Ms Phillips: The Alberta Serious Incident Response Team has recommended criminal charges against Lethbridge police officers who targeted me when I was a minister. I am grateful that ASIRT undertook a fulsome investigation and found what I’ve known for years, that my records were accessed in 2018 for no lawful purpose other than political intimidation.
The years that led up to ASIRT’s findings have been a bit rough on me. I know people think I’m strong. I’ve been the face of some tough files in Alberta and nationally, and that is true. I have a reserve of all the strength in the world for building a better world with my NDP colleagues, but I was not prepared for how hard the years-long grind of trying to get a bit of police accountability has been on me, my family, and my love of political life. The LPS did incredible harm to my career and my reputation. They’ve never shown accountability or responsibility.
It also has a profound and important effect on democracy. In particular, these findings of criminal behaviour by sworn officers send a message to progressive people who might want to participate in politics: in Lethbridge you might be a police target for your views. The threat that law enforcement may violate a citizen’s right to be free from unreasonable search and seizure if they don’t like that citizen’s politics is intolerable in a free and democratic society.
The lesson for the community and for Albertans is that we have still not seen accountability for the LPS, and at some point we have to send the message that police intimidating elected officials or anyone else is intolerable.
At this point none of it’s over, but I do want to issue some words of thanks to Lisa Lambert, my assistant, who has endured all of this with me in my constituency office; to Geoff Braun, my partner – it hasn’t been easy on him either – to my kids and my mom, who helped me with the legal bills; and to the Member for Calgary-Mountain View for all of her support and friendship.
The arc of history is long, but it bends toward justice. It only bends that way if we are the ones who do the work.

GAZA/JERUSALEM, Nov 28 (Reuters) - Israeli forces and Hamas fighters held their fire beyond the original deadline of a truce on Tuesday, extended at the last minute by at least two days to let more hostages go free.
With both sides expressing hope of further extensions, mediator Qatar hosted the spy chiefs from Israel's Mossad and the U.S. CIA at a meeting to "build on progress", a source briefed on the visits told Reuters.
A single column of black smoke could be seen rising above the obliterated wasteland of the northern Gaza war zone from across the fence in Israel, but for a fifth day there was no sign of jets in the sky or rumble of explosions.
Both sides reported some Israeli tank fire in the Sheikh Radwan district of Gaza City in the morning, but there were no reports of casualties. Israel said its troops had been approached and fired a warning shot.
Previously during the truce, Hamas fighters released 50 Israeli women and children, some of them toddlers, from among the 240 hostages they captured in southern Israel during a deadly rampage on Oct. 7. In return, Israel released 150 security detainees from its jails, all women and teenagers.
Hamas also released 19 foreign hostages, mainly Thai farmworkers, under separate deals parallel to the truce agreement.
Israel has said the truce could be prolonged as long as Hamas continues to release at least 10 hostages per day. But with fewer women and children left in captivity, keeping the guns quiet beyond Wednesday could require negotiating to free at least some Israeli men for the first time.
"We hope the occupation (Israel) abides (by the agreement) in the next two days because we are seeking a new agreement, besides women and children, whereby other categories that we have that we can swap," Hamas official Khalil Al-Hayya told Al Jazeera late on Monday.
Israeli security cabinet minister Gideon Saar told Army Radio that the two-day extension had been agreed under the terms of the original offer, and Israel remained willing to extend the truce further if more hostages were released.
"Immediately upon the completion of the hostage-recovery framework, the warfighting will be renewed," he said.
Qatar's foreign ministry said it was now trying to secure a further extension based on Hamas releasing more hostages.
FIRST RESPITE
The truce brought the first respite to the Gaza Strip in seven weeks, during which Israel had bombed swathes of the territory into a desolate moonscape.
Many Gazans used the opportunity to return to abandoned or destroyed homes, like Abu Shamaleh, who was picking through the rubble of his flattened home in Khan Younis, looking for anything recoverable in the masonry. He said 37 family members had been killed.
"Today I have nothing in this world but memories. Everything is gone," he said. There was no machinery to excavate the body of a cousin still buried in the ruins, he said. "The truce is the time to lift the rubble and search for all the missing people and bury them. We honour the dead by burying them."
Among Israeli hostages yet to be freed was ten-month-old baby Kfir Bibas, along with his brother Ariel, 4, and their parents Yarden and Shiri, bundled from a kibbutz by gunmen on Oct 7. Yarden's sister told reporters relatives had learned the family would not be in the group to go free on Tuesday. Israeli officials said they believed they were being held by a militant group other than Hamas.
"Kfir is only 10 months old. He is a child who still doesn't even know how to say 'Mommy'," Jimmy Miller, a cousin, told Channel 12 TV. "We in the family are not managing to function... The family hasn't slept for a long, long time already - 51 days."
Israel has sworn to annihilate Hamas, the militant group that rules Gaza, after its gunmen burst across the fence and went on a violent spree, killing around 1,200 people and seizing 240 captives.
