As you move through the apartment, your eyes dart from corner to corner, searching for any clue that might lead you to Spencer or indicate the presence of the stalker. You approach the kitchen, your grip on the gun tightening. The sight of a shattered coffee mug on the floor makes your heart skip a beat. Could there have been a struggle? Is Spencer hurt? Your mind races with possibilities, each one more terrifying than the last.
Morgan follows soon after, splitting off from you to check the small office space Spencer had fashioned himself out of a spare bedroom, his eyes scanning the room with equal intensity.
You continue your search, moving from room to room, hoping to find any sign of Spencer's whereabouts. Each empty room fuels your worry, and the silence becomes suffocating. Time feels like it's slipping away, and a sense of urgency settles in your chest.
You make your way to Spencer's bedroom last, your footsteps almost soundless on the carpeted floor. The door is slightly ajar, and you push it open slowly, trying to minimise any noise as you enter with your gun raised to your eyes, index finger held against the trigger.
The sight that greets you is both chilling and heartbreaking. The room is in complete disarray, the curtains drawn shut, books scattered across the floor, shelves pulled off their brackets. But what catches your attention is the lump in Spencer’s bed sheets.
You approach it slowly, removing the blanket with your left hand to reveal what was causing the lump underneath it, and the sight almost makes you drop your weapon.

“Morgan…” Morgan arrives at your side almost before you have the time to call out to him, concerned at how long you’d spent in Spencer’s bedroom.
That concern grows into full blown worry as he catches sight of Spencer. “Oh my God..”

Morgan’s reaction confirms that you’re not dreaming.

It’s a torn scrap of lined paper housing only six words. The same six words that had urged you to involve Spencer in this mess in the first place.

Morgan takes a small step back and holds your shoulders. “Wait wait, you’re being stalked?” He looks at you with serious concern in his eyes. You hadn't mentioned that you'd had a stalker to anyone else on the team.
“I didn’t want to tell anyone… I thought I was just being paranoid, but I got scared and Spencer let me spend the night here a few days ago… and- I told him everything and- I lead my stalker right to him…” Your voice cracks as you speak, and you force yourself up to take a seat on Spencer’s bed as you try not to lose your composure any further than you already have.
“Hey-“ Morgan continues to kneel in front of you, putting his hands firmly on your shoulders. “Hey, look at me... look at me, okay? You are not at fault for this. I'm not gonna let you blame yourself for this, you hear me?” His voice held a more commanding tone than he would usually use around you.
“How can I not blame myself for this?” You take a sharp breath in through your nose, wiping the back of your hand over both of your eyes in attempt to rid your cheeks of the dampness of your tears.
"Hey, listen to me." Morgan holds your shoulder firm and he leans in so that you can't break eye contact with him. "This is not on you, and I don't ever ever want to hear you say or think otherwise."
He seemed incredibly sure of himself. Morgan had been a rock for you for a very long time now, and he'd always been right.

“we have to tell the rest of the team…” Morgan urges solemnly. "…and they're gonna ask questions... especially about why you didn't go to them before. Are you ready for that?" He was trying to prepare you for the onslaught of questions that were about to be dumped on the two of you in the next hour.
You give him a small nod as you take in a slow, shaky breath, trying to regain a regular breathing pattern. “Mhm…”
“Hey... look at me?” He shakes his hand against your shoulders slightly. “You’re not alone, okay? I’m here with you. The team is with you.”
Morgan looks at you with a small smile. “We’re not gonna let this sonofabitch get away with anything.” He’d already started mentally planning the investigation he was about to launch into finding your stalker.
“What about Spencer? I need to make sure he’s okay…”
“He’s in good hands. He’s going to be fine. We have to focus on tracking down the one responsible for this. Okay?” Morgan’s plea sounds more like an order as he pulls you to your feet, keeping his hands braced on your shoulders in case you were lightheaded from crying.
“Okay-" You muster up a small nod, taking a shaky breath in through your nose.
“C’mon, let’s go tell the team.”

The team had reacted how you’d expected them to.
They were surprised and bewildered by the situation, especially Prentiss, who just kept saying:

Hotch then brought attention to you, seeing that you were struggling, your eyes still red and slightly bloodshot. “Okay... We’re gonna put together a profile to track down your stalker... but for now, go home, alright? You need to get some rest.”
He looked to Morgan who gave an affirming nod, agreeing with Hotch's decision. “I need to see Spencer first-“
Hotch turns to Morgan, gesturing for him to join you. “Go with her.”
Morgan has no objection to Hotch’s order, and he quickly makes his way across the room to join you on your way out. You can sense the protective, domineering aura radiating from him as you two walk out of the conference room, ready to take the trip to the hospital where Spencer was being treated.
You take a short stop on the way to get some flowers. It’s a little cliche but you wanted to do something to express your regret over what happened to him, and flowers were the only thing that came to your mind.
You leave Morgan in the car as you step into the quaint flower shop around the corner from your house, greeted by the sweet aroma of blossoms and a kaleidoscope of colours from the arrangements of flowers covering the walls.
“Oh hello sweetheart, it’s been a while since you’ve given us a visit.” The sweet voice of the flower shop’s owner calls your attention, and you give her a soft smile as you walk over to her, giving a short wave to her two children also working behind the counter. “Hi Mrs Fontana, yeah it really has been a while huh? How’s everything holding up?”
You loved the homey vibe of the shop, family-owned businesses always appealed to you for some reason, it made them feel more genuine, rather than a large corporation solely focused on making as much money as possible.
“Everything’s well my dear,” She gives you smile as you walk over. “What can I get for you today?”
“I’m not actually sure yet, I’m looking for something to bring to a friend of mine in the hospital,”
“Hospital? Is everything okay?” Your confession caught the attention of Mrs Fontana’s two children, who joined the two of you in your conversation with shared looks of mild concern.
That was another thing you appreciated about small businesses like this, it meant you could form a friendly relationship with the people who ran it.
“He was pretty badly injured, so I just want to get something to show my sympathy you know?”
Rachel, Mrs Fontana’s daughter gave you a soft nod with a sympathetic look of her own. “Yeah i get you, one of my friends ended up in the hospital a little while back through a car accident so I know how it makes you feel,”
“What happened? if you don’t mind me asking of course, it might help us pick out a proper arrangement for you,” Mrs Fontana’s son Riley piped up next, leaning his hands against the counter.
“He got into an accident, he was rushed off to the hospital a few hours ago and I’m on my way to go and visit him now, joys of being in the FBI I suppose,” You keep the details of the origins of Spencer’s injuries to yourself, not wanting to dump all of your problems on the three, no matter how well you’d become acquainted with each other since you’d started frequenting the shop a few months ago.
“I can imagine-” Rachel reaches over the counter to place a comforting hand on your own.
One furrowed expression of consideration later, you were being led towards the back of the shop to have a look at some of the flowers. “Traditional sympathy bouquets usually contain tulips, carnations, and hydrangea, but there’s no real ‘rules’ for what can and can’t go into them,”
You give a small nod at Riley’s explanation as he pointed towards a few collections of brightly coloured tulips. “Yellow and white are the best colours to go for if you’re looking for a symbolic bouquet, although I know that some people don’t really believe in colour symbolism so it really is up to you,”
You mull over your options for a moment as your eyes flicker across the different collections of possible flowers.
“Or if you’d prefer something more simplistic, roses are always a great option, they can mean so many things depending on the context in which they’re given,” Rachel shrugs lightly as she walks past you and Riley to grab a few clusters of lily of the valley for a separate bouquet that she was putting together.
You end up choosing a mix of purple tulips and roses, Spencer’s favourite colour, and you watch as Riley organises them into a neatly wrapped bouquet. “Thanks Riley,”
You give him a soft smile of appreciation and he returns it with one of his own. “It’s no problem at all,”
You bid the three florists a goodbye as you rejoin Morgan in the car, propping the flowers gently in the backseat.

