Liam's death investigation official update

The head of the National Criminal and Correctional Court No. 34, Laura Bruniard, processed last Friday the five people accused in the framework of the investigation that the Public Prosecutor's Office carried out on the death of Liam James Payne, which occurred on October 16 when the 31-year-old British musician fell from the balcony of the hotel in the Buenos Aires neighborhood of Palermo where he had been staying for three days. Three of the accused were processed without preventive detention for negligent homicide, and the other two for the crime of supplying narcotics, and they were ordered to preventive detention.
The defendants were charged at the time by the head of the National Criminal and Correctional Prosecutor's Office No. 14, prosecutor Andrés Esteban Madrea, who investigated the circumstances of the incident from the beginning.
RLN, the victim’s representative who accompanied Payne on this trip to Buenos Aires to obtain his US visa again; the hotel manager, GAM; and the head of reception, ERG; are the three accused of “culpable homicide,” a crime contemplated in article 84 of the Penal Code (CP) and which provides for a sentence of 1 to 5 years in prison for anyone who “through imprudence, negligence, lack of skill in their art or profession or failure to observe the regulations or duties in their charge causes the death of another.” The judge also placed an embargo on all three of them for 50 million pesos each.
Meanwhile, the EDP hotel employee and a waiter whom Payne met in the Puerto Madero neighborhood and whose initials are BNP, were prosecuted for “supply of narcotics,” a crime specified in article 5, section “e” of Law No. 23,737 on Narcotics, which provides for a sentence of 4 to 15 years in prison. Both were given preventive detention and five million pesos in assets were seized.
In the case of RLN, Payne's companion during his stay in Argentina, there was a difference in the criminal classification chosen by the judge, since the prosecutor Madrea, when charging him and requesting his questioning, had done so for more serious crimes: abandonment of a person followed by death - contemplated in article 106 of the Criminal Code and which carries a sentence of 5 to 15 years in prison -, as the author, in ideal competition with supply and facilitation of narcotics.
"Bringing Payne up to room 310 in that state, where he was staying, was creating a legally unacceptable risk to his life," the judge said.
The accusations
In the resolution, Bruniard transcribes the five charges formulated by the MPF at the time of the investigations and whose details are as follows:
EDP ​​(hotel employee): He is accused of having delivered cocaine, for a fee, once on October 15, 2024, at 3:25 a.m., and the next time on October 16, 2024, between 3:30 p.m. and 4:00 p.m., for Liam James Payne to consume during his stay at the Casa Sur Palermo hotel, located at 6032 Costa Rica Street in this city.
BNP (waiter): he is accused of having delivered cocaine, for a fee, on October 14, at 3:24 a.m., for Payne to consume at the hotel, where he even accompanied him to room #310, checking in with him, between 3:25 a.m. and 8:15 a.m. when he checked out. Also, on the same day, he is accused of having delivered more cocaine, for a fee, for the accused to consume, between 10:03 a.m. and 10:44 a.m., on which occasion Payne went to the defendant's home, at 400 Agüero Street in the Federal Capital, traveling in a taxi and returning to the hotel.
RLN (representative): he is held criminally responsible for the death of Liam James Payne through the execution of actions and omissions in the period prior to and contemporaneous that culminated in Payne falling from the balcony of room No. 310 corresponding to the Casa Sur Palermo hotel […]. Thus, the accused N. failed to comply with his duties of care, assistance and aid that he had towards Payne due not only to a pre-existing legal duty but also to specific functions of guidance and personal accompaniment, previously coordinated and accepted by the relevance and activities of his profession, abandoning him to his fate, knowing that he was incapable of caring for himself, knowing that the accused suffered from multiple previous addictions - to alcohol and cocaine - and having full knowledge of the state of intoxication, vulnerability and helplessness in which he found himself.
GAM (hotel manager): She was present in the lobby at the time prior to the events and noticed the state of health of Lyam James Payne, who was unable to stand due to the consumption of various substances. The manager was in charge of the establishment and allowed, at least by omission, for Payne to be taken to his room moments before his death. In the room, number 310 of the Casa Sur Palermo hotel, there was a balcony that, given the detailed situation, was a source of risk for Payne. […] The conduct that M. should have carried out was to keep him safe in an area without sources of danger, in company and until medical care was provided for him.
ERG (hotel reception manager): was present in the hotel lobby at the time prior to the events and noticed the state of health of Lyam James Payne, who was unable to stand due to the consumption of various substances. G. led a group of three people who dragged Payne to his room moments before his death. In the room, number 310 of the Casa Sur Palermo hotel, there was a balcony that, given the detailed picture, was a source of risk for Payne. […] The conduct that G. should have carried out was to keep him safe in an area without sources of danger, in company and until he could be provided with medical care.
"I maintain that the person named tried to leave from the balcony of the place where he was left because the forensic experts noted that he did not lose his balance. This is how the fall occurred," explained the magistrate.
The supply of drugs
In the case of the EDP hotel employee, Bruniard said he shared "the prosecutor's theory that the accused provided cocaine to Payne for a fee."
Based on testimony and analysis of some of the footage, he mentioned that the accused received “100 dollars” from the victim in exchange for buying drugs from him and that, on another occasion, the British musician sent a car to the defendant’s home in the Buenos Aires district of Lomas de Zamora to bring him more narcotics.
Regarding the waiter BNP - who in his defense admitted having given drugs to Payne but stated that he did so to spend time with him - the judge also agreed with "the prosecutor's thesis that the delivery of cocaine was for money."
To do so, he evaluated the chats between the musician and the defendant that talked about it, the hotel footage that captured the waiter's arrival at the hotel in the early hours of October 14 and his departure almost five hours later, and the fact that "Payne asked for money at the reception desk while the defendant was in his room."
