Today’s Legislative Updates February 13, 2025
Trans rights are still under attack in the United States. Please visit our website linked below to learn about your state and contact your reps. Here's a thread of today's updates:
Bathroom bills deny access to public restrooms by gender or trans identity.
They increase danger without making anyone any safer and have even prompted attacks on cis and trans people alike. Many national health and anti-sexual assault organizations oppose these bills.
Old Bills:
Missouri SB212 has a hearing scheduled on 2/18 at 8am in Senate Lounge - 3rd Floor in the Senate Education Committee.
Montana passed bill HB121 through both chambers yesterday and sent it to the governor.
South Dakota passed bill HB1259 through its committee yesterday and sent it to the House floor.
Healthcare bills go against professional and scientific consensus that gender-affirming care saves lives. Denying access will cause harm.
Providers are faced with criminal charges, parents are threatened with child abuse charges, and intersex children are typically exempted.
New Bills:
West Virginia introduced under-18 health care ban SB279 yesterday and sent it to the Senate Health & Human Resources Committee.
West Virginia introduced bill HB2072 yesterday and sent it to the House Health & Human Resources Committee. This bill allows doctors to refuse treatment on the grounds of ‘religious freedom’.
Colorado introduced under-18 health care bill HB1253 yesterday and sent it to the House Health and Human Services Committee.
Colorado introduced HB1254 yesterday and sent it to the House Judiciary Committee. Expands medical liability to allow patients to sue doctors UP TO AGE 38.
Old Bills:
Missouri passed bill SB75 through its committee today and sent it to the Senate floor.
Missouri sent bill SB249 to the Senate Families, Seniors and Health Committee today.
Drag Bans restrict access for folks who are gender non-conforming in any way.
They loosely define "drag" as any public performance with an “opposite gender expression,” as sexual in nature, and inappropriate for children.
This also pushes trans individuals out of public spaces.
New Bills:
West Virginia introduced drag bans SB278 and SB276 yesterday and sent them to the Senate Judiciary Committee.
Old Bills:
Iowa HSB158 has a hearing on 2/18 at 12:30pm in RM 304 in the House Education Committee.
Educational Censorship and Student Suppression bills force schools to misgender or deadname students, ban instruction on sexual orientation and gender identity, and make schools alert parents if they suspect a child is trans.
They remove life-saving affirmation and support for trans youth.
New Bills:
Kentucky introduced university-level educational censorship bill HB4 yesterday and sent it to the House Committee On Committees Committee.
West Virginia introduced educational censorship and forced outing bills HB2071 and SB154 yesterday and sent them to the House/Senate Education Committee.
Old Bills:
Wyoming introduced bill SF0103 in the House yesterday and sent it to the Joint Labor, Health & Social Services Committee.
Ohio passed bill SB1 through the Senate yesterday and sent it to the House.
Tennessee sent bills HB1262 and HB1270 to the House Education Administration Subcommittee yesterday.
Pennsylvania sent bill HB581 to the House Education Committee yesterday.
Trans Erasure bills create legal definitions of terms like “sex” designed to exclude or erase trans identity and insert them into various laws. This can have many different effects, depending on what laws are affected.
They can force a male or female designation based on sex assigned at birth.
Some target anti-discrimination statutes, legally empowering trans discrimination.
New Bills:
Texas filed trans erasure and bathroom bill HB2704 yesterday.
West Virginia introduced trans erasure bills HB2127 and SB244 yesterday and sent them to the House/Senate Judiciary Committee.
Old Bills:
Missouri passed bill SB76 through its committee today and sent it to the Senate floor.
Missouri sent bill SB298 to the Senate General Laws Committee today.
Arizona passed bill HB2062 through the House today and sent it to the Senate.
South Dakota passed bill HB1260 through its committee yesterday and sent it to the House floor.
Alabama passed bill SB79 through both chambers yesterday and sent it to the governor.
Digital Censorship Bills describe any legislation that potentially targets Queer and Trans media/material for removal.
They typically do this by using vague and broad definitions of "Obscene" or "Harmful to Minors" and then banning such content from being accessible to minors, which often either removes the material entirely or requires age verification methods in order to view.
This includes online censorship bills, library book bans, and other such legislation.
Old Bills:
South Dakota HB1239 has a hearing on 2/19 in the House Education Committee.
