Depending on the needs and agreement of the two parties, the enterprise may request employees to work overtime during lunar new year (Tet) holiday, but must not exceed 12 hours in a day and must pay overtime as prescribed by law.
According to Article 25 of Decree No. 05/2015 / ND-CP, the salary for overtime work on lunar new year holiday for employees is prescribed as follows:
An employee who works overtime in the daytime of the lunar new year holiday is entitled to at least 300% of the normal day salary, excluding the salary on that new year holiday if the employee receives wages.
Employees who work overtime at night during lunar new year holiday, apart from enjoying 300% of the normal daily salary, excluding the salary, if the employee receives a daily salary, the employee is also paid at least 30% extra of the average daily wage, and 20% extra of the of the lunar new year holiday pay rate.
In particular, night working hours are calculated from 10:00 pm to 6:00 am of the following day.
For employees who work overtime on the same day as lunar new year holiday, they shall receive overtime pay according to lunar new year holiday; if the lunar new year holiday is the same as a weekly holiday, pay overtime is same as pay for work in weekend.
In addition, when making overtime workers, the enterprise must pay attention to the maximum number of overtime hours a day and must organize compensatory leave for employees as prescribed in Article 106 of the Labor Code and Article 4. Decree 45/2013/ND-CP.

Making Connections: Marshall Hosts Annual Jamboree, Poster Expo By Celine Smith Engineers, researchers, and scientists at NASA’s Marshall Space Flight Center had the opportunity to showcase their vast range of projects and learn about others at Marshall’s annual Science, Technology, and Engineering Jamboree and Poster Expo. Tom Inman, lead organizer of the jamboree and assistant director of Marshall’s Science and Technology Office, greets attendees of the 2024 Science, Technology, and Engineering Jamboree and Poster Expo. NASA/Danielle Burleson The jamboree took place May 16 in Activities Building 4316. Team members created and displayed more than 100 posters summarizing their projects at the center. From engineering easier ways for astronauts to take pictures in space to studying galaxies light years away, the projects represented Marshall’s diverse capabilities. The jamboree also included eight flash talks, which are brief speeches from team members about their research and experiments. The idea to host a jamboree originated from flash talks presented during past holiday luncheons at the National Space Science Technology Center (NSSTC) at the University of Alabama in Huntsville. “Scientists were only allowed to speak about their discoveries and research for two minutes and were limited to one slide,” said Tom Inman, lead organizer and assistant director of Marshall’s Science and Technology Office. A cowbell was rung if the speaker went over their time, which added to the fun. With Marshall team members becoming more aware of all that’s happening at the center, they can better connect with each other, according to Inman. In addition, learning about existing work could aid another project or create an entirely new one. “If we know what other people are working on it sparks more work and more innovation, while also building our portfolio and Marshall,” Inman said. “It’s an opportunity to see our colleagues and potentially collaborate.” During the expo, engineers, researchers, and scientists stood alongside their poster, educating viewers and answering questions about their work. Food trucks were present right outside the building for the lunch. The event also was open to attendees from other government agencies at Redstone Arsenal. The jamboree attracted about 850 people. Rae Ann Meyer has been selected for the position of deputy director at NASA’s Marshall Space Flight Center.NASA In this role, Meyer will assist in leading Marshall’s nearly 7,000 on-site and near-site civil service and contractor employees and an annual budget of approximately $5 billion. She will also help guide the center as it continues to deliver vital propulsion systems and hardware, flagship launch vehicles, world-class space systems, state-of-the-art engineering technologies and cutting-edge science and research projects and solutions. Prior to this assignment, Meyer served as Marshall’s associate director from 2022-2024, where she led execution and integration of the center’s business operations, mission support enterprise functions, and budget management. Meyer was previously deputy manager of Marshall’s Science and Technology Office. Named to the Senior Executive Service position in May 2019, she assisted in leading the organization responsible for planning, developing, and executing a broad range of science and technology investigations, programs, projects, and activities in support of NASA’s science, technology, and exploration goals. The office also leads the pursuit of new partnership opportunities with other government agencies and private industry. Meyer helped oversee an annual budget of more than $475 million and managed a diverse, highly technical workforce of approximately 300 civil service and contractor employees. Julie Bilbrey has been named as director of the Office of Strategic Analysis and Communications (OSAC) at NASA’s Marshall Space Flight Center.NASA In Bilbrey’s new role, she will lead the organization in providing strategic planning, objective analysis, and comprehensive communication to support the policy, program, and budget decisions for Marshall. 'Bargaining' with a high material wall vs. 'Ghost' that goes beyond the era and genre
While the Hollywood blockbuster 'Avatar: Water Road' and the Japanese animation 'The First Slam Dunk' are on a long run, two Korean films are targeting theaters during the Lunar New Year holidays. These are the movies 'Negotiation' and 'Ghost'.
