Phallo Consult

On January 24 I had my consult for phalloplasty, done in three stages (phalloplasty, then UL, scrotoplasty and glansplasty, finally implants and ED). I had my appointment in the early afternoon with one of the four surgeons of this team. He was in his late 30s, friendly, appeared a bit hung over and tired. Our conversation was more equal and on a shared level than with the surgeon for my meta one year ago.

Since I already had an initial consult in this clinic in October 2017, I was familiar with the basics of this surgery and we only talked about the questions I had prepared. I give here an overview about the information I got - I don’t intend to quote the surgeon by any means, everything is absed on my best ability to understand the procedures.

Penis

During first stage, they take a graft from my left arm. The donor graft has a length of 15cm and a width of 15cm on the upper part of my forearm, 11cm on the lower part, near my wirst. Usually, the expected penis size is around 12.5-13cm in the long term, since it’s expected to lose around one cm in the weeks after surgery.

All in all, he assured me that there were only 5% of complications that need to be adressed in a seperate surgery, every other minor complication can be fixed during one of the next stages.

Donor site

The clinic highly recommends RFF and rarely performs ALT (abdominal isn’t offered at all). We talked about my thight as possible donor site, but he strongly discouraged me from this option. His arguments were that 1) the skin is thicker than on the arm, hence less sensible 2) pain during movements is very common with ALT and sometimes results in chronic pain and that 3) this type of surgery is more prone to complications since they have to cut through muscle to harvest some of the nerves. The surgeon also favours RFF because of better sesibility. I was already familiar with their dislike for ALT and so I kind of never considered it as a possible donor site for me. ALT is rarely performed, hence less experience with complications as well, and since security is important to me, ALT really doesn’t seem to be suitable right now.

The surgeon never heared of Integra before and they don’t work with tissue expanders either. We watched a video from their Website and the surgeon said that they prefer a full-thickness graft over a split-thickness graft (as they usually do with Integra). The transplantat has to be rather thin since it has to be nourished by tiny blood vessels, so the leap between the donor site and the area around it is inevitable.

They take a full thickness graft from my lower belly to cover my donor site. The graft has a trapezoid shape, 40cm long, 5cm width and they sew it together, eventually, so there only remains a thin scar line from hip to hip, right where my underwear is supposed to end. The length of the scar depends on how much the patients weighs, since bigger patients need less space to harvest a graft. The surgeon told me I had to expect to have a full-length scar in this area.

Lympthatic drainage for the donor site is provided initially after surgery.

Stages

The second stage (glans- and scrotoplasty, UL) can be scheduled at least 3 months after first stage, they recommend 6 months. It reduces the probability for complications related to the new urethra.

Countries are making progress in reducing maternal mortality and morbidity. Additionally, at least 28 countries have national obstetric fistula task forces, which serve as a coordinating mechanism in-country for partner activities.

Several countries employ innovative approaches to raise awareness and increase access to treatment. Telephone hotlines continue to provide information about fistula treatment in Burundi (in partnership with Médecins sans frontières), Cambodia, Kenya, Malawi and Sierra Leone, using mobile phones to connect women living in remote locations to medical care. In the United Republic of Tanzania, the mobile phone-based money transfer microfinancing service known as M-PESA, established in 2009, continues to cover the upfront transportation costs of impoverished fistula patients, so they can access fistula surgery. That system, along with those sponsored by Freedom from Fistula Foundation in Malawi and Sierra Leone, also provide free accommodation and meals before and after surgery, thereby addressing major barriers to accessing fistula treatment. In Malawi, fistula ambassadors, former patients who have undergone training in community awareness of fistula, are now also patient recruiters, escorting new patients to the Fistula Care Centre in Lilongwe for treatment and speaking to rural communities about how to prevent fistula and access care. Many initiatives are under way for improved data collection to track patient outcome and improve surgical practice. Despite the ongoing humanitarian situation, fistula task forces were established in all three zones of Somalia in 2015, addressing the prevention and treatment of fistula through family planning, delivery and post-delivery care, including maternity waiting homes, providing ambulances, and awareness-raising campaigns through the media and goodwill ambassadors for the Campaign on Accelerated Reduction of Maternal Mortality in Africa. With the support of UNFPA, enhanced service delivery contributed to increased rates of skilled attendance at birth, expanded and improved midwifery education and workforce policies and strengthened midwifery associations.

