7 Questions to Ask a House Painter Before You Hire Someone You Sorely Regret

Primping your home for sale, or just trying to freshen it up a bit? Sometimes the only thing your house needs is a new coat of paint, in which case you have two options: do the painting yourself, or hire a pro.
Taking the do-it-yourself approach can help you save money, but it’s not right for everyone—especially for people who are looking to paint more than one room, says Katie Wethman, a Washington, DC–based real estate agent and founder of the Wethman Group.
Hiring a home painter also means you’ll wind up with a professional-looking finished product, which may be difficult to achieve on your own.
Of course, you want to hire the right painter—someone who will get the job done on time, charge a fair rate, and leave your home looking beautiful. To help you with your search, we’ve provided seven great questions you may not think to ask a home painter but totally should before you hire one.
1. Are you licensed and insured?
Conceivably, anyone who can pick up a paintbrush can paint a wall, says Frank Campanelli, a home painter in Farmington, CT. Professional painters, however, have a state-issued license. Though licensing laws vary by state, a licensed painter is held to higher standards and can be fined or sued by the state if he does a shoddy job.
Finding a home painter who has a comprehensive liability insurance policy, including workers’ compensation coverage, is also a must. This provides you with protection in the unfortunate event that your house gets damaged during the project or a worker gets injured on the premises.
2. What personal protection equipment do you use?
Even if painters have workers’ compensation insurance—which, once again, they absolutely should—the last thing you want is to have a painter get injured on your property. To mitigate that risk, professional painters are expected to wear safety equipment such as goggles, gloves, coveralls, and other garments or equipment designed to protect the wearer’s body from injury or infection.
3. Do you use subcontractors?
Many painting companies hire subcontractors (also called day laborers) instead of having their own full-time staff. Allowing subcontractors into your home, though, creates a number of risks. Background checks are often not performed on subcontractors. Many subcontracted painters work on flat—not hourly—wages, meaning they may not be as committed to doing the work efficiently as a full-time crew would. And, if any subcontractors go unpaid (say, by a careless or dishonest painting company), they can file a mechanic’s lien against your property, potentially require you to shell out extra money to pay for their services.
4. What kind of prep work is included in your quotes?
Generally, one-third of a high-quality paint job is spent on prep work—such as removing stains, caulking cracks, sanding rough wall surfaces, or repairing drywall, says Ryan Benson of Benson Painting Services, in Apple Valley, MN.
Some home painters, however, offer more intensive prep work than others—and some don’t offer any prep work at all. So, it’s important to find out what a painter will—and won’t—do to get your walls ready to be painted. And, if the painter does offer these services, do they cost extra?
Of course, tackling these tasks yourself can help you save money by cutting down on labor costs, since most painters charge an hourly rate—about $25 to $100 an hour on average—though some painters charge per room, says Reba Haas, a real estate agent with Team Reba of Re/Max Metro Realty, in Seattle.
5. Do you provide all of the supplies?
Generally, you’re responsible for purchasing your own paint, and the painter handles the rest of the operation. But, not always! Some home painters, particularly those who charge significantly lower rates to beat out their competitors, don’t provide basic supplies such as dropcloths, tape, or even brushes and rollers—and these expenses can add up if they’re coming out of your pocket. Painter’s tape—a must for masking off areas that should not be painted, like crown molding—alone costs about $7 to $10 for a roll of 60 yards.
6. Do you offer a warranty for your work?
Most paint manufacturers offer warranties—meaning they’ll fix any problems that were caused by their paint job, such as blistering, peeling, or flaking paint. Therefore, you want to select a painter who will guarantee his work. Painter’s guarantees typically last one to three years.
7. How will my furniture, fixtures, and floors be protected during painting?
News flash: Paint spills. Obviously, furniture should be covered and moved away from walls before painting begins—but what you want is a painter who’s going to take extra measures to protect your furniture, fixtures (e.g., chandeliers), and floors from spatters.
Simply placing newspapers on the floors isn’t enough, especially considering that heavy paint can seep through the paper. Thus, a good painter will use dropcloths, which will absorb any paint spills—giving you peace of mind.