You absentmindedly mess with the brown paper wrapping of the bouquet as you enter the hospital, leaving Morgan to speak to one of the receptionists to find where Spencer had been roomed as you focused on keeping yourself from falling into another potential panic attack.
“He’s in room 315, up the hall on your right, although he’s still unconscious.”
Morgan and you make your way to the room, and when you get there the door is slightly open. You can see Spencer lying on a bed with bandages all over his abdomen and one over his nose.
He’s fast asleep.
You sigh softly as you walk into the room, half relieved he’s stable and half guilty that he’s in this position in the first place, and you pull up one of the plastic chairs from the corner of the room to take a seat next to his hospital bed, carefully leaving the flowers on one of the side tables.
Morgan stands back, his eyes flicking over to you as he leans against the wall.
It was a weird thing to think, but... Spencer looked quite peaceful when he was asleep, considering the circumstances of the situation.
You hesitantly take one of Spencer’s hands in in your own, the frigid coldness of his fingers again becoming apparent compared to the warmth of your palm as you cupped his hand between both of yours.
“Can I- have some privacy for a minute? Please?” You give Morgan a half pleading look as you squeeze onto Spencer’s hand slightly, to which Morgan responds with a small nod of reassurance, stepping out of the room and closing the door behind him.
The minute the door clicks shut you feel the tears threaten to spill from your eyes again, and you take a sharp breath in through your nose in a fruitless attempt to combat them.
“I know you can’t hear me right now but I just want you to know that I’m so sorry…” The first tear falls hot against the skin of your cheek, landing against the back of your hand as you lower your head towards the floor. “If I’d’ve just kept it to myself-“
You cut your ramble short as your voice cracks.
“I put you in danger because I was being selfish instead of thinking logically, and I’m so sorry…”
Spencer makes a slight but noticeable movement, his eyes fluttering open slowly as they adjust to the harsh white lighting of the hospital room.
He blinks the sleep out of his eyes and his vision focuses... eventually landing on your tear-streaked face, and he mutters out your name in a mix of drowsed-confusion and concern at the fact you were crying at his bedside.
“What the- hey, you- what’s wrong?”
Of course the first thing Spencer would ask whilst waking up from a grievous assault was if you were okay.
“What’s wrong with me? You’re lying in a hospital bed half beaten…”
You remove one of your hands from his to wipe your cheeks with the back of your hand, trying to regain a fraction of composure instead of breaking down in front of him.
“Hey- Hey no-“
Spencer’s face is filled with concern and worry as he sees you on the verge of a breakdown, and he tries to sit up for a moment, but he grimaces when he feels his wounds. “Hey, it's okay, okay? I’m okay, please…”
“Spencer don’t sit up-“
You get out of your seat to encourage his shoulders back down against the hospital bed as he tries to comfort you despite him being the one that is actually in need of comforting. He begrudgingly obliges to your gentle insistence as he moves to lie down again, although propping himself a little higher up against the angled head of the bed so that he wasn’t completely lying down, and he puts his hand gently on your cheek to wipes away a tear that you’d missed. “Please don’t cry...”
His hands are oddly comforting, like a cold shower on a sunny day. You don’t know why, but something about these small touches that you had with Spencer felt comforting in a way that you couldn’t even begin to fully comprehend.
“Hey, please... I’m okay. You need to be calm, okay? It's okay. I’m okay.”
Was that his go-to line for comforting someone when he himself was clearly hurting? If so, you found yourself rather endeared by the whole thing if not more guilty.
That soft, velvety voice of his saying, “you need to be calm.” was weirdly soothing.
“This is all my fault I’m so sorry-”
Tears freely cascade down your cheeks as you shift to take a seat on the edge of the hospital bed, squeezing one of his hands in between both of your own as you apologise.
Spencer looks at you with concern in his eyes, but he tries his best to reassure you. “Hey, look at me. Please don’t cry. This is not your fault. I promise you that.”
He brings your hand to his chest, gently pressing it over where his heart is as he rubs his thumb over the back of it.
Feeling the gentle strokes of Spencer’s heartbeat under your palm helped a little, but it didn’t stop the guilt from flowing through your mind, overwhelming your senses. “I lead him right to you…”
“Hey... hey look... look at me.” Spencer lifts your chin up and makes eye contact once more. “You don’t know if that’s what happened. Okay? You don’t know.”
Spencer sounds so soothing and genuine, it’s hard to doubt what he’s saying.
As you make eye contact with him you see something in his eyes that you hadn’t seen before. It was small and subtle, but there was something there... a longing of some sort.
“No Spence I do know-“
You wipe the sleeve of your free hand over your cheeks in another attempt at wiping them from the dampness of your tears. “He left a quote from the book, in your hand,”
Spencer pauses, and the corner of his lip tugs into a frown at your revelation. “...what?”
You can see Spencer’s eyes flicker with concern as he takes the information in.
“I never should have brought you into this I’m so sorry Spencer…”
Spencer is surprised how much you’re blaming yourself when he doesn’t think the situation is entirely your fault at all.
“Hey.” Spencer brushes the hair away from your face. “Stop saying sorry.”
For a moment, there's an electric moment between the two of you as Spencer continues to touch your face. His eyes linger over the remnants of tear stains on your cheeks.
“He’s escalated from sending me things to hurting people that I care about…” You lean your cheek into the palm of Spencer’s hand.
“You’re hurt, because of me."
Spencer’s eyes continue to flit over your form as the silence between the two of you hangs heavy in the air.
His chest rises as he takes a deep breath, his hand still lingering on your cheek. He looks down at your face as his hand traces an outline against your cheek and jaw line. “It’s not your fault… I promise. You couldn’t have known.”
“I just- You mean so much to me Spencer, and I-“ You cut yourself off with a deep breath through your nose, trying to calm yourself down enough to word your sentence properly.
“I can’t bare to see you like this… Especially when i’m the reason it happened…”
“Hey no... listen... I’m okay.” Spencer gently caresses your cheek with his thumb.
“I know… I just-“ You let out a soft sigh at the gentle sensation of his thumb on your cheek.
“I’m so sorry…”
Spencer continues to look at you for a moment, his eyes taking in your appearance before locking with yours.
There are flecks of light green throughout his golden brown irises, and you find yourself on the verge of getting lost in the way the colours shift in the overhead lights.
Spencer gives a soft sigh, muttering your name softly under his breath. "It's okay. Stop apologising."
“Sorry-“ You cut yourself short as you instinctually apologise for apologising, pursing your lips together with a nod instead.
“I just wanna put this guy behind bars… Before he hurts anyone else…” Your fear that spencer is still in danger begins to make you feel increasingly regretful about coming to visit him.
This guy had obviously attacked Spencer because he was a ‘threat’ of some kind to the stalker’s objective of forming a romantic relationship with you, and you feared that you continuing to see him would only put him in more danger.
"I know you do..." Spencer’s hand moves from your cheek to caress your hand slightly as he speaks, his voice barely above a whisper. "And we will. We will do everything we can to do that."
Spencer’s eyes flicker downwards in the briefest of glances before locking his gaze on yours again. "Please... please stop blaming yourself."
“I’m sorry…”
“No more sorries,” Spencer’s voice is soft as it caresses your ears. “You did nothing wrong.”
Spencer tugs on your hand gently with his fingers so your eyes flit back to his. “I’m okay,”
His eyes are clear and they are only gazing at yours.
"I just- I love you a lot spencer, I just want you to be safe…" You feel a few more tears rolling down your cheeks as your guilt threatens to make you cry again. “I’m putting you in danger just by being here…”
Spencer lets out a small sigh and tilts his head. "Hey... hey, listen to me."
Spencer caresses the back of your hand with your thumb to get your attention.
"Stop apologising and just... stop beating yourself up, okay? None of this is your fault, okay?"
Spencer's voice is soothing as he speaks to you, and he makes eye contact, caressing your arm gently. "If I had the choice to go back, I would let you stay over all over again."
