HOT TAKE TOURNAMENT
TOURNAMENT OVERTIME #168
Submission 542
The "if I had a nickel every time [specific thing happened] I would have two nickels, which isn't a lot but it's weird that it's happened twice." meme has been overused to the point that it isn't funny anymore
Most of the time it just isn't that weird that it happened twice. It was a very funny joke, especially in its original context (Phineas and Ferb) but it is way too overused at this point. Find another joke please.
Propaganda is encouraged!
Also, remember to reblog your favourite polls for exposure!

It was a close one, but 'Roy washes Jamie's hair' won the WIP poll. It's too much hassle to count sentences, so I've figured about 11 words on average a sentence, and with 12 votes, its 132 words.
Can confirm, I have added 542 words to this wip this evening so 🎉. And below is a little snippet of dialogue as proof and a thanks to those who voted.
(For context, Jamie's broken his arm and is sporting a fresh cast.)
“Do you think this will mess up my tattoos?” “What the fuck are you on about?” “Billy Mason broke his arm jumping from the caretaker’s shed roof in year 7. And when the cast came off his arm was proper rank, it was disgusting, all that dead skin and shit.” “Did you get your tattoos out of a cereal packet?” Roy asks slowly. “What? No.” “Then they aren’t gonna rub off you fucking muppet.”

With 50.1% of 1081 votes, Gable & Nicky Close move on to Round 5!
Full transparency, the Mod did vote for Gable and Nicky, and by Announcement #3 if the Mod's vote breaks the tie then we mend the tie. This website says that there were 542 votes for Gable & Nicky and 539 votes for Killian. If we subtract 1 vote from Gable & Nicky and 1 vote from the total, we have 50.0925925... (925 repeating)% for Gable & Nicky, and 49.9074074... (074 repeating)% for Killian.
I don't know how Tumblr rounds the polls, but by the most generally accepted rules of rounding it would still be a 50.1% to 49.9% split.
Sexiest Podcast Character — Unscripted Bracket — Round 4
Propaganda
Gable (Campaign: Skyjacks):
7ft tall silver-haired thembo of a fallen angel. was the literal sword of god until they killed him! reasons slightly unclear but probably sure to forbidden queer love! super caring for their friends. has one friend they have known for hundreds of years who they HATE but are bound to by the red string of fate. their sword is a part of them, they can sheathe it into a tattoo. they start out indistinct at the edges but as they have continued on through the campaign they have become more and more distinct. they became a flaming engine of justice to kill their friends shitheaded older brother who was following him. they have learned enough necromancy to allow other fallen angels to die, even though they typically cannot. they fly giant birds in to battle.
7ft tall beefcake wielding a sword as tall as they are. vengeful sweetheart
Imagine now: a fallen angel with beautiful gray hair and very big muscles. Now imagine them with a 9 ft sword. Now imagine them as a helmsperson of a pirate ship in a flowy deep-v pirate shirt. Now imagine they're dumb as a fucking rock. And finally, imagine that they killed god. Here, you have made Gable Skyjacks: sexiest podcast character of all time.
7ft tall nonbinary/genderfluid thembo fallen angel sky pirate who wields a buster sword. silvergrey hair with black/gold streaks as they regain feathers/memories of before their fall. back is covered in tattoos that hide the scars of their shredded off wings. killed God. toxic exes with lucifer. they are the keeper of several giant war birds who occasionally crave human flesh. they enjoy getting rowdy/smoking rope with their boys. they collect rocks that they think are neat. When anyone admits they are attracted to them, Gable trips over their words and absolutely swaglessly ends up sounding stupider and sexier by the end of the conversation; the will they/won't they and teasing they dish out to these (un?)lucky few is palpable. Sometimes the buster sword is on fire. They are immortal, they are cringe, they are trying to atone because they believe they are the reason the world is ruined.
Okay so aside from all of the above (giant with a matching giant flaming sword, killed god, extreme dumbass), here's some more propaganda for Gable the Godkiller.
They've escaped death multiple times with their partner in... crime? Like literally they were about to be executed in the most brutal way possible and just. Escaped and killed all their captors in the snowy wastelands.
