7 Aspiring Lawyers of Color Want You to Pay Attention to the DA Race

No position in America, no single individual has a bigger impact on the criminal justice system ― including police brutality, but the whole crisis of mass incarceration in general ― than your local district attorney.

Lady Justice might hold the scales, but there are surprisingly few checks and balances in our U.S. criminal justice system. While judges have recently been the focus of media attention, another figure in the courtroom wields similarly unchecked power over the impartment of justice, yet we don’t seem to pay her the same attention. One single person has complete authority to decide which crimes are to be prosecuted, what charges will be filed, and whether a child will stand trial as an adult. Likewise, she decides who receives a plea deal. One person can recommend probation over prison and decide whether or not a police officer must answer for his or her crimes. That often-overlooked figure is the District Attorney, and her reach is unparalleled.
No law mandates the DA to pursue certain cases. In fact, there is no clear oversight of the DA’s decisions. The responsibility to limit or oversee a district attorney rests solely upon ALL OF US. Only the voters have the power to hold district attorneys accountable to the highest standards of integrity, fairness, and compassion. In 2002, about 79,000 more residents in San Diego county voted for governor than they did for district attorney, meaning many of us have willingly given up the most important tool to influence our criminal justice system. By emphasizing both the power of our vote and the role of the DA, we take a step forward toward reforming the current justice system.
If you’ve never had a run-in with the law, it may seem easy to ignore to the race for district attorney, but the stakes are too high for young people of color to do so. According to the NAACP, “the United States makes up about 5% of the world’s population and has 21% of the world’s prisoners.” Representing 32% of the population, African Americans and Latinos made up 56% of the prison population in 2015. African American men in particular, are being incarcerated at five time the rate of white men. In a report submitted to the Inter-American Commission on Human Rights, the American Civil Liberties Union writes, “These racial disparities result from disparate treatment of Blacks at every stage of the criminal justice system, including stops and searches, arrests, prosecutions and plea negotiations, trials, and sentencing. Race matters at all phases and aspects of the criminal process, including the quality of representation, the charging phase, and the availability of plea agreements, each of which impact whether juvenile and adult defendants face a potential LWOP sentence.” Further details of the report demonstrate the active role that the district attorney, as the lead prosecutor, plays in creating these disparities:
Racial disparities in sentencing also result in part from prosecutors’ decisions at the initial charging stage, suggesting that racial bias affects the exercise of prosecutorial discretion with respect to certain crimes. One study found that Black defendants face significantly more severe charges than whites, even after controlling for characteristics of the offense, criminal history, defense counsel type, age and education of the offender, and crime rates and economic characteristics of the jurisdiction.
Available data also suggests that there are racial disparities in prosecutors’ exercise of discretion in seeking sentencing enhancements under three-strikes and other habitual offender laws. For instance, a 1995 legal challenge revealed the racially biased role of prosecutorial discretion in the application of Georgia’s two-strikes law. Georgia prosecutors have discretion to decide whether to charge offenders under the state’s two-strikes sentencing scheme, which imposes life imprisonment for a second drug offense. They invoked the law against only 1 percent of white defendants facing a second drug conviction, compared to 16 percent of Black defendants. As a result, 98.4 percent of prisoners serving life sentences under the law were Black. In California, studies similarly show that Blacks are sentenced under the state’s three strikes law at far higher rates than their white counterparts.
The evidence that prosecutors contribute to systematic inequalities in criminal justice is nothing short of damning. It is clear that “equality under the law” is far from reality, and yet, we as voters fail time and time again to exercise our power to bring our country closer to this ideal. When officials are elected by the people, they must conform to the values of the electorate. Right now, we’ve shown our leaders that we are complicit in racial inequality, that we don’t value justice or equality, and that we will continue to elect them despite their racist sentiments and actions. What message will you send with your vote?
Many of us already know the lifelong impact of convictions. This impact compounds itself not only on people of color but on immigrants as well. It is all too common that formerly incarcerated individuals encounter unreturned calls for interviews and are denied public services or assistance and immigration relief. Those convicted of a felony are ineligible to vote in many states, contributing to a cycle of disenfranchisement and recidivism. Only racially diverse prosecutors who respect human rights above all else can remediate this crisis in the penal system. The District Attorney influences the level of prosecution, sways police action, and dictates the sentencing for the person being prosecuted. Therefore, the DA race is inescapably important. No matter where you live, it is in your best interest to be informed of what the DA’s track record has been within your community.
As today’s immigrant population faces attacks from the highest levels of the government, the DA race gives us an opportunity to respond. The DA’s prosecutorial choices can lead to even greater threats of deportation. Such was the case for Roland Sylvain, a Haitian immigrant who faced deportation from the U.S. due to a “aggravated felony” conviction which stemmed from his use of a false name while receiving a speeding ticket. Harsh prosecution practices are part of the current war on the immigrant population and our choice for DA directly impacts the lives of individuals and the integrity of families.