“Spencer-”
“No, listen to me. I would not change a single thing. I’m just sorry I couldn’t help you solve this earlier so this didn’t have to happen.” You can see something in Spencer's eyes as he interrupts your attempt to chastise him, a hint of longing as though there’s something he’s trying to keep hidden.
There’s a soft smile on his face as his eyes flicker over your face.
Spencer slowly props himself up on his elbow as he can look at you properly, ignoring your soft plea for him to remain lying down.
Your eyes flit between Spencer’s chest and the buttons of his hospital gown as they shift with his body. It makes your stomach tingle. You can see the steady rise and fall of his chest, and a part of you wants to collapse into his arms and let him tell you that it’s all going to be okay.
“Can I ask you something..?” Spencer’s question is quiet and hesitant, and if your ears weren’t hyper aware of his voice your not sure you would have heard it.
You give him a small nod, eyes flickering away from his chest to look at his eyes once more
"What does... love mean to you right now?"
Spencer’s eyes lock with yours like they did before, although this time there’s a silent insistence in them.
"Because right now, you’ve said that you ‘love’ me, and I don’t know what that means to you."
"I-"
You blink a few times as you pull away from him a little further, straightening your posture to sit up properly again as your mind computes his question.
You can almost see the thoughts spinning through Spencer's head as he monitors your expression. His eyes still flicker between yours, and you can hear the heavy breathing of his chest as he stares at you.
The longer you sit there staring at each other, the more you start to realise how close Spencer's face is to yours. Even his breath is so close to yours that it's making your heart rate rise to the point where you can feel it in your throat.
"I- You’re one of my closest friends Spencer…" You instinctively dry swallow as if it was going to help you get out of the conversation "I don’t want to lose you- I can’t risk that, not after everything we’ve been through,"
Your words seem to have triggered something in Spencer's mind, as his eyes quickly fix on yours, your name falling from his lips as he shifts himself to sit up further.
Spencer leans in towards you slightly, his lips slightly parted. "I can tell that whatever 'love' is to you... it's not the way that friends love each other. It's different. And I think... I think I'm starting to understand why." The words seem to fall out of Spencer's lips like they're burning to be let free.
"I... love you."
Spencer blurts out the words with genuine emotion, his eyes filled with warmth and compassion, his eyebrows furrowed together.
"I love you, and... and the feeling I get when I'm around you... it's different than anything else I've ever felt, and-" Spencer cuts himself off before saying anything else, his voice breaking towards the end as if he's trying to hold back tears.
His words cause your heart to drop in your chest. But not the type feeling you’d get after your anxiety lifts after solving a case. Not the type of feeling you’d get after the man who you’d been subconsciously pining after for years has just confessed his love for you.
It was that feeling you get when you expected something bad to happen and it turned out even worse than you could have possibly imagined.
"Spencer…”
Your simple utterance of his name seems to cause Spencer to lose any restraint he had left.
“I'm so goddamn in love with you…" he whispers so softly you can barely hear it.
Spencer's eyes are locked with yours, a deep passion in his eyes that he doesn’t think you’ve ever seen from him ever before.
"I-" Your mind seems to short circuit as he doubles down on his confession, and you feel as though you’re going to throw up from the pit you’re feeling in your stomach.
"I can’t do this- I’m sorry-"
You shake your head as you stand up from where you were sat on the edge of Spencer’s hospital bed, a sudden wave of lightheadedness washing over you as you do.
"Please don't do that." Spencer’s voice is gentle as he tries to reach out his hand towards you. "Don't just... hide from this because you're scared, okay?"
Spencer pauses for a moment before speaking again, his voice a bit of a murmur. "You... you love me too, don't you?"
The words are quiet and uncertain as he seems to question himself, his eyes never wavering from yours.
"I’m sorry Spencer-" You subconsciously retreat from his outstretched hand, pulling on your sleeves with your own. “I should go-”
"Wait-" Spencer’s voice is filled with emotion, his beautiful hazel eyes silently begging you not to leave as they glass over with tears.
"Please... Can I please have a moment to just..." Spencer pauses for a moment, searching for the words he wants to say.
"I don't want to let you walk out of this room so you can pretend you don't feel the same way that I do." Spencer takes a breath and tries to calm himself. "Please... please just stay... let’s talk about this…"
"Get some rest Spencer…" Your voice wavers as you walk away from the bed to leave the room.
“No, wait, don't-”
Spencer's voice trails off to a murmur as you close the door behind you, leaving him alone in the hospital room.
Spencer drops back against the bed, and as he spots the bouquet left on the side table the tears that had welled in his eyes finally trickle down his cheeks.
Was he making a mistake...?
No, what is he thinking?
You just need time to process everything... that's all.
Spencer sighs and closes his eyes, trying to keep his mind off of the fact that the love of his life had just walked out the door.

It was one of those days that most people loved, a day where public displays of affection were adored instead of frowned upon. You could see flowers being purchased everywhere, the lovesick looks of couples holding hands as they carry overpriced presents and sometimes balloons if they wanted to shove it in your face. It wasn’t that you hated Valentine’s Day as such, it was more so the fact you had never had a real valentine to call yours.
Luckily, it wasn’t something that was spoken much of around the compound as few actually had living loved ones to celebrate with. Despite those who longed for a Valentine, you couldn’t help but smile as Clint would pass by with Natasha helping him with final preparations for his wife. He nearly crushed the red roses in his grip as Natasha fixed his tie, patting his chest before sending him off like a proud Mother.
“Ugh, they grow up so fast.” She mutters under her breath as she turns around, spotting you curled up reading in the main living space. “You not heading out anywhere?” She calls out, catching you off guard as you lift your head up.
Forcing a small smile, you shake your head in response. “Not this year, Nat.” You comment, trying to not let it bother you too much.
“But it’s the weekend before V Day.” She sits beside you, patting your arm before a wave of sadness crosses your face and she backs down. “Sorry, girl.” She mutters.
“No no,” You protest, turning to face her. “it’s just another day anyway.” You explain, oblivious to Sam, Bucky and Steve who are wandering down the corridor leading toward you and Natasha.
Bucky is fully engaged in a conversation with Sam whilst Steve trails behind, too deep in thought about Valentines Day. “-oh wait.” Bucky pauses, holding his arms out to prevent the trio from moving any further.
“What’re you doing, Buck?” Steve sighs as both Bucky and Sam turn to face Steve with that mischevious look that he’s grown to despise.
Lifting his finger to his lip, Bucky motions to the living space as you continue to speak up. Steve tenses, feeling his cheeks tint with rose as you discuss Valentines Day in confidence with Natasha.
“And it’s not like I’ve got a Valentine, or ever had one.” The last part of your sentence trails off and Natasha raises an eyebrow in surprise. “Oh come on, Nat.” You chuckle, nudging her lightly. “Don’t seem so surprised ‘bout it. I mean, look at my job, my career. Hardly able to meet normal people.” You half joke, but Steve can hear the sorrow in your voice, that hint of regret about not leading a normal life.
“I’m sure someone out there is perfect for you, Y/n.” Natasha smiles, knowing exactly who if they had the guts to just admit it. “I know it.” She reaches over, taking your hand and giving it a light squeeze.
Steve quietly sighs in the corridor, turning back around and walks in the opposite direction as Bucky whisper shouts his name. “God, he just won’t do it.” Bucky mutters, shaking his head in disbelief as he and Sam walk into the living space as your conversation with Nat comes to a halt.
“Thanks, Nat.” You sit quietly for a few minutes as you lean back on the sofa, noticing Sam and Bucky walking toward you with furrowed brows. Turning your head to face Natasha, you quietly mutter to her. “I just wish I believed it.”

Opening your eyes, you let out a deep sigh realising today was the day. “Just another day.” You mutter under your breath, hoping that if you say it enough it might just register as true.