The community’s borders are defined by Bryn Mawr and Peterson Ave. on the North, Montrose Ave. on the South, Ravenswood Ave. on the East and the Chicago River on the West. The are consist mostly of the single family and small multi-unit structures. Because we wanted to do some foundation planting before it got too cold, Ed scheduled us only about 10 days after we signed the deal. They did a terrific job for a better price than the other quotes I got. They even did some extra work at no charge to remove some paint off the brick where a gutter used to hang. A couple of neighbors stopped to complement us on how great the house looked. Then, my customer satisfaction got even better. We had a storm a couple days after the tuckpointing was done. The front gate post is bolted onto the front of the house and that cedar fence post snapped off. Of course they had not tuckpointed behind the fence post, so now that much lighter mortar color was exposed. So they came back at no charge within a week and tuckpointed that spot. My client and her siblings, also with impairments, were so happy with John from Edmar and selected him right off the bat, even though his estimate was higher than the other estimate they received. Edmar wound up giving them a discount, which made the cost come down a bit, which made the client happy. Not only did John and his crew offer to fix the roof, they were able to fix other things in the home, such as putting in drywall and painting the ceiling to seal the crack, installing two new light fixtures and two smoke detectors, installing a new screen door and fixing an old garage door that would not close properly and covering some holes in the wall. We asked John if he could select/purchase the light fixture/smoke detector and factor the cost into the contract, which he was able to accommodate, which made it so much more convenient for the client, who would have needed help to do such. While the work was being done, the client kept asking John for other things that they wanted fixed, which he did even though they were not in the contract. The other things were paid for separately, but this goes to show the company's ability to accommodate people with disabilities who do not understand how these things usually work. As her case manager, I am grateful for his patience, sense of humor and treatment of them as any other individual and for not taking advantage of them, as others might have done in this situation (and have done in the past). In my opinion, he and his crew went above and beyond and the client is very happy with the work and plan to use him again in the future, as I would. read less

I hired them to come and redo the siding, soffits, gutters, and downspouts on the addition of my 1927 Mediterranean-inspired brick Tudor in Highland Park. The workers were incredibly polite and cleaned up after themselves every day. They greeted me in the morning and said goodbye at the end of the day (with confirmation of next step/part of work plan). The work as far as we can tell is impeccable. The calking around the vertical seams and lengths of hardi board were very well done and even. I’m in the midst of a backyard renovation. Edmar Corp. made sure to check with the deck guys about some questions they had that might impact their job. The people in the office were really quick to respond to my emails and any questions. I’m also a good communicator, so I don’t usually have issues with this. Who knows if the good communication requires a good client. The work ended up better than I expected. For the past five days I had a crew of 5 working on my 3 story building in Chicago. I have to admit it was neglected and in a very bad shape since no work has been done on it for decades… it’s probably close to 100 years old. It’s a brick structure, with 3 chimneys that had holes in it and every time it rained my basement was flooding. There are 14 windows with steel beams that needed replacement due to heavy rust, this also involved partial rebuilding of walls above those beams. My last problem was the wall section that sticks above flat roof surface, I think they call it “parapet wall” or something, which has disintegrated almost completely and basically required full rebuilding. I just wanted to say “Thank you” for all the work that was done on my house and recommend Ed (the owner of EDMAR) to everyone looking for a good mason. read less

