YOU DON’T HAVE TO DEAL WITH THE AFTERMATH OF A CAR CRASH ON YOUR OWN
Injuries from car wrecks devastate lives. People face large medical bills, loss of income, pain and suffering, and the disruption of lives and families. Sometimes people have severe fractures, back and spine injuries, or disfiguring scars. Then the worries creep in.
Here are the common concerns we hear from clients:
I need a rental car. How do I get one? Who will pay for it?
How are my medical bills going to get paid?
I can’t work. What am I going to do?
I may need surgery in the future. How does this affect my claim?
The insurance company is being unfair in fixing my car. What do I do?
IT CAN HAPPEN TO YOU
Over three million people are injured every year in car accidents on our nation’s roadways, and fifty thousand dies. In Bowling Green alone, nearly one thousand people are injured every year in car accidents. Add in Scottsville, Brownsville, Glasgow, Morgantown, Tompkinsville, Munfordville, Franklin, Leitchfield and Russellville, Kentucky, and there are many thousands more, and hundreds more deaths each year.
WHAT YOU SHOULD DO
The first hours and days following a car accident can be confusing. We have some suggestions for you to help.
Call EMS paramedics and have your injuries checked out
Go to the hospital if necessary
Cooperate with the investigating police officer
DON’T talk to the insurance company for the other driver
Take photographs of your injuries
Take photographs of your car
Follow your doctor’s instructions
Contact your insurance agent
If you suspect that the other driver is drunk tell the police officer
Contact a law firm with experience in car accident claims. Mike Breen & William Williford will give you free confidential advice without obligation.
It is very important that you take care of yourself, and get medical attention if you need it. People frequently have back and spine injuries from car accidents that may not cause problems until days or even weeks after the wreck. Fractures may not be obvious to doctors or hospital staff at first. By going to the doctor you are making sure that you are getting proper medical treatment, and that your doctor has a record of all of the injuries from the accident. If you wait too long to get medical treatment then the insurance company might say your injuries did not come from the wreck, or that you waited too long and caused your own problems.
Car accidents require a dedicated personal injury lawyer. At Breen & Williford, Injury Lawyers, we’ve been there time and again. We can answer your questions about medical bills, wage loss, disability, pain and suffering, and more.
We will talk to you at no charge for as many times as necessary to decide if we can help you. Contact Bowling Green car accident lawyers Mike Breen and William Williford today.
OUR PERSONAL INJURY LAWYERS CAN HELP YOU
Our injury lawyers and staff want to help you, in the unfortunate event that you need our help. Just e-mail or call us for a free, no-obligation, confidential consultation.

Why You Should Hire the Services of a Personal Injury Attorney After an Accident
Tumblr media
Road accidents occur a lot. Most of these accidents are usually caused by negligence on the drivers’ part. It is quite unfortunate because so many lives are lost through these accidents and so many victims are left treating serious injuries. If you are a victim of such a case you should consider suing the driver. Never let anyone talk you out of this decision because it is your constitutional right. Filing a claim and winning it will help you in getting compensation that you can use in paying for your treatment if you injuries are serious. You can also use the money in getting psychological help due to the trauma that you might have suffered during the accident. Getting a lawyer is important because they are the ones who will build a case for you. Hiring a general lawyer won't be of any help and that is why you should get an attorney that specializes in personal injury. They also know what is expected from them, therefore they will ensure that they deliver to your expectations.
Never make a mistake of representing yourself in a court of law most especially if you are not a lawyer. When looking for car accident injury lawyers ensure that you check the reputation that they have in the industry. The information that will gather will help you in knowing if you are dealing with someone who will be a disappointment to you or they will build a strong case for you. People are encouraged to hire lawyers who work for law firms because they tend to be the best. These lawyers are usually given all the resources that they need in building a strong case and that is why their service tends to be the best compared to an independent morgantown WV car accident lawyer . Another good thing is that their work is monitored by the law firm therefore you are guaranteed of receiving exceptional services. Check the number of cases that the attorney has one before you allow them to handle your case. Ensure that you settle for attorney that has more wins than losses. They will also advice you and train you on how to answer questions in case you are put on the stand. Such a process is usually very delicate and if you end up answering the questions badly it might affect your case.