Montana HB446 has a hearing on 2/17 at 8am in Room 137 in the House Judiciary Committee.
Most sports bills force schools to designate teams by sex assigned at birth.
They are often one-sided and ban trans girls from playing on teams consistent with their gender identity.
Some egregious bills even force invasive genital examinations on student athletes.
Old Bills:
Utah HB0424 has a hearing tomorrow at 8m in Room 30 House Building in the House Judiciary Committee.
Indiana passed bill HB1041 through its committee today and sent it to the House floor.
In other bills that either fit multiple categories or stand on their own, we have:
New Bills:
Wisconsin introduced bill SB40 yesterday and sent it to the Senate Licensing, Regulatory Reform, State and Federal Affairs Committee. This bill is a pride flag ban.
Kentucky introduced bill HB5 yesterday and sent it to the House Committee On Committees Committee. This is a youth incarceration bill that dictates housing incarcerated youth by ‘biological sex’ as well as denying them gender-affirming care.
West Virginia introduced bills HB2033 and HB2153 yesterday and sent them to the House Health & Human Resources Committee. These are foster care/adoption/custody bills that prevent denying placement/custody due to transphobic or homophobic beliefs.
Old Bills:
Kansas HB2311 has a hearing on 2/17 at 1:30pm in Room 152-S in the House Child Welfare and Foster Care Committee.
Missouri sent bill SB272 to the Senate Economic and Workforce Development Committee today.
It's not too late to stop these and other hateful anti-trans bills from passing into law. YOU can go to http://transformationsproject.org/ to learn more and contact your representatives!

Noah Berlatsky at Public Notice:
Kamala Harris’s choice of Minnesota Gov. Tim Walz as her running mate is, in some respects, a standard, safe choice. Like most of her potential picks, Walz is a white man. He’s a popular Democratic governor with deep roots in the party. He’s by no means an odd or risky selection. And yet, at the same time, Harris’s choice of Walz is unusual, exciting, and even inspirational. Over the last forty years, Democrats have generally used the VP pick to try to cater to centrist swing voters. Some of Harris’s leading choices, like Pennsylvania Gov. Josh Shapiro and Arizona Sen. Mark Kelly, were in that mode. Instead, Harris chose Walz — a candidate who has a good deal of potential bipartisan appeal, but who is also well-positioned to excite Democrats, and particularly progressives. As such, Walz’s rise is a promising indication that Harris plans to continue and expand upon the approach of President Biden, who’s embraced progressive ideas and legislation as a way to unify and inspire Democratic voters.
Walz as safe pick
It’s easy to make the case for Walz as a safe, sturdy, and conventional pick for VP. He served in the National Guard for 24 years; he’s now the vice presidential candidate with the longest military career. In 1996 he left the military to to work as a high school history teacher in Mankato, Minnesota. He ran for Congress in 2006, a strong year for Democrats, and defeated six-term Republican Gil Gutknecht. He held the rural district through 2010 and 2014 — two red wave years — and even held on in 2016, when Trump won the district by 15 points. In 2018, he ran for governor and won. He won a second term in 2022. This is an impressive record, and one that seems almost custom-made for a vice presidential resume. Walz’s military record should appeal to at least some conservative voters, who tend to value military service in candidates. His strong record in a rural Trump district also testifies to his ability to reach out to red voters.
On the other hand, Walz’s experience as a teacher should play well with educators — a core Democratic constituency — and with teacher’s unions. He’s also shown himself to be exceptionally skilled at attacking Republicans. After he called Republicans “weird” on MSNBC, Democrats as a whole seized on the word to define the abortion-hating, single-women hating, book-hating weirdos in the GOP.   Walz’s conventional qualifications and strengths have made him acceptable within, and popular with, the mainstream of the Democratic Party, as evidenced by the wave of enthusiasm from mainstream party leaders.
[...]
Walz Is a Biden Democrat
Walz isn’t a leading left voice in the party, like Bernie Sanders, Elizabeth Warren, or AOC. He’s a mainstream Democrat who has been (stunningly) successful in pushing mainstream progressive Democratic priorities in Minnesota. After 2022, when Democrats won a narrow majority in the state Senate and House, the legislators and Walz passed a paid family and medical leave bill, banned LGBT conversion therapy, legislated a carbon-free electric grid by 2040, and legalized cannabis. They also restored voting rights to people released from jail, mandated gun background checks, and put in place a free school lunch program for all students, regardless of income.
