I've Told You A Million Times To Avoid Cliches Like The Plague

Recently a year old re-print of a 1959 Writer’s Digest article by Donald Westlake started circulating on social media.

First off, if you don’t know who Donald Westlake is, go find out. You like rough edge crime stories, try his Parker books published under his Richard Stark pseudonym; you like funny crime, dig up the Dortmunder series under his own name; you like odd ball history, check out Under An English Heaven “being a true recital of the events leading up to and down from the British invasion of Anguilla on March 19th, 1969 in which no one was killed but many people were embarrassed.”

Second, Westlake was a serious writer in that he took the craft of writing Very Seriously indeed, no matter how light hearted and funny some of his books could be. He wrote a blistering letter (later turned into an essay) in the fanzine Xero (starts on page 97) where he excoriated the sci-fi field of the era as being neither artistically nor commercially viable.*

So who am I to challenge this master’s assertions?

Well, I take the craft of writing Very Seriously indeed myself, and to quote a late, lamented friend: “Fools rush in, and there we are…”

The Writer’s Digest article is a mixed bag, partially a quick off-the-cuff job for a few bucks, partially a valid observation on pitfalls in writing popular fiction in September of 1959.

Bear the date in mind, it’s crucial to this discussion.

This was an era when Americans read a lot. Millions of people subscribed to The Saturday Evening Post or dozens of other slick magazines (not to mention the digests, which are what the form the old genre pulps mutated into), and this meant each week dozens of new short stories or serialized novels were available to them (and that’s not counting non-fiction).

Westlake in 1959 was commenting on an over saturated market, one where too many writers and editors simply replayed old tropes over again and again because they knew a significant portion of their audience felt comfortable with them (this is particularly true in the slicks, more so than the digests).

Westlake divides his 36 plots into three groups: Mysteries, science fiction, and slicks.

My first quibble lays in what Westlake means when he says “plot”.

From the original article:

“A plot is a planned series of connected events, building through conflict to a crisis and ending in a satisfactory conclusion. A formula is a particular plot which has become stale through over-use.

“My own working definition of plot is what I call “5C.” First, a character. Anybody at all, from Hemingway’s old man to Salinger’s teenager. Second, conflict. Something for that character to get upset about, and for the reader to get upset about through the character. Third, complications. If the story runs too smoothly, without any trouble for the character, the reader isn’t going to get awfully interested in what’s going on. Fourth, climax. The opposing forces in conflict are brought together. Like the fissionable material in an H-bomb and there’s an explosion. Fifth, conclusion. The result of the explosion is known, the conflict is over, the character has either won or lost, and there are no questions left unanswered.

“5C: Character. Conflict. Complications. Climax. Conclusion.”

All well and good, but in his article Westlake provides almost no examples of same.

To me, a plot is a quick summary of a story that lays out beginning, middle, and end: G.I. Joe captures a Cobra secret weapon but doesn’t realize what it is. Cobra needs to get the weapon back without alerting the Joes to its potential, and the Joes must figure out what Cobra is after before they can get their hands on it.

(There’s a lot you can do with that plot. It can be a slam-bang action oriented story, a techno thriller, or a slapstick farce depending on your angle of attack.)

What Westlake presents are more along the lines of story springboards: ”What would happen if…”

A lot of the situations Westlake presents are rife with potential: “John Smith is sitting in the park, feeding the other squirrels, when a beautiful girl runs up, kisses him, and whispers, ‘Pretend you know me.’”

Okay, let’s list the possibilities, shall we?

She’s being stalked by a creepy guy and needs protection…

She’s been hired to set Smith up for some reason…

She’s mentally disturbed from trauma in her past…

She’s a flipping psycho intending to kill Smith…

She’s a secret agent slipping a secret code in Smith’s pocket…

She’s a silly college girl doing this on a dare, unaware Smith is a serial killer…

Six stories right off the top of my head, and each one could be played in several different ways, from deadly serious to over the top farce.

That’s a lot of potential in a single trope.

Here’s another: “John Smith, private eye, is sitting at his desk, when Marshall Bigelow, thimble tycoon, trundles in waving thousand-dollar bills and shouting, ‘My daughter has disappeared!’”

Well, d’uh, isn’t that what private eyes do? Find missing people? Or uncover who committed a crime when people don’t want the police involved? Or find out if a spouse is cheating?

Name a private eye story that doesn’t play off some variant of this. From Murder, My Sweet to Harper to Shaft, hiring a private eye to find a missing person is a perfect way to get a story started. “You find my Velma.”

Of the dozen story springboards he offers in his mystery section, none are unworkable, though two remain overly familiar to this day and probably are best avoided unless the writer can provide some incredible new spin.

The science fiction section is more problematic, and here’s where I suspect Westlake was slumming (there ought to be an article on the type of articles one shouldn’t write for Writer’s Digest that includes articles like the one Westlake wrote).

Seven of the eleven clearly reference classics of the genre, and if this wasn’t a deliberate dig at those authors on Westlake’s part, one can only argue that while they may be shopworn now due to retreads by the untalented, these ideas remain strong enough to support a good story.

The other four remain headscratchers. Two -- Adam & Eve and “atoms are tiny solar systems” -- are indeed hoary old ideas, burned off by EC comics earlier in the decade.

