Women's Not So Distant History

This #WomensHistoryMonth, let's not forget how many of our rights were only won in recent decades, and weren’t acquired by asking nicely and waiting. We need to fight for our rights. Here's are a few examples:

📍 Before 1974's Fair Credit Opportunity Act made it illegal for financial institutions to discriminate against applicants' gender, banks could refuse women a credit card. Women won the right to open a bank account in the 1960s, but many banks still refused without a husband’s signature. This allowed men to continue to have control over women’s bank accounts. Unmarried women were often refused service by financial institutions entirely.

📍 Before 1977, sexual harassment was not considered a legal offense. That changed when a woman brought her boss to court after she refused his sexual advances and was fired. The court stated that her termination violated the 1974 Civil Rights Act, which made employment discrimination illegal.⚖️

📍 In 1969, California became the first state to pass legislation to allow no-fault divorce. Before then, divorce could only be obtained if a woman could prove that her husband had committed serious faults such as adultery. 💍By 1977, nine states had adopted no-fault divorce laws, and by late 1983, every state had but two. The last, New York, adopted a law in 2010.

📍In 1967, Kathrine Switzer, entered the Boston Marathon under the name "K.V. Switzer." At the time, the Amateur Athletics Union didn't allow women. Once discovered, staff tried to remove Switzer from the race, but she finished. AAU did not formally accept women until fall 1971.

📍 In 1972, Lillian Garland, a receptionist at a California bank, went on unpaid leave to have a baby and when she returned, her position was filled. Her lawsuit led to 1978's Pregnancy Discrimination Act, which found that discriminating against pregnant people is unlawful

📍 It wasn’t until 2016 that gay marriage was legal in all 50 states. Previously, laws varied by state, and while many states allowed for civil unions for same-sex couples, it created a separate but equal standard. In 2008, California was the first state to achieve marriage equality, only to reverse that right following a ballot initiative later that year. 

📍In 2018, Utah and Idaho were the last two states that lacked clear legislation protecting chest or breast feeding parents from obscenity laws. At the time, an Idaho congressman complained women would, "whip it out and do it anywhere,"

📍 In 1973, the Supreme Court affirmed the right to safe legal abortion in Roe v. Wade. At the time of the decision, nearly all states outlawed abortion with few exceptions. In 1965, illegal abortions made up one-sixth of all pregnancy- and childbirth-related deaths. Unfortunately after years of abortion restrictions and bans, the Supreme Court overturned Roe in 2022. Since then, 14 states have fully banned care, and another 7 severely restrict it – leaving most of the south and midwest without access. 

📍 Before 1973, women were not able to serve on a jury in all 50 states. However, this varied by state: Utah was the first state to allow women to serve jury duty in 1898. Though, by 1927, only 19 states allowed women to serve jury duty. The Civil Rights Act of 1957 gave women the right to serve on federal juries, though it wasn't until 1973 that all 50 states passed similar legislation

📍 Before 1988, women were unable to get a business loan on their own. The Women's Business Ownership Act of 1988 allowed women to get loans without a male co-signer and removed other barriers to women in business. The number of women-owned businesses increased by 31 times in the last four decades.

📍 Before 1965, married women had no right to birth control. In Griswold v. Connecticut (1965), the Supreme Court ruled that banning the use of contraceptives violated the right to marital privacy.

📍 Before 1967, interracial couples didn’t have the right to marry. In Loving v. Virginia, the Supreme Court found that anti-miscegenation laws were unconstitutional. In 2000, Alabama was the last State to remove its anti-miscegenation laws from the books.

📍 It wasn’t until 1993 that marital assault became a crime in all 50 states. Historically, intercourse within marriage was regarded as a “right” of spouses. Before 1974, in all fifty U.S. states, men had legal immunity for assaults their wives. Oklahoma and North Carolina were the last to change the law in 1993.

📍  In 1990, the Americans with Disability Act (ADA) – most comprehensive disability rights legislation in U.S. history – was passed. The ADA protected disabled people from employment discrimination. Previously, an employer could refuse to hire someone just because of their disability.

