In 1941, World War II was raging. A number of Latin American countries were beginning to sympathize with the Axis Powers. The Roosevelt administration did not want fascist ideology creeping into the western hemisphere. The State Department needed an ambassador to steer South America towards US interests. They needed Walt Disney.

Walt Disney Animation Studios was in a precarious situation in 1941. For starters, Disney Studios made an irreversible pivot towards feature filmmaking. After the success of Snow White and the Seven Dwarfs, the company expanded. The Hyperion Disney Studio had been abandoned for the larger, more lavish, and pricier Burbank Studio. It was a great cost, but one Disney hoped to offset with his next few pictures.

Disney expected up to 75% of his gross revenue to be earned internationally. Because of the war, the European film market had dried up. As a direct result, Pinocchio and Fantasia were financial losses. Disney had spent too much money and was not earning it back.

These financial struggles culminated in the most infamous labor dispute in the company’s history. Layoffs were imminent, and Disney could only promise security to a small fraction of his 1200 employees. This was the tipping point for the Disney Studio staff.

While Disney proved his mettle as a cartoonist and filmmaker, his business savvy was underdeveloped. Disney was running his big company like a little company, not delegating tasks or departmentalizing. There were wild discrepancies in employee pay and benefits. Animators earned anywhere from $12-$300 a week for the same output of work. Disney, unsympathetic to his employee’s complaints, refused to amend his practices. The ensuing Disney Animator’s Strike lasted from May 29 to September 14th, 1941.

As a result of downsizing and retaliatory firings, Disney Studios exited the strike with only 694 employees. A majority of them, rather incensed by the ordeal. Disney needed three things to keep his company afloat. First, enough money to keep production financially stable. Second, a new market to sell his films until Europe became viable again. Third, he needed to recuse himself from duty until animosity subsided. The US Department of State could provide all three.

The deal was simple. Disney would embark on a 10-week goodwill tour to South America, financed by the United States Government. He would visit Argentina, Brazil, Chile, and Peru. Disney would convince the populace, media, and politicians that The United States was an ally worth keeping. For his cooperation, Disney was given federal loan guarantees, staving off bankruptcy.

Disney brought sixteen faithful employees along on the journey. They were a combination of animators, writers, and composers. They were tasked with soaking up the culture, atmosphere, and influence. Disney Studios would use these inspirations to create two films especially for Latin American audiences: Saludos Amigos (1942) and The Three Caballeros (1944).

Saludos Amigos is comprised of four independent segments, each one centered on a different area of South America: The Peruvian highlands, the Chilean Andes, the Argentinian Pampas, and Rio de Janeiro. Between these segments is video footage of Disney and his crew touring the continent. Perhaps to bookend the segments. Perhaps to ground the cartoons in a sense of reality. Perhaps to pad the runtime; Saludos Amigos is only 42 minutes long!

The first segment is titled Lake Titicaca, taking place at the namesake body of water, resting on the Peruvian and Bolivian border. The short features Donald Duck on vacation.

Donald Duck is one of the most popular characters in the Disney pantheon, and this is his feature film debut. He is appearing in a short within a movie, but it still counts as a feature film debut. Donald is a very static character. You know exactly who he is, what he is capable of, and what sort of situations he will find himself in. Some misfortune will befall him, he’ll overreact, and his anger will exacerbate the situation.

How he behaves in Lake Titicaca is exactly how he behaves in every short. Donald plays a tourist vacationing in Peru. He gets altitude sickness. He upsets a llama. His boat sinks and he’s plunged into the lake. The rope bridge he’s walking across falls apart, sending him careening down a gorge. It’s funny, the slapstick is well done, and it is paced well. It is a very typical Donald Duck cartoon.

It is so representative of Donald Duck, it could easily serve as a stand-alone short. It didn’t need to be part of a movie at all. There’s no massive increase in artistic style. No daring adventure in animation techniques. No groundbreaking backgrounds or design. Disney raised the bar for five consecutive films. Now he was lowering it.

In fairness, the artists did depict the Peruvian environment in a vivid manner. It’s a travel advertisement that doesn’t feel like one. The native craftwork, clothing, and culture are on full display, just as intended. 

