Mr. Charlie Prakash is a young lawyer practicing at the Allahabad High Court. He has been associated with leading social litigation group Human Rights Law Network. He is currently working on the issues of human right violations in the state of Uttar Pradesh.

Vishal Kumar Singh interviewed Mr. Prakash, Here’s candid conversation:

Tell us about your journey to the law college. How did you choose law as a career option?

I have completed my graduation in Political Science and I completed my 3 year law degree from the Allahabad University in 2015. I had interest in the field of political science and pursued it with my interest in legal studies.

What basically inspired you to opt for the pro-bono litigation?

– During my students days I was very interested in the Human Rights issue and I got to develop my interest in the field of social service through an interest in the Human Rights Law Network. I formed a group for minority group for the Christian and minority group. I worked with HRLN for rain water conservation and hunger death. I did field visits. HRLN chose me student of Human Rights. I attended meetings of acid attack victims etc. As a student, I did 16 PILs in the Hon’ble Allahabad High Court in around one and a half years, which is still a record in entire Uttar Pradesh. These PILs were helpful for the society but at the same time these PILs also helped me to grow as a lawyer in Human Rights field.

Tell us about your first Public Interest Litigation

– My first PIL was regarding the hunger death issue in Uttar Pradesh. At first I was scared but gradually I got to contest that case successfully. I learned the legal drafting, fact finding etc for the PIL and during this process, I realized that there is nothing like Shining India that ever existed. I got the opportunity to personally argue in this matter before the Allahabad High Court. Arguing before Allahabad High Court was not an easy task. A lot of senior lawyers were there and as an intern it was my first time before any bench. So, I was a bit nervous but as it was for the sake of society, I realized that I have a greater responsibility and thus, I got the fair order from the court. But my first interesting PIL was regarding the issue of entrance of girls in the library of Aligarh Muslim University in which the girls were banned from entry in the library in night. I made a report and presented before the hon’ble Chief Justice of the Allahabad High Court. The court issued a notice to the Vice Chancellor of the AMU and this rule was changed by the AMU. So, this was a very practical experience which helped me to connect to the day to day issues which people face but they never speak.

You have worked with an Organization called the Freedom Firm for 18 months. What did you do there?

– In Freedom Firm is a Pune based organization and I worked as the Legal Advisor of the firm. It worked in the field to provide relief to the Human Trafficking Victims particularly girls who were in their adolescence. I worked in Meerut, Pratapgarh, Allahabad districts of UP and I was lucky enough to be with them in a few rescue operations and raids. I helped in rescuing 7 girls in a raid in Ratlam city. I also played a very crucial role in closing down the Red Light area in Allahabad. The court passed an order to vacate that area. The court also ordered health check up of rescued girls. Lately, 80 more girls were rescued.

What are the current issues you are working on?

– Currently, I am working for the release of 3000 prisoners who illegally jailed in various prisons in UP. These prisoners are in jail for more than around 20 years and they are old, ill and disabled. UP government does not have any rules and guidelines for the release of these prisoners. On 26th January 2019 i.e., on the occasion of Republic Day, around 1800 prisoners will be released from various prisons in UP. Prior to this, I raised the issue of Deoria Shelter Home Case in which the court ordered for the proper guidelines regarding managing the shelter homes. A team of 16 interns is working with me and till date around 300 law students have interned with me who have worked with me on various human rights issues so far.

Uttar Pradesh is turning into Encounter Pradesh. What are your views on it and what HRLN is doing in this regard?

– The HRLN has sent a lot of applications to the National Human Rights Commission in this regard. In last one and half year the new government in the state has done 1200 fake encounters in which around 50 people were killed. Most of the deceased persons are either from the minority community or from the dalit community. The current government has developed a trend to kill the innocent and poor people and protect the aids or goons supported by the local leaders of the ruling party. This is not a duty of the state to do encounters. Even the Hon’ble Supreme Court has scolded the state government on this issue and strictly said that these encounters are not justified in any way. In the case of PUCL it has been already held that these encounters are purely illegal and have no justification. It is a sheer violation of the Human Rights.

