COVID-19 protocol:
Masks are required inside the venue at all times for attendees, regardless of vaccination status except while eating and drinking. This DOES NOT mean you don’t need to wear a mask if you have a drink in your hand. IF YOU REFUSE TO WEAR A MASK YOU WILL BE REMOVED FROM THE SHOW WITHOUT A REFUND. IT’S YOUR CHOICE.

Proof of vaccination can be your physical vaccine card, a photo of your card, or your digital vaccination record using the Bindle app.
****A NEGATIVE TEST WILL NOT BE ACCEPTED*****
Also, bring appropriate ID matching the name on your COVID-19 vaccination document.
Children under 12 who are not yet fully vaccinated, and those with documented qualifying medical conditions preventing them from becoming vaccinated:
a negative COVID-19 PCR or antigen laboratory test taken within 48 hours of the show date will be accepted
along with documentation of medical exemption
matching photo ID
At-home self-tests will not be accepted.
You will NOT be allowed into Louis’ show without proof of vaccination OR proof of negative COVID-19 test (for those under 12). Yes, even if you have a ticket.

General admission (GA pit tickets):
Fans can START to line up after 6AM on the day of the show
Overnight camping will not be allowed.
In most cases they do not do a wristband system, however security could always decide to do that if the call is made that it would be better for line management to do so.
Every location in the venue has a great view, so you don’t need to line up extra early.

Photo and recording policies are at the acts’ discretion and change night to night. You may bring your camera with the understanding that you will likely need to check it for the duration of the show. There is a charge to store items at Coat Check.
Outside food and beverage are not allowed.
Coolers, beverages (in any type of container) are not allowed.
Weapons/chains, Mace or pepper spray are not allowed.
Balloons are NOT allowed
Toys, stuffed animals are NOT allowed
Drugs or drug paraphernalia, including marijuana are not allowed.

Number 28 out of the angst prompt list, but with my own little tiny twist: "Billions of people in the world, and you chose me, how stupid was that" (for VergiLeon)
("Billions of people in the world, and you chose me, how stupid was that" (for VergiLeon) Ohhh possible angst! Or maybe...Nero’s first real Halloween and he isn’t aware of his Mama and Papa’s bickering...or is Vergil really there at all?
Also, sorry for the late Halloween piece! And late piece in General! With the holidays around the corner, and work picking up, I've been busy. And the uncertainty of another lockdown has Me mentally exhausted, but I'm sure everyone else is as well.)
“Mama, look how much candy I got tonight!” Nero exclaimed as he dumped his candy out onto the living room floor.
“I know! Cousin Sherry and Aunt Claire and Uncle Chris know all the best Candy Spots!” Leon chuckled.
Leon sat down on the floor and helped Nero sort through his candy. The little boy had dressed up as a dragon, saying that he wanted to be “scary but cool” in hopes to get a lot of candy. Leon went with the logic and him, Chris and Claire had looked all over the place for a costume. Jill ended up being the one who found the perfect one for Nero, and thus, had been the one to help Nero get a lot of candy.
At least that’s what Leon told Nero, who now loved his “Aunt Jilly Bean”.
Currently, they had just gotten home after a long night of Trick or Treating around Washington DC. Leon would occasionally glance up at Chris, who was in the process of setting up the DVD player so they could watch “It’s the Great Pumpkin, Charlie Brown”. Chris cursed as he accidentally poked himself with a thumbtack that had fallen back behind the entertainment center. Leon chuckled as Nero scolded Chris for swearing, Chris laughing as well and apologizing to the four year-old. Leon shook his head, looking up at the man sitting on the couch, reading his book.
The Omega did a double-take once he realized who it was sitting there, “...Vergil?”
“Hm?” Chris hummed as he peered over at Leon, “You say something?”
Leon looked between the two, “Do you...can you…?”
“He can’t.” Vergil merely replied for Chris, not looking up from his book.