I can’t say there weren’t thirteen year old aspiring sci-fi writers who submitted these to publishers and editors back in the day, but they seem more likely to have been found on the pages of fanzines (i.e., what sci-fi geeks had before the Internet) than a professional slush pile.

We know Westlake was active to some degree in sci-fi fandom of that era; could those two tropes have come from seeing those stories in the pages of amateur magazines?

The remaining two ideas represent a ribald attitude I don’t recall seeing in sci-fi digests of that era.

Oh, sex was starting to rear its beautiful head in science fiction, and there were a few cutting edge stories, but these two seem more like set ups for smutty fanfic, not genuine submissions of the time.

Again, something I’d expect to see in a fanzine, not a professional market.

Like I said, I think this tips off that Westlake is having us on, that this whole article came off the top of his head in a matter of minutes instead of being carefully thought out.

On the other hand, his critique of slick magazine fiction seems pretty spot on and devastating.

While he covers several sub-genres, his primary focus seems to be on stories written for a female audience, the type found in McCall’s and Ladies Home Journal. He doesn’t come close to a dozen examples, however, as several (even those labeled as sub-examples) are just the same story springboard in different settings.

Two of his bad examples, however, stand out quite clearly as a dislike (whether personal / professional / aesthetic, I can’t tell) aimed at a specific series of stories found in The Saturday Evening Post, i.e., the Alexander Botts, tractor salesman stories of William Hazlett Upson.

One of Westlake’s verboten plots isn’t even a plot but a literary device: “Any story told in an exchange of letters”. The other one that ties into Upson’s oeuvre is “Joe Doakes, a traveling salesman for a paper clip company, gets involved in some pretty unbelievable adventures in a small town in the Midwest. The other participants are a local belle and a salesman for a rival paper clip company.”

The two combined describe Upson’s Botts stories to a T. The second one is richly ironic since Westlake eventually used the same basic premise for his Dortmunder series (the only change being Dortmunder is a thief, not a salesman; po-tay-to, po-tah-to).

Finally, Westlake left himself a huge out with “If you can take one of the 36 clichés listed above, and give it a brand new twist, so it doesn’t look like the same story any more, you may have a sale on your hands. If you search hard enough in the magazines on the stands today, you’ll find one or more of these variations currently in print.”

Look, I get it. I’ve faced deadline doom before myself, and more than once have fired off a short piece that contained all the depth of a dixie cup.

This isn’t the worst writing advice I’ve seen, but it’s far from the best, and Westlake coulda and shoulda done better.

* He wasn’t alone in his opinion, though ironically the 1960s proved to be one of the most fertile eras for the genre. Yet Westlake and other writers such as John D. MacDonald, Frederic Brown, and John Jakes left sci-fi for other genres because it couldn’t support them either as artists or professionals.

Realty, Real Property and Leased Land; Definitions, Discussion in addition to Explanations