The authors of this piece all reside in Alameda County. For the fiscal year 2017-2018, 17% of Alameda county’s budget went towards incarceration and responding to crime. That number becomes disproportionately high when you compare it to the 1.2% of the county’s budget that went towards prevention services for at-risk youth. We would like to see a significant shift in these statistics. The upcoming election for the District Attorney in Alameda County involves two democratic candidates, Pamela Price and Nancy O’Malley. Pamela Price has been running her campaign as a progressivist as well as a reformist. Her goal is to unseat the incumbent District Attorney Nancy O’Malley by incorporating a humanitarian approach of “justice with compassion.” Incumbent O’Malley runs with support that relies “heavily on police unions, attorneys from all over the bay area,” Governor Jerry Brown, and Senator Kamala Harris. O’Malley has been denounced by the East Bay Citizen, who opined that “Price’s campaign has been boosted by an outpouring of support from progressives in Alameda County, who believe O’Malley is ambivalent toward convicting police officers for wrongdoing.” The election is complex, as many powerful figures endorse O’Malley despite her less progressive appeal. Senator Harris has, according to Rockridge Patch, “formerly worked with O'Malley in the Alameda County District Attorney's Office before becoming a district attorney herself in San Francisco,” which may explain her endorsement of DA O’Malley. However, in addition to the substantial support O’Malley is receiving, Rockridge Patch has also acknowledged that “billionaire George Soros backs challenger Pamela Price.” This endorsement from Soros might level the playing field, giving Price the chance to compete, or weaken her campaign due to public distrust of billionaires and large individual donors.
The election of a District Attorney requires a fundamental evaluation of our values. We must make an informed choice. To be complicit in these races is to ensure the status quo. It is to say that we do not feel empowered to choose who we elect to hold our community and, importantly, our police accountable to the law. To vote can mean so much more. It can voice the pain of millions of American residents, especially those groups most disproportionately entwined in the criminal justice system. It can make clear that we not only expect but we demand that our prosecutors act without bias in choosing which cases to indict, plea deals to offer, and sentences to recommend, that they hold police officers to the highest of ethical standards and stand firm in prosecuting them to the fullest extent of the law when they abuse their authority. We cannot stay silent in underscoring the importance of electing not only a just DA in areas with high concentrations of people of color, but a just DA who has the boldness and courage to ensure that her functionaries are just as well. A vote can demand that no one be above the law and that everyone be treated equally under the law, one county at a time. What are your values? Do you know the values of the District Attorney whose sole discretion determines the direction of justice for your community? Why not?
Juan Martin Cabrales : “As the son of immigrants and a person of color, I care about the DA race because of the influence the office holds over my community. For several years I have worked professionally with numerous immigrants and can attest to fact that families have been torn apart due to low level crimes. A DA who is informed about the severe consequences certain convictions have on an individual’s immigration case is extremely important. Minor crimes such as possession or petty theft can create a catastrophe for a family unit. Our DA should be compassionate towards individuals who clearly do not pose a threat to the community. Furthermore, the DA has the power to sign certifications of cooperation, which are required for an immigrant obtain certain immigration benefits, such as a U Visa for victims of crimes. The DA race is a vital role in the criminal justice system and we should do our parts to be informed on the power they hold and who it will effect.”
Ausjia Perlow : “When I was younger, I always valued fairness above all and was taught that the American justice system did as well, that justice was blind treated everyone fairly. This illusion culminated in my aspirations to practice law. That naivete has since been replaced with a determination to be a changemaker, one who meaningfully brings that system closer to the ideals of equality and fairness that we purport to hold so dear. One of the easiest ways that we can all accomplish this is simply by electing District Attorneys who are also committed to being changemakers. We need more people willing to reject the status quo and to instead to adopt new methods to strive toward these higher aims of fairness, compassion, and justice.”
Gabriela Arroyo : “As a person color I have always felt unrepresented in politics. I also feel that the experiences of people of color are not taken into consideration properly, thus when DAs use their discretion they are not always aware of the impact their decision has on a person who is already at a (structurally) racial disadvantage. Therefore, It is essential to make changes by electing DAs who can relate and understand the communities that they are involved with. DAs should be able to understand the full effect of a cyclical approach, and should hold values that incorporate rehabilitation, reintegration, and community-based programs.”
Kimberly Anne Verzano : “Race, power and privilege are factors that perpetuate the problem of structural inequalities within the American Legal Justice System. As a woman and a first generation Filipino American, I understand and relate to the struggles that people of color face. Minorities are not always at the forefront of power but are more often crushed by those who possess it. Historically, people of color have been exploited for their labor or victimized by the legal system because they cannot afford exceptional legal aid. In the 21st century, police brutality especially in Oakland is a major contributor to social injustice. The police need to be held accountable and the only way we can do this is by electing the right District Attorney [DA]: someone who is aware of the racial inequality within the American Justice System and is willing to be the main advocate for underprivileged communities. Take Oakland, for example, a city of diverse cultural backgrounds, where minorities from impoverished communities have been disproportionately represented. Historically, Oakland’s reputation in incarceration has heavily been focused on specific minorities such as Black and Brown bodies.”
Ashley Lopez Figuera : “I care about the DA race because the District Attorney’s decisions help determine the fate of my Latino and immigrant community. Is it one filled with fear of authority? Or with a sense of safety and tolerance? Can I see people from disadvantaged backgrounds beating the odds and rising to powerful positions? Or wasting their untapped potential in a jail cell? I want my loved ones to have an equal opportunity to live life to the fullest, and I am sure you do too.”