We had to reconstruct our brick and wrought iron fence after the garbage truck relocated it to the ground. It wasn't a huge project and many of the masonry companies we called wouldn't even come and give an estimate because "it wasn't worth it". We found Edmar on yelp and the experience was awesome from start to finish. When I called to schedule an estimate, Ed came to my house within 48 hours and arrived at exactly the time he said he would arrive. He thoroughly inspected the damage and found other damage that other masons had completely missed. We were provided a written estimate on the spot. When I called Ed to give the go ahead a few days later, he was able to get our job done that week. Once again, he arrived with his crew at exactly the time he had provided. The job was done perfectly within one day. Unfortunately, it is hard to find honest and trustworthy companies in construction. Edmar Corp. breaks every stereotype. I reviewed a number of companies and eventually settled on Edmar as they were clearly the most knowledgeable and the most experienced. I've found out the hard way that it's not always best to go with the cheapest proposal...had some contractors rebuild my chimney a while back only to have the mortar crack 5 years later (!!!) Edmar was not the cheapest, but you definitely get what you pay for, and when it comes to home repair, you want the job done right. I called to set up an appointment and Ed stopped by the next day to give me an estimate. I had some cracked bricks above my first story window and turns out the lintels needed to be replaced. Ed outlined how the job would be done and gave me an approximate amount of time it would take to complete (Turns out, he was right on target!) They replaced the lintels and rebuilt part of the wall using the same face brick as the rest of the house so it looked perfect. I cannot praise his workers enough--they were very competent, super respectful, and took the time to answer all of my questions. I will definitely be using Edmar again in the future. We needed some masonry repairs on our single family home in Lincoln Park and I called Edmar to give us a quote. Our chimney was in pretty bad shape—missing bricks and apparently a cracked concrete cap. Ed stopped by to check it out and told us that the chimney had to be rebuilt above the roofline. He counted the number of bricks needed, in addition to a new cap and replacement clay tiles. We got a great price and hired Edmar for the job. The crew that came out was very skilled and hardworking. My client and her siblings, also with impairments, were so happy with John from Edmar and selected him right off the bat, even though his estimate was higher than the other estimate they received. Edmar wound up giving them a discount, which made the cost come down a bit, which made the client happy. Not only did John and his crew offer to fix the roof, they were able to fix other things in the home, such as putting in drywall and painting the ceiling to seal the crack, installing two new light fixtures and two smoke detectors, installing a new screen door and fixing an old garage door that would not close properly and covering some holes in the wall. We asked John if he could select/purchase the light fixture/smoke detector and factor the cost into the contract, which he was able to accommodate, which made it so much more convenient for the client, who would have needed help to do such. While the work was being done, the client kept asking John for other things that they wanted fixed, which he did even though they were not in the contract. The other things were paid for separately, but this goes to show the company's ability to accommodate people with disabilities who do not understand how these things usually work. As her case manager, I am grateful for his patience, sense of humor and treatment of them as any other individual and for not taking advantage of them, as others might have done in this situation (and have done in the past). In my opinion, he and his crew went above and beyond and the client is very happy with the work and plan to use him again in the future, as I would. read less

Thus, it was no different with me when I asked Edmar to stop a leak that had ruined a bedroom. To do so, they had to remove the capstones of a parapet in the corner of my 4-floor townhouse. It require their building a scaffold to access the area and elevating all the materials needed for the repairs. When they were done, they had installed a waterproof seal, flashing, wicking -- all that had not been there before. With new mortar and properly sloped capstones (another improvement), they were done by 4pm. It was a one-day job! I'm very pleased with the work, the results, and the price. In order to attain inside look of the kitchen we wanted, we needed to brick some windows in and maybe move the door and also repair the chimney. I called a few companies on yelp and in discussing quote and scope of work, Edmar came out ahead, the owner met with my husband, he showed up very prepared with his ladder and binoculos to take a close look at the chimey and he had very great ideas as to which windows he will suggest we brick in and what to do with the door, he gave us a lot to think about in a good way, he also gave us the quote on site, who does that, it was fabulous, since we had previously talked to other companies, we felt good enough to sign the contract and have them start work immediately. He suggested replacing more than just the first few layers of the chimney and pointed out that the old ones will crumble soon underneath the new one. He moved our back door from off the kitchen to off the family room which we like so much better because we have more cabinet space now and he used some of the brick from the new opening to patch the old opening. He also tried his best to match the old brick, he did a pretty good job, so much that you wouldnt really know it from the outside unless it was pointed out. His guys were in and out in a jiffy. point is, although he wasn't the cheapest, he was the most thoughtful and we felt his job was quality without a doubt. He also did some crack repairs on the outside of our property, he removed the bricks and relayed them with morter, patching everything. The only thing was that there are some morter stains on a few bricks in that one area where they repaired the cracks that my husband is not happy about, and he point it out every day now. It came to our attention that there were leaks on the ceilings of the top floor apartments, and we called a number of contractors to come check out the situation. Ed fit us in for an emergency quote the next day. This was a rare find as most of the other contractors we called didn’t even bother getting back to us. After taking a look at our roof, Ed explained to us how serious the job was and how the damage came about. The firewall and the parapet wall were both in really bad shape and needed to be rebuilt. The firewall and parapet wall were both crooked and the bricks were loose. To stop the ceilings from leaking, we needed to have the roofing redone as well. Ed was very thorough with explaining how the repairs were going to be done and after comparing a few more bids, we decided that Edmar Corp was best suited to handle our repair needs. They were able to schedule a start date pretty quickly and were flexible about working on Saturday. The workers were very professional and took great caution about ensuring the safety of the surrounding buildings and set up tarps to prevent debris from getting around. They got the firewall and parapet wall up in a few days, and were even able to match the bricks of the parapet wall to the rest of the building. Ed called and checked in with us every couple days and let us know where they were in the process. Our condo association was very happy with the work and highly recommends Edmar. read less

