We Need a ‘Small Business First’ COVID-19 Retail Policy
“In the wake of the lockdown restrictions placed on businesses across Toronto and Peel Region this morning, and to ensure fairness in the application of critical services rules, the Canadian Federation of Independent Business (CFIB) is calling on the Government of Ontario to implement a "Small Business First" COVID-19 Retail Policy to help small retailers safely salvage the remainder of the holiday season.”
CFIB recommends that the Government of Ontario:
Allows all non-essential small retailers to open to in-store sales, but with very limited capacity for customers and public-facing staff
Limits customers to three per store for a fixed time for personalized shopping
Limits the store to three public-facing staff to help customers shop as efficiently as possible from a safe distance
Encourages pre-booking appointments, to avoid long lines outside the store
Requires all businesses to sign the POST Promise before opening in-store operations
Still encourages customers to shop by curbside pickup or delivery as preferred means

"This campaign has also showed us that we as a city are not as united as we may have thought. There are many different points of view on how we move forward. And the best part of city council is we get to leave our ideology at the door."
The quote above is drawn from the victory speech of Calgary Mayor Naheed Nenshi who won reelection this week against a serious contender on the right. Nenshi had originally been expected to win handily but the race became closer than anticipated due to a variety of issues including what amounted to an attempt at political blackmail by the owners of the city's hockey team the Flames.
While seemingly mundane and very par for the course as a statement by a liberal, "progressive" or social-democratic politician in this era, its underlying narrative is fascinating and telling.
Nenshi could not possibly have embodied more the bankruptcy and politics of retreat and the constant pandering that aims towards the illusion that a polity can be "united" -- or that this is a worthwhile goal, which it is not -- that is modern "progressivism", liberalism and social democracy if he had tried.
Despite its pretensions at embracing the eschewing of ideology (or, more accurately, because of them) the comment is a deeply ideological one.
We see this kind of 'progressive' rhetoric all the time including from the once socialistic NDP. And it is a rhetoric that is entirely about diminishing the expectations of the workers and the powerless while also supposedly dampening the fears of the powerful and the business class.
Though there are a great many we can point to one need only look a little further north within Alberta to Edmonton to find a recent example of this.
After pulling off one of the great political upsets in Canadian history, the new NDP Premier Rachel Notley began her tenure by on her very first day in office going out of her way to strike an explicitly collaborationist and conciliatory tone with the business community and the energy sector.
"I'm going to be making phone calls today to leaders within the energy industry to begin those conversations. They can count on us to work collaboratively with them. I'm hopeful that over the course of the next two weeks they will come to realize that things are going to be just A-OK over here in Alberta."
Would the NDP government favour unions and workers over capital and big business? Of course not! Hence when "asked about the close relationship the NDP traditionally has with unions, Notley said there will be no fear or favour shown" because "my job is to represent all Albertans". To make sure there could be no misunderstanding she went on to say "there's no question that there's common cause on many issues with union leaders, but there's also common cause on many issues with business leaders. That's the kind of approach I'm going to take with governance."
This kind of quisling tradition within social democracy of reaching out to and wanting the approval and respect of the enemies of the working class and of people living in poverty goes back a very long way. It is deeply ironic that shortly after winning the election Notley also assured the media that "an Alberta NDP government will in no way resemble NDP premier Bob Rae’s controversial regime in Ontario between 1990 and 1995". Ironic given that one of the earliest steps that Rae took in backing away from the mildly radical "An Agenda for People" that he and the party had run on during the 1990 election was to reassure the Ontario business community that they had nothing to fear from him. He began framing his government in ways identical to how Notley would 25 years later. She could have almost been his echo.
As we know, Rae's attempts to court the business community and moderate the NDP's agenda not only did not placate Bay St at all (they waged a relentless and vicious campaign against his government from day one) it alienated his base and the party's supporters. Whatever was accomplished by the Rae government was very quickly undone by the reactionary Harris government in the years after Rae's defeat in 1995. A lesson social democrats, Notley included, either never seem to learn or draw the wrong conclusions from.