"In this case, it was proven that both EDP and BNP supplied cocaine in exchange for money to Liam James Payne," Bruniard said, supporting the MPF's accusation.
The judge's thesis 
In the grounds of the indictment, and after analyzing and validating the evidence collected by the prosecution, the judge developed her own "thesis" on what happened to the former leader of the band One Direction .
Bruniard stated that “it was proven by the testimonies gathered by the prosecutor that Liam James Payne had a history of addiction.” In this regard, he explained that he was seen demanding cocaine and alcohol by the staff of the Casa Sur Palermo hotel and that “the autopsy performed on his body showed that the death was caused by multiple trauma and internal and external bleeding,” and that “the presence of cocaine and alcohol in large quantities was confirmed.”
“On October 16, moments before 5 p.m., Payne was unable to care for himself,” the judge noted, pointing out as evidence of this the photograph incorporated into the case, which corresponds to the footage taken by a camera in the hotel lobby, where at 4:54 p.m. the musician was seen unconscious and being dragged “by three people.”
“The way he was being handled shows a state of vulnerability,” the judge said, referring to the situation of the hotel manager and receptionist, stating that “bringing Payne up in that state to room 310 where he was staying was creating a legally disapproved risk to his life.”
“Payne’s consciousness was altered and there was a balcony in the room. The proper thing to do was to leave him in a safe place and with company until a doctor arrived. The people responsible at the hotel that day were the manager GAM and the head of reception ERG,” he added.
When analyzing the hotel security camera recordings presented by the prosecution, Bruniard also highlighted that thanks to them it was possible to observe that the head of reception ERG “is the one who led Payne to be dragged to his room” and that “the images are compelling” when this defendant and the manager GAM are seen moments before 5 p.m. “in the hallway of room 310,” and that minutes later the victim was found dead in the restaurant's patio.
Payne wanted to leave through the balcony
In another section of the ruling, the judge mentioned that, according to her hypothesis, Payne did not faint when he fell into the void, but that, in his state of intoxication due to polydrug use, he tried to leave the room through the balcony and thus fell.
“I maintain that the person named tried to leave from the balcony of the place where he was left because the forensic experts noted that he did not lose his balance. This is how the fall occurred,” explained the magistrate, who to support this theory mentioned an extension of the report of the Forensic Medical Corps and an ocular inspection carried out on December 5 at the Casa Sur Palermo hotel, in which the magistrate herself participated.
“I believe that M. (manager) and G. (head of reception) did not act maliciously in relation to the singer's death, but they were imprudent in allowing him to be taken to the room and taking him there respectively. They created a legally disapproved risk and Payne's death is the concretisation of that risk. The named man tried to leave via the balcony, in the state detailed, he fell into the void and died,” he concluded.
According to the forensic experts, Payne fell into the hotel restaurant's patio "without any sign of defense," which caused multiple injuries to his body, especially to his head after hitting the concrete support of an umbrella directly.
"Payne's consciousness was altered and there was a balcony in the room. The proper thing to do was to leave him in a safe place and with company until a doctor arrived," the judge said.
The situation of the companion
Regarding RLN -who assisted Payne during his stay in Buenos Aires-, the judge held that “he is responsible for the crime of negligent homicide as the perpetrator given that he had assumed a position of guarantor in front of the family of the deceased.” Based on testimony statements and analysis of communications and messaging chats presented by the prosecution, she added that “it is evident that this defendant was Liam James Payne's contact for the hotel.”
She explained that RLN was present at the hotel moments before the dangerous situation occurred and this is supported by the images that show him leaving Casa Sur at 16:11 - some 50 minutes before the incident. "I believe that at that point, given the results of the autopsy, Payne's state of vulnerability was evident. N. could not trust that the rest of the hotel staff would act appropriately," the magistrate assessed, beyond the continuity of the investigation.
The rating
In justifying the criminal classification chosen for the three defendants for negligent homicide, the judge explained that "the situation of these defendants can be treated jointly, although each one must answer as the author for their act given that there is no co-authorship in the negligent crime and the way in which they have created the risk situation, which resulted in Payne's death, is different."
“In this specific case, I do not consider that N. (representative), M. (manager) or G. (head of reception) planned and wanted Payne’s death. They did not imagine the outcome but they created a legally disapproved risk. M. created this, in his role as manager of the establishment, by allowing Payne to go up to room 310. G. did so by leading the group of people who took Payne to the aforementioned room. […] What happened was foreseeable,” he said.
"In the case of N. (representative), he should have consulted a doctor given the commitment made to the family of the deceased. He should have done this without relying on what the hotel employees could do," he assessed.
Finally, the judge considered that "the three people who are being prosecuted have contributed, although not in a planned manner, to creating a risk that resulted in Payne's death, whether by action or omission."
Precautionary measures
In justifying the pretrial detention of the hotel employee and the waiter, Bruniard took into account the expected sentence for the crime for which they were prosecuted, which does not allow a suspended sentence.
Regarding the three defendants charged with manslaughter - who were not given preventive detention - the magistrate indicated that there were no procedural risks, that they have roots and that the sentence does allow for a suspended sentence. In any case, the prohibition against RLN, a US citizen, was upheld in order to guarantee his permanence in the country.