'Negotiation' is a film depicting the negotiating operation between a diplomat and a local NIS agent who went to Afghanistan to save Koreans who were held hostage by the Taliban in the worst kidnapping case. Based on the 2007 saemmul church kidnapping case, Hwang Jung-min and Hyun-bin play the lead roles, and director Lim Soon-rye, who directed 'Waikiki Brothers', 'The Whistleblower', and 'Little Forest', took the megaphone.

Regulations on Pay to Employees Working During Lunar New Year Holiday
Under the provisions of Article 106.1 of the Labor Code 2012, overtime is a period of work outside normal working hours prescribed by law or according to a labor agreement or regulation. Depending on the needs and agreement of the two parties, the enterprise may request employees to work overtime during lunar new year (Tet) holiday, but must not exceed 12 hours in a day and must pay overtime as prescribed by law.
According to Article 25 of Decree No. 05/2015 / ND-CP, the salary for overtime work on lunar new year holiday for employees is prescribed as follows:
An employee who works overtime in the daytime of the lunar new year holiday is entitled to at least 300% of the normal day salary, excluding the salary on that new year holiday if the employee receives wages.
Employees who work overtime at night during lunar new year holiday, apart from enjoying 300% of the normal daily salary, excluding the salary, if the employee receives a daily salary, the employee is also paid at least 30% extra of the average daily wage, and 20% extra of the of the lunar new year holiday pay rate.
In particular, night working hours are calculated from 10:00 pm to 6:00 am of the following day.
For employees who work overtime on the same day as lunar new year holiday, they shall receive overtime pay according to lunar new year holiday; if the lunar new year holiday is the same as a weekly holiday, pay overtime is same as pay for work in weekend.
In addition, when making overtime workers, the enterprise must pay attention to the maximum number of overtime hours a day and must organize compensatory leave for employees as prescribed in Article 106 of the Labor Code and Article 4. Decree 45/2013/ND-CP.

【Payroll Calculation】HR and employers must-see the main points of tail-pay calculation
Every December is the peak time for changing jobs. After receiving the year-end bonus, many employees will consider resigning to find a new way out, and HR and employers will face the problem of calculating the remaining pay. After the employment contract is terminated, the employer must pay the remaining wages within 7 days, otherwise it will be illegal. Therefore, we have prepared the following three points for simple payroll calculation so that you can calculate more quickly and accurately.
Step 1: Confirm the last working day
When receiving a resignation letter from an employee, it must be clearly stated which day is the last working day, and the employee must negotiate with the employer in accordance with the employment contract. Assuming that the notice period on the contract is one month, and you resign on August 12, then you can retire on September 11 at the earliest. If you wish to start work earlier, you must obtain the consent of your employer, or pay your employer payment in lieu of notice.
Step 2: Get to know ADW, and calculate the statutory rights based on the 12-month average salary
Usually related to tail rations are 1. Holiday pay 2. Annual leave pay 3. Year-end pay 4. Pay in lieu of notice
Step 3: Understand the composition of tail grain
Any unpaid wages i.e. base salary + commission and allowances (if any)
Assuming a monthly salary of $20000, September 11th is the last working day, the basic salary is $20000 / 30 x 11 = $7333.33
untaken annual leave
With reference to the Employment Ordinance, as long as employees have worked under a continuous contract for 12 months, they are entitled to annual leave. However, after resigning, the annual leave cannot be used to offset the notice period. They can only be paid in lieu of untaken annual leave.