Peter the project manager came out to our building to give an estimate, and answer all follow up questions before signing the detailed contract. Every person at Edmar responds to all calls, questions, and appointments quickly and are always on time. Once Peter walked us through the scope of work and came in with reasonable and fair pricing we signed with Edmar over four other companies we had gotten estimates from. When the work began, Edmar promptly got us the building permit, certificates of insurance and showed up on time every day. They replaced almost 500 bricks in our back stairwell, did extensive tuck pointing around the building, and major work on our chimney. The building is safer and in much better shape now! The work was done quickly, they always cleaned up after every work day, and were professional and polite. Any questions we had were answered immediately. They even came back to make sure we didn’t have any more concern areas, and did some touch ups in areas that had not been on the original scope of work. Edmar goes above and beyond to make sure their clients are happy, the work is done right, and that their pricing is fair. I had 4 other companies come to give me quotes on tuckpointing my house on all sides and they were the most competitive and in line with what I was looking for. My complaint is more with the communication aspect of things. Everything was good up until I sent the contract in. I had asked when they might be able to start when first sending the contract in and was told probably the next week. I heard nothing for the next week. I sent an email and asked again, being told they would let me know asap. I heard nothing for the next week and a half. I sent another email saying that if I could not find out when they would be able to come out, I would start looking for another contractor. I then heard back that it would likely be in 2-3 weeks. The next morning, people showed up outside my door. Fortunately, that ended up working out fine but there appears to be a lack of communication between people in the front office. I was called twice by people after the project was finished to find out how I wanted to pay my balance as well. So long story short, service good, communication needs some improvement. read less

I rarely write reviews unless I am really impressed. City inspectors came and identified issues with the tuck-pointing and window lintels so I did some calling around to get some estimates. Ed showed up right on time for the appointment which was much appreciated. Also I made a point of not saying anything about what the inspectors had said to see what he would see. Ed pointed our word for word what the inspectors had seen. He took the time to explain to me exactly why one lintel would need to be replace and not another. He also showed me where bricks would need to be replaced, and where not. Finally he showed me where the tuck-pointing would need to be completely done and where it could be touched up. Most importantly, my building is red brick, and need a special mixture strength, Ed was on point. The windows which are the most difficult part on the work were completed in two days, and a third day to finish the tuck-pointing. The guys work like a well-oiled machine, the work fast and the building looks brand new. I cannot express how happy I am with the experience and the completed work. I will be calling them in the future for other jobs and will gladly refer them to my friends, family, and neighbors. read less

