SC seeks to know why Unnao rape victim's letter to CJI didn't reach him
Tumblr media
The Supreme Court on Wednesday sought a report from its secretary general as to why a letter written by the Unnao rape victim to Chief Justice of India Ranjan Gogoi, apprehending threat to her life, was not placed before him.
"Unfortunately, the letter is yet to see the light of the day and yet the newspapers flashed it as if I have read the letter," Justice Gogoi said.
The observations came when senior lawyer V Giri, who is assisting the court as an amicus curiae in child rape cases, sought urgent listing of the Unnao rape case.
The court also asked the Uttar Pradesh authorities to file a status report by Thursday on the accident of the Unnao rape case victim.
The 19-year-old woman, who was allegedly raped two years ago by BJP MLA Kuldeep Singh Sengar at his residence in Unnao, was critically injured in a car crash on Sunday. Read More

A 23-year-old rape victim set on fire by a gang of men, which included her alleged rapists, has died in a New Delhi hospital, prompting protests from opposition leaders who blamed the ruling party for failing to check incidents of violence against women.
The woman was on her way to board a train in Unnao district of northern Uttar Pradesh state to attend a court hearing over her rape when she was doused with kerosene and set on fire on Thursday, according to police.
She was airlifted to New Delhi for treatment later that day.
The attack, the second major case of violence against women in the past two weeks, has sparked public outrage in India.
The woman died on Friday after suffering a cardiac arrest, Dr. Shalabh Kumar, the head of burns and plastic department at New Delhi's Safdarjung Hospital told Reuters.
"She was having 95% burns," he said, adding the woman's wind pipe was burned and "toxic and hot fumes" had filled her lungs.
The woman had filed a complaint with Unnao police in March alleging she had been raped at gun-point on December 12, 2018, police documents showed. The woman named two local men, one of them was arrested by police, the other absconded.
Having been subsequently jailed, the alleged rapist was released last week after securing bail, police officer S.K. Bhagat said in Lucknow, the capital of Uttar Pradesh state.
On Thursday, the rape victim was seized by five men, including the two people she had named in her complaint, and beaten, stabbed and set on fire, local media reported citing her statement to police.
Still ablaze, she walked nearly a kilometer, seeking help before finally calling the police herself, according to Aaj Taj TV news channel.
All five of the accused have been arrested and are in 14-day judicial custody, Vikrant Vir, superintendent of police, Unnao, told Reuters.
A fast-track court would hear the case and the guilty would not be spared, Uttar Pradesh Chief Minister Yogi Adityanath said.
In India, lengthy trials, often a result of fewer courts and judges, tend to delay convictions, leaving poor, disillusioned victims with little money and patience to pursue the case.
Also, long trials result in bails to the accused who often intimidate victims and their witnesses, and try tampering with evidence.
The victim's father has alleged that his family was been harassed and threatened by the family of the accused.
"We tried to seek protection as the accused and their family kept threatening my daughter and my family, but we received little help from the government," he said. "Now, every single accused should be either hanged or shot dead."
CRIME IN UTTAR PRADESH
Uttar Pradesh is India's most populous state and has become notorious for its poor record regarding crimes against women, with more than 4,200 cases of rape reported there in 2017 - the highest in the country.
Opposition leaders, including Priyanka Gandhi Vadra, general secretary of India’s main opposition Congress party, accused the Uttar Pradesh government, run by Prime Minister Narendra Modi's ruling Bharatiya Janata Party, of failing to curb crimes against women.
In an earlier incident in Unnao, a young woman had accused Uttar Pradesh lawmaker Kuldeep Singh Sengar of raping her in 2017. In July last year, the victim and her lawyer were critically injured in a highway collision, when a truck hit the car in which they were traveling. The woman's two aunts, who were also in the car, were killed in the accident.
Sengar denies the rape and any involvement in the car crash.
On Friday, Indian police shot dead four men who were suspected of raping and killing a 27-year-old veterinarian near Hyderabad city, drawing applause from across the country angry over violence against women.
But many were also concerned that police had over reached in shooting the alleged suspects without any trial.
