A moral wrong or injury, even if it does not constitute a violation of a statute law, should be compensated by damages. In this case, the defendant clearly acted in bad faith when it schemed and effected the attachment of the C-54 plane of its debtor CALI by assigning its credit to its sister company in the US. Therefore, the defendant is liable to pay damages.
FACTS:
Shell supplies fuel needs of CALI. However, due to financial crisis CALI failed to pay Shell and its other creditors. Thus, they entered into an agreement that they would present suits against the corporation but to strive for a pro-rata division of the assets, and only in the case of non-agreement would the creditors file insolvency proceedings. However, when Shell PH assigned the credit to Shell Oil, its American Sister Corporation, the latter filed a case against CALI for the collection of assigned Credit attaching the C-54 plane of CALI which the creditors opposed and filed damages against Shell for breach of their agreement.
ISSUE:
Whether or not Shell shall be liable for damages. (YES)
RULING:
Article 21 of the Civil Code states that any person who wilfully causes loss or injury to another in a manner that is contrary to morals, good customs or public policy shall compensate the latter for the damage. This is the legal remedy for that untold numbers of moral wrongs which is impossible for human foresight to provide for specifically in the statutes.
Another rule is expressed in Article 23 which compels the return of a thing acquired ‘without just or legal grounds’. This provision embodies the doctrine that no person should unjustly enrich himself at the expense of another, which has been one of the mainstays of every legal system for centuries. Now, if Article 23 of the Civil Code goes as far as to provide that: “Even if an act or event causing damage to another’s property was not due to the fault or negligence of the Shell, the latter shall be liable for indemnity if through the act or event he was benefited” with mere much more reason the Shell should be liable for indemnity for acts it committed in bad faith and with betrayal of confidence. Shell taking advantage of his knowledge that insolvency proceedings were to be instituted by CALI if the creditors did not come to an understanding as to the manner of distribution of the insolvent asset among them, and believing it most probable that they would not arrive at such understanding as it was really the case — schemed and effected the transfer of its sister corporation in the United States, where CALI’s plane C-54 was by that swift and unsuspected operation efficaciously disposed of said insolvent’s property depriving the latter, of the opportunity to recover said plane –to the detriment of the other creditors.

CIVIL CODE OF THE PHILIPPINES ARTICLE 19. Any   person   must,   in   the   exercise   of   his   rights   and   in   the performances   of   his   duties,   act   with   justice,   give   everyone   his   due   and observe honesty and good faith.
FACTS:
Domestic airline CALI met with its creditors and told them that the company was about to go bankrupt and would have to cease operations. While CALI announced that it would file for bankruptcy in the event that creditors could not agree on a pro rata distribution of the company's assets, the creditors decided that it would be better to work toward a fair pro rata division of the company's assets in order to ensure payment of their claims against CALI. Following the meeting, defendant Shell Philippines one of the creditors of CALI—assigned its credit to its sister company, Shell USA. Subsequently, Shell USA filed an action in a California court to collect the assigned credit and requested a writ of attachment against CALI's Douglas C-54 plane, which was located in the state. Shell Philippine turned down an offer from CALI to sell the plane before the creditors' meeting. Velayo filed this lawsuit for damages against defendant Shell Philippines in his capacity as the assignee of CALI's other creditors. He contends that the agreement on the pro rata distribution of assets was broken and that the fraudulent assignment of Shell Philippines' credit to Shall USA hurt the interests of the other creditors.
ISSUE:
1. Whether Shell Philippines acted in bad faith by using its knowledge of CALI's airplane in the US to assign credit to its sister company, thereby undermining the pro-rata allocation of CALI's assets among its creditors, remains to be seen.
RULING:
Yes, Shell Philippines committed bad faith when it gave its sister company credit, thereby undermining the pro rata allocation of CALI's assets among its creditors. The defendant planned and carried out the transfer to its sister company in the US, where CALI's C-54 plane was located. The insolvent and the later-appointed assignee were deprived of the chance to retrieve the plane due to the quick and unexpected action that effectively disposed of the latter's property. The author of this decision does not doubt for a moment that the defendant schemed and carried out the transfer of its sister corporation in the United States, where CALI's plane C-54 was by that swift and unsuspected operation effectively disposed of said insolvent's property, depriving the latter and the assignee that was later appointed of the opportunity to recover. In addition to Section 37 previously mentioned, the following is provided in Chapter 2 of the Civil Code's PRELIMINARY TITLE, which deals with human relations: "Art   19.   Any   person   must,   in   the   exercise   of   his   rights   and   in   the performances   of   his   duties,   act   with   justice,   give   everyone   his   due   and observe honesty and good faith". Although it is true that this article consists solely of declarations of principles, we discover that these declarations are put into practice by Article 21 and the subsequent sections of the same Chapter, which specify the following:  "Art. 21. Any person who wilfully causes loss or injury to another in a manner that is contrary to morals, good customs or public policy shall compensate the latter for the damage".

