Treasurer's Report

- $8700 of dues outstanding. Sheila will do some door-to-door collection, some members have a habit of waiting for that.

- We use Quickbooks, a desktop version that’s manually backed up. Quickbooks offers a cloud solution with automatic backups and ability to transfer between treasurers. It would cost $600/year. It would be quite handy, but we’re not feeling ready to commit yet.

Reserve Study

- Sheila has talked to Scott Nelson, our CPA, to get recommendations.

- Per her research, we’re not yet noncompliant. If cost would be >5% than our gross revenue, we would be exempt. However, it’s still a good idea to move forward with it.

Secretary Correspondence

- For directory, Cheri will put together the document and send digital copies to everyone we have email address for. Then, she’ll send doc to Brock to print and mail to members.

Report on the tank cleaning 

- Homeowner adjacent to tank and pumphouse were very nice, no problems at all.

- Cleaners said there was so little silt in the tank that it was hard to identify. We could probably switch to cleaning every 10 years. Tank is in excellent condition, hatch looks great. We will get a written report with photos soon.

- Advanced Diving Services, the company we used, was very professional, we should use them again.

End of Season maintenance: 

- All done Float relocation / Bathrooms closed / water shut off

In early June, that shouted invite might arise from a friend who just pulled up in front of your pad, itching to get going; or your friends up ahead holding the door open to a bar; or a foot-stomping kid a block away from a park yelling back at his parents.

By July it might be you yalping at someone taking too long to get out of the roller coaster seat so you can jump in; or maybe getting just a little exasperated that the next band at some outdoor show is taking a little long to get on.

But sure enough, around the last week of July, one of those infernal “Back to School” commercials come on the tube (which is really your fault, cuz why the hell are you sitting in front of a TV during the last week of July!), and you yell, “Oh, COME ON!” at the TV. So, essentially, the square world gives us from June to July to enjoy summer, before already kicking in with the, “Summer’s winding down...” jive. Even though technically summer doesn’t even begin until June 21 and doesn’t end until September 21.

We still have about a full month of summer, left, not counting the sizable Indian Summer that usually occurs here in NYC. (Oh, and it looks like mid-90s in NYC for the next three days, so there’s your “unofficial end of summer” for ya.)

So I was thinking it’d be fun to post an incomplete list -- tossed off like a t-shirt on the way to the water -- of favorite songs that have always exuded that massive “COME ON” in me when some killjoy wants to remind me before September 21 that “summer is almost over.” Pal, summer never ends in a Nikki & the Corvettes song.

Some of these songs are up, some down, some cracking open another cold can, some looking for a garbage bin on the way off the beach. The irony -- irony being the metaphysical embodiment of, “Sorry pal, summer does actually end” -- is that these songs all hold a kind of melodic melancholy in their middle somewhere, a swelling that is more sun setting than rising, the iridescent horizon of 8:13 p.m.

April 10, 2022 board meeting minutes

Agenda

Well access issue The people who purchased the house where the well is have restricted access to the area. We’ve collected our easement documentation to support our conversation with the owners in explaining that access must be retained. The home is in an area that is becoming incorporated, Rick G, the new president of their HOA, contacted Shorebrook board to ask for documentation on easements. FYI, some of the easements are on personal property, not real property, so doesn’t show up on title searches, which is why this might be coming as a surprise to owners. Making sure their HOA knows about the easements should reduce miscommunications in the future.

FYI water outage in winter Water went out a while ago. It was a short in the tank. A wire on one of the floats in the tank broke, causing a hard short. We don’t have an alarm system in place, but if we did it probably wouldn’t have caught this because of the type of short it was. Most alarms monitor electricity to panel or pump function. Right now, Jim McFarland is our “early warning system,” as he lives on high ground and is the first to notice decrease in water pressure. During this outage, we did learn a lot about our system. It’s been fully repaired and we expect no other problems like this.