For the first half of the short, anyway. Partway, the focus drifts away from Donald Duck visiting Peru to Donald Duck’s wacky hijinks with a llama. In short, Lake Titicaca does a decent job of portraying Peru. However, the focus is on Donald Duck first. Peru is simply the backdrop.

The second featurette is Pedro. Pedro is a personified airplane, the baby in a family of personified airplanes. Pedro’s father’s job is carrying the mail between Chile and Argentina. Every day, he flies over the treacherous Andes. One day, Pedro must fill-in for his father. It’s a parable about growing up and accepting responsibility.

The task and the journey is formidable. It’s made all the more complicated by Aconcagua, the tallest mountain in South America. More than an obstacle, Aconcagua is also personified. He is an angry and territorial mountain, with the ability to control the weather. Whenever planes bother him, he creates storms. It makes little sense. Personified airplanes also make little sense. Clearly, we can accept a large quantity of silliness. 

Much like Lake Titicaca, Pedro is enjoyable, but offers little in terms of cinematic grandeur. It’s easy to understand why. Disney and his group returned from South America in October, 1941. Saludos Amigos debuted in August, 1942. Cinematic grandeur was not the goal. A finished product was the goal.

Throughout the rest of the 1940s, Disney would be releasing a series of package films. Shorts, cobbled together without much rhyme or reason, released as a feature. The combination of Disney’s financial woes and reduced staff forced him to dial his filmic aspirations back. For the foreseeable future, his productions needed to be fast, cheap, and accessible. Saludos Amigos was the forefather of these films.

While the cartoon is underwhelming, it’s not necessarily bad. The major problem is, Pedro offers a very poor representation of Chile. Lake Titicaca offered Peru and its environments as a backdrop. Pedro seems determined to ignore its setting. If young Pedro was carrying mail from Denver to Sacramento, and a personified Pike’s Peak was giving him grief, very little would be changed. There is no Chile in this cartoon dedicated to Chile.

Chileans themselves were well aware of this slight. Chilean cartoonist René Ríos “Pepo” Boettiger was especially frustrated. After seeing Saludos Amigos, Pepo created a truly Chilean cartoon character. Condorito, an animated condor, debuted in 1949. Beginning as a simple comic strip, Condorito has been syndicated internationally, featured in his own comic books, been adapted to TV, film, and a webseries. He remains popular in Chile and throughout Latin America. It’s easy to get inspired by art you like. You can also be inspired by art you don’t like.

Next in the program is El Gaucho Goofy. Here, Disney staple Goofy makes his feature film debut. By 1941, Goofy’s schtick was drifting away from narrative-driven comic shorts and towards a parody of instructional videos. Already, he had “instructed” on baseball, skiing, swimming, fishing, and martial arts. These themed shorts would continue all the way to the 1960s.

El Gaucho Goofy aims to teach the differences between an American cowboy and a South American gaucho. Both have the same job, tending to cattle on the open prairie. The short highlights the regional and cultural differences.

A defining aspect of these satirical Goofy shorts, Goofy is at constant odds with an omniscient narrator. Goofy either tries and fails to follow the provided instructions, or follows the instructions too closely, resulting in disaster. The slapstick is one mere aspect of the humor. The remainder is a dissonance between what the narrator deadpans, and what Goofy actually delivers.

El Gaucho Goofy is funny in its own right. What’s more, Goofy is truly representing the life of a gaucho on the Argentinian Pampas. The short is basic, but entertaining, informative and detailed. Another strike against Pedro, outclassed in dignity and competency by Goofy.

The final segment of the film is Aquarela do Brasil (Watercolor of Brazil). Here, Donald Duck is employed once again. Not simply a sightseer in a foreign land, Donald is paired with Jose Carioca, a parrot and enthusiastic Brazilian patriot. Donald’s fiery temper and bad luck are sidelined for a whirlwind travelogue of Rio de Janeiro.

At the time of filming, Rio was the third most populous city in the western hemisphere (it’s currently fifth). It was the clear intention of the filmmakers to highlight the urban metropolis in all its modern glory. A deliberate rebranding of South America as not just farmers and rural villages. South America also houses centers of industry, culture and commerce, on par with New York.