This notion of 'progressive' or social democratic governance is an explicit rejection of class politics and of the idea that a 'progressive', labour or left party or government is meant to represent the workers and, yes, to take their side and act in their interests.
To the great cry of "which side are you on" it answers with "both", which is no answer at all. The principle of "evenhandedness" is predicated on a quaint idealization of capitalist "democracy" where workers and their bosses are all parts of society who need to work together for the "common good" and "shared values", etc.
But power, wealth and influence are not at all evenly distributed in our society or economy. A party or politician that says they will seek to represent "everyone" is at best going to aim at a few token reforms that will attempt to "humanize" capitalism while keeping all of the fundamentals and structures of it completely in place. Workers and their bosses do not share "common interests". You cannot be a party of the working class or a party that claims to be on their side and acting in their interests and yet represent "everyone".
At times it is like the so many New Democrats and their supporters who love to share the 'Mouseland' parable that Tommy Douglas made famous have entirely missed its point. It is not going to be a government by and for the mice if it wants to find "common cause" with the cats.
The only way to push an agenda that will seriously combat inequality, poverty, precarious work, exploitation and many other social and economic injustices is to confront the corporate agenda head-on. This means fighting for economic and social policies that are not in the interests of the corporations or business owners at all and it does exactly mean favouring workers and, when they exist, their representatives, organizations and unions. It also means repudiating the neo-liberal ideological hegemony that has existed in North America for over a generation.
Part of the success of this hegemony has been the defeat of working class and socialist ideas and polices to such an extent that even many who call themselves socialists are confused as to what the word means anymore.
Nenshi, of course, neither is nor would ever claim to be a socialist, though he is very popular in the Canadian left. To many in the public and on the left the NDP, however, is still seen as some form of a socialist party -- even if vaguely -- in spite of the fact that the federal party itself has officially discarded the word. On occasion an NDP politician will even describe themselves as a "socialist", though more often it is viewed as a "rusty anchor" that needs discarding as former Manitoba MP Pat Martin so famously opined.
Nowhere was the confusion about socialism's meaning more glaringly proven then during the Bernie Sanders campaign (and he actually did call himself a socialist) in the United States where popular notions of what socialism is and isn't were shown to be hopelessly muddled. Hence we were treated to silly videos and internet memes with nonsense about how "if you are opposed to socialism you are opposed to the post office and public parks", etc., as if anything public or publicly funded is an example of socialism at work.
This was even extended in some cases to trying to portray the army as a socialist institution and to call corporate bailouts socialism in action which is inane.
It is not that the post office, public parks and what have you are not "good things", it is that they have nothing at all to do with working class or socialist models of ownership or society. Socialism loses all meaning and becomes simply a term for radical liberalism unless it continues to have as its aim the overturning of capitalist modes of ownership and government and their replacement by worker ownership and control over both the economy and society.
Cheddi Jagan, who as leader of the Guyanese People's Progressive Party was a great popularizer of socialist ideas in Guyana from the 1950s through to the 90s, wrote of the differences between capitalist and reformist forms of nationalization, as an example, and socialist ones.
He noted that some forms of "nationalization" are not nationalization at all as with the armed forces or NASA in the United States which are publicly run and financed for rather obvious national security reasons but which also serve as a way to funnel vast government funds to big corporations through very lucrative contracts.
This is not socialism.
Further, in capitalist countries when enterprises or sectors of the economy were or are nationalized this is generally done to keep resources out of foreign hands or to provide services such as electricity to corporations and citizens more rationally and more cheaply. The workers of these new state enterprises do not control them and their new boss, the state and its technocrats, are not necessarily a more generous or benevolent employer.
As Jagan once put it:
The stress of socialist nationalisation was on the producer -- to stop the exploitation of the workers; the stress of reformist nationalisation is on the consumer -- to provide a cheaper service.
The difference between a socialist program of nationalization versus a social democratic or liberal desire to nationalize or keep in public hands this or that industry or service consists not solely in the extent of the nationalization but in the very aims and goals of it.