If you have high quality traffic sources, it can go up to 6 7$ a lead. It terrible, really. Not fair on parents in the slightest. If I didn have some genes that I don want to pass through I still wouldn want to have children in a culture that sees raising a child in such a nuclear way. The reality is, the absolute lack of data gives no real view of what's working and what's not. There are too many states not reporting and states that are reporting partial information. If there was a method for every adjudication or sentencing to be followed up with a simple form that could be sent to the DOJ (Department of Justice) it would allow a better view of how cases are being handled.

Interview with Continuum's Erik Knudsen

Tech Support: Interview with Continuum's Erik Knudsen

At the age of 10, Erik Knudsen played on a children’s hockey team that was chosen to appear in a Visa TV commercial. Little did the actor realize the impact that this event would later have on his life. “I loved it and I always wanted to act after that,” he says. “My parents, of course, were always telling me to have a back-up plan just in case things didn’t work out.
“When I was younger I wanted to be a policeman. I thought that that would be an awesome job and still do, but unfortunately I don’t think I have quite what it takes. I’m 5’ 8” and 125 pounds, so it would probably be kind of difficult. I always wanted to be an actor, though, and felt that if I had a back-up, it would allow me to give up too easily on my dream. So I don’t have a back-up right now. I’m just concentrating on my acting and would love to do that for the rest of my life, and maybe direct down the road.”
In Knudsen’s case, hard work and perseverance have certainly paid off in the form of several feature film and TV credits. Currently, the affable and talented actor is playing Alec Sadler in the hit Canadian TV Sci-Fi/Police Drama Continuum. When Kiera Cameron (Rachel Nichols), a Vancouver CPS (City Protective Services) officer in the year 2077, is unexpectedly sent back in time to Vancouver 2012 along with a group of convicted terrorists, the technology in the future suit she is wearing manages to connect with a frequency used by Alec.
A 17-year-old computer genius, he has, unbeknownst to him, created the foundation for all the technology that runs the world in 2077. While at first only a voice in her head, Alec becomes one of Kiera’s most important allies in her efforts to stop the terrorists from wrecking havoc in the present and changing the future.
“When my character first heard Kiera’s voice over the radio he thought it was a prank,” explains Knudsen. “Alec couldn’t believe that anyone could get onto this encrypted frequency that he created, so when he first starts speaking to Kiera, he doesn’t believe her. For a while, she’s telling him that she’s from 2077 and Alec thinks, ‘OK, that could be true,’ but he doesn’t understand how that’s possible.
“Throughout the first few episodes, my character is trying to help Kiera, but there’s a great deal of doubt. Now, however, we’re filming our 10th episode [and first season finale], and there’s a lot of trust has built up between them. He’s helping her out every day to find these bad guys and fight crime, and Kiera is becoming reliant on him. Alec is basically all the backup she has right now because no one really knows the truth about her. So Kiera really trusts him and I think their relationship has developed quite nicely over this first season. They’ve become close friends and, of course, Alec is a teenage boy, so he thinks that Kiera is really hot,” says the actor with a chuckle.
In Continuum’s first season opener A Stitch in Time, the first glimpse that audiences have of Alec is of him sitting in a dark room surrounded by computer screens and various other technical paraphernalia. Because he is supposed to be playing a computer genius, Knudsen was almost immediately rattling off the “dreaded” technobabble.
“They pack all my dialogue into one day because we film most of my scenes in a barn, which is Alec’s workshop,” he notes. “So my first impression on my first day of work on Continuum was, ‘Holy cow, what did I get myself into,’ because it was a lot of work. Alec is very smart, which meant I had to learn all this technical jargon and lingo. All I can say is that the Internet is amazing; it gives you links to all these websites that basically tell you how to pronounce these words, so that was a big help for me.
“It takes a week for me to memorize all the dialogue that I have for my one day of shooting usually on Fridays,” continues Knudsen. “As far as prep, it consists of a couple of hours every day of me writing everything down, trying to memorize the words and just get the rhythm of it all. So in the beginning it was a little bit startling for me to play a character that knows so much about stuff that I don’t know anything about. Again it was a lot of memorization as well as preparation, but so far so good. I’ve learned a ton and because we’re coming to the end of filming, my mind is a little tired now, but it got a pretty good workout this season.
“Another challenge with this role is that I didn’t know too much about my character of Alec. I knew that he’s a farm boy who keeps to himself and does all this technical stuff in his family’s barn. As far as what comes down the road for him, well, he’s trying to deal with a woman from 2077 and what she’s telling Alec about himself as well as the future. How do you act like this is news to you? I can’t give away too much, but as the season goes on, he changes just like anyone else who is being told the kind of information that Alec is. When it comes to specifics, though, you’ll just have to watch,” teases the actor.
As his on-screen relationship is taking time to develop with the show’s leading lady Rachel Nichols, the actor’s off-screen rapport has solidified much quicker. “Rachel Nichols is incredible,” says Knudsen. “It’s always scary settling into a new show with a new cast because you don’t know what everyone is going to be like, but the whole Continuum cast is fantastic. Rachel is the coolest person to be working with on this show. She’s like one of the guys; Rachel is drama-free, she loves football, and coming into this show she’s learned to really love hockey, which is terrific.
“So Rachel is perfect and a pleasure to work with. I mean, she comes in on her day off just to help me out by doing her character’s off-screen dialogue. It’s difficult because we’re never face-to-face; I’m always in the barn and talking to her through a blue tooth. So we don’t get the usual actor interaction that you’d normally get, but we help out one another by reading off-camera for each other in order to develop the flow of the scenes and that care in the lines instead of just talking to one of the crew who’s reading the [off-camera] dialogue. At first we were concerned about how things would all play out if that was the case, but I’m happy to say it’s been fine.”
Having worked on a number of made-for-TV movies as well as played the lead role in YTV’s Mental Block and guest-starred on such TV series as Doc, Blue Murder and The Guardian, the Toronto-born Knudsen made his first major feature film appearance as Daniel Matthews in the 2005 horror flick Saw II.
“I was around 16 when I booked that job, and I was so excited,” recalls the actor. “I studied so hard for that role and wanted it so badly. I sat in the car before for audition and was really nervous, but at the same time I pumped myself up. Like most actors, when you finish an audition, you hate it and think you did horrible. However, I got a phone call telling me I got the role and I almost died. I couldn’t believe that I was going to be in the sequel to one of my favorite horror movies.
“So this was a dream come true, and any nervousness was soon overtaken by my excitement. We only had 21 days to shoot the movie and not a big budget at all. We filmed in this abandoned warehouse in Toronto and were working 16-hour days. At the time I had this really bad flu and was so sick. Also I was still young enough to need an on-set tutor. So I had to have two hours minimum of tutoring every day on top of working 16 hours and being sick. It was hard, but a good challenge for me. Funnily enough, my character is sick in the film, so I guess it actually worked out that I was sick in real life,” he jokes.
Not long after Saw II, the actor booked a series regular role in the CBS action/drama Jericho followed by four big screen projects including Scream 4. “I grew up watching the Scream movies, so it was awesome to work on Scream 4,” he enthuses. “As a kid I was terrified of the Scream mask, and here I was years later face-to-face with the real thing. It was an honor to work on such a classic movie with such an amazing and legendary director like Wes Craven, who I looked up to while growing up. It’s one of the best experiences of my life so far.”
In addition to Continuum, Knudsen can also be seen in episodes of the Canadian-made TV medical drama Saving Hope (premiering in June on NBC in the States) and writer/producer/ director Darren Lynn Bousman’s (Saw II) upcoming movie The Barrens. For the actor, having his name appear in the credits is not quite as important as the type of project he is working on.
“It’s really difficult because being an actor you don’t know when your next paycheck is going to come in, so you can’t always make the most artistic choices,” says Knudsen. “A lot of times you have to accept a role you’re not too thrilled about and might not really care for. Thankfully I have been really lucky and been working enough that I can choose projects that truly stand out to me, are well-written and a real challenge. I’m very grateful for that because right now I know a lot of people don’t have that luxury. A year from now that might all change, but right now I’m able to do that and I’m very happy with what I’ve chosen so far, including Continuum. I just saw some clips of the season finale and it’s going to be a great ride.”

