Petition to Deny Parole of Convicted Murderer Jeffrey Whitlock

Petition Text:

Joann "Joanie" Pruitt, a beloved young mother, daughter, sister, and wife, was tragically taken from us on February 1, 1990. Her life was cut short in a senseless and horrific act of cruelty and violence perpetrated by Jeffrey Whitlock, along with James Michael Charping. On that fateful evening, the trio drove Joanie to a secluded area in Lexington County, SC, where she was brutally raped, tortured, and ultimately drowned by Whitlock and Charping. Her murder left a lasting impact on her family, notably her young son, Rick, who grew up motherless and tragically passed away from cancer in 2021 at the same age of his mother, 32. Despite the gravity of Jeffrey Whitlock's crimes, there is a chance he could be granted parole. This thought not only poses an existential threat to public safety but also profoundly undermines the justice served for Joanie's cruel death. Joanie was robbed of the opportunity to see her son grow, and Rick was denied the unconditional love of his mother. Our sorrow and our pain have not faded away with time. We cannot allow this man, whose actions took away an innocent life, to walk free. Our fight has moved beyond seeking justice for Joanie to protecting society from a proven threat. Therefore, we call on the The South Carolina Board of Paroles and Pardons to deny the parole application of Jeffrey Whitlock, Offender #00184875 and ensure he serves the full term of his sentence, for Joanie, for Rick, and for the countless others whose lives have been forever scarred by his actions. Please sign this petition to deny Jeffrey Whitlock's parole and seek justice for Joanie and her grieving family. We truly thank you for your support.

9. The defendants named in paragraph 5(a), (b) and (c) (hereafter referred to as Boston defendants), and their predecessors, have effected racial segregation and discrimination in the Boston public schools and have otherwise denied equality of educational opportunity to black children by acts and practices including, but not limited to:

(a) Adopting and maintaining parent-pupil school selection policies and practices, including open enrollment transfers and optional school attendance zones, which have contributed to pupil racial segregation;

(b) establishing and manipulating district lines, attendance areas for schools and classes, assignments within and among attendance areas, and school feeder patterns in ways promoting racial segregation of students:

(c) transporting pupils to schools in ways promoting racial segregation of students;

(d) establishing and manipulating the organization of schools and grade structures in ways promoting racial segregation of pupils;

(e) adopting and maintaining pupil assignment policies and practices which have built upon and reflected residential racial segregation resulting from public and private discrimination in housing;

(f) administering school capacity, enlargement, and construction policies in ways promoting racial segregation of students;

(g) failing and refusing without justification to adopt, implement, or continue policies reasonably available to remedy pupil racial segregation;

(h) adopting and implementing pupil classification practices which discriminate against some children, in their admission to certain schools, classes, and courses of study, on the basis of their race and color, and which deny to such children, on the basis of their race and color, educational opportunities

Bobby Shoemaker, 90

Mr. Bobby Shoemaker, age 90 of North Wilkesboro passed away Sunday, February 9, 2020 at Hugh Chatham Memorial Hospital in Elkin.

           Graveside services will be held 2:00 PM Friday, February 14, 2020 at Arbor Grove Baptist Church Cemetery with Rev. Lane Roark officiating.  

           Mr. Shoemaker was born March 15, 1929 in Wilkes County to Robert McKinley Shoemaker and Addie Mastin Shoemaker.  He was a retired carpenter, first working for Foster Sturdivant Construction Company on projects that included the Reins-Sturdivant Chapel and Arbor Grove Baptist Church.  He was also a brick and block mason and helped to build the racing garages for race car owner Junior Johnson in Ingle Hollow. He also worked alongside his two brothers to build many homes in Wilkes County.   He loved to hunt and raised beagle dogs for many years. His greatest joy was his family and especially his grand and great grandchildren.  

           He was preceded in death by his wife of 69 years, Vecie Hall Shoemaker, his parents, two sisters R.V. (Robert Virginia) Bowman and Agnes Alexander, two brothers; Bruce Shoemaker and Edward (Dink) Shoemaker and a son-in-law; Mike Cannon.

           Mr. Shoemaker is survived by two daughters; Lynn Shoemaker Dyer and husband Danny of Millers Creek, Diane Shoemaker Cannon of Wilkesboro, a son; Bobby F. Shoemaker and wife Pam of North Wilkesboro, four grandchildren; Robin D. Hamby and husband Matt, Amber C. Shumate and husband Andy, Ashley D. Cannon and fiance' Bobby Sheets and Adam P. Shoemaker, six great grandchildren; Aaron and Adrienne Hamby, Emeliegh and Ashlyn Shumate, Dawson and Gage Sheets, and a sister-in-law; Ruth Shoemaker, and his special friend and caregiver; Debbie Whitley.

 Gene Stewart 89

Mr. Gene Ray Stewart age 89 of North Wilkesboro passed away Sunday, February 9 2020 at his home.

           Funeral Services will be held at 2:00 PM Wednesday February 12, 2020 at Welcome Home Baptist Church with Rev. Lyn Lambert, Rev. John Triplett, Rev. Jeff Collins, and Rev. Dean Crane officiating.  The family will receive friends from 12:00 to 1:30 PM prior to the service at the church. Burial with Military Honors by Veterans of Foreign Wars Post 1142 will be held in Welcome Home Baptist Church Cemetery

           Gene was born August 18, 1930 in Watauga County to Edward "Eddie" and Blanche Luther Stewart. He served in the United States Army in the Korean Conflict. He was a graduate of Clevinger Business School.  He retired from Holly Farms Poultry/Tyson Foods as a manager in the accounting department. Gene was a member of Welcome Baptist Church where he served as Secretary-Treasurer for many years.

           Mr. Stewart was a member of the Silver Striders through the YMCA. He loved fishing, gardening and spending time with his grandchildren.  He was a devoted husband, father, and grandfather. He was a faithful church member and was known for his mild mannered spirit. Gene was a Tarheel Fan and Braves Fan, and loved watching his grandkids involvement in sports. He enjoyed watching West Wilkes Basketball.

           In addition to his parents, he was preceded in death by his wife, Opal Faw Stewart, and two brothers, John Stewart, and Jimmy Stewart.

