Prisons for the Privileged? Taiwan’s Minimum Security Prison Selection System Under Scrutiny

Convicted in the 2014 nightclub police murder case, Bao-hong Yi, the son of celebrity Shu-kuan Yi, was sentenced to 9 years in prison for manslaughter and was permitted to serve his sentence at the Wuling Minimum Security Prison in March 2022.

This incident has once again raised concerns about the selection process for minimum security prisons, indirectly leading to the Legislative Yuan's passage of amendments to certain articles of the Statute of Open Prisons (外役監條例) in July 2023.

The purpose of establishing minimum security prisons, also known as open prisons, is to encourage inmates to control themselves and improve their behavior through an “open treatment” prison system, as outlined in Article 149 of the Prison Act. This aims to reduce the spread of criminal habits in a closed environment and prevent inmates from struggling to adapt to society after their release. Despite being amended three times, the selection system for minimum security prisons still occasionally produces cases of unfair selection, leading to questions from the opposition party and the public about whether it favors the privileged.

In the past decade, nearly 20 politicians involved in corruption cases and businessmen involved in significant financial or social cases have served their sentences in minimum security prisons. This includes Shi-wen Yeh from the Bade Linkou A7 affordable housing scandal, Nai-ren Wu from the Taiwan Sugar Corporation land scandal, Wan-jin Yan from the Beitou aerial tramway scandal, Yu-zhu Zhao and Juan-ming Zhao from the Taiwan Land Development Company stock insider trading case, Ling-yi Wang and Ling-chiao Wang from the China Rebar Company and Eastern Home Shopping & Leisure Company embezzlement case, and Wei Ying-Chung from the “gutter oil” scandal.

Many of these individuals, often considered privileged, have spent more than half of their sentences in minimum security prisons. According to the Statute of Open Prisons, one can reduce their sentence by 4 to 16 days per month, indicating that they not only enjoy a better living environment but also have shorter prison terms.

Forty-two out of every 100 politicians convicted of corruption serve their sentence in minimum security prisons. Additionally, 12% of individuals convicted of breach of trust are also serving in these facilities, a rate significantly higher than for other types of property crimes.

Legislator Ou-po Chen pointed out that over 50% of the inmates in minimum security prisons are convicted of corruption and major economic crimes, leading to a perception that these facilities are specialized for white-collar criminals and the privileged.

Deputy Minister of Justice Ming-tang Chen responded that individuals convicted of corruption and major economic crimes pose a lower escape risk and are less likely to reoffend. The inclusion of “family support” as a factor in the selection criteria makes it easier for these individuals to be admitted to minimum security prisons.

Legislator Hsien-chih Chiu also expressed concern that the disproportionate ratio of crimes among inmates leads to public doubts about the fairness of the minimum security prison system.

In response to these concerns, the Ministry of Justice proposed amendments this year, which were passed by the Legislative Yuan. Now, those convicted of corruption and major economic crimes must have no criminal income or must have returned all illicit gains to the court to be eligible for minimum security prisons. Additionally, inmates in regular prisons must have served at least one-third of their sentence for first-time offenders, and at least half for repeat offenders, before they can be transferred to a minimum security prison.

The Control Yuan's investigation reports show that from 2015 to 2018, the scores for selection into minimum security prisons varied significantly. Although the average score was around 80, there were still inmates who were selected with scores between 40 and 49. The Agency of Corrections stated that there is a “considerable correlation” between an inmate’s score and their qualification, but the score is not the sole criterion. For a comprehensive consideration, the selection committee also takes into account the inmate’s remaining sentence and the nature of their offense, said the Agency of Corrections.

Famous cases of low-score selections include Shih-wen Yeh and Ying-chung Wei, raising questions about the standards of selection scrutiny. Shih-wen Yeh, convicted of corruption, passed the selection in 2016 with a score of 60; Ying-chung Wei, convicted of fraud, passed in 2017 with a score of 65.

After 2018, applicants for minimum security prisons were changed to anonymous. However, the “comprehensive consideration” in the review standards still leaves a significant amount of ambiguity.

The selection process for minimum security prison consists of two stages. In the first stage, the selection review criteria form includes five major items: incarceration status (20%), risk of recidivism (20%), security risk (30%), health condition (20%), and family support (10%), with a total score of 100. 

Even if the score on the selection criteria form for inmates applying for minimum security prison is low, they may still be selected due to a high quantitative score in the second stage. Additionally, there are instances where inmates with a perfect score of 100 points on the criteria form are selected for minimum security prison.

Bao-hong Yi, who was convicted of manslaughter in a police murder case, was allowed to serve in Wuling Open Prison after serving 2 years and 6 months in a regular prison. Moreover, an investigation by Mirror Media revealed that Bao-hong Yi’s application for minimum security prison had a full score of 100. This was due to a mistake on the score for risk of recidivism section, which incorrectly marked his drug record as clean, leading to no points being deducted.

The Ministry of Justice confirmed that there were inaccuracies in the review and scoring process and two staff members from Taipei Prison are under investigation for possible forgery and corruption. From this, it can be inferred that there may be instances of unfairness in the minimum security prison selection process due to potential discrepancies in the human review process.

Wang Wei (王維) (Taiyuan, Shanxi, 701-761) foi um poeta, calígrafo, pintor e estadista chinês  da Dinastia Tang. Também foi conhecido como o "Poeta de Buda". Aprovado nos exames imperiais no ano de 721, chegou a ocupar no ano de 758 o cargo de chanceler, o mais alto posto no governo imperial da China antiga após o Imperador. Durante a Rebelião de An Lushuan contra a dinastia Tang, evitou servir de forma ativa aos insurretos durante a ocupação da capital fingindo ser surdo. Por dez anos estudou com o Mestre Tch'an Daoguang. Após a morte de sua esposa no ano de 730, não voltou a se casar e estabeleceu um monastério em suas terras.