Again as Jagan phrased it:
It is essential not merely to transfer ownership of the means of production (factories, land, machines, tools, etc.) from foreign-private to state, but also to change the relations of production with the aim of making socialist production relations predominant. Economic growth and nationalisation alone do not mean socialism. Although a certain level of economic development is a prerequisite for socialism it is not its content. Socialism is a class and political concept; its essence consists in the socialisation of the basic means of production, distribution and exchange and the establishment of the rule of the working people.
This can be more broadly applied. A genuine socialist program may involve steps, polices and actions under capitalism akin on the surface to those that may be taken in some instances by liberal reformists, social democrats or even right wing statists or nationalists, but its desired destination is fundamentally different.
We can have debates about what methods and means are to be used to get to this destination, but if the social ownership of the basic means of production and the rule of the working class is not the ultimate goal, then the goal is not socialism.
This is not simply an academic point. By denuding "socialism" of its meaning, as was done with term "social democracy" before it, the very idea of an actual alternative to capitalism as a system becomes dimmer. If "socialism" becomes about doing or creating "good things" or standing up for a nebulous variety of causes under capitalism then it is no longer an anti-capitalist idea and there is one less threat to the power of the corporations and the bosses.
If there is no coherent and organized anti-capitalist left, then there is no coherent and organized anti-capitalist left.
Those who seek to diminish or strip ideology of its importance under capitalism are either consciously or unconsciously turning politics into a narrative about who will be the "better", "fairer" or more "just" manager or show "leadership" under a system that is fundamentally unfair and unjust. They have conceded in advance that the economics, class and political structure and society of the future will look fundamentally the same as those of today and the past.
Socialists need to reject this politics of defeat and preserve the socialist vision as one of working class and human emancipation from capitalism. Socialists should always know which side of the class struggle they are on and would do well to build parties and movements that reflect this and will govern accordingly.

WHICH CAME FIRST? CHICKEN OR EGG?
I was researching some of Shakespeare works yesterday looking for a particular item which I never found. However, I did come across a particular word Shakespeare mentioned several times in The Merry Wives of Windsor. “Cuckold.”
Cuckold led to “henpecked.” Henpecked to the eternal question as to which came first: The chicken or the egg?
Lets begin with Shakespeare. Then back in time 10,000 years to something like a chicken. From whence we shall return to answer the eternal question.
Cuckold was a word familiar to the chicken farmers of Shakespeare’s day. When the rooster or cock grew old, the farmers would bring in a younger cock to service the hens. The older cocks were then referred to as cuckolds.
The farmers would cut off a cuckold’s spurs so it could not injure the younger cocks should they fight.
Henpecked is another word that comes down to us from the farmers of Shakespeare’s time. Henpecked meant a man who was dominated by his wife. Still does.
When a cock attempted to mount a hen, the hen pecked at the cock, thus driving him away. Unable to mate with the hen, the cock was said to have been henpecked.
Chickens were native to Asia. Specifically, the jungles of southeast Asia. They were domesticated. Today, valued as one of the most domesticated animals in the world.
Going back 10,000 years ago, chickens were not valued as food. Cockfighting was their forte in Asia and China.
With that background, the question arises as to which came first: The chicken or the egg?
Difficult to answer. As some things are.
Recall Luna Lovegood, the dreamy yet dotty witch from Harry Potter. Lovegood was asked about the riddle, “A circle has no beginning.”
It is impossible to identify the first case of a circular cause or consequence.
A circle has neither beginning nor end.
Determining whether the chicken or egg came first similar in difficulty.
However, the answer has been arrived at.
Long ago, a “chicken like bird” was close in many respects to a “chicken,” but not a chicken yet. That “first almost chicken” has became known as a “proto-chicken.”
A proto-chicken laid an egg. The “proto-rooster” fertilized it.
One of the fertilizations resulted in a freak of nature. The genes from the ma and pa “almost chickens” fused. They combined in a new way. Created a mutation that accidentally made the baby different from its parents.