Asbestos Laws in West Virginia
West Virginia Mesothelioma Lawyer
A Goldberg, Persky & White asbestos attorney can help anyone diagnosed with mesothelioma get the compensation they deserve. West Virginia is one of the many states which had heavy mining and industries which exposed thousands of workers to asbestos. The main health risk of being exposed to asbestos is the development of mesothelioma. Exposure to asbestos is the only known cause of mesothelioma. Asbestos-containing products were used in steel mills, railroads, power plants, oil refineries, and other industries throughout West Virginia.
Between the years of 1999 and 2013, West Virginia’s asbestos-related death rate was nine deaths per one hundred thousand people. That number is almost twice the national average, which was reported by the Environmental Working Group Action Fund.
The asbestos-related death rate is more than three times the national average in some West Virginia counties. This does include Kanawha County, which is the state’s center of industry.
Kanawha County was ranked among the top ten counties in the nation for asbestos litigation in 2017, which was reported by a KCIC industry. Even though there was a national descending trend happening, Kanawha County had shown an increase in claims from the years of 2016 to 2017.
How Can A West Virginia Mesothelioma Lawyer Help Me?
A West Virginia mesothelioma attorney at Goldberg, Persky & White PC can help you file a claim for compensation against the companies who exposed you to asbestos. Our law firm specializes in asbestos litigation and we are standing by with a West Virginia asbestos exposure lawyer to help you 24/7.
West Virginia Asbestos Laws and Regulations
The DEP enforces Hazardous Air Pollutant Emission standards in West Virginia’s. There are licensing requirements set for professionals who audit and abolish asbestos-containing materials. Before any renovation or demolition operations can begin, all buildings must be inspected for asbestos. The DEP should be notified in advance when asbestos-containing materials will be placed in a spot where they would be disturbed.
Asbestos-abatement professionals must go through specialized training through the state so that they can effectively remove asbestos-containing materials.
How To File a Mesothelioma Lawsuit in West Virginia
In order to manage the large number of disease cases, specific rules and regulations have been enacted by the West Virginia Legislature and state courts. The attorneys at Goldberg, Persky & White are familiar with regulations and the case process in West Virginia.
Mass Litigation Panel
There is a specialized panel, established by West Virginia’s Supreme Court of Appeals, which is set in place to help handle large litigation cases such as asbestos self-injury lawsuits. Asbestos cases that are filed in West Virginia are referred to the Circuit Court of Kanawha County.
The Mass Litigation Panel (MLP) Asbestos Case Management Order holds the procedures for filing asbestos cases.
Plaintiff’s in a pending asbestos self-injury case are required by the MLP to submit a “Plaintiff Fact Sheet”. In this fact sheet, the plaintiff’s must report their work history, medical providers, smoking history, and any kind of benefits such as workers’ compensation and/or disability.
Case Consolidation
Case consolidation is a method that the courts use to categorize similar claims for processing. The courts use this as a tool to lessen filings, streamline case scheduling, and expedite trials.
Currently, under the Asbestos Case Management Order, the plaintiff’s attorney designates a “trial group” of twenty cases. After that happens, the court will schedule trials for three of those groups every year.
Medical Severity
The Asbestos cases are divided into different categories based off of the plaintiff’s illnesses. The categories are used to group cases for scheduling.
Category I cases involve living plaintiffs who have been diagnosed with malignant mesothelioma or asbestos-related lung cancer. This category’s plaintiffs receive first priority in trial groups, and any category I plaintiff who dies before being deposed is automatically moved to category II.
Category II cases involve plaintiffs who are deceased. These plaintiffs were diagnosed with malignant mesothelioma or asbestos-related lung cancer.
Category III cases involve plaintiffs who have been diagnosed with nonmalignant asbestos-related diseases, such as asbestosis.