That record has made Walz a darling of progressives, who have enthusiastically boosted his candidacy. It’s also the kind of record that appeals to all Democrats and makes him look a lot like another leading Democratic figure — Joe Biden. Biden came into office with a record as a moderate compromiser. He was not the choice of most progressives or leftists, who would have preferred Sanders or Warren in the 2020 primary. But once in office, Biden embraced a range of popular progressive proposals. Despite Republican (and Supreme Court) resistance, he’s pushed through billions in student debt relief. He managed to pass a bipartisan gun control bill. He passed massive investments in green energy. His administration’s aggressive antitrust enforcement has reversed decades of Democratic timidity in the face of corporate consolidation. His pro-union policies have ignited a major labor renaissance. Obviously, progressives and the left have serious differences with Biden, most notably on his continued support for Israel’s right-wing government. On many issues, though, Biden has created a new blueprint for Democratic governance — one which builds on progressive ideas and energy to craft a powerful, popular agenda that the entire party can embrace.
Kamala Harris’s pick of Tim Walz is a shrewd and smart one to complete the ticket.

LETTERS FROM AN AMERICAN
July 19, 2024
HEATHER COX RICHARDSON
JUL 20, 2024
Today a Russian court sentenced 32-year-old Wall Street Journal reporter Evan Gershkovich to 16 years in a high-security penal colony after convicting him of espionage in a secret three-day trial. The U.S. government considers Gershkovich “wrongly detained,” a rare designation signifying that he is being held as a political bargaining chip.
Today, President Joe Biden said that Gershkovich was “targeted by the Russian government because he is a journalist and an American. We are pushing hard for Evan’s release and will continue to do so.” He added: “Journalism is not a crime. We will continue to stand strong for press freedom in Russia and worldwide, and stand against all those who seek to attack the press or target journalists.”
Last night, a faulty update of software from cybersecurity firm CrowdStrike crashed computer systems all over the world. Banks and hospitals were locked out of their own programs, and government services shut down. In the U.S., more than 2,600 flights were canceled and 9,000 were delayed. Bloomberg’s David Rovella quoted Australian security consultant Troy Hunt: “I don’t think it’s too early to call it,” Hunt said. “This will be the largest IT outage in history.”
Also making history last night was the final night of the Republican National Convention in Milwaukee, Wisconsin, the night on which former president Donald J. Trump accepted the party’s presidential nomination. Coming as it did just days after a would-be assassin took a shot at Trump at a rally in Butler, Pennsylvania, killing one attendee and badly wounding two others, the convention was billed by Republican operatives as a way for Trump to rebrand himself as a candidate of “unity.”
This was certainly the way many major newspapers billed Trump’s acceptance speech this morning, in stories that, as media journalist Parker Molloy noted, were probably based on prepared remarks delivered to news agencies in advance of the speech. But it was not how the evening played out.
Since Saturday’s shooting, it has been notable that there has not been a medical review of Trump’s injuries, although he has said he was injured by a bullet that ripped through his ear. This matters not only because of the extent of his injuries, but also because Trump has made the story part of his identity without any fact check, and the media appears simply to be letting it go on Trump’s say-so, something that adds to the sense that media outlets are treating Trump and Biden differently.
Last night, Trump perhaps tried to address this lack by recounting last Saturday’s shooting. Interestingly, he did not say he was hit by a bullet, but that when he felt the injury he thought, “it can only be a bullet.” Josh Marshall of Talking Points Memo today noted a report from local Pennsylvania television station WPXI that four motorcycle officers standing within feet of Trump suffered minor injuries from flying debris. Trump has likely cut off further discussion of the topic by saying it is too painful to tell the story again.
With that story behind him, Trump hit the theme of unity, saying he would bring the country together. “The discord and division in our society must be healed, we must heal it quickly. We are bound together by a single fate, a single destiny,” he said. “We rise together. Or we fall apart…. I am running to be president for all of America, not half of America, because there is no victory in winning for half of America. So tonight, with faith and devotion, I proudly accept your nomination for president of the United States.”
But that was just in the first ten minutes. Then Trump ignored the teleprompter and things veered far off course, reflecting the candidate that has stayed in the safe spaces of Mar-a-Lago and rallies of his loyalists for years. Trump rambled for more than 90 minutes, making it the longest acceptance speech in U.S. history and outlasting the interest of the audience, some of whom fell asleep.