Since then, Gaza health authorities deemed reliable by the United Nations say more than 15,000 people have been confirmed killed in Israel's bombardment, around 40% of them children, with many more dead feared to be lost under rubble.
More than two-thirds of Gaza's 2.3 million people have lost their homes, with thousands of families sleeping rough in makeshift shelters with only the belongings they could carry.
When the war resumes, Israel has made clear it intends to press on with its assault from the northern half of Gaza into the south. U.S. officials said they have told their ally to be more careful protecting civilians as its forces press on.
"You cannot have the sort of scale of displacement that took place in the north replicated in the south. It will be beyond disruptive, it will be beyond the capacity of any humanitarian support network," one U.S. official said in a call with reporters. "It can't happen."
Despite releasing 150 detainees under the truce, Israel has been arresting Palestinians far faster than it lets them go: according to the Palestinian Prisoners' Club, a semi-official organisation, 3,290 Palestinians have been detained since Oct. 7.
Israel added an additional 50 Palestinian women to its list of 300 detainees cleared for release under the truce, seen as a sign it was prepared to negotiate for more hostages to go free under further extensions.
Israel's siege has led to the collapse of Gaza's health care system, especially in the northern half of the territory where no hospitals remain functioning. The World Health Organization said more Gazans could soon be dying of disease than from bombing.
There were already a very high number of cases of infants suffering from diarrhoea, said WHO spokesperson Margaret Harris: "No medicines, no vaccination activities, no access to safe water and hygiene and no food."

A Tent for the Ark
1 And they brought in the ark of God and set it inside the tent that David had pitched for it, and they offered burnt offerings and peace offerings before God. 2 And when David had finished offering the burnt offerings and the peace offerings, he blessed the people in the name of the Lord 3 and distributed to all Israel, both men and women, to each a loaf of bread, a portion of meat, and a cake of raisins.
4 Then he appointed some of the Levites as ministers before the ark of the Lord, to invoke, to thank, and to praise the Lord, the God of Israel. 5 Asaph was the chief, and second to him were Zechariah, Jeiel, Shemiramoth, Jehiel, Mattithiah, Eliab, Benaiah, Obed-edom, and Jeiel, who were to play harps and lyres; Asaph was to sound the cymbals, 6 and Benaiah and Jahaziel the priests were to blow trumpets regularly before the ark of the covenant of God. 7 Then on that day David first appointed that thanksgiving be sung to the Lord by Asaph and his brothers.
David's Song of Thanks
8 Oh give thanks to the Lord; call upon his name; make known his deeds among the peoples! 9 Sing to him, sing praises to him; tell of all his wondrous works! 10 Glory in his holy name; let the hearts of those who seek the Lord rejoice! 11 Seek the Lord and his strength; seek his presence continually! 12 Remember the wondrous works that he has done, his miracles and the judgments he uttered, 13 O offspring of Israel his servant, children of Jacob, his chosen ones!
14 He is the Lord our God; his judgments are in all the earth. 15 Remember his covenant forever, the word that he commanded, for a thousand generations, 16 the covenant that he made with Abraham, his sworn promise to Isaac, 17 which he confirmed to Jacob as a statute, to Israel as an everlasting covenant, 18 saying, “To you I will give the land of Canaan, as your portion for an inheritance.”
19 When you were few in number, of little account, and sojourners in it, 20 wandering from nation to nation, from one kingdom to another people, 21 he allowed no one to oppress them; he rebuked kings on their account, 22 saying, “Touch not my anointed ones, do my prophets no harm!”
23 Sing to the Lord, all the earth! Tell of his salvation from day to day. 24 Declare his glory among the nations, his marvelous works among all the peoples! 25 For great is the Lord, and greatly to be praised, and he is to be feared above all gods. 26 For all the gods of the peoples are worthless idols, but the Lord made the heavens. 27 Splendor and majesty are before him; strength and joy are in his place.
28 Ascribe to the Lord, O families of the peoples, ascribe to the Lord glory and strength! 29 Ascribe to the Lord the glory due his name; bring an offering and come before him! Worship the Lord in the splendor of holiness; 30 tremble before him, all the earth; yes, the world is established; it shall never be moved. 31 Let the heavens be glad, and let the earth rejoice, and let them say among the nations, “The Lord reigns!” 32 Let the sea roar, and all that fills it; let the field exult, and everything in it! 33 Then shall the trees of the forest sing for joy before the Lord, for he comes to judge the earth. 34 Oh give thanks to the Lord, for he is good; for his steadfast love endures forever!
35 Say also:
“Save us, O God of our salvation, and gather and deliver us from among the nations, that we may give thanks to your holy name and glory in your praise. 36 Blessed be the Lord, the God of Israel, from everlasting to everlasting!”
Then all the people said, “Amen!” and praised the Lord.