Another One of Those Days (C! Eret X Reader)
Being a king was no small feat. It wasn't all classy parties and fur lined capes - it also meant actually running a nation. And the SMP was no small nation. There were disputes to be settled and laws to be upheld, and at the end of the day, all of that responsibility fell to the king.
You were a little biased, but you thought Eret was doing a pretty good job of handling an entire kingdom. For the king of the entire SMP - a nation torn apart by wars on a regular basis - he wasn't doing half bad. Even war torn, Eret had the SMP as one of the most stable places to live. He did it all with a smile on his face, too.
Of course, he wasn't doing it entirely alone.
You were a something of a helping hand when it came to making sure the kingdom ran smoothly, being Eret's spouse. While he handled the most important parts of running a kingdom, you did a lot of the smaller things. Things like managing the palace staff, and handling smaller disputes (things like property line disagreements and civil arguments). It wasn't much, on the large scheme of things, but some days it could get pretty hectic.
Like today, for instance.
Since you had woken up this morning, you had been running around the palace all day. It seemed like the whole universe needed your attention - something had happened down in the kitchens during breakfast (meaning you'd had to cut your morning meal with Eret short), and the civil disagreement you were supposed to resolve today ended up stretching on for hours (meaning you weren't able to catch Eret after his morning council meeting) and then just as things had been calming down, someone had broken a stained glass window in the west wing (meaning you'd had to skip dinner entirely, and ended up just sneaking a few slices of sourdough from the kitchens).
Needless to say, you were exhausted, and you missed your husband.
Luckily for you, the sun had sunk behind the trees, the day was over, and he would be waiting for you in bed.
You finished off your sourdough dinner substitute as you approached the door of your shared bedroom, opening it up as quietly as you could and slipping inside. You didn't want to disturb him if he was asleep, as you were sure he'd had a hard day as well...
But no, Eret was very much awake, and waiting for you on the edge of the bed.
He had taken off most of his kingly attire - the long red cape usually found draped over his shoulder was folded over one of the armchairs on the other side of the room, and the crown was in it's proper place on it's shelf. Now, Eret's hair hung loose in his face, and his white silk shirt lay unbuttoned across his chest.
"Hello dear." He greeted in a low rumble, a smile coming over his face. "I missed you today."
You melted, taking his hand as he reached out for you, pulling you into his lap. Your head found it's place tucked underneath his jaw, and you wound your arms around his middle, sighing deep in your chest. "Hello love."
"You seem tired." Eret noted, stroking a hand through your hair. "Long day?"
"Like you wouldn't believe." You grumbled. "I don't think I've had such a busy day since before we got married." You nuzzled into him more, letting your eyes drift shut. "It's better now though."
You could feel Eret's chuckle bubble up in his chest. "I'm sorry we didn't get to take our usual breaks today." He said. "Perhaps I can make up for the lost time now?"
Your eyes opened back up at the suggestive tone in his voice, and you pulled back a bit so you could meet his eyes. "Oh?"
"If you're feeling up to it, of course." He said. "I just thought maybe it would help you relax, blow off some steam, if you will." His hand found it's way down to your thigh, kneading the flesh gently.
Goosebumps rose from your skin at the touch. "That would be very nice." You said.
A grin stretched across Eret's face as he shifted, letting you get out of his lap. "Put on something nice for me, won't you? I missed seeing you today."

It couldn't have been more than a quarter of an hour later that you found your wrists bound to the headboard of the four poster bed you shared with Eret, your lingerie clad body spread over the sheets like a lewd painting. You tugged at the silk tie binding your wrists - one of Eret's many sashes. He'd worn this one to a few banquets before, a lovely deep purple color.
Now, the fabric only accented your skin as you lay in wait for him.
Eret stood at the foot of the bed, slowly shrugging the shirt off his shoulders, letting the fabric slide down over his back. He always liked to put on something of a show for you - and you were always appreciative.
Eret's eyes found you as he unbuttoned his pants, letting his trousers pool at his feet as he stepped out of them. In only his boxers, he climbed onto the bed, propping himself up beside you to run a hand down your body, toying with the fabric of the lingerie you had picked out.
"You look delectable darling." He said, playing with the fabric of your outfit. The action caused goosebumps to rise over your skin where his fingers just barely brushed across. "I love it when you wear this one."
"Well, you said you'd missed me." You responded, pulling against your ties to crane your neck forward. Eret indulged you, leaning down to press his lips to yours, wasting no time in opening the kiss. Eret stopped playing with your outfit and instead started removing it, exposing your bottom half.
He pulled away to toss the piece of the outfit away, throwing it towards the pile of his own clothes on the floor. A shiver ran up your spine as Eret's eyes drifted down your body - he looked like he wanted to eat you.
And he did.
You jerked against the ties as Eret put his mouth on you, his hands sliding upwards to grip around your hips, holding them down to the bed so you couldn't squirm away from the heat of pleasure. A moan escaped your throat as Eret licked around your hole, sliding a finger in.
Involuntarily, your hips jerked up, only for Eret to press back down, stopping you from moving too much. You ached to touch him, but you were still secured to the headboard. There was something tantalizing about being completely at his mercy though.
Another finger slid in, beginning to stretch you open as Eret kept up his ministrations. Your breathing picked up as the warm tingly feeling spread over the rest of your body. Eret never disappointed - not when he put his mouth to good use.

It’s not that poor countries can’t make their own vaccines. The Global South has a lot of vaccine production capacity. The problem is Big Pharma, which refuses to transfer the patents and know-how to repurpose those facilities for mRNA production.

