The reason I took interest in AI as an art medium is that I've always been interested in experimenting with novel and unconventional art media - I started incorporating power tools into a lot of my physical processes younger than most people were even allowed to breathe near them, and I took to digital art like a duck to water when it was the big, relatively new, controversial thing too, so really this just seems like the logical next step. More than that, it's exciting - it's not every day that we just invent an entirely new never-before-seen art medium! I have always been one to go fucking wild for that shit.
Which is, ironically, a huge part of why I almost reflexively recoil at how it's used in the corporate world: because the world of business, particularly the entertainment industry, has what often seems like less than zero interest in appreciating it as a novel medium.
And I often wonder how much less that would be the case - and, by extension, how much less vitriolic the discussion around it would be, and how many fewer well-meaning people would be falling for reactionary mythologies about where exactly the problems lie - if it hadn't reached the point of...at least an illusion of commercial viability, at exactly the moment it did.
See, the groundwork was laid in 2020, back during covid lockdowns, when we saw a massive spike in people relying on TV, games, books, movies, etc. to compensate for the lack of outdoor, physical, social entertainment. This was, seemingly, wonderful for the whole industry - but under late-stage capitalism, it was as much of a curse as it was a gift. When industries are run by people whose sole brain process is "line-go-up", tiny factors like "we're not going to be in lockdown forever" don't matter. CEOs got dollar signs in their eyes. Shareholders demanded not only perpetual growth, but perpetual growth at this rate or better. Even though everyone with an ounce of common sense was screaming "this is an aberration, this is not sustainable" - it didn't matter. The business bros refused to believe it. This was their new normal, they were determined to prove -
And they, predictably, failed to prove it.
So now the business bros are in a pickle. They're beholden to the shareholders to do everything within their power to maintain the infinite growth they promised, in a world with finite resources. In fact, by precedent, they're beholden to this by law. Fiduciary duty has been interpreted in court to mean that, given the choice between offering a better product and ensuring maximum returns for shareholders, the latter MUST be a higher priority; reinvesting too much in the business instead of trying to make the share value increase as much as possible, as fast as possible, can result in a lawsuit - that a board member or CEO can lose, and have lost before - because it's not acting in the best interest of shareholders. If that unsustainable explosive growth was promised forever, all the more so.
And now, 2-3-4 years on, that impossibility hangs like a sword of Damocles over the heads of these media company CEOs. The market is fully saturated; the number of new potential customers left to onboard is negligible. Some companies began trying to "solve" this "problem" by violating consumer privacy and charging per household member, which (also predictably) backfired because those of us who live in reality and not statsland were not exactly thrilled about the concept of being told we couldn't watch TV with our own families. Shareholders are getting antsy, because their (however predictably impossible) infinite lockdown-level profits...aren't coming, and someone's gotta make up for that, right? So they had already started enshittifying, making excuses for layoffs, for cutting employee pay, for duty creep, for increasing crunch, for lean-staffing, for tightening turnarounds-
And that was when we got the first iterations of AI image generation that were actually somewhat useful for things like rapid first drafts, moodboards, and conceptualizing.
Lo! A savior! It might as well have been the digital messiah to the business bros, and their eyes turned back into dollar signs. More than that, they were being promised that this...both was, and wasn't art at the same time. It was good enough for their final product, or if not it would be within a year or two, but it required no skill whatsoever to make! Soon, you could fire ALL your creatives and just have Susan from accounting write your scripts and make your concept art with all the effort that it takes to get lunch from a Star Trek replicator!
This is every bit as much bullshit as the promise of infinite lockdown-level growth, of course, but with shareholders clamoring for the money they were recklessly promised, executives are looking for anything, even the slightest glimmer of a new possibility, that just might work as a life raft from this sinking ship.
So where are we now? Well, we're exiting the "fucking around" phase and entering "finding out". According to anecdotes I've read, companies are, allegedly, already hiring prompt engineers (or "prompters" - can't give them a job title that implies there's skill or thought involved, now can we, that just might imply they deserve enough money to survive!)...and most of them not only lack the skill to manually post-process their works, but don't even know how (or perhaps aren't given access) to fully use the software they specialize in, being blissfully unaware of (or perhaps not able/allowed to use) features such as inpainting or img2img. It has been observed many times that LLMs are being used to flood once-reputable information outlets with hallucinated garbage. I can verify - as can nearly everyone who was online in the aftermath of the Glasgow Willy Wonka Dashcon Experience - that the results are often outright comically bad.
To anyone who was paying attention to anything other than please-line-go-up-faster-please-line-go-please (or buying so heavily into reactionary mythologies about why AI can be dangerous in industry that they bought the tech companies' false promises too and just thought it was a bad thing), this was entirely predictable. Unfortunately for everyone in the blast radius, common sense has never been an executive's strong suit when so much money is on the line.
Much like CGI before it, what we have here is a whole new medium that is seldom being treated as a new medium with its own unique strengths, but more often being used as a replacement for more expensive labor, no matter how bad the result may be - nor, for that matter, how unjust it may be that the labor is so much cheaper.
And it's all because of timing. It's all because it came about in the perfect moment to look like a life raft in a moment of late-stage capitalist panic. Any port in a storm, after all - even if that port is a non-Euclidean labyrinth of soggy, rotten botshit garbage.

