Thursday round-up
Yesterday the court issued its two remaining decisions of the term, and Justice Anthony Kennedy, long viewed as a âswingâ justice, announced that he will retire as of July 31. An early round-up of coverage of and commentary on the Kennedy retirement came from Jon Levitan for this blog. For the Los Angeles Times, David Savage reports that âKennedyâs decision to step down offers conservatives the opportunity they have long sought to lock in a reliable five-member majority on the high courtâ and âcaps what was already one of the most difficult terms for liberals in recent memory, including defeats on issues such as public-sector unions, Trumpâs travel ban and voting rights.â Additional coverage comes from Brent Kendall and Jess Bravin for The Wall Street Journal, Adam Liptak for The New York Times, Marcia Coyle and Tony Mauro at The National Law Journal (subscription or registration required), Kevin Daley at The Daily Caller, and Mark Walsh at Education Week. Coverage of Kennedyâs most significant opinions comes from Emily Cochrane for The New York Times, Jessica Contrera for The Washington Post, and Tony Mauro at The National Law Journal (subscription or registration required). At Bloomberg, Greg Stohr reports that the retirement âputs conservatives in striking distance of one of their most cherished goals: overturning the landmark Roe v. Wade abortion-rights ruling.â At The National Law Journal (subscription or registration required), Tony Mauro reports that â[i]t did not take long for the Washington nomination machine to kick into gearâ after the announcement. The New York Times lists the front-runners to be Kennedyâs replacement, as do Felicia Sonmez and others for The Washington Post.
At Jost on Justice, Kenneth Jost remarks that âKennedy gave liberal advocates and interest group little reason to cheer in his final term with his opinions and votes and no special reason apart from his previous record to mourn his decision to retire after 30 years on the Supreme Court.â Additional commentary on and analysis of the retirement comes from Emily Bazelon for The New York Times, Ian Millhiser at ThinkProgress, James Burling at the Pacific Legal Foundation, Howard Wasserman at PrawfsBlawg, Sean Smith at Ikuta Matata, Charlie Savage for The New York Times, the editorial board of The Washington Post, and the editorial board of The Wall Street Journal. At Modern Democracy, Michael Parsons looks down the road to the next retirement, possibly of Justice Clarence Thomas.
In Janus v. American Federation of State, County, and Municipal Employees, Council 31, the court, overruling longstanding precedent, held 5-4 that an Illinois law allowing public-sector unions to charge nonmembers for collective-bargaining activities violates the First Amendment. Jon Levitan rounded up early coverage and commentary for this blog. Mark Walsh has a âviewâ for this blog of the opinion announcement from the courtroom. At The National Law Journal (subscription or registration required), Tony Mauro also reports on the scene in the courtroom. At Good Judgment, Ryan Adler notes that the forecasting crowd âwent out with its own bang at 85%.â Additional coverage comes from David Savage for The Los Angeles Times, Kevin Daley at The Daily Caller, Commentary comes from William Gould at Stanford Law Schoolâs Legal Aggregate blog, the editorial board of The New York Times, and Howard Wasserman at PrawfsBlawg, who observes that âthe opinion demonstrates why asking SCOTUS nominees about stare decisis is pointless.â [Disclosure: Goldstein & Russell, P.C., whose attorneys contribute to this blog in various capacities, is among the counsel on an amicus brief in support of the respondents in this case.]
The last decision of the day, and the term, also 5-4, was in Florida v. Georgia, in which the court held that the special master had applied too high a standard of proof against Florida in its claim of injury from Georgiaâs use of the water in the Apalachicola-Chattahoochee-Flint River system. Lara Fowler analyzes the opinion for this blog. At E&E News, Amanda Reilly reports that although the court âhanded Florida a partial win in the long-running Southeast water wars, reviving the stateâs case against Georgia over water use in the Apalachicola-Chattahoochee-Flint River Basin,â â[t]he case ⌠is far from over.â Counting to 5 (podcast) discusses todayâs opinions.