But when featuring Brazil, one has an obligation to depict the country as a whole. The urban splendor must be paired with the natural beauty. The Amazon river basin and the Pantanal are magnificent natural wonders. Their unique ecosystems and indigenous life contribute to Brazil’s evolution as an empire. Even miles outside the city, there are sights to behold.

The Disney animators depict the natural landscapes well. They create a beautiful watercolor wonderland. A disembodied paintbrush swoops in from offscreen, creating the world in real time. We are given a contrast of deep greens, vivid fluorescents, and rich pastels. It’s very post-impressionistic in style and saturation.

When the short introduces Jose, it shifts into an exploration of Rio de Janeiro’s cityscape. Jose shows off trademark Brazilian interests, including nightclubs and a cachaça bar. Here, Donald partakes of his first glass of cachaça (a Brazilian spirit distilled from sugarcane, quite similar to rum). 

Saludos Amigos, not fully intended for children, has no shame depicting Donald Duck drinking hard liquor. For what it’s worth, he doesn’t seem to enjoy it. Not that the drink tastes bad, Donald can’t stomach alcohol at all. It’s a strange thing to both feature alcohol as a cultural highlight to be respected, but also outwardly discouraging the beverage to a percentage of the viewing audience. Such is the problem of using a children’s cartoon character as a cultural ambassador.

The character of Jose Carioca has a lot of personality. Even more when compared to an oddly subdued Donald, serving as an everyman and American analog. Jose is a passionate, excitable motormouth who launches into long monologues in his native Portuguese. He is often oblivious to Donald not understanding. He has much love for his native Brazil, and is quick to share it with everyone. He especially loves music and dance.

So much so, the movie has no choice but to end on a samba number. Like Fantasia before it, Saludos Amigos has no coda, no outro, and no farewell. Just a title card reading “The End.” Combined with its 42-minute runtime, I can imagine many audience members sitting confused in the theater, waiting for the movie to continue.

Saludos Amigos was never intended to be a masterpiece. It was a piece of propaganda and a tax write-off cobbled together in less than nine months. There are individual elements of the movie to be enjoyed, but nothing especially noteworthy. Had it been made by any studio besides Disney, it would be relegated to obscurity. Not that Saludos Amigos is a celebrated entry in the Disney canon.

The story behind the film’s production is more interesting than the movie itself. Walt & El Grupo, a 2008 documentary, fully detailed Disney and his South American tour. It’s clear that The Walt Disney Company, owner of the archival footage and distributor of the final work, had creative control. Details of Disney’s interoffice troubles and financial debts are briefly mentioned, but the film focuses instead on a recreation of his South American tour. The end result is a very dry, unengaging film.

Despite every problem with Saludos Amigos, it did improve American/South American relations during WWII. The Axis powers had tried to influence South America, but by 1944, Latin America fully embargoed both Germany and Italy. Saludos Amigos didn’t achieve much, but it helped stop fascism from conquering the world. How many movies can make that claim?

In the wake of the Disney animators’ strike and the end of the studio’s Golden Age with Bambi (1942), Disney’s industry rivals and the upstart United Productions of America (UPA) stood to benefit from the terminations to come. After seizing control of Fleischer Studios from Max and Dave Fleischer, Paramount set up Famous Studios – against the Fleischers’ sensibilities, Famous Studios doubled down on appealing to children while continuing the Popeye the Sailor and Superman short film series. But Metro-Goldwyn-Mayer (MGM) and Warner Bros., though neither were making animated features, had most to gain from Disney’s misfortune. MGM would pool its resources into self-referential, highly suggestive short films that could never exist under the Disney banner. The works of William Hanna, Joseph Barbera, Fred Quimby, and especially Tex Avery flourished. Under MGM, Barney Bear, Droopy, and Tom and Jerry became part of the American animated canon.