South Africa and India have petitioned the WTO for a vaccine waiver. We should all want this: first, because it is monstrous to doom millions to die in order to preserve the regulatory privileges of a handful of hugely profitable, heavily subsidized pharma companies.
But second, even if you don’t care about being monstrous, a waiver is needed to ensure all our survival: the longer and wider the virus circulates, the more mutations we’ll get, with the mounting risk of a more virulent, more lethal, more vaccine-resistant strain.
The pharma industry has an army of high-paid lobbyists (including Howard Dean), and volunteer simps (like Bill Gates) who are pushing the story that a waiver is unfair and counterproductive, a betrayal of the fundamental patent bargain.

They say that the pharma companies committed their capital to vaccine research because we, the people of the world, had promised them exclusive rights to those discoveries (notwithstanding that we also paid for the vast majority of that R&D).
If we alter the deal now, how can pharma trust us next time?
Of all the lies told by the pharma industry about the pandemic, this is the most insidious. Because that’s not how the global patent system works at all.
Gen Xers and their elders will remember the summer of 1999 and the Battle of Seattle, where anti-globalization activists fought for weeks to block the signing of the WTO agreement and its chapter on IP, the TRIPS agreement.
The WTO agreement fundamentally changed the way global patents worked.
Prior to the WTO, it was common for poor countries to completely ignore the patents issued by rich countries (unless the World Bank or a former colonial power coerced them into recognizing these claims).
That’s because countries that are net importers of finished goods have no reason to honor their suppliers’ claims — doing so merely burdens their own struggling manufacturers by forcing them to pay rent to rich foreigners.
This creates drag on local development, ensuring that importer countries stay importers, never becoming self-sufficient.
Ignoring other countries’ exclusive rights regimes — copyright, patent, trademark, etc — is a tried-and-true method to gain self-sufficiency.
That’s why the Framers of the US Constitution decided that America would ignore foreign patents and copyrights, a policy that persisted for over a century, only ending once the US became a net exporter of ideas and inventions, and thus stood to gain more than it lost.
Not just the US, of course. Many European nations spent a century or two a-pirating while their developed their capacity. The Dutch, for example, abolished patents during much of the 19th and 20th centuries.
It doesn’t make sense for a poor country to pay a rich country for rent on ideas. At least, it doesn’t make sense from the perspective of the poor countries.
It’s easy to see what rich countries get out of the deal.
That’s where the WTO (and specifically TRIPS) came in.
TRIPS proposed a bargain to poor countries: if you pay rent on rich countries’ ideas (by recognizing their patents, trademarks and copyrights), we’ll engineer the system so that you become the favored manufacturing contractors for rich countries.
This creates jobs in the short term, and, long term, it builds capacity, by teaching people how to build and operate complex systems.
It’s a form of “technology transfer” that replaces the old adversarial system of rent-collectors and tenant states with global cooperation.
This was a dubious proposition, but the WTO threw in a sweetener: a provision for emergengy waivers. These meant that if there was ever a situation where honoring foreign patents would result in domestic mass-death, those offshore obligations would be immediately suspended.
Think about that for a second. The pharma industry wants you to think that a vaccine waiver reneges on the bargain the world made with it.
But that was never the bargain.
The bargain the Global South struck was, “We will pay rent on rich countries’ ideas. In exchange, we’ll get capacity-building help. In case of emergency, all bets are off: not only will we get access to ideas for free, the WTO will use its might to force tech transfer.”
That’s the bargain pharma signed up for. The claim that a waiver reneges on the deal is truly Orwellian, a heads-I-win-tails-you-lose proposition where poor countries pay rent on ideas and get NOTHING in return — save death and the option to pay yet more rent.

First published yesterday, it delves into a detailed account of this dynamic, and opens with a devastating argument:
If the pharma companies are right and poor countries truly don’t have the capacity to build vaccine factories, then the WTO is a failure.
The whole point was to build capacity.
If it’s not there, then all the rents the poor world paid all century were a lethally squandered opportunity — they should have followed in the footsteps of America and the Netherlands and ignored the rent demanded by wealthy lands.
The authors describe how pharma gamed the system in the WTO decades. For example, companies devote enormous energy to patenting small variations on their processes and products, allowing them to extend the life of their patents long beyond the 20 years they’re promised.
This produces some genuinely hideous outcomes. In Patrick Radden Keefe’s EMPIRE OF PAIN, the author documents how the Sackler family contemplated seeking regulatory approval to prescribe Oxycontin to children in order to extend the life of their patents.

It’s hard to imagine how we’ll survive the pandemic crisis without a waiver. COVAX, the “voluntary” system that lets billionaires, corporations and rich countries offer vaccine doses to poor countries as charity, is a total disaster.
COVAX has only raised pledges of 20% of the needed doses — and it isn’t delivering on those pledges.
The system isn’t just failing by accident — the pharma companies are actively sabotaging it.
C-TAP, the WTO’s own scheme for pooling vaccine production know-how, has failed, largely because companies like Pfizer and Biontech have forced NDAs on their contractors that prevent them from participating in the program.

