I’m glad I‘ve read this post from 5280.com about the places to see in Denver for the best home light shows. Every winter, few residents of Colorado transform their homes into a top holiday display. Steve Bannon Is Charged With Fraud in We Build the Wall Campaign
What would advise to Brian Kolfage, who lost both his legs and one of his arms during his service in Iraq, and created We Build the Wall as a GoFundMe page in December 2018, which was an immediate success, raising nearly $17 million in its first week online, but wanted to raise much more from donors: (1) Promise potential donors that he would not take a penny in salary or compensation and that all of the money he raised would be used “in the execution of our mission and purpose,” and then pay Kolfage $350,000 secretly from the donations for his personal expenses (and keep about $1 million for yourself too), or (2) find some other way to pay him? Why? What are the ethics underlying your decision?
Stephen K. Bannon, President Trump’s former adviser and an architect of his 2016 general election campaign, was charged on Thursday with defrauding donors to a private fund-raising effort called We Build the Wall, which was intended to bolster the president’s signature initiative along the Mexican border.
Mr. Bannon, working with a wounded Air Force veteran and a Florida venture capitalist, conspired to cheat hundreds of thousands of donors by falsely promising that their money had been set aside for new sections of wall, according to a federal indictment unsealed in Manhattan.
The fund-raising effort collected more than $25 million, and prosecutors said Mr. Bannon used nearly $1 million of it for personal expenses.
Despite the populist aura he tries to project, Mr. Bannon is known to enjoy the high life, and he was arrested at 7:15 a.m. on a $35 million, 150-foot yacht belonging to one of his business associates, the fugitive Chinese billionaire Guo Wengui, law enforcement officials said.
Working with the Coast Guard, special agents from the United States attorney’s office in Manhattan and federal postal inspectors boarded the yacht off Westbrook, Conn., the officials said. Mr. Bannon, 66, was on deck, drinking coffee and reading a book, when the raid occurred.
The criminal charges, filed a week before Mr. Trump was to accept the Republican nomination for a second term, marked a stark turn of fortune for the flamboyant political strategist. Mr. Bannon first came to prominence when he was in charge of the right-wing media outlet Breitbart, where he had aligned himself with the alt-right, a loose network of groups and people who promote white identity.
As chief strategist, Mr. Bannon was one of the most powerful figures in the White House early in the Trump administration, but he stepped down in August 2017 after frequently clashing with other aides.
With the indictment, Mr. Bannon became the seventh Trump associate to have been charged with federal crimes, a list that includes Paul Manafort, Mr. Trump’s former campaign manager; Michael T. Flynn, the former national security adviser; and Michael D. Cohen, Mr. Trump’s onetime lawyer and fixer.
The 24-page indictment, unsealed in Federal District Court in Manhattan, is by far the most politically sensitive case that Audrey Strauss, the acting United States attorney in Manhattan, has handled since she assumed her job after her predecessor, Geoffrey S. Berman, was fired in June by Mr. Trump.
At a brief arraignment on Thursday, Mr. Bannon, sunburned and his hair unbrushed, pleaded not guilty to charges of wire fraud conspiracy and money laundering conspiracy, each of which carries a maximum penalty of 20 years in prison. The government agreed to release him from custody on a $5 million bond.
Walking to his car after being freed, Mr. Bannon said, “This entire fiasco is to stop people who want to build the wall.”
Shortly after the charges were announced, Mr. Trump had sought to distance himself from Mr. Bannon and the fund-raising initiative, though the president also expressed sympathy for his former adviser.
“I feel very badly,” Mr. Trump told reporters in the Oval Office. “I haven’t been dealing with him for a very long period of time.”
The president said he knew nothing about the multimillion-dollar We Build the Wall campaign but quickly contradicted himself.
“I don’t like that project,” Mr. Trump said. “I thought it was being done for showboating reasons.” He called paying for the border wall privately “inappropriate.”
One of Mr. Trump’s sons, Donald Jr., publicly promoted the We Build the Wall effort at an event in 2019, calling it “private enterprise at its finest.”
Donald Trump Jr. said in a statement on Thursday that he had no involvement with the effort beyond praising it at that one event.
A White House official said that President Trump did not know Mr. Bannon would be arrested, and that he was told by aides after it happened.
Attorney General William P. Barr was briefed on the investigation several months ago, according to a Justice Department official, and the federal prosecutor’s office in Manhattan gave him notice that the indictment would be unsealed on Thursday.
According to the authorities, Mr. Bannon hatched the plot to defraud the donors with three other men: Brian Kolfage, a 38-year-old Air Force veteran and triple amputee from Miramar Beach, Fla.; Andrew Badolato, 56, a venture capitalist from Sarasota, Fla.; and Timothy Shea, 49, of Castle Rock, Colo.
Mr. Kolfage and Mr. Badolato were arrested in Florida on Thursday, and Mr. Shea, who prosecutors said funneled money for the group through a shell company he owned, was arrested in Denver.