"What will it take (to end rapes)? Not the encounter of just the poor men who rape but swift arrest and certain punishment of all rapists, however powerful or closely related to the victim," said Karuna Nundy, a lawyer practicing at India's Supreme Court who was instrumental in shaping anti-rape laws in 2013.
"And that takes real change, it's not as easy as passing a legal amendment to increase sentencing."

‘Unleashed a tirade’: Judge convicts MLA Kuldeep Sengar for rape; he breaks down - india news
Tumblr media
A Delhi court on Monday convicted expelled Bharatiya Janata Party (BJP) legislator Kuldeep Singh Sengar for abducting and raping a minor girl in 2017, pronouncing judgment in a sensational case that triggered nationwide protests. Reading out his order, district judge Dharmesh Sharma noted that the testimony of the rape survivor, who is now 19 years old, was “truthful and unblemished” against a “powerful person”. “She was under threat, worried. She is a village girl, not from cosmopolitan educated area...Sengar was a powerful person. So she took her time...,” the judge said. WATCH | Unnao rape case: MLA Kuldeep Sengar convicted by Delhi court; CBI pulled up Sengar, 53, a four-time legislator who is also accused of hatching a criminal conspiracy against the survivor’s family and causing them harm, was convicted under the Protection of Children from Sexual Offences (Pocso) Act. The court will hear arguments on the quantum of sentence on Tuesday. Sengar’s offences can invite a maximum punishment of life imprisonment. “A tirade was unleashed upon the girl and her family members... where imprints of the accused Sengar were quite visible,” the judge said. Sengar, once a powerful lawmaker, was in tears in the court. The judge added that the Central Bureau of Investigation (CBI) proved that the survivor was a minor and that Sengar was rightly prosecuted under the Pocso Act. “The instant case manifests the multitudes of restrictions and taboos within which many women in the rural areas are brought up, grow and survive. It epitomises the fear ingrained in the mind of young girl in the countryside or elsewhere against reporting issues of sexual assault by powerful adults,” the judge said in the order. The judge also pulled up CBI, saying the investigation “suffered from patriarchal approach or inherent outlook to brush the issues of sexual violence against the children under the carpet”. “It appears that somewhere the investigation in the instant case has not been fair to the victim of crime and her family members. The investigation has not been conducted by a woman officer... and successive statements of the victim girl had been recorded by calling her at the CBI office without bothering for the kind of harassment, anguish and re-victimisation that occurs to a victim of sexual assault in such case,” the judge said. The judge also questioned CBI over the delay in the filing of a charge sheet in a related case. “The CBI has not explained the fact that when the investigation in the alleged kidnapping, illegal confinement and gang rape of the victim in another FIR had been taken over by them on April 13, 2018…..what prevented the CBI from not filing the charge sheet/final report without any further delay and it was filed belatedly October 3, 2019 after almost a year…” Judge Sharma acquitted co-accused Shashi Singh, who allegedly took the survivor to Sengar on the pretext of helping her get a job. Moments before that, Singh fainted in the court as the judge started pronouncing the order. “Her health is improving gradually. She is desperately waiting him to be punished,” the survivor’s sister said. “We lost our father and aunts during the battle for justice. This man should not be allowed to roam free...” According to the family, Sengar raped the survivor in Uttar Pradesh’s Unnao on June 4, 2017. In April 2018, her father was beaten up by some people, and allegedly framed and arrested in an arms case. On April 8 that year, the survivor attempted self-immolation outside chief minister Yogi Adityanath’s residence, alleging police inaction in the rape case and demanding a first information report (FIR) against Sengar. The next day, her father died in custody , allegedly due to his injuries. In the wake of widespread outrage, the Allahabad high court transferred the rape case to CBI, which arrested Sengar on April 10. In July, the agency filed a charge sheet in the rape case. Her family wrote to the then Chief Justice of India Ranjan Gogoi in mid-July, saying they were under threat from Sengar and his accomplices. On July 28, a truck rammed a car in which the survivor, her family, and their lawyer were