The catch-all investment for online shopping is the Amplify Online Retail ETF (NASDAQ:IBUY), which has seen some volatility this year. IBUY closed up 0.9% on Friday after Black Friday online sales reports came in strong, but trades 23% below its 52-week high.
Mars: NASA’s planned landing of the Insight spacecraft is a huge moment for Lockheed Martin (NYSE:LMT). The lander built by Lockheed is due to touch down in the Elysium Planitia region of Mars at around 3:00 p.m. ET on November 26. A Lockheed mission operations team based out of Denver will support science collection through the life of the mission, estimated to last approximately two Earth years or one Martian year. Investors are looking for a little Mars magic, with shares of Lockheed Martin down 8.0% YTD.
Food for thought: Campbell Soup (NYSE:CPB) holds its shareholder meeting on November 29 amid a raging proxy battle with Third Point. Shares of Campbell Soup are up 3.5% since the company reported better-than-anticipated Q3 results, but the food company still has some work to do. Wells Fargo points to the new CEO selection, Lance-Snyder integration and soup turnaround as some big hurdles that need to be cleared. It’s hard to say if any M&A news will come out of the Campbell meeting, but food names such as J.M. Smucker (SJM), Farmer Bros. (NASDAQ:FARM), General Mills (NYSE:GIS), Flower Foods (NYSE:FLO), Kellogg (NYSE:K) and Hostess Brands (NASDAQ:TWNK) have been perky off of Campbell developments.
Los Angeles Auto Show: The L.A. Auto Show running from November 30 to December 9 will have a heavy focus on Automobility, including speakers on the topic from Ford (NYSE:F), General Motors (NYSE:GM), Magna International (NYSE:MGA), Lucid Motors, Honda (NYSE:HMC) and even an Amazon Alex exec. Visa (NYSE:V) will also be represented on an Automobility panel. Notable models debuting at the show include the 2020 Toyota (NYSE:TM) Corolla hybrid, BMW (OTCPK:BMWYY) X/5/X7 Sport Activity and 2020 Kia (OTCPK:HYMLF) Soul Crossover – as well as surprise models from Porsche (OTCPK:POAHY) and Nissan (OTCPK:NSANY).
Carvana in focus: Carvana (NYSE:CVNA) is scheduled to host its analyst day event on November 29. Wolfe Research has tipped that the event could be a catalyst if the company clears up the visibility on its long-term margin profile.
New Jersey: Keep an eye on the Garden State, with the New Jersey Senate Budget and Appropriations committee and the Assembly Appropriations committee set to meet on November 26 to discuss four marijuana-related bills. If legislation is to move forward, lawmakers will have to work out a tax rate for marijuana producers and retailers in the state. Good news out of New Jersey could provide a little lift for Cronos Group (NASDAQ:CRON), Aurora Cannabis(NYSE:ACB), Aphria (NYSE:APHA), Canopy Growth (NYSE:CGC), Tilray (NASDAQ:TLRY) and gang.
FDA watch FDA decision are due on Loxo Oncology (NASDAQ:LOXO)-Bayer ‘s (OTCPK:BAYRY) larotrectinib tumor treatment and Catalyst Pharmaceutical’s (NASDAQ:CPRX) Firdapse treatment for Lambert- Eaton myasthenic syndrome. There could also be FDA action on the resubmitted application from Celltrion-Teva Pharmaceutical Industries (NYSE:TEVA) on the Truxima biosimilar.
Evercore ISI HealthcareX: One of the bigger healthcare conferences of the year is scheduled to run from November 26 to November 29. Presenting companies include Agilent Technologies (NYSE:A), AbbVie (NYSE:ABBV), Arena Pharmaceuticals (NASDAQ:ARNA), Alexion Pharmaceuticals (NASDAQ:ALXN), Biogen (NASDAQ:BIIB), bluebird bio (NASDAQ:BLUE), CVS Health (NYSE:CVS), GlaxoSmithKline (NYSE:GSK), Illumina (NASDAQ:ILMN), Incyte (NASDAQ:INCY), Qiagen (NASDAQ:QGEN), Charles River Laboratories (NYSE:CRL) and Natera (NASDAQ:NTRA).

Under the Trafficking Victims Protection Act of 2000 (TVPA), the U.S. Department of Health and Human Services (HHS) is the sole Federal agency authorized to certify foreign adult victims of human trafficking so that they are eligible for federal and State benefits and services to the same extent as refugees admitted to the United States. Similarly, it is the sole Federal agency authorized to determine the eligibility of foreign minor victims of trafficking for the benefits and services available to refugees. Certification and Eligibility Letters are issued by the HHS Office of Refugee Resettlement (ORR).  U.S. citizen and Lawful Permanent Resident (LPR) victims do not need to be certified or receive a letter of eligibility to be eligible for similar benefits and services.
The Certification for Adult Victims of Trafficking and Child Victims of Human Trafficking fact sheets provide more information about HHS/ORR certification and eligibility determinations.
ORR also provides funding for services to foreign victims of trafficking and potential victims in the United States. The ORR National Human Trafficking Victim Assistance Program funds comprehensive case management to foreign victims of trafficking and potential victims in the United States seeking HHS/ORR certification through a network of sub-awardees in locations throughout the country.
Benefits and Services Available to Victims of Human Trafficking
Certified and eligible victims of human trafficking can receive benefits and services necessary for their safety, protection, and basic wellbeing. These include:
Housing assistance
Food assistance
Income assistance
Employment assistance
English language training
Health care
Mental health services
Foster care
Temporary Immigration Status and Relief
The TVPA created the T visa, a nonimmigrant status that allows a foreign victim of human trafficking to remain in the United States for up to four years. The law also allows certain members of a T visa holder’s family to apply for derivative T visa status.
There are several benefits to a T visa, including the following:
Employment authorization (EAD);
Possibility of adjusting status to Lawful Permanent Resident; and
Ability of certain family members to obtain nonimmigrant status as T visa derivatives.
Eligible family members of trafficking victims who have received T nonimmigrant status can apply for a special T visa for derivatives. These family members include the spouse, child, parent, or an unmarried minor sibling of a victim of trafficking victim who is under 21 years of age, or the spouse or child of a victim of trafficking who is 21 years of age or older. Like certified trafficking victims, T visa derivatives are eligible for Federal and State benefits and services to the same extent as refugees. Also, derivatives can apply for EADs.
Continued Presence (CP) is a one-year form of immigration relief that Federal law enforcement officials request on behalf of a victim of a severe form of trafficking who is also a potential witness. Continued Presence allows the victim to remain in the United States during the course of an investigation or prosecution as well as obtain an Employment Authorization Document (EAD).
Both CP and T nonimmigrant status are granted by the U.S. Department of Homeland Security.
The following are some of the specific benefit programs for which trafficking victims with a Certification or Eligibility Letter can apply.
Temporary Assistance for Needy Families (TANF) - A federally subsidized, State-run cash-benefit and work-opportunities program for needy families with children when the parents or other caretaker relatives are unable to provide for the family’s basic needs, and for pregnant women.
Supplemental Security Income (SSI) - A monthly benefit for persons who are blind or disabled, or are at least 65 years old and have limited income and resources.
Refugee Cash Assistance (RCA) - HHS/ORR program available to victims who are ineligible for TANF and SSI. RCA benefits are available for up to eight months from the date of ORR certification. RCA recipients must register for employment services and participate in employability service programs unless specifically exempted by State criteria. Minors who cannot comply with the employability service requirements cannot receive RCA.
Supplemental Nutrition Assistance Program (SNAP), formerly Food Stamps - Federal benefits to buy food that is provided to low-income individuals and families through an electronic card that is used like an ATM card at participating grocery stores.
Women, Infants and Children (WIC) - Provides supplemental food packages for nutritionally at-risk, low-income pregnant, breastfeeding, and postpartum women; infants; and children up to five years of age.
Medicaid - The federally subsidized State-run program that provides health coverage for low-income pregnant women, children, parents, adults, and those with disabilities who may have no insurance or inadequate medical insurance.
Children’s Health Insurance Program (CHIP) - The public health insurance program for low-income, uninsured children 18 years of age or younger who do not qualify for Medicaid.
Refugee Medical Assistance (RMA) - HHS/ORR program available to victims who are ineligible for Medicaid or CHIP. RMA benefits are available for up to eight months from the date of ORR certification, or the date of eligibility if the victim is a minor.
Medical Screening - Conducted by State or local health departments or their proxies for the diagnosis, treatment and prevention of communicable diseases and other conditions of public health importance.  This usually includes screening for tuberculosis (TB), parasites, and hepatitis B, as well as school vaccinations.
One-Stop Career Center System - Department of Labor (DOL)-funded nationwide network of employment centers that provide information and assistance for people who are looking for jobs, or who need education and training to get a job. Services include training referrals, career counseling, job listings, and other employment services.
Job Corps - DOL-funded centers to help eligible youth aged 16- 24 achieve employment, earn a high school diploma or GED and/or learn a vocational trade.
Matching Grant - HHS/ORR self-sufficiency program administered by private agencies as an alternative to public assistance and designed to enable clients to become self-sufficient within four to six months from the date of certification or eligibility. Provides case management; cash assistance and housing, when needed; and employment services. Clients must complete enrollment in Matching Grant within 31 days of the date of certification or eligibility.
Housing - Eligibility for affordable rental housing for low-income families, the elderly, and persons with disabilities, and Housing Choice Vouchers issued by low-income housing agencies to very low-income individuals and families so that they can lease privately owned rental housing.
Unaccompanied Refugee Minors (URM) Program - Provides specialized, culturally appropriate foster care or other licensed care settings according to children’s individual needs. Provides family reunification assistance when appropriate.