Worship Before the Ark
37 So David left Asaph and his brothers there before the ark of the covenant of the Lord to minister regularly before the ark as each day required, 38 and also Obed-edom and his sixty-eight brothers, while Obed-edom, the son of Jeduthun, and Hosah were to be gatekeepers. 39 And he left Zadok the priest and his brothers the priests before the tabernacle of the Lord in the high place that was at Gibeon 40 to offer burnt offerings to the Lord on the altar of burnt offering regularly morning and evening, to do all that is written in the Law of the Lord that he commanded Israel. 41 With them were Heman and Jeduthun and the rest of those chosen and expressly named to give thanks to the Lord, for his steadfast love endures forever. 42 Heman and Jeduthun had trumpets and cymbals for the music and instruments for sacred song. The sons of Jeduthun were appointed to the gate.
43 Then all the people departed each to his house, and David went home to bless his household. — 1 Chronicles 16 | English Standard Version (ESV) The Holy Bible, English Standard Version. President of Georgia sworn in amid political tensions
On Sunday, 29 December, Mikhail Kavelashvili was sworn in as president of Georgia, a move that has intensified the ongoing political tensions. This took place shortly after outgoing president Salome Zurabishvili, a pro-EU figure, declared herself the only legitimate president, further escalating the divide.
Political divide and legitimacy dispute
Zurabishvili addressed her supporters outside the presidential palace. She stated, “I remain the only legitimate president. I will leave the palace with your trust, the flag, and legitimacy.” Following her speech, she joined thousands of her supporters in protest.
Kavelashvili took the oath in a private ceremony at parliament. Foreign ambassadors did not attend after they decided to boycott the event. In his address, Kavelashvili highlighted Georgia’s “traditions, values, national identity, family, and faith.” His inauguration has deepened the ongoing political crisis. Furthermore, the suspension of EU talks and large pro-EU demonstrations have intensified the tensions.
Zurabishvili has publicly argued that Kavelashvili’s election is invalid due to fraud during the October vote. Nevertheless, the ruling Georgian Dream party insists that his election is legitimate. The party also asserts that it is the only force capable of securing peace and stability.
Rising tensions and calls for new elections
Georgia faces a pivotal moment. Once viewed as a democratic and pro-Western leader in the former Soviet states, the country now experiences significant political divisions. Zurabishvili has become the symbol for pro-EU protesters. These demonstrators, along with opposition parties, support her and demand a rerun of the election. However, Prime Minister Irakli Kobakhidze has rejected the idea of new elections.
The crisis deepened on 28 November when Kobakhidze announced that Georgia would delay opening EU accession talks until 2028. This announcement sparked protests, which have continued daily. Riot police responded by using tear gas and water cannons to disperse the crowds. Over 400 people were arrested, with many protesters reporting police brutality.
In response, the international community condemned the actions. The United States and several European nations imposed sanctions on Georgian Dream officials. In particular, the US targeted Bidzina Ivanishvili, the founder of the party, accusing him of undermining Georgia’s democratic future for the benefit of Russia.

English, s/on @0458z with Bowbells int. fb ID, pips and Newsday preview. @0501z World News anchored by Neil Nunes. § Donald Trump set out his final pitch to voters during a huge rally in Madison Square Garden, New York. He vowed an "America first" approach and set out a new tax policy - but comments made by his supporters at the event have drawn criticism. One supporter called Harris the "antichrist", while another described Puerto Rico as a "floating island of garbage". Trump has distanced himself from the latter comment. Elsewhere, Kamala Harris campaigned in Pennsylvania, a crucial swing state, where she appealed to young voters "impatient for change" § The United States and the European Union called for a full investigation into reports of violations in an election in Georgia, where the president urged protests on Monday following the disputed parliamentary vote. The results, with almost all precincts counted, were a blow for pro-Western Georgians who had cast the election as a choice between a ruling party that has deepened ties with Russia and an opposition aiming to fast-track integration with Europe. § The coalition led by Japan’s ruling Liberal Democratic Party (LDP) has lost its majority in parliament, its worst result in over a decade. § The LDP and its coalition partner, the much smaller Komeito, have taken 215 seats together, falling short of the 233-seat majority needed to govern. The election was called by the LDP’s new leader Shigeru Ishiba just days before he was sworn in as prime minister - but the loss of his party's parliamentary majority has now put his political future into question. In a speech on Monday, he said the LDP had received "severe judgement", adding they would "humbly" accept this. § Egypt's president on Sunday said his country has proposed a two-day cease-fire between Israel and Hamas during which four hostages held in Gaza would be freed and some Palestinian prisoners would be released. President Abdel-Fattah el-Sissi, speaking in Cairo, said the proposal also includes the delivery of humanitarian aid to the besieged Gaza Strip. This is the first time Egypt's president has publicly proposed such a plan. Egypt, along with Qatar and the United States, has been a key mediator for peace talks between Israel and Hamas since the war broke out more than a year ago. Months of negotiations sputtered to a halt in August. § Japanese endoscope manufacturer Olympus Corp said on Monday that it has sacked Chief Executive Stefan Kaufmann after an allegation that he had purchased illegal drugs, sending its shares sliding 6%. Kaufmann, a German national who only took the helm in April last year, had been tasked with expanding Olympus' medical equipment business after preceding CEO Yasuo Takeuchi steered the company through years of asset sales. § French actor Gérard Depardieu is facing a criminal court trial in Paris over alleged sexual assaults on two women on a film set in 2021. @0506z “Newsday” begins. 100' (30m) of Kev-Flex wire feeding "Magic Wand" antenna hanging in backyard tree w/MFJ-1020C active antenna (used as a preamplifier/preselector), JRC NRD-535D, 125kW, beamAz 27°, bearing 103°. Oh! The depart into stare of uncontrolled like thee this thus in the last great vernal mansion.

