Before I started writing here again, I tried to write something else, somewhere else, for about two years. Let's do an inventory.
That's what I wanted to say, at least. I was going to give you an inventory of my failed projects. Instead, I started writing up the first item on my list. And that's where I stopped.
I was going to write something up on the "equal protection component" of the Fifth Amendment's Due Process Clause. See, e.g., Bolling v. Sharpe, 347 U.S. 497, 499 (1954); Schneider v. Rusk, 377 U.S. 163, 168 (1964); United States v. Valleo Madero, 596 U.S. 159, 166 (2023) (Thomas, J., concurring).
I had even read up on some of the literature. See generally Richard A. Primus, Bolling Alone, 104 Colum. L. Rev. 975 (2004); Ryan C. Williams, Originalism and the Other Desegregation Decision, 99 Va. L. Rev. 493 (2013). See also Daniel Farber & Suzanna Sherry, The Pariah Principle, 13 Const. Comment. 257 (1996).
I was explaining to a friend that the affirmative action case, Students for Fair Admissions, Inc. v. President & Fellows of Harvard College, 600 U.S. 181 (2023), turned on structural questions that none of the opinions really spoke to.
But I don't reach any of that in this post. Not the equal protection component. Not the affirmative action case. Not the structural questions, at least not directly. I got stuck earlier than that. I got stuck on maybe the most basic question of all.
Why do we even have two Due Process Clauses?
I.
The United States Constitution, a little instrument of seven articles and twenty-seven amendments, has two Due Process Clauses and one Equal Protection Clause.
The first Due Process Clause provides that "No person shall ... be deprived of life, liberty, or property, without due process of law." That's the Fifth Amendment. The second provides that "No State shall ... deprive any person of life, liberty, or property, without due process of law." That's the Fourteenth.
The Fourteenth is also what gives us the equal protection of the laws. "No State shall ... deny to any person within its jurisdiction the equal protection of the laws." But set that aside for now.
At first impression, the Fourteenth Amendment's Due Process Clause almost seems superfluous. No person means no person. If no person shall be deprived of life, liberty, or property, it follows that no State shall deprive them of it. The Fifth Amendment takes care of everything, doesn't it?
But however general its "[n]o person" language reads on first impression, we take the Fifth Amendment to bind only the United States, not the several States. That's what the Court told us in Barron v. Mayor of Baltimore, 32 U.S. (7 Pet.) 243, 247 (1833), at least. It's what we tell ourselves today, if we care to think about it. It's why we have the Fourteenth Amendment.
II.
At the time, the Constitution was generally taken as an instrument addressed to the United States, not the several States. (That's the Barron idea, at least.) It spoke to the United States, not the several States. It was something more than a treaty, but something less than a full constitution.
The Constitution sets up the United States an imperfect sovereign, with an imperfect power over its territory and people. The Constitution left the several States more or less as they were, but set up a United States, separate and paramount, with a controlling power over the several States' territory and people within the scope of the United States' own imperfect sovereignty.
But it's not the imperfection that makes the Constitution something less than a full constitution. It's the silence. It's that the Constitution leaves the several States more or less as they were, without saying what they can do or how they can do it.
The Constitution leaves the several States not just as imperfect sovereigns, but as uncertain ones. The several States can do as they please with whatever the Constitution has not denied them, unless the United States steps in. But the Constitution doesn't say more than that. It doesn't even quite say that. It's not for them.
The Constitution always speaks to the United States, and always binds it, but it only speaks to the several States when it expressly addresses them. That's when it binds them. That's Barron. And that's how we read the Fifth Amendment.
It doesn't expressly address the several States, so it doesn't bind them. When it says "[n]o person shall ... be deprived of life, liberty, or property, without due process of law," it's only talking to the United States.
The several States don't have to read that bit.
III.
That conclusion wasn't universal. Some thought that the Constitution did bind the several States, even when it didn't expressly address them. Some thought that those parts of the Constitution were always binding, but only enforceable against the several States by the States themselves.

That conclusion left the United States without the power to enforce the guarantees of the Fifth Amendment against the several States. That conclusion was acceptable in practice, even for skeptics of the prevailing reading of the Constitution, as long as the several States guaranteed and enforced the same rights themselves.
But as States denied what were taken to be fundamental rights, as Southern states did during Jacksonian controversies over antislavery speech and the antislavery press, Northern opinion, and especially the advanced part of Northern opinion that came to constitute the Republican Party, turned against that conclusion.
Republicans came to feel that the United States should have some power to enforce the Constitution's guarantees against the several States, in the several States, even if only in extremis. And so they gave us the Fourteenth Amendment.
And that's why we have two Due Process Clauses.