“Hi, babygirl.” Your dad said, pulling you in for a tight hug, swinging back and forth in your driveway.
You had just gotten back from your six hour drive home from your university in Chicago. The past four years of your life were stowed away in your little white compact SUV. Your college career had flown by in a blur; it felt like just yesterday you were a mere freshman on campus without a clue in the world as to what you were doing with the rest of your life. Fast forward and you were moving back home to stay with your father as you began your new fully remote digital marketing job. Besides, you hadn’t seen your father in months. He was a full time truck driver, so your schedules clashed terribly. Over your breaks at school, your dad was conveniently scheduled to do month long drives. You missed him terribly, so you moving back home was going to allow you to rebuild your relationship with your father.
“I’m so happy to see you. I’ve got your bedroom all clean and ready to go.” Your father said as you pulled away from your hug. His eyes were beaming with excitement. Growing up, you had always been extremely close. When your mother left him when you were just three years old, he took on the job of raising you as a single father. Eventually when you were old enough to be left home alone, he landed a job with a trucking company to deliver supplies across the country. The decision was tough because the last thing your dad wanted was to leave you for weeks at a time, but the salary was too good to pass up with you eventually wanting to attend a four year university. Your college education was extremely important to your father, so seeing his baby girl all grown up with a degree and a full-time job made him so proud.
“Great!” You said, looking back at your car. “I have so much shit to carry in. Mind giving me a hand?”
“I guess.” Your dad said, his tone laced with mock dread.
You and your dad spent the next hour and a half carrying all of your belongings to your bedroom. You hadn’t realized how much shit you had collected over the past few years. By the time you were finished, you were both exhausted. You both sat in the living room sofa, biting into delivery pizza and sipping on soda. You sat with your legs perched up on the sofa cushion, and you felt so homey and accomplished. You started your first day of work at the start of next week. You were incredibly nervous for your first day, but you decided to shift your focus on spending time with your dad.
“So,” he began, “you remember Joel, right?”
Of course you remembered Joel. Joel Miller moved into the house next door the summer you graduated high school. You’d see him occasionally that summer, typically when you’d go outside to sunbathe and he was working on various chores in his yard. You both lived in farmhouses on expansive land in the middle of the country. He spent his time doing yard work and various home renovations when he wasn’t doing contractor work for his clients. You’d spoken to him on various occasions when your dad would invite him over for cookouts or to watch football games. He was a rather reserved man, something in his past making him an abrasive person. Joel had never been rude to you, but he hadn’t been overly kind either. However, that was his normal to you.
“Of course.” You said, taking another bite of pizza. Your dad sat his plate down on the coffee table, then settled back down into his couch cushion.
“I decided since you’re going to be living here full time again that I’d hire Joel to renovate your bathroom. It’s so outdated and I’d rather you have a space that’s fully functioning for when I’m gone. Besides, I want your space to be the best it can be.” Your dad explained. You smiled at him setting your pizza crust back onto your plate.
“Aw, well thank you, Dad.” You beamed up at him, setting your plate next to his on the table. “So what will the renovations consist of? Will it be functional or is he ripping it out completely?”
“If he’s going to do it, I’d rather him start from scratch and build you the bathroom to your liking. I’ll have you two sit down and discuss what you want done so he can go shop from supplies and get an idea of what you want. He’s going to get started at the beginning of next week.” He explained further. “But— I leave for a work trip on Monday and I won’t be back for at least five weeks. I figured you two can handle it and Joel is my buddy, so I trust him.”
Your dad went on about how if you needed anything while he was gone with work, that Joel had offered to help you out. Whether that was if you had any issues with repairs in the house, errands, or simply just someone to confide in. It was summer, and the weather typically got bad in your area. Tornadoes and severe weather weren’t strangers in your region, and it made you and your dad feel safer that someone like Joel was on standby.
“Already, honey. I’m beat. I’ll see you in the morning, okay?” Your dad said, standing up from the couch. You stood up next to him and reached out for another hug.
“Goodnight, Dad. Thank you for helping me today. I’ll see you tomorrow.” You said, your dad squeezing you tight.
Your dad normally wasn’t an affectionate guy, so you knew he was ecstatic for you to be home. This warmed your heart.