Worthy Brief - March 28, 2024
Have a heart after God!
Psalms 89:3-4 I have made a covenant with my chosen, I have sworn unto David my servant, Thy seed will I establish for ever, and build up thy throne to all generations. Selah. [Selah in Hebrew means “pause and ponder this!”]
Matthew 1:1 The book of the generation of Jesus Christ, the son of David [in the Hebrew New Testament it’s written - Yeshua HaMashiach ben David], the son of Abraham.
New Testament genealogies of Yeshua Ha Mashiach (Jesus the Christ) all identify Him as the son of king David. It was universally understood from the Tenach (OT) that the messiah would be descended from David and that he would restore the Davidic monarchy to its ultimate and most universal expression, even that this king would reign and sit on the throne forever.
Why was Yeshua's identification with David so significant? One reason is that David is the only man in the Bible about whom the Lord said, this is “a man after My own heart”. Yet we know well David's imperfections … adultery and murder -- so why would God say this about him? I believe it was David's lifelong love for and abandoned worship of the Lord, and also his contrite heart (Ps. 51) and the depth of his sorrow and repentance which showed this relationship to be the most important and precious in his life.
God isn’t expecting perfection from us -- His Son has provided that. Yeshua alone is the Man whose heart and actions are flawless. But David exemplified a man whose love and respect for his God were constant, if imperfect, a man after God's own heart. And this is the heart that God is seeking today, contrite, worshipful, and filled with respect and love for our God.
David provides a wonderful example for us who are as imperfect as he was. We may fall and fail miserably – but its how we get up that makes the difference. Our constant desire to preserve this most precious of all relationships will show that we too have a heart after God. I know I want to hear Him say, "Yes, you are truly someone after my own heart!"
Your family in the Lord with much agape love,
George, Baht Rivka, Obadiah and Elianna (Dallas, TX) (Baltimore, Maryland)

Germany's Development Minister Svenja Schulze traveled to Mauritania on Monday to formally take over the rotating one-year presidency of the Sahel Alliance — a key development body for the region — from its predecessor Spain.
"I am taking over the presidency of the Sahel Alliance to show that Germany, together with its partners, is there for the region and is committed to the region. My priorities for the Sahel Alliance are jobs, agriculture and social security in the region. And preventing state-free spaces," said Schulze in Mauritania's capital Nouakchott.
The 18-member Sahel Alliance was founded by Germany, France and the European Union in 2017 to assist Burkina-Faso, Chad, Mali, Mauritania and Niger — collectively known as the G5 Sahel Group — in their struggle against poverty and terrorism.
Since its creation, the Sahel Alliance has spent more than $28 billion ($30.71 billion) in a region stretching from the Atlantic Ocean to the Red Sea south of the Sahara. Germany is the group's fourth-largest donor behind the World Bank, France and the EU — having spent €2.73 billion on 181 projects.
Worries that UN troop departure could create vacuum
"The Sahel is one of the poorest regions in the world, with one of the youngest populations," said Schulze. "At the same time, the Sahel has become the new epicenter of Islamist terrorism, and Russian influence is increasing."
Schulze's comments come at a time when there is great concern in the region over whether a power vacuum will be created when UN MINUSMA peacekeeping troops leave Mali by the end of the year at the insistence of that country's military leadership.
Mali left the French-speaking G5 Sahel Group — formed in 2014 in part to defend against the growing threat posed by Islamist groups — last year after its government was taken over in a military coup. It has since forced the departure of all French troops from its country and now wants the UN out as well.
At the same time, mercenaries from Russia's Wagner private military group have expanded their influence in the region, ingratiating themselves as the French departed.
Schulze said Germany would focus on education and employment projects as well as expanding social protection and community infrastructure such as water supply, hospitals, markets and schools.
The government minister said she was convinced people would take such assistance to heart, "By these actions, the population will notice who genuinely cares and who doesn't. Because terrorist groups don't lay water pipes."