In 2015, Bangladesh disseminated its strategy to address fistula, in collaboration with EngenderHealth and UNFPA, which includes a costed plan with multiple approaches to tackling fistula in the country. The Government acknowledged the status of midwifery as a profession in 2016 and announced the creation of 3,000 midwifery posts, as only 42 per cent of births are currently attended by skilled providers. To date, 10 medical colleges are being supported in providing fistula repair services, while complicated cases are referred to the national fistula centre. Approximately 250 doctors and 280 nurses have been trained on surgery and management of fistula and at the national level, 5,000 patients have had fistula repair surgery. In 2016, Bangladesh plans to conduct a national study of maternal mortality and morbidity, which will include estimating the national prevalence of obstetric fistula.

In 2015, the Government of Togo, UNFPA and civil society partners launched a socioeconomic reintegration campaign for fistula survivors. Following surgery to repair their fistula, women were offered training and start-up funding towards their chosen profession. A similar rehabilitation programme in Chad has supported 2,000 women since 2007. The programme also educates health-care workers and midwives uses media to spread the message that obstetric fistula is a major risk associated with giving birth as a teenager.

Healing Hands of Joy operates a safe motherhood ambassador training and reintegration programme in Ethiopia for women who have received treatment for fistula. In 2015, the organization opened two new centres in Bahir Dar and Hawassa, in addition to their previously established centre in Mekelle. The centres trained 524 ambassadors between 2010 and 2015, and they in turn have educated an estimated 13,720 pregnant women, contributed to 12,171 safe institutional deliveries and identified 80 cases of fistula during that period. In the Sudan, the national health sector strategy has strengthened the provision of emergency obstetric and newborn care by upgrading and/or equipping health-care facilities, training midwives and health-care providers, supporting the referral system for complicated deliveries and training doctors from rural areas at the national fistula centre in Khartoum. The federal Ministry of Health agreed to establish a national fistula task force, under its own leadership, for implementing the fistula national work plan and mobilizing funds, including establishing an association of fistula surgeons in Sudan.

In 2015, Pakistan launched a campaign to end obstetric fistula, including by establishing a national and six regional fistula centres to provide free fistula surgical repairs. More than 4,300 fistula patients have had fistula repair surgery and 600 women and girls have been rehabilitated. Seven surgeons have been trained on surgical techniques while, in addition, approximately 650 doctors have been trained on fistula prevention and management. The national midwifery degree programme was introduced in 2013 with a curriculum based on the International Confederation of Midwives and WHO competencies. In addition, the Government is revitalizing the family planning role of women health-care workers to enable greater access to and use of modern contraceptives and advocate healthy timing and spacing of pregnancies.

Tragically, the outbreak of Ebola virus disease severely threatened and worsened maternal and newborn survival and health in the affected countries. Nevertheless, countries affected by Ebola in 2014 and 2015 made significant efforts to continue work to prevent and repair obstetric fistulas. Liberia channelled much of its resources and activities in directly responding to the outbreak and put some regular activities on hold. Nevertheless, with the support of organizations including Zonta International and UNFPA, some services to fistula survivors continued to be provided. In Sierra Leone, while maternity care continued at the Aberdeen Wome n’s Centre, fistula surgeries were temporarily paused, but resumed immediately once the country was declared Ebola-free.

