City of Oil City in which the Supreme Court of Pennsylvania decided in May 2023 that a contractor who has created a dangerous condition through work performed for a possessor of land may be liable to all persons suffering injuries caused by the dangerous condition.   Bordas works on cases involving diverse areas of law, including insurance bad faith, toxic torts, personal injury, medical malpractice, oil and gas cases, business litigation and more. In Mackey vs. Irisari, Linda obtained a $1.8 Million verdict following the failure of physicians to recognize signs of septic shock following a surgery. In Nickerson vs. Andreini, she obtained a $1 Million verdict on behalf of a young boy who required a hip replacement as a result of negligence by an orthopedic surgeon. She has also obtained multiple multi-million dollar settlements on behalf of other clients in medical malpractice cases involving various areas of medicine.    Geoffrey Brown, a partner at Bordas & Bordas, has been a West Virginia Super Lawyer for 12 years. Who was John Nash?
Nash was born in Bluefield, West Virginia, a former mining town in the Appalachian Mountains, in 1928. The son of a Latin teacher and an engineer, he first showed mathematical prowess in elementary school. Events of the fateful day
The Nashes had just arrived back in the United States with Louis Nirenberg, a professor at New York University after the two mathematicians received the Abel Prize in Mathematics. Because of altered travel plans, the couples arrived several hours earlier than anticipated. The Nashes chose to call a cab at the airport since they were several hours ahead of schedule. The taxi crashed before they got home, killing both Nashes.
The accident
The Nashes were reportedly in a cab on the New Jersey Turnpike northbound in the left lane when their driver lost control of his vehicle. So, What’s the Deal with DuPont?
You’re probably asking yourself “who even is DuPont and why are they so horrible?” Well, let’s get started. According to Sharon Lerner in her article “The Teflon Toxic,” DuPont trademarked Teflon in 1945, so that’s where our story begins. Teflon is the patented name for a group of toxic chemicals created by DuPont. This group includes Perfluorooctanoic Acid, also known as PFOA or C8. The American Cancer Society claims that this man-made chemical has the potential to be dangerous because it can’t be broken down, causing it to stay in the environment almost permanently. PFOA is now found in around 98% of humans, so it’s safe to say we’ve been getting exposed for longer than we originally thought.
 The company, Dupont De Nemours, also known as DuPont, started as a family owned business in 1797 which focused on manufacturing gunpowder and explosives. (Gale Encyclopedia of US Economic History) Over time, they expanded into other areas, which eventually led to them being a chemical based company. They also helped the United States war effort in World War One and Two. They seem like a fine company, right? They’re based in the United States and supporting our military. So where does the drama start?
Technically, the drama starts in 1945, but let’s speed it up a bit. Nathaniel Rich from The New York Times wrote that Robert Bilott, a corporate lawyer in Chicago, decided to take Wilbur Earl Tennants' case against DuPont in 1999. Tennant was a cattle farmer from Parkersburg, West Virginia. He had called Bilott explaining that he believed DuPont, who had bought land from his family previously in order to build a landfill, had been dumping toxic chemicals onto his land which was poisoning his cattle. Taft, the law firm that Bilott worked with typically defended chemical companies, not civil cases, but he claimed he felt he needed to take on the case. This case ended up taking Bilott over 20 years, and in 2006, DuPont agreed to phase out their use of C8 by 2015. (The Teflon Toxic) There are still approximately 3,500 personal- injury lawsuits to be fought against DuPont, however Bilott hasn’t quit yet. As of 2020, DuPont has paid around $753 million dollars in settlements. (Wikipedia) With all that said, there's still plenty more where that came from. This scandal has been ongoing for around 80 years so there is still a lot to unpack.

Ohio Supreme Court Unanimously Rules No Immunity for Police Officers from Negligent Acts with K9 Officer Outside of Duty

The Ohio Supreme Court reversed the Seventh District Court of Appeals’ judgment on a negligence claim and remanded the matter to the trial court for further proceedings in a recent case that determined whether a K-9 officer can be granted immunity if the dog bites a social guest at the officer’s home.  Chief Justice Sharon L. Kennedy, a former police officer herself, wrote the unanimous opinion of the Court which was joined in by the six other Justices.  Jamie Bordas, managing partner of Bordas & Bordas, argued the case before the Ohio Supreme Court.  “We are pleased that the Ohio Supreme Court unanimously held that a police officer does not have immunity as a matter of law for his negligent acts in keeping and harboring a K-9 dog,” Bordas said. “The officer in this case was off duty, drinking alcohol at a party at his home, and using the dog in an inappropriate manner to do tricks for his guests by having him search for drug paraphernalia in his yard and giving him police commands. There is even testimony that he gave the dog alcohol to drink. If any individual, including a police officer, engages in negligent acts that harm another person, like Ms. Harris here, they should be held responsible and their insurance company should pay damages for those acts. Ms. Harris has had significant injuries and surgeries as a result of this dog attack, and she should be compensated for these things.” The case will be remanded to the trial court in Jefferson County for further proceedings.  In the case, Harris v. Hilderbrand, Slip Opinion No. 2023-Ohio-3005, Allison Harris attended a cookout at the home of Dustin Hilderbrand, a Belmont County deputy sheriff and K-9 handler, where she was bitten and seriously injured by the K-9 partner, Xyrem. K-9 deputies keep their dogs in their homes when off duty. Hilderbrand was demonstrating the K-9’s ability to respond to attack commands and search for drugs which the officer had placed throughout his backyard during the cookout.  The dog’s shock collar, which is used for training purposes, was removed during the evening. When the K-9 attacked Harris, the shock collar was not on, leading to serious injuries that required medical attention and surgeries to repair the damage.  Jefferson County trial court Judge Joseph J. Bruzzese, Jr. acknowledged that keeping the K-9 at Hilderbrand’s home was required but noted that the dog was meant to be used for officer work, not entertainment and that Hilderbrand is not immune from liabilities caused by the K-9 when used for amusement. Hilderbrand appealed the trial court’s judgment on the negligence claim and the court of appeals determined that, “Although this was an unfortunate situation, reasonable minds can find only one conclusion, i.e., is entitled to immunity as a matter of law because there is nothing tending to show that he was acting manifestly outside the scope of his official responsibilities at the time of the incident.” Harris appealed this decision, resulting in the Supreme Court’s reversal of the Seventh District’s judgment and remanding the matter to the trial court for further proceedings.  Bordas & Bordas is a plaintiff’s litigation law firm with offices in Pittsburgh, Wheeling, W.Va., St. Clairsville, Ohio, and Moundsville, W.Va.