Hideyasu Kurose : “When I was living in South Central, people of color from my neighborhood were arrested, sequestered, and ultimately incarcerated on a moment by moment basis. I recall that many were labeled gang members and profiled as gang members but these hard-working men and women were simply blue-collar workers lacking sufficient funds to pay basic parking fines, car registration, or exorbitant tax assessments. Functionaries of the LA District Attorney would ensure that these hard-working men and women spent the maximum amount of time in prison so that their resolve would be broken prior to their trial. There is no doubt that many among them who had never encountered gang members before, certainly encountered them in LA County jail. Therefore, the rapid apprehension and incarceration of my neighbors by the LA County DA’s office not only promoted prejudice, it fueled gang recruitment by putting hard-working men and women of color in prison side-by-side with established gang members. If poor people could afford bail, then gang exposure awaiting trial would be limited but as the searing op-ed of Kamala Harris and Rand Paul in the NY Times confirms, most poor people of color cannot afford bail.”

The Luxury Market Mid-Pandemic: A Bird’s Eye View
In high-end real estate, life goes on.
A six-acre Southampton compound just a two-hour drive from New York City sold for $57.5 million in April, and Tyler Perry’s old 35,000-square-foot mansion on the banks of Atlanta’s Chattahoochee River sold for $15 million in May.
In less rarified but still pricey destinations, such as Manhattan’s Upper East Side, a $5.5 million co-op stalled mid-transaction amid early pandemic fears but sold at a slightly adjusted price in June. Some Florida mansions that languished for more than 1,200 days on market pre-pandemic are now seeing multiple offers as the wealthy seek spaces large enough to house their multi-generational families.
Diane Hartley, ILHM
“Early in the COVID-19 crisis the affluent, like most people, hit the pause button on real estate, opting essentially to stay safe by staying put,” says Diane Hartley, president of the Institute for Luxury Home Marketing (ILHM).
Hartley notes, however, that the high-end market is a want market, not a need market—after weeks or months of sheltering in place, wish lists began to emerge.

“The pandemic had people at every level spending more time within their walls and re-evaluating, ‘what home means to me,'” says Mike Miedler, president and CEO of Century 21 Real Estate. “As their priorities shifted, the wealthy began to pursue what they wanted—more space, more privacy and more at-home amenities: a home gym, his-and-her offices, a private dock or helipad, even space to homeschool their children if it came to that.”
For high earners with workplace flexibility, there was an instant surge of interest in homes outside crowded urban areas.