To persuade potential donors to contribute to the effort, prosecutors said, Mr. Kolfage promised them that he would “not take a penny in salary or compensation” and that all of the money he raised would be used “in the execution of our mission and purpose.” According to the indictment, Mr. Bannon described We Build the Wall as a “volunteer organization.”
But all of that was false, prosecutors said. Instead, they claimed, Mr. Kolfage secretly took more than $350,000 in donations and spent it on home renovations, boat payments, a luxury S.U.V., a golf cart, jewelry and cosmetic surgery.
Mr. Bannon, working through an unnamed nonprofit organization, received more than $1 million from We Build the Wall, prosecutors said, some of which he used to pay off hundreds of thousands of dollars in personal expenses.
Mr. Bannon and three others are accused in a scheme to use funds raised for construction to pay for personal expenses.
Court papers suggested that prosecutors were in possession of several text messages between the men, including one in which Mr. Kolfage told Mr. Badolato that the payment scheme was “confidential” and should be kept on a “need to know” basis.
Mr. Kolfage initially pitched We Build the Wall as a way to sidestep the considerable legal and political obstacles to erecting Mr. Trump’s long-sought barrier. While the group has drawn approval from some top Homeland Security and Border Patrol officials, it has also prompted a backlash over its connections to Mr. Trump’s associates and its construction methods.
The federal government has built parts of the wall well within the American side of the border on federally owned land. But the sections built with private funds — slightly less than five miles in all, according to We Build the Wall’s website — have been erected along the riverbank of the Rio Grande in New Mexico and Texas.
Environmental groups have challenged those portions, citing potential harm. When experts recently said that sections along the river could fall into the river, even Mr. Trump criticized the project.
It remained unclear precisely when the yearlong investigation into the alleged scheme began. But last year, a bank informed Mr. Bannon that federal prosecutors had subpoenaed records related to We Build the Wall, according to a person briefed on the matter.
Prosecutors said that despite the effort’s early success, there were questions almost instantly “about Mr. Kolfage’s background” and the viability of his promises to use the money he had raised to actually build Mr. Trump’s wall.
Because of these concerns, prosecutors said, GoFundMe warned Mr. Kolfage that if he did not find a “legitimate nonprofit organization” to handle the money, it would return it to the donors. Mr. Kolfage claimed that the group had determined that only $800,000 of the funds needed to be given back.
“No rules were broken,” he said in an interview last year.
As the problems with donors mounted, Mr. Kolfage said he would establish a board of advisers and incorporate the group as We Build the Wall Inc.
Mr. Kolfage enlisted Kris Kobach, the former Kansas secretary of state, to serve on the board. Mr. Kobach, a longtime Trump supporter and a prominent immigration hard-liner, was not named in the indictment.
Mr. Kolfage also brought in Mr. Bannon, who had joined Mr. Trump’s campaign as chief executive in August 2016 and later became the White House’s chief strategist.
Several times, prosecutors said, Mr. Kolfage falsely assured his donors that every dime they gave him would go to the wall.
“It’s not possible to steal the money,” he said at one point, according to the indictment. “We have an advisory committee.”
When special agents from the Manhattan federal prosecutor’s office and postal inspectors boarded Mr. Guo’s yacht, the Lady May, in Long Island Sound, they searched the vessel and seized Mr. Bannon’s cellphone, officials said.
The investigators also conducted other searches in Florida, Colorado, Nevada, Missouri and Virginia, including at the homes of all of the defendants, the officials said.
Mr. Guo, a real-estate magnate, has been in exile since 2014 after fleeing China in anticipation of corruption and rape allegations by its government.
While living abroad — sometimes at a palatial apartment overlooking Central Park in Manhattan — he forged relationships with China hard-liners like Mr. Bannon and bought a membership to Mr. Trump’s Mar-a-Lago club in Palm Beach, Fla.
Almost immediately after leaving the White House, Mr. Bannon struck up lucrative financial ties to Mr. Guo that began with a $150,000 loan, according to a memo written in May 2019 and obtained by The New York Times.
The GoFundMe page through which Mr. Bannon and his co-defendants raised money is now inactive. On Wednesday, less than 24 hours before their arrests, Mr. Kolfage made an appearance on Mr. Bannon’s podcast and explained the deactivation as an example of how tech companies censor conservative speech online.
When Mr. Bannon asked how people could continue giving money to the wall campaign, Mr. Kolfage responded by directing potential donors to his personal website, as well as another specifically for wall funding.
“How do people get access to We Build the Wall?” Mr. Bannon said.
“Don’t go to GoFundMe anymore,” Mr. Kolfage replied. “Screw them. Go straight to our website.”

