according to yourerielawyers.com, your miranda rights still apply if you’re being questioned without having them recited to you beforehand. if the cops still get you to talk, but didn’t read your rights, then whatever you say to them will have to be suppressed in court; meaning that they can’t use that interview as a reference when you’re in trial. the case won’t be dismissed, but them not reading your rights affects what evidence they could use against you in court. so in mangione’s case, the police can’t use anything he says to them during an interrogation.

instead, they’d have to rely on the forensic evidence, which takes a long-ass time to process. the task of processing evidence itself is fairly quick- depending on what they need to do- it’s just that crime labs are backlogged with evidence from other cases, and have to outsource private companies and other crime labs to ease the workload.

tl;dr: the cops can’t use mangione’s interrogation in court as evidence, and instead would have to rely on the forensic evidence, but it would take a long time to process bc bureaucracy is a motherfucker.

Update! Luigi's Attorney Dickey confirms that his "outburst" where he tells the cameras that this is unjust, was because he was never read his miranda rights and was under the impression at that time that he was being denied the right to a fair trial, an attorney, or any legal representation.

He is angry and terrified in that footage because they have failed to follow basic procedure to inform him that he has any rights at all. This is a major red flag of police corruption. This is UNACCEPTABLE and further means any interrogation they did of him is unlawful, and inadmissible in court.