“Bedroom communities on trainlines into urban destinations are seeing renewed popularity, especially larger homes with tennis courts and swimming pools, which were previously waning in popularity,” notes Paul Boomsma, president and CEO, Leading Real Estate Companies of the World® (LeadingRE). “In many of the nation’s most desirable destinations, the market today is outperforming last year’s numbers, with second or third home purchases also on the rise.”

“If demand in the upper tier in March and April were at a veritable standstill, May lit a match under it,” says Chris Kelly, president, Ebby Halliday, REALTORS® in Dallas, Texas. “Unlike the last recession, when real estate lost value, affluent consumers today see real estate as the answer to privacy, on-site amenities, a safe place for the family and a stable place to park their cash.”
With inventory low as demand continues to surge, most high-end properties are selling for more than 90 percent of their list price, Kelly says, and multiple offers are becoming more commonplace, especially for homes in move-in condition.
That’s a statistic from the July ILHM report, which shows the inventory level of single-family homes in greater Dallas’ Collin County region in June down by 58 percent—barely changed from May figures. But the number of sales is up 22 percent from a year ago and 60 percent over the prior 30 days.
Leianne Messina, Coldwell Banker
Numbers like these come as no surprise to Atlanta agent Leianne Messina, a top producer with Coldwell Banker Residential Real Estate who specializes in the upscale market.
“The clients I serve are at the top echelons,” Messina says. “They can afford to live wherever they wish and fly private planes where they need to go—and they are flocking to the lake areas of greater Atlanta from states like New York, New Jersey and Florida, where prices for similar properties are much higher.”
Just a weekend ago, she says, she fielded 25 offers on a $1 million-plus property that sold for well over the asking price.
Messina says she is also assisting investors who are flush with cash, or who are taking advantage of rock bottom interest rates to buy tired properties, have them renovated and reap huge profits turning them over to buyers for whom price is not a concern.

“The luxury market is definitely back,” says Lennox Scott, chairman and CEO, John L. Scott Real Estate, serving four Northwest states. “For Seattle homes listed at $1 million and above, where there is a shortage of inventory and surging interest, we are seeing intense activity—perhaps the highest in our history—and we expect that trend to continue as travel restrictions ease and buyers feel safer coming in from other states.”
June figures for the Seattle area, reports ILHM, show inventory levels down by 25 percent, but sales up by 43 percent over the last year and as much as 73 percent over May’s sales.
“Other hot spots are emerging across the nation,” says Hartley. “In Palm Beach, Fla., June sales were up 18 percent over a year ago and 87 percent over May. In the most active price band—between $4.5 million and $5 million—sales might have been higher had there been more available inventory. The same could be said of some areas in Arizona, California and in the wide-open spaces of Idaho and Montana.”

“In many ways,” Pessin says, “the luxury market was better prepared for COVID-19 than other sectors because high-end agents have been using 3D video tours and similar technologies with great success for some time—and the wealthy often depend on long-standing relationships with trusted real estate advisors to guide them toward the properties that best meet their needs without expending a lot of time or energy.
In today’s environment, he notes, when seeking the right property is more of a health concern for wealthy buyers than an economic concern, brokers who have developed such relationships and mastered the art of the virtual sale have been more than ready to meet the challenge.
Bess Freedman, Brown Harris Stevens
“In the New York City market, summer rentals in the Hamptons are always brisk,” says Bess Freedman, chief executive officer, Brown Harris Stevens, which serves the Manhattan, Hamptons, Palm Beach and Miami markets, and recently folded Halstead Real Estate into its ranks. “This year, those summer rentals filled up faster and earlier because of COVID-19, and the competition was super-heated.”
With changing tax strategies that impact the wealthy making it problematic for New Yorkers to change permanent residence, Freedman says, interest has increased in finding the perfect second home within easy reach of the city.
“Not all square footage is created equally,” she says. “Buyers today are looking for privacy and updated luxury in a location that offers peace of mind, and our tech-savvy brokers are using virtual means to help clients find what will suit them.”
Price is often no object, says Freedman, although as sellers who took their homes off the market early in the pandemic slowly come back, most properties are fairly priced.
“Our index confirms that the higher the price point, the slower the turnover,” notes Hartley. “And while changing priorities are fueling interest, a $20 million home is not flying off the market or met with the same buyer frenzy as homes at lower price points.”
The basic principles still apply, she notes, especially in a low-inventory environment: A renovated, well-priced house in a desirable location will sell at close to asking price.
As fall approaches, valid concerns make it difficult to predict the path forward: school re-openings; stock market volatility; new surges of coronavirus cases and/or the emergence of a vaccine; and, not least, the state-by-state patchwork of rules, restrictions, regulations and requirements that make relocating a challenge.
“Many months into this pandemic, we are still trying to get a handle on what the new normal will be like,” says Kelly. “But if present demand is an indication, luxury real estate will see a strong second half and momentum going into the New Year.”