           He is survived by a daughter Jeannie Stewart Stinson and husband Joel of North Wilkesboro, two sons, Stephen Ray Stewart and girlfriend Jayme Love of Statesville, and Reverend Dean Crane and wife Betty of Purlear, seven grandchildren Lucas Stinson, Jackson Stinson, Mackenzie and Christopher Stewart, Matthew Crane, Adam Crane, Josh Crane seven great grandchildren and three sister in-laws; Bonita Greene Stewart of Wilkesboro, Linda Stewart of Lenoir, and Babe Faw of Wilkesboro.

 Jesse Church, 83

Jesse Carson Church, age 83, of North Wilkesboro, passed away, Saturday, February 8, 2020 at his home. Jesse was born April 11, 1936 in Wilkes County to George and Nettie Adams Church. He was of the Baptist Faith. Mr. Church was preceded in death by his parents; and brothers, Albert, Marvin, Clayton and Richard Church.

           Surviving are his wife, Mary Catherine Cooper Church; several nieces and nephews.

           Memorial service will be held 3:00 p.m. Sunday, February 16, 2020 at Harvest Time Fellowship Church, 2865 Elkin Highway 268, North Wilkesboro, NC 28659 with Rev. Tom Lineberger and Rev. Steve Rose officiating. The family will receive friends at Harvest Time Fellowship Church from 1:00 until 3:00 on Sunday, prior to the service.  Clarence Carty, 86

Mr. Clarence Ray Carty, age 86 of Wilkesboro passed away Sunday, February 9, 2020 at Accordius Health at Wilkesboro.

           Funeral services will be held 2:00 PM Wednesday, February 12, 2020 at Edgewood Baptist Church with Pastor Eddie Tharpe officiating. Burial will be in Edgewood Baptist Church. The family will receive friends from 1:00 until 2:00PM prior to the service at the church.

           Mr. Carty was born September 24, 1933 in Washington County, VA to Maiden and Ella Mae Holbrook Carty.

           In addition to his parents he was preceded in death by a granddaughter, Valerie Teague, and a grandson, Jonathan Teague, and thirteen brothers and sisters.

           He is survived by two sons; Jeffrey Lynn Carty and wife, Gigi of N.Wilkesboro and Timothy Ray Carty and wife, Vicki of North Wilkesboro, nine grandchildren; Misty Davis and Alex, Mindy Teague and Drew, Tasha Summerford and Dan, Christina Harrold and James, Shonna Davis, Tabitha Carty, Rebecca Minton and Anthony, Brandi Linville and Kenneth, Samantha Carty and Michael, and sixteen great grandchildren.

Raydell Blackburn, 80

Raydell Billings Blackburn, age 80, of Mulberry, passed away Sunday, February 9, 2020 at Wake Forest Baptist Health-Wilkes Regional. Raydell was born March 18, 1939 in Wilkes County to John and Nellie Key Billings. Mrs. Blackburn was preceded in death by her parents; sister, Shirley Billings Miles; and nephew, Ronnie Elmore.

           She is survived by her husband, Clyde Blackburn; daughter, Karen Blackburn Earp and spouse George of Hickory; son, Brent Blackburn and spouse Erica of Mulberry; brother, Danny Billings of Mulberry; grandchildren, Julia Golden and spouse Matt, Justin Earp, Claire Earp, Olivia Blackburn, Lilly Blackburn; great grandchildren, Embry and Violet.

           Funeral service will be held 2:00 p.m. Saturday, February 15, 2020 at Mountlawn Memorial Park Mausoleum Chapel with Pastor David Jones officiating. Burial will follow in Mountlawn Memorial Park. Flowers will be accepted. Miller Funeral Service is in charge of the arrangements.  

 Yolande Caudill, 97

Mrs. Yolande Desmond Kerbaugh Caudill, age 97 of North Wilkesboro, died Saturday, February 8, 2020 at Villages of Wilkes.  

           A graveside service will be held 11:00 AM Wednesday, February 12 at Mountlawn Memorial Park with Dr. Bert Young officiating.  The family will receive friends from 1:30 until 3:00 PM at Reins-Sturdivant Funeral Home after the service.  

           Mrs. Caudill was born October 27, 1922 in Greenville, TN to John Thomas and Eula Leonard Kerbaugh.  She was a lifetime member of First Baptist Church of North Wilkesboro and a FBC choir member, was a member of the VFW Auxillary and the Crickett Home Demonstration Club. She was an expert seamstress, made the best yeast rolls, and was a crafter of Chrismons, displayed at FBC North Wilkesboro during the holidays.

           In addition to her parents she was preceded in death by her husband, Thomas Lee Caudill, Sr.; one sister, Vivian K. Greene; and three brothers, Shoun Kerbaugh, Glyn Kerbaugh, and Lyn Kerbaugh.  

           She is survived by one daughter, Sharon Caudill Adams and husband, Jack, of Clemmons; two sons, Thomas L. Caudill, Jr. and wife, Vickie, and James S. Caudill and wife, Joann, all of Wilkesboro; five grandchildren, Michael B. Caudill, Brian T. Caudill, Andrea A. Turner, Geoffrey T. Adams, and Sara A. Caudill; eight great-grandchildren, Matthew B. Caudill, Brandon A. Caudill, Brennen T. Caudill, Lilly Kate Turner, Savannah C. Turner, Madison G. Adams, Colton T. Adams, and Mila A. Morales; and one sister, Doris K. Bentley and husband, Jim.

 Julie  Minton, 50

Julie Christine Minton, age 50, of North Wilkesboro, passed away Thursday, February 6, 2020 at her home. Julie was born October 13, 1969 in Wilkes County to Thomas James "Johnny" and Mary Christine Bouchelle Call. Julie attended Cricket Baptist Church and was a loving mother to her sons.      She was preceded in death by an infant brother; grandfather, Clarence C.J. Call; and uncle, Joey Call.

           Surviving in addition to her parents of Wilkesboro; are her sons, Jonathon Marshall Minton, Joshua Austin Minton both of Hays; brother, David James Call of North Wilkesboro; sisters, Tammy Annette Shew and spouse Bodean, Sandy Ann Yates and spouse Keith all of North Wilkesboro; grandmother, Della Call of North Wilkesboro; nephews, Austin Shew and spouse Ashley, Michael Lane Bare all of Hays; nieces, Catherine Yates and Hope Yates both of North Wilkesboro; great nephew, Bentley Shew; aunts, Patricia, Joann, Janie, Gail, and Jeanette; and uncles, Jimmy and Jeff.