travelling on July 28. Two of the survivor’s aunts were killed in the incident in Rae Bareli, while she and her advocate sustained serious injuries. An FIR was filed the next day, and it booked Sengar and over a dozen others for murder and attempt to murder. Sengar was expelled from the BJP in August. The Supreme Court took cognisance of the victim’s letter, transferred the matter to Delhi, and directed the court to complete trial in 45 days. The day-to-day trial began at Tis Hazari court on August 5. After undergoing treatment at Delhi’s All India Institute of Medical Sciences (AIIMS), the survivor was shifted to a rented accommodation in the Capital with help from the Delhi Commission for Women. The trial was held in-camera, and a special court was held at AIIMS on September 11, 12 and 13 to record the statement of the survivor, who was admitted there. Sengar’s lawyer, advocate Tanveer Ahmed Mir, said he would appeal against the judgment in a high court. Advocate Dharmendra Kumar Mishra, counsel for the survivor, said it was “indeed the victory of justice”. On August 9, the court framed charges against Sengar and Singh for criminal conspiracy, abduction, rape under the Indian Penal Code, and other relevant sections of the Pocso Act. The trial in the other four cases — framing of the rape survivor’s father in an illegal firearms case, his death in judicial custody, conspiracy by Sengar and others in the accident case, and gang rape by three other men — are going on in the same trialcourt in Delhi. Welcoming the judgment, Sunil Singh ‘Saajan’, a Samajwadi Party leader, said, “We had no faith in the BJP and its government, and had full faith in the judiciary.” The BJP too welcomed Sengar’s conviction.“Sengar’s conviction is a triumph of justice, but it also underscores CM Yogi Adityanath’s zero tolerance on crime and matters as sensitive as these,” said Uttar Pradesh BJP spokesperson Navin Srivastava said. This is What Swara Bhasker Has to Say on Women’s Safety in India
Tumblr media
This is What Swara Bhasker Has to Say on Women’s Safety in India - Swara says, "This is an alarm for our entire society. We need our lawmakers to walk the talk with regards to women's safety," Bollywood actor Swara Bhasker has opened up on the consequences faced by victims in the Unnao and Chinmayanand cases and raised a serious question on women’s safety. “Women’s safety has become a crisis in India. We have a situation where at least three high profile members, who hold elected office are accused of rape. In the case of Unnao and Chinmayanand, the victims have had to face serious personal consequences for reporting rape. This is an alarm for our entire society. We need our lawmakers to walk the talk with regards to women’s safety,” Swara shared with IANS. The victim in the Unnao case, who was allegedly kidnapped and raped by expelled Bharatiya Janata Party MLA Kuldeep Singh Sengar in Uttar Pradesh’s Unnao in 2017, had an accident in July this year. She was admitted to Delhi’s All India Institute of Medical Sciences (AIIMS) for two months and discharged yesterday. Now her family fears going back to their hometown because they are apprehensive about their safety. The law student who has accused BJP leader Chinmayanand of rape, has been arrested by Uttar Pradesh Police on charges of extortion and blackmailing. The Shahjahanpur student has alleged that she was raped by Chinmayanand for over a year. Swara has raised her voice regarding the consequences faced by these rape victims. Yesterday, she tweeted reacting to the news of the Chinmayanand victim’s arrest shared by a journalist. “Beti inhi se bachao!! (save your daughter from such people) Shame!!” she wrote. The actress also shared how she was trolled after tweeting her opinion. “I tweeted regarding the same and one user/ troll made fun of the victim’s ordeal by asking if I was raped as well, with a smile at the end of the sentence. I reacted by using an expletive because I feel that sometimes people who use abusive language or try to slut shame women by cracking rape jokes need to be reminded that women can swear as well,” she said. Taking a dig at misogynists, the actress added: “I don’t think it’s fair to expect women to brave the risk of being raped, the threat of arrest if it’s reported and also bear the burden of being dignified in the face of abuse. Sometimes misogynists have to hear it like it is.” On the work front, Swara will next be seen in a web series titled “Rasbhari”. She has also started working on her own production, a movie based on the life of a con artist. This is What Swara Bhasker Has to Say on Women’s Safety in India Read the full article