The pharma companies have refused to license for mRNA vaccines for production in both in the rich world (Canada, Israel and Denmark) and the poor world (Bangladesh).
The deals pharma struck with the global south don’t just bump the world’s poorest to the back of the line — they also charge the poorest people the highest prices for vaccines. Astrazeneca is charging South Africa twice the going rate in the EU.

The very idea of pharma patents is surprisingly new. France instituted pharma patents in 1960; Ireland, 1964; Germany, 1968; Japan, 1976. Pharma demanded these patents to produce the “incentive” to invest, but the bulk of basic pharma R&D is still publicly funded.
Take the Astrazeneca vaccine, developed at Oxford. Between 97.1 and 99% of the funding for that research came from public sources, not Astrazeneca’s profits.

The WTO agreement promised the Global South that in a global pandemic, the same might that was used to coerce them into passing laws enforcing rich countries’ patents would be brought to bear on rich countries to force them to help make medicine where it’s needed.
The pharma shills who claim that waiving the patents on mRNA vaccines actually have a point: pharma companies have gamed the patent system so that much of the know-how is never disclosed in patent filings, and the filings themselves are sealed for 18 months.
In the face of this sabotage, the WTO could order rich member states to uphold their obligations by forcing their companies to transfer patents AND trade secrets to poor countries — just as the US forced pharma companies to pool their research on pennicillin during WWII.
That would be the fair thing to do. The right thing to do. The rational thing to do — if we want to ensure the continuation of our civilization and even our species in the face of new mutant strains.
The WTO claimed that poor countries that honored the TRIPS would become tech exporters, building their own domestic capacity. Twenty years later, they’re still importers — and on track to stay that way forever (or until we’re all killed by covid).
The US has no standing to complain about a TRIPS waver. A country that built its fortune and capacity by refusing to pay rent to rich nations for their ideas deserves the same treatment once it becomes rich itself.

Her face burned at the prospect of being kicked offstage by Frankie Fellows himself. But as he stepped up next to her, she saw the fierce gleam in his eye and the thin hard line of his mouth. He seized the microphone. He did not look like he was here to put on a show. “Hey!” he barked. “HEY!” The crowd went instantly quiet, aside from a few murmurs. He stared out past the lights, as if he could see every last face. “Have some fucking respect, yeah? This girl, this talented girl, comes to play some tunes for you and here you are acting like a pack of bloody savages. Animals, the lot of you! You should be ashamed of yourselves.” It was dead silent, except for the blood pounding in Stef’s ears. “I am not gonna fucking tolerate that on my tour. Yeah? Sports sucks. That’s what Kuroo knew about (y/n), yet he still egged him on to play volleyball with him. He had a choice to say no, which was what younger him was hoping for, yet he still did it in hope of gaining his affection.
All his life he thought he was annoying. All his life he’d been in the mindset of how annoying he was, and how blissful it would’ve been for him to just disappear off the face of the earth.
So when (y/n) suddenly stopped showing up to practice, Kuroo didn’t expect himself to get worried.
He was starting to miss all the clingy touches, or the ‘good morning, Kuroo-kun!’ every single morning practice. He didn’t realize how quiet the walk was to his classes, or to and from home, when (y/n) wasn’t there to fill the noise on random things he found cool or how his day was. He didn’t know how expensive the drink (y/n) religiously bought him from the vending machine was, even though he bought him the drink with a smile plastered on his face like it was nothing.

Kuroo dropped the volleyball he was holding. He’d gone up to coach nekomata to ask where (y/n) was, and why he wasn’t showing up to practice. But he was regretting asking in the first place. Nekomata gave him a sympathetic look.

Kuroo figured he’d stop by his apartment to see what was going on. It’s been weeks, yet he couldn’t find him anywhere in his classrooms, and he nor Kenma could reach him on his phone.
When he walked up the stairs, looking for the ever familiar door to his apartment, he was nervous. For once in his life when going to talk to the boy, he was nervous. It wasn’t a good feeling, he never felt nervous to talk to him before.
When he noticed the door slightly ajar, he clutched the apology basket of sweets in his hand tighter. He wasn’t sure what he wanted to apologize for, though. Maybe for yelling at him, or maybe for something else.
“...hello? (Y-y/n)?” When he opened the door, he was met face to face with construction workers, and a blank apartment. Kuroos heart stopped beating. A man, who Kuroo believes was the apartment owner, looked at Kuroo, to his schools jacket, and down to his basket saying “I’m sorry (y/n) :(“
“Oh? Are you here for that (h/c)-haired kid?” Kuroo nodded vigorously.
“Sorry bud. He moved out a few days ago.” Kuroo couldn’t hide the devastated frown from tugging at his lips. He mumbled a small “sorry” and spedwalked out of the building.
He spammed (y/n’s) phone, probably texting more than he ever did his whole life combined, with “where are you’s” and “hey look I’m sorry, okay? Please answer me’s”
None of them were even read.
Kenma didn’t react well to knowing one of his best friends moved away so suddenly. Unlike Kuroo, (y/n) was good friends with him, practically attached to the hip. When Kuroo told him he couldn’t find (y/n) at his apartment, Kenma clutched his ds harder and glared at the screen like it was it’s fault for making him disappear.
But as much as Kenma blamed the ds, they both knew it was Kuroos fault.