European and UN forces have been in the area for a decade in an attempt to dislodge armed militants — mainly from Burkina Faso, Mali and Niger — many of whom have sworn allegiance to al-Qaida or so-called "Islamic State." More than 2.8 million people in the region have been displaced, with over 2 million fleeing Burkina Faso alone.

ANKARA, Turkey — Turkey’s longtime leader, Recep Tayyip Erdogan, took the oath of office on Saturday, ushering in his third presidential term that followed three stints as prime minister.
Erdogan, 69, won a new five-year term in a runoff presidential race last week that could stretch his 20-year rule in the key NATO country that straddles Europe and Asia into a quarter-century. The country of 85 million controls NATO’s second-largest army, hosts millions of refugees and played a crucial role in brokering a deal that allowed the shipment of Ukraine grain, averting a global food crisis.
Erdogan was sworn in during a session in parliament before an inauguration ceremony at his sprawling palace complex. Supporters waited outside parliament despite the heavy rain, covering his car with red carnations as he arrived.
All eyes are on the announcement of his new Cabinet later on Saturday. Its lineup should indicate whether there will be a continuation of unorthodox economic policies or a return to more conventional ones amid a cost-of-living crisis.
Dozens of foreign dignitaries are traveling to attend the ceremony, including NATO Secretary General Jens Stoltenberg and Carl Bildt, a high-profile former Swedish prime minister. They are expected to press Erdogan to lift his country’s objections to Sweden’s membership in the military alliance — which requires unanimous approval by all allies.
Turkey accuses Sweden of being too soft on Kurdish militants and other groups that Turkey considers to be terrorists. NATO wants to bring Sweden into the alliance by the time allied leaders meet in Lithuania on July 11-12, but Turkey and Hungary have yet to endorse the bid. Hungarian Prime Minister Viktor Orban will also be attending the ceremony.
According to state-run Anadolu Agency, other leaders in attendance include Azerbaijan’s Ilham Aliyev, Venezuela’s Nicolas Maduro, South Africa’s Cyril Ramaphosa, Armenia’s Nikol Pashinyan, Pakistan’s Shahbaz Sharif, and Libya’s Abdul Hamid Dbeibah.
Erdogan was sworn in amid a host of domestic challenges ahead, including a battered economy, pressure for the repatriation of millions of Syrian refugees and the need to rebuild after a devastating earthquake in February that killed 50,000 and leveled entire cities in the south of the country.
Turkey is grappling with a cost-of-living crisis fueled by inflation that peaked at a staggering 85% in October before easing to 44% last month. The Turkish currency has lost more than 10% of its value against the dollar since the start of the year.
Critics blame the turmoil on Erdogan’s policy of lowering interest rates to promote growth, which runs contrary to conventional economic thinking that calls for raising rates to combat inflation.
Unconfirmed media reports say Erdogan plans to reappoint Mehmet Simsek, a respected former finance minister and deputy prime minister, to the helm of the economy. The move would signify a return by the country — which is the world’s 19th largest economy according to the World Bank — to more orthodox economic policies.
In power as prime minister and then as president since 2003, Erdogan is already Turkey’s longest-serving leader. He has solidified his rule through constitutional changes that transformed Turkey’s presidency from a largely ceremonial role to a powerful office. Critics say his second decade in office was marred by sharp democratic backsliding including the erosion of institutions such as the media and judiciary and the jailing of opponents and critics.
Erdogan defeated opposition challenger Kemal Kilicdaroglu in a runoff vote held on May 28, after he narrowly failed to secure an outright victory in a first round of voting on May 14. Kilicdaroglu had promised to put Turkey on a more democratic path and improve relations with the West. International observers deemed the elections to be free but not fair.

Shiv Sena Case: Supreme Court Verdict
This article on 'Supreme Court rules the Governor not entitled to enter the political arena: Facts and Laws (Shiv Sena Case)' was written by an intern at Legal Upanishad.
INTRODUCTION
Governor is a nominal executive head of the state. He forms an important part of the state executive where he acts as the chief executive head. The central Government nominates the governor for each state. The governor has to act on the aid and advice of the council of ministers headed by the chief minister. Through the constitution, the governor has provided some power such as discretionary power, judicial power, financial emergency power, and legislative power and the governor has to act according to those powers given to him by the constitution. Every politician in our country is bound by the constitution and they cannot go beyond the constitution and if they do the same they will be treated as a criminal like a normal citizen in India and they will be punished accordingly by the laws and acts which are there for committing or breaching the constitution. Governor is the head of the state and like all other politicians, he is bound by the constitution. Through this article, the author will give you an enhanced view of where the Supreme Court ruled that the governor is not entitled to enter into a political arena through a famous case Shiv Sena Case.
