As a night shift girlie, my girlfriend got to my place around lunchtime and spent the day sleeping til midnight. I didn't mind. I know how tired she gets at work and I'm happy to spend time with her even if it meant just staring at her in her sleep. She woke up at midnight, at syempre naghanap ng food haha. We wanted to try the midnight buffet in BGC, unfortunately it was already closed by the time we got there (not sure if closed lang sila the day we went there or talagang hindi na offered yung midnight buffet) so we searched for other options and found this Premier branch that operates 24/7. It offers unli Samgyupsal and hotpot. My girlfriend invited my brother (who stays with me during the holidays). It's just so cute to watch a foodie eat! (My brother majors in culinary and is always down for food trip.)

1624H | Route 95 Diner, Makati

Since I've been practicing OMAD (bc of recent medical concerns), sinabayan ako ni girlfriend kumain that day lmao. We went to this diner that offers unli platter of chicken, sausage, ribs, and Salisbury steak. Serving was hefty that I was only able to ask for a refill of the Salisbury steak and half of the ribs. The sausage was hard to finish though kasi di ko gusto yung taste huhu sorry. The rest of the food were good naman.

Also, really nice interiors and we were the only guests when we arrived. Unfortunately there's a group of friends that came in about 20mins after and istg these folks lack etiquette sa lakas ng boses at tawanan myghad. My girlfriend is seated right next to me but we struggle to have a conversation since we can barely hear each other's voices. We wanted to try their desserts pero we decided to leave na lang after dinner.

Since I'm still craving for ice cream, we went to Farmacy for a quick fix. Got there around 2034H then headed to the Taguig TLC Park to see the Christmas Village. Unfortunately, we did not anticipate the traffic and got there at 2243H, which left us only about 10 mins and we were not able to have a full tour of the place. Will try to come back again next time.

Today was miserable. Today was pleasant. Today was dark. And today was harrowing. Has a segment of..you know..the news ever stick out to you? Like it stays with you for a bit because you were a part of it? Not directly but you saw the catastrophe and you're doomscrolling at 2 am looking at yourself in a 3rd perspective. TV Patrol did a little segment on an incident at Makati today.

The report ate at me for hours. Different people, cameras, screams, and voices saw that glowing thing that was atop the building of the studio.

Maybe, just maybe my translated description of the news clipping does it any justice.

"A MYSTERIOUS GLOWING PERSON WAS FOUND ALL AROUND MAKATI CITY BEGINNING AT 5:37 PM AS POSTED BY NETIZENS.

According to our vigilant Kapamilya Netizens, a woman who appeared to be glowing like a lightbulb appeared suddenly on the top floor of ECH Building on Makati Avenue. She was standing on the edge of the building, flocking concerned citizens around the area she might fall into, convincing her to not take the leap. Suddenly, she disappeared as if she had not been there in the first place. The fast food restaurant and travel agency lost electricity shortly after her disappearance followed by the power interruption of several other connecting buildings on Jupiter Street.

"WAG KA DIYAN ATE! MARAMI KA PA MAGAGAWA SA BUHAY!" ("Don't go there, ma'am! There's still a lot you can do with your life!") [The video shakes as it zooms up to the setting sky broken by a sharp light green and blue light. The woman's glowing long hair flows in the wind as she looks down wordlessly]

"TAWAG TAYO NG PULIS!" ("Let's call the police") [The video taker turns to his companion who's dialing on his phone an emergency contact.

"WAIT LANG ATE! WAG KANG TATALON-- HA?! NASAAN NA SI ATE!?" ("Wait a moment, Ma'am! Don't jump-- Ha?! Where did she go!?") [Suddenly the woman is gone and the video taker leaves with the impression she left on her own or jumped. The noodle shop on the ground floor's lights spark then die].

In this video taken by another Kapamilya posted on X, the glowing woman is seen again on a building on Ayala Avenue. People plead for her to not jump, but she disappears again, worrying and frustrating many by leaving them confused and scared for her safety. The commercial building hosts 24 offices- temporary work agencies, printing and publishing offices, and an animation studio. These as well as this noodle chain branch were affected by a power interreuption leaving many works lost or unsalvagable.