Kuroo strived to be a better person. He came to terms with his feelings for (y/n), and how he could never repeat his mistake again.
He grew to love (y/n), and he messed it up so bad.
He’d be sure to never lead anyone on again, minus when he’d lead his team to victory as their new captain. He’d try and hold less grudges, tell someone when he doesn’t like them, as to let them down easy instead of blowing up in their face, and even bought his team snacks and filled up their water bottles during practice.
Kuroo walked around the unknown streets of miyagi, scanning his eyes for a mop of bleached hair. He knew Kenma got distracted on his phone, but this was excessive, even for him.
Eventually, his eyes landed on two bright figures. Kenmas usual bright blond hair, and a tuft of orange next to him.
“Kenma!”
Kenmas head whipped up, and he shut off his phone, but then a flash of (h/c) came into his peripherals. He looked a little further down and locked eyes with someone who made his throat close up.
(Y/n).
He looked older. Not in the way that he looks physically older, but he carried himself with a somewhat mature, grown stance that made Kuroo so a double take. His hair was slightly longer and he was wearing a black team jacket instead of the red Nekoma jacket he used to wear. Shocked (e/c) colored eyes morphed into an expression of pure resentment, making Kuroos shocked happiness short lived. Kenma walked up next to him, about to ask what happened when Kuroo turned his head away, walking with his head down.
Kenma waved bye to Hinata, when his eyes landed on (y/n). He was talking to a silver headed guy, with a distasteful frown directed at Kuroo. He didn’t say anything though, just ducked his head and walked beside his captain.

(Y/n) kept his eyes fixed on the ground, as Nekoma and Karasuno stood in a line, facing eachother. Kenma was practically standing in front of him, shocked to the core, but also averting his gaze. Not just because (y/n), but Hinata next to the boy was staring at him with his mouth agape.
Eventually everyone filed into the gym, Hinata stopping Kenma to talk, while taketora eyed him menacingly. (Y/n) side-eyed the little interaction with an unwanted jealousy. He wanted to talk to Kenma, he WAS his childhood and best friend. But it soon dissipated when he felt a hand on his shoulder.
That jealousy turned into hatred.
“Can we talk, (y/n)?”
(Y/n) slapped Kuroos hand away and stepped past him, pushing him back slightly with his shoulder.
“Don’t call me that. You have no right. It’s
(L/n).”
Kuroo watched as (y/n) stepped into the gym, his lips pressed into a fine line.

(Y/n) sat on a bench in the corner with an obviously closed off aura, watching as people set up the net or the players from both schools talked to eachother. He walked as Kuroo shook hands with Daichi, not noticing the mop of bleached hair sit himself next to him. (Y/n) flinched when he felt something brush his shoulder.
He whipped his head around to find Kenma, sitting right next to him, but looking straight in front of him. He said nothing, and fiddled with his fingers. Guess he didn’t change, even after a new school year.
(Y/n) relaxed a bit and went back to stalking his team and old teammates with a somewhat less intimidating aura. They sat in heavy silence for what seemed like forever, until (y/n) coughed into his Karasuno jacket.
“S-so how you been Ke-“
“So you’re just not gonna tell me why you left?”
Kenma was looking straight at (y/n), with his normal, neutral gaze. It looked like his normal face, but (y/n) knew how hurt he was. He understood, though. He would be hurt too if his best friend moved without saying goodbye.
“I’m...I’m sorry.”
“It’s fine.”
More silence consumed them. Sounds of sneakers squeaking and the rustle of the net being hung up seemed to vanish under the cloud of quiet sheltering them. Kenma stood up.
“I’m not mad. But I know why you left. And I’m not saying it’s a stupid reason, but you should talk to him.”
Kenma walked away without another word, leaving (y/n) to trail his eyes over to his old teammate, now captain. The frown that summoned up on his face came naturally, despite taking Kenmas words to heart.
He also stood up, brushing himself off and turning his cheery attitude back on. Why play a game with a frown when you’re about to destroy your old team?