           Funeral service was February 10,  at Fishing Creek Arbor Baptist Church with Rev. David Wellborn and Rev. Ronnie Millsaps officiating. Burial  followed in the Church Cemetery.   Miller Funeral Service is in charge of the arrangements.  

 Teodulo DeLeon, 80

Mr. Teodulo Meza DeLeon, age 80 of North Wilkesboro passed away Thursday February 6, 2020 at Kate B. Reynolds Hospice House in Winston Salem.

           Funeral Services were February 9,   at Reins Sturdivant Funeral Home Chapel with Father John Hanic officiating. Burial was at Scenic Memorial Gardens in Wilkesboro.  

           Mr. DeLeon was born February 17, 1939 in San Luis Potosi, Mexico to Gunercindo Meza and Severiana Meza DeLeon. He retired from Tyson Foods.

           In addition to his parents, he was preceded in death by three sisters, Felipa Meza, Antonia Meza and Cecilia Meza.

           Mr. DeLeon is survived by his wife, Antolina DeLeon DeMeza of the home, four sons, Agustin, Natalio, Emeterio and Crispin Meza, six daughters, Ubalda, Catalina, Maria, Bertha, Carmen and Guadalupe Meza, twenty-seven grand-children, ten great grand-children, four sisters, Marciana, Marcela, Atanacia and Agapita Meza, two brothers, Crispin and Leopoldo Meza.

           Flowers will be accepted.

 Darcie  Call, 88

Mrs. Darcie Lee Minton Call, 88, of Wilkesboro, passed away on Wednesday, February 5, 2020 at Wilkes Medical Center.

           Darcie was born on May 14, 1931 in Wilkes County to Ransom Edgar Minton and Connie Lee Parker Minton.  

           Darcie is survived by her daughters, Brenda Call Hooks (Len) of Chesnee SC, Phyllis Call Johnson (Bryce), Thricia Call Walter (Steve), Wanda Call Smith (Rick), all of Wilkesboro; sons, Ransom Call (Shirley) of Wilkesboro, Nelson Call (Laurie) of North Wilkesboro; twelve grandchildren and fifteen great grandchildren.

           Funeral was February 9,  at Fishing Creek Arbor Baptist Church.  Burial was in the church cemetery with Rev. David Welborn  officiating.

 Randy Osborne, 34

Mr. Randy Paul Osborne, 34, of North Wilkesboro, passed away on Wednesday, February 5, 2020.

           Randy was born on June 25, 1985 in Wilkes County to Brian Tracy Osborne and Cathy Marie Fitzwater Osborne.

           Randy is preceded in death by his grandparents, Lonnie and Rose Osborne, Samuel and Cordelia Fitzwater; aunts, Mary Moran, Donna Fitzwater and cousin, Jason Fitzwater.  

           Randy is survived by his parents Brian and Cathy Osborne.

           A private service will be held at a later date.

 Mamie  Osborne, 91

Mamie "Nell" Osborne, formerly of N. Wilkesboro, is heaven bound after spending 91 years on earth as a loving daughter, sister, mother of five and grandma to many.

           Nell was born in Wilkes County on June 30th, 1933, to Marion Frank Church and Daisy Agnus Milam Church during the Great Depression.

           The red head was also known for her wit and spunk. Never did one have to guess what Nell was thinking. She was funny, but also exceptionally bright. She was an avid reader and writer. She documented many of her life stories and travels through her books and poems. She always had a word search, a good book and her Bible close at hand.

           Her humor, kindness and selfishness will be remembered by all who came in contact with her during her 91 remarkable years.

           A celebration of Nell's life will be held Friday, February 7th at Miller Funeral Service from 1-2 p.m. Family and friends are encouraged to come gather in her memory.

           Special thanks to the team at Chatham Nursing and Rehabilitation.          Memorial contributions may be made, in honor of Nell, to Samaritan's Purse - a local charity that she supported during her life.

 Peggy Taylor,  74

Peggy Ann Prevette Taylor, age 74, of McGrady, passed away, Tuesday, February 4, 2020 at her home. She was born June 7, 1945 in Wilkes County to Dewey Gaither and Hazel Johnson Prevette. Peggy was a graduate of Wilkes Central High School, was a Teacher's Assistant; and a school bus driver for Mulberry Elementary School. Mrs. Taylor was preceded in death by her parents; and a daughter, Pamela Taylor West.

           Surviving are her husband, Wallace Taylor; daughter, Mandy Wyatt and spouse Ricky of McGrady; grandchildren, Eric Brown and spouse Chelsea of Purlear, Evan Handy and spouse Victoria of Wilkesboro, Lauren Mitchell and spouse Ethan of North Wilkesboro; brothers, "Junior" Dewey Prevette and spouse Linda of Wilkesboro, Kenneth Prevette and spouse Sarah of Lewisville; sister, Kathy Williams and spouse Dean of North Wilkesboro; several nieces and nephews.

           Funeral service was February 7,  at Miller Funeral Chapel with Rev. David Key officiating. Burial   followed in Taylor Cemetery in McGrady.   The family has requested no food.  Lawrence  Pruitt,  86

Lawrence Allen Pruitt, age 86, of Traphill, passed away Tuesday, February 4, 2020 at Wake Forest Baptist Health-Wilkes Regional. Mr. Pruitt was born May 7, 1933 in Wilkes County, he was a son of the late Archie and Jettie Shaver Pruitt. Lawrence served in the Army and fought in the Korean War.

           In addition to his parents, he was preceded in death by his sons, Michael Allen Pruitt and Thomas Wayne Pruitt; and sister, Loreen Cockerham.

           Lawrence is survived by his wife of 63 years, Wanda June Pruitt of the home; son, David Mitchell Pruitt and lifemate Ann Sossaman of Traphill; daughter, Zendoline Kay Adams and husband Roger Adams of Traphill; brothers, Jarvie John Pruitt and wife Alice Pruitt, Gene Pruitt and wife Renee Pruitt all of Traphill; sister, Abby Pruitt Combs and husband Edsel Combs of Roaring River; grandchildren, Tara, Chad, Lance, Ayla and Leia; great grandchildren, Oaklen and Lily.