"Ano yun?! May shooting star ba? Ang ganda pero bakit ang lapit niya?" ("What's that?! It's so pretty but why is it so near?") [The video is taken from a cafe in Legazpi village on the 3rd floor of a commercial building. It spots the glowing lady on top of the Makati Diamond Residences before it disappears like a signal]

"Ay, nawala na siya. Baka radio tower lang yan pero nag-twitwinkle siya parang star." ("Ay, it disappeared. Maybe it was just a radio tower but its light was twinkling like a star.") [Moments later the woman yells as the electricity gives out, immersing the video in black].

The electricity had also disappeared in majority of Legazpi Village. In this video by mary-janie-cutie, she witnesses what seems to be another apparation of the glowing lady going off and on a building, leaving it powerless and tumbling a domino effect.

And on 8:24 pm, the glowing lady was seen on the edge of the logo of a clothing store's flagship store in Ayala Centre. Security guards, police, firefighters, and people gathered around the building to beg it to come down. The security guard of the clothing store first spotted them on the edge and called for emergency services. But just like all efforts to save the woman, she disappeared and shut down all the lights and electronics of the Glorietta mall, SM Makati, One Ayala, Greenbelt, and even MRT stations Buendia to Ayala. Operations are postponed until further repairs are made.

Over 70,000 individuals were affected by the power interruptions and over 40+ hours of work were lost. As of right now, people are still being evacuated, rescued, and even some needed to be transported to hospitals due to injuries.

Hey, hey! It’s me! 😁 And welcome back for another installment of "My Wangan Maxi Tune Career"! I returned in 2022, and now I'm continue it, this 2024. Yes, it's been a while. I haven't shared my WMMT's play progress in this current year, with the last record I posted was on May 31st, 2023 (Pls, go check it out in the "previous" section) before it went into troubles. And by that, I'm talking about my PC desktop problem. *sigh* 😫😔 Nevertheless, I have now SO MANY photos and screenshots that need to be uploaded on my current social media sites right away before I move on to my current update.

• [1st to 3rd Images] June 19th, 2024, I'm here at the specific TZ Arcade branch in Araneta City Gateway Mall II, with my two beloved paper dolls (🐻👨‍🍳 Chowder & Panini 🐰👩‍🍳). Upon entering the said mall and TZ branch, the atmosphere was pretty nice and clean, much like I visited every TZ branch. Anyway, I've redeemed the ₱200 free Power Load coupon through my gold membership TZ Power Card 💳🕹️😁, with an additional ₱150 load for a good measure 💵. However, there's one problem though... There's no Wangan Maxi Tune cabinet at this particular TZ branch. 😥 Damn, it'll be better if I play it inside this awesome atmosphere, alas it ain't happened. 😓 So, should go back to Trinoma where I previously played? 🤔 Nah, because as far as I know, there's another TZ branch located somewhere at the huge "Araneta City" mall. So, I venture myself to search for another TZ branch with my trusty Google Maps app 🗺️📲, in about a 1 hour ⌚.

• [4th to 6th Images] And said an hour later, I finally found another TZ branch located at the OG Gateway Cinema. 🎞️🕹️😃 Huh, you know what, the layer reminds me of going to the Ayala Glorietta mall in Makati City, where there's a TZ branch beside the Cinema. And that was my "Real Life Story". 😁📖 I was in my High School days 🧑‍🎓🏫 (3rd year High School to be specific; 2010 to 2011) when my former BF ("Best Friend") 👤 invited me to a meet-up for playing a music rhythm arcade game (named "DJ MAX Technika" 👇🎶🎧) at the aforementioned Glorietta TZ branch, which I suck at it. But, I was also playing my debuted "Wangan Maxi Tune 3DX Plus" 🚘🌃🛣️ arcade, which is my preferred over that music rhythm. 😊 Yeah, who doesn't love playing arcades after watching an awesome movie (say the new upcoming Disney movies, etc..). I've been there, but I never actually attempted that in my life. 😥 As for the actual arcade branch, it matches my memories back in 2012 😊, and no doubt this is one of the most unique branches unlike the Glorietta branch because besides the TZ branch was this Taco Bell / Pizza Hut stand, which is an awesome nice touch if I want it to grab something delicious Taco/Pizza from the "Yum" brands! My paper dolls loves eating Taco/Pizza! Yum! 🌮🍕😋 Sadly, I don't have funds for ordering food. Bummer... 😥😓

In Relation to Article 91 What Constitute Community Property

FACTS: 

Private respondent Natividad Calaunan-Uy was the common-law wife of the late Menilo B. Uy, Sr., for about thirty-six (36) years. Their union bore four children — Melito, Jr., Nilda, Melvin and Merlito — all surnamed Uy.