The mutation was not noticed initially. Took one hundred years for the difference to be noted. The egg difference sufficient after a century for the noticeability to become the official progenitor of a new species. The “chicken.”
The simplified answer to the eternal question: Two birds that weren’t really chickens created a chicken egg. Ergo, the egg came first following which it hatched a chicken.
Coronavirus is affecting many persons and businesses economically.
Businesswise, the hospitals are taking a beating. Surprisingly since they are full of coronavirus patients. Most of whom however never had or have lost their medical insurance.
Rural hospitals are taking the biggest beating. It is expected the big city ones will follow.
The rural hospitals have and are continuing to go under for 3 reasons. They have been forced to cancel elective procedures which are the most profitable for a hospital. Delay in reimbursement killing them. Finally and perhaps difficult to believe, dwindling patient volumes.
Thus far this year, 42 hospitals have closed. Twenty nine of which have already filed for bankruptcy.
Recall Benghazi? The very people outraged for 8 years because of 4 dead people in Benghazi are now telling us that 100,000 plus deaths due to Trump’s negligence is acceptable.
Jimmy Carter is 92. The former President still active. His way of life the past several years helping to build homes for Habitat for Humanity. Wife Rosalyn working by his side.
Last week, Carter was working in constructing a new home in Edmonton, Canada. He passed out. Dehydrated. Rushed to a hospital where he spent a few days. All is well now.
Carter has been out of office more than 30 years. Still active in helping others.
As I mentioned in yesterday’s blog, he is America’s best post-President.

Came across a Tumblr comment this morning that must be one of the circumstances to be considered in arriving at a determination as to whether reopen schools: “A parent knowingly dropped off their Covid positive child at day care because they had to work.”
Someone responded: “If you all don’t think this will be the case when schools open, you’re smoking crack rock.”
The Keys and Monroe County Commission should stop screwing around! Put the barricades back up at the entrance to U.S. 1 to the Florida Keys.
We don’t want Miami-Dade and Broward Counties’ Covid-19 bug out of control here!
An interesting comment in this morning’s Key West Citizen Citizens’ Voice: “Temporary inconveniences placed on personal freedoms to save lives and eradicate a disease is temporary at best. Death, on the other hand, is eternal.”

My Top Energy Stock Pick for 2020 Hasn’t Missed a Dividend in 118 Years:
The last few years have not been good for energy investors.
The sector hasn’t seen carnage this bad since the 1980s. Previously rock-solid oil and natural gas producers first saw their share prices decline, and then dividends were cut. Some of the weaker names eventually succumbed to bankruptcy, while even some of the stronger names are currently fighting for their lives.
Amid all this chaos, who would even want to invest in the energy sector, anyway?
But today is the perfect time to start nibbling. The sector is so destroyed that even small pieces of good news can have a big impact on the underlying share price. This is the time where fortunes are made, not when the consensus is bullish.
Let’s take a closer look at my top energy pick for 2020, a stable name that should provide plenty of downside protection while investors wait for the energy market to recover.
Go for the best
Many investors are drawn by the seemingly attractive risk/reward ratio of the most depressed names in the energy sector. They like the 300% to 500% upside potential, and are perfectly willing to accept 100% downside risk for that return profile.
There’s just one problem. If one stock has a one-in-ten chance of returning 500% and a nine-in-ten chance of going to zero, that’s a money-losing proposition over the long-run. You’d have to get awfully lucky to do well.
Instead, I advocate investors look at the finest stocks they can find in the sector. And you won’t do much better than Imperial Oil (TSX:IMO)(NYSE:IMO) and it’s grade-A balance sheet.
First, let’s talk about Imperial Oil’s production. The company produces some 400,000 barrels of oil each day, with the majority of that coming from three large oil sands developments. It also has conventional oil assets in the Motney and Duvernay fields close to Grande Prairie.
One of the things I really like about Imperial’s oil sands assets is you know what you’re getting. They have such a long reserve life there’s zero risk of having to continually acquire new acreage. These assets should continue producing at their current rate for decades.