The Home Office published the ‘Statement of Changes CP 232’, on 14th May 2020 introducing certain changes to the existing UK Immigration Rules pertaining to certain categories of visas/immigration applications, these impacted the following categories including Representative of an overseas business or Sole representative visa, Tier 2 intra company transfers, Start-up, Innovator and Global Talent, Restriction for Tier 4 (General) Students applying within the UK, EU Settlement Scheme and EEA Family Permit, Family category (Spouse/Civil partner) [Appendix FM and FM-SE]
Whilst a majority of these changes are aimed at further specifying and clarifying the underlying aspects of the Immigration Rules which were provided for within the guidance for those specific categories of visas or previously left for interpretation. The changes are to take effect from 4th June 2020 (majority of them).

They key focus of the changes (May 2020) to the Sole Representative category (entry clearance applications) is on the genuineness of the applicant.
Particularly that the applicant has been recruited and taken on as an employee outside the United Kingdom, by a business which has its headquarters and will continue to have its headquarters and principal place of business outside the UK;
Clarifying the rule on who can be a sole representative the applicant should be a senior employee of an active and trading overseas business which has no active branch, subsidiary or other representative in the UK for the purpose of representing that business in the United Kingdom by establishing and operating a registered branch or wholly-owned subsidiary of it,
the branch or subsidiary will actively trade in the same type of business as that overseas business and is not being established solely for the purpose of facilitating the entry and stay of the applicant;
The changes also emphasise that the applicant should be able to demonstrate the skills, experience and knowledge of the business necessary to undertake that role, and the full authority to negotiate and take operational decisions on behalf of that business.
It continues to emphasise that the applicant is an existing senior employee of that overseas business who intends to be employed full time as a representative of that business and will not engage in business of his own or represent any other business’s interest in the United Kingdom;
To avoid this route being used by majority owners of the business, the changes clarify that the applicant should not have a majority stake in, or otherwise own or control, that overseas business, whether that ownership or control is by means of a shareholding, partnership agreement, sole proprietorship or any other arrangement;
The major change introduced to the Sole-Representative (dependent partner) category was clarifying that where the applicant is accompanying or joining a person granted entry clearance or leave to enter or limited leave to remain as the sole representative of an overseas business, the applicant does not have a majority stake in, or otherwise own or control, that overseas business, whether that ownership or control is by means of a shareholding, partnership agreement, sole proprietorship or any other arrangement.
This is a significant change as there were no previous specifications (Rules) regarding the overseas employment/self-employment of the dependent partners of Sole-Representative visa holders.