As you walk from your suite and into the shared kitchen, you notice Nat sitting with Steve. “Mornin’ Y/n.” Natasha calls out and you smile before turning away to make a drink and remain blissfully unaware of Steve looking like a deer caught in headlights by your presence. “Just tell her, Steve.” Natasha mutters to him as you stand on your tiptoes reaching for a mug, missing Steve shaking his head sorrowfully before you turn back around.
“How’re you guys doing today?” You ask, taking the seat beside Steve with a soft smile as you ignore the flutters that grow in your stomach, silently forcing them back down.
Steve clears his throat, hoping you can’t hear the intensity of his heart beating as you sit within such close proximity to him. “Doing good,” Steve manages to force the words from his lips, to which you respond with a curt nod before looking to Natasha with wide eyes.
Natasha chuckles silently to herself at the pair of you. Both oblivious to the others feelings and dance around one another for what feels like years- when in reality it’s been about seven months, but that was long enough.
“Swell as always,” Natasha lifts her mug up to you as you chuckle, a sound that causes Steve’s ears to perk up as he glances down at your tired but beautiful state. “well, Happy Valentine’s Day.” She speaks up, and both you and Steve look at her with blank expressions.
“Oh, I kinda forgot.” You lie through your teeth, taking a glance up to Steve who hides his face in his bowl of cereal. “Not like I was getting anything anyway.” You shrug your shoulder and Steve silently swears under his breath, wishing he had just taken everyone’s advice.
As Steve opens his lips to speak up, Bucky runs in. “Hey, doll?” He calls out to you as you point to yourself in surprise. “That’d be you, Y/n.” He adds, and Steve hates how suave his best friend effortlessly is.
Rising to your feet, you walk hesitantly away from Steve. “What’s up, Buck?” You question as a smile crosses his lips as he glances back to Steve before focusing on you.
“There’s a gift for you,” He states and you merely shake your head.
“That erm, nope that can’t be right.” You dismiss it with a short laugh that escapes your lips. “I don’t, I,” You stumble over your words as Bucky takes your hand, taking you down the corridor.
Natasha quickly looks at Steve with a growing grin. “You did it, didn’t you?” She questions, but as Steve lifts his head up to reveal a frown, reality sinks in. “Oh,” Natasha mutters. “she, she actually has a Valentine?”
“Yeah,” Steve replies as he stands up. “guess I was too late, as always.” He harshly comments, hearing Natasha following behind him as they hear the sound of your laughter echoing in the reception.
Walking into the reception, Steve’s eyes widen at the sight before him. “You gotta be shittin’ me.” He mutters as he crosses his arms over his chest to hold his heart in place.
You’re being consumed by a giant teddy bear, one that is almost as tall as the ceiling. Steve watches as you sit on one of its legs, hugging it tightly with a bright smile on your face. “Could’ve been you, Steve.” Natasha makes a passing comment before she walks over to you, evident shock on her face as she sits opposite you on the teddy bears legs.
“I can’t believe someone got you this.” She shakes her head, and your eyes widen as you look up. “Is that a card?” Natasha questions, following your eye line as you nod.
“Yeah, I, I think it is.” You rise to your feet, looking up at the teddy bears bow around its neck. “I think I could get it.” You say with less confidence as you close your eyes, focusing and feel yourself becoming weightless.
“If you just did something, Steve, this would be you.” Bucky walks over, standing beside Steve as they watch you rise from the ground, your arm outstretched with determination.
Your open your eyes as you feel the card against your fingertips. “I got it!” You call out as your eyes meet Steve’s, and that weightless feeling disappears as you begin to fall.
“Y/n!” Steve yells as he runs over, dodging you from falling to the ground and back into the teddy bear’s stomach, allowing you a softer landing.
Clearing your throat, you brush yourself down as you slowly stand back up. “Maybe it’s too soon to test that out again,” You half-laugh, looking over to Steve who pants as he nods to you.
“You alright?” He asks, his voice lacing with concern as he walks toward you.
“I’m okay.” You admit, moving closer as you lift your arms up, giving him a tight hug. “Thank you.” You whisper to him as warm spreads through his system as your lips brushed against his ear.
Pulling away, you look down at the card with a smaller smile, tearing your eyes from Steve. “Well, who’s it from, doll?” Bucky pipes in, standing beside Steve as all eyes remain locked with the card, all eyes except Steve’s.
As you open the card, it contains a small note. “To Y/n, may your Valentine’s Day be cosier with this in your life. All my love, T x.” You read out the note, looking to Natasha who wears a blank expression. “T? T could be anyone.” You sigh, folding the note back up and into your pocket.
“Tony, Thor, oh maybe Thomas from security!” Natasha suggests, knowing the security guy has been giving you the eye for a few weeks.
You laugh lightly, dismissing it. “I don’t know, but I guess that’s the joy of Valentines?” You ask, looking up at the teddy. “Now how the hell do I get it to my suite?”

As Valentines Day draws to a close, you are still none the wiser as to whom your Valentine was. But weirdly, you aren’t as concerned as you anticipated yourself to be.
Sitting down on the roof, you curl up beneath a blanket from the small area Tony helped you set up. It was a cosy spot with fairy lights draped above you on beams and outdoor furniture nailed to the ground. You felt like you were away from everything, even if it was just for a short while.
Steve walks into the living space, his eyes darting around. “Where’s Y/n?” He calls out, seeing Nat and Bucky lift their heads up.
“Why’d you wanna know?” Natasha quips, and Steve huffs.
“Oh, that struck a nerve.” Tony speaks up, removing his glasses as he leans forward. “This about the teddy I got her?”
All eyes turn to face Tony now. “You, YOU?” Steve loudly questions as Tony stands up, nodding. “You’re Y/n’s Valentine? You?” Steve repeats the question, watching as Tony rolls his eyes.
“Why is that so surprising? Y/n is a dear friend of mine, no offence to the rest of you and I knew it’d cheer her up. Did it or did it not, huh?” He looks around, seeing Bucky nod along even though it pains him to agree with Tony. “See? Even Tin man agrees.”
“So you did it to make Y/n happy? That’s all?” Steve steps closer, seeing Tony nod.
“Well you don’t have the balls to, so I took matters into my own hands with Pepper’s help.” Tony responds as his phone starts to ring. “Speaking of,” He answers his phone, heading out of the room. “hi Honey, yes, I’ll get going. No, no I’ve not forgotten the dinner reservation.”
The sound of Tony’s footsteps as he runs echoes in the silence as eyes revert back to Steve.
“She’s on the roof.” Peter comments, not lifting his eyes from his phone. “She wanted some downtime.”
Steve lifts his head up, a smile lacing his lips as he realises that there’s still a chance. “Thanks, kid.”
“Steve?” Natasha calls out as he begins to walk away. “Just, just tell her okay? Don’t mess her around.”
“I won’t, I promise.” He tells Nat truthfully before he heads to the lift, trying to compose some form of speech in his head as his thoughts cloud over with the realisation that this is it, he can finally tell you how he feels.
Your ears perk up as a small ding sounds from the lift doors. Turning around, you notice Steve walking toward you, exiting from the lift.
“Hey,” You call out, rising to your feet as you keep the blanket tightly wrapped around you, fighting the shiver that spreads through you from a mixture of the cold and growing nerves. “what’re you doing up here?”
Steve steps closer, looking down as the blanket drapes over the roof tiles, catching dust. “I, I just wanted to come and check if you were alright? You know, after the fall.” He explains, catching the small smile that crosses your lips for a split second.
“Yeah,” You tuck your hair behind your ear, turning to sit back down as Steve sits beside you. “I mean, I feel fine. It just,” You sigh heavily. “it feels like I’m falling back again, that any progress I made has just gone.” You feel yourself being vulnerable, opening up willingly as Steve listens, refusing to interrupt. “Like, after everything I wasted my energy and progress on retrieving a stupid valentines card.” You scoff, thinking about the giant bear in the entrance to your suite.