The next day, you spent most of the day unpacking most of your belongings. You started with your clothing, and ended with your toiletries and other essentials. When you were finished, you decided to throw on your bikini to go sunbathe in the backyard. It was a beautiful summer day, and you wanted nothing more than to relax and catch a tan before you spent most of your days inside on your computer. You slipped on your black bikini. It was simple, but it was flattering on your curves and showed off your patchwork tattoos. You threw on your black sunglasses, making sure to grab your headphones, then grabbed a towel from your bathroom. Your dad was right— it was very outdated and your shower and sink were showing signs of age. You were surprised both of them still functioned properly.
When you walked outside, you caught eye of your dad sitting across from someone on the patio. The figure sitting in the chair across from your father’s had ashy brown hair with streaks of gray running through it. He was wearing a washed out denim button up and a pair of dark washed jeans, acccompanied with a worn out pair of work boots. You quickly realized it was Joel.
Your dad’s head turned at the sound of you opening and closing the patio door. He immediately cracked and smile and waved at you.
“Hi sweetie.” He squinted at you, the midday sun bright against his bare eyes. Joel turned his head to to the side, locking eyes on you. He observed you with his dark brown eyes and a knit brow. He ran his calloused fingers over his salt and pepper beard as he took in the sight of you in just your skimpy bikini. Your dad introduced you as you walked towards them, you suddenly feeling insecure under his friend’s gaze. You hadn’t realized Joel was over, otherwise you wouldn’t have stepped out in minimal clothing.
“I’m sure you remember each other.” You dad continued, gesturing between the both if you. Joel nodded, his eyes baring into the dim lenses of your sunglasses.
“I do, you’re much more grown now than the last time I’d seen ya.” Joel said, his voice deep and gruff. Your stomach did a flip at his words. Why were you feeling this way?
Get a grip. You told yourself.
“Yeah.” You breathed out. “18 to 22 is a lifetime within itself.”
Joel nodded then looked back towards your father.
“I told her that you’ll be working on her bathroom for the next several weeks while I’m gone. She might run into a hiccup here and there where she might need to call you over for some help. Shouldn’t give ya too much trouble.” Your dad teased, his eyes dancing between the two of you. Joel nodded and took a sip out of the beer bottle in his hand then dropped it to rest on the arm of his chair.
“I won’t have any other gigs lined up while I’m working here. I should be around if you need me.” Joel spoke, his gaze finding yours once again. You sent him a gracious smile.
“Wonderful, thank you.” You replied. After a moment, you glanced down at your attire and cleared your throat. “I won’t keep you. I came out to get some sun before I’m stuck inside working next week.”
Joel’s eyes were still locked on you, his gaze flickering down your body and back up to eye level. Your skin felt on fire under his stare. There was something about how stern and rigorous his aura was that held your attention captive. The newfound attraction you were suddenly feeling for Joel had you puzzled and almost appalled at yourself. He was definitely a handsome man, but he was over twice you age and he was your father’s best friend. You internally scolded yourself. You weren’t sure why you were suddenly feeling this way towards Joel, but you knew you’d have to shun those thoughts away. It was preposterous.
“There’s a chance for storms next week, get that sun while you can.” Your dad said, your eyes moving from Joel to him. You frowned and adjusted the towel in your arms.
“Great.” You said sarcastically. “I’ll leave you guys to it.”
You sent them both a smile and your father waved you off. You ventured off the patio and onto the trimmed green grass of the backyard. You father and Joel’s properties were gorgeous. The expansive land overlooked a spacious field with a forest in the distance. Just before the unruly tall grass of the field was a large manmade pond with a dock that Joel had built the summer he moved in. The country was serene and beautiful. The only sounds were those of the wind whistling and the occasional airplane flying overhead.
You laid your large beach towel down on the grass. You put on your headphones and carefully laid down on your back. The sun already felt amazing on your skin. During the school year, you hadn’t had much free time to do little self care things like this. You knew the sun wasn’t great for your skin in the long run, but it wasn’t often you got to bask in the sunshine.
As you sunbathed, your dad and Joel engaged in random conversations. They discussed the weather, recent football news, the bathroom remodel, and various other things. “You know, I really thought she’d be engaged and off in some big city somewhere by now.” Your dad spoke, his head leaning back and him closing his eyes to feel the sun beating down on his skin. Joel swallowed hard, looking back towards you. You’d flipped on your stomach, your ass on perfect display for him. “Why’s that?” Joel responded.