Elsewhere in Burbank, Leon Schlesinger Productions, partnered with Warner Bros., became Disney’s crosstown antithesis. Schlesinger, as arrogant a person as Disney was socially awkward to his employees, harbored no illusions that Merrie Melodies and Looney Tunes could ever compete with the sheer artistry of Disney’s Golden Age features and its Silly Symphonies. Fostering the talents of Chuck Jones, Friz Freleng, Tex Avery (before his defection to MGM), Bob Clampett, and Robert McKimson, Warner Bros. – in a studio as ratty as Disney’s was pristine – operated anarchically. In this culture spawned a style that leans into anything that might make an audience laugh. No matter how outrageous a proposed story’s premise or behavior, Schlesinger would not be one to say “no”*. Take the characteristics of Mickey Mouse and friends and maximize them. As a result, you have the wiseassery of Bugs Bunny and Daffy Duck, the situational ineptness of Porky Pig and Wile E. Coyote, and the dimwittedness of Elmer Fudd. Warners’ films had a disorderly, unrestrained (and sometimes callous) energy that Disney’s animators were on record of being envious towards.‡

Disney’s animators wanted to channel some of this mania into their next two films: Saludos Amigos and The Three Caballeros (1944). Both films are the result of Walt Disney’s 1941 goodwill trip to Brazil, Argentina, Chile, and Peru, organized by the United States Department of State. The United States was concerned that South American nations might sympathize, if not outright ally with, the Axis. Thus, the federal government offered loan guarantees to Disney’s financially struggling studio if Walt would partake on the tour. Walt agreed, with an ulterior motive – he could leave his brother Roy and studio counsel Gunther Lessing to handle the post-strike wave of layoffs. With Norman Ferguson, Wilfred Jackson, Jack Kinney, Hamilton Luske, and Bill Roberts as supervising directors, Saludos Amigos is the first of the Disney “package films”, and the result of vastly conflicting interests. It is an inconsistent film, its comedy overshadowed by the Looney Tunes series, and the first non-masterpiece Disney animated feature after five inspiring triumphs.

Saludos Amigos is barely a feature film, clocking in at forty-two minutes (the Academy of Motion Picture Arts and Sciences, the American Film Institute, and the British Film Institute all define a feature as a film longer than forty minutes). As such, the movie is essentially a selection of four glorified, narratively unrelated short films. Also included is behind-the-scenes footage of Walt Disney’s entourage (“El Grupo”; including Walt, Lee Blair, Mary Blair, Norman Ferguson, and Frank Thomas) to transition between segments. In order, the segments are: “Lake Titicaca” (Peru), “Pedro” (Chile), “El Gaucho Goofy” (Argentina), and “Aquarela do Brasil” (Brazil).

Beginning with “Lake Titicaca” – named after the eponymous lake on the Peruvian-Bolivian border – the film opens with a Donald Duck short. In the years just before Mickey’s appearance as the sorcerer’s apprentice in Fantasia (1940), Donald Duck had briefly overtaken Mickey Mouse in popularity. After the Japanese attack on Pearl Harbor, the studio enlisted Donald Duck to be the center of its World War II propaganda – it would be hard to imagine Mickey Mouse going to war. Donald’s appearance in “Lake Titicaca” is a rare non-propaganda outing for the barely understandable duck. It just so happens to also be a lazy Donald Duck short. The best Donald Duck shorts exploit his infamous temper – gradually. Instead, Donald is subjected to what amounts to a travelogue where his tourist’s mentality occasionally endangers him. Though it may not be the prototypical Donald Duck piece, the segment adds nothing to his characterization. The narrator reveals brief, exotifying factoids that could not have played well to a presumably Latin American audience – something that colors the rest of this film.

Next up is Peru’s Andean neighbor, Chile. “Pedro” follows the daring of the anthropomorphic mail airplane of the same name and packs in a lot of storytelling in just several minutes. Pedro, the child of Papá Plane and Mamá Plane (wait, some will say – planes don’t grow as they age!), is tasked to deliver the mail across the Andes when Papá comes down with a cold. Why doesn’t Mamá Plane fly the mail? “High oil pressure” – but knowing the boys’ club that was the Disney studios of this era, that probably isn’t the real reason. Pedro must brave the turbulence as he ascends over the Andes, and especially as he nears Aconcagua. At 22,837 feet (almost 7,000 meters), Aconcagua is the tallest mountain outside Asia – and with a mountain of that size, it invariably creates its own unpredictable weather.