Assault, Attempted Assault
In January 2023, a beefy fitness model who stabbed his roommate more than a dozen times in a fit of rage was sentenced to eight years behind bars for the sensational 2018 attack.
Geoffrey Tracy, 30, learned his fate nearly four years after he came at his rental host Gregory Kanczes with a knife, leaving the then-50-year-old man covered in blood in his Hell’s Kitchen pad.
“It is only by the grace of god that I survived your assault that nearly ended my life,” Kanczes said in a victim impact statement read aloud during the hearing in Manhattan Supreme Court.
Justice Curtis Farber cited cellphone footage of the Aug. 14, 2018 crime as he sentenced Tracy — who was convicted at trial of assault and attempted assault the month before — saying he was disturbed by the sight of “a man literally having been assaulted by Mr. Tracy.”
Prosecutors initially sought 10 years in state prison, in addition to five years supervised release, while the defense argued that five years incarceration was sufficient. Tracy, of Gilroy, Calif., was eventually handed an eight year term on the assault conviction and a sentence of up to four years for attempted assault, to run concurrently.
The stabbing frenzy occurred just days after Tracy, then 25, moved to New York to dance at a strip club.
Prosecutors said the bodybuilder attacked Kanczes 16 times with a knife after accusing him of going through his belongings.
Tracy, who initially fled the scene and disposed of the knife, plead not guilty to charges of second-degree attempted murder and first-degree assault in Sept. 2018.
The prosecutor cited Tracy’s alleged steroid use, noting that he made money by dealing performance-enhancing drugs at the time of the attack.
Tracy, who looked noticeably less muscular in his khaki jail clothes, was supported in court by his father, Thomas Tracy, his girlfriend, Shawley Henderson, and his employer Alex Larson.

headcanons regarding the man over there + some others
When I wrote this fanfic of TMOT's perspective of the beginning of the Jellicle Bal and this semi-related fic that includes Old Possum lore, I also wrote half-baked headcanons for him and others as minor background/character details. I ended up expanding on them, and I like what I came up with.
The Man Over There
Name: Thomas [Frank] Stephens. He doesn’t like it when people call him Tom or Tommy, unless said people are family or his close friends.
Age: ~40
Family: Younger sister Anne (~36, nurse), and his mother Esmé (~74, retired actress). Anne has a cat, Apricot. Thomas considers Apricot family, depending on who he’s talking.
Occupation: Veterinarian. Thomas enjoys taking care of animals and seeing their owners’ happy faces (if the owners are pleasant and actually care for their pets).
Due to being a vet, Anne jokingly asks Thomas if she ever goes to his workplace, he should give her a discount (Anne actually takes Apricot to a different vet clinic).
Is the man who threw the boot down during Jellicle Songs for Jellicle Cats. How did Thomas get the flat that resides over/near the Junkyard? The price was a steal and affordable, sold to Thomas by Mr. Farber, a Man in White Spats…
Frequents pubs. Main two are The Victoria and Westminster Arms (but Thomas met Mr. Faber at The Princess Louise). At any pub, he asks for gin (neat), a gin fizz, gin and tonic, or a Freddie Bartholomew mocktail (he doesn’t care if he gets stares).
Originally wanted to be in theatre (acting, singing), but Thomas eventually realize it wasn’t for him. His preforming skills are as good as he was back in the days.
Headcanons Regarding The Man Over There's Sister, Anne
Name: Anne [Helen] Stephens. Anne doesn’t have a nickname. While her family does call her ‘Annie’ it’s said when the situation/topic is serious, or to help calm her down.
Age: ~36
Family: Older brother Thomas (~40, veterinarian), her mother Esmé (~74, retired actress), and cat Apricot [Jellylorum].
Occupation: Nurse. Anne told her family when younger due to her fear of blood, she will never work in a medical feel. Anne grew out of said fear, and here she is now.
Anne is something of a ‘no hesitating’ sort of person. She will do or jump into action without any second thought (most of the time).
Knows how to play the guitar and piano. Anne loves to play covers of pop songs, mainly from the 60s and 70s, though she can play older (and newer) songs if she tries.
Anne loves a good story, be it told to her at a pub or café, or reading said story in a book on the sofa or bed. Anne could be caught up in a book for hours if she doesn’t set an alarm that limits her reading time.
Anne is 100% certain Apricot is supernatural, having once her heard talk on a full moon.
Headcanons Regarding The Man in White Spats
Name: Faber [Andrew] Faber. Yes, his first name is the same as his last name. This is not a joke. There was a communication error between the nurse and his mother.
Age: ~80
Family: Younger sister Georgiana Verdure née Faber (~75, retired nurse, amateur singer), brother Henry (~70, retired banker, amateur artist/painter), brother-in-law, Elias Verdure (~76, retired retail purveyor of ales and beers, amateur chef), a nephew Isador (~41, took over his father’s job as purveyor of ales and beers), niece-in-law Jacqueline (~38, teacher), and one grand-nephew name Donaghue (~8, student).
Occupation: Currently working as an agent of small furnished flats and has yet to retired.
Owns the Junkyard that the Jellicles gather to and/or live and call home if strays. Old Deuteronomy knows of this fact, and is grateful for this.
Really enjoys eating fried gammon and peas. There’s something about the combination that Faber likes. Funny enough, this combination is the only way he’ll eat peas.
Loves hot air balloons since he was a child. Faber rides in a balloon once every year, even if it means he has to travel outside the city to do so.
Wears the white spats as a weird fashion statement from an argument he had with his siblings when children. Faber likes his title of ‘The Man in White Spats’ very much.
Faber is worried that the Junkyard is at risk of getting destroyed by outsiders. For the last few years, he been trying to find his replacement, but it’s been troublesome.
Faber thought about giving his title of replacement to Isador, but he lives outside of London. The traveling makes it an inconvenience.

