, you're sacrificing the rule of law and then you do become subject to China's allegation or criticism that this is all political," said Robert Adamson, who teaches business law at the Beedie School of Business at Simon Fraser University.
Meng's arrest by the RCMP at the Vancouver airport in December 2018 placed Canada in the middle of rising tensions between the U.S. and China, and two Canadians, ex-diplomat Michael Kovrig and entrepreneur Michael Spavor, were detained in China nine days later. They remain in custody.
Meng is accused of misrepresenting Huawei's relationship with Skycom Tech Co. and making false statements to HSBC, putting the bank at risk of violating U.S. sanctions against Iran.
Her lawyers argued that Meng's conduct could not constitute fraud in Canada because it related to American sanctions that Canada doesn't apply, while the Attorney General of Canada told the court the fraud allegations could be argued without reference to the U.S. sanctions.
Justice Holmes found the U.S. sanctions are relevant to the issue of double criminality, but it wasn't enough to dismiss the case.
"The essence of the alleged wrongful conduct in this case is the making of intentionally false statements in the banker-client relationship that put HSBC at risk. The U.S. sanctions are part of the state of affairs necessary to explain how HSBC was at risk, but they are not themselves an intrinsic part of the conduct," she wrote in her decision.
"For this reason, I cannot agree with Ms. Meng that to refer to U.S. sanctions in order to understand the risk to HSBC is to allow the essence of the conduct to be defined by foreign law. Canada's laws determine whether the alleged conduct, in its essence, amounts to fraud."
A broad definition of double criminality helps avoid unforeseen consequences, said Adamson, a member of the Canadian Bar Association.
He said a narrower definition of double criminality could stop extradition hearings at preliminary junctures and limit Canada's ability to extradite as well as ask for someone to be extradited here.
Vancouver extradition lawyer Gary Botting took a different view, saying Justice Holmes's ruling creates a "hybrid" way of looking at double criminality by importing some, but not all of the context of the U.S. sanctions.
The Supreme Court of Canada has made plain that they prefer to say, "fraud is fraud, theft is theft," said Botting, adding that's "more or less what Holmes has followed."
However, by importing some, but not all of the context of the sanctions, Botting said Justice Holmes "made a mistake of the law."
"It can't be both ways. In other words, this is an appealable judgement, in my view."
In the next phase of the proceedings, the court will hear arguments about whether Meng's arrest was unlawful.
Her lawyers have alleged the Canada Border Services Agency, the RCMP and the Federal Bureau of Investigation conducted a "covert criminal investigation" at the airport and violated Meng's charter rights.
Border officers seized Meng's cellphones, tablet and other devices and wrote down her passcodes, which were then handed to the RCMP.
The Crown has told the court that when the border agency learned of its mistake it told the RCMP that the codes couldn't be used or shared because they were obtained during the agency's examination.
It said officials followed the law and there's no proof that Meng was illegally arrested.
Botting said he believes Meng's rights were violated.
"Whether that amounts to a stay of proceedings or not is entirely, again, up to the judge."
Adamson disagreed, saying he hasn't seen "any strong evidence" of her rights being violated, and from what he understands, that argument from her defence team isn't as strong as the double-criminality argument was.
"That is, if Ms. Meng and her defence team had a better change of this case coming to a conclusion it was more likely to be on the double-criminality issue and not on this abuse of process," he said.
Canada's Justice Minister David Lametti will still have the final say on whether Meng should be extradited to the U.S.

Huawei CFO Meng Wanzhou Goes to Canada Court to Fight US Extradition

A senior Huawei executive whose arrest in Vancouver led to a breakdown in Canada-China relations headed to court on Monday to fight extradition to the United States.
Meng Wanzhou, the company’s chief financial officer and eldest daughter of its founder Ren Zhengfei, is wanted by US authorities for alleged fraud.
In order to secure her freedom, the “princess of Huawei” must convince a Canadian judge that the US charges – linked to alleged violations of US sanctions on Iran – would not stand up in Canada and are politically motivated.
The US alleges Meng lied to HSBC about Huawei’s relationship with its Iran-based affiliate Skycom, putting the bank at risk of violating US sanctions against Tehran.
“Simply put, there is evidence she deceived HSBC in order to induce it to continue to provide banking services to Huawei,” the justice department said in court filings.
Meng has denied the allegations. She has been out on bail, living in one of her two Vancouver mansions for the past year, awaiting trial.
The justice department will say in arguing for her extradition that the US accusations against Meng would be considered a crime in Canada if they had occurred there. This is a key test known as double criminality.
Her lawyers, however, will counter that the misrepresentations do not amount to fraud, but rather are an attempt by the United States to enforce its sanctions against Iran — which Canada has not matched.
Caught up in US-China row Meng’s arrest during a Hong Kong-to-Mexico flight stopover in December 2018 put the 47-year-old at the centre of the US and China’s battle over the technology giant’s growing global reach.
It also stuck Canada in the middle of a trade row between the world’s two largest economies, resulting in the arrests of two Canadians and restrictions on its agricultural shipments to China.
China’s “arbitrary detentions,” according to Ottawa, of former Canadian diplomat Michael Kovrig and businessman Michael Spavor on espionage suspicions, nine days after Meng was taken into custody, have been widely interpreted as retribution by Beijing aimed at pressuring Canada to free Meng.
China’s ambassador to Canada, Cong Peiwu, has said Meng’s release was a “precondition” for improved bilateral ties.
Ottawa, however, has maintained it will not interfere in the legal process.
The hearing is scheduled to last five days.
But if the US accusations are found to also be a crime in Canada, it will proceed to a next phase in June, when defense arguments that authorities conspired to nab Meng as part of a “covert criminal investigation” would be heard.
Later in the year, the court is also scheduled to weigh evidence in the US fraud case. Any appeals risk drawing out the proceedings for years.
According to court documents, Huawei allegedly controlled the operations of Skycom in Iran. Its staff used Huawei email accounts and security badges, and its bank accounts were controlled by Huawei, the Crown said.
But Meng told HSBC executives in a presentation in 2013 that Huawei no longer owned Skycom and that she had resigned from Skycom’s board.
From 2010 to 2014, HSBC and its American subsidiary cleared more than US$100 million worth of transactions related to Skycom through the US.
Stunting Huawei’s rise Ren Zhengfei has suggested that the case is part of a US plot to crush Huawei, which it sees as a security risk.
Founded by the former People’s Liberation Army engineer in 1987, Huawei has grown into one of the world’s biggest technology firms.
Meng is “like a small ant caught between the collision of two giant powers,” Ren told broadcaster CNN.
Prime Minister Justin Trudeau, who’d hoped when he came to power in 2015 to deepen Canada’s economic ties with China, prevailed on the US for help.
He told broadcaster TVA last month that he urged US President Donald Trump not to finalize a trade deal with China “that doesn’t settle the question of Meng Wanzhou and the two Canadians.”
Trump still went ahead and signed a “phase one” trade deal with China last week.
Former Canadian prime minister Jean Chretien and his ex-deputy John Manley, meanwhile, have urged Trudeau to simply release Meng in a “prisoner swap” for Spavor and Kovrig, in order to normalize relations with China.
That, however, risks legitimizing Beijing’s “hostage diplomacy” tactics, according to leading extradition experts consulted by AFP.