Flight in the 1940s was still a relatively risky proposition, and “Pedro” captures this during the stormiest sequences that define its closing minutes. As the most inspired moment not associated with “Aquarela do Brasil”, these moments are made possible due to the special effects honed in during previous Disney animated features and a crashing sound mix that sells the danger that Pedro faces. To its credit, this second chapter of Saludos Amigos feels the most like a potential feature film that went unrealized. “Pedro” does not suffer as much from exotified elements in comparison to other segments in Saludos Amigos. But nevertheless, it inspired Chilean cartoonist René Ríos Boettiger (“Pepo”) to create the character Condorito, a comic strip condor whose adventures are read widely across Latin America.

In Argentina, we find “El Gaucho Goofy”. This third part adopts the tone and style of the How to… series (1944’s How to Play Football, 1950’s How to Ride a Horse) featuring Goofy. It might as well be entitled “How to Be a Gaucho”. The omnipresent narrator imparts culturally specific terms and Gaucho equipment that spontaneously appear for Goofy to react to. As always, the narrator is moving too fast for poor Goofy, who can barely keep up. This is hilariously subverted in the scene where Goofy is pursuing a rhea (a distant relative of the ostrich) while on horseback. A fast rewind occurs, and the scene is played back in slow-motion. But it is obvious that the scene has been re-animated in slow-motion and the narrator has also recorded his lines to fit the hilarity on-screen. This is a hysterical touch and a rare (and effective) instance of a mid-century Disney movie breaking out metatextual jokes. “El Gaucho Goofy” also boasts Argentinian artistic input – illustrator/painter Florencio Molina Campos served as consultant for this segment, The Three Caballeros, and Fun and Fancy Free (1947). Campos’ style (muted colors and an emphasis on the Pampas’ skyward horizon) and preferred subject material (life on the Argentinian Pampas for Gauchos and their families) are apparent across “El Gaucho Goofy”. The segment undoubtedly benefits from his influence.

Moving north, the film ends with “Aquarela do Brasil” (“Watercolor of Brazil”). The segment is framed by an extended cover of the song of the same name composed by Ary Barroso and sung by Aloysio Oliveira – the song was popular in Brazil at the time, but Saludos Amigos vaulted the composition to international fame . Easily the most abstract of the four Saludos Amigos chapters, it also adopts a conceit later replicated in Chuck Jones’ Duck Amuck (1953) in which the background, foregrounds, and characters are painted by an artist’s brush onto a previously blank canvas. “Aquarela do Brasil” features Donald, but also marks the debut of the cigar-smoking, samba-dancing parrot, José Carioca. José (pronounced with a hard “J” in Portuguese) is Donald’s fun-loving foil dressed in malandro attire, but this clash of personalities will not be as apparent until The Three Caballeros. Following the interruption of José’s introduction, the film resumes with its splashy, colorful, romanticized abstractions of what life in Rio de Janeiro is like. It is the better and more aesthetically interesting Donald Duck short film when compared to “Lake Titicaca”, if mostly because José Carioca is a scene-stealer.

If the transitions between the descriptions of the four segments in this review feels abrupt, that is because there is little to no transition between the four segments of Saludos Amigos. Each segment is a hard reset after the last, and the supervising directors make no attempt to establish any linkages between them. It results in pacing issues that make “Pedro” – the most narrative-dependent of the four – feel much longer than it is.

When released in the United States, Saludos Amigos surprised American viewers. For many, the film upended their preconceptions of Latin America as a dour, unfashionable, and backwards place. Americans – rarely regarded as being worldly people – who saw Saludos Amigos more positively viewed their southerly neighbors. For Latin American audiences, interest in American culture, already deeply immersed in Hollywood movies, solidified. But for the Latin American governments in power during World War II and after, Saludos Amigos and The Three Caballeros’ intended aims had a muted effect – especially in Argentina, which waffled between the Allies and Axis due to its historic rivalry with Great Britain and its sympathies to Nazi Germany.

With a muted reception, Saludos Amigos begins the package era of films within the Walt Disney animated canon. For the next few years, Walt Disney and his animators would be making mostly propaganda short films for the United States government. These propaganda works helped stabilize the studio’s finances, if nothing more, and reflected Walt’s increasing political conservatism. His turn to the Republican Party for the remainder of his life was not due to long-held political convictions, but the outsize influence of studio counsel (and hardline anti-communist) Gunther Lessing on Walt’s political opinions. Walt Disney’s artistic soul would rarely surface over the next few decades, following the bitter disappointment of how the later Golden Age animated features were treated by audiences and critics. In the meantime, the Walt Disney Studios in Burbank kept their focus on fulfilling government requests for propaganda pieces, and now resembled more of an industrial factory than the happy, extended artistic family Walt had once sought.