Jera Lee Parsons Wagoner, age 40 of North Wilkesboro passed away Monday, February 3, 2020.

           Private services will be held at a later date.

           Jera was born May 27, 1979 in Wilkes County.

           She is survived by her father; Jerry Parsons of North Wilkesboro, her mother;

Rita Looney Hatmaker of Elkin, her husband; Ritchie Wagoner of North

           Wilkesboro and one sister; Kristina Parsons of Hays.

 David Dearman, 82

Mr. David Dewitt Dearman, age 82 of North Wilkesboro passed away peacefully at his home on Monday, February 3, 2020.

           David married his high school sweetheart, Carolyn on December 18, 1955.  

           He was preceded in death by his parents.

            David is survived by his wife of 64 years; Carolyn Johnson Dearman of the home, three daughters; Kimberly Dearman-Wilcox and husband Shaun of Oak Island, NC, Tamera Dearman Newton and husband Steve of North Wilkesboro and Kandice Dearman-West and husband Chris of Matthews, three grandchildren that he adored; Cameron David Newton, Joseph Stephen Newton and Kassidy Caroline Newton, special niece; Teresa Dancy Casey and his special dog; Duncan.

Wanda Kay Harms Montgomery, age 87, of Mt. Airy, formerly of West Jefferson, passed away Monday, February 3, 2020 at Twelve Oaks Nursing Center.

           She was born July 18, 1932 in Wilkes County to Harrison Columbus and Minnie Leola Brown Miller.          Her DNA says she was a mixed of English, Wales, Germanic, European, Ireland, Scotland, and small percent of Native American.

           Mrs. Montgomery was a great great great grand-niece of Daniel Boone. She moved to Savannah, Georgia in her early years and married William Harms Sr., then in 1972, she married Walter A. Montgomery, who was in the military and they traveled with their family all over the world and come to retire in Ashe County.

           Mrs. Montgomery was preceded in death by her parents; a son, Keith M. Miller; and siblings, Thelma, Herman, Blanche, Beulah, Dorothy, Clyde. She will be missed by all.

           Surviving are her husband, Walter A. Montgomery; her children, William S. Harms, Jr. and spouse Linda of Ellabell, Georgia, Lilly A. Harms of Vidalia, Georgia, Todd Stewart of Gainesville, Georgia; one grandson; and one great granddaughter

Mrs. Greene graduated from Catawba College in 1953.  She was a devoted wife, mother, grandmother and homemaker and loved art and music.  

           In addition to her parents, she was preceded in death by her husband; Edward Franklin Greene, a son; Richard Edward Greene and a daughter; Katherine Ann Greene.

Environmental groups on Tuesday sued the Environmental Protection Agency (EPA) over its decision to delay enforcement of a regulation meant to limit the number of trucks sold with older engines that don’t meet newer pollution rules.

A 2016 Obama administration rule limited sales of “glider trucks” — new truck bodies with old engines and chassis — to 300 per manufacturer per year.

But earlier this month, on his last day at the agency, then-EPA chief Scott Pruitt ordered the agency to stop enforcing that limit while it works through the regulatory process to repeal it.

The green groups who filed the lawsuit and refer to the glider trucks as “super-polluting” trucks are asking the federal Court of Appeals for the District of Columbia Circuit to issue an emergency order to force the EPA to enforce the 2016 rule.

“Scott Pruitt was at the EPA helm when this illegal policy was adopted, but Andrew Wheeler is refusing to fix it. Wheeler may try to claim he’s different from Pruitt, but in reality, he’s one in the same,” Joanne Spalding, the Sierra Club’s chief climate counsel, said in a statement, referring to the EPA’s acting administrator.

The groups are arguing that the EPA can’t legally stop enforcing a rule that’s on the books and that assert enforcing the rule would prevent significant amounts of air pollution.

A study completed by EPA researchers last year found that glider trucks emit as much as 43 times the nitrogen oxides as new trucks and 55 times the particulate matter. Multiple Republicans in Congress, including House Science Committee Chairman Lamar Smith (R-Texas) are investigating that study, claiming that close cooperation with truck maker Volvo Trucks may have violated scientific standards.

A federal court issued another blow to the Trump administration's aggressive deregulatory agenda when it ruled on Monday that the Environmental Protection Agency (EPA) must immediately reinstate an Obama-era pollution rule that sets methane emission standards for the oil and natural gas industry.

The Monday ruling, issued by the U.S. Court of Appeals for the District of Columbia Circuit, was celebrated by green groups that filed a suit challenging an EPA attempt to delay implementation of the rule. The "issuance of the mandate by the full D.C. Circuit protects families and communities across America under clean air safeguards that EPA Administrator Scott Pruitt sought to unlawfully tear down," said Environmental Defense Fund (EDF) lead attorney Peter Zalzal.

New E.P.A. Chief Closes Dirty-Truck Loophole Left by Scott Pruitt

Andrew R. Wheeler, the acting administrator of the Environmental Protection Agency, has reversed the final policy act of his predecessor, Scott Pruitt: granting a loophole that would have allowed more highly polluting trucks on the nation’s roads.

Mr. Wheeler’s decision, outlined in a memo to his top air policy staff, formally vacates the move Mr. Pruitt made on his last day in office, earlier this month, before resigning amid a host of ethics investigations. Mr. Pruitt had told manufacturers that the agency would not enforce a cap on what are known as “glider” trucks — vehicles with older and less efficient engines installed.

“I have concluded that the application of current regulations to the glider industry does not represent the kind of extremely unusual circumstances that support the E.P.A.’s exercise of enforcement discretion,” Mr. Wheeler wrote.

Mr. Wheeler has worked during his first three weeks as the E.P.A.’s acting chief to put distance between himself and Mr. Pruitt stylistically by addressing his staff, issuing a public schedule of his activities and taking questions from journalists. The about-face on gliders represents the first sign that Mr. Wheeler may seek to distinguish himself from Mr. Pruitt on policy as well.