Punitive Damages
Punitive damages are used to punish defendants who lose and deter them from causing more avoidable injuries. Since 2015, punitive damage awards in West Virginia have been limited to four times compensatory damages, or $500,000, whichever is higher.
Disclosures
Plaintiffs must disclose any claims that may exist against bankruptcy trusts no later than 120 days before their trial date; the Asbestos Case Management Order requires this.
Defendants have information about trust claims. The courts, however, may require claimants to disclose the amount that they receive or that they expect to receive from bankruptcy trusts. The defendants are entitled to reduce these amounts from verdicts as “set-off’s.”
West Virginia Mesothelioma Lawsuit Statute of Limitations
West Virginia’s statutes of limitations indicate patients with mesothelioma have two years from their time of diagnosis to file a personal injury lawsuit against those responsible for their asbestos exposure; the time limit is the same for filing a wrongful-death lawsuit.

West Virginia Mesothelioma Lawsuits
West Virginia mesothelioma lawsuits are filed against employers who put profit before their workers’ safety by exposing them to asbestos. These companies are held accountable by mesothelioma lawyers when those workers end up being diagnosed with mesothelioma. There are many ways in West Virginia for people with mesothelioma to receive compensation for their suffering as well as expenses.
Asbestos Verdicts
The ultimate way to hold a company accountable for causing workplace asbestos exposure is to take that company to a trial. Juries in the state of West Virginia have also held companies responsible for secondhand asbestos exposure.
DuPont was told to pay $6.4 million in expenses to the family of Leonard Cox in 2002. Cox died two years before from mesothelioma. Professionals traced his cancer back to asbestos dust, which was brought home on his father’s work clothes when Cox was still a child. His father was working at the time at the asbestos insulation at DuPont’s Belle chemical plant.
Settlements
Plenty of defendants in asbestos lawsuits will choose to settle their issues outside of the courtroom, rather than risk a jury verdict.
Out-of-court settlements amounts are usually less than verdict awards; out-of-court settlement amounts are kept confidential to keep the defendant from the news. Professional lawyers are known to seal mesothelioma settlements worth more than $1 million for the clients they work with.
Trust Funds
Asbestos trust funds are issued by liable companies so that they avoid going bankrupt because of lawsuits. An attorney that is familiar with asbestos cases can help determine which asbestos trusts individuals may be able to file a claim. Look at Online Reviews Reviews can tell you what other people think about the attorney that you are considering. If a specific car accident attorney is really good, you will get to read it on reviews. On the other hand, if they are known for offering terrible services, reviews will tell you all that. Additionally, from reviews you can also learn of all the complaints that previous clients have about the attorney, learn about the location and even any alternatives that you may have.
Compare the Prices The legal fee is the last factor. You can always go online, carry out some research and get to know the rates of hiring personal injury attorneys. Once you have the average estimate, you can use it to look for the attorney that you can afford. When comparing the rates, make sure that the quality of services that you are expecting match the cost. What is Asbestos?
Tumblr media
Asbestos is a naturally occurring mineral fiber that was once valued for its resistance to heat, electrical and chemical damage, and was used by dozens of trades. With millions of microscopic fibers, asbestos can easily break apart and become airborne and possibly inhaled. Should asbestos fibers be inhaled, they may become lodged in your lungs, potentially leading to lung cancer, mesothelioma or other asbestos-related diseases. Additionally, because asbestos fibers travel so easily through the air, not only the person working with asbestos-containing products but also bystanders run the risk of inhaling these fibers and developing an asbestos-related disease even decades after exposure.
From the early 1900s through the 1980s, asbestos was used in thousands of different industrial products, including pipe and furnace insulation materials, roofing shingles, floor tiles, millboard, textured paints and other coating materials.
In 1989, the United States banned asbestos in specific products. This ban, however, did not ban the use of asbestos altogether. Additionally, other countries continue to mine asbestos. As a result, asbestos can still be found in a number of consumer products, including building materials, friction products and heat-resistant fabrics.