He went on to recite his usual litany of lies: that Democrats cheated in the 2020 presidential election (they did not), that crime is going up (it’s plummeting), that inflation is the worst we’ve ever had (it’s around 3%; the worst was around 23%), that Democrats want to quadruple people’s taxes (CNN fact checker Daniel Dale calls this “imaginary”), and so on. Dale called it “a remarkably dishonest acceptance speech.”
Journalist James Fallows posted: “Of the maybe 10,000 political speeches I've heard over the years, this was overall the worst.” Statistician Nate Silver’s judgment was harsher, in a way: he began with “It’s a weird but a pretty good speech,” then posted “Semi-retract this tweet, this speech is boring AF, but there are worse things politically speaking than being boring.” Shortly after, came: “Fully RETRACT and RESCIND, sometimes it seems like both parties are trying to throw this election.”
MSNBC’s Chris Hayes watched the unhinged speech and concluded: "This is not a colossus, this is not the big bad wolf, this is not a vigorous and incredibly deft political communicator. This is an old man in decline who's been doing the same schtick for a very long time and it's really wearing thin."
The point, though, as Trump meandered through attacks on immigrants and a diatribe about the fictional character cannibal Hannibal Lecter—who he might think was real—as it always has been, was to present a picture of the U.S. under siege by enemies who are persecuting him because he represents true Americans and that he must be returned to office because only he can vanquish those enemies. Greg Sargent of The New Republic noted that Trump cannot offer a “unity” message because “Trump himself knows the MAGA masses will not be satiated without expansive displays of rage, cruelty and sadism directed at hated out groups and designated enemies of MAGA.”
For years, observers have noted that Trump’s approach to politics is patterned on the “kayfabe” at the heart of professional wrestling. Kayfabe is the performance aspect of professional wrestling, in which the actors play out relationships and scenes in which there are good and evil, love and hate, loyalty and betrayal. According to journalist Abraham Josephine Reisman, in old-school kayfabe the actors never let their masks slip, and while the audience knew what they were seeing must be fake, they played along with the illusion.
But in the 1990s, the barrier between reality and illusion blurred as wrestlers and promoters tried to increase the viability of the fading industry by tossing reality into the performances: real-life insults—the more outrageous the better—and real-life events. Decoding what was real and what was not drove engagement until in 1999, an estimated 18% of Americans, about 50 million people, called themselves fans. This “neokayfabe,” Reisman wrote in the New York Times in 2023, “rests on a slippery, ever-wobbling jumble of truths, half-truths, and outright falsehoods, all delivered with the utmost passion and commitment.”
Neokayfabe, Reisman wrote, “turns the world into a hall of mirrors from which it is nearly impossible to escape. It rots the mind and eats the soul.”
Trump participated in a storyline in this neokayfabe with World Wrestling Entertainment owner Vince McMahon in 2007, in part billed as a battle over hair. Eventually he was inducted into the WWE Hall of Fame, and many observers have made the link between neokayfabe and his approach to politics. Indeed, he even blended the two explicitly when he chose McMahon’s wife, Linda, to head the U.S. Small Business Administration during his presidency.
Neokayfabe and politics came together again last night at the Republican National Convention, as Linda McMahon, wrestler Hulk Hogan, and musician Kid Rock, whose music has been featured at wrestling events and who is also a member of the WWE Hall of Fame, all participated.
“So all you criminals, all you lowlifes, all you scumbags…. Whatcha gonna do when Donald Trump and all the Trumpamaniacs run wild on you, brother?!" Hogan yelled to wild applause after ripping off his shirt to show a Trump-Vance shirt. Like the other performers at the convention, he painted a portrait of Trump’s presidency, and of the United States since Trump left office, that was a fantasy of good and evil. Hogan reinforced that there was no way Trump was going to reach toward unity in Milwaukee. His approach to the world cannot be moderated. It depends on the idea that there are two teams in the performance and one must vanquish the other.
Part of that storyline requires rewriting not just the recent past, but our history. At the convention last night, Donald Trump Jr.’s fiancée, Kimberly Guilfoyle, said: “It is no wonder that the heroes who stormed the beaches of Normandy and faced down communism sadly say they don’t recognize our country anymore.” But the Allied soldiers in World War II were not fighting communism. They were fighting fascism. The three great Allied powers were Great Britain, the United States, and the communist Soviet Union.