What is a character?
This is a question I think about a lot. I don't have any answers to that question, however. Just questions, lemme use New Vegas t' pose these questions because I'm predictable as Hell like that.
We doubtlessly all agree that certain characters am characters: Edward 'Cesar' Sallow, Robert Edwin House, Benny, Craig Boone, Veronica Santangelo, Doc Mitchell and Jessup.
I deliberately brought up Jessup for the next question: is McMurphy a character?
What about characters who we only see dead, never alive, but have additional contexts? Like Sheriff McBain and his wife, General Martin Retslaf, Rangers Esteban Morales and his friend Jackson or Paladins Hughes and Fairbanks?
What about 'Blind' Luke and 'Sweet' Jill?
The dead prospectors who act as loot bags in some locations?
Are the Brotherhood Scouts who appear in Still in the Dark characters?
Is the Mitchell mentioned by Chris Haversam a character?
Is the Health Inspector mentioned by Corporal William Farber a character?
The Nameless Goodsprings Residents? Joe Cobb's Gang?
Is the act of implying a past experience with an unnamed person creating a character? Like are the people Cass says she punched for calling her 'Whiskey Rose' back in New California characters? The mercenaries Dr Thomas Hildern sent to Vault 22?
Is every NPC placed in the game of Fallout New Vegas, either alive or dead, named or unnamed, placed by hand or spawned at a spawnpoint from a template a character?
I could ask a thousand more questions. I could broaden the scope even further. Beyond New Vegas, beyond games to everything, but I think y'can see the questions that I keep in me head now.
Like I said, I dunno if there's answers. In me more extreme moments I declare a blanket 'Yes' to everything, but I'm never truly sure.
What is a character? What isn't a character? I don't bloody know.

The preliminary voting rounds are over!
Congratulations to our passing class of qualified seeds! The prelim master post has been updated to strikethrough all of our eliminated candidates, so that only our survivors remain. Check it out and give all of our winners a round of applause.
Some observations, from me, your poll-runner:
I was surprised on the very first day by the Hadrian Gang clinching second place for the ghoul in his two-qual prelim over Bruce Isaac! The Lonesome Drifter was the runaway favorite, but right away I was shown that I don't necessarily know who's the most popular.
Cpl. William Farber just barely pulled ahead of Lacey (who had a strong third for most of the poll) in the dead of night for that last qualifying spot in his round. Heartbreaking! Unless you're a fan of Cpl. Farber, which I was. Probably the most tense heat of the tournament so far!
In that same round, the Garrets had a roughly 40% share the entire poll, which doesn't sound like a lot until you consider that it was an eight-way prelim. That left, on average, a measly 8.5% for every other candidate if they all got even votes (they didn't). Definitely the most dominating lead in this whole prelim by that metric, I think.
Other crushingly dominant qualifiers include Violet; the most popular named Fiend character by a landslide; Troike, the only man in his qualifying bracket (the Omertas) who is neither a violent criminal or a rapist or both; and Marjorie, whose victory came as a significant final surprise for me in the prelims here on Tumblr, which I thought was the cannibalism transsexual eroticism website. Guess we run in different circles, voters! Or maybe we just play "Beyond the Beef" in our own way.
Finally, in the very first round, we all laughed and joked about the Angela Sweep, with Angela Williams getting a 90%+ lead on Thomas Hildern within minutes of the poll going live and never letting go. But folks, we hadn't seen nothing yet. There were many winners in the prelims, and there were even more losers, but there was only one ultimate loser. There is only a single character in this whole series of prelims who got not even a single vote: a big ol' goose egg, a fat zero, a little late addition to the numerical symbol chart brought to us by our friends in Arabia.
Congratulations to the least popular character in this entire tournament of minor Fallout: New Vegas characters: Captain Gilles, the NCR commanding officer at Bitter Springs!