“Can I what?” Chris asked, “What’s up?”
Leon was confused for a second, looking down at Nero’s devil arm. It didn’t glow like it would when trouble was nearby...or like that one time when Vergil came to say goodbye...so...what was Leon seeing here?
“It’s, uh...it’s nothing.” Leon lied, eyes looking to where Vergil clearly was sitting but evidently, Chris didn’t see him.
“Oh, alright.” Chris replied with a shrug as he went back to setting up the DVD player, “Are you okay, Le?”
Leon nodded and lied as he gave a smile of reassurance, looking back up at the now empty couch. Leon released a breath that he hadn’t even realized he had been holding. Maybe he was a bit tired from walking around all night? Maybe that was it? Although Halloween was known for its odd supernatural occurrences...and recently, although still a bit of a skeptic, Leon did believe in superstition and luck, maybe this was Vergil sending him a sign? Maybe…?
“Got it!” Chris cheered victoriously, Nero cheering as well, “Charlie Brown is a go!”
Leon shook his head with a laugh, “Alrighty then. I’ll go make some popcorn.”
“And juice?” Nero asked, “Please?”
“And juice.” Leon said, ruffling Nero’s hair before standing up to head into the kitchen, “Maybe Uncle Chris can help you sort out the rest of your candy?”
“As long as he doesn’t eat all the Hersy Bars!”
“Darn!” Chris snapped his fingers once he got the DVD going, kneeling down next to the little boy and proceeding to sort his candy.
Leon couldn't help but smile at the sight, watching a minute longer than necessary before going about retrieving the popcorn and drinks for their movie. Once he rounded the corner, the Omega jumped at the sight of Vergil standing in the middle of the kitchen. Leon did a double take from the position that the man had been in before to where he currently stood in the kitchen. Leon swallowed down a lump forming in his throat, looking over the...well, he didn't even know what this was supposed to be.
"Interesting choice of mate, Little Mouse." Vergil observed before turning his full attention to the Omega, "But, I don't think he would be good enough for you or Nero, if I'm being completely honest."
Leon blinked at that, "...What?"
"He's a mere human. You deserve someone stronger, more powerful to protect you and our son."
"You don't think he and I can protect Nero?" Leon asked, "Not that you're really here anyway...but I can take careful of myself and Nero. I'm not weak and helpless. And if something happens, Chris is here too."
"But he's a mere human." Vergil repeated, "You are enhanced with the Yamato. He is not. If a demon attacks…"
"We'll handle it." Leon emphasized.
Vergil, or whatever this was supposed to be, was quiet for a moment, looking Leon over with a look of skepticism before looking back out at Chris with the same look.
"I am unsure of him still." Vergil admitted, "You...are not like the other humans. That is why I chose you."
Leon laughed aloud at that, not caring if Chris and Nero heard, "How? Billions of people in the world, and you chose me. The guy with the worst luck. How stupid was that?" He chuckled with a shake of the head, "Why? I'm like everyone else."
"You are wrong." Vergil said, "You are not like the other humans I have met. You are untouched by Greed and selfishness. You give and protect. You sacrifice your own safety for the sake of others. You could have fled Raccoon City and left Claire, Sherry and that Ada woman to die...and even the others...but you didn't."
Leon listened as Vergil continued on, saying that most humans would have fled and not stayed to help the other survivors. At least, that was what occurred with most humans he had encountered. Leon also was not interested in obtaining power of any kind, choosing to survive and fight via his own will for survival and skill. Most humans Vergil had dealt with personally chose to strike deals with devils such as himself in hopes to obtain immortality or power beyond their wildest dreams.
"Yeah, but I struck a deal with you and got the Yamato." Leon pointed out.
Vergil shook his head, "Our deal was to help your friends and the other survivors. Not conquer the rest of humanity. Yamato chose you in Raccoon City. Therefore, I bestowed the Yamato onto you so you could hide it and use it to keep our son and others safe. Yamato simultaneously protected and prolonged your life in your battles."