FACTS (SHIV SENA CASE)
Uddhav Thackeray, a leader of the Shiv Sena and the Maha Vikas Aghadi (MVA), was sworn in as the chief minister of Maharashtra on November 28, 2019. The Shiv Sena, Nationalist Congress Party, and Indian National Congress have joined forces to form MVA. Mr. Eknath Shinde, the Shiv Sena's legislative leader, along with a number of other Shiv Sena MLAs vanished on June 21, 2022. The ‘rebel' group originally relocated to Surat before proceeding to Gauhati. They said that they lacked faith in CM Thackeray and the MVA coalition since they supported the Shiv Sena philosophy. On June 25, 2022, the Thackeray group delivered a notice for acting against party interests and began disqualification procedures against the dissident group. The notification was handed to the rebel group with 48 hours to reply. On June 26th, 2022, Mr. Shinde filed a petition with the Supreme Court of India disputing the actions taken to remove him and the other "rebel" MLAs from office. A vacation bench of the Supreme Court, consisting of Justices Surya Kant and J.B. Pardiwala, issued an extraordinary Order on June 27, 2022. The dissident party was given 12 days of "breathing time" by the Bench to react to the Deputy Speaker's (Acting Speaker) disqualification notice, which was issued on June 25th. The standard response period to notification of disqualification is seven days. The Court's involvement came as a surprise. The Court often stays out of the House's current processes in favour of awaiting the Speaker's decision, which it may then examine. The Deputy Speaker was also given notice by the Shinde faction to vacate his position. The Shinde gang also contacted Governor Bhagat Singh Koshyari at the same time. They announced that they were no longer supporting the MVA alliance. To determine if the Uddhav Thackeray administration still had the backing of the Maharashtra Legislature, the Governor ordered a floor test to be held on June 30. Because disqualification procedures against the rebel MLAs were still underway, the Thackeray side contested the results of the floor test before the SC. The floor test was scheduled for June 29, 2022, but the court declined to postpone it, indicating that the floor test's findings will depend on how the SC hearings turned out. CM Thackeray resigned shortly after the SC's Order without taking the floor test. The matter was referred to a 5-Judge Constitution Bench on August 22, 2022, by a 3-Judge Bench made up of former CJI N.V. Ramana and Justices Krishna Murari and Hima Kohli. On February 14, 2023, the Shiv Sena case was heard by a 5-judge Constitution Bench under the direction of Chief Justice D.Y. Chandrachud. The Thackeray side asked for the matter to be referred to a 7-Judge Bench during this hearing. The Bench resolved on February 17th, 2023, after hearing from the parties, not to refer the matter to a bigger Bench before a thorough hearing. The Electoral Commission of India (ECI) granted Shinde's group the party name Shiv Sena and the bow and arrow emblem on February 17th, 2023. The Thackeray side started claiming that the Shinde group ought to be dismissed since their activities constituted desertion on February 21st, 2023.
Supreme Court Verdict: Governor's Political Limits - Shiv Sena Case
WHAT IS DEFECTION?
According to the Constitution's 10th Schedule, defection is the act of a lawmaker switching political parties after winning an election. Under the 10th Schedule, legislators who have left their party are unable to hold office.
WHY ARE LAWS AGAINST DEFECTION REQUIRED?
Mr. Gaya Lal, a Haryana-based MLA, switched parties three times in a single day in 1967. As a result, "Aaya Ram, Gaya Ram" became well-known. Governments become unstable as a result of these defections. In order to combat defections and get rid of possible political corruption, the anti-defection provision was inserted into the Constitution in 1985. This legislation upholds the sacredness of open and transparent elections while valuing the voters' choice.
ARGUMENT FROM THE THACKRAY SIDE
The Shinde faction was accused of desertion by the Thackeray group because of its contempt for the party whip, selection of a new deputy speaker, demand for a floor test, and insistence of its majority. Additionally, they claimed that the Governor's request for a floor test was unlawful and that by doing so, he effectively acknowledged a "split" within the party. Splits, which were formerly exempt from the defection rule, no longer shield elected officials from being disqualified for defection. They also suggested that the SC should reevaluate its ruling in the 2016 Nabam Rebia case. According to this ruling, a Speaker cannot start disqualification actions against House members while a notification of his own dismissal is still pending. The Thackeray camp said that members who were considering defecting had a simple way to end the meeting. They just needed to submit a notification calling for the Speaker's dismissal.
WHAT DO THE SHINDE GROUP’S MAJOR DEFENCES CONSIST OF?
The MLAs from the Shinde group, however, asserted that they had not left the Shiv Sena. They are the real Shiv Sena, and their acts are the product of internal dissension. Additionally, the Speaker of the House, not the SC, had the power to rule in cases involving the disqualification of MLAs. Additionally, they said that the Governor had the legal authority to call for a floor test since he had sufficient grounds to think that Mr. Thackeray did not control the majority of the House. Furthermore, they said that Nabam Rebia (2016) made it very plain that a Speaker cannot initiate disqualification procedures against other House members while a notice of removal is pending in the chamber.