At The Hill, Lydia Wheeler reports that in Trump v. Hawaii, âJustice Anthony Kennedy, possibly the swing vote in Tuesdayâs 5-4 decision upholding President Trumpâs travel ban, issued a concurring opinion that appeared to warn the president against making statements that disfavor any one religion.â Coverage of the effects of the ruling comes from Abigail Hauslohner for The Washington Post and David Nakamura, also for The Washington Post. Commentary comes from the editorial board of The New York Times, Ruth Marcus at The Washington Post, and Curt Levey in an op-ed for Fox News,
At The Federalist, Margot Cleveland weighs in on National Institute of Family and Life Advocates v. Becerra, in which the court held on Tuesday that Californiaâs Reproductive FACT Act, which crisis pregnancy centers to make disclosures, including about the availability abortions, likely violates the First Amendment, writing that â[b]y ignoring the question of viewpoint discrimination and instead analyzing the FACT Act on its faceâand holding that the law cannot withstand even mid-level scrutinyâthe majority opinion provides crisis pregnancy centers a nearly impenetrable protection from government interference with their pro-life message.â For The New York Times, Elizabeth Dias and Sydney Ember report that â[w]hat many partisans on both sides agreed on ⌠was that Justice Gorsuch â who voted with the 5-to-4 majorities in both [Trump v. Hawaii and NIFLA] â was an especially key figure in Tuesdayâs decisions, because he wouldnât have been on the court if Mr. Obama had been successful with the original nomination of Judge Garland.â
Briefly:
At Rewire.News, Elizabeth Reiner Platt maintains that â[i]n four decisions issued near the end of the U.S. Supreme Courtâs 2018 term, the Court offered wildly different accounts of the significance of, and its duty to redress, âdiscriminationâ in U.S. law.â
At The George Washington Law Reviewâs On the Docket blog, David Brunori looks at South Dakota v. Wayfair, in which the justices ruled that states can require out-of-state retailers who donât have a store or warehouse in the state to collect tax on sales to state residents, suggesting that â[e]nding the physical presence test will not end the debate or discussion.â [Disclosure: Goldstein & Russell, P.C., whose attorneys contribute to this blog in various capacities, is among the counsel to the petitioner in this case.]
We rely on our readers to send us links for our round-up. If you have or know of a recent (published in the last two or three days) article, post, podcast, or op-ed relating to the Supreme Court that youâd like us to consider for inclusion in the round-up, please send it to roundup [at] scotusblog.com. Thank you!

Headcanon #2
Seth doesnât like to be touched, especially by people he doesnât know well. This is because the only times he has experienced touch were during conflicts, causing him both physical and emotional pain.
To this day, Garland Levitan is the only one who can touch Seth without him getting nervous.

What Happens when I Gizoogle Chapter I of "Shards of Darkness and Light"
(Original can be found here)
~*~*~*~Shardz of Darknizz n' Light~*~*~*~
PROLOGUE
Two muthafuckin years ago, tha ghetto was beset by nuff fuck ups - thangs like fuckin earthquakes, tsunamis, n' volcanic eruptions. These calamitizzles was caused by four elemenstrual fiendz n' they creator, Chaos - tha god of discord. Y'all KNOW dat shit, muthafucka! Even all up in these catastrophes, the playaz of tha ghetto clung ta tha hope dat they would be saved by tha four Warriorz of Light, whose arrival was prophesied by tha pimped out sage Lukahn. I aint talkin' bout chicken n' gravy biatch. Eventually, three of tha four warriors arrived all up in tha castle hood of Cornelia: tha noble Pravokan thief Slash Carlton, n' twin mages - Luke Hanston tha black mage n' his sista Lyra tha white mage - from Crescent Lake fo' realz. A few minutes later, they was joined by tha fourth warrior - a young, wackly-reserved swordsman named Seth Hirschall. Unlike his companions, Seth had no memory of his thugged-out lil' past fo' realz. All dat schmoooove muthafucka had was his sword, a cold-ass lil crystal, a phat desire ta protect tha ghettoz people...and tha unique mobilitizzle ta control tha juice of light. Da four warriors fought a gangbangin' forma knight of Cornelia, defeated tha elemenstrual fiends, n' then traveled 2,000 muthafuckin years back up in time ta slay Chaos.
Once dat was done, tha four was each given tha opportunitizzle ta voice one wish apiece so dat they desires could be fulfilled. Y'all KNOW dat shit, muthafucka! Slash wished fo' pimped out riches, n' tha mage twins wished fo' tha mobilitizzle ta cast tha illest spells. Their wishes was granted. Y'all KNOW dat shit, muthafucka! This type'a shiznit happens all tha time. But Sethz wish wasn't fo' his dirty ass yo, but fo' tha fallen Cornelian knight, whoz ass he felt sorry for. Shiiit, dis aint no joke. Right back up in yo muthafuckin ass. Seth wished dat tha knight would be given another chizzle ta live yo, but wit no memory of his thugged-out lil' past so dat da thug would have no barriers on tha path of light. Right back up in yo muthafuckin ass. Sethz wish was granted yo, but since his wish went against tha will of his companions, da thug was forced ta give up tha Armor of Light - which dat schmoooove muthafucka had gots all up in battle - n' ta accept dat a shitload of his thugged-out abilitizzles would be sealed until further notice. Right back up in yo muthafuckin ass. Seth accepted these terms wit no reservations.