They are the helmsperson of the Uhuru and take this job very seriously and definitely haven't left it to Bowser (you know, like from Mario) multiple times. Can steer that flying ship in horrible weather and still make it to port safely.
Healed an entire fucking hospital by cutting their hair for someone they had the hots for who was also in the hospital. Imagine being on that level of myth making in some random port city because of a hair cut.
Giant bird caretaker and also took the giant birds out on their friend's bachelor party (this was like. his Xth polyamorous marriage at this point btw) and had a fucking blast getting high on some rope and fucking around. They've also flown these birds into combat and looked cool as hell doing it (see: killing their friend's shithead of an older brother in a joust).
Had a relationship with Lucifer the Morning Star before they fell as an angel and killed God. Literally the reason the stars fell was their love for each other. The world would not look the same without Gable and they are, at the very least indirectly responsible for the creation of the Church of the Slain God and everything it represents (fantasy Catholicism).
And also yeah they are regularly tripping over themself and saying very silly things. 10/10 character we love Liz Anderson and Gable in this house
I am seeing people say that this Nicky fellow is basically trans! That's very cool! Gable is actually trans. Pronouns they/them/any presentation whatever they feel like.
Gable held a bachelor party for a BFF where the attendees hunted from their sky birds, wore dresses, and still managed to keep their eyeliner on point!
Gable killed God because he wouldn't let them be queer. They should rightfully crush anyone in their path.
Nicky Close (Dungeons & Daddies):
One armed half-demon man with a sword (also a Dedicated, Involved, Loving Father). (Specifically campaign 2, where he is an adult)
Transmasc bisexual (or at least so widely accepted as such it's basically canon) dilf half-demon let's start with the basics
And by half-demon I mean the literal prince of Hell
But also simultaneously is Saint Nicolas get you a man who can do both specifically this man
Missing an arm cause his ex-friends tragically betrayed him and shot it off but he doesn't need two arms to show you a good time wink wink ;)
The betrayal in question forced him to be seperated from his also hot milf voice actress wife and their son which is sad but in like a way that makes him sexier
Uses his one hand to wield a flaming katana that he used to rescue his son from the FBI
Protects his family with his life very literally which is hot as hell
Big himbo energy couldn't come up with a good plan if he used 100% of his brain
When he does fail at things it's pretty cute honestly
Definitely played a variety of musical instruments before the whole arm thing happened! Maybe he still does idk he's a sexy mystery
2 in 1 deal! This man was born from the merging of two timelines! Kinda sick!!! Also two dads = twice the daddy issues
You'd think the whole being forcibly split from his family thing would mean he isn't very close with his son but nope! His son adores him! They get along great!!!
His mom is simultaneously alive and dead
His mom bagged fucking two different dudes (one of whom FOUND HER DEAD in a different timeline, both of which are demons)
HIS MOMS NAME IS MORGAN FREEMAN, HIS DAD’S NAME IS GLENN CLOSE, AND HIS OTHER DAD’S NAME IS JODIE FOSTER, AND HIS GREAT SOMETHING GRANDFATHER’S NAME IS MERYL STREEP
HIS SONS NAME IS TAYLOR SWIFT
Lifelong pot smoker 👍 (plus drug flower user!!)