JUDGEMENT
The Supreme Court will issue its ruling in the Shiv Sena case involving the conflict between the Eknath Shinde and Uddhav Thackeray factions. The verdict will determine the future of the current Eknath Shinde-led Maharashtra administration. On February 14, 2023, the Constitution Bench, which was made up of Chief Justice of India DY Chandrachud, Justices MR Shah, Krishna Murari, Hima Kohli, and PS Narasimha, began hearing the Shiv Sena case. The Supreme Court declined to reinstate the Uddhav Thackeray government because he resigned during the Shiv Sena revolt last year without taking the floor test, therefore the Eknath Shinde administration is still in power.
CONCLUSION
The Supreme Court's ruling will make the Constitution's 10th Schedule's boundaries more clear. The judgement is anticipated to specifically address the Speaker's, Governor's, and SC's authority in cases involving internal dissents, splits, and party rebellions. If the Bench finds that the Shinde group left the Shiv Sena, they would essentially promote the role of party identity above individual member liberty in important House decisions. This implies that individual party members cannot ignore the Whip and cast a vote or abstain from casting a vote against the party's desires in the name of "internal dissent." The Governor was wrong to call for the floor test on June 28, 2022, and the SC's June 29th Order refusing to halt the floor test was also incorrect if the activities of the Shinde group amount to defection. This implies that the Governor cannot order a floor test in cases of disqualification (for defection) prior to the House passing a resolution of no confidence. Additionally, if the Thackeray side wins, the function of the ECI will be made clear. It will demonstrate that the Shinde group was improperly given the Shiv Sena party name and emblem by the ECI. The choice of the ECI cannot be made only on the basis of whatever group received the majority of votes in the Legislature. On the other hand, if the Bench decides that the Shinde group did not leave the Shiv Sena, then the autonomy of each individual member supersedes the party's identity. In doing so, the Governor would be entitled to call for a floor test if he had cause to believe that a party leader does not have the support of the majority of the House. This would prevent the House from passing a no-confidence resolution. It will also conclude that the ECI was correct to give the Shinde faction the Shiv Sena's bow and arrow insignia. Which side will leave this judgment with the moniker "the real Shiv Sena" depends on whether the case is referred to a bigger bench.

Kristen Michal becomes Estonia’s new PM
Estonia’s parliament on Monday approved Climate Minister Kristen Michal as the country’s next prime minister, succeeding Kaja Kallas, who recently resigned to take up the post of European Union foreign policy chief.
Michal, who like Kallas is from the liberal Reforma party, will lead the same centre-right majority coalition as his predecessor, along with the liberal Estonia 200 party and the Social Democrats. At the extraordinary session, 64 MPs voted in favour of authorising Mihal, with 27 against.
Before the vote, the politician spoke about the basis for forming the government. In particular, he explained the need to raise taxes by increasing spending on defence and internal security. At the same time, he promised spending cuts and governance reforms, as well as steps to boost Estonia’s economic growth.
After receiving the mandate on Monday, President Alar Karis is expected to appoint a new government. On Tuesday, Michal will be sworn in before the Estonian parliament.
Earlier, on July 15, Kaja Kallas, who headed the Estonian government, resigned. She left her post after EU leaders approved her candidacy for the post of the association’s high representative for foreign affairs and security at a summit in Brussels on June 28.

From Pakistan To Scotland: Meet Humza Yousaf, Scotland’s 37-Year-Old New Leader
Humza Yousaf, a Pakistan-origin leader and practising Muslim, has made history in Scotland after being elected as the head of the Scottish National Party. After winning a close-fought contest, the 37-year-old now has mounting challenges ahead of him
— FP Explainers | March 28, 2023
Hamza Yusuf, 37, of Pakistan Origin, Became Scotland’s First Muslim immigrant Minister. Yusuf hails From District Khanewal Tensil Mian Channu, Pakistan.
From Pakistan to Scotland. It’s a long road between the two nations but on Monday that distance was gapped when Scottish nationalists picked Humza Yousaf to be the country’s next leader.
The current health secretary edged out competition from Kate Forbes by a narrow margin and against Ash Regan to become the head of the Scottish National Party (SNP), after former First Minister Nicola Sturgeon tendered her resignation from the position in mid-February.
In winning, he has become Scotland’s first Muslim leader. The next step will be for him to be formally nominated to be the First Minister by the Scottish Parliament — a vote that is due on Tuesday in Holyrood. Yousaf will then be officially sworn in at the Court of Session, Scotland’s supreme civil court, on Wednesday.
Below we look at his career in politics to date and his beliefs.
Early life and political career
“As immigrants of this country who knew barely a word of English, they could not have imagined in their wildest dreams that their grandson would one day be on the cusp of being the next First Minister of Scotland,” Yousaf said after he won the vote on Monday.
And it’s true.
