FAMILY CODE OF THE PHILIPPINES

TITLE : MARRIAGE

Article 2: No marriage shall be valid, unless these essential requisites are present.

1. Legal capacity of the contracting parties who must be a male and a female;and

2. Consent freely given in the presence of the solemnizing officer

Article 3: The formal requisites of marriage are:

1. Authority of the solemnizing officer;

2. A valid marriage license except in the cases provided for in chapter 2 of this Title;and

3. A marriage ceremony which takes place with the appearance of the contracting parties before the solemnizing officer and their personal declaration that they take each other as husband and wife in the presence of not less than two witnesses of legal age.

Article 4: The absence of any of the essential requisites shall render the marriage void ab initio,except as stated in Article 35(2)

A defect in any of the essential requisites shall render the marriage voidable as provided in Article 45

An irregularity in the formal requisites shall not affect the validity of the marriage but the party or parties responsible for the irregularity shall be civilly, criminally and administratively liable

Facts:

The accused marry Maria Gorrea in Cebu City. While his wife was still living, he also married Maria Faicolin Iloilo City. Gorrea died in Cebu City on August 5, 1939.After said death, the accused brought Maria Faicol to Cebu City only to suffer injuries to her eyes becauseof physical maltreatment in the hands of the accused. And on January 22, 1953, the accused sent MariaFaicol to iloilo, allegedly for the purpose of undergoing treatment of her eyesight.During her absence, the accused contracted a third marriage with a certain Jesusa C. Magsalang onOctober 3, 1953, in Cebu.

Issue:

Controlling: Whether or not Proceso Aragon’s second marriage is valid

 General: Whether or not the accused (Proceso Aragon) is liable for bigamy under Article 349 of theRevised Code

Ruling:

No. The accused was freed from the special contract of marriage when his first wife died, however, thesecond marriage is illegal and void because the marriage was contracted while his first wife was stillsubsisting.The statutory provision (section 29 of the Marriage Law of Act 3613) plainly makes a subsequent marriagecontracted by any person during the lifetime of his first spouse illegal and void from its performance, andno judicial decree is necessary to establish its validity, as distinguished from mere annullable marriages.(

No, Article 349 of the Revised Code punishes only 'any person who shall contract a second or subsequentmarriage before the former marriage has been legally dissolved.' Since the complaint was instituted bythe second wife, whose marriage with the Proceso Aragon was void because it was not renewed after thedeath of the first wife and before the third marriage was entered into, the prosecution for bigamy cannotprosper. Notably, the last marriage was a valid one.For the foregoing considerations, the judgment appealed from is hereby reversed and the defendant-appellant acquitted, with costs de officio, without prejudice to his prosecution for having contracted thesecond bigamous marriage. Charles wasn't the relationship type he was always more focus on his future career, thus he never truly had the time nor wanting to have a relationship. Especially considering that with his family name attached he never knew if the women were more interested in his money or more in him. Most the relationship he ever had were shallow and he new deep down that he never truly gave them, her his entire time or was fully committed to this relationship. Her, Julia, only remembered him as this soothing memories, as her first love but after him she actually entered a relationship that she thought was gonna last forever she was ready to marry him, she actually had the entire day planned in her head but she never said anything because she didn't want to sound crazy they were still young and studying. She was pretty heartbroken especially considering the plan they had made and the fact that he had cheating on her, she felt like she lost her time with him. When they meet again, they fall into this bandwagon of those finding memories, but this exchange led to something more complicating and unexpected situation that would lead them to rethink their lives and what they truly wants not only in love but also when it comes to their families.
