July 3 (UPI) -- A group of Japanese men and women subjected to forced sterilization between the 1950s and 1970s won the right to compensation from the government in a landmark ruling in Japan's Supreme Court on Wednesday.
The 15-judge bench ruled for the first time that the surgery, carried out under now-lapsed eugenics legislation, was unconstitutional and that the 20-year statute of limitations did not apply in cases involving the law which targeted those with intellectual disabilities, mental illness or hereditary disorders to ensure their "inferior" children would never be conceived.
The unanimous judgment condemned allowing the government to dodge liability through the statute of limitations as "extremely unfair and unjust," calling its application by the state "intolerable," an abrogation of the "duty of good faith" and "an abuse of power."
Upholding the finding of five lower courts, the judges agreed the law was unconstitutional, they said, because it violated Article 13 of the Constitution guaranteeing the freedom of people not to undergo physically invasive procedures against their will, as well as their right to equality under Article 14.
Government figures put the estimated number of people who were sterilized under the 1948 law which was in force for almost four decades until it was repealed in 1996, at around 25,000 with 16,000 subjected to procedures without their consent.
The ruling enabling the plaintiffs to seek compensation sets a precedent for other victims in similar situations whose lawyers are pushing for a final resolution for their clients, all of whom are now in advanced age.
Prime Minister Fumio Kishida pledged immediate steps to correct the injustice.
Apologizing to the victims, Kishida promised a meeting by the end of the month to say sorry in person and said he had ordered his ministers for justice and equality to draw up a scheme to compensate them.
"I've instructed [Equalities] minister Ayuko Kato to consider measures to draft a new compensation framework in a swift manner."
The plaintiffs, who filed the lawsuits at five district courts in cities across the main islands of Honshu and Hokkaido were among 39 people pursuing similar lawsuits at 11 district courts and a branch court.
All five courts that heard the cases of the plaintiffs in Wednesday's case ruled the law was unconstitutional.
Judges in four of the courts threw out the time-limit defense and ordered the government to pay between $68,000 and $102,000 to each victim, and $13,600 to the spouse of a victim who had since died, far exceeding the $19,750 one-off payments to around 1,100 people under legislation passed in 2019.
The fifth court ruled the statute of limitations did apply forcing the Supreme Court, despite overturning that decision, to return the case to the court in Sendai, 230 miles northeast of Tokyo, for it to decide on the compensation figure due to the plaintiffs.

According to the ED, Chandrakar and Uppal orchestrated the operations of Mahadev Online Betting from a central headquarters located in the UAE. They employed a franchising model, establishing "Panel/Branches" for their associates, with profit-sharing arrangements set at a 70:30 ratio.
A deeply troubling aspect of this scandal revolves around the exploitation of vulnerable communities, specifically slum residents and those with limited incomes. It appears that individuals implicated in this alleged scam acquired UPI (Unified Payments Interface) details from these unsuspecting individuals, effectively using them as pawns in money laundering schemes. In return for the use of their UPI IDs, these victims were given meager sums, while the ill-gotten funds were channeled to foreign entities. The Enforcement Directorate (ED) is currently conducting a thorough investigation to determine the full scope of this fraudulent activity and quantify the amount of money that has been laundered through this deceptive modus operandi.
Lavish Wedding Expenditure Raises Concerns
Recent ED raids conducted in Bhopal, Mumbai, and Kolkata have brought to light the extravagant lifestyle of the primary accused, Saurabh Chandrakar. Astonishingly, it was revealed that he lavishly spent over Rs 200 crore on his wedding ceremony in the United Arab Emirates (UAE). Shockingly, reports suggest that the funds for this opulent celebration were sourced from the proceeds of criminal activities.
Private jets were chartered to transport family members from Nagpur to the UAE for the wedding festivities, and renowned celebrities were hired for special performances. An array of wedding planners, dancers, and decorators were flown in from Mumbai, with cash payments facilitated through clandestine hawala channels.