Introducing: The Poisoned Pearsons
They were doomed from the start.
Trigger warning: EVERYTHING. Homophobia, spousal abuse, cheating, injuries, child abuse, child sexual abuse, neglect, deportation.
Residence: Copperwood Apartments. XXX (this is horrible)
TL;DR: I went overboard writing because I have a problem. A closeted Canadian lesbian marries an ill-tempered Hawaiian to stay in the country. They’re poor, have a baby, a toxic relationship where they both cheat on each other. She works a lot, he stays with the kid and abuses her horribly. He finds out she’s cheating on him with women and gets her deported. She hides it from their daughter, saying she’s got a job abroad and will come back for her soon and keep in touch. Two years later, Rowan is living with her monster of a dad, has had no contact with her mom, thinking she’s just too busy. However, Rowan’s mom is in Vancouver, after becoming a successful international affairs analyst. She’s working tirelessly with her lawyers and a PI to find her daughter and husband (she hasn’t been able to divorce him) and being madly in love with an anesthesiologist Felix’s mom say what (they’re about to move in together). THIS IS SO FUCKING LONG
Amelia and Angelo met in college in Hawaii; A Canadian on a student visa and a partyboy.
Angelo fell for Amelia and constantly sought her attention. Little did he know that Amelia only had eyes for the gorgeous TA in one of her classes and had never been attracted to men ( PLOT TWIST!! )
Amelia’s parents were hateful WASPs from Montreal who kept pressuring her to find a good man to marry, so when she finally came out to them, she was disowned and casted aside like trash. This devastating for Amelia, who had to drop out of her beloved college.
Amelia didn’t want to go back to Canada, she had nothing left there and in a moment of vulnerability, gay panic and fear of the unknown, she got married to Angelo to get her green card.
Life was dull for them. They barely liked each other.
It was two days after Angelo first hit Amelia that she got a job as a flight attendant, ready to see the world like she had planned from the beginning and get away from the toxic shadow that was her husband.
They barely saw each other the next couple of years. Both cheating on each other with beautiful women. They knew the other was cheating, but never said anything. However, Angelo was still clueless about his wife’s being a lesbian.
Angelo had no plans of leaving Oahu, he found a job as a trucker for hire and had no ambitions. Amelia was hoping to save enough money to go back to school and follow her dreams of working for the U.N.
Until she found herself back in Oahu, in Angelo’s house on maternity leave. They had never even discussed kids, but Amelia was rejoiced by the news of being a mother. Angelo wasn’t.
But maybe a baby was what they needed to finally get some semblance of normalcy in their lives. Angelo took more jobs and when little Rowan was born, there was a sliver of hope that things could turn out okay.
Things were okay for a bit: they had a house and a quiet baby. Angelo and Amelia were still distant with each other, but amicable.
Angelo “hurt” his back and had to stop working and never really went back. He felt like it was unfair that his “wife” was spending time at home with the kid while he slaved off.
Which made Amelia have to go back to being a stewardess, leaving a six year old Rowan behind. It was heartbreaking but their finances weren’t stable and she wanted the best for her little girl.
There was no connection between Angelo and Rowan. Rowan barely knew her dad. She knew he was loud and scary and always criticized and yelled and said the most hurtful things, which drew Rowan deeper into her shell and she’d count the days until her mom would come back.
There was no apology from Angelo when he broke his daughter’s wrist for staining the carpet with mud. Luckily for him, the doctors only checked Rowan’s arm, because if they had checked her further they would’ve seen bruises littering the entirety of the young girl’s body. 
She doesn’t remember how the abuse started, she just knows it never stopped.
Then the weird touches started, the lingering stares, the forbidden roughness… He started coming into her bedroom at night and took Rowan’s virginity before she could even put the suffix “-teen” into her age, let alone know exactly what was happening. She just knew it was wrong and it was the most horrifying nightmare that she couldn’t wake up from.
And it just never stopped.
Expenses were growing so Amelia had to work more and more, barely seeing Rowan more than a few hours a week. 
She noticed some changes in her daughter but she figured they were from the separation. And Rowan never said a word about the abuse because Angelo told her that if she did, she would send her mother back to Canada and she’d never see her again.
Everything went to hell on a fateful night when Rowan and Amelia fell asleep watching a movie and Amelia started receiving texts messages from one of her one-night stands: a beautiful woman from Atlanta. Angelo unlocked Amelia’s phone and saw all the evidence that confirmed that his “wife” was cheating on him still. But that didn’t make him lose control, he cheated all the time too (was it even cheating if both of them knew?) 
What made him lose it was the fact that his wife was apparently a lesbian and was cheating on him with women.
Angelo disappeared for three days without saying a word, Amelia and Rowan blissfully unaware.
When he came back, he wasn’t alone. He had an entourage of ICE agents with him and a foolproof case that proved that his wife had overstayed on a student visa, married him only to get a green card, was cheating on him and on top of everything, was the one abusing Rowan.
Everything happened so fast, all the odds were against Amelia. Rowan was ready to defend her mom but Angelo swiftly threatened her into staying silently (breaking two of her ribs in the process) and saying he was going to do the same to her mom.
If there was a trial, Rowan heard nothing of it. For three days she was left in a motel with CPS officers checking in on her every few hours. Nobody would answer her questions.
In the end, a teary Amelia explained Rowan how she had done something bad when she was young but she was being allowed to fix it by going away for some time. She said she was going to be abroad for a few months, fixing the situation and she’d stay in contact.
It was not a lie, Amelia thought things would be that easy and she’d be able to come back to the States for her daughter, but the restrictions for her visa violation were strict and she needed at least a year to start getting everything in motion, let alone have enough money to pay lawyer and court fees.
She sent letters explaining everything to Rowan, but little did she know, that they were being intercepted by her husband and never reached her daughter. 
She tried calling, emails, anything to both Angelo and Rowan, but it was like they had vanished with no trace. Of course, vanished to Northlake, Wisconsin in the middle of the night, to escape the IRS so Amelia had basically zero chances of finding them.
Angelo’s abuse continued to escalate, to the point where he doesn’t even care if Rowan goes days without eating. He will still beat her senseless and abuse her sexually in any way he feels like it: Rowan is the reminder of the wife that turned out to be a lesbian. He can’t stand seeing her, all he can do is hurt her. 
Rowan keeps writing letters to her mom, to a P.O. box in Europe that belongs to a random stranger. But it’s the information Angelo gave her in a moment of weakness, thinking Rowan could start getting too suspicious. He knows better now, and knows he can quell his daughter’s curiosity with inflicting more pain. 
In the meantime, Amelia is currently residing in Vancouver, where she has become a great international affairs analyst and is making a lot of money, working with the Canadian government.
However, this is all mainly to fund her fight to reunite herself with her daughter. She has great lawyers who have told her she can charge Angelo with an array of crimes including kidnapping. She just has to wait a little bit longer, keep building the case. 
Amelia stays strong thinking about a happy future with Rowan, away from Angelo. But Georgia, her girlfriend, has also been an infinite source of strength and love. They are in the process of moving in together.

Volopay, a Singapore-based startup building a “financial control center” for businesses, announced today it has raised $2.1 million in seed funding. The round was led by Tinder co-founder Justin Mateen, and included participation from Soma Capital, CP Ventures, Y Combinator, VentureSouq, the founders of Razorpay and other angel investors.
The funding will be used on hiring, product development, strategic partnerships and Volopay’s international expansion. It plans to launch operations in Australia later this month. The company currently has about 100 clients, including Smart Karma, Dathena, Medline, Sensorflow and Beam.
Launched in 2019 by Rajith Shaiji and Rajesh Raikwar, Volopay took part in Y Combinator’s accelerator program last year. It was created after chief executive officer Shaji, who worked for several fintech companies before launching Volopay, became frustrated by the process of reconciling business expenses, especially with accounting departments located in different countries. Shaiji and Raikwar also saw that many companies, especially startups and SMEs, struggled to track different kinds of spending, including subscriptions and vendor payments.
Most of Volopay’s clients are in the tech sector and have about 15 to 150 employees. Volopay’s platform integrates multicurrency corporate cards (issued by Visa Corporate), domestic and international bank transfers, automated payments and expense and accounting software, allowing companies to save money on foreign exchange fees and reconcile expenses more quickly.
In order to speed up its development, Volopay integrated Airwallex’s APIs. Its corporate cards offer up to 2% cash back on software subscriptions, hosting and international travel, which Volopay says are the three top expense categories for tech companies, and it in November 2020, it launched a credit facility for corporate cards to help give SMEs more liquidity during the COVID-19 pandemic.
Compared to traditional credit products, like credit cards and working capital loans, Shaji said Volopay’s credit facility, which is also issued by Visa Corporate, has a more competitive fixed-free pricing structure that depends on the level of credit used. This means companies know how much they owe in advance, which in turn helps them manage their cashflows more easily. The average credit line provided by Volopay is about $30,000.
Since TechCrunch last covered Volopay in July 2020, it has grown 70% month on month in terms of total funds flowing through its platform, Shaji said. It also launched two new features: A bill pay feature that allows clients to transfer money domestically and internationally with low foreign exchange rates and transaction fees, and the credit facility. The bill pay feature now contributes about 40% to Volopay’s total payment volume, while the credit product makes up 30% of its card spending.
Shaji told TechCrunch that Volopay decided to expand into Australia because because not only is it a much larger market than Singapore, but “SMEs in Australia are very comfortable using paid digital software to streamline internal operations and scale their businesses.” He added that there is currently no other provider in Australia that offers both expense management and credit to SMEs like Volopay.