On October 31, 1990, soon after the death of Menilo Uy, Sr., petitioners Tshiate Uy and Ramon Uy initiated before the Regional Trial Court (RTC), Branch 65, Makati, Metro Manila. Special Proceedings entitled "In the Matter of the Petition for Letters of Administration of the Estate of Menilo B. Uy, Sr."

On 28 February 1991, private respondent filed a motion to hold the special proceedings in abeyance. The day before, or on 27 February 1991, private respondent filed for "Partition of Properties Under Co-ownership," against the Estate of Menilo Uy, Sr. (supposedly represented by their four children).

Petitioner Tshiatel Uy filed an omnibus motion, alleging that by virtue of a Hong Kong marriage, she was the surviving legal spouse of Menilo, Sr. She prayed that she and her son Ramon Uy be allowed to intervene in the civil case, submitting at the same time their answer in intervention.

ISSUE:

Whether or not Co-Ownership can be claimed by the alleged surviving spouse.

HELD:

The decision of the court was set aside reinstating the order of the trial court. The action of partition is predicated on the alleged co-ownership between Natividad and Menilo, the property evidently acquired during the period of their common-law relationship.

Art. 147 - When a man and a woman who are capacitated to marry each other, live exclusively with each other as husband and wife without the benefit of marriage, their wages and salaries shall be owned by them in equal shares and the property acquired by both of them through their work or industry shall be governed by the rules of co-ownership.

Pinoy Chef YouTuber and a former PIE Channel celebrity host makes its homemade version of 'MrBeast Burger'

MAKATI, MANILA -- A former PIE Channel celebrity host of "Swerteng Sulpot" named Ninong Ry, whose real name as Ryan Morales Reyes makes a homemade version of a viral fast food chain called "MrBeast Burger". This was after he left to assign the first interactive television channel in late mid-July 2022, before shifting to the online cooking tutorial content on his own YouTube channel.

MrBeast Burger, a food chain named after Jimmy Donaldson, also known as "MrBeast", a North Carolina YouTuber who founded a virtual restaurant brand, making a flagship fast food chain originated in Wilson City, the said state in America last December 2020. Filipinos introduced into the aforesaid fast food chain in Makati City, Metro Manila; just a several months after the branches expanded in Australia and United Kingdom to serve franchise internationally. The viral burger company became an internet sensation, due to uniqueness, massive size and richest flavor.

At the start of demonstration, Reyes started his homemade cooking process by simply toasting brioche buns to be associated with butter, followed by the smash-style patties, which were cooked to perfection. The burger condiments featuring fresh pickle relish, onion and sliced cheese, which were finely layered for a perfect texture and flavor, as stated from Ninong Ry's YouTube video.

The burger's uniqueness lies in the use of their homemade "special sauce", consisting of ketchup, mayonnaise and mustard, combined with a minor disclosed ingredient that they refused to reveal as a pre-caution without using its trade secrets in this video platform. OneNETnews cannot independently verify the authenticity per the actual sake of homemade cooking tutorials online.

The brand is expected to develop even more with the support of one particular influencer like Reyes. The said YouTube video received thousands of views, with viewers lauding the successful outcome and expressing interest by trying it out to yourself at home.

Per successful self-taping of their homemade MrBeast Burger's cooking tutorial video, he was planned to create more culinary creations for their respective channels, with the inspiration of "MrBeast" himself in the United States of America.