📍 Before 1993, women weren’t allowed to wear pants on the Senate floor. That changed when Sen. Moseley Braun (D-IL), & Sen. Barbara Mikulski (D-MD) wore trousers - shocking the male-dominated Senate. Their fashion statement ultimately led to the dress code being clarified to allow women to wear pants. 

📍 Emergency contraception (Plan B) wasn't approved by the FDA until 1998. While many can get emergency contraception at their local drugstore, back then it required a prescription. In 2013, the FDA removed age limits & allowed retailers to stock it directly on the shelf (although many don’t).

📍  In Lawrence v. Texas (2003), the Supreme Court ruled that anti-cohabitation laws were unconstitutional. Sometimes referred to as the ‘'Living in Sin' statute, anti-cohabitation laws criminalize living with a partner if the couple is unmarried. Today, Mississippi still has laws on its books against cohabitation.

LDS LGBTQ Anniversaries for 2023

For 8 years I’ve been in charge of creating my stake’s calendar. In addition to stake meetings & activities, I include holidays and significant LDS anniversaries like when it was the 175th anniversary of the founding of Sunday School or 40 years ago priesthood and temple blessings were restored to members of African descent. 

This year there's only 1 significant anniversary I put on the calendar: Sept 21st will be 200 years since the angel Moroni first appeared to Joseph Smith.

For readers of this blog, here’s a few anniversaries this year that may be of interest:

75 years ago

April 1948 - Gay BYU students Kent Goodridge and Richard Snow met with church president George Albert Smith. They were in love and wanted to get a clarification of their ‘status.’ President Smith treated them with great kindness and told them to "live their lives as best they could" in their companionship. They had gambled making this appointment and worried they could be excommunicated on the spot, instead they left feeling loved and valued. 

Unfortunately, this live-and-let-live attitude didn’t last long as President Smith's successor, David O. McKay, felt homosexuals "should be excommunicated without any doubt, that the homosexual has no right to membership in the Church."

30 years ago

May 18, 1993 - Apostle Boyd K. Packer gave an address to the First Presidency, the Quorum of the Twelve, and the Presiding Bishopric, in which he stated there are three great threats to the LDS Church: the gay/lesbian challenge, the feminist movement, and scholars 

September - The September Six are excommunicated for publishing scholarly work against or criticizing church doctrine or leadership. This was widely reported in national press and resulted in a chilling effect on academics challenging approved church narratives

25 years ago

October - Mormon-raised Russell Henderson and his friend Aaron McKinney tortured Matthew Shepard and left him for dead in Wyoming. The shocking crime made international news. The outrage over this crime eventually lead to the Matthew Shepard Act in 2009 which expanded the federal law’s definition of “hate crime” to include sexual orientation and gender identity. In 2018, Matthew's ashes were moved to the Washington National Cathedral

15 years ago

Chieko Okazaki, the first person of color to serve in an LDS Church general organization presidency, was first counselor in the General Relief Society President when she published a book in which she wrote “A family with a gay child is not a failed family. It's a family with a member who needs special love and understanding and who has love and understanding to give back.”

California’s Prop 8 - Church leadership heavily encouraged members donate time and money to pass Prop 8 which would ban same-sex marriage in California. About 1/2 of the money raised for its passage came from Mormons. The proposition passed and immediately there were protests at temples in Los Angeles and Salt Lake City, and the church received a lot of negative exposure. Since then the church has preferred behind-the-scenes roles in its efforts to combat queer rights

Dec 20, 2013 - Same-sex marriages became legally recognized in Utah. Seth Anderson & Michael Ferguson, both former Mormons, are the first gay couple to get married in Utah

January 2018 - The documentary "Believer" featuring Imagine Dragon's lead singer Dan Reynolds premiered at the Sundance Film Festival. Reynolds discussed the intersection of LGBTQ people in the Mormon community. Later in the year he appeared on The Ellen Degeneres Show and The Daily Show with Trevor Noah and spoke of LGBTQ Mormons and suicides

January 2018 - Josh Weed, the most famous LDS gay man in a mixed-orientation marriage, announces that he & his wife will get a divorce. They apologize to everyone who ever had their story held up as an example that gay people can get married and stay in the Church.