CANONICALLY BOTH A POLO WEARER (and yes, has all the stereotypes of that attached with it — a nerd, which is hot) AND A LEATHER JACKET WEARER (which also has all the stereotypes attached with it — a rebel dude person, which is also hot) [<- all widely accepted as canon by the fandom even as he’s older]
A part of the SECOND BIGGEST ship of season two, (Nark) despite the two characters only having one-two canon interactions (one of which JUST happened last episode)
Man’s a himbo what’s hotter than that
So many fucking names. You try to tag him in anything and he takes up half the space. That’s probably hot. For someone out there
This was already mentioned but so very very trans. Like. It’s basically canon
Rock and roll(er)
Joined a group of thieves called the watermice when he was like 13
for a few minutes had a guitar called the Battle Axe of Hatred
definitely had an frienimies with benefits relationship with his childhood friend Lark (sorry ppl that don’t ship nark lol) (it’s canon after ep 44 hah)
I feel like the audio of the entire Nick-breaking-into-the-FBI scene should be propaganda, but I'm copying select bits from the transcript:
Anthony: Yeah, it kind of echoes up through the vent, like the beginning of Metal Gear Solid. You hear a voice that strikes you as ever so slightly familiar, Taylor. Saying— ??: [a deep voice] [echoing in the vent] Where is he? Anthony: You hear— Will: Uh-oh, he’s hot. Anthony: —a bunch of shouting voices. [giggles] Beth: Uh-oh! Anthony: You hear a bunch of shouting voices and people shouting for him to get down on the ground to turn off his flame. To fucking get his hands behind his back. You hear this rhythmic stepping forward— because his footsteps don't sound like anybody else's because it's almost like… y’know when you toss a little bit of water onto a really hot pan and it just sizzles like that? It's like every footstep he's taking, you can hear that— Freddie: Cool Anthony: — and you can feel some of that heat coming up in this vent, even though you can't see him at this point. And he goes— ??: [echoing] Where. Is. My. Boy? Anthony: You hear the FBI agent—the FBI in quotation marks agent—in the back going like— Agent: [echoing] He's safe for now. If you want to go ahead and make sure that he stays that way, you feel free to go ahead and step inside the suite that we've prepared for you, my boy. Anthony: And you hear the hot guy voice saying— [chuckles] The Hot Guy: [echoing] I don't think that's going to happen.
...
[a powerful rush of air builds] Anthony: You hear— [gunfire, and the air rush culminates in a burst of flame; from underneath the fire, metal music starts playing] Anthony: —plumes of flame exploding. [a person’s pained shout, gunfire and bursts of flame continue] Anthony: You can feel the heat radiating through this metal vent and it's actually beginning to hurt and burn your hands.
...
Anthony: And you hear blood— [sizzling] Anthony: —hitting the fucking ground and you hear sizzling and things boiling and burning. Taylor: That could just be coffee! That could just be coffee. Link, let's go. Anthony: And you are getting closer and closer to the elevator. And you hear that same hot voice say— The Hot Guy: [echoing] Where the hell is Taylor?
Gable and Nicky Together:
We are on a joint ticket now! This is a truly unbeatable combo. Not even god can nerf it because Gable killed him. Vote for us. Nicky Close will watch your stuff and play with your cats while Gable gives you the night of your life.
Killian Fangbattle (The Adventure Zone: Balance):
she's an orc! she's really fuckin strong! she's a butch lesbian! she has a short fuse, loves to joke, and loves to threaten! and she is very soft and loves ducks + her lizard wife.
I don't even think I need to say anything here, we were all smitten the moment Griffin said "orc woman"

What Happened to the Voting Rights Act?
This country has a long history of disenfranchising and suppressing the votes of people of color, particularly in the South. But in 2013 the voter suppression efforts of yesteryear came roaring back. That’s when the Supreme Court gutted key provisions in the Voting Rights Act of 1965. Those provisions had stopped states with histories of voter suppression from changing their election laws without an okay from the federal government.
Let’s take a look at how that shameful decision has played out over the years, shall we? Today’s voter suppression often takes the form of purging eligible voters from the rolls, cutting back early and absentee voting, closing polling places, and using strict voter ID requirements – disenfranchising voters of color at every turn. Voter roll purges have become increasingly common.
Officials purged nearly 4 million more names between 2014 and 2016 than between 2006 and 2008 — a 33 percent increase. Officials in states that used to be under federal oversight purged voters from the rolls at a rate 40 percent higher than those in states with no history of voter suppression. As it turns out, Chief Justice John Roberts was dead wrong when he argued “things have changed dramatically” in the South. Election officials in Florida, North Carolina, Georgia, and Virginia have all conducted illegal voter roll purges. In Virginia in 2013, nearly 39,000 voters were removed from the rolls when state officials relied on a faulty database – removing voters who had supposedly moved out of the state. Even if you make it past a voter roll purge, you may get stuck in endlessly long lines to vote.
