Vehicular Homicide -- Reckless Driving, Manufacture/Distribution/Dispense of Controlled Substance
In October 2017, a Belleville New Jersey man was sentenced to eight years in prison for a drunken head-on collision that took the life of a young father of two in May 2016.
During a somber afternoon hearing in Superior Court in Newark, the judge said he had seen other victims' family members express forgiveness toward their loved one's killer. But none, he added, had ever done what Pietro Davila did following the death of his son, 33-year-old Luis Davila.
"I've never had a victim's family member come before me and request that he be put on the defendant's visitation list," said Superior Court Judge Ronald D. Wigler.
And while Wigler wished defendant Alan Faynzilberg, 20, success in eventually turning his life around, the judge was not as forgiving as Davila's family, and refused to reduce the 8-year sentence recommended by prosecutors in a deal that led to Faynzilberg's guilty plea earlier on June 26.
Faynzilberg was jailed for 10 months following the incident, then released, but has been back in custody since the prior week, when he turned himself in on what was supposed to be his original sentencing date.
Pietro Davila, 59, of Jersey City, was one of three people who made victim impact statements. But rather than condemning Faynzilberg, DaVila expressed compassion for the young defendant, who stood to the side of the courtroom in prison garb, with his hands cuffed.
"I feel content, because we are Christian," Davila said through an interpreter. Turning to Faynzilberg, he added, "This young man, Alan, on my behalf I forgive him."
The victim's sister, Giselle Davila, was equally compassionate, telling Faynzelberg, "I hope that when you complete your sentence, you change your life for the better."
Assistant Prosecutor Betty Rodriguez said during the hearing that Faynzilberg admitted using alcohol, marijuana and the tranquilizer Xanax prior to the crash. She told the judge that in that and prior arrests for drug-related offenses, Faynzilberg had repeatedly shown "a complete disregard for the law."
With his lawyer, William Fitzsimmons, at his side, Faynzilberg made an emotional plea for leniency.
"Let me express my deepest and most sincere apologies for May 27, 2016," Faynzilberg said, sobbing at that point and others during the hearing.
"I'm sure it was sincere," said Wigler, the presiding criminal judge in Essex County.
That said, Wigler told Faynzilberg that, under his plea deal, the prosecutor's office had already agreed to downgrade the vehicular homicide charge against him from first degree to second degree, sparing him several years in prison under sentencing guidelines.
Wigler added that Faynzilberg's prior record included two drug arrests, one in which he avoided a criminal conviction by being accepted into a pre-trial intervention program, or PTI, on April 15, 2016 -- just six week before the drug-fueled crash that killed Luis Davila.
"What's concerning is you don't learn from your past mistakes," Wigler told Faynzilberg. "And a family was destroyed."
A friend of the Faynzilberg, Alexandra Roth, made a statement on his behalf, assuring the court that he would have the loving support of his family to help him overcome his drug dependence and reintegrate him into society upon his release.
"The level of remorse that he felt was not of the kind, 'What's going to happen to me?' but truly of the magnitude of what happened," Roth said.

yeji getting the lowest trainee rank in history only to climb to the top as 1st of her class 2y later then 4y after debut saying she doesn’t have her own voice yet makes me seethe even more thinking about jyp making her cry in the recording booth and forcing a specific sound on her instead of encouraging her to work on her skills in a way that benefits her not some musty middle aged man who takes all his career frustrations out on young women

Has anyone watched 4Y Record Store videos from Neurotically Yours? I was very much into that stuff back then.
I think after losing in the X-Games, Bradley would default more on his vice than usual, and sleep ("have fun") his life away. Ironically, when Max and his team were announced as the winners of that fateful event, even he delved into some insomnia and became quite depressive ("After Today" had the vibe of some strange dream...) The leaves on the tree are still green, but Fall is starting, and some come off the branches, carried off by a solemn wind. "Mama."

No, it’s not true that there are no excuses.
I can see a boss or parent or bully stating there are no excuses! when a deadline isn’t met, or a project fails, or an error was made, or a line crossed, but they are assuming an excuse is a cowardly way to avoid responsibility.
An excuse is a plea for leniency and understanding in the face of failure or disappointed expectations. An excuse is an explanation, an attempt at mitigation, and often an apology.
If you failed to show up for a meeting or failed a test, for example, an excuse might be that you were ill. If you were ill, then the excuse has merit.