February 2018 - Church-run Family Services states it no longer provides reparative therapy or sexual orientation change efforts

February 2018 - Richard Ostler starts a podcast called “Listen, Learn, and Love,” which has LGBTQ members/former members share their stories

March 2018 -  BYU sponsors its first LGBT campus event, a panel of four students--Kaitlynn Wright, Ben Schilaty, Sarah Langford and Gabriel Cano–answer student-submitted questions

I just watch a YouTube video about insane and abusive parents. Parents only allowing 2 showers per week; parents freaking out and threatening to call the cops if their grown adult child doesn't want to share their location with them, (tracking apps) or if they've moved out of the house and they want them to "come home"; Parents who literally destroyed phones because their child didn't give then there phone's password; and even parents who tried to sell things that their child bought with their own money, or just getting angry when their kid eats/uses something that they bought for themselves with their own money, and don't share it with the rest of the family or the parents themselves; some parents even going as far as to lock their minor child outside for a night!

My mom is awesome! She not neglectful, nor is she abusive. She allows me to do my own thing, and if I buy something with my own money, she does not expect me to give her something. (All though I do know that she knows, that what's mine is hers. I love her a lot, and when I have money to spend, I will often get her something as a kind gift/gesture.) She respects my privacy, and trust me. She does not expect anything out of me, other then doing my fair share of the chores, and helper her if she needs it. She is the kind of woman to keep a roof over her kids heads, when they need it most, even if they disrespect her. (I always hated how my oldest brother treated our mom so horribly, and she didn't stand up for herself very much. Sure she used her voice to tell him that she didn't like what she was doing, but it often didn't matter because he kept doing it anyway. Because he failed to understand that this was her house, not his; and he doesn't make the rules, she does. Because it does not matter that he is 28, he is in her house, a house that she was kind enough to offer a room in; She did not have to do that.) She is hard working, and always does her part and then some; even if she's always hurting. She is just over all a great person, and I love her for that!

My dad on the other hand, is a rude narcissus. He likes to play these "games" like, "what's wrong with the car?" Where he will repeatedly press the gas and breaks over and over again, making the car continuesly jerk; or he will swerve the car left to right over and over again; in both situations, he will repeatedly say "What’s wrong with the car!?". But will then go on to tell me that I'm "to immature", and he won't let me "get behind the wheel of a killing machine", all just because I didn't want to do the dishes right then and there; or that, "if I can't follow directions around the house, then I won't be following directions on the road." Here's the thing, following the laws of the road, is more important than getting you a coke zero out of the fridge, and in your hands as fast as possible! He also tells me that I'm "to immature" and "inexperienced" to get a job; but he won't allow me ways "to gain maturity" or "experience". But oh my gosh! When I told him I was moving back to Oklahoma, with my mom, I was suddenly "experienced" and "mature enough" to get a job. (He lives in Utah. And my parents are divorced.)

When telling him I made the decision to move back in with my mom. (Because the household was toxic. My dad, and stepmom where having at least three fights a day, my stepbrother was also joining into these fights a lot; he also kept threatening my dad, and even told his mom that she should shoot him herself. On top of that my dad didn't even pay much attention to me, unless it was for his own benefit.) He kept asking why I wanted to move back in with my mom, and every time I gave the same answer. "Because, 1. I'm tired of living in a toxic and harmful household. 2. I will have an easier time getting a job. (Since you deny me that option.) And 3. I'll be able to get my driver's license." When telling my dad this, he told me that she was lying. (He says that a lot; my mom is just some kind of lying monster, that just doesn't know how to tell the truth. But don't worry! Because he won't "sugarcoat that shit.")

Eventually he just straight up told me he wasn't going to allow me to move back in with my mom. So in return, I told him that, "I would interact with him for as long as I had to, but as soon as I turn 18 I would leave and never return. So he better 'enjoy mcompany's, because my 18th birthday would be the last time he would ever see or hear from me again." (I was 16 at the time) (And, I may be lazy, but when I set my mind to something, I'm stubborn as HELL!) And the next thing I knew, I was on the next flight to Oklahoma.