Proposition 22 Passes, but Uber and Lyft Are Only Delaying the Inevitable

On Tuesday night, Californians voted to pass Proposition 22, a ballot measure supported by app-based gig companies that exempts them from reclassifying their workers as employees.

Companies including Uber, Lyft, Instacart, Postmates, and more, spent big to convince voters to approve the measure. The company-funded Yes on Proposition 22 campaign spent over $200 million (including millions in donations to the California GOP), deployed a record number of lobbyists, and spread waves of misleading political mailers. At the same time, Uber’s and Lyft’s chief executives undertook a media tour featuring threats to exit the state and repeatedly attempted to exempt themselves in California’s courts. The campaign bought  digital, television, radio, and billboard ads, and also sponsored academic research Meanwhile, delivery drivers were forced to use Yes on Proposition 22-branded packaging while the apps themselves told users to vote yes. 

On the other side of the issue was a grassroots campaign run by driver advocacy groups and organized labor, which spent just over $20 million. 

“We’re disappointed in tonight’s outcome, especially because this campaign’s success is based on lies and fear-mongering. Companies shouldn’t be able to buy elections,” Gig Workers Rising, a California-based driver advocacy group said in a press release early Wednesday morning. “But we’re still dedicated to our cause and ready to continue our fight. Gig work is real work, and gigi workers deserve fair and transparent pay, along with proper labor protections.”

As news of the results broke, Uber CEO Dara Khosrowshahi took to Twitter to show his excitement and shared a tweet from early Uber investor Jason Calacanis calling Assemblywoman Lorena S Gonzalez, the author of AB5, a “grifter” who “failed to hand gig workers over to big-money unions”.

After some time, Khosrowshahi reversed the retweet and instead emailed drivers a more subdued message celebrating that the “future of independent work is more secure because so many drivers like you spoke up and made your voice heard—and voters across the state listened.”

This is undoubtedly a victory for capital over labor, and one that will likely allow the unprofitable gig economy to continue limping along at the expense of workers. It does not, however, change the reality that the “gig” business model is doomed in the long-term.

For years, gig companies have misclassified employees as independent contractors—a legal distinction that has allowed unprofitable enterprises to avoid expensive labor costs such as a minimum wage, health insurance, and safe working conditions, among other benefits of employment. Proposition 22 was cooked up to undo Assembly Bill 5 (AB5), a California law that codified an “ABC test” to determine if a worker was independently contracted or employed by a company and which went into effect in January.

After AB5 went into effect, attorneys for some of California’s largest cities, along with the state’s attorney general, then filed suits demanding an end to app-based gig company worker misclassification. Uber and Lyft have waged the main legal battle, but lost the case and every appeal since, making Proposition 22 a make-or-break measure.

“Prop 22 means I get no workers’ compensation, no disability, no sick pay, it would be touch and go for me,” Mekela Edwards, an Oakland-based Uber driver who hasn’t worked since March because COVID-19 poses a high health risk to her. “I have to ask how long my unemployment will last, how long I’ll have before I’m forced to go back out there and work. I don’t want to imagine it, I can’t imagine being forced to choose between my health and making a living.”

Hundreds of thousands of people work for the gig companies behind Proposition 22 and many have been devastated by the COVID-19 recession. Still, this has not stopped the gig companies from threatening to take drastic measures if they’re not allowed to have their way. Over the past few months, Uber and Lyft in particular have threatened to radically downsize where service is offered, fire most of their drivers, radically restructure into a franchise model, or leave the state entirely, if Proposition 22 fails.

California voting Yes on Prop 22—which includes fine print that any changes to it must be passed with a seven-eighths majority in the state’s legislature—is a huge setback for labor. It will trap hundreds of thousands of workers under a permanent misclassification scheme that rewards a racist business model that disproportionately hurts Black and brown workers. Despite all this, Proposition 22 is not the final say on this matter in the U.S. or internationally.