“With Mr. Pruitt out, I’m glad to see EPA will reverse one of the most egregious — and likely illegal — environmental proposals of his tenure,” Senator Tom Carper of Delaware, the top Democrat on the Senate Environment and Public Works Committee, said in a statement. He called the reversal “a step in the right direction” but he criticized a longer-term E.P.A. plan that aims to eventually exempt glider trucks from greenhouse gas regulations.

Glider kits are new trucks that come without an engine or transmission — the name comes from the idea that they are engineless, like gliders. Older engines are then installed, and the resulting vehicles produce as much as 55 times the amount of air pollution as trucks with modern emissions controls.

They currently account for about 5 percent of all heavy-duty trucks on the road. The Obama administration had estimated that, left unchecked, gliders could generate a third of the truck fleet’s soot and other pollutants that contribute to smog and acid rain, and sought to limit their annual production to 300 vehicles through the end of 2019.

Those restrictions were supported by a mix of public health and environmental organizations as well as major companies like United Parcel Service, the largest truck fleet owner, and Volvo Group, one of the largest truck manufacturers. But the E.P.A. under Mr. Pruitt began the process of repealing the rule after lobbying by a small set of manufacturers that sell glider trucks.

Mr. Pruitt resigned July 5, but before he left office he notified manufacturers that the agency would not enforce the caps. An agency spokeswoman also indicated the E.P.A. might formally delay the caps until December 2019, by which point it hoped to have them permanently repealed.

The United States Court of Appeals for the Fourth Circuit stayed Mr. Pruitt’s loophole on July 18. Joanne Spalding, chief climate counsel at the Sierra Club, said in a statement that Mr. Wheeler’s decision to officially reverse course on the decision amounted to having “conceded defeat.”

Mr. Wheeler in the memo indicated that regulatory process to repeal the Obama-era rule will still move forward. But, he said, the E.P.A. will not offer any other “no action” assurance to companies. Instead the agency “shall continue to move as expeditiously as possible on a regulatory revision regarding the requirements that apply to the introduction of glider vehicles.”

Molly Block, an E.P.A. spokeswoman, confirmed the reversal and said Mr. Wheeler made the decision after consulting with agency staff and in light of pending administrative and judicial petitions and motions.

Green groups denounce Trump’s ‘all-out assault’ on climate regulations

President Trump signed an executive order Tuesday afternoon following through on his campaign promise to roll back Obama-era environmental protections intended to combat climate change.

The Trump administration’s “Energy Independence” order essentially begins the process of dismantling the Clean Power Plan (CPP), which limits greenhouse gas emissions from coal-burning power plants. It was former President Barack Obama’s signature legislation for restricting the carbon emissions that contribute to global warming.

In courting miners on the campaign trail, Trump condemned his predecessor’s environmental policies as an assault on American workers in the coal industry. His rhetoric made no allowances for jobs that might be created in renewable energy. In 2015, Fortune Magazine calculated there were twice as many Americans working in the solar-power industry as coal miners.

While introducing Trump at the Environmental Protection Agency (EPA) headquarters, Vice President Mike Pence said, “The war on coal is over. Everyone here knows the truth that affordable, abundant and reliable energy powers the American economy.”

Trump celebrated the signing of the executive order as the start of “a new era” in U.S. energy production and job creation.

“The action I’m taking today will eliminate federal overreach, restore economic freedom and allow our companies and our workers to thrive, compete and succeed on a level-playing field for the first time in a long time, fellas. It’s been a long time. I’m not just talking about eight years. I’m talking about a lot longer than eight years,” Trump said.

Earlier Tuesday, White House press secretary Sean Spicer said the executive order directs all agencies to review all regulations, rules, policies and guidance documents that hinder domestic energy production and identify those that are not mandated by law or contributing the public welfare.

“For too long the federal government has acted as barrier to energy independence and innovation. By reducing unnecessary regulatory obstacles, we’ll free up American energy companies to responsibly use our vast energy resources,” Spicer said.

In anticipation of the executive order, Rhea Suh, president of the Natural Resources Defense Council (NRDC), said Tuesday morning that she will not surrender “our children’s future” to profits for the coal and natural gas industry without a fight.

“This is an all-out assault on the protections we need to avert climate catastrophe. It’s a senseless betrayal of our national interests. And it’s a short-sighted attempt to undermine American clean energy leadership,” Suh said in a statement.

“Trump is sacrificing our future for fossil fuel profits – and leaving our kids to pay the price. This would do lasting damage to our environment and public lands, threaten our homes and health, hurt our pocketbooks and slow the clean energy progress that has already generated millions of good-paying jobs.”

The League of Conservation Voters (LCV) president Gene Karpinski also weighed in:

“Rolling back these public health protections shows Trump cares more about big polluters than the well-being of our communities. There is no excuse for unsafe drinking water, dirty air, more asthma attacks in kids, and increased extreme weather events that destroy homes and livelihoods,” Karpinski said. “Donald Trump may care more about corporate interests, but the people of this country care about a safe, clean and healthy environment and they will not let him get away with destroying it.”

The CPP is the centerpiece of Obama’s efforts to fight climate change. It’s also the key to U.S. compliance with the landmark Paris Agreement, in which 194 countries pledged to reduce carbon emissions to limit the increase in average global temperature to below 2°C. That dismantling the CPP disrupts the Paris Agreement likely wouldn’t bother Trump much — since he’s vowed to pull the U.S. from the accord anyway.

A senior administration official told reporters Tuesday, “The previous administration devalued workers by the policies. We’re saying we can do both. We can protect the environment and provide people with work and keep the economy growing. And that’s the policy agenda we’re going to try to focus on.”

But scientists say that climate change will have serious economic consequences in the form of rising sea levels and more disastrous hurricanes. The White House official could not respond when asked what the administration makes of those economic arguments.

“Again, you’ll have to talk to those scientists. Maybe I can talk to you afterward. I’m not familiar with what you’re talking about,” the official said.

Trump once characterized himself as being an environmentalist “to a large extent” but his actions and rhetoric paint a drastically different picture. In fact, that same day he signed executive orders advancing the controversial Keystone XL and Dakota Access pipelines.

In December, more than 2,300 scientists, including 22 Nobel Prize winners, signed an open letter beseeching Trump to respect scientific research and rely upon it when shaping policy.