Mecanoo cloaks palatial Tainan Public Library with decorative aluminium cladding

Patterned aluminium panels wrap the stepped exterior of the Tainan Public Library, which Dutch studio Mecanoo and local office MAYU Architects have completed in southern Taiwan.

The 37,000-square-metre library, located in the city of Tainan, houses over a million books, alongside collections of music, films and modern art.

Its palatial, staggered form was designed by Mecanoo and MAYU Architects to pay homage to local vernacular, including the city's old temples with cantilevered roofs.

"The oldest city in Taiwan, Tainan has a rich history influenced by different cultures," explained Mecanoo.

"There are remnants of maritime trade with Europe in the 17th century, of the Chinese Ming Dynasty and Japanese settlements from the beginning of the 20th century."

"The city is rich in temples, including the famous 17th century Confucius Temple with its cantilevered roofs and beautifully carved ceilings," added the studio.

"The new library takes from this history, is inspired by the local culture and has been designed for the tropical climate of Tainan."

Its stepped form creates sheltered outdoor space

From afar, Tainan Public Library is distinguished by its large, overhanging upper floor, which is enclosed by aluminium panels adorned with ornate, floral cut-outs.

According to Mecanoo, these panels are modelled on "latticed windows in the old town" and are designed to filter out light and heat during the day while illuminating the building at night.

While referencing local vernacular, the staggered exterior of the building also creates a series of sheltered, outdoor spaces, including four sunken patios for outdoor events.

Here, the slender columns that support the upper floors are arranged in groups of four and are intended to give the feeling of walking through a bamboo forest.

Inside, Tainan Public Library contains different sections dedicated to multimedia, children, teenagers, adults and the city's heritage.

These stand alongside exhibition spaces, a theatre, offices and maker spaces, as well as a study room that is open twenty-four hours a day.

A sculptural red staircase joins is a centrepiece

Entering the building, visitors are greeted by a large atrium that is overlooked by each floor.

Overhead is an installation by UK designer Paul Cocksedge that is composed of suspended sheets of paper, symbolising "freedom of thought and the pleasure of reading".

The atrium and surrounding ground floor spaces are dominated by a wooden material palette, designed to feel warm and welcoming.

On one side, revealed through openings in a slatted wall, is a contrasting sculptural staircase that is painted bright red. This is a centrepiece within the building, visible from each level.

The upper levels of the Tainan Public Library have bolder finishes, including bright yellow floors with contrasting black furnishings and circular pendant lights.

The first space visitors pass through is the multimedia library, which is filled with seating and cosy alcoves to watch the film collections. Above are the general and heritage book collections, with links to the roof gardens the complete the building and provide uninterrupted views over the city.

Mecanoo was founded in the Netherlands in 1984 by Dutch architect Francine Houben. Its collaboration with MAYU Architects on the Tainan Public Library follows its recent completion of a giant red cultural centre in Shenzhen that comprises an art gallery, science museum, youth centre and bookshop.

Mecanoo also designed a city library in Birmingham, England, which also has a distinctive stepped form and an ornate facade clad with metallic rings that nod to the city's jewellery quarter.

Elsewhere, the studio is currently developing a proposal for a copper-coloured tower alongside Frankfurt station as well as a sinuous maritime museum for Rotterdam harbour.

In past Neo Taipei’s collectivist society system, each resident was assigned to a certain role and identity. Adult male were work warriors; adult female were ideal mothers and wives ; juveniles were test machines caged in invisible uniforms. The beautiful future could be expected if you followed the right path of norms and rules. 《 First Memory Pawnshop 》, a brand-new service brought by Shiya Corp, initially is in response to Taiwanese eugenics policy. This service is planned to assure the healthy growth of all underaged registers and to become the future elites in the society. The registers can keep/discard/reset the memory of certain period at their sole discretion before reaching the legal age. In the process of resetting the first memory, the pawnbroker assesses the value and uniqueness of the memory-related object to determine to accept or not, and the collateral and memory will be both retained in the shop for 30 days as loan term. The borrower can redeem the collateral and memory before the end of the loan term, if the loan is repaid at higher interest plus the handling fee. Otherwise, the pawnbroker will forfeit the collateral and also resell the memory. To avoid receiving stolen items, the pawnbrokers normally would ask the police to keep the collateral for 21-30 days. One day , when Ching Wu was on her way to work, she accidentally heard the conversation inside the First Memory Pawnshop between the delivery boy, Huang Ho, and the boss of betel nut stand, Hsin Tsou. She then seriously considered to continue the in-system way of life or just take the uniform off and reset her life by pawning her memory.

Chiu Yi Chih (邱奕智) é professor de filosofia taoísta e trabalha com o taoísmo filosófico (道家 - dao jia). É tradutor, poeta e filósofo chinês. Graduado em Letras Português-Grego Clássico (USP) e mestre em Filosofia Antiga (USP). Leciona cursos de filosofia chinesa antiga com ênfase nos três principais pensadores do taoísmo clássico: Laozi, Chuangzi e Liezi. Em breve será publicado a sua tradução do Dao De Jing em versão bilíngue pela Editora Edipro. Atualmente escreve em língua chinesa seu segundo livro de ensaios filosóficos traçando um diálogo entre o pensamento de Laozi, Confúcio, o budismo Chan e a filosofia ocidental de Platão, Aristóteles, Nietzsche e Deleuze em relação à sua concepção estético-filosófica "Metacorporeidade" que terá versão bilíngue.