Know the Changes in the Immigration rules of UK Sole Representative Visa

The Home Office published the ‘Statement of Changes CP 232’, on 14th May 2020 introducing certain changes to the prevailing UK Immigration Rules concerning certain categories of visas/immigration applications, these impacted the subsequent categories including Representative of a foreign business or Sole representative visa, Tier 2 intra company transfers, Start-up, Innovator and Global Talent, Restriction for Tier 4 (General) Students applying within the united kingdom , EU Settlement Scheme and EEA Family Permit, Family category (Spouse/Civil partner) [Appendix FM and FM-SE]
Whilst a majority of those changes are aimed toward further specifying and clarifying the underlying aspects of the Immigration Rules which were provided for within the guidance for those specific categories of visas or previously left for interpretation. The changes are to require effect from 4th June 2020 (majority of them).
They key focus of the changes (May 2020) to the only Representative category (entry clearance applications) is on the genuineness of the applicant.
Particularly that the applicant has been recruited and brought on as an employee outside the uk , by a business which has its headquarters and can still have its headquarters and principal place of business outside the UK;
Clarifying the rule on who are often a sole representative the applicant should be a senior employee of a lively and trading overseas business which has no active branch, subsidiary or other representative within the UK for the aim of representing that business within the uk by establishing and operating a registered branch or wholly-owned subsidiary of it,
the branch or subsidiary will actively trade an equivalent sort of business as that overseas business and isn't being established solely for the aim of facilitating the entry and stay of the applicant;

The changes also emphasise that the applicant should be ready to demonstrate the talents , experience and knowledge of the business necessary to undertake that role, and therefore the full authority to barter and take operational decisions on behalf of that business.
It continues to emphasize that the applicant is an existing senior employee of that overseas business who intends to be used full time as a representative of that business and can not engage in business of his own or represent the other business’s interest within the United Kingdom;
To avoid this route getting used by majority owners of the business, the changes clarify that the applicant shouldn't have a majority stake in, or otherwise own or control, that overseas business, whether that ownership or control is by means of a shareholding, partnership agreement, sole proprietorship or the other arrangement;
The major change introduced to the Sole-Representative (dependent partner) category was clarifying that where the applicant is accompanying or joining an individual granted entry clearance or leave to enter or limited leave to stay because the sole representative of a foreign business, the applicant doesn't have a majority stake in, or otherwise own or control, that overseas business, whether that ownership or control is by means of a shareholding, partnership agreement, sole proprietorship or the other arrangement.
This is a big change as there have been no previous specifications (Rules) regarding the overseas employment/self-employment of the dependent partners of Sole-Representative visa holders.

BENGALURU: India’s cash rich IT services companies are eyeing captive technology centres of global corporations, as they gear up to provide IT and back-office services at lower costs and offset a demand slowdown from the US and European markets in the wake of the COVID-19 pandemic.
In the last three years, many global firms have either expanded their global in-house centres or set up new ones in India, looking to own the digital and analytics-based tech operations within the company as it became strategic.
The global economic slowdown has, however, made some of these companies shed costs and outsource work to large services companies.
India has nearly 1,300 captives across cities and they together employ nearly one-fourth of the 4.3 million workers in the $191-billion IT-Business Process Management sector.
“We have seen a 50% jump in captive search. Our records show that searches have gone up in March and April. Enterprises are searching for captive monetisation, those with poor financial performance and low cash to burn in the near term,” Vishwakumar Nandagopal, head of India Operations at global technology research and advisory firm ISG, told ET
Consulting firm ANSR, which has helped more than 50 captives set up shop in India, also said there had been a surge in enquiries for captives.
“Of the top 10 IT services companies we have spoken to, six of them reached out to us asking about captives,” said Lalit Ahuja, chief executive officer, ANSR.
The renewed interest in captives – just as during the global financial crisis of 2008 – can be attributed to reasons such as the unprecedented economic crisis, challenges of getting visas and softening of demand, Ahuja added.
“For us, merger & acquisitions is clearly in strategy and carve-outs and captives have always interested us. If there is an opportunity, we will definitely engage and have a conversation,” CP Gurnani, CEO, Tech Mahindra, told ET.
India’s largest technology services exporter TCS said last month that it would look at some strategic acquisition opportunities, without elaborating.

Fischer Wins First Match Havana (CP)—U.S. chess champion Bobby Fischer defeated Heinz Lehmann, West German international master, in 32 moves Thursday in a first-round match of the Casablanca chess tournament. Fischer's moves were relayed by teletype and cable from New York because the 22-year-old champion was denied a visa to travel to Cuba by the U.S. state department. Fischer, youngest of the international grand masters, will face a total of 22 opponents before the tournament ends Sept. 20. Fischer's moves were written on paper, which was carried to a small office where a teletype machine was set up to relay them by cable. The teletype operator relayed not only Fischer's moves but the time he took for each move. Fischer's opponents' moves also are relayed by teletype.

