Cautious administrator seeks court guidance amid beneficiary discord

Veronica Hurren died in March 2009 survived by children John, Peter and Lynne. Her last will appointed Toby Jacobs as executor, made some minor gifts and then left the rest and residue of the estate equally between the three adult offspring. Jacobs did nothing to administer the estate for many years.  John applied to the Supreme Court of Queensland and in September 2018 obtained orders from Justice Martin Burns removing him as executor. The judge appointed an independent administrator – solicitor John Fradgley – to administer the estate given what he took to be heightened conflict among the beneficiaries. The estate consisted of 2 properties at Biggera Waters, in which daughter Lynne and Jacobs occupied from time to time without the estate’s consent. Fradgley asked them to vacate and when they refused, he started actions in the Magistrates Court and in QCAT eventually selling the properties after achieving vacant possession in October 2019, for a net sum of almost $1.5 mil. A valuer assessed the rent lost to the estate from the unauthorized occupation of the properties by Lynne and Jacobs over 10 years from 2009 at $266,000. The administrator decided not to pursue Jacobs as he appeared to have no assets but considered recovering the forgone rent from Lynne by way of an adjustment to her estate share. Having eventually decided to pursue neither of them, Fradgley sought and obtained advice in August 2021 from the Supreme Court confirming the validity of that approach from Justice Peter Applegarth. Peter nevertheless pressed the administrator to sue Lynne for the foregone rent or a share of it. He wanted Fradgley to recover the lost rent, Fradgley did not want to waste time and legal costs on likely futile legal proceedings and Lynne wanted to avoid any payment. This issue went back and forth between the three protagonists until late 2022. The dispute was nearly resolved with an in-principle agreement that Lynne would pay half the lost rent, but she changed her mind and refused to formalise that arrangement. Fradgley – who was ‘between a rock and a hard place’ in estate administration land – faced mounting criticism from Peter for sitting on his hands. The administrator decided to get advice and directions from the Supreme Court for a second time. He applied to the court, outlining the background and circumstances and asking for an order that would permit him to deduct $133,000 – half the sum in dispute – from Lynne’s estate share in line with the earlier proposal. Due to be heard in early-2023 but delayed by Lynne until December 2023, the matter came before Justice Martin Burns who approved administrator Fradgley’s request. The case demonstrates the caution that is called for in estate administration. It also illustrates the importance of choosing a competent executor to avoid the huge expense by which an estate can be burdened by the appointment of an independent administrator. The legal costs incurred in the nearly 15 years from Veronica’s death are likely to be enormous. It may be tempting to laugh at Michael Caputo, the top communications official at the United States’ Health and Services Department, who recently accused Center for Disease Control scientists of “sedition” and predicted a socialist uprising would follow the November election.

“Remember the Trump supporter who was shot and killed [in Portland late last month]? That was a drill,” Caputo declared in a bizarre, hyper-paranoid broadcast on Facebook Live on September 13. He added: “If you carry guns, buy ammunition, ladies and gentlemen, because it’s going to be hard to get.”

Canadians often watch with fascination as American conspiracy theorists embarrass themselves. It’s certainly tempting to boastfully tell ourselves that intrigue inventories such as QAnon, which Caputo indirectly referenced in his rant, won’t gain a foothold here.

The thing is, it already has. And the mysterious Q — an alleged U.S. government insider who surfaced on the murky 4chan platform in 2017 with claims that Satanic forces were attempting to overthrow President Donald Trump and his administration — has drawn a following in Canada.

QAnon exploded onto the news cycle in July when Manitoba resident Corey Hurren smashed his pickup truck through the wrought-iron gates in front of Rideau Hall, the grounds currently hosting Prime Minister Justin Trudeau and his family, who weren’t home at the time.

Carrying an illegal rifle, revolver and a prohibited magazine of ammunition, Hurren was apprehended after a two-hour stand-off with police. In a two-page letter shared with Global News by an unnamed, Hurren raved that Trudeau was turning Canada into a “Communist country.” Foreign Policy magazine called this the “most high-profile action inspired by QAnon.”

That Hurren was a member of the Canadian Rangers — he even won an award from the Royal Canadian Horse Artillery — isn’t exactly surprising. Multiple investigations have revealed numerous adherents to far-right ideologies or groups within the military, including the Three Percenters and Soldiers of Odin, who have marched in an anti-mask rally alongside QAnon followers.

But even more troubling is QAnon’s infiltration of Canada’s political sphere.

If you're looking for a comics anthology to brighten your involuntary days at home or a book to introduce you to a wide range of independent creators with bodies of work you can start reading NOW, look no further. In fact, you'll probably love the front cover and spine (plus front endpapers) by Tom Gauld. He and Pascal Girard, whose work can also be found inside, draw the best bookstores and libraries.

The book opens with a section on the history of Drawn & Quarterly that includes old photos featuring questionable haircuts of famed comics creators that will make you laugh, particularly if you frequent the better sections of comic conventions. Then it's comics, lots of excellent comics! Alongside and among are reminiscences, tributes, and appreciations of the publishing personalities and the talent, my favorites being the one of Seth by Lemony Snicket and Aaron Cometbus' essay about John Porcellino. You don't have to read everything, you don't even have to read it in any order, and it's so diverse in tone and style you probably won't love it all, but there's so much great work inside that it won't matter. Depending on how widely you read, it's full of amazing comics by everyone you've heard of (if you already have great taste) or amazing comics from all of the indy creators you're about to discover (GET YOUR HANDS ON A COPY NOW!). D&Q has introduced me to so many artists whose work I love: Doug Wright, Adriane Tomine, Michel Rabagliati, Lynda Barry, John Porcellino, Guy Delisle, Tove Jansson, Brecht Evens, Jillian Tamaki, and more. And there were a few folks I'd never heard of; how is it I'd never seen a comic by Diane Obomsawin (aka Obom)? I loved the deadpan Greek mythology by her so much (it starts with Zeus seducing Callisto) that I ordered everything by her that's available.

And because I've heard that kettle bells are sold out all over the US, I want to point out that at 776 pages you can probably use this anthology as a weight for a variety of exercises.