Secret Recipe has two branches in the Philippines, and I checked out the one in Makati since it is the one nearest to my workplace—it really didn't disappoint! The spot has a super aesthetic, chill vibe that's perfect for just hanging out. With the flower ceiling and cursive font menu. The menu mixes up Asian flavors—from Singaporean and Thai to Malaysian and Filipino dishes—so there's something for everyone. Whether you're coming with a big family or just looking for a cozy date night, the place is spacious enough for all. And for the little ones, they've even got a dedicated Kid's Menu that really amps up its family-friendly appeal. Just a heads-up, though: the prices are on the higher side, which makes sense given its prime location in the heart of the metro at one of Makati's busiest malls.

Article 102. Upon dissolution of the absolute community regime, the following procedure shall apply:

(5) The presumptive legitime’s of the common children shall be delivered upon partition, in accordance with Article 51.

(6) Unless otherwise agreed upon by the parties, in the partition of the properties, the conjugal dwelling and the lot on which it is situated shall be adjudicated to the spouse with whom the majority of the common children choose to remain. Children below the age of seven years are deemed to have chosen the mother, unless the court has decided otherwise. In case there in no such majority, the court shall decide, taking into consideration the best interests of said children. (n)

Facts:

     The case at hand involves Johnson & Johnson (Phils.), Inc. as the petitioner and Alejo M. Vinluan, along with his wife Delilah A. Vinluan, as the respondents. The events leading to this case began in 1982 when Delilah Vinluan, operating under the name "Vinluan Enterprises," purchased products from Johnson & Johnson for her retail business. Over time, she incurred a debt amounting to P235,880.89, which she attempted to settle through several checks that ultimately bounced due to insufficient funds. Despite multiple demands for payment and extensions granted by Johnson & Johnson, the debt remained unpaid, prompting the corporation to file a complaint for collection on June 8, 1983, in the Regional Trial Court of Makati, Branch 137, which was docketed as Civil Case No. 4186.

     On February 5, 1985, the trial court ruled that Delilah Vinluan was solely liable for the debt, as there was no evidence of her husband’s consent to the obligations incurred by her, nor was there any benefit to the conjugal partnership from her business activities. The court dismissed the counterclaim of the Vinluan spouses for lack of merit. Following this decision, a writ of execution was issued on February 3, 1989, to enforce the judgment against Delilah's properties. However, the Provincial Sheriff of Rizal issued notices of levy that included not only Delilah's paraphernal properties but also the conjugal properties owned by both spouses. Alejo Vinluan filed a third-party claim to contest the levy on the conjugal properties, asserting that the trial court's earlier decision had absolved him of any liability for his wife's debts. The trial court denied his motion to quash the levy, leading to an appeal to the Court of Appeals, which ultimately ruled in favor of Alejo Vinluan, declaring the levies on the conjugal properties null and void.

Issues:

Can a husband be held liable for the debts incurred by his wife without his consent and which did not benefit the conjugal partnership?

Is a judgment declaring a wife solely liable for her debt’s executable against conjugal property over the objection of the husband?

Ruling:

     The Supreme Court ruled in favor of Alejo M. Vinluan, affirming the decision of the Court of Appeals. The Court held that the trial court's orders to levy on the conjugal properties were null and void, as the husband could not be held liable for his wife's debts that were incurred without his consent and did not benefit the conjugal partnership.The Court reiterated that the obligations incurred by Delilah Vinluan were solely her responsibility, as the trial court had previously established that there was no privity of contract between Johnson & Johnson and Alejo Vinluan. The Court further noted that the trial court's decision had become final and executory, and any subsequent orders attempting to levy on the conjugal properties were improper as they contradicted the final judgment. The ruling underscored the principle that a final judgment is immutable and unalterable, and the execution of such a judgment must strictly adhere to its terms. The Court concluded that since the obligations did not benefit the conjugal partnership and Alejo Vinluan did not consent to his wife's business dealings, the conjugal properties could not be subjected to execution for her debts.

Ricarze v. Court of Appeals [GR No. 160451 (09 February 2007)]

A collector-messenger accused of estafa through falsification of commercial documents challenges the substitution of the offended party and the validity of the Informations filed against him, leading to a Supreme Court decision affirming the Court of Appeals' ruling that the substitution was not a substantial amendment and the allegations in the Informations were sufficient to identify the offense charged.

Facts:

Petitioner Eduardo G. Ricarze was employed as a collector-messenger by City Service Corporation, assigned to Caltex Philippines, Inc. (Caltex) in Makati City.