Delaware, and the rest of the original British Colonies, features some land that is leased rather than owned by the owners of that land. Much of it is not evident to the casual observer. The land on Lewes Beach is leased, definitely not owned by the home owners. The land of Lewes Beachfront is owned by the Town of Lewes. The lands of Rehoboth by the Sea and Dewey Beach can include leased land too. Most of the leases on that acreage will NOT be renewed but will return to the owners and then the homes on top of that land will be removed by the home owners within their expense. Much of the land in Riverdale, for Indian River Bay, adjacent to Oak Orchard is leased as well. In Riverdale the leased land is had by Chief Clark of the Nanticoke Indians. We have about 50 % of the inhabitants of Sussex County living on rented land; most of that leased land is found in what people label mobile home parks or communities. However , in the communities there are seldom any homes that are truly wireless and there are even two story stick built properties on some of the leased lands in those communities. Condos and town houses are sometimes found on leased land at the same time. Some folks find all this rather difficult to understand. We Real estate agents and Attorneys use the term fee simple to describe secure that is being sold as real property; that is real estate. We all used the term leased land or leasehold interest to go into detail land that is not transferring as real estate. This rather time consuming text is regarding Leased Land, Real Estate, Private Place, Chattels, Mobile Homes, Homes on Leased Land along with a legal dissertation to define, describe and determine any differences. Terminology is important when discussing Real Estate, i. elizabeth. real property. Black’s Law Dictionary is the recognized, ideal source for legal definitions under our American Regularions; which is derived from English Law PROPERTY: In the strict legalised sense, an aggregate of rights which are guaranteed along with protected by government. BL6, p. 1216. PERSONALTY: Particular property; movable property; chattels; property that is not attached to housing. BL6, p. 1144 PROPERTY: (personal property) - Through broad and general sense, everything that is the subject connected with ownership, not coming under the denomination of real estate. The right or interest less than a freehold in realty, or possibly any right or interest which one has in matters movable. BL6, p. 1217 Therefore personal property, is certainly that which can be easily removed from the real estate, and is not likely real estate. Personal property includes crops, trees, shrubs, trailers, sheds, cars, mobile homes, manufactured homes that have an important Department of Motor Vehicle title instead of a deed, as well as contents of a home or building. In a home and / or business the personal property includes drapes, lighting fixtures, rugs (not installed carpeting) free-standing cabinets and cupboards, furniture, and even all the contents of closets, drawers and buildings. Properties without a foundation, that is sheds that are just supported through blocks are chattel property, that is personal property, without having to part of the real estate. Such chattel includes dog houses not to mention particularly the little storage buildings that are so common beyond homes today. LANDS: In the most general sense, comprehends any ground, soil or earth whatsoever... Black's Legal requirement dictionary 6th Ed. (BL6), p. 877 PRIVATE PLACE: As protected from being taken for public purposes, is such property as belongs absolutely to an man or women, and of which he has the exclusive right of biological mechanism. Property of a specific, fixed and tangible nature, very effective at being in possession and transmitted to another, such as properties, lands, and chattels. BL6, p. 1217. Private home is land, houses, and chattels. Private property is without a doubt protected from being taken for public uses. Secret property is owned absolutely. REAL ESTATE synonymous with proper property" and p. 1218 REAL PROPERTY... A general duration for lands, tenements, hereditaments (those things which are hereditary); which on the death of the owner intestate, passes for you to his heir. " BL6, p1263 ESTATE: The degree, amount of money, nature and extent of interest which a person has through REAL and PERSONAL property. An ESTATE in countries, tenements, and hereditaments signifies such interest as the renter has therein. BL6, p. 547 The definitions listed here all refer to: real estate = real property = residence = lands, tenements, and hereditaments. At first, one will probably think that ‘real property' is the proper term for 'all lands'. But it doesn't state the manner of ownership while clearly as the definition of estate. We just received a huge instance of this when the thousands of leased land quite a lot under the homes of several thousand people, in Angola, Cooking pots Nets, and Long Neck areas owned by the Robert Tunnel family was inherited by the children. IN OUR PLACE THERE ARE NUMEROUS LEASED LAND PROPERTIES AND THOSE PROPERTIES ARE THE REALTY OF THE OWNER OF THE LAND – NOT THE OWNER OF THE PLACE WHICH IS UPON THAT LAND. INTEREST: More particularly it means a right to have the advantage of accruing from anything; any right in the nature of residence, but less than title. - BL6, p. 812. Through this definition it's clear that INTEREST cannot be LABEL, since it is less than title. Interest may be a property to land, but it's not a right to absolute ownership for land. Those who live on leased land, thus, have primarily an interest in the land; and that interest is a lease-hold fascination. Is there a definition of property that says it will be land held in absolute ownership, as does secret property's definition? We can delve into this more. ABSOLUTE HEADING - As applied to title to land, an exclusive label, or at least a title which excludes all others not even compatible with it. An absolute title to land cannot are available at the same time in different persons or in different governments. BL6, w. 1485 PRIVATE PROPERTY -... is such property because belongs absolutely to an individual, and of which he has the particular exclusive right of disposition. BL6, p. 1217 PERSONALLY OWN - To have a good legal title; to hold as real estate; to have a legal or rightful title to; to have; to produce. BL6, p. 1105. To "own" is to have heading. An interest is LESS THAN TITLE. ESTATE: The degree, quantity, makeup and extent of interest which a person has in legitimate and personal property. An estate in lands, tenements, and hereditaments signifies such interest as the tenant seems to have therein. - - BL6, p. 547 From all these definitions, it's plain that we can't absolutely "own" properties. We can only have a qualified ownership of qualified and also described ownership of Real Estate. Thus, we need that Action Description to describe it and qualify it. That title is also qualified by various government rights, decrees plus laws, from antiquity, such as rights against trespass. Who ownership is qualified by taxation, zoning, rights in way, and a myriad of other entailments. We need, therefore , the title search to determine those entailments, some of which are invisible. Therefore there is NOT as much difference in the rights and liberties of ownership and interest as one is led to feel. I have no problem with those who live on leased land as an alternative for owning the land. Usually they are paying far less compared with it would cost them to own the same property. However , individuals don’t often get any appreciation of the land; typically the landlord gets the appreciation in real value, while the citizen can appreciate the lifestyle for less cost per month or perhaps year. However , since an interest in leased land seriously isn't automatically transferable and is NOT Real Estate and since the chattel property upon it, the mobile home is particular property, without a deed but instead has a title – Agents are not by law supposed to be involved in the sale of such – but we are. We are supposed to only be selling genuine property. It gets all cloudy and foggy doesn’t it. That is why there are people and companies who market mobile homes on leased land who are not realty and don’t need to be. In fact , although no one will talk about it, Realtors are not supposed to sell mobile homes in leased land. We don’t need to engage in that combat any more than I just did by describing it. POSSESSION: The complete dominion, title, or proprietary, including right from a thing or claim... Ownership of property is sometimes absolute or qualified. The ownership of property will be absolute when a single person has dominion over the software, and may use it or dispose of it according to his joy, subject only to general laws. The ownership is capable when it is shared with one or more persons, when the time of fun is deferred or limited, or when the use is fixed. - BL6, p. 1106 Such sharing is normal with husband and wife, partners, families and corporations, etc . DOMINION - Generally accepted definition of "dominion" is perfect control on right of ownership. The word implies both title as well as possession and appears to require a complete retention of deal with over disposition. - - -BL6, p. 486 It is my opinion you'd agree that zoning, building codes, home owners connections covenants, condominium documents of use and business licensing is actually a restriction on the use of land (if it's Real Estate). And there is obviously the fact that failure to pay property taxation's on real estate will result in loss of said property. That's rarely absolute ownership. But private property is defined as ABSOLUTE TITLE, not qualified (interest). PROPERTY (tangible) - All building that is touchable and has real existence (physical) whether it is authentic or personal. - - BL6, p. 1218 On summation, it takes a good attorney, and one well versed and veteran in real estate to understand the complex definitions, rights, liabilities, and privileges of real estate ownership. I have been buying and selling realty for myself and assisting others in the buying and selling regarding real estate for thirty years. I have taught courses regarding real estate and real estate law. And, I would NOT take into account purchasing a property, or purchasing property on leased area without the professional and paid assistance of an attorney who's going to be a real estate specialist in the exact county in which the place is located. Other attorneys from other areas are not valid selections at all.