Uttar Pradesh is being the soft target for the mob lynching and killings. What are your views and what is your finding in this regard?

– Recently our team visited in Meerut district in which during a flag march a mob lynching and murder was committed. The main agenda of this government is to make anti-muslim policies and divide the common masses in the name of religion. The government even shut down the slaughterhouses in UP. The court ordered to open the slaughterhouses and instructed to make rules in that regard. The government is focused more upon cows than human beings. Even in Goa and North-Eastern States the BJP government has not banned beef but in UP, they have banned it. The present government is playing dirty politics in the name of Hindutva. Due to this a lot of lynching incidents have been reported and the government is responsible for this.

A whole new breed of lawyers is being prepared in the Law Schools around the country who are more interested in the Corporate law sector instead of Human Rights. What are your views on this?

– I wish that the students should opt for the social litigation and pro-bono cases. The coming generations of law need to stand for the women, dalits and minorities in the society. Law field is a great career option and it’s a way of giving back what you have earned from the society. Corporate law is also a great and promising career option, big corporate houses can afford great lawyers and pay a hefty amount in fees but we should understand that the young lawyers need to stand for such people who do not have means to access to justice.

Short Report: Women’s Empowerment in India

Introduction

Women’s empowerment has gained momentum globally over the past few decades. From the British suffragette movement in the early nineteenth century to the United States’ Lilly Ledbetter Fair Pay Restoration Act in 2009, women have gained numerous rights world-wide over time. Studies have shown that as a byproduct of empowering women, countries have had a greater GDP per capita, lower infant mortality rates and higher literacy rates. Despite this, the gender inequality gap has not entirely been bridged.

Gender inequality combined with high poverty has resulted in numerous crimes against women in India. Though there are numerous factors that affect the status of women in Indian society, this report will concentrate on reproductive health, political participation and the economic independence of women in India.

Reproductive Health

Although there are laws that support access to women’s health care and the distribution of products for reproductive health in India, the implementation of such laws has been subpar. Due to a lack of adequate forms of birth control (like the birth control pill or IUDs), in 2010, India had one of the highest birth rates in the world with 21.595 births per 1,000 people. As a result, the government implemented a controversial sterilization program. By 2013, roughly 4.6 million Indian women were sterilized to lower the birth rate; roughly 568 women died from this procedure. The insufficiency of reproductive health care for women in India is a systemic issue and one that is barely addressed because of a stigma against it.

Political Participation

Since India gained its independence from the British in 1947, Indian women have been politically active. In 1966, India’s third prime minister Indira Gandhi was a woman who went on to serve for another term in 1980. In the 2014 Indian elections, 65.63% of women voted, which is an impressive figure considering that total voter turnout was only 66.40% that year. It was observed that in states where the literacy rates amongst women were lower than others, the percentage of women that voted was also less. This shows a correlation between women’s access to education and women’s political participation in India. It is important for women to exercise their right to vote because they can elect officials that will create an environment in India where women can flourish.

Economic Independence

Under section 498A of the Indian Penal Code, women have the right to financial and economic independence and anyone accused of demanding a dowry should be arrested. However, in 2014 this law was highly abused when the Indian Supreme Court ruled that any arrest must be approved by the magistrate. Due to such poorly executed laws and the lack of financial independence amongst Indian women, they are often dependent on their fathers and then after marriage on their husbands. Moreover, this has created a vicious cycle where young girls are never given the opportunity to have an education, hence must rely on a male authoritarian figure as they do not have a job and thus no financial independence.

Furthermore, in rural areas most women do not get the opportunity to work and earn a wage; instead, they take care of household chores. When women do get the opportunity to work, they earn roughly Rs. 85 ($1.27) per day, which is less than half of what men earn, because of discrimination in the work environment. The root of this problem is cultural and it is difficult to change a society that has been subordinating women for centuries, but not impossible. With the help of NGOs like Apne Aap and CARE India that specialize in giving young girls an education and adult women entrepreneurship skills to start their own business or job qualifications, women have slowly started gaining economic independence.