His duties included collecting checks payable to Caltex and delivering them to the cashier, as well as delivering invoices to Caltex's customers.

On November 6, 1997, Caltex, through its Banking and Insurance Department Manager Ramon Romano, filed a criminal complaint against Ricarze for estafa through falsification of commercial documents.

An internal investigation revealed that a company check (Check No. 74001) dated October 13, 1997, for PHP 5,790,570.25, had been cleared with forged signatures.

Further investigation uncovered two other missing checks and another check (Check No. 72922) dated September 15, 1997, for PHP 1,790,757.25, also cleared with forged signatures.

These checks were deposited at Banco de Oro's SM Makati Branch under a savings account in the name of Dante R. Gutierrez, who disowned the account and signatures.

It was discovered that Ricarze had opened the savings account using Gutierrez's name and deposited the forged checks.

A bank teller from Banco de Oro identified Ricarze as the person who opened the account.

Despite PCIB crediting PHP 581,229.00 to Caltex on March 29, 1998, the City Prosecutor of Makati City was not informed.

After a preliminary investigation, two Informations for estafa through falsification of commercial documents were filed against Ricarze on June 29, 1998, before the RTC of Makati City, Branch 63.

Ricarze was arraigned on August 18, 1998, and pleaded not guilty.

The cases were jointly tried, and the prosecution presented its witnesses.

The Siguion Reyna, Montecillo, and Ongsiako Law Offices (SRMO) later entered its appearance as private prosecutor representing PCIB, which Ricarze opposed, arguing that the private complainant was Caltex, not PCIB.

The RTC allowed the substitution of PCIB as the private complainant, which Ricarze contested, leading to a petition for certiorari with the Court of Appeals (CA).

The CA dismissed the petition, affirming the RTC's orders.

Ricarze then filed the present petition with the Supreme Court.

Issue:

Whether the substitution of PCIB as the private complainant for Caltex constitutes a substantial amendment of the Informations, which is prohibited after arraignment.

Whether the substitution of PCIB as the private complainant prejudices the rights of the petitioner.

Whether there was a valid subrogation between Caltex and PCIB.

Whether the Informations filed against the petitioner are defective and void due to false allegations.

Whether the petitioner timely objected to the appearance of SRMO as private prosecutor for PCIB.

Ruling:

The substitution of PCIB as the private complainant for Caltex does not constitute a substantial amendment of the Informations.

The substitution of PCIB as the private complainant does not prejudice the rights of the petitioner.

There was a valid legal subrogation between Caltex and PCIB.

The Informations filed against the petitioner are not defective and void due to false allegations.

The petitioner did not timely object to the appearance of SRMO as private prosecutor for PCIB.

Ratio:

The Supreme Court held that the substitution of PCIB as the private complainant for Caltex did not constitute a substantial amendment of the Informations.

The substitution did not alter the basis of the charge in both Informations, nor did it result in any prejudice to the petitioner.

The documentary evidence, including the forged checks, remained the same, and all such evidence was available to the petitioner well before the trial.

Therefore, the petitioner could not claim any surprise by virtue of the substitution.

The Court also found that there was a valid legal subrogation between Caltex and PCIB.

Subrogation is the transfer of all the rights of the creditor to a third person, who substitutes him in all his rights.

In this case, PCIB was subrogated to the rights of Caltex when it re-credited the amount of the checks to Caltex.

This legal subrogation occurred by operation of law and did not require the petitioner's consent.

The Court further held that the Informations filed against the petitioner were not defective and void due to false allegations.

The designation of the name of the offended party is not absolutely indispensable for as long as the criminal act charged in the complaint or information can be properly identified.

The Court cited the case of People v. Yu Chai Ho, where it was held that the erroneous allegation in the complaint that the unlawful act was to the prejudice of the owner of the check, when in reality the bank which cashed it was the one which suffered a loss, was immaterial.

Lastly, the Court found that the petitioner did not timely object to the appearance of SRMO as private prosecutor for PCIB.

The RTC had acknowledged the entry of appearance of SRMO on October 8, 1999, and the petitioner did not question it at that time.

Therefore, the petitioner's objection was considered untimely.