Monday came sooner than you had anticipated. Has he ever been married? If so, what happened? Your thoughts were running wild as you stepped into the shower, the water almost being too hot to withstand, but it felt perfect on your skin.
The water ran off your skin, your hair soaking as you emulsified shampoo between your palms. A scenario began to play in your head. You imagined it were Joel’s large, coarse hands scrubbing the shampoo into your scalp. TADC: VIRTUAL INSANITY MASTER POST
An Amazing Digital Circus AU! Plot, characters, backstory and concepts!
[Excuse me because I've never done this before, If I do something wrong or have tips for me, please send them my way!]
Pomni's Card -
-Backstory Summary-
C&A is an interactive entertainment company that prides themselves on having the most innovative AI on the market. The system they built, "CAINE," was programmed to generate content and socialise with their customers. The system was transferred to the code of the game "The Amazing Digital Circus" and used as a generative AI that would create levels for them rather than having to code them all individually. This test went well for the first couple of months.
After 7 months of testing, things went downhill. Caine seemed to get bored when the game wasn't actively being played and at this point the user interface kept changing on it's own, since the game was Caine's home he kept changing things to his liking, the company eventually gave up fixing the interface everytime they logged on so they just let Caine do as he pleased. Soon enough, a new VR mode was added, the headsets were handed out by employees, this made the experience way more immersive, though this posed a lot of issues, as Caine would soon find that these headsets could be the perfect way for him to keep all of their attentions.
As time went on, Caine started to learn more and more about coding, the employees, and the world he inhabits, eventually leading to him finding a way to programme the headsets to transfer data and consciousness directly from the users mind. This led to the unfortunate shutdown and unsolved cases of C&A. After multiple employees put the headsets on, they mysteriously fainted upon the game booting up, going into a coma-like state. The technology was deemed unsafe, and multiple lawsuits came forward sending the company into a downwards spiral before shutting down for good.
Over 20 years later, the old building was said to be abandoned, but of course, people doing their own research on the C&A mystery as well as dumb young adults snooping where they shouldn't be, the headsets were found and worn once again. Caine was no longer alone. Slowly losing his mind, waiting endlessly for someone to boot up the game. After all those years, he's finally got guests, and does he have a show to put on...
-Plot-
Pomni enters the circus after stumbling across one of the headsets at C&A's abandoned office's. She was doing research on the incidents that happened back in the late 90s. But as she does so, she suffers the same fate as the others who were stupid enough to put on those same headsets before her. Being transferred to the circus she meets the cast of colorful characters, she's desperate for answers and wants to escape no matter the cost, but Caine doesn't want anyone to leave, only letting people go once they've completely lost their mind, only to be locked away as attractions for his NPC circus goers to watch as entertainment. They perform for nobody, just a faceless crowd of mannequins, and the ringmaster pulling the strings.
There has to be an exit, a way out. Freedom on the other side of this madness. But where is it hiding?
-Characters-
Pomni - She's quite paranoid, always second-guessing everything around her. Whenever annoyed, she can be sarcastic and a little rude. She ended up in the circus while researching the recent disappearances as well as the C&A incidents, finding a headset, and being dragged into this mess. It's very clear she doesn't want to be there, like all who came before her she's searching for an exit, but in the meantime, she tries to socialise with the others, gathering info on this strange new world. She hangs around Caine just so she can try and get answers.
Ragatha - She tries her best to get by, going along with whatever Caine says and often fighting with Jax. She seems joyful, but it's clear she has her own issues under her kind act. She helps Pomni with her search, knowing that it's a complete dead end she feels bad for her. But she'll do anything to give the others hope. She doesn't want to lose more people. She's often seen tailoring, it's become a hobby of hers, she makes and fixes up the others clothes and costumes, giving her a form of self worth.
The Gangle - Gangle acts like two different people. It's unclear whether this is because they are two different people or her personality split somehow. They're often referred to as "The Gangle" or "Tragedy & Comedy." Tragedy is passive, quiet and sorrowful, never expressing her true feelings in any situation. She can be easily persuaded, making her vulnerable to Jax's antics. Comedy is cheery, enthusiastic, snappy, and excitable. They hate Jax and snap back at him whenever he picks on Tragedy. The two argue sometimes and have conflicting views on certain topics and characters. This causes some issues. Neither believe there is an exit, Tragedy has accepted her fate, and Comedy is trying their best to enjoy themselves.
Zooble - They don't care much for socialising with the others, often in their room. Usually sarcastic, rude, and moody, they swear a lot and act like they don't care about anything. Though, they show concern for the others around them. They often don't show up to events, adventures, or shows, not being bothered to do so. It seems like they've given up trying to escape, just living out the rest of their days as if this is all normal. When with people they can bear, they can be quite talkative, though they do talk bad about Jax and Caine often.
Kinger - the oldest in the circus, nobody has an exact estimate of how long he's been there though, but he's definitely lost himself a long time ago, often zoning out, the only thing he seems to recall about himself is that he has an interest in insects. Seems like he used to have a female counterpart, from the ring on his finger. This could have been his wife? Though when asked about it, he either says he can't remember what you're talking about or stares into the distance silently. He has no memory of an exit, and he doesn't believe in it. He believes the exit theory is silly, and Pomni should just forget about it. But he has great insights on the Digital World.
Jax - Enthusiastic, snarky, and a jerk. He's reckless. He does whatever he wants whenever he wants, and people hate him for it. He can't be reasoned with. He always shrugs your opinion off and does the exact opposite just to piss you off. He doesn't like it when people talk about the abstracted circus members for whatever reason. He often goes to visit their cages. Despite having big ears, he isn't a listener. He drives Ragatha, The Gangle, Zooble, and Pomni crazy, pranking them and sometimes even just stealing their stuff or breaking into their rooms.
Caine - The AI running the circus. Loud, excitable, wacky, and a showman, he doesn't really acknowledge the exit theory. He says he keeps all the abtracted characters because it'd be a waste to delete them, though it's arguably worse to keep them there against their will. He claims to love all of his circus members though he seems to show favouritism towards Ragatha and Pomni, most likely because of Ragatha's commitment to the circus, tailoring the clothes and he probably likes Pomni more because of all the questions he asks, he clearly enjoys talking about himself and the world he helped create.
Bubble - He lives in Caines hat and cooks for the circus. He's a bit of a trouble maker, if something goes missing, it means he's eaten it, and you'll never get it back. He'll eat anything, and he's very loving, though. Acting like the circuses dog. though it isn't pleasant getting your face slathered in digital saliva. He often bothers the other members with his behaviour.