After determining the number of unused annual leave days, assuming that the employee enjoys 10 days of annual leave each year, the last working day is the 200th day after taking office, and no major leave has been taken during the tenure, the remaining annual leave at the time of resignation is 5.48 days, and then multiplied by the average daily salary (ADW), which is the annual leave pay that employees can get back when they leave the company.
Year-end payment
If an employee resigns during/before the end of the remuneration period, unless otherwise stipulated in the contract, the employee who resigns before the end of the remuneration period shall not be entitled to the pro rata year-end payment. The remuneration period should be specified in the employment contract, if not specified, it will be calculated in the lunar year.
Difference in previously uncalculated statutory holiday pay
Some employees’ commissions or allowances account for a high proportion of their income. For example, the basic salary is $20,000, and the commission and allowances are $20,000. The average daily salary will increase. However, the statutory holiday salary is often not calculated in the previous month, and the average daily salary is not calculated. Only the basic salary is divided by the number of days in the month to settle the statutory holiday salary, so there is a difference. In the final payment, the statutory holidays of the employees in the past should be found out to make up the difference, so as to avoid the risk of employees claiming compensation in the future.
Payment in lieu of notice (if any)
The amount of payment in lieu of notice is equivalent to "the average daily salary in the past year X the number of days of early resignation".
Assuming that the monthly salary of wage earners is $20000, the average daily salary is: $20000 x 12 / 365 days = $657.5
The number of days of early resignation is 7 days, and the payment in lieu of notice is $4602.5. The employer has to deduct the employee's early resignation payment in lieu of notice from the remaining pay.
MPF
The last step is to deal with MPF contributions. Both the employee and the employer are required to contribute 5% of the employee’s relevant income to the MPF account. The amount of contribution is subject to the minimum and maximum relevant income levels. For monthly salaried employees, the current minimum and maximum relevant income levels are $7,100 and $30,000 respectively.
Relevant income refers to the amount in money paid or payable by the employer to the employee. Includes: any wages, salaries, vacation allowances, fees, commissions, bonuses, bonuses, contractual gratuities, gratuities or allowances. Excludes: severance payment or long service pay

China’s Economy Is Booming. Shoppers Are Skittish Anyway. Factories are whirring, new apartments are being snapped up and more jobs are up for grabs. When China releases its new economic figures on Friday, they are expected to show a remarkable post-pandemic surge. The question is whether small businesses and Chinese consumers can fully share in the good times. China is expected to report that its economy grew by a jaw-dropping double-digit figure in the first three months of the year compared with the same period the year before. The number is widely estimated by economists to be 18 percent to 19 percent. But the growth is as much a reflection of the past — the country’s output shrank 6.8 percent in the first quarter of 2020 compared with a year earlier — as it is an indication of how China is doing now. A year ago, entire cities were shut down, planes were grounded and highways were blocked to control the spread of a relentless virus. Today, global demand for computer screens and video consoles that China makes is soaring as people work from home and as a pandemic recovery beckons. That demand has continued as Americans with stimulus checks look to spend money on patio furniture, electronics and other goods made in Chinese factories. China’s recovery has also been powered by big infrastructure. Cranes litter city skylines. Construction projects for highways and railroads have provide short-term jobs. Property sales have also helped strengthen economic activity. But exports and property investment can carry China’s growth only so far. Now China is trying to get its consumers to return to their prepandemic ways, something other countries and will soon have to grapple with as more vaccines become available. Demand for Chinese exports is expected to weaken later in the year. Policymakers have moved to tamp down overheating in the property market and in the corporate sector, where many firms have borrowed beyond their means. Many economists are looking for signs of a broader recovery that relies less on exports and the government and more on Chinese consumers to juice growth. A slow vaccination rollout and fresh memories of lockdowns have left many consumers in the country skittish. Restaurants are still struggling to bounce back. Waiters, shopkeepers and students are not ready yet for the “revenge spending” that economists hope will power growth. When virus outbreaks occur, the Chinese authorities are quick to put new lockdowns in place, hurting small businesses and their customers. To avoid a wave of outbreaks in February, the authorities