AB5 clones are being considered in New York and New Jersey, while Massachusetts’ Attorney General has already sued Uber and Lyft to reclassify drivers in the state. Despite objections from Uber’s and Lyft’s impressive lobbying operations, the PRO Act—which would grant gig workers the right to collectively bargain, as part of a massive overhaul of labor law—has passed in the House.

“This is really a story about the kind of cities we are building,” Katie Wells, a researcher at Georgetown University told Motherboard. “The kind of cities—the kind of world we’ve built—it has allowed these entities to come in and build up a workforce through an extractive and predatory system. Regulators have to keep that in mind.”

Outside of the U.S., the global 2019 strike on the day of Uber’s public offering has been followed by successive waves. Over the summer, thousands of delivery workers organized militant strikes and protests in Brazil, Mexico, Chile, Argentina, and Ecuador targeting Uber Eats and other exploitative food delivery apps. These have been joined by even more strikes and protests in Nigeria, France, and India. At the same time, Uber is losing legal challenges in France, Britain, Canada, Italy, where high courts have either outright ruled Uber drivers are employees or have opened the door to lawsuits reclassifying them as such.

Governments across the world are also beginning to push Uber to pay billions in taxes that it has evaded over the past decade. In Britain, Uber will have to pay £1.5 billion ($1.9 billion) in unpaid value-added taxes it avoided by exploiting a legal loophole. In the U.S., Uber has dodged billions in taxes and wage claims through misclassification: in New Jersey it owes over $650 million in taxes, while in California drivers have filed $1.3 billion in wage claims against Uber and Lyft.

Since Uber’s only hope for survival lies in misclassifying workers and labor law, though, it won’t give up the billions to be made both domestically and globally (even if at a loss) without a fight. 

“There’s a lesson here for workers of all sectors, beyond classification: companies are willing to spend massive amounts of money to take away their rights,” said Jerome Gage, a Lyft driver and organizer with Mobile Workers Alliance. “It’s incredibly important for workers to organize to protect themselves, to protect upward mobility, a minimum wage, sick leave, healthcare—to roll back a century of basic protections that try and keep Americans out of poverty.”

Proposition 22’s victory, however, can’t obscure the fact that these companies are doomed. Even with a wage guarantee that effectively pays $5.64 an hour, the companies are no closer to sustainably achieving profitability than they were yesterday. Overcrowded markets for ride-hailing and food delivery, along with vicious price wars and poor unit economics meant there was never any real hope of achieving a monopoly, erecting barriers to market entry, and raising prices to levels that, for many of these companies, would yield their first ever profits. 

There’s good news for investors, however, who will finally begin to see returns on investments that have long been underwater thanks to massively inflated valuations that have tumbled in public markets. Indeed, share prices for Uber and Lyft soared in premarket trading on Wednesday morning. 

For workers, though, things will be bad. It is hard to imagine how hundreds of thousands of workers earning wages just under half of the minimum wage will be able to feed themselves, maintain housing, afford medical care, or otherwise make ends meet, especially under the boot of a pandemic and with no hope of government aid until next year.

Localities, cities, states, and countries will have to begin cooperating if they’re to have any hope of weathering the storm. They’ll need to start being aggressive, experimenting with ways they can outright take over the platforms or prohibit companies from providing the service to begin with—all while figuring out ways to expand mass transit so that not only they’re not only meeting the needs of people who need transportation, both those who worked for app-based ride-hail companies previously.

For the sake of maintaining an illusion that they’ll one day be profitable, gig companies have waged war in California at great expense to their workers, the public, and employees in other industries whose employers may grow emboldened this moment. The fight is far from over, and there is hope for labor in the continuing coordination of driver advocates, regulators, and legislators around the world, but it will get messy as likely to harken a period of unprecedented social unrest among increasingly immiserated gig workers.

“Beyond California, we need to strike early and strike quickly to ensure swift defeat to this idea that you can change the basic nature of employment and deny benefits to your employees,” Gage told Motherboard. “I ask people not involved to try and understand the labor movement in your area. Reach out to unions and ask how you can help volunteers…Get involved with and spread the world—[money] can buy misinformation and it can deceive, but it can’t beat the solidarity between two workers or between human beings.”