It also hopes to expand in the region, with various developments in various stages of planning. Aspen, which is the project slated to begin production first, will add 75,000 barrels of oil to current production when it comes online.
Downstream operations
While I like Imperial’s oil sands operations, profits from oil production are largely dependent on the price of crude. Investors need the market to cooperate for that part of the business to really skyrocket.
The downstream operations are different. They produce steady cash flow no matter what the underlying price of crude does.
Imperial’s main downstream assets are three refineries, located in Edmonton, Sarnia, and Nanticoke. Together, these refineries have production capability of more than 400,000 barrels of oil per day, or all of Imperial’s production. Fuel produced by these refineries are then delivered to more than 2,000 Esso, Mobil, and other service stations across Canada.
These downstream operations – which also include jet fuel and asphalt production – generated nearly $3 billion in cash from operations in 2018, and should post similar numbers in 2019. That’s easily enough to cover the company’s dividend.
Get paid to wait
There aren’t many energy dividends left on the TSX, and most of the remaining ones look to be pretty shaky.
Imperial Oil is a notable exception.
The current payout is $0.22 per share on a quarterly basis, a dividend that has been increased for each of the last 25 years. That’s a pretty impressive start.
In fact, Imperial has paid a dividend each year since 1891. That’s before Standard Oil – which eventually became Exxon – took a big investment in the company in 1898, a stake that continues to this day.
After years of paying a dividend in the 1% – or even lower – range, recent weakness in the share price has helped prop up the dividend. The current yield is 2.6%.

The last few years have not been good for energy investors.
The sector hasn’t seen carnage this bad since the 1980s. Previously rock-solid oil and natural gas producers first saw their share prices decline, and then dividends were cut. Some of the weaker names eventually succumbed to bankruptcy, while even some of the stronger names are currently fighting for their lives.
Amid all this chaos, who would even want to invest in the energy sector, anyway?
But today is the perfect time to start nibbling. The sector is so destroyed that even small pieces of good news can have a big impact on the underlying share price. This is the time where fortunes are made, not when the consensus is bullish.
Let’s take a closer look at my top energy pick for 2020, a stable name that should provide plenty of downside protection while investors wait for the energy market to recover.
Go for the best
Many investors are drawn by the seemingly attractive risk/reward ratio of the most depressed names in the energy sector. They like the 300% to 500% upside potential, and are perfectly willing to accept 100% downside risk for that return profile.
There’s just one problem. If one stock has a one-in-ten chance of returning 500% and a nine-in-ten chance of going to zero, that’s a money-losing proposition over the long-run. You’d have to get awfully lucky to do well.
Instead, I advocate investors look at the finest stocks they can find in the sector. And you won’t do much better than Imperial Oil (TSX:IMO)(NYSE:IMO) and it’s grade-A balance sheet.
First, let’s talk about Imperial Oil’s production. The company produces some 400,000 barrels of oil each day, with the majority of that coming from three large oil sands developments. It also has conventional oil assets in the Motney and Duvernay fields close to Grande Prairie.
One of the things I really like about Imperial’s oil sands assets is you know what you’re getting. They have such a long reserve life there’s zero risk of having to continually acquire new acreage. These assets should continue producing at their current rate for decades.
It also hopes to expand in the region, with various developments in various stages of planning. Aspen, which is the project slated to begin production first, will add 75,000 barrels of oil to current production when it comes online.
Downstream operations
While I like Imperial’s oil sands operations, profits from oil production are largely dependent on the price of crude. Investors need the market to cooperate for that part of the business to really skyrocket.
The downstream operations are different. They produce steady cash flow no matter what the underlying price of crude does.
Imperial’s main downstream assets are three refineries, located in Edmonton, Sarnia, and Nanticoke. Together, these refineries have production capability of more than 400,000 barrels of oil per day, or all of Imperial’s production. Fuel produced by these refineries are then delivered to more than 2,000 Esso, Mobil, and other service stations across Canada.
These downstream operations – which also include jet fuel and asphalt production – generated nearly $3 billion in cash from operations in 2018, and should post similar numbers in 2019. That’s easily enough to cover the company’s dividend.