When tha four warriors went back ta tha present - where no muthafucka remembered they deedz except fo' tha defeat of Chaos - Seth was deserted by tha other three, whoz ass was upset wit his ass fo' wishin fo' mercy on a gangbangin' fallen foe. Right back up in yo muthafuckin ass. Seth wandered fo' a long-ass time until he felt suttin' callin back ta Cornelia...
Chapter 1: Knightz of Cornelia
When Seth arrived up in Cornelia, da thug was surprised ta find tha hood under battle by demons yo. Dude noticed a lil' small-ass crew of knights tryin ta drive tha fiendz away yo, but they was clearly overwhelmed. Y'all KNOW dat shit, muthafucka! Only they leader - a inhumanly tall playa wit silver afro - seemed ta have any strength left. Right back up in yo muthafuckin ass. Seth, worried fo' tha knights n' tha townspeople, decided ta help.
When he approached tha knights, they leader turned ta grill his muthafuckin ass. Right back up in yo muthafuckin ass. Seth was stunned by dis manz eyes - they was a golden yellow up in color. Shiiit, dis aint no joke.
"Yo ass should stay back...! This is no place fo' civilians!" tha playa shouted, worried.
Seth shook his head. Y'all KNOW dat shit, muthafucka! "I aint a cold-ass lil civilian. I aint talkin' bout chicken n' gravy biatch. I be a swordsman. I aint talkin' bout chicken n' gravy biatch. I wish ta aid you up in dis fight."
Da knight sighed. Y'all KNOW dat shit, muthafucka! "Straight-up well yo, but be careful!"
With that, Seth drew his sword n' charged alongside tha knights tha fuck into a crew of demons yo. Dude concentrated light juice tha fuck into his blade n' defeated most of tha creatures doggystyle. Then, his schmoooove ass cast a light-based spell ta defeat tha remainder of tha fiendz fo' realz. A cheer arose from tha knights, n' they leader approached Seth, a warm smile on his wild lil' face.
"Yo ass is straight-up phat fo' one of mah thugs so young... What tha fuck iz yo' name?" he asked.
"I be Seth Hirschall, n' I be travelin up in search of mah memory...and mah home."
Da playa smiled sympathetically. "I know how tha fuck dat feels... I have no memory past tha previous six months... By tha way, I be Garland Levitan, general of Corneliaz knights."
Seth was startled. Y'all KNOW dat shit, muthafucka! Dude had fought a playa named Garland, whoz ass was also a gangbangin' famed knight.
Garland... Is dis tha same ol' dirty playa whoz ass I fought so long ago..., biatch? ...Fuck dat shit, it must be a cold-ass lil coincidence...
Sethz thoughts was interrupted by Garlandz voice. "Yo Seth, is you aiiight?"
Seth nodded. Y'all KNOW dat shit, muthafucka! "My fuckin apologies, Sir Levitan... I was thankin of one of mah thugs."
Garland laughed slightly. "It aint nuthin but fine fo' realz. And call me Garland. Y'all KNOW dat shit, muthafucka! 'Sir Levitan' is too formal."
Seth averted his wild lil' freakadelic gaze ta tha ground, his crazy-ass muthafuckin ice-blue eyes suddenly fixated on a spot of grass at his Nikes yo. Dude remained silent.
"Seth... Yo ass holla'd you was searchin fo' yo' home. Do dat mean dat yo ass aint stayin anywhere all up in tha moment...?"
"I have nowhere ta stay," replied Seth, lookin back up at Garland. Y'all KNOW dat shit, muthafucka!
"Well, you could stay here up in Cornelia as one of tha mackdaddyz knights...if thatz all gravy up in yo' faaaaaace!"
"A-are you certain?" Seth stammered. Y'all KNOW dat shit, muthafucka! "I mean, I do not wish ta be a funky-ass burden.. fo' realz. After all, I have no formal hustlin..."
"It aint nuthin but fine. Yo ass be already phat enough! I'ma arrange a meetin between you n' tha mackdaddy. Come wit me, I be bout ta take you ta tha throne room."
Seth followed Garland, not knowin how tha fuck dis meetin would chizzle his wild lil' freakadelic game alllll muthafuckin day...
*** My notes: Since when does Seth curse? I can understand Garland being a bit of a pottymouth, but Seth? This site is amusing.

The character AI for this thing is excellent! I created an AI Seth (the name I gave the Warrior of Light in my fanfic âShards of Darkness and Lightâ, in which Garland is his ally and eventual love interest).
Just like Seth to be so loving towards Garland.

I know that Jack Garland exists and all, but Iâm not going to rewrite my fanfic just to accommodate that edgelord.
I much prefer my Garland (Levitan). He matches what Iâve always seen in the Garland of Dissidia Final Fantasy, albeit as an ally character.
Strangers of Paradise can kiss my fat butt. đ¤