4 Future Funk Releases Deserving of a Vinyl Press

As 2020 looms, I inevitably start thinking about filing for tax returns. Getting some cash back from the Internal Revenue Service means more disposable income to drop on vinyl. While I’ll be spending quite a bit more on Japanese ambient wax this year, I’ll be ear-marking a fair share to go into vaporwave and future funk releases.

With the platform that I have currently, it’s now a definite responsibility to identify some gems that deserve a label to step up and put together a killer release on wax. With the social reach that I’ve gotten in just two months of somewhat milquetoast long-form reviews, it’s honestly a bit insane — but I’m also insanely thankful. I certainly wasn’t expecting over 400 followers from Japan when I’m publishing in English, so — ありがとうございました!

Over the past five days I’ve compiled a pretty exhaustive list of 100 digital-only and digital/cassette releases that I’ve streamed the most over the past year. To suss out which releases sounded best for hi-fi consumption, I decided to test them on my two Christmas gifts this holiday — A Cambridge Audio 851N network streamer/pre-amp and a pair of new “anniversary” JBL 4312 Mk2 speakers powered by my vintage H/K 700 series Amp. While most of the list slapped on this new kit, there were four releases that I felt were truly deserving of getting a wax treatment in 2020. These are, in effect, the ones I’d be a guaranteed buyer of. Here they are:

Marsy + HER by Marsy

Admittedly, I stumbled on Marsy’s work just by scrolling through the list of releases through Bogus Collective, which over the course of 2019 has rocketed to the top of my list of favorite digital labels for discovering new artists. While this is of course a fine way to discover an artist — I’m stunned that I didn’t first encounter Marsy’s work on the two most visible channels for future funk discovery and appreciation — Artzie & Real Love Music. Unfortunately Real Love and Artzie haven’t been keeping up with their releases, with the most recent video on youtube from either curator dating back to November 2018. While I do get a deja vu feeling with Marsy — as in, I must have seen them on these platforms before -- perhaps with actually being cognizant, an artist of this caliber should be all over those channels on a basis at least roughly corresponding with their releases.

Do better, fellas!

Marsy’s most recent work is an absolute banger with one of the widest mixes I’ve listened to this year. The JBLs absolutely ate up the rich bass and low-range in most of Marsy’s tracks, and for a moment I had to ask myself how this release was sitting around as a digital-only. This is just one of those funky profiles made for vinyl. That being said, 7 tracks seems a bit light for a twelve-inch LP, so if I was advising a label (happy to do this pro-bono!) I’d maybe pair this album with another robust, high-energy release from Marsy: 2018’s 5-track Her EP, which coincidentally has one of my favorite individual future funk tracks (愛のFantasy) and absolutely brilliant cover art.

Star Virgin -- サクラSAKURA-LEE

I’m going to go on a soapbox for a moment here: I don’t like Qrates. I’ve bought from Qrates campaigns before and often find their wax brittle and their presses tinny. Now, there are a whole host of reasons why this could be the case — vinyl necessitates a much longer production line — and this inevitably creates errors. But these errors should be corrected by someone in a quality control department. And if you talk to any of the major labels, relationships with QC/QA people are some of the most essential recipes to a good physical release. This is in effect the primary function of a physical-oriented underground label: ensuring a proper quality press by ordering tests, and keeping limited back stock in case there’s some kind of slip-up. Qrates campaigns don’t offer this in sufficient degrees — and as a result makes a lot of potential buyers feel insecure.

This all said, Sakura-Lee’s unsuccessful Qrates campaign shouldn’t be seen as a lack of desire to support a proper wax release of their iconic Star Virgin release — I genuinely think it’s regarding people’s reservations about dropping $30 or more for vinyl of potentially mediocre quality. Ultimately, this is where labels should step in, build up some buzz, and provide a modicum of quality assurance to truly finalize that sale. I’ve talked to a lot of audiophiles who would love the hear tracks like The Sweet Escape and Feelings with the warmth of vinyl. Sakura-Lee’s sound is so unique and so well-suited to the format. As an owner of the Star Virgin minidisc, I can certainly attest to the quality of that release and the great sound it’s produced on my hi-fi. But minidisc is cold. Crisp, but cold. Star Virgin is musical joie de vivre -- it has all the energy of life itself, and contrasts with the almost archival and clinical nature of the minidisc format. In my view, there’s no doubt that with the right master and press, this would produce an otherworldly sound worthy of its title once it finds its way onto wax -- hopefully in 2020!