“Least you got a giant teddy.” Steve jokes, catching your eye as you laugh lightly, nodding along. “And about the whole thing, Y/n. It’s a small bump, that’s all.” He reasons with you, knowing all too well how it feels. “You’ll overcome this, just like you have done before.” His hand reaches out, a surge of confidence rising through him as he takes your hand in his. “I believe in you, you know?”
You don’t even look down to see his hand in yours as you feel his gentle thumb brushing over yours.
“Thank you, Steve.” You mean it, and he knows you aren’t just saying that as your eyes remain locked with his, refusing to part. “I just forget sometimes that, that this is it. I, I’m not living a normal life where I’d still be a barista.” You chuckle, thinking back to what could be considered a simpler time.
“Do you ever miss it?” Steve questions, seeing you pause as you contemplate your response before you shake your head.
“Weirdly I don’t.” You tell him. “I, I never fitted in with anyone. The people I knew, they weren’t all great people.” This was information that Steve had never heard. “I was manipulated a lot, and that’s how SHIELD found me due to the situations I ended up involved in.”
“And then you ended up here.” Steve finishes, seeing you nod in response. “I, I don’t miss things, not anymore.” Steve thinks aloud. “I used to. I missed the simplicity of living, but I realised that here I’ve got a family, friends, a purpose.” He rambles on as you remain focused on him, unable to tear your eyes away as Steve reminisces on his past.
“I’m glad I was found.” You tell Steve as you shuffle closer, feeling Steve remove his hand from yours as he raises his arm, allowing you to curl up into him. “Otherwise I’d never have met, Bucky, or Wanda, or Nat,” The list goes on, and Steve looks down at you, waiting for his name. “oh and yeah, you too.” You joke, laughing happily as Steve holds his chest, feigning pain. “You’re a special one, Steve.” You tell him, and Steve releases his hand from his chest, slowly moving it toward your cheek.
“You mean that?” His eyes search yours for any sign of uncertainty, watching as you shake your head.
“Yeah,” You whisper. “I really do.”
Steve rests his hand against your cheek, feeling you lean into the embrace. “I know I’m a bit late, but will you be my valentine, Y/n?” Steve asks as you smile up at him.
“Valentine's day is a bit overrated I think.” You joke. “But how about a date tomorrow?” You suggest and Steve nods.
“It’s a date.” He smiles to you, watching as you lean against him, your arms wrapped around him as you pull the blanket further to cover him too. “Sorry for being a late valentine, Y/n.”
You smile to yourself as you close your eyes, comfortable in his embrace. “Some things are worth the wait, Steve. You’re lucky that you’re one of them.” You joke as his chest rises and falls in laughter before you both sit in a comfortable silence as valentines day comes to an end, and for once you finally found a valentine to share it with.

What are the main findings? Response: In the NIH sponsored SPIROMICS study we demonstrated that symptomatic, tobacco exposed individuals have frequent exacerbations. Many of these individuals are treated with the same inhaled medications that have shown benefit in COPD, but we don’t have any evidence basis for this practice. MedicalResearch.com: What should readers take away from your report? Response: The first is that we can't assume patients have COPD without doing spirometry. Only about a third of patients in the US with a diagnosis of COPD have had confirmatory spirometry. Pulmonary function testing helps us know which patients benefit from long acting bronchodilators. MedicalResearch.com: What recommendations do you have for future research as a results of this study? Response: The patient population we studied in the RETHINC trial needs to be tested with different types of medications, other than bronchodilators, to see how we can improve their symptoms. Salient Features of the Indian Constitution
This article is written by M.S.Sri Sai Kamalini, a fourth-year student currently pursuing B.A.LLB (Hons) from School of law, SASTRA. This is an exhaustive article which deals with the various salient features of the Indian Constitution.
Introduction
The Constitution of India is a very dynamic creation of our lawmakers. The Constitution of India as we all know is a supreme law of the country and every citizen of our country has to abide by the constitution.
The Lengthiest Constitution of the World
The Indian Constitution is one of the lengthiest constitutions in the world and it is also very detailed. There are 12 schedules and 448 articles in our Constitution. The Indian Constitution has incorporated various articles by taking inspiration from the various constitutions around the world. As we all know, India is a very diverse country and it was necessary to draft a long Constitution incorporating various provisions in order to accommodate various differences. The parent document for drafting the Indian Constitution was the Government of India Act 1935, and that document itself was very lengthy. The Constitution makers found it necessary to incorporate various provisions to provide special attention to States like Assam, Mizoram, and Nagaland. Various provisions were also incorporated to uplift the Scheduled Castes and Scheduled Tribes.
Establishment of a Sovereign, Socialist, Secular, Democratic Republic
The Preamble of our Constitution provides India to be a Sovereign, Socialist, Secular, Democratic and Republic Country. There are also various other terms in the Preamble which ensure equality and protect people. The various other terms are Justice, Liberty, Equality, and Fraternity.
SOVEREIGNTY
The term Sovereignty was incorporated in the Preamble to provide supreme power to the Government. The term Sovereignty is the backbone of our Indian Constitution that protects the authority of the people. Sovereignty is an essential factor of every State. The term “sovereignty” as applied to states implies ‘Supreme, absolute, and uncontrollable power by which any state is governed, and which resides within itself, whether residing in a single individual or a number of individuals, or in the whole body of the people’. The Sovereignty in India is of two types:
Internal Sovereignty- The States have the power to govern themselves and make laws in certain matters.
External Sovereignty- The Government is the supreme authority and can acquire or cede any part of the territory for proper reasons.
SECULARISM
It is mandatory to incorporate this term to promote peace between various communities in our country. Secularism promotes the development and unity of various religions. The term “Secular” was added by the 42nd amendment in the Preamble. In the case of S.R Bommai v Union Of India, it was held that “in matters of State, religion has no place” and also said that secularism is one of the basic features of the Constitution. In the famous case of Indira Nehru Gandhi vs Shri Raj Narain & Anr, held that the State shall not discriminate against any citizen on the grounds of religion.
DEMOCRACY
Democracy is an ancient concept that is followed by many south Indian rulers from time immemorial. Democracy provides people with the power to govern. The representative form of the Government is suitable for governing our country due to the huge population. In the case of Mohan Lal Tripathi vs District Magistrate, the meaning of the term “Democracy” was discussed and according to the case it was held that “Democracy is a concept, a political philosophy an ideal which is practised by many nations that is culturally advanced and politically mature via resorting to governance by representatives of the people elected directly or indirectly”. The main reason for incorporating democracy is to provide freedom to the people to choose their own representatives and to save them from the tyrant leaders.
SOCIALIST
The system of socialism promotes equality among people and ensures the welfare of people. The term “Socialist” was incorporated by the 42nd amendment. The term Socialist was discussed in the case of Samantha v State of Andhra Pradesh, and according to the case,” the term socialist is used to lessen the inequalities in income and status and to provide equality of opportunity and facilities”. Many leaders were interested in the concept of socialism, especially Jawaharlal Nehru was very much interested in this concept as he was inspired by the Russian Revolution. There were also other famous leaders like Jay Prakash Narayan who helped in the development of this concept. The concept of Socialism expels capitalism which is considered a threat to the economy. There were developments in economic policies to promote the concepts of Socialism.
REPUBLIC
The concept of “Republic” was borrowed from the Constitution of France. The term republic provides the people power to elect their own representatives. The term republic is the basis of our constitution as it ensures there would be no hereditary rulers and also ensures that the election would be happening in our country. The President of India is an elected head of the State for a fixed tenure.
JUSTICE
The Preamble of the Constitution of India guarantees three types of justice to its citizens like:
Social Justice- The concept of social justice promotes equal treatment of citizens and promotes the rule of law. This term ensures that there would be no discrimination among the citizens on different grounds. The fundamental rights also provided in Part 3 of our Constitution also ensures social justice.
Economic Justice- The concept of economic justice avoids discrimination between genders, provides equal opportunity to work, and ensures the equal distribution of wealth.
Political Justice- This term provides all citizens to participate in the political proceedings.