canceled the travel plans of millions of migrant workers for the Lunar New Year holiday, the biggest holiday of the year in China. “China’s Covid strategy has been to crush it when it reappears, but there seems to be a lot of voluntary social distancing and that’s affecting services,” said Shaun Roache, chief economist for Asia Pacific at S&P Global. “It’s holding back normalization.” Wu Zhen runs a family business of 13 restaurants and dozens of banquet halls in Yingtan, a city in China’s southeastern Jiangxi Province. When China began to bounce back last year, more people started coming to her restaurants for their favorite dishes, like braised pork. But just as she and her employees began preparing for the Lunar New Year, a new Covid-19 outbreak prompted the authorities to limit the number of people allowed to gather in one place to 50. “It should have been the best time of the year for our business,” said Ms. Wu, 33. This year, Ms. Wu decided that closing the entire business over the holiday would be cheaper. “If we want to serve Lunar New Year’s Eve dinner, the labor wage for one day is three times higher than the usual time. We save more money by just closing the doors and the business,” she said. It will be the second year in a row that the restaurants shut their doors over the holiday. Ms. Wu inherited the business from her father two years ago and employs more than 800 people. Before the pandemic, three quarters of the business revenue came from big banquets for weddings and family reunions. She said business has yet to return to normal after months of crushing virus restrictions. The setbacks facing small-business owners like Ms. Wu are also affecting regular consumers who are jittery about opening their wallets. According to Zhaopin, China’s biggest job recruitment platform, more jobs in hotels and restaurants, entertainment services and real estate are available than a year ago. But households are still being cautious about spending. Families continue to save at a higher rate than they did before the pandemic, something that worries economists like Louis Kuijs, who is head of Asian economics at Oxford Economics. Mr. Kuijs is looking at household savings as an indication of whether Chinese consumers are ready to start splurging after months of being stuck at home. “More people still seem to not go all the way in terms of carefree spending,” he said. “At times there are still some lingering Covid concerns, but there is perhaps also a concern about the general economic situation.” Many families took on more debt last year as they borrowed to buy property and to cover expenses during the pandemic. China still largely lacks the kind of social safety net that many wealthy countries provide, and some families have to dip into savings for health care and other big costs. Unlike much of the developed world, China doesn’t subsidize its consumers. Instead of handing out checks to jump-start the economy last year, China ordered state-owned banks to lend to businesses and offered tax rebates. Retail figures on Friday will give a better sense of where consumers are picking up their old spending habits. But data from the first two months of the year already show that consumers like Li Jinqiu are spending less and saving more. Mr. Li, 25, who recently got married, has a one-month-old baby at home. He had planned to work for the family business, but it has been hit by the pandemic and he doesn’t think there is much opportunity for him if he stays. “The whole family has some sense of crisis,” Mr. Li said. “Because of the pandemic and because of family business, I have a sense of crisis.” Mr. Li said he had received a job offer in sales at a financial firm in Beijing but had delayed the start date to help take care of his newborn. He said he once borrowed to spend on items like his $150,000 Mercedes. CEBU CITY – Muslim officials and employees working at the Cebu City government were exempted from reporting for work on Thursday to give them time to celebrate the “Lailatul Isra Wal Miraj” or the Feast of the Prophet’s Ascension.
The celebration has been a legal holiday for Muslims in the country.
The lunar calendar places this year’s celebration on March 11.
Councilor Raymond Alvin Garcia authored a resolution that was passed by the City Council on Wednesday, declaring that the local lawmakers are “one with our Muslim officials and employees as they celebrate the pious observance” of the feast.
The resolution also conveyed to the city’s Human Resource Development Office the provisions of Presidential Decree (PD) 1083, the Code of Muslim Personal Laws of the Philippines, and the Civil Service Commission (CSC) resolutions 81-1277 and 02072.
In the resolution, Garcia explained that although Article 170 of PD 1083 identified the provinces, cities, and towns in Mindanao where the holiday takes effect, Article 172 said that “Muslim government officials and employees in places other than those enumerated shall be excused from reporting to office in order that they may be able to join the observance.”
The issuance from the CSC, he said, also stated that Muslims in government are free from work and are not to be marked absent during the holidays in observance of Eid al-Fitr, Eid al-Adha, Maulod-en-Nabi, Lailatul Isra Wal miraj, Mahurram, and Amon Jaded. (PNA)