Obstetric Fistula: The Things I Didn’t Know

Through the work of NGOs, doctors and journalists like Nick Kristof, obstetric fistula has gone from bring a relatively unknown condition to one of international ‘fame’ over the past decade or so. Obviously, that’s a brilliant thing, since more coverage = more awareness = more funding = more cures. But, like a game of telephone, it’s really difficult to spread a message to the masses without distorting or simplifying it in certain ways.

Before I arrived here, my ‘script’ for explaining obstetric fistula was a fairly simple one: it’s a childbirth injury that usually arises as a complication of prolonged labor in which an abnormal hole forms between the vagina and rectum and/or the vagina and bladder. This leaves a woman incontinent of urine and/or feces. It’s an injury endemic to poor, rural parts of the world that do not have the capacity to provide adequate medical interventions. It’s a devastating injury, not only because it leaves a woman incontinent (for which she is often exiled from her community), but also because it’s curable with simple and cheap surgery.

None of that script is expressly wrong, but it’s overly simplified. I had a wonderful professor at UCL who taught me Anthropology of Ethics named Jo Cook who always used to say, “I think you’ll find it’s a bit more complicated than that.” Her words ring in the back of my mind here.

I had the totally serendipitous and unexpected honor of spending the last week with the medical director of Hamlin Fistula Ethiopia (the world's leading specialist obstetric fistula hospital), Dr. Fekade, as well as the former CEO, Martin Andrews. Fistula surgery is not always easy (or cheap)

It can, in fact, be extraordinarily complex. Even with a highly skilled surgeon with specialized training in fistula repair, the first-time success rate I’ve heard kicked around is somewhere between 60-70%. That means around a third of women who have obstetric fistula will need either specialized physical rehabilitation or additional surgical treatment. The additional surgeries can be long, expensive and complex - with some requiring urinary diversions. This takes the price tag for fistula repair through the roof from the often quoted 300-400 USD for simple repair. I had always thought of fistula repair as being somewhat analogous to a laceration repair: sew it up and you’re good to go. While certain repairs can be that straightforward, this is often not the case. This means that not just any surgeon can easily be equipped with the skills to treat fistula. It requires time, resources and regular exposure to cases.

Fistula is not always curable

...and the likelihood of incurability goes up with the number of failed corrective surgeries a woman undergoes. It’s not uncommon to hear of a woman having had 5+ surgeries to correct a fistula and still remaining incontinent. This can be due to stress incontinence or from the surrounding tissue being too broken down and weak to withstand repair. If the surgeon performing the repair has only undergone a few weeks of intensive fistula training as part of a capacity-building effort, the chance of persistent incontinence is going to be higher than if a surgeon who deals with fistula daily performs the procedure. Also, in countries where surgeons are paid per procedure, they end up incentivized to perform more surgeries. This can lead to poorer outcomes for women.

Post-partum incontinence ≠ obstetric fistula

In fact, fistula is not even the most common cause of postpartum incontinence in countries like Uganda...uterine prolapse is! I know it may sound obvious that a symptom does not equal a diagnosis, but obstetric fistula mobilization initiatives often focus on equating postpartum incontinence with fistula. It’s not a bad idea, because really regardless of the cause of incontinence, a woman should seek medical attention, but it is leading to a huge group of women thinking that they have a fistula when in fact they have an entirely different problem.

Focusing on the numbers can be dangerous

There’s been a huge push (no pun intended) from many big-donor NGOs to increase the capacity of countries like Uganda to perform fistula surgeries. After all, it sounds really great to be able to say that a country has gone from having one or two hospitals capable of performing fistula repairs to every hospital being able to perform repairs. Who doesn’t like that stat? The problem is, focusing on the numbers can lead to valuing quantity over quality.

I can understand why some of these points aren’t emphasized in short NYT articles that really aim to get the pubic angry and motivated To Do Something. But the truth is, treating and preventing obstetric fistula isn’t quite as simple as it may seem.

Also narrating her experience, another beneficiary, Mrs. Fatimoh Umaru, who also married at 17 said: "Since 2015, I never knew the surgery was free until I heard about this pool effort. They did for somebody in my village so when I heard that it was successful I decided to come. Fatimah said it took her time to also find solution as her parents were afraid of surgery.