Ed and Peter with Edmar came out and gave some great improvement suggestions that other companies did not, in addition to providing a reasonable estimate on the spot. I felt comfortable and trusting in Ed and my wife and I decided to use Edmar. Ed was easy to get ahold of and didn't make you feel like he rushing to get you off the phone. Scheduling was clear with Jennifer in the office, who is very nice and professional, and the on-site foreman quickly took care of the neighbor's concerns about their fence without hesitation. California job growth slows dramatically in July
California’s economic recovery slowed markedly last month as COVID-19 infections rose and the state resumed shutting businesses.
Employers added just 140,400 payroll jobs from mid-June to mid-July to a total workforce of nearly 15.8 million, state officials reported.
The July job gain was dramatically less than the record 542,500-job rise the previous month when some restaurants, gyms and other businesses briefly reopened amid hopes that the virus was abating.
California’s unemployment rate lowered to 13.3% last month, down from 14.9% in June. A year earlier, it stood at 4%.
Part of the decline in last month’s rate was due to a drop in people looking for work. In June, the state’s labor force expanded by 464,000 as many furloughed workers returned to their jobs. But last month it shrank by 167,000 as businesses closed again.
“July’s forward progress is welcome, but measured against historical benchmarks, the California labor market remains very much in the ICU,” said Scott Anderson, chief economist of Bank of the West in San Francisco.
Los Angeles County’s economic picture was particularly dire, with a July jobless rate of 17.5%, down from 19.4% in June. A year earlier, it was 4.4%.
Many of Southern California’s tourist-dependent industries, including hotels, restaurants and theme parks, remain closed, while many Northern California technology firms continued to thrive thanks to remote working, online shopping and digital streaming, economists say.
For the week that ended Aug. 15, California’s new unemployment claims fell to their lowest level in five months, with 201,600 applications submitted to the state Employment Development Department. But 4.8 million Californians were still collecting jobless benefits.
A federal supplement of $600 a week expired at the end of July. That’s expected to push more Californians to seek work this month, said Michael Bernick, a former EDD director.
“California’s local workforce boards and employment agencies are reporting an increase in job applicants,” he said. “But with the economic lockdowns, the jobs are not coming back in any significant numbers.
“In fact, the opposite is occurring. California businesses continue to announce that they are closing permanently. Any economic recovery we saw in June and early July has stalled, and a listlessness set in.”
The U.S. jobless rate of 10.2% was significantly lower than California’s in July, and the nation’s payrolls grew more than California’s: 1.3%, as compared with 0.9%.
The comparatively better national picture reflects the fact that many other states have either succeeded in tamping down the spread of the coronavirus or have been reluctant to close businesses despite high infection rates.
Over the last three months, California has regained less than a third of the 2.6 million positions lost during March and April as the pandemic took hold.
And the state’s jobless rate remains a percentage point higher than its 12.3% peak during the Great Recession.
As of Friday morning, California had reported more than 653,000 cases of COVID-19 and more than 11,800 deaths.
“Difficult times remain ahead,” said Lynn Reaser, an economist at San Diego’s Point Loma Nazarene University. “Forty-two of California’s 58 counties are currently on the state’s COVID-19 watchlist, which means bans on a significant number of indoor activities, including gyms, restaurant dine-in service, museums, indoor malls and hair salons. People also remain cautious about venturing out.”
Small businesses face cash flow crises as an extension of the federal Paycheck Protection Program loan program remains in limbo. “PPP was intended to provide a bridge for businesses to get to the ‘other side,’” Reaser said. “But the distance to the other side has turned out to be much longer than expected.”
Meanwhile, negotiations have stalled between the Trump administration and congressional Democrats who propose a trillion-dollar stimulus for state and local governments as tax revenues drop and safety net expenses rise.
The bill passed by the Democratic-led House would also extend the $600 weekly unemployment supplement through the end of the year, but it has been blocked by the Republican-led Senate and the White House.
This week California applied for a stopgap $300 weekly jobless payment to be drawn from federal disaster funds, under an executive order issued by President Trump on Aug. 8.
But the supplement is expected to last just a few weeks. It applies only to workers earning at least $100 in state unemployment benefits, thus excluding many low-income part-timers who have lost jobs.
“The end of the federal stimulus will have a big impact on California,” said Sung Won Sohn, a Loyola Marymount University economist. “It accounted for about 20% of personal income nationwide and allowed consumers to pay rent and buy food. Many small businesses may not survive.”
Statewide, nine of California’s 11 industry sectors gained jobs last month. Trade, transportation, and utilities had the largest job increase (40,900) because of motor vehicle and professional equipment wholesalers, as well as automobile dealers.
Construction lost 14,800 jobs, the largest drop in any sector, because of weak hiring in residential building despite a rise in commercial construction.
As its unemployment rate dipped slightly, Los Angeles County’s payrolls dropped by 3,600 jobs to 4,093,500. County employment was down 9.4% over the year, with leisure and hospitality jobs plummeting 30%.
In Orange County, joblessness stood at 12.3%, down from 13.6% in June, and from 3.1% a year earlier. July payrolls dropped by 17,700 jobs, to 1,464,500.
In the Inland Empire, the unemployment rate was 13.4%, down from 14.3% in June and 4.6% a year earlier. Payrolls in the region, encompassing Riverside and San Bernardino counties, shrank by 8,000 jobs last month to 1,385,400.
State employment numbers are based on a monthly federal survey of 5,100 California households that focuses on workers. Payroll estimates come from a second survey of about 80,000 California businesses.
If economists are doubtful that July’s job report offers much hope, they are even more pessimistic about the direction of the California economy in August.
“The July numbers probably paint a brighter picture of the California labor market than what actually occurred,” Anderson said, noting that Gov. Gavin Newsom ordered more business shutdowns in mid-July “so new layoffs from that likely won’t show up in the data until the August payroll report is released in September.”
California’s economic recovery will depend on whether the federal government can enact more stimulus measures, including unemployment benefits, and on curbing the COVID-19 infection rate, said David Smith, an economist at Pepperdine Graziadio Business School.
“It looks like a long road ahead where we are going to have to punch, kick and crawl our way back to anything near historically normal employment,” he added.
But beyond funding the social safety net, any economic resurgence is linked to the behavior of individual Californians, state officials say. It “depends on Californians choosing to wear face masks, staying at home when possible, and following state and local guidance” on coronavirus measures, California Labor Secretary Julie Su said in a statement on the jobs report.