Get paid to wait
There aren’t many energy dividends left on the TSX, and most of the remaining ones look to be pretty shaky.
Imperial Oil is a notable exception.
The current payout is $0.22 per share on a quarterly basis, a dividend that has been increased for each of the last 25 years. That’s a pretty impressive start.
In fact, Imperial has paid a dividend each year since 1891. That’s before Standard Oil – which eventually became Exxon – took a big investment in the company in 1898, a stake that continues to this day.
After years of paying a dividend in the 1% – or even lower – range, recent weakness in the share price has helped prop up the dividend. The current yield is 2.6%.
And remember, investors don’t have to worry about the payout. The downstream operations easily generate enough cash flow to cover the entire dividend. Excess cash can be funneled to the share buyback program, which has repurchased some 100 million shares over the last three years.

Clear usually helps people speed past the TSA line. Now it’s offering a Covid-19 screening service.

Now that airports are emptier than they’ve ever been, the air travel security platform Clear is adapting its technology for new pandemic-centric purposes. On Thursday, the NHL announced that it would be using the tech to screen players and staff during the playoffs, and earlier this month, the employees of the 9/11 Memorial & Museum started using the screening platform to allow staff back onsite. The new moves are a sign that Clear wants to use its tech to get people back to work �� and back to big events.
The basic premise is that regular screenings using a new Clear service called Health Pass can keep people who might have Covid-19 out of high-traffic spaces. Basically, its approach involves using new systems that can quickly identify whether someone might have Covid-19. Right now, that process could include a daily health quiz, temperature scans, and linking users to their lab results — while also confirming their identity through biometrics, which can include iris and fingerprint scans as well as facial recognition. The concept has already drawn skepticism from public health and privacy experts.
This new line of business represents a pivot for Clear, which is best known as the company that offers paid memberships to bypass airport security lines. While everyone else is stuck in the slow line waiting to speak to a TSA agent to check their travel documents and confirm their identity, Clear members can bypass the line and speed straight to the baggage screening. That’s because in addition to paying Clear’s membership fee, customers have volunteered more of their personal information, mainly their biometric data, to help airport security quickly confirm their identity at the airport. Importantly, while Clear’s technology has been certified by the Department of Homeland Security, it is not the same as the Transportation Security Administration’s (TSA) Pre-Check. However, as Clear is quick to point out on its website, fliers can purchase both.
Clear isn’t the only company pushing futuristic, sometimes questionable technology meant to help us return to some sense of normal. Universities have urged students to promise that they’ll download health screening apps. Facial recognition technology companies have pushed versions of their tech that, for instance, incorporate “fever-detection.” Some have even floated artificial intelligence-enabled cameras that can measure how well people are social distancing.
But Clear stands out as an established brand that’s become a familiar sight at airport security checkpoints and already has quite a few customers. The company claims that it has confirmed identities more than 50 million times since it relaunched in 2010. At that time, Clear had been acquired out of bankruptcy but was already operating in at least 16 airports. Now, Clear technology is used in more than 50 airports, as well as other large venues including sports stadiums like the AT&T Center in San Antonio and the American Airlines Arena in Miami.
While the venue expansion started a few years ago, Clear announced its Health Pass program in May and now has its sights set on a number of new partners, including restaurants. Clear Health Pass is being used to screen food service employees — keeping potentially sick people from returning to shared work areas — through partnerships with the restaurant group that runs the salad chain Chopt and the taco restaurant Dos Toros, through which Clear is currently running pilots at two locations. Clear’s health screening tech is also being used by the 450 staff members of the 9/11 Memorial & Museum, which is currently using the platform’s health quiz.
The company’s new partnership with the NHL will mean its Health Pass system will be used to coordinate this season’s playoffs in Edmonton and Toronto, Canada. According to the company, the system will help track about 3,000 people who are involved, including players, coaches, and support staff. In total, 24 teams, including the Pittsburgh Penguins and the Chicago Blackhawks, are expected to play. Their announcement comes as other organizations, like the NBA, and large venues, like Disney World, turn to other health safety initiatives in an effort to restart their activities.