Kween Pepsi -- Jesse Cassettes

Latin future funk is the warmest of all future funk. This is partially because us Latins (your humble reviewer is named Sebastião, after all) are the warmest people in all the world. It stands to reason then, that vinyl, music’s warmest medium — is a natural fit for for the funkiest of all music. I first discovered Jesse Casettes on the Eternal Vibes compilation, which is a compilation full of warm, Latin sounds and Jesse Cassette’s contribution to it was my absolute favorite. I’ve been a huge fan of their work ever since.

Kween Pepsi is a masterwork that toys with a good speaker’s treble response like nothing else I’ve listened to. Only a few future funk artists can reach this level of playfulness on the high end — Night Tempo, Cosmic Bae, and a few others. But almost none sound quite as fun as Jesse Casettes, and none sound as polished and well-mixed. Kween Pepsi hits you with banger after banger, and the Seikomart tape was already a commercial success. It stands to reason that Kween Pepsi could get a nice master and fly off the market, giving audiophiles another grail on vinyl that stands out as one of the genre’s finest albums of the decade. Bringing it into the next with a new physical seems like a great idea. What DJ wouldn’t want to drop the needle on a track as well arranged and layered Osaka Fall Season Nights and let their system shine?

Miss — Flammy

Real Love beat me to the punch very recently by featuring Flammy on their channel, but Flammy is still an under-appreciated artist that I’m hoping to see 2020 herald big things for. I’ve always appreciated their deeply creative sampling, and their mixes consistently sound rich and full on every hi-fi system I play them on. I happened upon “I bet my girlfriend is chinese and aesthetic” (a title very real for me as my girlfriend is both chinese and aesthetic) back in early 2018 and was instantly impressed on how it made my KEFs absolutely werk in spite of my stodgy old British floor-standers never receiving vaportrap/future hop with very much vigor.

After kind of losing track in the waves of new releases over the past year or so, I re-discovered their work this month after Miss released, and their mixes, creative micro-sampling (City Hunter, anyone?) have been just as rich and rewarding to both my system and my ears as on that initial listen. As I said earlier, I genuinely think this Lille, France-based artist is on the verge of a blowup, and when that happens I want to make sure my childish ranting of “I want this on vinyl!” is heard sufficiently by whatever label steps up to the plate. My suggestion: maybe get this EP on a 10-inch.

SAS 5 - Great Minds

May 1994 - Washington D.C.

The body was a 34-year-old male, Puerto Rican, gang member who had been the star witness in a Department of Justice trial involving a cartel operating out of the Port Authority in New York, importing goods and drugs for distribution and sale on the black market. The case was run of the mill, honestly, and the unfortunate fellow had been pretty cut-and-dry as far as such cases went. There wasn’t much a bullet to the back of the skull was going to tell you outside of the fact that the caliber was enough to make an open casket impossible for his family. Scully did what she could to ensure that the funeral home didn’t have to deal with too much of a mess, sewed up the Y-incision and went back to her office to begin writing up her notes.

She was only mildly surprised to see anyone sitting in there. Certainly, she was used to the itchy agent or three who would on occasions camp out there with the impatience of a hyper two-year-old waiting for the results for their investigation, and in fact she had been expecting that very thing on the body she had just put into the freezer. She didn’t even pause as she rounded towards her desk, barely looking at the woman seated across from it.

“Javier de Valle was a standard execution, plain and simple. Was asked to kneel in a parking lot, hands behind his back while they put a slug into the back of his head. The exit wound obliterated much of the upper part of his face. I’m getting ballistics to give me the specs on the weapon used and if it’s traceable, and when they do, I’ll add those to my report. I should have something preliminary for you by the end of the day with addendums within the next 48, depending on how our trace goes.”

The woman merely blinked dark eyes at her, a hint of something tugging at her lips. “Well, that was a horrible way to die.”

It was the British accent that caught her attention, as few people from Justice ever had one of those. She paused, really looking at her visitor for the first time. An older woman, maybe in her 60’s, still clearly vibrant judging from the bemused smirk on her faintly lined face, hair slowly fading from brunette to silver. Her well tailored suit and elegant pearls made Scully suddenly very aware of the standard-order scrubs she was wearing and her own copper hair pulled up in a messy scrunchy at the top of her head.

“Ummm...I’m sorry, I thought you were from Justice, on the body I had sent down to me.”

“I wish I was now, it sounds fascinating.” She shrugged, regarding Scully quickly. “Let me guess, gang killing, likely drugs or some such, and your body was an informant?”

Scully couldn’t deny or affirm that, so she only stared. The woman only seemed more amused by that.

“Of course, it’s the sort of everyday, run-of-the mill stuff that the Department of Justice feels they need to send to Quantico, because nothing less than their best forensic pathologists would do. After all, not everyone can tell that a man having his face blasted off was shot in the back of the head.”

“In fairness, most people wouldn’t get past the face being missing, but beyond that, I suppose they could have used a New York City coroner. They are backed up for a week or more, however, and as this was a key piece for a DOJ investigation, they came to me, as they should.” Scully leaned back in her chair, regarding the stranger. “You know, Quantico is a Marine base. They don’t just let anyone in here.”

“Well, good thing I have the clearance for that sort of thing.” Her smile was now genuine as she leaned across the desk, placing a white card in front of Scully. It read “Margaret Carter, Director, Strategic Homeland Intervention, Enforcement, and Logistics Division”

Scully suddenly felt her mouth go very, very dry.