Meet Gwen Osgard of Crawford High School
Today we’d like to introduce you to Gwen Osgard.
So, before we jump into specific questions about the business, why don’t you give us some details about you and your story.
I started working in the San Diego Unified School District as an English teacher 20 years ago. I have taught all high school grade levels and classes from ESL (English as a second language) classes to Advanced Placement classes and it has always been more about the students than the subject matter. I have found great purpose in teaching the immigrant and refugee students of City Heights, the new arrivals.
In 2008, I was fortunate to be a designer and teacher of one of the first (of two) New Arrival Centers in San Diego. For eight years, working with newcomers filled my life with stories from the far reaches of the world; tragic stories of war and loss, but also wonderful stories of human life and love. My kids and their families had been through everything unimaginable, and yet their spirits were intact and their desire for learning was an affirmation of the human spirit.
Crawford High School is the most diverse high school on the West Coast and the New Arrival Center served an amazing mix of students of varied home countries, languages, religions, cultures and customs. The students became a cohort and supported each other through their high school experience. And now, a decade later, I am continuously blessed to see my students graduate from high school, from college and become contributing members of our society.
Overall, has it been relatively smooth? If not, what were some of the struggles along the way?
The Crawford New Arrival Center was an incredibly challenging program to start. At the time, Crawford was divided into four small schools and we, the two teachers in the New Arrival Center, served students from each of the schools. Thus, enrollment, scheduling, taking attendance and assigning grades was awkward, to say the least. Furthermore, when the students were enrolled, most spoke no English at all, thus assessing the students’ skill levels and interest was next to impossible.
Opening the New Arrival Center in 2008 was full of unknowns, trial and error. It was a matter of taking a giant leap and knowing that we would do anything to figure out how to best serve our students. It was an exciting adventure in education and it stretched the hearts and minds of everyone involved. We scrambled for appropriate curriculum, relevant textbooks and lesson plans that met a classroom of students at varying levels of English language acquisition which were interesting to teens. It was a tall order, and it was incredibly gratifying to overcome obstacles and find solutions. Each community connection increased the success of our program. We explored San Diego with our students, took them on many college visits to make them familiar with their next steps, and hosted several interesting visitors, such as Joan Embery and Emmanuel Jal.
When we first opened, the Karen people had only been coming to the United States as refugees for about a year. We had no translators for the Karen language and the Karen Organization had not been formed yet. We had never even heard of Karen people and new practically nothing about Burma (Myanmar). We thought they were “Burmese” and that they spoke Burmese. It took the students acquiring enough English to explain to us why kids would write about Thailand (where they had lived in refugee camps) and that they were not Burmese- in fact, the Karen and other minority groups had been in a Civil War with the Burmese since the 1940’s and had endured torture, murder and the destruction of their homes and farms at the hands of the Burmese soldiers.
We learned that they were so small because they were usually about three years younger than their age on paper due to the fact that the Thai government gave the parents food rations according to the age of their children. In order to get enough rice, the parents would add a few years on to their children’s ages. We learned about other groups as well. We found out that students from Mexico and even from Vietnam may have interrupted formal education as well, even if they were not refugees. We learned about the religions of our students and adjusted our lessons during Ramadan (the Muslim month of fasting) because our kids were fasting and made sure to do our best to follow cultural rules and norms, such as sitting our girls in full hijabs (faces covered and only eyes showing) at all-girl tables and having a girl only room for lunch so that the girls could relax and enjoy their food together.
The kids taught each other about their customs, cultures and religions and formed an amazing cohort that still serves them as adults in college and other areas of life. I see my former students and they are still close with their multicultural friend groups, something that does not usually happen in high school, where students often clique together for safety and comfort rather than try to have a diverse range of friends. I have had students write letters to me telling me that the best thing about the New Arrival Center was learning so much about other people and making friends who turned out not to be so different from themselves.