The former real estate magnate went on to nominate Oklahoma Attorney General Scott Pruitt, who has close ties to the fossil fuel industry and sued the EPA more than a dozen times, to lead that very agency. Pruitt recently said he does not think carbon dioxide is the primary driver of climate change. Trump’s secretary of state is former ExxonMobil CEO Rex Tillerson, whose company has been accused of leading a campaign to deny climate change as far back as the 1970s — although ironically its public stance now (acknowledging that “the risk of climate change is real and the risk warrants action”) would seem to put it to the left of the administration on this issue.

Trump has variously called climate change a hoax perpetrated by China to make the U.S. uncompetitive in manufacturing and claimed “nobody really knows” if it’s real. Neither is accurate. The overwhelming majority of scientific organizations say the scientific evidence of the climate system’s warming is incontrovertible.

For instance, the U.S. National Academy of Sciences, the U.K. Royal Society, the Science Council of Japan and other international science organizations signed a joint statement affirming the reality of climate change back in 2005.

“Climate change is real. There will always be uncertainty in understanding a system as complex as the world’s climate. However there is now strong evidence that significant global warming is occurring,” the statement reads. “The evidence comes from direct measurements of rising surface air temperatures and subsurface ocean temperatures and from phenomena such as increases in average global sea levels, retreating glaciers, and changes to many physical and biological systems. It is likely that most of the warming in recent decades can be attributed to human activities.”

Independent analyses from National Aeronautics and Space Administration (NASA) and the National Oceanic and Atmospheric Administration (NOAA) found that the Earth’s average surface temperatures in 2016 were the warmest since record keeping began in 1880. It was the third consecutive year that the global temperatures set a new record for warmth.

Amid such dire data, 21 young Americans, who range in age from 9 to 20, have taken it upon themselves to force the federal government to protect the environment. The group filed a lawsuit, Juliana v. United States, against the federal government in the U.S. District Court for the District of Oregon in 2015. They argue that the U.S. government’s actions contributing to climate change violate the younger generation’s constitutional rights to life, liberty, and property and amount to a failure to protect public trust resources. The case is expected to go to trial sometime this year.

Joanne Spalding, the chief climate counsel at the Sierra Club, said the lawsuit is especially important given the Trump administration’s apparent denial of climate science.

“The Juliana case essentially says no matter what the statutes require of the EPA or other agencies, there is this fundamental right to a life-sustaining climate and that the federal government has a duty to protect that,” Spalding told Yahoo News. “It’s really groundbreaking.”

Nella Blackburn, 89

Mrs. Nella Mae Durham Blackburn, age 89 of Roaring River passed away Monday, July 8, 2019 at her home.

Funeral services will be held 1:00 PM Wednesday, July 10, 2019 at Macedonia Baptist Church with Rev. Mike Smith officiating. Burial will be in Durham Family Cemetery. The family will receive friends from 11:30 until 12:30 prior to the service at the church.

Mrs. Blackburn was born August 20, 1929 in Wilkes County to Erastus Jones and Dossie Clementine Wiles Durham.  

In addition to her parents, she is preceded in death by her husband; Jesse Eli  Blackburn, one sister; Evelyn Durham Welborn and one brother; William Cody Durham.

She is survived by seven sisters; Darlene Durham Grit of Roaring River, Susie Durham Hawkins of North Wilkesboro, Violet Durham Jolly of Winston-Salem, Perdetha Durham Transou of Gaffney, SC, Betty Jo Lovell of Princeton, WV, Mary Ann Casey of Bolvia, and Patsy Ingram of Raleigh and two brothers; E.J. Durham and wife Patricia of North Wilkesboro and Hayden Durham and wife Linda Sue of Roaring River and numerous nieces and nephews and great nieces and nephews.

 Dorothy Poole, 92

Dorothy Lee Poole, age 92, of Wilkesboro, passed away Sunday, July 7, 2019 at Wilkes Senior Village. She was born January 2, 1927 in Catawba County to Vance and Minnie Thomas Poole. Dorothy was a lifetime member of St. John Holiness Church in Wilkesboro, holding many positions in her church, including Treasurer. She was preceded in death by her parents; siblings, Rachel Reddick, Ethel Short, Eula Mae Brown, Bessie Poole, Leon, Burgan, Harold and Jessie Poole.

Surviving are her sons, Steven Poole of Wilkesboro, Larry Poole and spouse Carrie Bell of South Carolina; granddaughter, Stephanie Parker and spouse Josh of Jacksonville, N.C.; great granddaughter, Elizabeth Watkins of Greensboro; host of nieces and nephews.

Funeral service will be held 11:00 a.m. Wednesday, July 10,   at Miller Funeral Chapel.                                         Burial will follow in Scenic Memorial Gardens. The family will receive friends at Miller Funeral Service from 6:00 until 8:00 Tuesday night. Flowers will be accepted. Miller Funeral Service is in charge of the arrangements.  

 Betty Jenkins, 77

Mrs. Betty Jean Billings Jenkins, age 77 of Hays, passed away Saturday, July 6, 2019 at Wake Forest Baptist Wilkes Medical Center.

Funeral services were July 9,   at Bethel Baptist Church with Pastor Donnie Shumate and Rev. Shane Jenkins officiating. Burial was in Mountlawn Memorial Park.

Mrs. Jenkins was born August 28, 1941 in Wilkes County to Ulen Billings and Juanita Wingler Billings. She retired from CATO's and was a member of Bethel Baptist Church.

She was preceded in death by her parents.

Mrs. Jenkins is survived by her husband; Robert Lee Jenkins of the home, two sons; Richard Lee Jenkins and wife Lori of Yadkinville and Gregory Scott Jenkins and wife Jeanne of Burlington, three grandchildren; Cammi Leigh Jenkins, Emma Michelle Jenkins and Trevor Scott Jenkins, step grandchildren; Zach Hollar and Justin Gambill, step great-grandchildren; Kelsey Grace Hollar and Allison Faith Hollar and a sister; JoAnn Huffman of Statesville.

Pallbearers will be Jared Wiles, Jacob Wiles, Trevor Jenkins, Joseph Wiles, Joshua Thornton and Zack Hollar.

 Kathy Miller, 55

Kathy Louise Miller, age 55, of Millers Creek, passed away Wednesday, July 3, 2019 at Curis of Wilkesboro. She was born April 20, 1964 in Wilkes County to Carl and Ennis Barthenia Jarvis Miller. Kathy attended Maple Springs Baptist Church.