“Director Carter,” she managed, clearing her throat and tugging at her blood spattered and rumpled top. “I...uh..how can I help you?”

“I just wished to say hello, introduce myself, and tell you that Agent Coulson is speaking to your friend on my orders.” Her expression was mild enough, but there was something of the predator in her as she leaned back, crossing her legs at the knees, pulling her skirt down primly. “I must admit, I find it admirable the devotion you have for Agent Mulder. It’s rare to find that in our line of work. Though, to be fair, you two aren’t exactly the standard for FBI agents, now are you?”

“May I ask why you are reaching out to Mulder?”

“Because I know his father.”

That gave Scully pause.

If she expected Director Carter to elaborate, she was mistaken, as she breezed by that tidbit. “Agent Mulder has been on our radar for some time, since before the FBI managed to snare him. It is unfortunate they did because they’ve squandered the talent as they always do. Bill Patterson is a jackass and always has been, but, that’s where they put your partner and nearly ruined him for anything else.”

Scully’s brain swum as the other woman rattled off the information, racing to try and keep up with her. “I’m sorry, you said that SHIELD wanted Mulder first?”

“Oh, we had every intention of taking him. Politics got in the way of that.”

“But Mulder was a profiler. He didn’t work anti-terrorism.”

“As brilliant as your partner’s mind is, Agent Scully, I didn’t want him because he knows how serial killers think. I wanted him because of the way he thinks; outside the box, without labels or preconceived notions, willing to turn the picture on its side and look at it in a different way.”

“I see.” She didn’t really, but she wasn’t willing to admit that. “And this has nothing to do with the X-files, the death of a high profile man in a global conspiracy who served as Mulder’s informant, or the fact that Mulder was infected with a strange virus whose origins cannot yet be quantified?”

“It could be all of that, too.”

None of this made sense.

“I’m sorry, Director Carter, but I find it hard to believe that a global organization such as SHIELD is going out of its way for someone the FBI has nearly written off. Why not just approach him out in the open, like you and I are? Why all the clandestine business?”

Far from offending the other woman, Scully’s tone made her laugh outright. “I knew I’d like you from the start. I pushed to have the pair of you, honestly, but Fury said to try the more obvious one first. I’m glad to see my instincts were right.”

Before Scully could feel nettled enough to demand answers, the other woman leaned over to a briefcase at her feet, pulling out a file she flipped open on her lap. “Dana Katherine Scully, born 1964. Your father was career Navy, retired a read admiral, your mother was a homemaker and now spends her retirement volunteering and working for veterans’ causes. You have three siblings, a sister, Melissa, who last we saw was driving up the coast of California to see friends in San Francisco. You have two brothers, both career Navy, one in San Diego, the other based in Norfolk, specializing in naval intelligence.”

She raised an eyebrow at that. “Interesting...might have Fury look into him.”

“Is there a point reciting my life story?”

“I like knowing about people.” She didn’t even look up from the page. “You graduated from Maryland summa cum laude taking a bachelors in physics, and then Stanford Medical, where you specialized in cardiology before switching to pathology and the FBI. Had it not been for Daniel Waterston, you’d have been making high figures fixing hearts, instead you are in the basement of the Hoover Building trailing after a man whose heart was broken years ago and he’s never been able to fix it. Why?”

She might as well have dumped cold ice water over Scully’s head for all the shock Carter caused. She hadn’t expected her to drop Scully’s previous sins on her like that.

“I...my father and brothers were Navy. I wanted to do something equally as worthwhile, to make a difference.” It was mostly the truth.

“And a broken heart from a man cheating on his wife wasn’t the reason?”

“Do you honestly think I’d still be here, doing this, if Daniel Waterston is the only reason I joined the FBI?”

Her answer seemed to please Carter. “You didn’t want to join the Navy yourself? You have brains, a medical degree, you could have excelled. They are always looking for that.”

Scully did know that, had even considered it, briefly. “When I was a girl, my father was more often away than at home. It was Vietnam, he was off at one base or the other, and my mother was left in San Diego fending for four kids and praying that he’d come home safely from wherever her was stationed. Granted, it wasn’t World War II, but we all saw the news every night, the names read off. I wasn’t interested in being shipped off to fight in a war and break my mother’s heart.”

“Even though women can be in the military, now, which was more than in my day.” Carter only sounded slightly bitter at that.

“There are other enemies and other ways to fight a war and I’m not Captain America, able to throw myself into battle and defeat my enemies by just beating them into submission.”

She had meant it as a small joke, a call back to SHIELD’s history with the SSR. She had struck a nerve, though. Carter’s geniality faltered, briefly, regarding Scully, as if attempting to stick her 5’2 frame into anything close to Steve Rogers and failing miserably.

“No,” she finally sighed, somewhat sad, somewhat humorously grieved. “Few people can claim to be as hard-headed or foolishly determined to fight unwinnable wars as Captain Rogers was. But, I think your friend, Fox Mulder, might just give him a run for his money.”

That made Scully snort loudly. “He just might.”

She wasn’t sure what it said about Mulder if they could mutually agree he was almost, but not quite, foolish enough to do something like take an untested serum in order to fight super-Nazis. Scully didn’t think she wanted to put the notion in his head.