LIBERTY AND FRATERNITY
The term Liberty and Fraternity is provided in the Preamble of the Indian Constitution. The term liberty and fraternity was used in the French revolution.
Parliamentary form of Government
The Bicameral Legislature system is followed in our country. The Unicameral legislature system is followed in countries like Norway. The law making procedure is easy in the unicameral legislature but the bicameral legislature is effective as there would be a lot of discussions and deliberations before making legislation. Articles 74 and Article 75 is concerned with the Parliamentary system at the centre and Article 163 and Article 164 is concerned with the Parliamentary system at the states. Article 74 of the Indian Constitution provides that there should be a Council of Ministers with the Prime Minister and Council of Minister can aid and advise the President. Article 75 of the Indian Constitution deals with the other provisions relating to the appointment of Ministers.
Parliamentary v. Presidential System
The Presidential form of Government is followed in countries like the United States of America. The President is the head of the State in the Presidential System of Government. The Parliamentary system is preferred over the Presidential system as it ensures the equal distribution of power and also power is not within the hands of a single person. The drafters of our constitution did not prefer the presidential system as the executive and legislatures would become independent of each other. The makers felt that this would be an issue afterwards.
A unique blend of rigidity and flexibility
The Indian Constitution is neither rigid nor flexible, this is also one of the reasons for its length. The famous example of the rigid constitution is the Constitution of the U.S., and it is known as a rigid constitution as the amendment process is very difficult. The Indian Constitution is not very difficult to amend, as the Constitution of The U.S.A. It has gone through 103 amendments so far but there are certain steps to be satisfied before bringing in the amendment. Thus the Indian Constitution is a unique blend of rigidity and flexibility.
Fundamental Rights
Part III of the Indian Constitution deals with fundamental rights.
Article 14
Article 14 of the Indian Constitution guarantees the right to equality. Article 14 is applicable not only to citizens but also to corporations and foreigners. According to this Article, it is the duty of the state not to deny any person equality before the eyes of the law and to provide them equal protection of laws within the territory of India. The term “Equal protection of laws” was discussed in the case of St.Stephen’s college vs. The University of Delhi, according to this case it was said that the state has to provide equal protection of laws to every citizen and non-citizen in this territory and no one should be denied such protection. In the case of Chiranjit lal Chowdri vs Union of India, it was said that “there is no doubt that Article 14 provides one of the most valuable and important guarantees in the Constitution which should not be allowed to be whittled down.” The concept of the rule of law is incorporated in this Article. The concept of rule of law was developed by Dicey. According to Dicey, there are three main aspects of this rule of law,
Equality before the law.
Absence of arbitrary power and discrimination.
The importance is given to the rights of the individual.
Article 14 allows differentiation in certain situations when there is an intelligible differentia, that there should be a proper reason for differentiating. The differentia which has been applied in the classification should have an essential connection with the objective which is sought to be achieved by the classification. Article 14 does not permit any class legislation. The classification should be reasonable and the persons in the same situation cannot be treated differently. For example, the persons who are under 18 years of age are incompetent to vote is a reasonable differentiation. In a famous case, it was mentioned that the prisoners from India and prisoners from Europe who are in Indian Jails convicted for the same crime must be treated in the same manner.
Article 15
Article 15 prohibits discrimination on the grounds of caste, race, religion, sex and place of birth. According to this article, there should not be any discrimination in:
Accessing shops, public places, hotels and other public places of entertainment.
The use of places of public resort-like wells and shops that are maintained wholly or partly out of State funds or dedicated to the use of the general public.
There are certain exceptions to this Article provided in clauses 15(3) and 15(4). They are:
The State can make special laws for women and children and those provisions should be for their betterment;
This Article will not prevent the state anyway from making special provisions for the advancement of any socially or educationally backward classes of citizens or for the Scheduled Castes and Scheduled Tribes.
The Hon’ble Supreme Court, in the case of G.M. Southern Railways v. Rangachari, held that Article 15(4) of the Indian Constitution to be an exception to Article 15(1) and nothing provided in the Article15(1) will affect the State from making any special laws for the improvement of backward classes of citizens. In the case of Dasaratha Rama Rao vs State of Andhra Pradesh, it was held that Article 15 is a particular application of the general right of equality provided for in Article 14. The concept of gender equality provided under Article 15 was also discussed in a case like Vishaka vs the State of Rajasthan.

Article 16
Article 16 of the Indian Constitution guarantees equality of opportunity in matters of public employment. In the case of J.K v Triloki Nath Khosa, it was held that even though Article 16 provides equality of opportunity, the state can prescribe all the necessary qualifications and tests that are necessary for providing employment. In the case of M.R.Balaji vs Mysore, the Court put a 50% limit on reservations in almost all states except Tamil Nadu and Rajasthan.
Article 16(4) is a very important provision that allows the state to make reservations of appointments for the development of backward classes if they are not adequately represented by the services of the state. The case of Devadasan v Union of India is a landmark judgment which discussed the scope of this Article. In this case, the validity of the “carry forward rule” made by the government that is used to regulate the reservation of employment was discussed. The Supreme Court held that the carry forward rule is not valid as reservation exceeds over 50 percent because of this carry forward rule and it affects the other classes of society.
Article 17
Article 17 of the Indian Constitution abolishes untouchability and practising it in any form is forbidden. In Shastri Yagnapurushdasji and Ors. v. Muldas Bhundardas Vaishya and Anr., it was held that ‘untouchability is founded by superstition, ignorance, complete misunderstanding of the true teachings of Hindu religion’. In the famous case of the State of Karnataka vs Appa Balu Ingale, it was noted that,
Abolition of Untouchability is the arch of the Constitution to make the preamble meaningful and to integrate the Dalits in the national main-stream;
The practice of untouchability is the root cause for social segregation, denial of opportunities for Dalits in the educational, economic and cultural pursuits;
All customs, usages, practices directly or indirectly recognizing or encouraging the practice of untouchability in any form is void, as it is opposed to public policy;
The new Act “The Protection of civil rights 1955” was brought out and it was said that the Act is an instrument to enhance the civil, social, cultural, economic and constitutional rights of the Dalits in addition to the rights provided in the Constitutional provisions.
Article 18
Article 18 of the Indian Constitution abolishes the titles. According to this Article, no Indian citizen can accept the titles from any foreign states. The provision was brought out to prevent discrimination. The awards like Bharat Ratna and Padma Vibhushan awarded by the Indian Government do not come under the titles so they can be accepted. The aristocratic classes like Khan Bahadurs created by the British were abolished under this Article.
Article 19
Article 19 of the Indian Constitution guarantees various freedom like:
Freedom of speech and expression;
To assemble peaceably and without arms;
To form associations or unions or co-operative societies;
To move freely throughout the territory of India;
To reside and settle in any part of the territory of India;
To practice any profession, or to carry on any occupation, trade or business.
The freedom of speech under Article 19(1)(a) includes the right to express one’s opinions on any issue through various ways like pictures and films. It includes the freedom of communication and the right to provide or publish opinions and this right is subject to reasonable restrictions being imposed under Article 19(2). In the case of Romesh Thapar vs the State of Madras, it was held that freedom of expression also includes the freedom of publication and propagation. In the case of Government of India v. Cricket Association of Bengal, it was held that freedom of speech and expression also includes the right to acquire information. There are also certain reasonable restrictions provided for the freedom of speech and expression guaranteed under Article 19(1). Article 19(2) provides those restrictions. They are,
The statements made should not be defamatory.
The statements should not affect the interest of sovereignty and integrity of India.
The statements should not affect any friendly relations with the foreign states.
The statements should not affect public offence, decency and morality.
The statements should not be in relation to the contempt of court.
Article 20
Article 20 provides protection in respect of conviction for offences. According to this Article:
No person shall be convicted of any offence except for violation of a law in force at the time of the commission of the Act considered as an offence, should not be subjected to a penalty which is greater than that which might have been inflicted under the law in force at the time of the commission of the offence.