Surviving are her parents, Carl and Bartha Miller of Millers Creek; sister, Crystal Miller of North Wilkesboro; and brothers, Michael Miller of North Wilkesboro, Tim Miller and spouse Sheila of Taylorsville.

No service will be held. The family has requested no flowers. Memorials may be made to St. Jude Children's Research Hospital, 501 St. Jude Place, Memphis, Tennessee 38105-9956.

 Jerry Hamby, 81

Mr. Jerry Gray Hamby, age 81 of Wilkesboro passed away Tuesday, July 2, 2019 at his home.

Funeral services were July 5, at Pleasant Grove Baptist Church with Rev. Brady Hayworth officiating.  Burial was in the church cemetery.                                            Mr. Hamby was born September 7, 1937 in Wilkes County to Arvill Henson and Pearl Claudine Rhymer Hamby.  He retired from Carolina Mirror after 37 years of service and joined Pleasant Grove Baptist Church in 1958 and became a Deacon in 1967 where he served until his death.

In addition to his parents he was preceded in death by a brother; Gary Hamby.

He is survived by his wife; Shirley Parsons Hamby of the home, two daughters; Cheryl Church and husband Scott of Wilkesboro and Angela Gray Hamby missing since October 1982, two grandchildren; Adrienne Church and Elizabeth Cooke and one great grandchild; Julian Aoki and a sister; Brenda Trivette of North Wilkesboro.

Mrs. Carolyn Jane McGrady McDowell, age 73 of Moravian Falls, passed away July 1, 2019 at her home.

Memorial services were July 8,  at Reins Sturdivant Chapel with Rev. Steve Snipes officiating.  

Mrs. McDowell was born May 5, 1946 in Ashe County to Dwight Isaiah McGrady and Grace Dean Lovette McGrady. She was a member of North Wilkesboro Presbyterian Church and a Realtor with Realty One.

In addition to her parents, she was preceded in death by a brother; Jerry McGrady.

She is survived by a daughter; Amanda McDowell Crafton and husband Jeff of Mooresville, a son; Raymond Anderson McDowell and wife Gina of Raleigh, four grandchildren; Maxwell Crafton, Gabrielle Crafton, McKinley Dawn McDowell-Santiago and husband Hector and Olivia Grace McDowell and a brother; Roger McGrady and wife Katherine of Wilkesboro.

 Berlene Gant, 93

Mrs. Berlene Pearson Gant, age 93 of Moravian Falls passed away Monday, July 1, 2019 at Wake Forest Baptist-Wilkes Medical Center.

Funeral services were July 4,   at Moravian Falls Baptist Church with Rev. Joe Sturgill and Rev. Arvil Perry officiating.   Burial was in the church cemetery.  

Mrs. Gant was born February 7, 1926 in Wilkes County. Mrs. Gant was a special education teacher, she began her career in Welcome, NC, she then moved to Wilkes County and ended her teaching career in the Wilkes County School System after teaching for 27 years.  Mrs. Gant attended Guilford College where she played on the basketball team, she was one of the bell ringers for the chapel, active in Christian organizations, a Sunday School Teacher at Moravian Falls Baptist Church for many years and she was the oldest member of Moravian Falls Baptist Church.    

She was preceded in death by her mother; Martha Naomi Pearson Smithey and step-father; William Shafter Smithey, her husband; William "Bill" Arthur Gant, one daughter; Martha Jolaine Barlow and one son; Daryl Lee Gant.

She is survived by two daughters; Linda Jeanette Gant of Wilkesboro and Marcia O'Donnell of Moravian Falls, and two sons; William Ronald Gant of North Wilkesboro and Norman Dewayne Gant and wife Paula of Cutler Bay, FL, ten grandchildren, sixteen great grandchildren and four great-great grandchildren.

 Truman Gaultney, 78

Mr. Truman Arlin Gaultney, age 78 of Boomer passed away Monday, July 1, 2019 at his home.

Memorial services will be held at a later date.

Mr. Gaultney was born July 17, 1940 in Williamsville, MO to Frank and Della Mae Luke Gaultney.  Mr. Gaultney was a hardworking, loving husband, father and grandfather.  He lead by example and was a member of Boomer Advent Christian Church.  He enjoyed his grandchildren.  He was respected and loved by those who knew his kind and gentle nature, he helped others and loved all members of his family, nephews, nieces, brothers and sisters.

In addition to his parents, he was preceded in death by a daughter; Angela Gaultney and two sisters; Lois DeShaney and Dorothy Livingston and one brother; Cledis Gaultney.

He is survived by his wife; Ollie Sandlin Gaultney of the home, one daughter; Carolyn Jones of Boomer, five grandchildren; Robert and Ross Rushin, Emily Brooks, Mark Brooks, Jr. and Shawna Swaim, three great grandchildren; Jacob Swaim and Camron and Christian Brooks.

  Robert Pearson, 49

Mr. Robert Pearson, 49, of Morganton, passed away on Saturday June 29, 2019.

Robert was born on November 2, 1969 in Wilkes County to Alton Rayvon Pearson and Lilly Carolyn Triplette Pearson.

Robert is survived by his parents; brother, Dennis Ray Pearson of Wilkesboro; nieces, Amanda Parish, Raven Pearson, Amber Pearson; nephews, Colton Pearson,  Dallas Pearson; great nephew, Jameson Parish and great nieces, Kimberlyn Pearson and Lillian Brittian.

The family will conduct a memorial service at 2 p.m. on July 13th 2019 at Boomer Advent Christian Church in Boomer.

Pastor David Jones will be officiating.

 Timothy Johnston, 68

Timothy Leon Johnston, age 68, of Hays, passed away Sunday, June 23, 2019 at Deerfield Ridge Assisted Living in Boone. He was born October 27, 1950 in Wilkes County to Carey and Mabel Fern Owens Johnston. Timothy was a member of Hinshaw Baptist Church and was All Conference in football at Wilkes Central High  School. He was involved with the local Jaycees. Timothy enjoyed singing, golf and helping anyone in need. Mr. Johnston was preceded in death by his parents; and a brother, Kenneth Johnston.