WASHINGTON (CN) — Under normal circumstances, with malpractice suits and doctors’ Hippocratic oaths in mind, hospitals take great lengths to prevent patient infection.
During a pandemic, where contagious people crowd spaces shared with the uninfected or the healthy, concern over liability is heightened.
But even as extra precautions are taken, the paradox remains twofold: the crisis mode of the moment ups the ante for potential negligence and the increased contact ups the ante for additional liability.
When it comes to infectious disease, those who would file suit also face a causation hurdle.
“If you are alleging infection, that can be tough because where did the virus come from? Was it left on a counter or doorknob? Did a nurse sneeze? You have to actually prove it came from hospital failure instead of maybe, shaking your boss’ hand a day before you walked into a hospital,” Dr. Michael Wilson, a physician and lawyer based in Washington, D.C., said in an interview.
The question is also about a lapse in the standard of reasonable care.
Dr. Bruce Fagel, who practiced emergency medicine for a decade before becoming a medical-malpractice lawyer in California, said in a recent interview that, as with beauty, making the determination of reasonable or unreasonable care in a claim is largely in the eye of the beholder.
“It’s going to be very difficult to have valid claims against ER physicians, especially given the way things are happening right now,” Fagel said. “If the patient comes into the emergency room and has an urgent condition other than coronavirus, because the whole health care system has been upended, well, the standard of care has changed for them, too.”

States like New York addressed this new dynamic by activating legislation like the Emergency Disaster Treatment Protection Act and including it in its 2021 budget.
It protects licensed hospitals, nursing homes and similar facilities from most civil and criminal liability claims, while also shielding attending nurses, aides, EMTs, physicians, administrators and other staff. The protections began March 7 when Governor Andrew Cuomo declared a state emergency, and they will not end until the declaration is terminated.
Similar protections have been extended in multiple states including Illinois, New Jersey, Michigan, Arizona, Connecticut, Kansas, Mississippi, Georgia, Arkansas and elsewhere through executive order.
With this patchwork, one might be tempted to turn to sweeping federal legislation as a means to streamline the liability protection process.
But that could be a hard sell, Fagel said, noting old chestnuts in the medical malpractice arena that have moldered in Washington like California’s $250,000 cap on “noneconomic” malpractice damages, which has remained largely unchanged for 45 years despite lobbying.
“There’s no way to have a blanket catch-all, certainly not from Washington,” Fagel said.
Plus, states’ needs and resources are different in a pandemic so liability can shift. In California, he noted, emergency rooms have not been as overwhelmed of late, so a doctor in Bakersfield might not be experiencing the same resource shortage or circumstances ripe for malpractice like a doctor up to his eyeballs with patients in Brooklyn.