It might be that Guilfoyle misspoke, or that she doesn’t know even the most basic facts of our history. Or it might be that by rewriting that history to put America on the side of the fascists, people like Guilfoyle hope to make that alliance more palatable to MAGA followers today.

Published: Sep 13, 2023
On August 25, Texas judge Maria Cantú Hexsel temporarily blocked Senate Bill 14, which limits sex-trait modification procedures—euphemistically called “gender-affirming care”—to adults only. In her decision, Hexsel stated that the law “interferes with Texas families’ private decisions and strips Texas parents . . . of the right to seek, direct, and provide medical care for their children.” In response, the Texas attorney general’s office swiftly filed an appeal with the state’s Supreme Court to halt Hexsel’s injunction, highlighting the “unproven” nature of pediatric sex-trait modification procedures being “pushed by some activists in the medical and psychiatric professions.”
Weeks before the hearing, the Texas attorney general’s office had asked me to serve as an expert witness on the biology of sex. It invited me to respond to a series of false and perplexing assertions made by the plaintiff’s three expert witnesses—including the premise that a person’s sex is comprised of many traits, among them chromosomes, hormones, internal reproductive organs, genitalia, and secondary sexual characteristics, as well as one’s “gender identity.”
In the scientific understanding of sex, only one trait—the type of gamete (i.e., sperm or ova) that someone can, will, or would produce—defines male or female. This is true not only for humans but also for all plants and animals. The other traits mentioned by the plaintiffs’ experts, while related to one’s sex, do not define it. Moreover, the push to include “gender identity” as a defining aspect of being male or female represents an extreme departure from empirical reality in service of a pseudoscientific outlook designed to validate the feelings of people who experience discomfort with their bodies.
Traveling to Austin and appearing before a judge to explain these basic facts was a surreal experience. To my knowledge, this was the first time a biologist has been called to testify in court to defend the material existence of males and females as natural and distinct biological categories. Yet, this isn’t the first time that core principles of biology have been put on trial.
In the 2005 case Kitzmiller v. Dover Area School District, plaintiffs contested a Pennsylvania school district’s policy that mandated teaching the religious concept of Intelligent Design (ID) alongside evolution in biology class. Biologists were summoned to defend the extensive evidence supporting evolution and explain how ID does not meet the fundamental standards of the scientific method: ID is unfalsifiable and relies on supernatural explanations that fall outside the purview of science.
The Kitzmiller case fascinated me, and I followed it closely. In fact, it inspired me to pursue a career as an evolutionary biologist. Over the years, I’ve engaged in debates with numerous creationists and ID supporters. While I didn’t realize it then, confronting these faith-based arguments against the reality of evolution equipped me to handle the current wave of popular anti-science sentiment around the denial of biological sex. Strikingly, the arguments made by sex denialists often mirror those presented by creationists and ID proponents.
In addition to being glaring instances of metaphysics parading as science, both ID and sex denialism rely on a similar “argument from complexity” designed to stun audiences into adopting their perspectives. ID advocates, for instance, contend that biological systems and features are “irreducibly complex,” meaning that they couldn’t have emerged from gradual, unguided processes like natural selection and random mutation and must therefore have been directed by a supernatural “designer” (i.e., God). In a similar vein, gender activists argue that biological sex is so complex and irreducible to any single trait that all efforts to classify individuals as male or female are futile, and people should therefore be allowed to identify as any sex they like.
While both arguments highlight genuine complexities within biology, they misconstrue the actual scientific understanding. In the Kitzmiller case, the presiding judge, a Christian appointed in 2002 by President George W. Bush, saw through the ruse and ruled against teaching ID as science, stating that “ID is a religious view . . . and not a scientific theory.” The denial of biological sex is no different, and its societal impacts are more pervasive and harmful than the denial of evolution.
However, in a twist I could not have anticipated, the same colleagues who once applauded my efforts to defend evolution against creationism and ID now condemn me for challenging the new sex pseudoscience. Evidently, scientists are not the impassive, Spock-like figures that both society and many scientists themselves perceive them to be. They, too, can get wrapped up in ideological and political trends.