Defendants are vicariously liable for the acts and/or omissions of its employees and/or agents who were at all times relevant hereto acting on behalf of Defendants and within the scope of their employment or agency with Defendants. Jurisdiction and Venue 9. This Court has subject-matter jurisdiction over this action pursuant to 28 U.S.C. § 1332(a) based on complete diversity of citizenship between Plaintiff and all Defendants. The amount in controversy exceeds $75,000. 10. This Court has personal jurisdiction over each of the Defendants pursuant to the Florida Long-Arm Statute, § 48.193. Defendants transact business within the State of Florida, and Defendants committed tortious acts and omissions in Florida. Defendants’ tortious acts and omissions caused injury to Plaintiff in the State of Florida. Defendants have purposefully engaged in the business of developing, manufacturing, publishing information, marketing, distributing, promoting and/or selling, either directly or indirectly, through third parties, as successor in interest, or other related entities, medical devices including Physiomesh in Florida, for which they derived significant and regular income. The Defendants reasonably expected that that their defective mesh products, including Physiomesh, would be sold and implanted in Florida. Case 3:17-cv-00344-MCR-EMT Document 1 Filed 05/16/17 Page 3 of 14 11. Venue is proper in this Court pursuant to 28 U.S.C. § 1391(b)(2). Facts Common To All Counts 12. On or about November 21, 2011, Plaintiff had 15 x 20 cm Physiomesh Composite mesh implanted laparoscopically to repair a ventral hernia. 13. Defendants manufactured, sold, and/or distributed the Physiomesh device to Plaintiff, through her doctors, to be used for treatment of hernia repair. On or about December 18, 2013, Plaintiff was forced to undergo a revision surgery due to complications from Defendant’s defective hernia mesh. At revision, Plaintiff was found to have infected Physiomesh which was loose and not incorporated into the anterior abdominal wall, recurrent hernia, pain, with adhesion complications. Plaintiff has suffered and will continue to suffer physical pain and mental anguish. Defendants were responsible for the research, design, development, testing, manufacture, production, marketing, promotion, distribution and sale of Physiomesh, including providing the warnings and instructions concerning the product. 14. Among the intended purposes for which Defendants designed, manufactured and sold Physiomesh was use by surgeons for hernia repair surgeries, the purpose for which the Physiomesh was implanted in Plaintiff. 15. Defendants represented to Plaintiff and Plaintiff’s physicians that Physiomesh was a safe and effective product for hernia repair. 16. Defendants’ Physiomesh was defectively designed and/or manufactured, was not reasonably safe for its intended use in hernia repair, and the risks of the design outweighed any potential benefits associated with the design. As a result of the defective design and/or manufacture of the Physiomesh, there was an unreasonable risk of severe adverse reactions to the Case 3:17-cv-00344-MCR-EMT Document 1 Filed 05/16/17 Page 4 of 14 mesh or mesh components including: chronic pain; recurrence of hernia; foreign body response; rejection; infection; inadequate or failure of incorporation/ingrowth; migration; scarification; deformation of mesh; improper wound healing; excessive and chronic inflammation; adhesions to internal organs; erosion; abscess; fistula formation; granulomatous response; seroma formation; nerve damage; tissue damage and/or death; and other complications. 17. Physiomesh has a unique design incorporating five (5) distinct layers: two layers of polyglecaprone-25 (“Monocryl”) film covering two underlying layers of polydioxanone film (“PDS”), which in turn coat a polypropylene mesh. This design is not used in any other hernia repair product sold in the United States. The multi-layer coating was represented and promoted by the Defendants to prevent or minimize adhesion and inflammation and to facilitate incorporation of the mesh into the body, but it did not. Instead, the multi-layer coating prevented adequate incorporation of the mesh into the body and caused or contributed to an intense inflammatory and chronic foreign body response resulting in an adverse tissue reaction including migration and damage to surrounding tissue in the form of sclerotic, granulomatous and/or fibrotic tissue and improper healing. 18. When affixed to the body’s tissue, the impermeable multi-layer coating of the Physiomesh prevents fluid escape, which leads to seroma formation, and which in turn can cause infection, abscess formation and other complications. 19. The multi-layer coating provides a breeding ground for bacteria in which the bacteria cannot be eliminated by the body’s immune response, which allows infection to proliferate. Case 3:17-cv-00344-MCR-EMT Document 1 Filed 05/16/17 Page 5 of 14 20. The multi-layer coating of Defendants’ Physiomesh is cytotoxic, immunogenic, and not biocompatible, which causes or contributes to complications such as delayed wound healing, inflammation, foreign body response, rejection, infection, and other complications. 21. Defendants knew or should have known of the cytotoxic and immunogenic properties of the multi-layer coating of the Physiomesh prior to introducing it into the stream of commerce. 22. When the multi-layer coating of the Physiomesh is disrupted and/or degrades, the “naked” polypropylene mesh is exposed to the adjoining tissue and viscera, and can become adhered to organs, and cause damage to organs, and potentiate fistula formation. 