(Y/n) wasn’t mad he lost. He was actually quite satisfied with ticking off some of his old teammates by receiving spikes or feints no one saw coming. He sort of felt like an inside man. A spy even. It wasn’t enough to secure a win, but (y/n) never really cared for that.
Everyone was bidding their new friends goodbye, or just idly standing by. He promised Kenma to unblock his number, but only if they never talked about Kuroo again. (Y/n) knew he was being petty, but if it meant never talking to that piece of shit again, so be it-
“Stop ignoring me.”
Speak of the fucking devil. (Y/n) didn’t turn around, choosing to clutch the edge of his black jacket instead.
“Then stop trying to fix a friendship that never existed, Kuroo.”
“Oi!” Kuroo grabbed onto (y/n’s) shoulder harshly, pulling him back and making him stumble a little. (Y/n) pried and clawed at Kuroos iron hard grip. As much as he hated to admit it, he missed Kuroos touch, a lot.
“Can we please have a civilized fucking conversation? I’m fuckin begging you here!”
“Stop fucking cursing and let go of me you fuckass scheming bitch!”
(Y/n) swung at Kuroos head, but avertedly missed. He wasn’t sure if he missed on purpose, or if Kuroo ducked. Kuroo grabbed onto (y/n’s) waist, earning a choked squeak, and hauled him over his shoulder. Kuroo looked for a secluded area, ignoring the fists digging repeatedly into his back and the confused stares he got passing by his team and (y/n’s) teammates.
Kuroo practically threw (y/n) off his back, him stumbling down and hitting the back of a wall a bit harshly, and trapped him between his body and the wall. Both of his hands were on either side of (y/n’s) head, and his legs were long enough to trap him in if he tried to escape.
(Y/n) shrunk back into the wall ever so slightly, but kept the scowl present on his face. Kuroo pursed his lips and sighed.
“(Y/n)-“
“Let me go. I don’t wanna tal-“
“GODDAMNIT (Y/N) IM BUSTING MY BALLS HERE TO TELL YOU THAT IM SORRY!” Kuroo slammed his hands against the wall again, earning a surprised flinch from the smaller boy. “FUCKING LISTEN TO ME! PLEASE!”
Kuroos eyes softened a bit when he finally met eyes with (y/n’s) petrified form, cowering against the wall with his arms tucked in shakily. (Y/n) was quick to push past Kuroo though, diving past him and turning around, free from the wall.
“You see-this is what I fucking hate about you! You act so slick and perfect to the point where you lead people on to think they mean something important to you! I wanted to be a writer, Kuroo! I gave that up to spend my time bouncing a fucking volleyball around with you, and what did I get?! Nothing! I only did it for your stupid friendship, yet I didn’t even get that!”
(Y/n) practically had steam rolling out up his ears, and his words dripped with pure hatred with each retort. Kuroo opened his mouth to speak, but (y/n) beat him to it.
“So if you really want to apologize, give me back the blood sweat and tears I wasted on this stupid volleyball shit!”
(Y/n) punched at Kuroos chest with trembling hands. He kept punching and hitting Kuroo until Kuroo gently grabbed his wrists and pulled him into a hug. Kuroo felt him balling his fists into his back, trying to push him away, but he knew he was stronger. (Y/n’s) mouth was muffled by the cloth of Kuroos shirt, yet he still kicked and screamed at the top of his lungs.
“LET ME GO! I WANT MY CHILDHOOD BACK! I WANT ALL THE YEARS I COULD’VE BEEN WRITING OR LITERALLY BE DOING SOMETHING I ACTUALLY FUCKING LIKE BACK! ITS YOUR FAULT! ITS YOUR FAULT THAT MY ARMS HURT EVERYDAY! ITS YOUR FAULT I GAVE UP ON WRITING! ITS YOUR FAULT! I HATE YOU! I HATE VOLLEYBALL! I FUCKING HATE YOU! I hate you! I-I hate...I....”
Yelling turned into incoherent sobs as (y/n’s) punches died out into love taps. Kuroo said nothing, rubbing circles onto (y/n’s) back, who finally gave up and weakly wrapped his arms around Kuroos waist. He stained Kuroo with his salty tears, choking out half assed “let me go”s in between hics and sobs like a broken record.
They stood like that in comfortable silence, Kuroo combing fingers through (y/n’s) hair while the smaller boys sobs turned into occasional sniffles. Kuroo rocked gently from side to side, attempting to calm him down until he was ready to talk.
“I just wanted to be your friend, stupid Kuroo...” his words were barely understandable through the cracks and sniffles of his voice-also being muffled by Kuroos chest-but the taller boy heard every word as clear as day. He rested his chin on top of (y/n’s) head, looking off to the side.
“Sorry. If it means anything, I was stupid enough to hold a childhood grudge against you. You did nothing wrong. I just...i was dumb and disliked you because I thought you were lazy and annoying even though you were anything but that and...yeah. Sorry.”
Kuroo pulled away from the hug, the cold air hitting (y/n) like a truck. He silently whined at the loss of contact, wiping away stray tears with his team jacket. Kuroo awkwardly held his hands behind his back, his tongue suddenly feeling too big to fit comfortably in his mouth.
“...I’m sorry too.”
(Y/n) averted his gaze, his eyes half lidded and puffy from crying. Kuroo looked at (y/n) with a blank expression.
“Why?”
“For um...being annoying or something. And like...bitching a lot. I’m sorr-.”
Kuroo grabbed hold of (y/n’s) shoulders and shook him violently. “Don’t apologize! You don’t have anything to be sorry for! It’s my fault! Let me take the blame!”
“God shut up you’re gonna make me cry again.”
“...sorry.”
Kuroo looked like a kicked puppy, which made (y/n) burst into a fit of laughter. Kuroos ears perked up as he was graced with the sight of (y/n) wiping happy tears off his face and clutching his stomach. It was a beautiful sight, so beautiful that it made Kuroos chest tighten.
Chuckles died out into snickers as (y/n) huffed and leaned against the wall.
“So-what are we? Friends?”
Kuroo hesitantly nodded, watching (y/n’s) face intently for any sign of protest. When (y/n) broke out into a smile, Kuroo felt like he was on cloud nine. Like a weight had been lifted off his shoulders after so long. He felt like he was flying.
“We should probably head back. I gotta go back to my schoo-“
“Yeah. Yeah that’s probably..smart...”
It was kind of bittersweet knowing you had to say goodbye to someone you just got your hands back on, but after (y/n) unblocked his number right infront of him before enveloping him in a hug, he supposed it was alright.
“Bye~! call me~” (y/n) mouthed out, stepping onto the bus. People started asking him if he was crying, or what that meltdown was about, but he just shrugged and put some earbuds in with a reserved smile.
Sports sucks. That’s the mindset (y/n) has, and probably will have forever.
But not when I’m with you.