Defending the binary nature of sex in court will become increasingly important as more states consider implementing age restrictions on hormonal and surgical sex-trait modification. This is because the depiction of sex as a haphazard collection of sex-related traits—instead of being tied to reproductive function—forms a central tenet of gender ideology. If one determines a person’s sex by tallying various traits, which can range from male-typical to female-typical, it follows that hormonal or surgical modifications can literally shift one’s physical sex along this perceived spectrum to align with that person’s internal “gender identity.” If, however, a person’s sex is immutable, then such interventions lack empirical justification
After I was sworn in and presented my credentials as an expert on the biology of sex, the plaintiff’s lawyers objected that they didn’t understand “the relevance of this witness.” I don’t think they were being insincere: I believe they really did not understand the relevance of natural science to the debate over how to help kids who feel alienated from their bodies. And that, of course, is exactly the problem.
Our Constitution guarantees all Americans the right to direct their lives according to their faith—whether that faith is about a revelation on Mt. Sinai or about sex as a spectrum or about the existence of gendered souls. The Constitution does not, however, immunize doctors from scientific criticism when their own beliefs clash with empirical fact and lead to medical harm. It is essential that scientists find the courage to defend the principles of rationalism and empiricism in the court of law as well as in the court of public opinion to help guide medicine, and our society, back to reality.
==
Another striking similarity is that both ID and gender ideology insist simultaneously that they are scientific - despite being unverifiable and unfalsifiable - and that science only rejects their claims due to intolerance and bigotry.

WASHINGTON, D.C. – The Consumer Financial Protection Bureau (CFPB) today took action against a medical debt collector, Commonwealth Financial Systems, for illegally trying to collect unverified medical debts after consumers disputed the validity of the debts. Under the order issued today, the company will cease operations and pay a $95,000 penalty to the CFPB’s victims relief fund.
Commonwealth Financial Systems is a nonbank corporation with its principal place of business in Dickson City, Pennsylvania. Commonwealth is a third-party debt collector that specializes in the collection of past-due medical debts and furnishes information about consumer collection accounts to consumer reporting companies.
Commonwealth’s actions violated the Fair Credit Reporting Act because the company failed to conduct reasonable investigations of disputed debts and failed to inform consumer reporting companies that certain information was being disputed. Commonwealth also violated the Fair Debt Collection Practices Act because it continued to attempt to collect disputed debts without substantiating documentation.
Enforcement Action
Under the Consumer Financial Protection Act, the CFPB has the authority to take action against entities violating consumer financial protection laws, including the Fair Credit Reporting Act and Fair Debt Collection Practices Act. Under the CFPB’s order, Commonwealth must:
Shut down permanently: Commonwealth is banned from participating in or assisting others in any debt collection activities, debt buying, debt selling, and consumer reporting activities.
Tell consumer reporting companies to delete all information: Commonwealth must request all consumer reporting companies to whom it previously furnished information about any consumer to delete all collection accounts for such consumers.
Pay a $95,000 fine: Commonwealth will pay a $95,000 penalty to the CFPB’s victims relief fund.
Read today’s order.
Tens of millions of people are pursued by debt collectors for medical bills, and the CFPB has described the significant evidence, including reports from consumers themselves, that the collection, furnishing, and reporting of medical bills is plagued by inaccuracies. Accordingly, the CFPB has taken numerous actions on the issue of medical debt. In November, the CFPB issued a report highlighting the challenges American families face when debt collectors pursue allegedly unpaid medical bills. In September, the agency kicked off a rulemaking to remove medical debt from credit reports. Along with the U.S. Department of Health and Human Services and the U.S. Department of Treasury, the CFPB launched, in June, an inquiry into costly credit cards and loans pushed onto patients to pay for health care costs. Also in June, the CFPB took an enforcement action against Phoenix Financial Services for illegal medical debt collection and credit reporting practices.
Read about the CFPB’s rulemaking to remove medical tradelines from consumer reports.
Read about the CFPB’s other work to stop unfair medical debt collection and coercive consumer reporting practices.
Consumers can submit complaints about financial products and services by visiting the CFPB’s website or by calling (855) 411-CFPB (2372).
Employees who believe their companies have violated federal consumer financial protection laws are encouraged to send information about what they know to [email protected]. To learn more about reporting potential industry misconduct, visit the CFPB’s website.