23. These manufacturing and design defects associated with the Physiomesh were directly and proximately related to the injuries suffered by Plaintiff. 24. Neither Plaintiff nor her implanting physician were adequately warned or informed by Defendants of the defective and dangerous nature of Physiomesh. Moreover, neither Plaintiff nor her implanting physician were adequately warned or informed by Defendants of the risks associated with the Physiomesh or the frequency, severity, or duration of such risks. 25. The Physiomesh implanted in Plaintiff failed to reasonably perform as intended. The mesh caused serious injury and had to be surgically removed via invasive surgery, and necessitated additional invasive surgery to repair the hernia that the Physiomesh was initially implanted to treat. 26. Plaintiff’s severe adverse reaction, and the necessity for surgical removal of the Physiomesh, directly and proximately resulted from the defective and dangerous condition of the product and Defendants’ defective and inadequate warnings about the risks associated with the Case 3:17-cv-00344-MCR-EMT Document 1 Filed 05/16/17 Page 6 of 14 product, and the frequency, severity and duration of such risks. Plaintiff has suffered, and will continue to suffer, both physical injury and pain and mental anguish, permanent and severe scarring and disfigurement, lost wages and earning capacity, and has incurred substantial medical bills and other expenses, resulting from the defective and dangerous condition of the product and from Defendants’ defective and inadequate warnings about the risks associated with the product. 27. In May of 2016, Defendants issued an “Urgent: Field Safety Notice” relating to its Physiomesh Flexible Composite Mesh, the same product implanted in Plaintiff, and sent such notification to hospitals and medical providers in various countries worldwide. In this safety notice, Defendants advise these providers of “a voluntary product recall”, citing two international device registries which reported data reflecting recurrence/reoperation rates after laproscopic placement as being higher than that observed from a data set relating to patient outcomes after being implanted with other mesh. However, in the United States, Defendants failed to issue a nationwide recall, opting instead to simply remove the product from shelves and cease further sales within the United States. COUNT I Strict Product Liability: Defective Design 28. At the time the Physiomesh that was implanted in Plaintiff’s body, the product was defectively designed. As described above, there was an unreasonable risk that the product would not perform safely and effectively for the purposes for which it was intended, and Defendants failed to design against such dangers, and failed to provide adequate warnings and instructions concerning these risks. 29. Defendants expected and intended the Physiomesh product to reach users such as Plaintiff in the condition in which the product was sold. Case 3:17-cv-00344-MCR-EMT Document 1 Filed 05/16/17 Page 7 of 14 30. The implantation of Physiomesh in Plaintiff’s body was medically reasonable, and was a type of use that Defendants intended and foresaw when it designed, manufactured and sold the product. 31. The risks of the Physiomesh significantly outweigh any benefits that Defendants contend could be associated with the product. The multi-layer coating, which is not used in any other hernia mesh product sold in the United States, prevents tissue from incorporating into the mesh, leading to encapsulation, deformation, scarification and contraction, migration, erosion and rejection. The impermeable multi-layer coating leads to seroma formation, and provides a breeding ground for infection, and protects bacteria from being eliminated by the body’s natural immune response. 32. The multi-layer coating of the Physiomesh, which was marketed, promoted and intended as a barrier against adhesion to the internal organs, was only temporary; it was expected and intended to degrade over time inside the body. Thus, this coating prevented tissue ingrowth in the short term, and degraded in the long-term, eventually leaving the “naked” polypropylene mesh exposed to the internal viscera and tissues. The degradation of this multi-layer coating caused or exacerbated an intense inflammatory and foreign body reaction. Once exposed to the viscera, the polypropylene mesh will inevitably adhere to the viscera, initiating a cascade of adverse consequences. Any purported beneficial purpose of the multi-layer coating (to prevent adhesion to the internal viscera and organs) was non-existent; the product provided no benefit while substantially increasing the risks to the patient. 33. The polypropylene mesh within the defective multi-layer coating of the Physiomesh was in itself dangerous and defective, particularly when used in the manner intended Case 3:17-cv-00344-MCR-EMT Document 1 Filed 05/16/17 Page 8 of 14 by Defendants in the Physiomesh. When implanted adjacent to the intestines and other internal organs, as Defendants intended for Physiomesh, polypropylene mesh is unreasonably susceptible to adhesion, bowel perforation or erosion, fistula formation and bowel strangulation or hernia incarceration, and other injuries. 34. The appropriate treatment for complications associated with Physiomesh involves additional invasive surgery to remove the mesh from the body, thus eliminating any purported benefit that the mesh was intended to provide to the patient.