At least one lawmaker thinks federal intervention is worth a shot: Nebraska’s Republican Senator Ben Sasse.
In early April, Sasse introduced the Facilitating Innovation to Fight Coronavirus Act, a bill that would protect doctors during the crisis who practice beyond their specialty plus those who are forced to use modified medical devices to treat Covid-19 patients. The liability protections also extend to practitioners working outside of normal facilities, like a field hospital in Central Park.
Expecting malpractice lawsuits to grow as the pandemic continues, the American Tort Reform Association published a white paper this month with its concerns and recommendations for states as policy and Covid-19 litigation intersect.
Tiger Joyce, the tort-reform group’s president, supports Sasse’s legislation. In an interview, Joyce said he would like to see similar language applied in the upcoming Covid-19 economic relief bill, which will be the fourth CARES Act as the packages are known.
The act includes a “Good Samaritan” protection that removes liability from health care professionals providing volunteer services to prevent, treat or diagnose patients with Covid-19 unless the harm was an act of omission, grossly negligent, reckless or flagrant.
For more than 40 days now, doctors and nurses across America have had to contend with record numbers of patients and personal protective equipment in short supply. The Journal of the American Medical Association published findings in late March — as the virus slowed down in China where it originated and picked up in Europe and the United States — that health care workers in China had increasingly returned to the breach with depression, anxiety and insomnia.
“I’m sure the hospital would say it is doing the best it can under the circumstances,” said Dr. Wilson.
Sasse’s expansion could be a balm for health care workers who fear legal repercussions as they try to do their jobs under extraordinary conditions, Joyce said.

But executive orders from state officials raise other questions.
Take Georgia Governor Brian Kemp’s executive order that limits liability for staff, employees and contractors at medical facilities during the pandemic while leaving immunity off the table for injury caused by gross negligence and willful misconduct.
“That’s the appropriate step because it is essentially conferring emergency management worker status on people treating patients,” Joyce said. “It calls for elevated standards and a willful standard, which is a fairly high bar because it suggests a level of intention as opposed to error or just a mistake.”
Joyce thinks these moves will be challenged in court, just as groups have challenged orders from Texas and other states to suspend abortions during the pandemic. In Pennsylvania, businesses unable to topple an executive order to shutter operations that are “non-life-sustaining” now seek U.S. Supreme Court relief.

“The question is whether [the lawsuits] will come in six months from now or a year from now,” Joyce said.
Nick Jurkowitz, partner of the Fenton Law Group in California, can see the argument for and against federal legislation to address liability for doctors.
“We are treating a situation medically that we may not necessarily know 100% of the right way to treat people. We could have much stronger negative consequences to the health of everyone if hospitals and health care providers are too scared to try experimental treatments, make changes or make hard ethical decisions,” Jurkowitz said. “If they’re so concerned they will be sued they might do what they need to and that could harm patient care.”
Assuredly, Jurkowitz said, it poses a conundrum.
“I think this is a really difficult situation modern law and medicine are facing,” he said.
He also suspects that if action happens at a federal level it may end up being retroactive.
“The potential for lawsuits as a result of this pandemic is great,” Jurkowitz said. “That could devastate the system in and of itself.”
Even if state governments are doing their best to keep an eye on things, the pandemic moves fast and the only constant is change.
“Courts are closed and strained right now,” Jurkowitz said. “People also might be a little sensitive to filing a lawsuit against a doctor in the middle of a pandemic. I certainly wouldn’t want to serve a health care provider right now, and I don’t think most lawyers would want to serve a doctor who is spending every night in the ER fighting a pandemic.”