After the game Sutton praised Lock for changing a play call from the sidelines that led to a Bronco touchdown. This is the kind of story I want to hear about the new quarterback. Joe Flacco was the first quarterback of the season and he just took his marching orders without question, until he was relieved of his duties. Perhaps Lock heard Flacco’s message about bad play calling costing the team victories and took a mental note. Brandon Allen was the next quarterback to play for the team and he was able to scramble. Hopefully Lock noticed Allen took fewer hits and opened up the offense by moving outside the pocket.
The problem though and this has happened in almost every Bronco game this season is the hard headed, defensive, controlling, conservative play calling coming from the sidelines. In the first quarter, Lock was making plays and the team looked great. In the second quarter, the staff started to exercise control and the play calling became extremely conservative and the Broncos play went downhill. This lasted till the end of the game.
Members of the media jumped all over the attendance numbers. There were 19,000 no shows. These are people that paid for their tickets but didn’t go to the game. It was noticeable on the TV. Personally, I don’t really enjoy going to the stadium. Everything you buy is a complete rip off. Security is annoying. The Broncos prefer you use e-tickets which means bringing a ‘smart’ phone to the game. I didn’t even bring up the fact that concession stands in the Denver area have terrible rankings, which I pointed out in one of my posts last season maybe. Basically health inspectors found rats in food storage areas. For those reasons and many more, football is best enjoyed at home on your couch.
Von Miller was back in the news. He didn’t play on Sunday and sports talk speculated on his value to the team. The point being made was that you can have a losing season with or without him. People were questioning the value of spending a lot of money on a pass rush when you haven’t even found your franchise quarterback. Von Miller’s mom even gave Elway flack about that during the Vance Joseph era. Von’s Halloween party of 2018 reentered the news because Von’s personal photographer has decided to sue x-Bronco quarterback Chad Kelly over injuries suffered during a fight at the party.
During the game, there was an ad by the Broncos showcasing the Broncos offensive line serving food to the homeless. A pretty standard pr move by the NFL during the holidays. I’m mentioning it because it was of the Broncos offensive line. Garret Bolles was not in the ad.
Last week I forgot to mention that the next generation of the Bowlen family, Britney, was given a new title/position with the Broncos. I didn’t mention it because the title sounded like corporate gamesmanship to me. The title was fancy, but to me, it sounded like she would be in charge of parking outside the stadium. I’m bringing this up because there was some talk about the contracts of Elway and Ellis coming up in two years and some think Brittany was put on the “fast track” to take over the team. The big assumption is that the contracts of Elway and Ellis will not be renewed. Who will replace them? Nobody knows.

