public/private knowledge
Public Knowledge
Leon Scott Kennedy is a nationally recognized agent occasionally assigned to the US President's security detail.
He's a survivor of the Raccoon City Incident.
He saved Ashley Graham, daughter of former President Graham from a cult in 2004, and is considered a "Hero".
He is a founding and high ranking member of the Division of Security Operations.
Private Knowledge
Leon's official codified orders are federally recognized and have been since 2002 under Anti-Virus Weapons Protocol No. 7600. It authorizes him to act on behalf of national security separate from military operations. He takes full advantage of this protocol to make decisions about what to do next. This is a position of service but also an extreme position of potentially rogue power.
Leon was involved in Operation Javier, and took Manuela Hidalgo into protective custody in 2002.
His F.O.S. Point of Contact and Handler is Ingrid Hunnigan. They have been partners since 2004.
Leon was coerced into the position of special agent for the United States by Adam Benford, who was a CIA agent then.
He's considered a mutant, due to complications with Las Plagas after 2004, and that has also locked him into specific healthcare providers, necessary procedures, and biological disposal options postmortem. He's paid significantly less than he should be paid because of legislature that was passed regarding B.O.W. mutations and he absolutely refuses to fill out paperwork to acquiesce to the law. He'll take the pay cut.
Leon took a chip containing evidence of treason that formed the groundwork of the DSO in 2005. It's a very well kept secret of his.
Leon was sent on a mission to the small country of Daijoon in 2009, where he fought a BOW species that the local populous called "Demons". He took a mission from the country's Prince exile after his own mission was fruitless, to burn a BOW "Tree of Life" that had fallen into the hands of a rich foreigner. He was successful in this mission.
A year later, he got placed into the Eastern Slav Republic on a search and apprehend/destroy mission for the "Beekeeper" of the Plaga Parasite being used there.
Leon killed President Adam Benford during a banquet in Tall Oaks University, Tall Oaks, after Adam had succumbed to C-Virus.
He made the decision to hunt and kill Derek Simmons after their first phone conversation.
Leon was involved with the routing of A-Virus in Manhattan, and successfully helped rescue Rebecca Chambers from Glenn Arias. It wasn't his finest moment.
Leon was called to Alcatraz afterwards, and assisted the BSAA in taking care of the remnants of the outbreak there, and apprehending his suspect.
There are other outbreaks he has handled in the backdrop, and his schedule is always changing.
Leon Kennedy is a Delta-32 gene carrier, making him one of the naturally immune people to Tyrant Virus. He was bitten/exposed several times in Raccoon City and didn't turn.

i'll finish the thoughts post eventually just need to get the ball rolling on the rest of it but i will say one major disappointment i have with RE4R in terms of its story is that while it is better told, there are so many interesting elements from the original that begged to be carried over & expanded upon that are simply either completely missing, changed entirely or otherwise left just as vague, & no better example i could think of than operation javier being mentioned but completely butchered as being solely krauser's backstory with no connection to wesker, t-veronica, leon or manuela hidalgo (unless they plan on giving us some kind of krauser DLC that would at least expand on the single file we've been given, there's hints in separate ways of a connection between wesker & krauser at the very least) .
there was a push here to make what was a very goofy & charming outing for ressie into something darker & while i do enjoy some of the directions taken by the franchise since RE7 the lingering dread of its subject matter hidden beneath an unassuming veneer of b-movie cheese & gratuitous action has always been present, RE4 being no different, but i think the remake tried to have its cake & eat it too & while it delivers & enhanced the gameplay thrills of the original, i do think its story is overall lesser in comparison with several elements simplified for easier digestion (& completely missing almost any mention of american foreign intervention, salazar musing about the popularity of the word terrorist in a game set in 2004 & released in 2005 is kind of insane considering what america was justifying at the time & still is under the guise of combatting terrorism), especially in its villains, i've already mentioned my dislike for remake!saddler but wesker ? what did they do to you man .

Tumblr media
He encontrado a nuevos compañeros y amigos , me siento contento y motivado.

Me llamo Ricarda."