No person shall be prosecuted and punished for the same offence more than once.(Double jeopardy).
No person accused of any offence shall be compelled to be a witness against himself(Self-incrimination).
Article 20(1) provides protection against ex post facto laws or retroactive laws. According to this provision, no person can be punished for any offence that was not considered as an offence when it was committed, and no person can be awarded greater punishment. In the case of State Bank of India vs T.J Paul, an employee working in Bank Of Cochin was served with charge sheet but the bank was amalgamated with the State Bank of India after a certain time, and it was held that the person cannot be convicted with the rules of State Bank and only the rules of Bank of Cochin is applicable to him.
Article 20(2) provides the doctrine of double jeopardy which means no person can be prosecuted and convicted twice for the same offence. This principle is related to a legal maxim “Nemo debet bis vexari” which means no person can be put twice in peril for the same offence.
Article 20(3) provides protection against self-incrimination and no accused can be compelled to be a witness against himself.
Article 21
Article 21 of the Indian Constitution guarantees the protection of life and liberty. Article 21 is an important right that protects citizens and non-citizens. In the case of Maneka Gandhi vs Union of India, it was stated that Article 21 also includes the right to live with human dignity. In the case Peoples Union for Democratic Rights v. Union of India, famously known as Asiad Workers Case, it was held that non-payment of minimum wages to the workers employed affects their right to life and their human dignity and it is violative of Article 21. In the case of State of Maharastra vs Public Concern for Governance trust, it was held that the right to maintain a good reputation also comes under the ambit of Article 21. In the case of Hussainara Khatoon vs the State of Bihar, the right to a speedy trial also comes under the ambit of Article 21.
Article 21A
Article 21A guarantees the right to free and compulsory education to children aged 6 to 14 years. This provision was added in the year 2002 by the Eighty-sixth amendment.
Article 22
Article 22 provides protection against detention in certain cases. According to this Article:
No person who is arrested shall be detained in custody without being informed of the grounds for his arrest.
No person arrested shall be denied the right to consult and to be defended by a legal practitioner of his choice.
Every person who is arrested and detained in custody shall be produced before the nearest magistrate within a period of twenty-four hours of such arrest, excluding the time necessary for the journey from the place of arrest to the court of the magistrate and no such person shall be detained in custody beyond the said period without the authority of a magistrate.
Article 23
Article 23 provides the prohibition of traffic in human beings and forced labour. Human trafficking is the illegal trade of humans for the purposes of forced labour and sexual slavery. In the Asiad workers case, it was held that the persons working with low wages also come under the ambit of forced labor. The offences mentioned in Article 23 have been laid out in various enactments the Bonded Labour Abolition Act of 1976 and the Child Labour (Prohibition and Regulation) Act 1986. In the case of State of Gujarat and Anr vs Honorable court of Gujarat, it was held that Article 23 must be always provided with a purposive interpretation.
Article 24
Article 24 prohibits the employment of children below fourteen years of age in factories, mines or any other hazardous form of employment. This provision is also enforced under various legislations like the Factories Act as it is necessary to protect young children from exploitation and to provide them with proper education.
Article 25
Article 25 provides the Freedom of conscience and free profession, practice and propagation of religion. The concept of the secular state provided under the Preamble is supported by this Article. In the case of Javed vs the State of Haryana, while discussing the marriage practices like polygamy it was mentioned that what was protected under Article 25 was the religious faith and not a practice which may run counter to public order, health or morality. Polygamy was not an integral part of religion and monogamy was a reform within the power of the State under Article 25. The Supreme Court in M.P. Gopalakrishnan Nair and Anr. v. State of Kerala and Ors. held that management of the temple primarily is a secular act, even though the State cannot interfere with the freedom of a person to profess, practice and propagate his religion, the secular matters can only be controlled by the State.
Article 26
Article 26 provides the freedom to manage its own religious affairs. The various rights provided under the article are:
to establish and maintain institutions for religious and charitable purposes;
to manage its own affairs in matters of religion;
to own and acquire movable and immovable property;
to administer such property in accordance with the law.
In the case of Sri Adi Visheshwara of Kashi Vishwanath Temple’s case, the Supreme Court held that right to manage the temple or endowment is not integral to religion or religious practice and it is known that administration, management and governance of the religious institution or endowments are secular activities and State could regulate them by appropriate legislation.
Article 27
Article 27 guarantees the freedom as to payment of taxes for promotion of any particular religion.
Article 28
Article 28 guarantees the freedom as to attendance at religious instruction or religious worship in certain educational institutions. According to this section, any person attending any educational institution that is recognized by the State or receiving aid out of State funds cannot be forced to be a part in any religious instruction that may be provided in such an institution and cannot be forced to attend any religious worship that may be conducted in such institution or in any premises attached without the consent of that person.
Article 29
Article 29 protects the interest of minorities. The minorities who have a distinct language, script or culture of their own have all rights to protect their identity. The minorities cannot be denied admission in any educational institution that is maintained by the State or receiving aid out of State funds on grounds only of religion, race, caste, language or any of them.
Article 30
Article 30 provides minorities with the right to establish their own educational institutions and the State shall not discriminate against any such minority institution while providing grants.
Article 31A
Article 31A of the Indian constitution guarantees the person, right to have a property and no person shall be deprived of this right.
Article 32
Article 32 guarantees the right to constitutional remedies. There are various constitutional remedies allowed under this Article in the form of writs. If there is any violation of fundamental rights, the aggravated person can approach the Supreme Court under the rights provided by this Article. The rights provided under this Article cannot be suspended. The Constitution of India under Article 32 confers power on the Supreme court to issue direction, award or writs. There are five types of writs, that is appropriate to provide relief and for enforcing fundamental rights.
Habeas corpus- The term habeas corpus literally means “bring the body”.This writ prevents unlawful detention without any justification. The persons who are affected can file an application in the Supreme Court under Article 32 and the court after verifying all the documents will issue a writ of Habeas corpus which will mandate the authorities to produce the persons before the Court.
Mandamus- The term Mandamus means “We command”. The Court issues mandamus to any public authority and commands them to do their duty or sometimes mandamus is issued in order to refrain them from doing certain acts which they are not authorized to do.
Prohibition- The writ of Prohibition is issued by the Supreme Court in order to prohibit or stop the proceedings in the inferior courts when the matter does not come under their jurisdiction.
Quo warranto- The term Quo warranto means ‘What is your authority?’ and as the name suggests this writ is issued to question the authority of the officer doing certain acts.
Certiorari- The term Certiorari means to “to certify” and this writ is issued when there is any illegality in the judgments passed by the inferior courts.
Directive Principles of State Policy
Part IV of the Indian Constitution deals with the Directive Principles of State Policy. It is the duty of every State to apply these principles while making any new legislation. The Directive Principles of State Policy is similar to the ‘Instrument of Instructions’ that is in the Government of India Act 1935. They are basically instructions to the legislature and executive that has to be followed while framing new legislation by the State. There are various directive principles like,
The State shall promote the welfare of the people by securing and protecting as effectively as it may a social order in which justice, social, economic and political, shall inform all the institutions of the national life.
The state should ensure that the citizens should have adequate means of livelihood.
The state should make sure that the ownership and control of material resources are equally distributed among citizens.
The state should provide equal pay for equal work irrespective of gender.
The state must also take care of the operation of the economic system and should make sure it does not lead to concentration of wealth.
The State shall provide free legal aid shall secure that the operation of the legal system in order to promote justice.
The State shall take steps to organise village panchayats and should encourage self-governance in villages.
The State shall make provision for providing just and humane conditions of work and for maternity relief.
The State shall develop the educational and economic interests of the weaker sections of the people like the Scheduled Castes and the Scheduled Tribes, and can save them from social injustice and all kinds of exploitation.
The State shall regard the raising of the level of nutrition and the standard of living of its people in order to bring improvement in public health.
The State shall bring out new scientific developments in the field of agriculture and animal husbandry.