The Supreme Court denied the petition and affirmed the decision and resolution of the Court of Appeals, remanding the case to the Regional Trial Court of Makati City, Branch 63, for further proceedings.

Let’s start with their Greenbelt exclusives, which you won’t find in any of their other branches.

The Black Pepper Beef was a standout for me. Tender, juicy beef coated in a savory black pepper sauce, it had just the right balance of spice and flavor to keep you reaching for more.

Then there’s the Spicy Szechuan Crispy Chicken, which is every spice lover’s dream! Crispy, fiery, and packed with those unmistakable Szechuan flavors.

For a sweeter contrast, the Stir-Fried Pork Rib in Honey Sauce was an absolute delight. The pork ribs were fall-off-the-bone tender, with a crispy coating that soaked up the sticky, sweet honey glaze beautifully.

Pair it with the La Mian noodles in Signature Pork Bone Soup, a rich, comforting bowl of hand-pulled noodles exclusive to Greenbelt when served with a Crispy Pork Chop, which was sooo tender and flavorful.

Of course, no visit to Paradise Dynasty is complete without their signature Xiao Long Bao. This iconic dish features eight different flavors of xiao long bao, each one bursting with its own unique twist. Each bite was like a tiny explosion of flavor in your mouth! If you’ve never tried flavored xiao long bao, this is where you start.

Other dishes that wowed us included the Lettuce Roll with Homemade Sesame Sauce, a simple yet refreshing, crunchy appetizer that’s perfect for kicking off the meal.

Then there was the Scrambled Egg White with Fish and Conpoy, a delicate dish that’s light yet packed with umami thanks to the dried scallops (conpoy).

One of my personal favorites was the Crispy-fried Crystal Prawns tossed with Salted Egg Yolk. This dish was the perfect marriage of creamy salted egg yolk and crunchy prawns. Paired with the Yang Zhou-Style Fried Rice, it made for a complete and satisfying combination.

We ended our meal with two unforgettable desserts. The Black Sesame Glutinous Rice Ball in Ginger Soup was warm, comforting, and spicy, with that deliciously nutty black sesame filling oozing out of the chewy rice balls.

And if you’re more into cool, fruity flavors, the Chilled Mango Pudding is a must-try. It’s smooth, creamy, and perfectly sweet! It’s a refreshing finale to an indulgent meal.

BREAKING OVERNIGHT: British Hairstylist and Salon Owner "David's Salon" dies at 69

MAKATI, NATIONAL CAPITAL REGION -- 'David Charlton', the founder of David's Salon, and a respected figure in the independent hair care world has sadly passed away at the age of 69 last Tuesday (October 29th, 2024 -- Makati local time). The salon's management confirmed this tragic news on their social media platforms, and it has left the beauty community were shattering and heartbroken.

It began for Mr. Charlton in the world of hairdressing in Europe, way back when he was as young at the age of 16, and hails originally from 'Sunderland, England' in the United Kingdom. He opened a salon in the Philippines in 1978, while still sometime during the country's Martial Law under the previous late administration of 'Ferdinand Emmanuel Edralin Marcos Sr.'. As the name suggests, after working at a salon prior to its opening in 1989, he took on a vision to service the masses with quality services in an affordable price, which led to the establishment of the said independent hair care company.

Under his leadership, David's Salon now boasts close to 250 branches nationwide and abroad. One flagship store is located in 'Makati City, National Capital Region', while another is right here on the 2nd Floor of Robinson's Place Dumaguete in Brgy. Calindagan of Negros Oriental. Under his strong commitment to quality and customers, he won the hearts of the market.

Charlton's death has been linked to a long and brutal battle against a serious health conditions. However, details were not released to the public media at the time of our writing. His wake opens for public viewing starting this week on Wednesday (October 30th) at 2pm until Saturday (November 2nd), while the final mass is set for next Sunday (November 3rd) at 'The Chapels Heritage Park' in 'Carlos Polestico Garcia Avenue, Taguig City, NCR.

He will continue to inspire hairstylists for Filipinos, and their clients to be creative on what you wanna be, as the beauty industry forever bears stamped his memories, not being fully forgotten and yet being retired as a foreign citizen.