Since the Voting Rights Act was gutted in 2013, 1,688 polling places have been shuttered in states previously bound by the Act’s preclearance requirement. Texas officials closed 750 polling places. Arizona and Georgia were almost as bad. Not surprisingly, these closures were mostly in communities of color. In Texas, officials in the 50 counties that gained the most Black and Latinx residents between 2012 and 2018 closed 542 polling sites, compared to just 34 closures in the 50 counties that gained the fewest Black and Latinx residents. In Georgia’s 2020 primary, 80 polling places were closed in Atlanta, home to Georgia’s largest Black population — forcing 16,000 residents to use a single polling place. And even if you get to a polling place after standing for three hours to cast your ballot, you may end up being turned away because of a restrictive voter ID law.
Republican lawmakers in 15 states have passed such laws since the Supreme Court’s shameful decision. Texas Republicans put a voter ID law into effect almost immediately following the decision — a law that they had been prevented from passing in 2011 when the Voting Rights Act was still intact. That law has been struck down five times since it went into effect, with multiple courts finding it intentionally discriminates against Black and Latinx voters. A federal appeals court finally allowed a watered-down version that’s still one of the most restrictive voter ID laws in the country. In Georgia, the state’s restrictive “exact match” ID law — requiring a voter’s ID to exactly match the name on their registration, down to any dots or dashes — allowed state officials to throw out 53,000 majority-Black voter registrations less than a month before the state’s tight 2018 gubernatorial race. Stacey Abrams, who would have been the country’s first Black woman governor, lost the election by just under 55,000 votes — after years of her rival Brian Kemp systematically suppressing the votes of people of color. Meanwhile, in North Carolina, a court found that the state’s voter ID law “target[ed] African Americans with almost surgical precision,” and struck the law down in its entirety. Imagine all we could accomplish with all the time, money, and resources that go into prolonged legal battles against these discriminatory laws that should never have seen the light of day in the first place. Voter suppression is wreaking havoc on our electoral process.
When the Supreme Court gutted the Voting Rights Act seven years ago, it passed the buck to Congress to update it, but Senate Republicans haven’t lifted a finger.
In December 2019, John Lewis presided over the House of Representatives to pass H.R. 4, the Voting Rights Advancement Act, now named the John R. Lewis Voting Rights Act in his honor, to restore the Voting Rights Act and stop this pervasive voter suppression. It’s been collecting dust on Mitch McConnell’s desk ever since. He and his GOP colleagues think they can sit idly by as Republican state officials suppress the vote with no accountability. They're wrong. The people are ready to fight back against their agenda and build a 21st century democracy that is representative of and responsive to our growing, diverse nation. If your vote didn’t count, they wouldn’t be trying so hard to suppress it. Make sure you check your registration, stay up to date on your state’s rules for mail-in voting, find your polling place, and get involved with organizations on the frontlines of protecting the vote. There’s no telling what we’ll be able to accomplish when we win the battle for voting rights.

Ah dammit, my reading comprehension sucks and I thought this was asking how long I've known I was nonhuman. I should have answered 6 - 10 and not 21 - 25 -_____-
More ages to follow; if you see only this post/poll, check the reblogs for an expansion poll!

Little number crunching
So someone on Reddit shared some really interesting data on panel appearances / character.
Here are the top 10 in terms of panel time:
Izuku Midoriya 4925
Katsuki Bakugo 1695
All Might 1450
Shoto Todoroki 1430
Ochako Uraraka 1105
Tenya Ida 1062
Shota Aizawa 944
Eijiro Kirishima 918
Tomura Shigaraki 820
Endeavor 593
Momo Yaoyorozu 542
So, I decided to cross-check how much panel time correlates with popularity (adding the popularity poll votes and dividing them with the panel count). It's pretty interesting.
Bakugou is on the top as expected with 29.7 votes per panel appearance.
Todoroki is not far behind with 24,1.