Surviving are his daughters, Deidra Dickens and spouse Eddie of Charlotte, Carey Barefoot and spouse Brian of Huntersville, Meredith Hayes and fiancé Mitchell Weot of Millers Creek; sister, Mary Ellen Edmiston of North Wilkesboro; brothers, Larry Johnston and spouse Oma Lea of North Wilkesboro, Joe Johnston of Wilkesboro, Mike Johnston and spouse Cheryl of Haymarket, Virginia; sister-in-law, Sherry Johnston of Knoxville, Tennessee; six grandchildren; and his canine companion, Blue.

Celebration of Life will be held from 4:00 until 8:00 p.m. Saturday, July 20, upstairs at the Wilkes Heritage Museum in Wilkesboro (please enter thru back entrance).   David Jackson, 85

David L. Jackson, 85, of Chattanooga, TN passed away Sunday, May 26, 2019. There he was a retired teacher and a member of Brainerd United Methodist Church. Formerly a member of the Masonic Lodge and The Shriners. Born in Lenoir, NC, David was the son of the late George T. Jackson (Helen J. Jackson), Grandson of the late Arthur Jackson (Ila Laws Jackson) all of Wilkes County.

David graduated from Pearisburg High School (VA), Hiwassee College (TN) and attended Emory & Henry College (VA). He worked in Advertising for many years and eventually taught Graphic Arts.

David was an imaginative soul who handcrafted various items for friends and family. His sister recalls a painting he made of her as a child sitting on the porch of their family home. From reproducing a model of his grandmothers house to painting a mural on a restaurant wall, his creative talents spanned many platforms. He was a Music Director for various churches in his early days.

Survivors include his wife of 63 years, Nancy M. Jackson; daughter, Pamela S. Jackson; sister, Hope Jackson Bowen of Charlotte, NC; brother, George T. Jackson Jr. of Roanoke Rapids, NC; and many nieces and nephews.

Interment will be held Wednesday, July 10,   at 11:00 a.m. in the Moravian Falls Cemetery.

Former Environmental Protection Agency Administrator Scott Pruitt’s parting shot (or perhaps middle finger) to the environment was knocked down by his successor this week.

Forced to resign after a hailstorm of scandals ranging from bizarre (sending his security team to scavenge for Ritz-Carlton lotion) to alarming (purging the EPA’s science advisers), Pruitt moved to secure a loophole for some of the dirtiest, most polluting trucks on the road on his last day in office.

These trucks, known as gliders, repurpose old engines in new truck bodies to bypass pollution rules. They tend to be cheaper and have better fuel economy than completely new trucks. However, gliders can emit upward of 55 times the amount of pollutants of trucks that meet current standards. The EPA itself warned that gliders would account for half of all nitrogen oxide pollution from trucks by 2030 based on current trends.

The Obama administration’s EPA issued a cap of 300 new glider trucks per year that was supposed to take effect this year. Pruitt said the EPA would not enforce the cap until 2019 as it works to repeal it altogether.

Environmental groups like the Center for Biological Diversity, Sierra Club, and the Environmental Defense Fund along with 16 state attorneys general immediately filed lawsuits to make the EPA uphold the Obama-era limit.

In response, the US Court of Appeals for the District of Columbia Circuit issued a stay forcing the EPA to enforce the limit. And on Thursday, acting Administrator Andrew Wheeler, who took over for Pruitt, conceded in a memo that the EPA is giving up the fight.

Wheeler concluded that “the application of current regulations to the glider industry does not represent the kind of extremely unusual circumstances that support the EPA’s exercise of enforcement discretion.”

The means the EPA will limit the number of new glider trucks each year to 300. But Wheeler is still trying to revise the regulation “as expeditiously as possible.”

Joanne Spalding, chief climate counsel for the Sierra Club, told me that the EPA is still advancing a proposal to loosen restrictions on glider trucks under their heavy-duty truck rules. But the rollback is based on a study finding that glider trucks produce comparable pollution to new trucks. That study was disavowed by the university that performed it.

So glider trucks might still get a bigger exemption from pollution standards from the EPA, but it’s going to be much more challenging to accomplish.

World: Risks for Pruitt in rush to kill Obama rules

WASHINGTON — As ethical questions threaten the Environmental Protection Agency administrator, Scott Pruitt, President Donald Trump has defended him with a persuasive conservative argument: Pruitt is doing a great job at what he was hired to do, roll back regulations.

But legal experts and White House officials say that in Pruitt’s haste to undo government rules and in his eagerness to hold high-profile political events promoting his agenda, he has often been less than rigorous in following important procedures, leading to poorly crafted legal efforts that risk being struck down in court.

The result, they say, is that the rollbacks, intended to fulfill one of the president’s central campaign pledges, may ultimately be undercut or reversed.

“In their rush to get things done, they’re failing to dot their i’s and cross their t’s. And they’re starting to stumble over a lot of trip wires,” said Richard Lazarus, a professor of environmental law at Harvard. “They’re producing a lot of short, poorly crafted rule-makings that are not likely to hold up in court.”

Six of Pruitt’s efforts to delay or roll back Obama-era regulations — on issues including pesticides, lead paint and renewable-fuel requirements — have been struck down by the courts. Pruitt also backed down on a proposal to delay implementing smog regulations and another to withdraw a regulation on mercury pollution.

One of the chief examples cited by Pruitt’s critics came this week when the EPA filed its legal justification for what is arguably the largest rollback of an environmental rule in the Trump administration: the proposed undoing of an Obama-era regulation aimed at cutting pollution of planet-warming greenhouse gases from vehicle tailpipes.

Pruitt made his case for the rollback in a 38-page document filed Tuesday that, experts say, was devoid of the kind of supporting legal, scientific and technical data that courts have shown they expect to see when considering challenges to regulatory changes.

About half the document consists of quotations from automakers laying out their objections to the rule. By comparison, the Obama administration’s 1,217-page document justifying its implementation of the regulation included technical, scientific and economic analyses justifying the rule.

Environmental groups have welcomed Pruitt’s court losses. Joanne Spalding, chief climate counsel for the Sierra Club, said she was pleased by what she called “sloppy” and “careless” EPA legal work. “It’s fine with us,” she said. “Do a bad job repealing these things, because then we get to go to court and win.”