Vergil explained that, although he himself had abused its powers, Yamato didn't work for just anyone. It was a reflection of his father and his power. Much like Mjolner in Norse Mythology, Yamato only worked for those worthy enough to wield it.
"And that is you." Vergil finished, "Which is why you need someone to protect not just Nero, but you. If you fall to an enemy and into the wrong hands, so too does the Yamato."
Leon turned to look at him, looking deeply into his eyes, "I know...that's why I try not to use it. I already had one too close for comfort calls with those guys from "The Order" or whatever. I also hide Nero as much as I can, my boss even has a private school Nero can go to when he's old enough. I think Chris can help us because he's got ties to the UN. He can go places I can't and get us out of here in a pinch." Leon stopped as he remembered one tiny detail, "The only thing is…"
"If you leave, so does Sherry Birkin's safety." Vergil finished for him, "And that's why you're still here and not in hiding."
Leon nodded, "I can't just abandon her…"
"And what of Chris and his ties?"
"The organization he's working for are looking into loopholes and researching how to get her and I out of this hellish contract." Leon explained, "I struck a deal with a different kind of devil to keep her and Nero safe."
"The only downside to being selfless." Vergil mused, "Is that you fall into the serpent's pit without a rope or a ladder."
"...Yeah." Leon agreed, scratching the back of his neck.
"You can always kill them."
"What? No!" Leon protested, "I can't kill anyone in the US Government! Then we'll really be in trouble!"

Accessibility of Metro and bus lines:
All metro stations have escalators and elevators. You can sign up for the ELstat alert system to get live updates when elevators are out of service. Metro stations have bumpy tiles near platforms, flashing lights when trains arrive, and have audio and visual display systems that show announcements.
Metro cars do not have a gap between the platform and car, and there is priority seating, as well as wheelchair securement spaces on all cars.
for buses, all buses are kneeling buses that have lifts or ramps. There is priority seating, and most buses have both a visual and audio display.
for public restrooms on the day of the march, all Smithsonians are free to enter and have public restrooms, including ADA accessible restrooms, but you might have to walk through a metal detector or get your bag searched to enter. Another close public restroom is the Eisenhower Memorial, which has public restrooms around the back of the building that are available from the outside.
There are many different police forces in DC, and depending on what area you're protesting on in DC, and whether or not federal police forces have jurisdiction, there might be many different agencies who have different procedures they follow. Keep an eye out for police, what uniforms they're wearing, and ask people local to DC for help identifying what cops are in the area. Here's a link with some basic info on the most frequently present cops. Here's some resources from the DC NLG about your rights and what to expect from police response, what happens if you get arrested, etc. Also check out the principles to DC organizing created by Washington Peace Center and DC BLM, especially if you have never protested in DC before and are not familiar with local activist work!

Looking To Travel In The US? Here Are The Travel Restrictions By State
(CBS13/CNN) — With the Covid-19 pandemic in near-constant fluctuation in the United States, the 50 states are having to adapt rapidly with their rules and regulations.
If you’re planning a family vacation or simply wish to travel from California to another state, it is important to be updated on the latest statewide regulations. While some US states — like California — have no statewide restrictions on travel, all their sites have important Covid-19 safety information, including possible face mask mandates in public settings.
This list is alphabetical and includes links where you should get more information and updates before you head out:
Alabama
As of October 11, there were no statewide travel restrictions in Alabama. However, visitors should be aware of the state’s mask mandate and other rules effective through November 8. You can check here for updates.
Alaska
Alaska’s latest travel protocols have been in effect since August 11. Visitors from other states must do one of the following:
— Submit a travel declaration and self-isolation plan online and arrive with proof of a negative Covid-19 test.
— Follow a plan that your employer filed with the state if you come for work.