Though Yousaf was born in Glasgow, Scotland in 1985, his grandparents had moved to the country back in 1962 from Mian Channu in Punjab, Pakistan. Yousaf’s mother, also of South Asian descent, emigrated to Scotland from Kenya.
He was privately educated at Hutchesons’ Grammar School in Glasgow and studied politics at the University of Glasgow. After his studies, Yousaf briefly worked in a call centre before becoming a parliamentary assistant to SNP MSP Bashir Ahmad and later an aide to Alex Salmond.
In 2011, a then slightly more than 25-year-old Yousaf made history by becoming the youngest-ever member of Parliament. And since then, he has only climbed the political ladder and gaining in reputation.
Humza Yousaf edged out the win against candidates Ash Regan (left) and Kate Forbes after a bruising five-week contest that exposed deep fractures within the pro-independence movement. AP
Yousaf became the first Scottish Asian and Muslim to be appointed as minister to the Scottish Government in 2012 when then First Minister Alex Salmond appointed him as the Minister for External Affairs and International Development, responsible for external affairs, fair trade policy and diaspora. When Sturgeon took over from Salmond, he continued his junior ministership.
He then became justice secretary in 2018 and introduced the Hate Crime and Public Order bill which made “stirring up hatred” on religion, sexual orientation, age, disability and transgender identities an offence.
Yousaf has also served as transport minister, and international development minister, before becoming the health secretary in 2021.
However, it’s not been all smooth sailing for him. His political performance has been far from stellar. As transport minister in 2016, he was fined £300 (Rs 30,370) for driving a friend’s car without insurance.
He also faced criticism for the performance of ScotRail after Abellio took over the contract to run the rail franchise, which ultimately led to it being nationalised.
As health secretary, he was criticised for the long hospital waiting times, especially during the COVID-19 pandemic. However, he had defended himself, saying the problem wasn’t unique to Scotland and, in fact, the country was the only one in the UK to avoid strikes by NHS (National Health Service) staff.
Humza Yousaf has been a close ally of former First Minister Nicola Sturgeon and was seen by many as the continuity candidate. He is expected to take forward SNP’s demand for Scottish independence. File image/Reuters
Scotland’s Expectations From Him
With Yousaf winning the SNP vote, it marks the end of the acrimonious and unpredictable leadership contest. Yousaf has been widely seen as the continuity candidate and the favourite of the SNP leadership, even though Sturgeon refused to endorse anyone.
He pledges to preserve the party’s progressive values; he is the poster child for multiculturalism — in 2016, after winning his second term as an MSP, Yousaf delivered his oath of allegiance in Urdu while wearing a kilt. In 2011, he had worn a sherwani while taking oath.
He has liberal views on matters of immigration as well as gender. He was one of the proponents of the Marriage and Civil Partnership (Scotland) Act 2014 which legalised same-sex marriage. He also extended his support to Sturgeon’s controversial Gender Recognition (Reform) Bill which will allow trans persons to self-identify. This legislation has been blocked by the Rishi Sunak government as of now.

He is also a firm advocate of Scottish independence, but has said that he will not follow Sturgeon’s path to independence. He has said that the party needs to get back to making the case for independence, rather than endlessly debating process. “We will be the generation that delivers independence for Scotland,” Yousaf said in Edinburgh after the result.
He also said an independent Scotland should look at ditching the monarchy, telling the National newspaper in an interview: “Let’s absolutely, within the first five years, consider whether or not we should move away from having a monarchy into an elected head of state.”
Furthermore, he has stated in a BBC interview that he is his “own man and will do things my own way”. Yousaf added: “I have a lot of admiration, as you would imagine, for the excellent work Nicola Sturgeon has done as first minister.
“But she had a certain leadership approach. Mine would be less inner circle and more big tent.”
The road ahead for Humza Yousaf is not easy. But he has vowed to take the country forward. “We will be the generation that delivers independence for Scotland,” he said after his win. AP
Challenges Ahead of Him
The road for Humza Yousaf is going to be tricky and full of roadblocks. He faces the monumental task of bringing together a party that has been driven apart by a bitter leadership contest.
Yousaf will also have to prove himself and that too quickly. While Sturgeon enjoyed positive approval ratings, her government did not. An Ipsos poll found that across a number of policy issues — including on health care, education and standard of living — “more people think that the Scottish government is doing a bad job than think they’re doing a good job.”
As The Politico reports, there are some in his party itself who question whether he’s up to the job, given his struggle to avoid negative headlines in previous Cabinet jobs. “Nobody — including his backers — looks at Humza and says ‘there’s our leader for the next 10 years’ or even that he’ll win independence,” an SNP adviser was quoted as telling The Politico.
It is left to be seen if he sinks or swims. But for now it’s interesting to see that the three leaders of Britain, Scotland and Ireland all have leaders of South Asian origin — Britain’s Rishi Sunak, now Scotland’s Humza Yousaf and Ireland’s Leo Varadkar.