Oct. 11 (UPI) -- The Biden administration on Wednesday announced new measures in its ongoing effort to eliminate so-called "junk fees."
President Joe Biden was expected to join FTC Chair Lina Khan and Consumer Financial Protection Bureau Director Rohit Chopra at 11:45 a.m. EDT at the White House Wednesday to announce the latest initiative aimed at prohibiting surprise fees that continue to burden consumers.
The Federal Trade Commission proposed new rules Wednesday that would ban hidden fees on goods and services that continue to nickel and dime American consumers with unexpected costs.
If enacted, the new rules would prohibit junk fees and deceptive charges for airline tickets, hotel and resort bookings, live events, apartment rentals, and utility bill payments -- potentially saving taxpayers tens of billions of dollars each year.
The U.S. Consumer Financial Protection Bureau also issued fresh guidance Wednesday to the nation's big banks, saying they were still subject to the 2010 Consumer Financial Protection Act, which prohibits large financial institutions and credit unions from charging junk fees for basic customer service.
"While small relationship banks pride themselves on customer service, many large banks erect obstacle courses and impose junk fees to answer basic questions," Chopra said in the statement from the agency. "While the biggest banks have abandoned the relationship banking model, federal law still requires them to answer certain customer inquiries completely, accurately, and in a timely manner."
Since taking office in 2021, Biden has called for increased limits on bank fees for bounced checks and account overdrafts, which would save consumers more than $5 billion a year.
Under the FTC rule changes, businesses would have to disclose all mandatory fees up front, which would make it easier for consumers to comparison shop for the lowest price, the agency said.
Airlines would also be required to disclose all fees up front, and eliminate family seating fees, while hidden fees for concert and sports tickets would also be prohibited, the White House said previously.
The proposed rules seek to end bait-and-switch practices across the wider economy and prevent businesses from running up the tab with hidden fees, ensuring customers know exactly how much they are paying and what they are getting from the deal.
The changes would have the effect of sparking more competition in the market, leading to lower prices for consumers, the administration said.
The time savings alone equates to about $10 billion, or 50 million hours, that consumers currently spend each year searching for cheap tickets and hotel stays, according to government estimates.
The Biden administration requested public comments on bogus fees a year ago, with more than 12,000 consumers attesting to the ongoing impact of hidden charges.
"All too often, Americans are plagued with unexpected and unnecessary fees they can't escape," FTC Chair Khan wrote in a press release announcing the next phase of public commentary on the issue. "These junk fees now cost Americans tens of billions of dollars per year -- money that corporations are extracting from working families just because they can."
Khan said the hidden fees take advantage of consumer-protection loopholes while serving as a drag on the American economy.
During the first public comment phase, a majority of consumers said merchants often don't reveal the total cost of a product until the transaction is completed, and the receipt printed with the fees included.
Many also said that sellers often misrepresent the purpose of certain fees, leaving consumers wondering what they are paying for or if they are getting anything at all for the fee charged, the agency said.
"By hiding the total price, these junk fees make it harder for consumers to shop for the best product or service and punish businesses who are honest upfront," Khan wrote. "The FTC's proposed rule to ban junk fees will save people money and time, and make our markets more fair and competitive."
Should the provisions become law, the FTC vowed to enforce the rules by seeking federal damages against companies that do not comply and give those awards back to consumers.
The FTC voted 3-0 to approve the public notice of the proposed rules, which will now go into the Federal Register for 60 days for public comment.

RBI Extends Transaction Limits for UPI 123Pay and UPI Lite UPI 123Pay and UPI Lite are two features that RBI had introduced to make UPI payments even more convenient and easy than they already are. Recently, RBI further enhanced these features by increasing their transaction limits. Customers using UPI123Pay, which provides UPI functionality on feature phones, will have a per-transaction limit of ₹10,000, up from the previous cap of ₹5,000.