Common Mistakes To Avoid When Using The Pennie Marketplace
Tumblr media
The Pennie Marketplace offers Pennsylvania residents a straightforward way to shop for and enroll in health insurance plans. While the platform is designed for ease of use, navigating health insurance can be complex, and certain missteps can lead to financial setbacks, loss of coverage, or inadequate protection.
This article will explore common mistakes users make on the Pennie Marketplace and how to avoid them to ensure a smooth and informed experience.
Missing the Enrollment Deadlines
One of the most critical mistakes is failing to enroll during the Open Enrollment Period. For 2024, the Open Enrollment Period for Pennie health insurance typically runs from November through mid-January. Missing this window could leave you without coverage for the year unless you qualify for a Special Enrollment Period due to a qualifying life event, such as marriage, childbirth, or job loss.
How to Avoid:
Set reminders for the Open Enrollment Period and any relevant deadlines. If you experience a qualifying event, act promptly to secure coverage.
Not Understanding Eligibility for Subsidies
Many users miss out on financial assistance because they assume they don’t qualify. Pennie provides subsidies based on income and household size, including premium tax credits and cost-sharing reductions. Failing to explore these options can result in overpaying for your plan.
How to Avoid:
Use Pennie’s built-in calculator to estimate your eligibility for financial assistance. Double-check your income details to ensure accurate calculations.
Providing Incorrect or Incomplete Information
Errors in your application, such as incorrect income estimates or family details, can delay enrollment or lead to an incorrect subsidy amount. These mistakes can result in higher premiums or even repayment of tax credits.
How to Avoid:
Gather all necessary documents, including income verification, Social Security numbers, and immigration documents if applicable, before starting your application. Double-check every detail before submission.
Choosing the Wrong Plan Type
Selecting a plan without fully understanding the coverage can lead to dissatisfaction. For example, choosing a plan with the lowest premium may seem cost-effective but could result in high out-of-pocket costs if you require frequent medical care.
How to Avoid:
Evaluate your healthcare needs, including anticipated doctor visits, prescriptions, and specialist care. Compare plan options based on premiums, deductibles, co-pays, and out-of-pocket maximums to find a balance that works for you.
Ignoring Provider Networks
Not all health plans on Pennie include every doctor, hospital, or specialist in their network. Choosing a plan without verifying the network can lead to unexpected costs if your preferred providers are out-of-network.
How to Avoid:
Check the provider network for each plan before enrolling. If you have a preferred doctor or specialist, confirm they are in-network to avoid surprise bills.
Overlooking the Auto-Renewal Process
While auto-renewal can simplify coverage, it might not always select the best plan for your changing needs. Your plan's premiums, coverage, or subsidies may change annually, leaving you with a plan that no longer suits you.
How to Avoid:
Review your plan and subsidy details annually during the Open Enrollment Period. Compare available plans to ensure you are getting the best coverage for your needs.
Underestimating the Importance of Preventive Care
Some individuals opt for minimal coverage plans without considering the preventive care services covered at no additional cost. Skipping these services can result in avoidable health issues and expenses.
How to Avoid:
Understand that all Pennie Marketplace plans cover preventive services like vaccinations, screenings, and annual check-ups. Take advantage of these benefits to maintain your health.
Failing to Report Life Changes
Changes in income, family size, or employment status can significantly impact your eligibility for subsidies or even your plan’s cost. Failing to report these changes promptly may result in inaccurate subsidies or loss of coverage.
How to Avoid:
Notify Pennie immediately of any life changes. Regular updates ensure you receive the correct financial assistance and remain compliant with tax regulations.
Not Seeking Help When Needed
The Pennie Marketplace provides resources, including trained assisters and brokers, to help you navigate the enrollment process. Attempting to go it alone when unsure can lead to costly mistakes.
How to Avoid:
Reach out to Pennie’s customer support or find a certified assistant or broker in your area. They can guide you through the process and answer specific questions about coverage.
Failing to Budget for Out-of-Pocket Costs
While subsidies can make premiums affordable, users often overlook deductibles, co-pays, and other out-of-pocket costs, leading to financial strain during the year.
How to Avoid:
Consider all costs associated with a plan, not just the premium. Budget for potential healthcare expenses throughout the year.
By avoiding these common mistakes, you can make the most of the Pennie Marketplace and secure a health insurance plan that meets your needs and budget. Proper planning, careful attention to detail, and utilizing available resources can help you navigate the enrollment process with confidence.