In the case of the NHL, the idea isn’t just to do screenings but to create closed mini-ecosystems of secured areas. In each city where there are games, there will be at least 30 physical access points that are managed with kiosks that will take temperatures. After registering their identity within Clear’s biometric system, those involved in the playoffs will be expected to fill out a regular health survey after leaving hotel rooms, take a selfie with their phone to confirm their identity, and then use a QR code to register their information at the kiosk and have their temperature taken.
While the company’s current offering seems more limited to health quizzes and temperature checks, Clear appears to be setting the groundwork for including more detailed medical information in its screening process down the line. On its website, the company advertises that the “possibilities are endless,” and hints that “vaccine status” could one day be incorporated, seemingly echoing contentious proposals for immunity passports that the World Health Organization has warned against.
Unsurprisingly, privacy advocates are skeptical of the new Clear Health Pass, which they argue doesn't really solve the problem of keeping an area free of infectious people. If anything, they say, the service introduces a host of privacy concerns. They worry that deploying this Health Pass in a wide range of venues could facilitate unwanted surveillance and become a ubiquitous part of life.
“Forcing someone to upload extensive medical information to a privately run centralized database that’s then going to decide whether or not they can enter public accommodations or potentially go to work or find a plane, that’s really a nightmare scenario,” John Davisson, an attorney at the Electronic Privacy Information Center, told Recode.
Kenneth Goodman, the director of the University of Miami’s Institute for Bioethics and Health Policy warns that a program like Clear’s Health Pass could become a form of “security theater.”
“What exactly is any company going to do to ensure that people who get through security, come to the party, get on the plane, go to the restaurant, are actually free of the virus?” Goodman said. “The idea that fever detection or a quiz — which of course you could lie to — is going to improve our safety on the streets or at airports or stadiums or anywhere else is so far not particularly based on solid, peer-reviewed evidence.”
Albert Fox Cahn, the executive director of the Surveillance Technology Oversight Project, called Health Pass an “absolutely horrifying product.” He points out that Clear’s ultimate goal seems to be based on the assumption that people have access to regular testing, which is a questionable premise in the United States. Also, public health experts still don’t have a full understanding of how Covid-19 immunity works or how antibody tests should be factored into the equation.
“After 9/11, we passed emergency surveillance powers, and we were told, ‘don’t worry, they’re going to go away in a few years,’” Fox Cahn told Recode. “As of this year, we’re still debating whether to renew them. We have to assume that any surveillance infrastructure we build to respond to this crisis will become a permanent facet of American life.”
Lawmakers are also worried about what Clear’s doing. In May, Sens. Jeff Merkley and Cory Booker, who have called for regulating facial recognition, sent a letter to Clear demanding more information on its pandemic-related business plans, pointing to the Health Pass in particular. The senators specifically warned that “facial recognition technology risks a state of undetectable, constant government surveillance that can track one’s movements and associations with organizations such as schools and places of worship.” They also expressed concern about algorithmic bias, which could make Clear inaccessible to some users.
In a June reply to the letter from Sens. Merkley and Booker, Clear chief executive Caryn Seidman-Becker wrote, “We do not conduct passive monitoring and we do not collect images of non-members.” She also emphasized the opt-in nature of Clear’s system as well as the company’s commitment to security. With regard to Health Pass, she said “biometric data is not shared with employers or venues, and our biometric tools are not themselves used as diagnostic tools.” Seidman-Becker also said that her company considers “racial and gender equitability” when choosing their facial recognition algorithms, which Clear purchases from third-party providers.
A Clear spokesperson told Recode that police and governmental agencies can’t access the data it oversees and that Clear would not share personal information about its members.
At the same time, Clear seems to be eager to become the technology platform that allows places to reopen, both for the short and long haul. Despite the concerns of privacy advocates who doubt the service’s utility and privacy protections, the new Health Pass system is winning big clients, like the NHL. And as the pressure to return to normal life continues, who knows where you might run into Clear technology next.