Tank Clean-out We need to schedule a clean-out. Guys in scuba tanks go in and clean and inspect the inside of the tank. It’s supposed to be done every 3-5 years. Costs about $600. We use a team out of Klamath Falls, have used them a couple times before. ACTION: John S will call and schedule the cleaning, determine what kind of water outage members may see. ACTION: When scheduled, Cheri will post notice of the event at the post office bulletin board and via email list and website.

Pumphouse fencing ACTION: John E will get some pricing info for 8’ and 10’ sections of chainlink so we can have a good price estimate to fence in the pumphouse. We’re looking at 6’ tall chainlink. Motivation is to make clear that area should not be accessed by public. We don’t expect any bad actors, have only experienced people wandering into the area unaware.

Road Gravel We need to finish adding gravel to road access to second well site. ACTION: Jim will measure the area and estimate how much gravel it’ll take. Then we can consider type of gravel and budget for it.

Railing John E suggests we need a second railing on access road. Board feels that existing railing is sufficient.

Short term rental concerns Background: Our lawyer, Mr Dille, said our current bylaws and covenants do not prohibit short term rentals. The prohibitions on running a business out of a home do not apply to short term rentals. The bylaws do clearly state that “tenants are not guests,” and therefore tenants do not have access to the beach and other community amenities. The board does not have enforcement powers. Community members are responsible for enforcing each others’ behaviors. Shorebrook board is only responsible for water system and park.

Bylaws change. Maybe bylaws should be changed to explicitly prohibit short term rentals. Cheri says trying to explicitly make rules about what “short term rental” means gets very fuzzy. How do know who someone is, whether they’re paying to stay or are a friend of the owner? If we focus on the problematic behavior, which we already have rules against, we’ll have better outcomes. John E & Bill have concerns about “not knowing what kind of person will be next door to you” when short term rentals happen. Bob mentions that insurance (officers & board) cost may be impacted by allowance of short term rentals.

We need to put together proposed changes to bylaws to put to the vote in annual meeting. Whatever policy we vote to proceed with can be put to lawyer for editing into correct language. All members just need to vote on how to proceed. Cheri says main options are explicitly permit short term rentals, prohibit rentals to x days, or strengthen board authority to enforce problematic behavior (fines for noise complaints, etc).

Do we need other bylaw changes? If so, we should put them to vote an annual meeting as well. Better to do one large change at once, rather than changes every year.

One concern is charging for water usage by usage. ACTION: John S will talk to lawyer to see if a bylaw change would be necessary to start charging by usage.

ACTION: Send out link to website to members by email. Cheri will do, ask Sharon for list.

Proposals for bylaw changes: 1. minimum rental term of 29 days 2. no change to bylaws, permitting short term rentals 3. strengthen enforcement of existing rules on problem behavior (e.g. levying fines)

Sheila and Bob propose opening to comment period from members before the meeting. Use email list.

ACTION: Cheri send email to list of Shorebrook members (get list from Sharon, just members, not off plat water customers), giving 3 options listed above, soliciting input within a 30 day deadline. Attach latest bylaws to this email. Also solicit changes to bylaws. They must submit it in writing to the board, which can be accomplished by replying to email. Cheri will collate responses, make proposed changes to proposals, email to board for notification. Reminder: we must give members 30 days notice of items to be voted on before the meeting with voting.

Cheri motions that we follow this course of action, Jon E seconds, motion passes.

Process for communication to members moving forward? Website is best tool. Need info about issues (e.g. water outage cause and solution) as well as regular updates (e.g. when the float will be put out).

Storage tank replacement Note that in the long term (5-10 years), we need to replace our water storage tank. According to WA department of drinking water, the tank needs to be large enough to hold 120% of our peak usage, which is about 100,000 gallons. The first step will be to find a new location to put this tank, as the current space is not appropriate. Note that right now, we’re only using about 18%-20% of our water rights as permitted by the state.

We completed a short house sit in Hastings before touching base with our cousins in the Bay of Plenty, and now, up into the Coromandel. One of the great things about NZ is due to it’s small size you can switch up sights with a short half day drive.