— Buy a $250 Covid-19 test when you arrive and self-quarantine at your own expense until you get the results.
Alaska residents also have protocols they must follow for travel.
According to the CDC, “people in quarantine should stay home, separate themselves from others, monitor their health, and follow directions from their state or local health department.” Leaving your home state to enter a state with a mandatory quarantine means you need one place to stay and to stay put. Arizona
As of October 11, there were no statewide travel restrictions in Arizona. Check here for updates.
Arkansas
As of October 11, there were no statewide travel restrictions in Arkansas. Check here for updates.
California
As of October 11, there were no statewide travel restrictions in California. However, you should also check the status for wildfires before making plans. Check here for Covid-19 updates and possible local restrictions.
Colorado
As of October 11, there were no statewide travel restrictions in Colorado. Check here for updates.
Connecticut
Any traveler coming from a state that has a positive rate of 10 out of 100,000 people or a 10% or higher positivity rate must self-quarantine for 14 days. The traveler must have spent more than 24 hours in said state for the rule to apply. Everyone also needs to complete a travel health form.
Visitors can opt out of the 14-day quarantine in limited cases if they can provide proof that they have had a negative Covid-19 test in the past 72 hours.
There were 33 states plus Guam and Puerto Rico on the 10% or higher positivity list as of October 6. The list is updated each Tuesday. Check here for updates and details.
Delaware
As of October 11, there were no statewide travel restrictions in Delaware. Check here for updates.
Florida
As of October 11, there were no statewide travel restrictions in Florida. Check here for updates.
Georgia
As of October 11, there were no statewide travel restrictions in Georgia. Check here for updates.
Hawaii
Starting October 15, travelers who arrive with an FDA-approved nucleic acid amplification test (NAAT) taken no earlier than 72 hours before their flight, performed using a nasal swab, and can show proof of negative test results from a CLIA certified laboratory can avoid the state’s quarantine. This includes anyone 5 or older.
Until then, Hawaii still has its quarantine system in place. Check here for updates and details.
Idaho
In Ada County, which includes Boise, travelers coming from outside Idaho are “encouraged” to quarantine for 14 days. Check here for updates.
Illinois
There are no statewide restrictions, but a 14-day quarantine is required for visitors heading to Chicago from Alabama, Alaska, Arkansas, Idaho, Iowa, Kansas, Kentucky, Minnesota, Mississippi, Missouri, Montana, Nebraska, Nevada, North Dakota, Oklahoma, Puerto Rico, South Carolina, South Dakota, Tennessee, Utah, Wisconsin, and Wyoming.
The list of states on the quarantine list is updated each Tuesday and goes into effect each Friday. Check here for updates on the list of states and more information before you travel.
Indiana
As of October 11, there were no statewide travel restrictions in Indiana. Check here for updates.
Iowa
As of October 11, there were no statewide travel restrictions in Iowa. Check here for updates.
Kansas
If you’re in any of the following categories, you need to quarantine for 14 days after arrival in Kansas (this includes residents and visitors):
— Attended mass gathering events (out-of-state) of 500 people or more.— Took a sea or river cruise ship since March.

Kentucky
Visitors from states with a coronavirus testing positivity rate of 15% or more on Johns Hopkins University’s website should quarantine for 14 days.
The states with 15% or higher as of October 11 were Idaho, Iowa, Kansas, Nevada (14.92%) South Dakota, Wisconsin, Wyoming and the US territory of Puerto Rico. Check here for updates.
Louisiana
As of October 11, there were no statewide travel restrictions in Louisiana. Check here for updates.
Maine
Travelers must quarantine for 14 days upon arrival or sign a form stating they’ve received a negative Covid-19 test within 72 hours. You may also get tested upon arriving in Maine but must quarantine while awaiting results.
Residents of Connecticut, Massachusetts, New York, New Jersey, New Hampshire and Vermont are exempt from quarantining or having a negative test. Check here for updates.