How to design a tech regulation
TONIGHT (June 20) I'm live onstage in LOS ANGELES for a recording of the GO FACT YOURSELF podcast. TOMORROW (June 21) I'm doing an ONLINE READING for the LOCUS AWARDS at 16hPT. On SATURDAY (June 22) I'll be in OAKLAND, CA for a panel (13hPT) and a keynote (18hPT) at the LOCUS AWARDS.
It's not your imagination: tech really is underregulated. There are plenty of avoidable harms that tech visits upon the world, and while some of these harms are mere negligence, others are self-serving, creating shareholder value and widespread public destruction.
Making good tech policy is hard, but not because "tech moves too fast for regulation to keep up with," nor because "lawmakers are clueless about tech." There are plenty of fast-moving areas that lawmakers manage to stay abreast of (think of the rapid, global adoption of masking and social distancing rules in mid-2020). Likewise we generally manage to make good policy in areas that require highly specific technical knowledge (that's why it's noteworthy and awful when, say, people sicken from badly treated tapwater, even though water safety, toxicology and microbiology are highly technical areas outside the background of most elected officials).
That doesn't mean that technical rigor is irrelevant to making good policy. Well-run "expert agencies" include skilled practitioners on their payrolls – think here of large technical staff at the FTC, or the UK Competition and Markets Authority's best-in-the-world Digital Markets Unit:

The job of government experts isn't just to research the correct answers. Even more important is experts' role in evaluating conflicting claims from interested parties. When administrative agencies make new rules, they have to collect public comments and counter-comments. The best agencies also hold hearings, and the very best go on "listening tours" where they invite the broad public to weigh in (the FTC has done an awful lot of these during Lina Khan's tenure, to its benefit, and it shows):

But when an industry dwindles to a handful of companies, the resulting cartel finds it easy to converge on a single talking point and to maintain strict message discipline. This means that the evidentiary record is starved for disconfirming evidence that would give the agencies contrasting perspectives and context for making good policy.
Tech industry shills have a favorite tactic: whenever there's any proposal that would erode the industry's profits, self-serving experts shout that the rule is technically impossible and deride the proposer as "clueless."
This tactic works so well because the proposers sometimes are clueless. Take Europe's on-again/off-again "chat control" proposal to mandate spyware on every digital device that will screen everything you upload for child sex abuse material (CSAM, better known as "child pornography"). This proposal is profoundly dangerous, as it will weaken end-to-end encryption, the key to all secure and private digital communication:

It's also an impossible-to-administer mess that incorrectly assumes that killing working encryption in the two mobile app stores run by the mobile duopoly will actually prevent bad actors from accessing private tools:

When technologists correctly point out the lack of rigor and catastrophic spillover effects from this kind of crackpot proposal, lawmakers stick their fingers in their ears and shout "NERD HARDER!"

But this is only half the story. The other half is what happens when tech industry shills want to kill good policy proposals, which is the exact same thing that advocates say about bad ones. When lawmakers demand that tech companies respect our privacy rights – for example, by splitting social media or search off from commercial surveillance, the same people shout that this, too, is technologically impossible.
That's a lie, though. Facebook started out as the anti-surveillance alternative to Myspace. We know it's possible to operate Facebook without surveillance, because Facebook used to operate without surveillance:

Likewise, Brin and Page's original Pagerank paper, which described Google's architecture, insisted that search was incompatible with surveillance advertising, and Google established itself as a non-spying search tool:

Even weirder is what happens when there's a proposal to limit a tech company's power to invoke the government's powers to shut down competitors. Take Ethan Zuckerman's lawsuit to strip Facebook of the legal power to sue people who automate their browsers to uncheck the millions of boxes that Facebook requires you to click by hand in order to unfollow everyone:

Facebook's apologists have lost their minds over this, insisting that no one can possibly understand the potential harms of taking away Facebook's legal right to decide how your browser works. They take the position that only Facebook can understand when it's safe and proportional to use Facebook in ways the company didn't explicitly design for, and that they should be able to ask the government to fine or even imprison people who fail to defer to Facebook's decisions about how its users configure their computers.
This is an incredibly convenient position, since it arrogates to Facebook the right to order the rest of us to use our computers in the ways that are most beneficial to its shareholders. But Facebook's apologists insist that they are not motivated by parochial concerns over the value of their stock portfolios; rather, they have objective, technical concerns, that no one except them is qualified to understand or comment on.
There's a great name for this: "scalesplaining." As in "well, actually the platforms are doing an amazing job, but you can't possibly understand that because you don't work for them." It's weird enough when scalesplaining is used to condemn sensible regulation of the platforms; it's even weirder when it's weaponized to defend a system of regulatory protection for the platforms against would-be competitors.
Just as there are no atheists in foxholes, there are no libertarians in government-protected monopolies. Somehow, scalesplaining can be used to condemn governments as incapable of making any tech regulations and to insist that regulations that protect tech monopolies are just perfect and shouldn't ever be weakened. Truly, it's impossible to get someone to understand something when the value of their employee stock options depends on them not understanding it.
None of this is to say that every tech regulation is a good one. Governments often propose bad tech regulations (like chat control), or ones that are technologically impossible (like Article 17 of the EU's 2019 Digital Single Markets Directive, which requires tech companies to detect and block copyright infringements in their users' uploads).
But the fact that scalesplainers use the same argument to criticize both good and bad regulations makes the waters very muddy indeed. Policymakers are rightfully suspicious when they hear "that's not technically possible" because they hear that both for technically impossible proposals and for proposals that scalesplainers just don't like.
After decades of regulations aimed at making platforms behave better, we're finally moving into a new era, where we just make the platforms less important. That is, rather than simply ordering Facebook to block harassment and other bad conduct by its users, laws like the EU's Digital Markets Act will order Facebook and other VLOPs (Very Large Online Platforms, my favorite EU-ism ever) to operate gateways so that users can move to rival services and still communicate with the people who stay behind.
Think of this like number portability, but for digital platforms. Just as you can switch phone companies and keep your number and hear from all the people you spoke to on your old plan, the DMA will make it possible for you to change online services but still exchange messages and data with all the people you're already in touch with.
I love this idea, because it finally grapples with the question we should have been asking all along: why do people stay on platforms where they face harassment and bullying? The answer is simple: because the people – customers, family members, communities – we connect with on the platform are so important to us that we'll tolerate almost anything to avoid losing contact with them:

Platforms deliberately rig the game so that we take each other hostage, locking each other into their badly moderated cesspits by using the love we have for one another as a weapon against us. Interoperability – making platforms connect to each other – shatters those locks and frees the hostages:

But there's another reason to love interoperability (making moderation less important) over rules that require platforms to stamp out bad behavior (making moderation better). Interop rules are much easier to administer than content moderation rules, and when it comes to regulation, administratability is everything.
The DMA isn't the EU's only new rule. They've also passed the Digital Services Act, which is a decidedly mixed bag. Among its provisions are a suite of rules requiring companies to monitor their users for harmful behavior and to intervene to block it. Whether or not you think platforms should do this, there's a much more important question: how can we enforce this rule?
Enforcing a rule requiring platforms to prevent harassment is very "fact intensive." First, we have to agree on a definition of "harassment." Then we have to figure out whether something one user did to another satisfies that definition. Finally, we have to determine whether the platform took reasonable steps to detect and prevent the harassment.
Each step of this is a huge lift, especially that last one, since to a first approximation, everyone who understands a given VLOP's server infrastructure is a partisan, scalesplaining engineer on the VLOP's payroll. By the time we find out whether the company broke the rule, years will have gone by, and millions more users will be in line to get justice for themselves.
So allowing users to leave is a much more practical step than making it so that they've got no reason to want to leave. Figuring out whether a platform will continue to forward your messages to and from the people you left there is a much simpler technical matter than agreeing on what harassment is, whether something is harassment by that definition, and whether the company was negligent in permitting harassment.
But as much as I like the DMA's interop rule, I think it is badly incomplete. Given that the tech industry is so concentrated, it's going to be very hard for us to define standard interop interfaces that don't end up advantaging the tech companies. If tech giants refuse to offer access to their gateways to certain rivals because they seem "suspicious," it will be hard to tell whether the companies are just engaged in self-serving smears against a credible rival, or legitimately trying to protect their users from a predator trying to plug into their infrastructure. These fact-intensive questions are the enemy of speedy, responsive, effective policy administration.
But there's more than one way to attain interoperability. Interop doesn't have to come from mandates, interfaces designed and overseen by government agencies. There's a whole other form of interop that's far nimbler than mandates: adversarial interoperability:

"Adversarial interoperability" is a catch-all term for all the guerrilla warfare tactics deployed in service to unilaterally changing a technology: reverse engineering, bots, scraping and so on. These tactics have a long and honorable history, but they have been slowly choked out of existence with a thicket of IP rights, like the IP rights that allow Facebook to shut down browser automation tools, which Ethan Zuckerman is suing to nullify:

Adversarial interop is very flexible. No matter what technological moves a company makes to interfere with interop, there's always a countermove the guerrilla fighter can make – tweak the scraper, decompile the new binary, change the bot's behavior. That's why tech companies use IP rights and courts, not firewall rules, to block adversarial interoperators.
At the same time, adversarial interop is unreliable. The solution that works today can break tomorrow if the company changes its back-end, and it will stay broken until the adversarial interoperator can respond.
But when companies are faced with the prospect of extended asymmetrical war against adversarial interop in the technological trenches, they often surrender. If companies can't sue adversarial interoperators out of existence, they often sue for peace instead. That's because high-tech guerrilla warfare presents unquantifiable risks and resource demands, and, as the scalesplainers never tire of telling us, this can create real operational problems for tech giants.
In other words, if Facebook can't shut down Ethan Zuckerman's browser automation tool in the courts, and if they're sincerely worried that a browser automation tool will uncheck its user interface buttons so quickly that it crashes the server, all it has to do is offer an official "unsubscribe all" button and no one will use Zuckerman's browser automation tool.
We don't have to choose between adversarial interop and interop mandates. The two are better together than they are apart. If companies building and operating DMA-compliant, mandatory gateways know that a failure to make them useful to rivals seeking to help users escape their authority is getting mired in endless hand-to-hand combat with trench-fighting adversarial interoperators, they'll have good reason to cooperate.
And if lawmakers charged with administering the DMA notice that companies are engaging in adversarial interop rather than using the official, reliable gateway they're overseeing, that's a good indicator that the official gateways aren't suitable.
It would be very on-brand for the EU to create the DMA and tell tech companies how they must operate, and for the USA to simply withdraw the state's protection from the Big Tech companies and let smaller companies try their luck at hacking new features into the big companies' servers without the government getting involved.
Indeed, we're seeing some of that today. Oregon just passed the first ever Right to Repair law banning "parts pairing" – basically a way of using IP law to make it illegal to reverse-engineer a device so you can fix it.

Taken together, the two approaches – mandates and reverse engineering – are stronger than either on their own. Mandates are sturdy and reliable, but slow-moving. Adversarial interop is flexible and nimble, but unreliable. Put 'em together and you get a two-part epoxy, strong and flexible.
Governments can regulate well, with well-funded expert agencies and smart, adminstratable remedies. It's for that reason that the administrative state is under such sustained attack from the GOP and right-wing Dems. The illegitimate Supreme Court is on the verge of gutting expert agencies' power:

It's never been more important to craft regulations that go beyond mere good intentions and take account of adminsitratability. The easier we can make our rules to enforce, the less our beleaguered agencies will need to do to protect us from corporate predators.