Of course there are always excuses.
But with the many type of people in the world, some excuses are valid, and some are false. Therefore, causing people to not believe your excuses.
If you stumble upon the opportunity to defend your wrongdoing with an excuse, do not expect people to sympathize with you.
For example, if you did not complete your homework or time, it was your responsibility to hold up your end of the bargain. And it is your fault because you don’t have a skill of time management.
When confronted with a situation than requires an excuse, a suggestion would be to acknowledge your mistake and apologize, not to state your excuse, which would lower your reputation in the other’s eyes.

Displacement begins tomorrow.
Thankfully I have some really good friends who are able to accommodate me. Sadly it's only able to be short term. I'll have about a week to recover some of my lung capacity before being tossed back into the fray.
More details under the cut:
The landlord is replacing the water heater, and as far as I know has no plans to address the mold or anything else unless we move out (he's done nothing to address any of this in the 4y total we've stayed here, last 2.5 of which I've been stuck, time is a weird soup). The water supply has potential to improve, but the electricity is actively out in some areas, and feedbacking in others. So not just mold inhalation, but fire hazards, inadequate heating (double fire hazard multiplier), and more.
My ex has promised new housing soon, but he's just starting to refinance and go thru the USDA red tape for a homeowners loan. They still need him to jump through hoops to be at enough of a standing to be able to apply, let alone find a house, have that house pass inspection, be approved for the loan for the theoretical property in question, and finally close. For the record, I've not been able to reliably bank on anything he's said since December 2020 when he threw me out and his whole ableist abuse of my boundaries and blatant disregard for my health started.
He's lying to his whole family, and they're under the impression we've been together this whole time, when he's played with my mind, my heart, and my body at every available opportunity. He still calls me "his" despite my clearly laying boundaries to the contrary about all of this. I don't feel safe here.
I've spoken to my DSS worker, who advised me against filing for disability before I have my diagnosis for Ehlers Danlos, (which I won't be able to see a Dr for til June, then I can maybe be allowed to have the genetic testing I need to diagnose the condition) and not to try applying for any emergency housing assistance unless I actively get kicked out again, or unless I can prove my ex has been physically violent to me (I can't). I can't call code enforcement without a worse eviction happening to me (violently, by the landlord, who continues to threaten my safety, and is worse than my ex).
So yeah. I don't feel safe here.
He's talking about spending another winter in this death trap, bc it's half the rent of anywhere else, and we can't afford to move before this loan goes thru. I'd rather go to the psych ward if it has to come to that.

I've been subject to too many mind games over the last year, so I apologize if my posts have seemed disingenuous. I deleted the old post bc I keep being assured things are okay, when they very much are not.
I have 4w to raise enough money to find a place to stay or I'm going to be pretty much homeless, and trapped.
He wants us to put all our things in storage and move into a tiny one room trailer that has a leaky roof. I am chronically ill. I can't live there. He didn't even ask. Just assumed I'd be down to sacrifice all my belongings to effectively be trapped worse than I already am.
I'm working on income based housing and disability applications but neither of those will be effective in time so

Arson, Attempted Murder
In August 2018, a South Carolina sheriff’s deputy was accused of setting fire to the house where his ex-girlfriend’s family was sleeping.
The August 23, 2018 fire destroyed the home, but smoke detectors are credited with saving the four people inside, including children ages 9 and 15, according to media reports.
Dylan Brice Ellis, 22, of Boiling Springs, faced four charges of attempted murder and one charge of third degree arson, according to Spartanburg County jail records.
He was fired by the Spartanburg County Sheriff’s Office on August 30, after investigators linked him to the August 23 arson in Inman.
Ellis had been with the department 15 months. Ellis, who worked as a jailer, was accused of setting the home on fire at 4 a.m. while a mother, her two children and a second woman were inside asleep.
He confessed to the criminal acts during questioning. “The incident appeared to be motivated by feelings for an ex-girlfriend,” according to Sheriff Chuck Wright.
Evidence appears to indicate that Ellis’ ex-girlfriend did not live at the home, but she is related to the four who escaped.
Bail was not granted upon his initial arrest. He remained in local custody for more than 18 months before being transferred to control of State Department of Corrections.