“Back to the matter at hand, you joined the FBI to make a difference, to have a bit of adventure, use that incredible talent of yours to solve the world’s problems and not just triple bypasses. So, why are you stuck in Quantico again, dissecting gangland executions for needy DOJ prosecutors who got their short hairs in a twist because they didn’t protect their informants well enough?”

Scully nearly choked on her own spit as Carter dropped them neatly between them, all tweed and pearls, as cooly as she was discussing the weather. “Well, I’m here because that’s where the FBI assigned me after Agent Mulder’s unfortunate fall out and the closing of the X-files.”

“Are you seriously happy here, though, doing work any city examiner could do while teaching green-faced cadets how not to puke at the sight of blood and guts coming out of a corpse?”

“Is it what I’d like to do, no, but I’m knowledgeable at it.”

“I’m knowledgeable at how to make a good cuppa and not dribble on myself and yet you don’t see me at tea parties.” She sniffed mildly, disdain evident. “All this talent wasted because the FBI wanted to reign you in and shut you up. Are you really content accepting that?”

“And what, leave? To do what? Work for you?”

Carter only arched one dark, elegant eyebrow.

“I’ve never done the work SHIELD does. I’m a pathologist who has some skills in an ER, that’s about it.”

“You also have some knowledge on a virus known as ‘Purity Control’ correct?”

How in the hell did Carter know about that? “I’ve seen it, yes, but the evidence I have for it is gone now.”

“Yes, I’m afraid it is. But, I can help you and Mulder find it again.”

“How? His contact has already been killed.”

“Because the FBI has no idea what they are dealing with, but I do. SHIELD has been fighting them for decades. And I’m offering a chance for you to come alongside Mulder to keep up your work.”

Keep up their work? Opening the X-files?

“What is it that SHIELD does again?”

“A little bit of everything, Agent Scully, but primarily we protect, just like every good shield does. Things, places, but mostly people. We are what keeps the world safe at night, able to live another day, because there are things out there that are far bigger than armies or governments, and threats that no one could even predict or begin to understand. We are the first line of defense, and if we are lucky, the only one they ever meet. That’s the idea, anyway, and I should know, as I helped found the bloody place.”

Found? Scully’s eyes went impossibly wide as she stared at the woman in front of her. “You...helped to found SHIELD?”

“Why yes, darling, else the thing would have never gotten off the ground, though I daresay without Chet and Howard we’d have failed even getting that far. The threats didn’t end because Hitler was dead. There needed to be an organized group that could handle these sorts of bigger-than-life threats, ones that all the superpowers caught in their Cold War were too busy to pay attention to. Thus, SHIELD was born.”

All Scully could think in the heat of the moment was that the Gunmen would die of absolute envy at this moment.

“So you want Mulder to help you stop global threats?”

“Fox Mulder isn’t the only one we want.”

Scully knew it was coming, but even when the other shoe dropped, she still felt stunned. “I’m just a forensic pathologist. We are a dime a dozen.”

“You are a gifted scientist, a talented doctor, and you’ve managed to keep up with the likes of Mr. Mulder for over a year, which knowing his reputation I say is an impressive feet. Beyond that, I’ve seen your work. You have a clinical mind and a meticulous investigatory brain and I want it. The Bureau is wasting what talent they have here throwing you at gangland killings and raw recruits, you have more to offer than that.”

Scully glanced down at her scrubs, then at her desk, the piles of papers stacked in the corner, the notes scribbled across a legal pad, the tape recorder with her verbal notes on it from her autopsy. She hadn’t minded returning to the lab, really, but if she were honest with herself, she missed the field work she had been doing with Mulder, the true investigations, the search for the truth. Besides, if he was going to be working for SHIELD, he would need a minder.

“How is your insurance plan?”

At that, Carter smiled widely. “As long as you don’t mind the occasional experimental treatment, I think you will find it adequate.”

“Good, because you are going to find that Mulder is going to need it.”

This places the burden on the Information Security Professional to champion the cause at corporate level and provide the confidence and security that patients need.

Unfortunately, there are a few gray areas in the interpretation of the scope and responsibility of the Information Security Profession. The Wall Street Journal reported on the secret transfer of 50 million Americans medical data to Google for their own purposes under the Nightingale Project. It is also reported that Amazon, Microsoft and Apple are also pushing aggressively into the healthcare market. (wsj.com11/11/2019 4:27) This is not to be confused with another deal between Google and other smaller groups like Colorado Centre for Personalized Medicine, who only send encrypted data with the keys being held only on the medical site.

Let's raise the Bar...

Obviously, the massive tide of opportunities presented by larger organizations moving into the healthcare market cannot be ignored. For some people, the temptation to broker a deal with Google regarding your user data may appear financially tempting. However, as we all know, with that bait comes the call to maintain ethical standards of the medical profession, within our business and security framework.

Similarly, with the massive increase in commercial value of medical data among the criminal community, comes a call for greater depth and breadth in information security services for medical data. The volume of commercially available attack tools is growing daily. The sophistication of the more targeted attacks often requires a degree of forensics beyond the scope of most in-house cyber security teams. Very few organizations can afford the cost of a team of specialists in such a wide range of experiences.

Medical Professional Standards

The aim in Caresocius is to promote the same standards of integrity and confidentiality in Information Security that are applied to the medical profession.