Kirishima: 10,66
Momo: 8,5
Iida: 6,7
Aizawa: 6,4
Midoriya: 5,7
Endeavor: 4,7
Uraraka: 4,45
All Might: 3,87
Shigaraki: 3,0
These are some really interesting numbers. It shows that giving a character growth moments / serious arcs makes it feel like they have more "panel-time" than they actually do.
Especially, as I've seen people complaining how much time Bakugou and Todoroki get - but in reality, their numbers are not that much more than Uraraka or Iida. It's just that their appearances feel more significant to the story.
Also, Midoriya has a ton of panel-time, with an ever widening gap compared to the others, even as his character arc feels lately pretty stagnating. So it's not a question of lack of focus, but a lack of development that his popularity return is not so strong.
Out of the class 1A, the characters with the strongest numbers on “popularity return” are: Ojirou (8,6) - this was a big surprise to me, Kaminari (6,7) and Tokoyami (6,1). The mid-range is Jirou (4,9), Asui (4,2), Sero and Aoyama (2.4). The rest is below 2 and one of the worst performers is Mineta (so I'm not the only one who'd like to see less of him) with 0.5.
Based on this, I definitely would expect Kaminari and Tokoyami get more background.
Best Jeanist's "popularity return" is a crazy outlier at 86 votes/ panel appearance. That’s almost 3 times that of Bakugou's. Based on this, I totally buy that his votes were "rigged" somehow in poll 3 and 4.
The pro-heroes do really well in general: Hawks is 17,89 and Gang Orca 16,3. Others also have solid numbers: Present Mic 5,9, Fatgum: 4,8 (they all outperform All Might), while Sir Nighteye is at a measly 1,2.
Out of non-class1a students: Shinsou is at 11 (higher than Kirishima, which seems to suggest that his underdog story-line really struck a chord), Amajiki: 3,7, while Mirio a pretty low at 1.3 (which seems to say that his back-story and character arc fell flat, and is an answer to people who think that he'd make a better MC than Deku. He's simply too flawless to be interesting).
Out of the more popular villains, Toga is 4,47, while Dabi is only at 2,8 (which is quite low, considering how crazy popular he is on Tumblr).

youtube

"Divide, Divert and Rule"

youtube
2. EVM machines-ஐ மாத்துறது.
youtube
youtube
#digitalindia

Okay, I initially reblogged this on someone else's post, but to be honest, I see nothing useful in disagreeing with someone loudly on the internet, when they're probably having a rough time of it and blogging to vent. So. If we're gonna keep talking about "Well this is the consequence of people not voting in 2016" I feel like it's important to point something out here: Hillary Clinton won the popular vote in 2016 by nearly 2.9 million votes. People did turn out. They voted their asses off. And Donald Trump became president because he won the electoral college. People are voting, but their votes are not impacting the government the way they ought to.
If we are to push people to see the importance of voting as a way to shape what happens in our country, we cannot handwave away the very real dysfunction that riddles our government at the state and federal level. I live in Texas, one of the hardest states to get an absentee ballot in, where our administration is notorious for closing polling sites in neighborhoods of color and for gerrymandering. Stacey Abrams founded Fair Fight in Georgia in *because* of the widespread disenfranchisement in her home state and in Texas. And organizers are still busting their asses to fight widespread attempts at repressing voters. I lived in Missouri, another state notorious for redlining, voter disenfranchisement and gerrymandering. Movement work got a progressive candidate, Cori Bush, elected in 2021, in spite of that shit. If we want to talk the last 50 years, since 1970 the incarceration rate in the US has increased by 500%.
Do you know who can't vote in the US? People in prison.
