Overstaying your visa while you await approval for your next visa is how you get your next visa. It’s a normal experience in the process of the legal immigration system in the United States.
Nearly everyone I know from another country has overstayed their visa regardless of which country they came from, the color of their skin, their criminal record, their education level, what their job is.
White House press secretary stated that it is of the opinion of this administration that anyone who overstays a visa is a criminal.
Currently overstaying a visa and entering the country outside of the legal system are not crimes but civil violations. Doing either of these things does not make one a criminal. Trump made it clear yesterday he intends to criminalize such behavior, and states are already proposing laws to give “illegal immigrants” life in prison to keep the prison to slave labor pipeline churning.

3. Tempest
One of the strongest memories that had stuck to the inside of Erenville’s skull since a child was an afternoon lying along the top of the wall around the house, practising being as still as the lizards he was watching as they sunbathed on the hot adobe. The sky had been an oppressively heavy blue, the sun cooking the back of his neck and legs, but he pretended it was warming him just like the little red lizards; almost the same colour as the wall but with shiny dark eyes like chips of obsidian, that they blinked ever so slowly. There were ten of them, he remembered. He’d carefully counted them a few times, and was quite sure of it even though it had been a very big number.
He didn’t remember if he had already thought of this as part of his training at the time, or if that was a later thing he’d thought back to this memory as the start of.
A huge crash of thunder right above had made each lizard jolt up to their full height, peeling hot bellies off the wall to look about in alarm. And then black clouds had poured over the sky from behind the cliff that sheltered Tesh’pyani Village, and within seconds sharp, ice-filled rain was hammering down.
He didn’t remember who had shouted for him to get inside; if it had been Iyaate or someone else from the village. Or even Cahciua. He remembered the lizards scattering, though, and he wasn’t sure if the rain or the shout had come first, just that he was more upset they’d run for shelter and this moment was over, than he was at getting soaked. He was still so hot from soaking sun out of the bricks.
He remembered watching that storm from the upstairs window, peering down at the wall and hoping that water wasn’t pooling in all the secret cracks lizards found to hide. He didn’t remember who had watched the sky with him until the storm had passed.

The part of the wall that he’d lain on was still standing. The window he’d watched out of still looked down on the yard. Not much else of the house was still solid. The lizards were long-gone. The storm lashing the ground now had stripped away much of the topsoil. It had taken away the smell of the sun and the hot ground radiating it back.
Just for a moment when he’d come around the corner of the road, he had smelled it, though, somewhere deep back in his throat before the sensation of rising bile had taken over it, and a moment of hope that maybe the desolation they’d found so far in Yyasulani hadn’t reached home. That somehow the constant lightning, the endless storm, had spared this tiny place that had been his.
The rain smelled sharp and electric and of some alien chemicals. Even the thunderstorm was wrong.