H-1B Visa Ban: What it Means for Indian IT
US President Donald Trump issued an order to suspend H-1B visas along with other foreign work visas for the rest of the year, stating that the step was essential to help millions of Americans who have lost their jobs due to the current economic crisis. Many of the tech industry’s biggest and most influential companies criticized this move as it prevents highly skilled foreign citizens from entering the US through the end of the year.
While Trump was reportedly mulling on the work visa ban for a while now, the recent announcement would severely affect Indian IT firms and their ability to meet their project deadlines as over three-to-four lakh H-1B visa workers in the US are employed by Indian IT firms like Infosys, Tata Consultancy Services (TCS), Wipro and Cognizant that account over two-thirds of the H-1B visas. Nonetheless, some see a silver lining waiting for tech professionals in India and the move would not be as disruptive as it seems now.
Indian IT in troubled water
With over 60% of engineers in the US comprise H-1B visa holders, and three-fourth being Indian, the ban will surely impact the prospects of the H-1B visa applicants from top Indian IT services firms in India .
With Trump supporting stricter immigrant, non-immigrant visa regimes, the Indian IT firms have reduced their applications for H1-B visas considerably since the last couple of years with efforts to hire more locals in the US, as TCS said in its annual report that it has nearly 20,000 US nationals on its payroll.
However, industry analysts fear that a long term ban of H-1B visas which recruit workers for specialist positions in fields such as IT, science will hurt the project deliverability of Indian IT services firms because of shortage in the talent.
“The overall unemployment rate in the United States nearly quadrupled between February and May of 2020 — producing some of the most extreme unemployment ever recorded by the Bureau of Labor Statistics,” Trump wrote in the order. “Without intervention, the United States faces a potentially protracted economic recovery with persistently high unemployment if labor supply outpaces labor demand.
Trump’s expanded travel restrictions by the newly announced freeze of the H-1B, H-2B, H-4, L-1 and J-1 visas will prohibit about 525,000 people from entering the country, including 170,000 green-card holders who have been prevented from entering the US since April, according to a report by The Wall Street Journal that quoted a senior administration official.
Stating this as a ‘significant number’, the official said President Trump is focusing on getting Americans back to work as quickly as possible after suffering this hit to the US economy based on the coronavirus and the harm it’s done.

H1B Ban: The fierce opposition
The Directive however, is fiercely opposed by business leaders and IT lobbies, who believe it will block their ability to recruit critically needed workers from countries overseas for jobs that Americans are not willing to do or are not capable of performing.
According to the National Association of Software and Service Companies (Nasscom), the new order will prevent Indian companies and thousands of other organizations from accessing the talent they need from overseas. The proclamation will impose new challenge and possibly force more work to be performed offshore since the local talent is not available.
Nasscom wrote to the President and his Secretaries that policies such as these undercut the ability to grow and create jobs, inhibit the provision of critical infrastructure services, and add burdensome new regulatory requirements and costs.
Nasscom argued that American workers are facing greater challenges than they have in years, but that does not mean that talent shortages do not continue to exist.  Despite national unemployment trends across the economy, the National Foundation for American Progress found that the unemployment rate for computer professionals actually went down from 3% in January 2020 to 2.8% in April 2020, according to its analysis of the Bureau of Labor Statistics’ Current Population Survey.
“Virtually every segment of the American economy, including manufacturing, technology, accounting, medicine, among others, employ skilled workers from other countries for the innovation, productivity, and skill they bring to their companies or for their clients,” said the Nasscom statement.
Highly skilled non-immigrants are playing critical roles in the delivery of these services and the development of these services and products. Without their continued contributions to the U.S. economy, the economic pain would worsen, industry would slow, and the timeline for a treatment and cure of Covid-19 would lengthen. Moreover, the people who come to the United States on H-1B and L-1 visas pay taxes and contribute to their communities and to local economies in myriad other ways as well.
Studies have revealed the immeasurable value non-immigrants have and will bring to America, said Nasscom stating that the IT body hopes that the Administration will rethink its stated plans to move forward on a series of regulatory changes that would place additional restrictions and costs on visa programs while doing little more than amplifying the harm already being done to the U.S. economy.
Groups representing Silicon Valley technology giants also criticized the move. The Information Technology Industry Council, a high-profile lobby group for large technology companies including Silicon Valley giants Apple, Facebook, Google, HP, Oracle and Salesforce, said Trump’s move came at a bad time, and urged him to reconsider.
BSA, The Software Alliance, whose members include Microsoft and Slack, urged the administration in a statement to “refrain from restricting employment of highly-skilled foreign professionals,” adding that “these restrictions will negatively impact the U.S. economy” and decrease job opportunities for Americans.
Silicon Valley’s technology companies for years have relied heavily on the H-1B, pushing for an expansion to the annual cap of 85,000 new visas and arguing that they need more visas to secure the world’s top talent. Critics point to reported abuses and say the visa, intended for jobs requiring specialized skills, has been used by staffing and outsourcing companies, and major tech firms, to supplant U.S. workers, drive down wages and facilitate outsourcing of U.S. jobs, believe experts.

So far this year, Facebook has received approval for 666 new and extended H-1B visas for its Menlo Park office, Google has been approved for 824 new and extended visas for its Mountain View offices, Apple has obtained approval for 670 new and extended visas for its Cupertino offices, and electric car manufacturer Tesla received 186 new and extended visas for its offices in Palo Alto and its Fremont factory, according to data from U.S. Citizenship and Immigration Services. The H-1B is also widely used by universities — Stanford University was approved for 94 visas this year and the University of California, Berkeley for 39.
The silver lining?
Some however see a silver lining in this entire process. They believe, while suspending H1B visa for the rest of 2020, US President Donald Trump mentioned merit-based H1B visa for all foreign workers. And if merit-based visa is introduced, it can be beneficial for all Indians, especially those who are highly skilled, and are experts in their domain of work.
Under the current system of H1B visa allocation, a lottery determines who gets the visa, and who are denied. For immigration visa, there is The Diversity Immigrant Visa Program, which takes into account the nationality of the applicant, and if citizens from a nation have received more than 50,000 green cards, then immigration visa is denied.
However, under merit based immigration and H1B visa, the US government will consider giving visas to the highly skilled, and in-demand employees. A simple check would be the salary offered by US companies to the H1B visa applicants. In other words, the ones with the maximum salary will be given more preference, compared to low-paid workers.
This will ensure that only the cream of the foreign workers, whose work is in high demand will be given more preference, and also it will be open up entry-level jobs for the Americans, since H1B visa won’t be entertain that.
Indian IT workers, who are the most educated, experienced and seasonal employees with highest salaries, will be the most beneficial category, in case merit-based H1B visa is introduced.
Also as Tech Mahindra MD and CEO CP Gurnani said in an interview to CNBC-TV18, Trump administration’s move to restrict work visas will not lead to any disruption for the Indian IT services sector. He said the industry had prepared itself for unrealistic immigration challenges, and is not overly depending on H-1B visas.
“We were locally hiring and training a lot more engineers. So India’s own applications for H-1B visas have reduced. The impact on India or on Indian companies will be less in the short-term, it is not going to lead to any disruption,” Gurnani said, adding that the US needed Indian IT talent more than the other way round.