Crawford High School – what should we know? What do you guys do best? What sets you apart from the competition?
Prior to the creation of the New Arrival Center by Terry Walter, then Director of the Office of Language Acquisition, newcomers (immigrant and refugee students) would take English as a second language (ESL) classes and mainstream classes for the rest of the day. This led to students earning failing grades in their first year or two until they had acquired enough English to study the other subjects. This could be detrimental to their grade point averages and prevent them from ever graduating. The New Arrival Center was designed to give immigrant and refugee students a safe space in which to become proficient in English in one year in order to find success in the classes to follow.
They were comfortable enough to make mistakes because everyone was learning and there was none of the bullyings that is often experienced by international students who do not know how to speak English, dress differently, and lack things that American kids take for granted. It was a semi self-contained set of classrooms in which newcomers had the opportunity to build their English language skills all day while also studying math, science and American history in order to fill in the gaps in education. The majority of the students were SIFE (Students with Interrupted Formal Education) and they needed to study math from kindergarten to the ninth-grade level in order to be successful and to have the background in science and social studies. The students went to PE class, Advisory class and sometimes to art or computer classes. Those who arrived with math skills went to appropriate math classes.
The acquisition of English in preparation for high school classes was the focus of the New Arrival Centers; however, at Crawford High School, our work with the immigrant and refugee students went far beyond classroom instruction. We connected with the local organizations that rescue refugees, such as the International Rescue Committee, the Alliance for African Assistance, Jewish Family Services and Catholic Charities. We connected with the Karen Organization and the East African Cultural Center. My colleagues and I helped our students and their families to go to the doctors and dentists and to access other services that are so difficult to navigate without fluency in English.
Our New Arrival Center became a bustling hub of instruction, student activities and family support. By years two and three of this innovative endeavor, my teacher colleagues and I had developed a system wherein our older students who had mastered enough English and already successful in their high school classes would mentor the even new students to understanding American school culture and the surrounding City Heights community. We created clubs to support our students in extracurricular activities, such as the Karen Youth of San Diego Club (KYSCD), which continues to successfully share the Karen culture and provide support for Karen* students and International College Scholars, a club created to foster a college-going culture for our newcomer students.
I am very proud of the work we did in the New Arrival Center. We had a very high graduation rate, many of our students are in college, are college graduates or have finished other types of training programs and are working members of our community.
Councilmember Marti Emerald presented us with a proclamation on May 16th, 2014, signed by all councilmembers and the mayor declaring May 16th as Crawford High School New Arrival Center Day for the City of San Diego. She presented it to us during our Big Celebration, an end of the year cultural performance in which our students shared their songs and dances from their home countries and student-created skits about their experiences as new arrivals.
Over the years, there were several articles and television reports focused on the New Arrival Center, all positive. In two such stories, NBC’s Rory Devine interviewed me. On the second occasion, I was awarded the Inspiring Teacher of the Month award by NBC and the San Diego County of Education. Directly after that story, the New Arrival Centers were closed.

What are your plans for the future? What are you looking forward to or planning for – any big changes?
Nonetheless, enrollment in charter schools continues to rise as more and more families and educators look for more engaging and personalized educational experiences. Since the closure of the New Arrival Centers, my colleagues and I have been exploring the steps necessary to open a specialized charter school that would encompass our researched support methods and advocacy. In the meantime, my colleague, Skye Cooke-Pinon and I have been working with the University of California San Diego (UCSD), implementing a tutoring program for refugee students with a focus on English language acquisition at the Sudanese Cultural Center.
I continue to be the advisor for the Karen Youth of San Diego Club and the Culture Club, which consists mainly of refugee students from Africa and Syria. I continue to work with the Karen Organization of San Diego and the International Rescue Committee as well as other community organizations. I engage in discussion and work concerning immigrant and refugee students and families whenever possible and consider this to be my life’s work.