Conclusion

Overall, while women have been empowered in India, there are still numerous flaws with the implementation of laws that are supposed to decrease the inequality gap between men and women. Additionally, class does play an integral role in this dilemma as women from lower classes and rural areas have more difficulty obtaining access to education and other such vital resources that enable women to reach their true potential. Taking all these factors into consideration, it is only through a cultural revolution where the population truly understand that both women and men are capable of achieving greatness that women can accomplish empowerment.

Reflection

While writing this short report, I had to combine a range of techniques that we learned in class. The most prominent technique that I implemented was paraphrasing. Paraphrasing was necessary in the short report because I had to convey a lot of information and also condense it into the word limit. I did not have too much experience paraphrasing, but aI understood the general gist of it from what I had gathered in class. So, I went back onto bCourses and checked the modules section where I found the lessons we had learned on paraphrasing.

While typing out this short report, I found myself looking at the Birds Of Egypt document often and seeing all the steps that were listed. After a while. I did not have to look at the steps when paraphrasing and it became almost like second nature to me. Also, I often did not realize when I would combine two or more steps because they are all interconnected. By writing this short report, I understood how paraphrasing worked and how to implement the steps that were listed. While paraphrasing, I had some difficulty grasping how to paraphrase specific numerical data. For instance, I had come across a particular statistic (which I eventually did not include in the essay) on the literacy rate amongst women in Tamil Nadu being 73% and I had trouble paraphrasing that. I felt that if I wrote “roughly three-fourth…” then I was being inaccurate and when writing a short report, it is important to be factually correct. However, after consulting a friend who has great experience in paraphrasing and writing reports, I felt more comfortable saying “roughly three-fourth” because it did not convey inaccurate information and gave the general idea of the literacy rate. Moreover, while paraphrasing, I used many synonyms and eventually had to look through a thesaurus. I ended up learning many new words and incorporating them into my vocabulary.

Since this paper was highly research-driven, I felt that it was very important for me to learn the techniques on writing reports since numerous classes require that. While doing this report, I learned how to use in-text citations, which was something that I was completely unfamiliar with. It was also beneficial because in certain published texts I have often come across in-text citations, but did not know what they were and how to use them. Though I decided to use the MLA format of citations in the form of footnotes in this short report because it is what I am familiar with and what numerous of my classes require, it was very useful to expand my knowledge and learn a new and quicker way of citations. These are two of the most important things that I learned while writing this short report.

SYNOPSIS OF THE CONFERENCE - Women have a right to survive childbirth, but it is not their only human right.

The Human Rights in Childbirth Global Conference in India will be held at the Tata Institute of Social Sciences in Mumbai from 2-5 February to 2017.

The event addresses how maternity care can optimize maternal and infant health outcomes in a respectful, culturally sensitive, human rights framework.

The Conference will convene a vibrant and interdisciplinary group of maternity care providers, public health professionals, lawyers, activists, policy makers and reproductive justice advocates and others interested in advancing respectful and evidence-based care.

Collaborators and participants will join the front edge of global efforts to eliminate disrespect and abuse in maternity care and ensure non-discriminatory access to care for every woman and baby.

(a) What are the 5 priority areas that need immediate attention in maternity healthcare in the region?

(b) How will those identified priorities support and/or protect women's human rights in pregnancy and childbirth?

HRiC is an international network of some of the most influential thought leaders who work to address global maternal and newborn health issues through the lens human rights in interdisciplinary and innovative ways. HRiC integrates the professional and political segmentation of women’s and children’s health, and advocates for recognition of the full range of human rights at stake in pregnancy, childbirth, and postpartum.

Birth India was initially founded in 2007 by five women in Mumbai from various nationalities. These women were looking to make a positive difference in the way women in India are cared for during pregnancy, childbirth, and postpartum. Since inception, we have seen an increase in the presence of international childbirth education, birthing options, doulas, midwives, and lactation institutions within India. Our mission is to promote the benefits of best practices for childbirth in India by advocating for women’s reproductive rights and spreading awareness on mother-baby-friendly care.