Do you know which sections of the population are sentenced at disproportionately high rates? Black Americans. Democracy is broken in the United States. Yes, 2016 happened, and the Trump administration unmade a lot of protections and strongarmed three right-wing judges onto the Supreme Court. And---Biden ran on a campaign that promised formally protected Roe V. Wade in the letter of the law. Many Congressional candidates did too. And they have been promising to write Roe v Wade into law, for decades. They've been promising a lot of things for decades, in fact. The current administration has had nearly two years to do something to prevent this move by Alito, and they have done jack and shit. Other Promises that Democratic Candidates Ran on this Time Around: -Childcare Funding -Defunding of Police (Or if not defunding at least reform) -Healthcare Reform -Student Loan Forgiveness People have a right to be angry and feel disenchanted with the entire system of voting, when in the midst of a pandemic the democratic administration they fought so hard for is not delivering on their campaign promises. And also, if we're talking about the long tail here, we did not just get here from Republican politicians. Law passed under the Clinton Administration set the precedent that created ICE with a 1996 piece of legislation known as IIRIRA and the "Prevention Through Deterrence." Clinton's Violent Crime Control and Law Enforcement Act of 1994 is credited with a major increase in the incarceration rate in this country. Over 542 drone strikes happened under the Obama administration. If we're talking the long tail, things don't look any better in terms of voting. Democratic candidates have been moving closer and closer to the center in the last 50 years, making promises of reformation while delivering programs that offer the bare minimum in social support. Progressive candidates are routinely mocked by the media, actively censured by their Democratic colleagues, and face the threat of physical violence in their place of work. We need to change how we're talking about voting when we're trying to rally people.
Voting is one tactic as part of an overall strategy to enact meaningful change in our country. It can not be touted as a be all end all move to solve systemic issues, because it simply won't. If we're gonna holler for people to vote, we need to treat their concerns seriously when they say "I voted, and nothing got better."
People don't want a zoom-out 50-year map to explain to them why they can't get health coverage, their job pays shit, and everything costs three times more than it did twenty years ago. They want to know how the fuck they're supposed to feed their families, stay housed, and be safe and healthy. If taking unpaid time off and standing in line for hours to cast their ballot isn't getting them that, then people will stop fucking voting. Civil Rights Activists pushed hard with voting registration and getting people to the polls, but they also had health clinics, childcare, food programs, ways to get people housing. They knew voting would not secure what people needed for a long time, so they organized in the in-between. Queer activists organized palliative care, meal networks, and housing during the AIDs crisis, but long before that there were ballrooms and whisper networks getting unhoused kids off the street, getting people fed, helping folks stay safe and paid and out of jail. Voting is one tactic in getting shit done, it is not an entire strategy in and of itself. Voting is a long-term game, but we need to talk about the grassroots community action and care that helps people survive to the point where they can see their vote matters.
#Voting#US politics#United States#Roe V Wade#Civil Rights#Democrats#2016 election#I studied public policy and will holler about this from the tops of mountains#you cannot just shout at people to vote and expect it to work

CJ court watch 1jul21
Big cases last couple days, not about criminal justice, but about Constitutional rights.
Brnovich v. Democratic National Committee, 594 U. S. ___ (2021) was a 6-3 decision on Arizona’s rules on voting.
***The regulations at issue in this suit govern precinct-based election-day voting and early mail-in voting. Voters who choose to vote in person on election day in a county that uses the precinct system must vote in their assigned precincts. See §16–122 (2015); see also §16–135. If a voter goes to the wrong polling place, poll workers are trained to direct the voter to the right location. Democratic Nat. Comm. v. Reagan, 329 F. Supp. 3d 824, 859 (Ariz. 2018); see Tr. 1559, 1586 (Oct. 12, 2017); Tr. Exh. 370 (Pima County Elections Inspectors Handbook). If a voter finds that his or her name does not appear on the register at what the voter believes is the right precinct, the voter ordinarily may cast a provisional ballot. Ariz. Rev. Stat. Ann. §16–584 (Cum. Supp. 2020). That ballot is later counted if the voter’s address is determined to be within the precinct. See ibid. But if it turns out that the voter cast a ballot at the wrong precinct, that vote is not counted. See §16–584(E); App. 37–41 (election procedures manual); Ariz. Rev. Stat. Ann. §16–452(C) (misdemeanor to violate rules in election procedures manual). For those who choose to vote early by mail, Arizona has long required that “[o]nly the elector may be in possession of that elector’s unvoted early ballot.” §16–542(D). In 2016, the state legislature enacted House Bill 2023 (HB 2023), which makes it a crime for any person other than a postal worker, an elections official, or a voter’s caregiver, family member, or household member to knowingly collect an early ballot—either before or after it has been completed. §§16–1005(H)–(I). In 2016, the Democratic National Committee and certain affiliates brought this suit***
The en banc 9th Circuit said this was all terribly discriminatory. SCt reversed.