Maryland
As of October 11, there were no statewide travel restrictions in Maryland. Check here for details.
Massachusetts
All visitors and residents must complete a travel form before arriving in Massachusetts unless they are arriving from a state designated by the Department of Public Health as low risk. As of October 11, those were Connecticut, Maine, New Hampshire, New York, Vermont and Washington, DC.
Travelers must “quarantine for 14 days or produce a negative Covid-19 test result that has been administered up to 72 hours prior to your arrival in Massachusetts.”
Those waiting on test results need to quarantine until they receive their negative results. Failure to comply with these directives may result in a $500 fine. Check here for updates.
Michigan
As of October 11, there were no statewide travel restrictions in Michigan. Check here for updates.
Minnesota
As of October 11, there were no statewide travel restrictions in Minnesota. Check here for updates.
Mississippi
As of October 11, there were no statewide travel restrictions in Mississippi. Check here for updates.
Missouri
As of October 11, there were no statewide travel restrictions in Missouri. Check here for updates.
Montana
As of October 11, there were no statewide travel restrictions in Montana. Travel restrictions might vary at seven Native American reservations. Check here for updates.
Nebraska
As of October 11, there were no statewide travel restrictions in Nebraska. Check here for updates.
Nevada
As of October 11, there were no statewide travel restrictions in Nevada. Check here for updates.
New Hampshire
Those traveling from outside other New England states (Maine, Vermont, Massachusetts, Connecticut and Rhode Island) who are visiting for “an extended period of time” are asked to self-quarantine for two weeks. Check here for updates.
New Jersey
All travelers to New Jersey from states that have a Covid-19 testing positivity rate of 10% or higher or have 10 people test positive for every 100,000 residents is asked to quarantine for 14 days. This rule does not apply for visitors spending less than 24 hours in the state.
The state government is also asking travelers to fill out a voluntary survey regarding information about where they are traveling and their destination.

New Mexico
People traveling from out-of-state are required to self-quarantine for 14 days or the length of their stay in New Mexico, whichever is shorter. The state issues a weekly list of exemptions, updated each Wednesday.
On October 11, the exemptions were: California, Connecticut, Maine, New Hampshire, New Jersey, New York, Vermont, Washington, DC, and Washington state. Check here for updates.
New York
All travelers who have recently visited a state with a positive testing rate of 10% or higher over a seven-day rolling period or had a positive test rate of 10 or more per 100,000 residents must quarantine for 14 days. That’s well over half the US states. You can check on the most recent list here (last updated October 6).
Those traveling by airplane must fill out a travel form before exiting the airport or face a fine of $2,000. Those traveling to New York through other methods such as cars and trains must fill out the form online. Check for updates here.
North Carolina
As of October 11, there were no statewide travel restrictions in North Carolina. However, the state urges visitors to check local destinations with possible restrictions before traveling. Check here for updates.
North Dakota
As of October 11, there were no statewide travel restrictions in North Dakota. Check here for updates.
Ohio
Travelers visiting Ohio from states reporting positive testing rates of 15% or more must self-quarantine for 14 days. As of October 11, the states on the list were Idaho, Iowa, Kansas, Missouri, South Dakota, Wisconsin and Wyoming. This list updates each Wednesday. Check here for updates.
Oklahoma
As of October 11, there were no statewide travel restrictions in Oklahoma. Check here for updates.
Oregon
As of October 11, there were no statewide travel restrictions in Oregon. Check here for updates.
Pennsylvania
Visitors traveling from states with “high amounts of Covid-19 cases” are asked to quarantine for 14 days. Check here for updates and changes to the list of states, last updated on October 9.
Rhode Island
Those traveling to Rhode Island from a state that has a positive testing rate of 5% or more must quarantine for 14 days. Travelers can opt out of the quarantine if they can provide proof of a negative Covid-19 test taken within 72 hours of their arrival. You can check that updated list of states here on this Google doc last updated on October 5.
