Background
Present Writ Petition is before High Curt of Madras seeking direction to the first respondent – District Collector Tirunelveli to permit the petitioner – S Jamal Mohideen and his family members to execute burial of petitioner's deceased wife – J Habiba Beevi, in the common burial ground belonging to the first respondent (Distric at Malukka Maliyar Sunnathwal Jamath, Pathamadai & Kesavasamuthiram, Pathamadai Taluk, Tirunelveli District. The Petitioner's wife passed away a day before the filing of the WP.
Issue
Dispute is the manner of burial of her body.
Point of dispute has arisen as the petitioner belongs to Tamil Nadu Thowheed Jamaat. The “Kabristhan” is run by Sunnat – ul- Jamaat.
The members of Thowheed Jamaat and Sunnat – ul – Jamaat disagree on the rites and customs to be followed at the time of burial.
Court Activities
Urgency for taking up the matter was mentioned by the Counsel of the Petitioner & the Writ was taken in the post lunch session.
The Notice couldn’t be served on the Tamil Nadu Wakf Board however, local police facilitated conversation on whats app with the Waqf Board.
Considering the urgency Court didn’t went into the merit of the matter.
Court confined itself to burial issue.
Petitioner S Jamal Mohideen wanted Court to direction to the Fifth Respondent – Syed Meeran for allowing burial of his wife in the Kabristhan maintained by him.
Observation of the Court
Direction can’t be given to the 5th Respondent unless notice upon him is served.
Directing 5th Respondent will amount to allowing the relief prayed for by the Petitioner – S Jamal Mohideen.
It would not be proper on the part of the writ court to ride roughshod over the customs and practices traditionally followed by the fifth respondent.
Court Relegated the matter to the Tamil Nadu Wakf Board.
I am conscious that the Wakf Board had already passed a resolution mandating that the facility of burial should not be denied. The 5th respondent is insisting that the traditional practice should be followed.
More so, the father of the deceased ais also a member of the Sunnat – ul- Jamaat.
Counsel of the petitioner was insisting on the disposal of the Writ Petition.
Direction by Hon’ble Mr. Justice G R Swaminathan J
I direct the Chief Executive Officer of the Tamil Nadu Wakf Board to take a call in the matter tonight itself. He shall have a virtual conference over Zoom or WhatsApp with the writ petitioner, the fifth respondent and render his decision in writing.
It shall be communicated through e-mail or any other mode.
He can seek the assistance of revenue and police authorities.
Section 50(2) of the Wakf Act, 1995 states that it shall be the duty of every Mutawalli to carry out the directions of the Board.
I am conscious that the Chief Executive Officer cannot be equated with the board.
But in the special facts and circumstances of the case, the Chief Executive Officer of the Board shall take a call in the matter.

Some of the property frauds or scams happened in India namely Emaar properties scam, Rangmahal Cooperative group housing scheme. Karnataka Wakf Board Land Scam, Noida land scam, Adarsh Housing Society Scam and so on.
1. EMAAR PROPERTIES SCAM
Situated at Dubai, Emaar properties had a partnership with the Andhra Pradesh Industrial Infrastructure Corporation (APIIC), of 70:30 equity. The key aim of this partnership was to build an ultra-luxury township on 535 acres of land in Gachibowli, Hyderabad. MGF (another Dubai based infrastructure company) became the new partner of this existing companies. It reduced the APIIC managing director. It fetched huge loss to the government and central Bureau of the investigation suspected that Emaar- MGF partnership had a gain of excessive 2500 crores.
2. RANGMAHAL COOPERATIVE GROUP HOUSING SCHEME (CGHS) Scam was 4000 crore scam
It was started when the plot was illegally allocated by the lawbreakers for Rangmahal CGHS in Pitampura area of North West Delhi. In total 11 people were apparently involved including the public servants. They forged the to the society.
3. KARNATAKA WAKF BOARD LAND SCAM
In 2012, Anwar Manipadddy, Karnataka State Minorities Commission’s chairman in his report to the Chief Minister of Karnataka brought out about the scam of 2 lakh crores. It was alleged that Karnataka Wakf Board illegally distributed the land of 27000 acres for a small amounts of actual market value.
4. NOIDA LAND SCAM
The top scientists of Indian Council of Medical Research (ICMR) reassigned the government plot of 70 crores value to a private group in a small amount to construct society flats.

J&K Wakf Board abolishes local Auqaf Committees Newscraving Desk: Srinagar, Dec 18: The Jammu and Kashmir Wakf Board has abolished the local Auqaf Commitees. An order was issued in this regard by the Chief Executive Officer of the Wakf Board. The order said that in pursuance to Waqf Act, 199 extended to Jammu & Kashmir (UT) with the constitution of new J&K Waqf Board” which “has taken overall control/management of all the Shrines/Ziarats including other Assets/Properties under the Muslim Specified Waqf in whole UT of Jammu & Kashmir.” “No Association/Self-styled Local Auqaf Committee/Management have any legal standing under the provisions of the Central Waqf Act, and no such Committee has any kind of registration of validation from J&K Waqf Board.” The authorities said that “ it is hereby notified that all the local Waqf/Auqaf Committees shall be deemed as void ab-initio throughout J&If & any hind of interference by such local Waqf Committees be reckoned illegal & to invite action under Law on all the Waqf Units managed by J&K Waqf Board.”
“Therefore all the Government Departments & the general public is informed that any communication/decision of any such local committee at any Waqf Unit may not be entertained. This order is issued to ensure smooth, systematic, transparent & legally viable management syste at all the Waqf Units throughout J&K,” an order read. Read the full article