A Federation with a strong centralising tendency
The famous salient feature of our Indian Constitution is that it is a federation with a strong centralising tendency. The constitution of India is neither federal nor unitary. The reasons for calling the Indian Government unitary is that,
The division of powers is not equal. The centre has more powers than the state that is evident from the fact that the Union list contains more matters than the State list.
The federations like the U.S.A have rights to frame their own constitution, which is not possible in India as the entire country follows the Single constitution.
During the time of emergency, the states come under the control of the Centre.
There is a single system of Courts which enforces both the Central and State laws.
There is no equal representation of States in the houses of Parliament which is not the same in federations like the U.S.A.
The Indian Constitution is considered as federal for various reasons like:
There is a written Constitution which is an essential feature of every country following the federal system.
The supremacy of the constitution is always protected.
Thus the Indian Constitution can be described as quasi-federal or a federation with a strong centralizing tendency.
Adult suffrage
The concept of Adult suffrage allows every citizen of our country who is above eighteen years has the right to vote in the elections. Any adult who is eligible to vote should not be discriminated on any basis like gender, caste and religion. This provision was added in the sixty-first amendment which is also known as the Constitution Act, 1988. The accepted age for voting was twenty-one before this amendment afterwards it was changed to 18 years of age. Article 326 of the Indian Constitution guarantees this right. There are also certain disqualifications provided under Article like:
Non-residence;
Unsound mind;
Criminals who are indulged in the corrupt and illegal practice.
The persons with these disqualifications are not accepted as a registered voter and they are not allowed to cast votes in the election.
An Independent Judiciary
The Judiciary ensures the proper functioning of the constitution and the enforcement of various provisions of the Constitution. The Constitution makers ensured that Judiciary has to be independent so that it will not be biased. The Supreme court is considered as the watchdog of democracy. There are various provisions in the Article which ensures the independence of the judiciary,
The appointment of Judges is independent and there is no involvement of any executive authorities;
The tenure of Judges is secured;
The removal of judges from the tenure must be also based on the constitutional provisions.
A Secular State
The term Secular State means that there is no separate religion for the State and every religion is respected equally in the State. The Preamble of the Indian Constitution itself states that India has to be a secular state. The Fundamental rights provide the citizens’ freedom to follow their own religion and religious practices and no one can be forced to follow any religion. The proposal of developing a uniform civil code is also provided in the directive principles of State policy in order to resolve the differences between various religions, though it is not implemented still. Article 26 also provides the right to manage their own religion in order to prevent any intrusion. The Supreme Court has also held that various religious denominations like Anandmargi though they are not considered as separate religion will also enjoy protection under Article 26.
Single Citizenship
There is no separate citizenship for the States and the Centre like in various federal countries like the U.S.A. There is single citizenship provided to our citizens. Part 2 of the Indian Constitution, i.e. Article 5 to Article 11 of the Indian Constitution deals with citizenship. The Citizenship Act, 1955 which was amended recently in 2019 also deals with citizenship. Single citizenship allows the persons to enjoy equal rights in various aspects across the country. According to Article 5, it is clearly mentioned that the persons will be considered as citizens of the territory of India, which ensures that there would be only single citizenship. The citizenship of Indians is largely determined by the principle of jus sanguinis ( i.e. the citizenship is based on the citizenship of the parents).
Fundamental Duties
Article 51A of the Indian Constitution provides various fundamental duties. There are no specific provisions to enforce fundamental duties in the Courts like the fundamental rights but it is also necessary to follow the fundamental duties. In the case of AIIMS Student Union vs AIIMS, it was held that the fundamental duties are equally important as the fundamental rights. There are various duties provided to a citizen like:
To respect the Constitution and its ideals and to abide by the provisions of the Constitution.
To cherish and follow the noble ideals which inspired our national struggle for freedom.
To value the rich heritage of our country.
To defend our country when there is a necessity and to render national service when called upon.
To protect the environment and carry out measures to improve them.
To safeguard the public property.
To promote harmony and the spirit of a common brotherhood.
Landmark Judgements on Fundamental Duties
In the case of Rural Litigation and Entitlement Kendra v. State of Uttar Pradesh, the court banned all the mining activities in the Mussoorie hills as it was affecting the environment and ecological balance, as it is one the fundamental duty provided in Article 51 A.
In the case of Mumbai Kamgar Sabha v. Abdulbhai, where the court held that if the constitutionality of the Act is challenged then the fundamental duties under Article 51 A can be taken into consideration.
In the case of Ram Prasad v. State of Uttar Pradesh, the fundamental duty of every citizen of India to strive towards excellence in all spheres of individual and collective activity provided under Article 51A was discussed.
Judicial Review
The concept of judicial review is an essential feature of the Constitution which helps the constitution to work properly. The judiciary is considered to be the guardian of the constitution, thus it is the duty of the judiciary to check the actions that are violative of various articles in the Constitution. The actions of various organs of the government like executive and legislature can be questioned by the judiciary using the judicial review. The judicial review is an important check and balances in the separation of powers. The court that is authorized with the power of judicial review can invalidate any act that is violative of the various basic features of the Constitution. Article 32 and Article 136 of the Indian Constitution are the articles related to the Judicial review in the Supreme Court. Article 226 and Article 227 are related to the judicial review in the High Court. The scope of judicial review is limited to three grounds:
Unreasonableness and irrationality;
Illegality;
Procedural impropriety.
It is also a settled principle that there should be no judicial review in policy matters, that the policy decision taken by the State or its authorities is beyond the scope of judicial review unless the decision is found to be arbitrary, unreasonable or it is in contravention of the statutory provisions or if it violates the rights of individuals guaranteed under the statute. The policy decision cannot be in contravention of the statutory provisions because if the Legislature in its knowledge provides for a particular right, the authority making a decision regarding the policy cannot nullify the same. The same principle was also stated in the case of Monarch Infrastructure (P) Ltd. v. Commissioner, Ulhasnagar Municipal Corporation. In this case, it was said that the court will not interfere in the matter of administrative action or changes.
Landmark Judgements on Judicial Review
In the case of Marbury v. Madison, the U.S Supreme Court in the year 1803 declared that the legislative actions can also be questioned by the judiciary even though there is no separate provision in the constitution of the U.S.A providing the power of judicial review.
In the case of Kesavananda Bharati vs. the State of Kerala, even though the court after agreeing that the Parliament is not restricted to amend the Constitution, also put a caveat of the doctrine of the basic structure. The Court observed that the constitutional amendments have to be made only after considering the basic structure of the Constitution.
In the case of A.K. Gopalan v. the State of Madras, it was held that the law of preventive detention is subject to such limited judicial review.
In the case of State of Madras v. V.G. Row, while discussing the importance of judicial review held that judicial review, itself is a limitation on the supremacy of the legislature, and it is a fundamental part of our constitutional scheme and it is the duty of the court to declare an enactment void if is in contravention to the provisions of the Constitution.
In the case of Binoy Viswam v. Union of India, the scope of judicial review of the legislative action was discussed in detail.
In the case of Shayara Bano v. Union of India, it was said that the Judicial review must be exercised with insight into social values and to supplement the changing social needs.
In the case of L.Chandra Kumar v. Union of India held that the power of judicial review of the High Court under Article 226 could not be excluded even by a Constitutional Amendment.
In the case of Indian Express Newspapers (Bombay) Pvt. Ltd. & Ors. v. Union of India & Ors, there was a judicial review of subordinate legislation and the Court said that subordinate legislation does not carry the same degree of immunity that is provided for a statute passed by a competent legislature.
In the case of State of Tamil Nadu v. P. Krishnamoorthy, the court laid down various conditions for the judicial review of subordinate legislation.
Conclusion
The Indian Constitution has a lot of salient features which makes it special. The lawmakers have taken all the factors into consideration and have tried to accommodate all the differences in our Country. The Constitution and various rights provided in the Constitution acts as a guardian to our citizens.