Those waiting on test results must self-quarantine until a negative test result arrives. However, the state still recommends quarantining for 14 days as opposed to relying on a negative test result.
Travelers who check into a hotel or rental property will be required to sign a certificate compliance that verifies that they plan to quarantine for 14 days or that they’ve had a negative test. Check here for updates and details.
South Carolina
As of October 11, there were no statewide travel restrictions in South Carolina. Check here for updates.
South Dakota
As of October 11, there were no statewide travel restrictions in South Dakota. Some routes through Native American lands might be closed. Check here for updates.
Tennessee
As of October 11, there were no statewide travel restrictions in Tennessee. Check here for updates.
Texas
As of October 11, there were no statewide travel restrictions in Texas. The state urges people to wear a mask, saying “an itty-bitty piece of cloth goes a long way towards keeping yourself and others healthy.” Check here for updates.
Utah
As of October 11, there were no statewide travel restrictions in Utah. Check here for updates.
Vermont
Most travelers visiting Vermont must quarantine for 14 days upon arrival.
Any traveler arriving in a personal vehicle from counties in New England, Mid-Atlantic states, Ohio and West Virginia that have less than 400 active cases of coronavirus per million people does not need to quarantine upon arrival. The information is updated each Friday.
Vermont is allowing visitors to self-quarantine before they travel as long as they use a personal vehicle to travel. They must make minimal stops and follow precautions such as wearing a face mask or covering, washing their hands and staying six feet apart. They must self-quarantine for 14 days or for seven days if they receive a negative test.
If travelers use public transportation such as an airplane or bus, they must quarantine for 14 days upon arrival or for seven days followed by a negative Covid-19 test. Check here for updates.
Virginia
As of October 11, there were no statewide travel restrictions in Virginia. Check here for updates.
Washington, DC
Visitors traveling to or from a high-risk state must self-quarantine for 14 days. The restrictions exclude Virginia and Maryland.

Washington state

West Virginia

Scientists and their supporters march in favor of actual facts in DC
Just inside the entrance to the Washington Monument, a handful of people hold black and white signs bearing the words ADA assistance. As one one man walks by, he briefly pauses to consider their message. “Americans with Disabilities Act, or Ada Lovelace?” he says. “She was a great mathematician.”
It’s just shy of 9 a.m. in Washington DC, where thousands of scientists, researchers, academics, doctors, students, and concerned citizens are gathering on the damp grass surrounding the landmark. They’ve come from New York, Philadelphia, Maryland, New Mexico, and across the U.S. to show their support for science. Scientists have been planning a March on Washington since late January, shortly after Donald Trump took office.

What are "Protected Classes"?
Discrimination in the employment context: which groups get federal protection?
Not all unfair treatment is a violation of the law. In the employment context, for example, courts have noted they are not “super-personnel” departments meant to second guess every employment decision (see, e.g., Johnson v. Weld County (10th Cir. 2010); Chapman v. AI Transp. (11th Cir. 2000). Instead, the civil right statutes only prohibit actions that occur because of a person’s membership in a protected class. Congress has extended protections to specific groups who have historically faced hardships in obtaining employment, housing, and other public accommodations
What are the protected classes?
Under federal law, employers cannot discriminate on the basis of race, color, national origin, religion, sex, age, or disability. The law is not, however, a blanket bar on employers taking into account a person’s membership in one of these groups in all circumstances. For example, employers may consider membership in a protected class when making employment decisions if there is a business necessity for doing so, or if membership in a protected class is a bona fide occupational qualification. There are also certain criteria that must be met in order to be considered a member of protected class, such as being a qualified individual with a disability to be entitled to reasonable accommodations in the workplace.
History of the protected class
Race and color were the earliest protected classes. The Civil Rights Act of 1866 prohibits discrimination “in civil rights or immunities . . .on account of race, color, or previous condition of servitude.” Section 1981(a) of the Act barred discrimination in the making of contracts on the basis of race and color, which is understood to include employment contracts.