My point is, for all of those people who have one or more abusive parents/step-parents; just know you're not alone. For all of you who are over the age of 18, I wish you the best of luck getting them to respect you as a human being, or just trying to get them out of your life completely. Eight dead in Utah murder-suicide

The Utah father who killed himself after murdering his five kids, wife and mother-in-law left his family a warped suicide note where he confessed he'd rather 'rot in hell' than deal with his wife another day.

Michael Haight, 42, fatally shot his wife, her mother and the couple's five kids on January 4 after he was investigated for child abuse. Local police and the city of Enoch have also released the disturbing bodycam footage of the shooting, showing cops padding through the family's eerily silent home while their bodies lay inside.

But now Haight's twisted suicide note have emerged, where he claimed his wife Tausha had driven him to violence. Haight did so despite investigations showing he was the abuser in the family - and his wife was the victim.

'This is nonsense and I can't handle it for one more day. We will not be a burden on society. I kept asking for help and you wouldn't listen,' Haight wrote. 'I would rather rot in hell than to put up with another day of this manipulation and control over me.'

Also murdered by Haight were his daughters Macie, Briley, Sienna, and sons Ammon and Gavin, as well as Tausha's mother Gail Early, 78. Tausha had planned to file for divorce from her controlling husband when he exterminated her and the rest of their family.

The agency had opened the investigation 11 days earlier based on abuse of the couple's oldest daughter that had occurred in previous years. The newly released report documents detail several reports of abuse, including an incident in 2021 when Haight suddenly slammed on the brakes on the highway. It scared the family and left red marks from the seat belts on their bodies. In another incident, Haight grabbed his oldest daughter's head and threw her into the hard part of the couch. The daughter, Macie, told caseworkers that her dad would tower over her and her siblings and get close to make them feel intimidated. 'Dad jumps to react to anything he doesn't like,' said Macie, the records show. 'He yells a lot and wants to make sure they know he is right.'

I think the biggest one I’ve made a bit of mention so far is my headcanon about him being the child of divorce. I think he carries a lot of unprocessed abandonment issues and complex emotions related to that—I’ve been toying with the idea lately that he chose to stay with his dad, since he would have been old enough to have a say in the custody arrangement. However, I don’t think this protected him from mommy abandonment issues because I think his mom still felt lowkey rejected by him… and then basically proceeded to have minimum contact with him? She rebuilt her life, got remarried and had his three half-siblings.

And that’s going to still be devastating to a kid. Because as much as you have a vague idea of what your choice means, almost nobody really explains to kids the consequences of what their choices are before hand, even for incredibly benign choices sometimes.

I’m still trying to decide what the outcome of Danny committing patricide is—did he get caught in Utah? Is this the event which put him on the run? Has he been running ever since?

I kinda wish BHVR would give us another tome just so I don’t have to make the decision.

I’m drawn to the idea that he got caught but his mom managed to literally and metaphorically bail him out, it just… gets caught against my sense of disbelief. The amount of Law and Order I ingest doesn’t give me much to go off of—maybe a hung jury? That could be interesting. Like his killing of his dad sounds like it could be pled down to manslaughter, but I have a hard time picturing him not getting convicted if that makes sense…. But at the same time, a prior conviction feels like it complicates his background. It’s really a lot. It’s something I need more feedback on because… well, it’s so much to think about.

Another angst related idea I’ve been toying with as background for my fic includes whether Danny has had a doomed infatuation with someone before—Sam is a particularly butchy bi woman at times and the idea that her character might remind Danny of somebody he’s known in the past was… intriguing. I’ve been visualizing a sort of doomed ho-yay unresolved sexual tension relationship with a guy in his background… maybe even the original “owner” of one of Danny’s aliases?

I'm posting the Wells family plot next, because Emmeline Woodward Wells and Helen Kimball Whitney were very close friends and it feels thematically appropriate. I was sort of startled that Emmeline's gravestone is so small and plain given how well-known she was in Utah in her lifetime. (Another note: the little tags Daniel and Emmeline have on their gravestones with the covered wagon indicate that they were part of the first wave of Mormon migration to Utah. Helen and Horace Whitney have pioneer tags as well on the backs of their gravestones.)