***because this is our first §2 time, place, or manner case, a fresh look at the statutory text is appropriate. Today, our statutory interpretation cases almost always start with a careful consideration of the text, and there is no reason to do otherwise here.***
The key requirement is that the political processes leading to nomination and election (here, the process of voting) must be “equally open” to minority and non-minority groups alike, and the most relevant definition of the term “open,” as used in §2(b), is “without restrictions as to who may participate,” Random House Dictionary of the English Language 1008 (J. Stein ed. 1966), or “requiring no special status, identification, or permit for entry or participation,” Webster’s Third New International Dictionary 1579 (1976). What §2(b) means by voting that is not “equally open” is further explained by this language: “in that its members have less opportunity than other members of the electorate to participate in the political process and to elect representatives of their choice.”***
Casting a vote, whether by following the directions for using a voting machine or completing a paper ballot, requires compliance with certain rules. But because voting necessarily requires some effort and compliance with some rules, the concept of a voting system that is “equally open” and that furnishes an equal “opportunity” to cast a ballot must tolerate the “usual burdens of voting.” Crawford v. Marion County Election Bd., 553 U. S. 181, 198 (2008) (opinion of Stevens, J.). Mere inconvenience cannot be enough to demonstrate a violation of §2.***
+++
Brendan Eich nods. SCt decided Americans For Prosperity Foundation v. Bonta, 594 U. S. ___ (2021) 6-3.
To solicit contributions in California, charitable organizations must disclose to the state Attorney General’s Office the identities of their major donors. The State contends that having this information on hand makes it easier to police misconduct by charities. We must decide whether California’s disclosure requirement violates the First Amendment right to free association.***
The court also determined that the disclosure regime burdened the associational rights of donors. In both cases, the court found that the petitioners had suffered from threats and harassment in the past, and that donors were likely to face similar retaliation in the future if their affiliations became publicly known. For example, the CEO of the Foundation testified that a technology contractor working at the Foundation’s headquarters had posted online that he was “inside the belly of the beast” and “could easily walk into [the CEO’s] office and slit his throat.”***
The District Court also found that California was unable to ensure the confidentiality of donors’ information. During the course of litigation, the Foundation identified nearly 2,000 confidential Schedule Bs that had been inadvertently posted to the Attorney General’s website, including dozens that were found the day before trial. One of the Foundation’s expert witnesses also discovered that he was able to access hundreds of thousands of confidential documents on the website simply by changing a digit in the URL. The court found after trial that “the amount of careless mistakes made by the Attorney General’s Registry is shocking.”***
We have also noted that “[i]t is hardly a novel perception that compelled disclosure of affiliation with groups engaged in advocacy may constitute as effective a restraint on freedom of association as [other] forms of governmental action.” NAACP v. Alabama ex rel. Patterson, 357 U. S. 449, 462 (1958).***
While exacting scrutiny does not require that disclosure regimes be the least restrictive means of achieving their ends, it does require that they be narrowly tailored to the government’s asserted interest.***
we conclude that California’s blanket demand for Schedule Bs is facially unconstitutional. A As explained, exacting scrutiny requires that there be “a substantial relation between the disclosure requirement and a sufficiently important governmental interest,” Reed, 561 U. S., at 196 (internal quotation marks omitted), and that the disclosure requirement be narrowly tailored to the interest it promotes***
the pertinent facts in these cases are the same across the board: Schedule Bs are not used to initiate investigations. That is true in every case. California has not considered alternatives to indiscriminate up-front disclosure. That is true in every case. And the State’s interest in amassing sensitive information for its own convenience is weak. That is true in every case. When it comes to the freedom of association, the protections of the First Amendment are triggered not only by actual restrictions on an individual’s ability to join with others to further shared goals. The risk of a chilling effect on association is enough, “[b]ecause First Amendment freedoms need breathing space to survive.”***