ASKING THE JURY TO ACT AS THE VOICE OF THE COMMUNITY
NO. DC-16-05198
PLAINTIFF’S TRIAL BRIEF REGARDING ARGUMENTS ASKING THE JURY TO ACT AS THE VOICE OF THE COMMUNITY OR TO SEND A MESSAGE BY ITS VERDICT
TO THE HONORABLE JUDGE OF SAID COURT:
Comes Now, Plaintiff and files this trial brief regarding Plaintiff’s arguing that the jury should act as the voice of the community or send a massage by its verdict and in support thereof would show the court as follows:
“The Final Argument is Designed to be Persuasive” – Not “Lukewarm and Sterile”
Because the purpose of final argument is to persuade the jury, attorneys enjoy a great latitude in crafting their arguments:
Counsel is not required to make such a lukewarm and sterile argument that the jury is unable to determine which side of the case he is on, and likewise counsel must be indulged the privilege of flights of oratory.
The final argument is designed to be persuasive, and so long as it is based upon the facts and issues raised by the evidence and not so inflammatory as to influence the jury to render an improper verdict, the argument is not intrinsically improper.
Rainbow Express, Inc. v. Unkenholz,
780 S.W.2d 427, 434
(Tex. App.- Texarkana 1989, writ denied) (citations omitted).
Accordingly, Texas law does not permit Defendants to micromanage the Plaintiff  family’s final arguments by motions in limine that would dictate what counsel can and cannot argue based on the facts and issues raised by the evidence.
Asking the Jury to Send a Message as the Voice of the Community is Proper Argument Closing “arguments to send a message to the … industry… have been held to be within the logical parameters of a closing argument when based on the facts.”
Schindler Elevator Corp. v. Anderson,
78 S.W.3d 392, 405 (
Tex. App .-Houston [14th Dist.] 2001, judgm't vacated w.r.m.).
Likewise, “pleas to the jury that it act as the voice of its community and ‘send a message’ are not improper.”
In re A.J.G., 131 S.W.3d 687, 692-93 (Tex. App.--Corpus Christi 2004, pet. denied); see also
Littleton v. Prange,
9 S.W.3d 223, 230 (Tex. App.-San Antonio 1999, pet. denied)
(“The involvement of juries in the judicial process provides an important voice of the community.”);
Wal-Mart Stores, Inc. v. Garza,
27 S.W.3d 64, 70
(Tex. App.-San Antonio 2000, pet. denied)
(“The standard of ‘reasonable care under all the circumstances’ enables a jury, as representatives of the community, to achieve an allocation of the costs of human injury which conforms to community standards of acceptable … behavior,”
Hardberger, CJ, concurring);
Haryanto v. Saeed,
860 S.W. 2d 913,919-21
(Tex. App. -Houston [14th Dist.] 1993, writ denied)
(rejecting challenge against closing argument urging that the jury “should render a verdict that upholds the values of equality that America represents” and “should render a verdict that sends a message”);
Rodriguez v. Hyundai Motor Co.,
944 S.W.2d 757, 774 (Tex. App.—Corpus Christi 1997), rev'd on other grounds,
995 S.W.2d 661 (Tex.1999)
(rejecting challenge to Hyundai’s argument which “appealed to the jurors, as citizens of Hidalgo County, to essentially make a statement … that… justice is not for sale in their county,” emphasis added).
The Texas Supreme Court approved jury arguments which ask the jury to “send a message” in Uniroyal Goodrich Tire Co. v. Martinez, which involved an unsuccessful challenge against a jury argument “for $500,000 for each of the thirty-four other lawsuits filed against Goodrich so as to send a ‘message back to Akron.’”
977 S.W.2d 328, 343 (Tex.1998) (emphasis added);
see also Gorman v. Life Ins. Co. N. Am., 859 S.W.2d 382, 389 (Tex. App.- Houston [1st Dist.] 1993, no writ) (argument asking “the jury to leave a ‘legacy’ … and send a ‘message’… was not improper,” emphasis added);
Gannett Outdoor Co. of Texas v. Kubeczka, 710 S.W.2d 79, 86-87 (Tex. App. - Houston [14th Dist.] 1986, no writ) (rejecting appellate challenge to argument asking the jury to “send a message” by their verdict because argument was supported by the evidence)
Arguments asking the jury to act as a representative of the community and to “send a message by its verdict” are appropriate both in cases seeking punitive damages and in cases which do not seek punitive damages.
Compare Ogden v. Wilson, 649 S.W.2d 780,
786 (Tex. App.—Austin 1983, writ ref'd n.r.e)
(punitive damage findings must be “grounded in the community's reaction, found in the jury's verdict, to the actions of” the defendant, emphasis added) with Nat'l Freight, Inc. v. Snyder,
191 S.W.3d 416, 420 (Tex. App.-Eastland 2006, no pet.)
(rejecting appellate challenge to argument asking the jury to “send a message …was improper because [plaintiff] did not seek the recovery of exemplary damages,” emphasis added).
Similarly, arguments asking the jury to “send a message by its verdict” are also appropriate in cases where the jury is required to apportion liability among multiple parties.
See Welch v. McLean,
191 S.W.3d 147, 162
(Tex. App.-Fort Worth 2005, no pet.)
(“arguing that a finding of more than fifty percent negligence was necessary to send a message to Dr. Welch that he was more responsible for Delores's death than Dr. Novotny” was not improper, emphasis added).