To make this more real, lets make it personal.

How would you like your mothers medical data to be sold, profiled and used to manipulate her daily life, what she buys, where she goes and even what news she receives.

The security community recognize that medical data has greater longevity so more commercial value than even banking details. Banking details can be changed but medical data stays for the rest of our lives.

One challenge is to enable even the smallest point of contact with medical data to have the same data vault integrity as institutions with the resources to employ a full information security management and response team.

Another challenge is to promote and maintain adopted ethical approach to data security at all levels of operation.

Perhaps it is a little easier to promote ethical standards in a tight-knit, business community. Generally speaking, the larger the community the harder it is to get the adoption of ethical standards as a way of life.

However, presenting and maintaining a viable security profile for a clinic, at all levels of the organization is a challenge when resources and experienced staff are not readily available.

Beyond the Bounds of the Enterprise

In these times of global connectivity, some wanted and some unwanted, even the smallest institution can be hit by a state-sponsored actor on another part of the globe.

Since they are no-longer the target but they become the vehicle to target others, the concept of the “Small, insignificant target” no-longer exists. Every member of the team is a useful target to the commodity hacking tools now available.

So, even the smallest medical service provider needs a strategy to stand against the thousands of spiders creeping across the threads of the global web.

The general feeling used to be that only the larger companies have sufficient resources and SME's are stuck, stranded, without any defence against the tremendous breadth and depth of commercially available exploits on the fingertips of potential criminals.

While waiting for the annual check-up on my car I met John Sherwood, the founder of SABSA, an enterprise security architectural standard. In that conversation I found confirmation of my concerns that we should broaden the security scope from Cyber Security to Enterprise Security- protecting the entire business model.

It became clear that although we had a small team, our personal experiences in emergency, crisis and recovery scenarios, coupled with I.T. and network management was sufficient to shift the focus from the narrow field of internal cyber security to externally supported Enterprise Security. It became clear that cyber security must incorporate the security of all aspects of the enterprise, from cleaner to client facing web services.

To carry this out would normally require considerable in-house resources. At Caresocius we decided to adopt the concept of standing on the shoulders of giants.

Why try to do in-house what is already available somewhere else!

With the global connectivity of data comes the global connectivity of security products and services.

The strategy has been to develop four columns of expertise and experience that we could depend upon; Governmental, Industrial, Academic and International Standards.

With these columns we can offer a stable support to the full spectrum of clinical service providers with the confidence that their Armory behind us can deal with most of our security concerns.

Governmental

In 2016, the UK Government, national Cyber Security Centre formed the Active Cyber Defence initiative to reduce the high volume of commodity cyber attacks on UK businesses.

They recognized that the NCSC already developed strategies to help their national infrastructure defend against commodity cyber attacks. Recognizing that these were plaguing much of British industry they decided to offer these services to vetted organizations working in critical industries.

We have found the services and experience invaluable, from basic take-down service, mail check, web check and a vulnerability disclosure platform to guidance and collaboration from highly skilled professional.

Industrial

Having explored various organizations, we formed partnership with a few high value partners. These have given us the capacity to carry out remote vulnerability analysis, rapid detection and response, cloud protection for the sales force, and to call upon specialist services for escalated incident response if needed.

Academic

It is always useful to keep track on what the academic community is doing in their explorations and development of new lines of research and development. With the changing academic climate, many universities are seeking industrial contacts to generate revenue and their input is highly valued. As part of the E.U. Funded H2020 CUREX project. This has a focus in cyber security in healthcare. It works to discuss challenges, methodologies, tools and solutions to reduce the risks in clinics and hospitals.

International Standards

It became clear that standards are more of an asset than a problem.

We have seen how ISO27k, GDPR and HIPAA bring a degree of structure and consistency to the industry. They enable us to promote a genuine, maturity assessment to the board of most organizations. The risk of penalties is no-longer a burden to the InfoSec team but becomes a checklist that brings financial pressure on the commercial side to take things seriously and invest in security.

We find that bringing GDPR to the attention of Medical Data Management outside the E.U. re-enforces the need for Security by Design and restores the concept of Personal Ownership of data. This in turn lead Caresocius to place a Block-Chain approach into the long term development program for patient controlled data.

In Conclusion

With £130bn stolen from global consumers in 2017, the global cyber crime market is an attractive source of revenue for organized cyber-crime. The situation is getting more serious within the US healthcare market where Universal Health Services stalled due to a cyber-attack, forcing some hospitals to resort to pen and paper. With an average ransomware payment of $234k USD and a median payment of $110k USD, the US healthcare services are becoming more aware of the risks they face. Not all these attacks are sophisticated. The fatal attack on a hospital in Germany was a result of widely used commodity software with known vulnerabilities that had not been identified. The legacy systems of some medical equipment and associated IT have been a challenge for some health centers. There may be a general reluctance to throw away a perfectly good medical scanner just because it can only work under Windows 7 for example.

However, with the globalization of data comes the globalization of the tools and services available from the cyber security community. Find the sources of experience and skills among the wealth of services available and build partnerships that will benefit you both. Do not try to go it alone, the front-line battle is too broad and the sheer volume of attacks too great.

You will be surprised at the quality and level of support these partnerships can bring. These mature professionals have acquired a range of experiences and have a willingness to step in if the problem seems overwhelming.