Pediatric Cancer Research Foundation Announces Grant Recipients
In a July 2024 press release, the Pediatric Cancer Research Foundation (PCRF) announced that it had awarded 21 researchers grants. The researchers will receive over $1.9 million in grants, which will go toward developing breakthroughs in treating pediatric cancers. This year's recipients include researchers who have made groundbreaking innovations in pediatric cancer.
PCRF aims to fuel research that reduces the number of cancer-related childhood deaths. The organization funds research it believes will achieve the greatest result in addressing childhood cancers. The role that PCRF plays fills a gap for researchers who do not have a track record in discoveries and do not qualify for federal grants, which require the researcher to demonstrate they have preliminary data reflecting their research shows promise.
The PCRF will fund five new recipients and 16 researchers for ongoing projects this year. Most of the researchers are conducting their projects at world-renowned research institutes. Danielle Fragalla, CEO of PCRF, stated the review committee spent hours pouring over awardee applications to determine which projects had the most potential to advance children's cancer research. Furthermore, the organization was enthusiastic about helping research to expand understanding and find advanced methods for treating childhood cancers.
The criteria for selection, first and foremost, was that these projects had to have the chance to advance the prevention, diagnosis, or treatment of cancer and whether the researcher could jump from research to clinical application. The committee looked at the originality of the research idea and presentation clarity. They also considered the researcher's resources, such as patients and the research lab. Finally, the selection committee considered the researcher's experience, background, and investigator qualifications.
Awardees include Susan Brady-Kalnay, PhD, from Case Western Reserve University Hospital. Her research project uses magnetic resonance fingerprinting (MRF) to determine how immunotherapy treats pediatric brain tumors. Before the award, Dr. Brady-Kalnay and her team developed MRF technology that generates assessments in as little as 11 seconds. This invention is significant because, before, researchers had to wait lengthy times for imaging, with images generated not producing information on whether the progress of the tumor is related to treatment-induced side effects. This fingerprinting technology allows medical professionals to precisely track responses to therapies.
Maria Fareri's Children's Hospital's Mitchell Cairo, MD, was another 2024 PCRF Grant awardee. Dr. Cairo's project focuses on cancer genetics, tumor immunology, and childhood/adolescent-targeted treatments for hematological malignancies and tumors. Prior to the award, his team also focused on re-engineering immune cells for targeted immune therapies, stem cell biology, cancer stem cells, and regenerative therapy, among other related topics.
Brian Crompton, MD, from the Dana-Farber Cancer Institute, was approved for grant funding for his project on liquid biopsy treatment for pediatric Ewing sarcoma, a destructive bone cancer. He and his research team have developed an innovative technique for extracting and profiling tumor DNA using liquid cancer biopsy samples. This treatment is important to help physicians determine if patients are responding to treatments early, enabling them to modify treatment for better outcomes.
Children's Hospital of Philadelphia Research Institute's Thomas De Raedt, PhD, will use the PCRF award to advance his work on understanding glioma development pathways. Glioma cells are tumors found in glial brain or spinal cord cells. His research analyzes tumors, conducts cellular studies, and creates accurate mouse models.
Anat Erdreich, MD, PhD, from Children's Hospital Los Angeles, is an award recipient selected for her work in using DNA hypomethylating agents for high-grade pediatric glioma. In the preclinical stage, her work builds upon prior research that found a gene that inhibits the growth of several brain cancers. She also discovered that a drug used in low doses lengthens the survival rate in mice. Her work focuses on using this drug combined with other therapies to treat brain cancers in children.

Excellent drama, along with some very realistic dialog and some top-notch acting brings this title to the forefront of its niche. I guarantee you won’t figure out “who done it” until the very end. Definitely not a date night movie, or something to watch while the kids are around, but something perfect for a rainy afternoon flick with the guys.

Your Journalism project is submitted, it's nearly holiday. I'll be recapping some things, talk about next term, then we'll do a bit of practical work. Let's showcase your newspaper by making a mockup and GIF.
TASK 1: Please start by completing the feedback form here- it’s really useful for planning your projects.
TASK 2: Think of a target you could set yourself for improvement next term. Write it down on your phone or a piece of paper. We’ll discuss it in your 1-1.
TASK 3: Create mockups of your newspaper. Download the template file mockup and open in Photoshop. I would like 3x mockups for - keep your front page the same for all 3, but change the double spread each time (pick your favourites!). Consider changing the background colour if you like.
Each image should be saved as a separate JPG - you will end up with 3x JPGs in total.
TASK 4: Create animated GIF. You will need to upload your JPGs to the gifmaker website. Watch the video tutorial here.
Don't forget to save your GIF.