The protected classes grew significantly in the 20th Century, beginning with the passage of the Civil Rights Act of 1964. Title VII of the Act prohibits discrimination in employment on the basis of race, color, national origin, sex, and religion. The Act also created the Equal Employment Opportunity Commission (“EEOC”), the independent federal agency that oversees the enforcement of Title VII and the other civil rights acts as they apply to employment.
In 1967, Congress added age to the listed of protected classes with the Age Discrimination in Employment Act (“ADEA”). The ADEA only applies to individuals age 40 and older, and the federal courts have interpreted it narrowly over time, generally requiring more than a year or two age difference between employees to support a finding of age discrimination.
Disability first entered the list of protected classes in a limited way in 1973. The Rehabilitation Act of 1973 prohibits discrimination based on disability in federal employment. Employees in the private sector gained similar protections in 1990 with the passage of the Americans with Disabilities Act (“ADA”). Congress expanded the definition of who is covered by the ADA in 2008 with the Americans with Disabilities Amendments Act.
Protections against harassment
Title VII states that an employer may not discriminate against an employee or applicant for employment “because of” the person’s race, color, national origin, sex, or religion. The statute does not specifically reference harassment, or the creation of a hostile work environment that may include non-economic harms such as name calling or inappropriate touching. In Meritor Savings Bank (1986), the Supreme Court recognized that such harassment, although it might not rise to the level of distinct economic harms such as a demotion or firing, is covered by Title VII. This interpretation also encompasses the other civil rights statutes, and includes harassment based on retaliation.
The Supreme Court limited the reach of Title VII’s harassment protections in Meritor Savings to only those instances where the harassment is so “severe or pervasive” that it alters the terms and conditions of the employment. Since then, courts across the country have had to determine on a case-by-case basis what harassment is sufficiently severe or pervasive to meet this standard. Generally there must be multiple incidents of harassment to meet the standard. In only very limited circumstances, such as the use of specific racial slurs or the hanging of a noose, is a single incident sufficiently severe.
The ongoing evolution of sex as a protected class
In Price Waterhouse v. Hopkins (1989), the Supreme Court held that sex stereotyping is a form of prohibited sex discrimination. In Hopkins, Price Waterhouse denied Ms. Hopkins a position as a partner. The partnership committee based its decision on Ms. Hopkins not behaving as they expected a woman to in the workplace. For example, Ms. Hopkins received feedback that she should “walk more femininely, talk more femininely, dress more femininely, wear make-up, have her hair styled and wear jewelry.” The Court concluded that allowing such discrimination would undermine the purpose of Title VII.
The concept of sex stereotyping is an important part of more recent developments in the area of protected classes. Two federal courts of appeals and the EEOC have concluded that Title VII prohibits discrimination based on sexual orientation because it is a form of sex discrimination. These courts have concluded that sexual orientation discrimination is based on stereotypes of who an individual should be attracted to based on the individual’s sex. As the EEOC noted in Baldwin v. Department of Transportation (2015), “‘[s]exual orientation’ as a concept cannot be defined or understood without reference to sex.”
The Bostock Supreme Court ruling
In June 2020, the Supreme Court issued a decision in Bostock v. Clayton County, Georgia, holding that Title VII’s prohibition against discrimination “because of . . . sex” encompasses discrimination based on sexual orientation and gender identity. The Court rested its decision on the plain language of the statute, which bars an employer from treating an employee worse than others because of the employee’s sex, and concluded that any action taken because of sexual orientation or gender identity inherently involves a consideration of an employee’s sex. The Court illustrated this through several examples, including a hypothetical involving a model employee introducing a woman as the employee’s spouse at a company holiday party. The Court explained that whether the employee would fire the employee for violating a policy against employing gay or lesbian employees would turn on the sex of the employee—if the employee is a man, the company will not fire him. If the employee is a woman, the company will terminate her employment.