Mesothelioma and Asbestos-Related Diseases
Asbestos exposure is strongly associated with several potentially fatal illnesses, the most serious of which is malignant mesothelioma. This aggressive cancer affects the lining of the lungs, heart, abdomen and other organs, and, as with all asbestos-related diseases, it often doesn’t manifest for years or even decades after the initial exposure. Because mesothelioma, asbestos lung cancer and other related diseases can almost always be attributed to asbestos exposure, you should tell your doctor about any past exposure, including your work or family history. Learn more about our cases involving mesothelioma and asbestos-related diseases.

Asbestos Exposure
Companies and manufacturers dealing with asbestos have known for almost a century that the inhalation of asbestos fibers is associated with mesothelioma, lung cancer, asbestosis and several other debilitating and often fatal asbestos-related diseases. Thousands of unsuspecting workers were exposed daily to this dangerous carcinogen as they worked in factories, mills, railroads and other industrial occupations, often bringing asbestos fibers home and unknowingly exposing their family through household asbestos exposure.
For decades, asbestos manufacturers chose profit over people’s health by continuing to manufacture, distribute and supply asbestos-containing products. Until this harmful carcinogen is banned once and for all, asbestos exposure, asbestos-related diseases and mesothelioma will continue to be major national and international health concerns.
OUR HISTORY IN ASBESTOS LITIGATION
Motley Rice lawyers have more than three decades of experience litigating asbestos-related lawsuits, taking on giant asbestos corporations and fighting for the rights of mesothelioma victims and victims of asbestos cancers and other related diseases.
Motley Rice co-founder Ron Motley began working on asbestos cases in 1976, but it wasn’t until 1978, when he secured the infamous “Sumner Simpson” papers demonstrating manufacturer knowledge of the hazards of asbestos as early as the 1920’s, that the tide began to turn against asbestos defendants.
Many firms also turn to Motley Rice to help with their cases due to our experience and resources in challenging asbestos- and mesothelioma-related litigation. Along with litigating asbestos cases across the country, our attorneys also hold leadership and liaison roles in asbestos litigation in several of the states where our offices are located, including West Virginia, South Carolina, Rhode Island and New York.
West Virginia Asbestos
Along with our offices located around the country, we’re proud to have asbestos-focused attorneys working from Morgantown, West Virginia. For more than 30 years, our attorneys have worked closely with West Virginians who have been exposed to asbestos through their employment at one of the many industrial plants located throughout the state.
Our Work as Canadian Asbestos Counsel
Our attorneys have also served as U.S. legal counsel for Canadian provincial workers’ compensation boards since 1987, helping Canadians seek U.S. legal recoveries from non-employer third parties who may be responsible for a Canadian employee’s workplace-related injury.
Asbestos Exposure, World Trade Center Dust and the 9/11 Victim Compensation Fund
On Oct. 3, 2011, the United States government reopened the 9/11 Victim Compensation Fund for people physically injured or exposed to toxins such as asbestos and other harmful dust at the World Trade Center crash site following the terrorist attacks on September 11, 2001. The new 9/11 VCF enables more people, including 9/11 workers and volunteers who were hurt, got sick or died as a result of the attacks and the aftermath, to obtain compensation from the program. Learn more about this fund and how we can help.

Asbestos Bankruptcies
Nearly 100 asbestos industry companies have filed for and entered bankruptcy in the past three decades, with more than 30 trusts created through asbestos bankruptcy reorganization in the past 10 years. The majority of the asbestos bankruptcy plans involve a settlement trust that processes asbestos personal injury claims and disburses compensation.
Motley Rice co-founder Joe Rice has been instrumental in developing and negotiating structured settlements with asbestos manufacturers emerging from bankruptcy. Through our many years in asbestos litigation and working with asbestos trusts in particular, we have acquired a strong understanding of the bankruptcy trust process as well as the wide variety of jobsites and trades involved.
This historic background gives our firm the in-depth knowledge and experience to help asbestos victims navigate an often complicated claims system and to receive fair, expeditious and timely recovery from bankrupt asbestos manufacturers.