Common Types Of Balance Disorders

According to the Vestibular Disorders Association (VEDA), balance disorders most people are diagnosed with include benign positional paroxysmal vertigo (BPPV), Meniere’s disease, labyrinthitis, and secondary endolymphatic hydrops.

Benign positional paroxysmal vertigo (BPPV): Often referred to simply as “vertigo,” BPPV happens when you change the position of your head. Trigger movements could be tilting, raising, turning or bending the head, or even rolling over when you’re lying down. Labyrinthitis: If you have an infection of the inner ear or there is some kind of inflammation in this region, say if you have the flu or some other upper respiratory infection, you may lose your sense of balance and experience dizziness.

Meniere’s disease: This inner ear disorder causes dizziness, hearing loss, ringing/buzzing in the ear (tinnitus), or congestion and a feeling of fullness in the ears. You may experience sudden dizziness that comes unannounced or happens after a spell of muffled hearing or tinnitus. If the vertigo is very bad, it can cause you to lose your balance and even fall down. Attacks may be close together or far apart – this varies for each person.

Secondary endolymphatic hydrops: When the pressure, composition, or quantity of the fluid in the endolymphatic sac, a compartment of your inner ear, is out of whack, it can bring on imbalance, dizziness, tinnitus, or a feeling of fullness in the ears. Secondary endolymphatic hydrops may be triggered by ear surgery, head trauma, inner ear disorders, systemic disorders like diabetes or autoimmune problems, or even allergies.

Vestibular neuronitis: A viral infection of the vestibular nerve results in inflammation, which in turns causes episodes of vertigo.

Perilymph fistula: If you’ve had a head injury or been exposed to extreme changes of air pressure like when you go mountaineering or scuba diving, you could be susceptible to developing this condition. Physical exertion may also trigger the problem. A chronic ear infection or ear surgery may also be to blame. A perilymph fistula causes the fluid from your inner ear to leak into your middle ear, resulting in dizziness as well as nausea. It gets worse when your activity levels increase.