By relying on the plain language of the statute, the Court did not need to reach the question of whether sexual orientation or gender identity discrimination involves sex stereotyping. It also did not expand Title VII to include new protected classes, as the dissenting justices asserted. Instead, the Court clarified that sexual orientation and gender identity discrimination are forms of sex discrimination
Conclusion
Protected classes are how federal law conceptualizes protections against discrimination. The understanding of the classes may continue to evolve, either incrementally through courts or through federal legislation. Societal responses to new issues of discrimination generally start the process.

The Bureau manages the health and treatment of approximately 149,000 inmates in BOP facilities and RRCs. Over half of our institutions have no COVID-19 positive cases among inmates or staff. Indeed, two-thirds of our positive cases are in just 7 of our 122 institutions nationwide. As of June 1, 2020, across all facilities, there are 1,650 federal inmates who are currently COVID-19 positive based on test results. There are also currently 171 Bureau staff who have confirmed positive test results for COVID-19 nationwide, with 445 staff recovered and returning to work.
In total, from March 1, 2020, the date of the beginning of the national emergency proclaimed by President Trump, until today, 5,323 inmates total have tested positive for COVID19 and to-date, 3,784 have recovered. More than 80 percent of infected individuals have not become significantly ill. The number of hospitalized inmates — those who became significantly ill — is currently only 83 in total. And in fact, the number hospitalized is on a significant downward trajectory (see attached), suggesting that our attempts to mitigate the transmission of the virus is effective. Regrettably, there have been 68 federal inmate deaths from COVID-19.
To-date, the Bureau’s overall infection rate is approximately 4%, including clinically-probable and suspect cases, and based on the total number of inmates in custody. The BOP's death rate of those infected is approximately 1.1% and is slightly lower than the US rate of 1.3%. The BOP's rate of hospitalization has continued to decline over time with only 83 inmates currently hospitalized and only 22 of those on ventilators....
As the pandemic grew more widespread, the Bureau began aggressively screening the inmate population for inmates who were appropriate for transfer to RRC or Home Confinement for service of the remainder of their sentences. On March 26, 2020 and April 3, 2020, Attorney General Barr issued memoranda to the Bureau directing us to increase the use of Home Confinement, particularly at institutions that were markedly affected by COVID-19, for vulnerable inmates. The CARES Act, signed by President Trump on March 27, 2020, further expanded our ability to place inmates on Home Confinement by lifting the statutory limitations contained in Title 18 U.S.C. § 3624(c)(2) during the course of the pandemic. I am pleased to note that we currently have 6,120 inmates in RRC and 6,398 on Home Confinement. This is an 124% increase in HC from March 26, 2020. There are an additional 985 who are scheduled to transfer to Home Confinement in the coming weeks. While we continue to make robust strides in these placements to reduce risk of spread to the inmate population and staff, public health and safety must remain our highest priority. The Attorney General has issued guidance as to which inmates should be considered for home confinement. Staff are conducting individualized assessments to ensure inmates are appropriate for community placement both from a public safety perspective and given their own specific needs and circumstances. Additionally, we must ensure inmates who release to Home Confinement have a viable residence in which to reside.
It should go without saying that while we are dedicated to the protection of our inmates’ health and safety, we also have to consider — as the Attorney General’s guidance emphasized — that inmates who presented a risk of public safety because of their criminal acts or other factors cannot be released. Neither can we release inmates who would be worse off outside Bureau facilities than inside, such as those whose medical conditions could not be adequately cared for by health systems that are themselves overwhelmed by the response to COVID infections in the general community. Nor can we release inmates who do not have safe housing for themselves or housing that is not subject to appropriate safeguards for home confinement, which is still, after all, a form of incarceration for persons convicted of crimes whereby such persons are still serving a federal sentence.