Epilogue:
“(Y/n)!” Kuroo ran up behind the boy and picked him up, twirling him around before setting him down. Tsukishima visibly gagged while Yamaguchi snickered behind him, stepping off the bus and preparing for the training camp.
“Yo! What’s up! God I missed you and your stupid hair.”
“I missed you too~”
...
“So...are we-“
“Yeah, that’s what we said on video chat right? I mean-if you meant it and all.”
“I DID!” Kuroo picked his new boyfriend up, this time placing a chaste kiss on the bridge of his nose.
“And god I love you so much.”

Part 7: And now... what?
This is a post long overdue. I must admit, this is the most difficult one, so I was putting it off, reading again and again what I had already written and browsing through the internet to try and get the most complete picture.
Disclaimer: in this case, almost all of the post is my personal opinion (I tried to keep the previous post objective). I’m biased because of the XZ friendly content I’m usually exposed to and by my own views of their situation. Open to discussion, but please make sure you’ve enough information to do so.
Let’s go back to anon’s original ask:

I think I have been answering your first question in the past posts. However, about the next two:
When I was compiling information and writing the previous posts, a song kept coming back again and again to my head, specifically, this part of the lyrics:

Innocence
What happened to XZ was a combination of incredibly bad luck, strenuous social circumstances (the pandemic), high stress in the public and a set of underlying issues that had been festering for a long time.
From being a celebrity on the way up, he suddenly became a scapegoat for a conflict he hadn’t caused and the receiver of a lot of senseless hate. He didn’t do anything from start to finish in the 2/27, but ended up the most affected from it, as the consequences reverberated all the way from March to July.
Because XZ didn’t ask the author to write such a fanfic. He didn’t request for it to be taken down. He didn’t ask his fans to report anything. And he didn’t have anything to do with ao3 being banned in the country as a response. From start to finish, he didn’t participate in any of it.
Many of the analysis I’ve watched/read determine that the cause of the problem  were his fans. One of the bloggers even said that “his fans are the ones that have hindered his career the most”.
But, from my point of view, the saying of “two people can’t have an argument if one of them doesn’t want to” also applies here. From start to finish, the issue was filled with overreactions and exaggerated responses from both XZ’s fans and the rest of the people that engaged in this ridiculous fan war with them.

However, let’s keep in mind that “XZ’s fans” is also a huge generalization. Most of the people don’t have the necessary time, resources and mental energy to engage in ridiculous crusades in the name of their favoured celebrity.
Part of the reasoning of the anti-XZ faction is that he should have taken measures and steps to make sure that his fans didn’t cross the line. However, even if the people leading all of this are only a small % of his fans, they are still a lot of people. Being the receiver of their fans’ love and admiration doesn’t make him and his team able to discern who is a reasonable, sensible fan, and who is a crazed troublemaker. And being famous and admired shouldn’t make him the responsible of all of his fans actions (in my opinion). I think this is also how Western society would view the situation.
I was surprised to discover that c-society did expect him to “guide” his fans, because he has a huge influence on them and he’s supposed to guide them towards more civilized behaviour. It’s not of course what everyone thinks, but the stance his studio has taken also points in recognizing that they should have done that (there are more reasons to their stance, of course, explained in the part 5+6).
However, people did realize (I think) that most of the people that follows him gives him support silently. There are of course ardent and fervent people who jump to defend him, but even that kind of behaviour is discouraged by XZ’s studio (applying that ignoring the antis is the greatest way to defeat them).
So here it came the lyrics from WuJi. It’s true that a fraction of his fans have caused him a lot of trouble. But this kind of fans (there is a fine line between very invested and obsessed) are also the ones who push forward a lot of events, who create things like “XZ’s fans Association” and who promote his works the most. His studio did call them out in the end, and said that everyone should relax in their support, but it’s also true that this fans also had a great hand in pushing him to the top of the charts. There’s a very fine line between gain and loss here, so how can one measure the value?
(But the antis who disguise as his fans and create trouble just for the sake of ruining his reputation are a whole other issue. No excuses for them).
Finally, the answers
To answer (I know we*bo and his studio has taken some steps recently but how has this affected public opinion on xz? Has it improved/ are more people favoring him or has it gotten worse?) more exactly:
When we are talking about public opinion, it can actually be divided into 3 factions: his fans, the antis, and the actual general public who is neutral by default.
1. His fans stayed the same, supporting him through the storm. The opinion of the fans isn’t so easily swayed (though he has lost some in this process, he has also gained new followers), and the main feeling they have towards him now can be summarized in 心疼 (”xin teng”, a feeling that, in this case, can be described as “I’m really sorry that all of this has happened to you because I know that you were innocent in this”). I’ll explain a little bit more about his fans support in the last part of the post.
2. The antis can also be divided into 2 groups: “regular” antis and “professional” antis. The 2/27 Great Union community still exists, but it’s a closed off community and to enter it, the new member has to be approved by a moderator. I’ve seen public comments with the 2/27 Great Union tag, that after his interviews have morphed into “I’m a commoner and I hate XZ”, but they are a lot less active these days. Even if they still have hate after everything that happened, the average anti has gone back to their usual life after quarantine was lifted, so it’s less active.
Some of the “regular” antis will stay active, but that’s to be expected. For example, some of WYB’s solo fans were all exploding over the new vlog XZ’s Studio updated three days ago. While it’s ridiculous for the rest of us, these people will continue their “XZ is using WYB to further his own fame” campaign.
However, it’s different with the “professional” anti. As we said in previous posts, people like “B” has a lot of time, energy and resources to invest in a smear campaign against XZ. Where does all of that come from? I don’t know. What I do know is that once XZ’s topic cools down enough and another scandal of another idol, no matter how small, appears, they’ll shift to hate content about the other idol. What matters to them is to produce content that people will engage with, so they get more views and followers, and profit with it.
3. And now, the “neutral-by-default general public”. There is a problem in how we, as netizens, manage the information. In the previous post, I talked about a hater who had written an assessment because “XZ’s fans” had insulted her parents. While the main objective of the document wasn’t to see how the general public views him, I took the data she had extracted.
The general public isn’t so neutral anymore. While it’s true that XZ keeps gaining fans (he’s still riding on CQL’s success train), what general public, the average passerby, has heard from him is:
A XZ fan has stolen a deceased person’s account to keep promoting him
“XZ’s fans” attack a user’s parents on Father’s Day.
A primary school teacher promotes her favourite idol in her class.
These are bound to create a bad image and reputation in people’s mind. We know (I explained all of those incidents in previous posts) that only the teacher incident was truly caused by a XZ fan. There’s no proof that the person who insulted that user’s parents was a XZ fan, and w/ibo has proved that the “stolen” account incident was a scheme from start to finish.
However, the headache in all of those incidents is that the initial issue (“a XZ fan stole a deceased person account to continue to promote him!”) is announced widely and loudly, attracting people’s attention to it. However, people won’t dig up more information. Less than half will actually read the article or investigate more about it. W/ibo actually investigating it and discovering that it was all a plot to frame XZ isn’t given importance, nor does it go on the hot search chart. People only know what happened at first, but don’t know how the story ended. And this is a huge problem for him, because people accuse him but don’t care to know if he was actually the culprit.
(Wow, just like WWX in CQL).
So I found this to describe it.

There are still neutral people: those who couldn’t care less about the tabloids, and that never read gossip sites. These are still a great part of the general public. Anon was asking about the public opinion: the fact is that previously neutral people have only heared bad things about him for half a year, so that’s bound to affect their image of someone they’re not invested in.
If XZ were defeated, and retired, I’m sure a lot of articles like “framing the innocent” would appear. We people just like to have something to talk about.
His fans’ support
XZ ended 2019 with his followers on w/ibo numbering on 21,690,000. The exact number of his w/ibo followers right now is 26,458,877 (26,459,350 two hours later, by the time I’m editing this to post it). He continues to be liked by more people, and antis may try to reduce his popularity, but it’s a fact that his talent and effort are appreciated by people with no hidden agenda. 
XZ is also slowly coming back to work and to his endorsements, which are very good news. We saw him recently in the R/SEONLY add for Chinese Qixi, in the event for Cao Yu’s anniversary, the vlog the studio updated.
Less directly, Kai Xiao Zao, one of the brands that didn’t stop working with him even after 2/27 (they are a smaller brand, and they must have invested a lot in their endorser, so they can’t just put him aside like other bigger brands did), recently put up little stands in malls all over China to promote their new product. In every stand there was a wall for customers to write and a couple of XZ cardboard cutouts.
In his interview in Yunnan, XZ had been seen wearing his red cord bracelet, to ward off bad luck. So fans started to add their own amulets to ward off bad luck and offerings to the cutouts.

And they ended up like this. The funny fact it’s that people started to add plush toys, hats and even food to the cutouts, so based on what “XZ” is wearing one can guess where was the photo taken.
This was a widespread phenomenon in all of KXZ stands. So to say that XZ has lost support from his fans would be certainly false.
His dramas are also expected to be aired soon and have been confirmed to. His patience is paying off little by little, and he’s coming back to work.
The moral of the story
I hope we can all learn something from this. If anything, it has changed my own attitude on the Internet. I used to be very quick to answer with extreme words if I felt strongly about a topic. Now I try to tone down my responses. I’m not saying that you’d all do the same, but it’s a lesson I extract from other people’s experiences. History should serve to avoid mistakes others have committed as much as possible.
In the technology and communications based world we live in, to believe that what we do on Internet doesn’t affect real people’s everyday lives is a huge lie. So, now that we can see that XZ is slowly coming back, let’s all remember that this once happened: let’s all be kind on the internet and avoid engaging with people who dedicate themselves to spread hate.
It has been hard on him. But he’s going to top the snowy summit. Let’s do our best to support him rationally.