When noncompliance is identified, the facility is served a citation that indicates which regulation that was identified, along with the severity of the incident. hospice facilities are subsequently required to execute a program of resolution in order to meet compliance. Some scenarios require enforcement actions to be applied, such as a civil monetary penalty or withholding of payment(s), to incentivize resolution in a timely manner.Penalties Facilities are applied 2 types of penalties due to non-compliance / accumulation of incidents. Civil penalties are monetary fines that may be applied to a facility based on citations / infractions identified during a review. The severity of a penalty is defined primarily by the size and frequency of the infraction.Quality of Residence Care There are 3 types of resident care ratings, but for this exercise, we primarily focused on the overall quality measure rating. The quality measures (QMs) include 17 data points that are derived from clinical information reported by the respective hospice facilities and also from Medicare claims data submitted for payment. For each of registered nurse staff and total staffing, a 1 - 5 rating is applied according to definitions established for each category. These ratings are subsequently combined to assign an overall staffing rating. As an example, to get an overall staffing rating of 5 stars, nursing homes must earn a rating of 5 stars for both registered nurses and total staffing. hospice facilities could also be assigned a 1 star rating should they not have a registered nurse on-site daily, and do not submit staffing data, or which the data cannot be verified.

Inspection Concerns for Crawl Spaces & Attics in Condos & Townhomes

I would like to begin with that I am a father of 3 daughters, and when I am inspecting any residential property, I am thinking of them.  I especially think of them when I am inspecting a home for a single woman or single parent mom moving into a new condo or townhome.  I think about my client’s safety as I superimpose my own daughters onto the inspection.  Sounds weird, I know, but there it is.
Concern for safety is what has led us to this subject, “Inspection Concerns for Crawl Spaces & Attics in Condos & Townhomes”
In general, attics and crawlspaces are excluded in condo and townhome inspections for a real estate purchase.  This is due to the fact that they are covered or maintained by the condo association or HOA. But they should be at least viewed from the hatch (in the case of the attic) and partially traversed (in the case of a crawl space) in order to see if there is any access from other units and/or if there is a compliant fire partition.  The applicable building code for fire partitions can be found in Section 708 Fire Partitions.
Fire code today for multiple unit buildings, such as condos and townhomes require that a fire “partition” be built all the way to the roof line.  The “partition” should have a 1-hour fire rating, or a ½-hour fire rating for buildings that are sprinkled.  And for buildings built after the 1960’s you generally do find that to be the case, but, of course, not always.  There are concerns other than fire blocks that an inspector should be looking for in these areas.  As that father of 3 daughters, I am always thinking about their safety, and as an inspector safety is why we’re looking in attics and crawl spaces in condos and townhomes – because the client’s safety could be compromised.
What safety concerns should be considered in attics and crawl spaces for condos and townhomes?
The main safety concern is open access between units.  Below are articles that highlight the importance of securing the access points in attics and crawl spaces in these types of complexes.

Attic Access Concerns
A compromised access can be found in a number of surprising ways.  Let’s examine attics first.
Attics can have an open configuration that allows individuals from one unit to gain access to another unit.  Many times, there is only a drywall cut-out that is set into the ceiling with no locking system to keep unwanted (they’re all unwanted) intruders out.  Even when there is a fire partition, sometimes workers cut access panels into them (against fire code) to make it easier for them to perform work that needs to be completed.  Below is a picture of a real inspection completed in the Denver area of condo / townhome attic that had an open configuration.

The area to the left is actually over the adjacent unit.  There is complete access over all the units and each unit has its own access to the attic area.
So how do you fix this kind of issue?  There are three courses of action to pursue.  First is to identify it as a safety concern in the inspection report and use it in your negotiations with the seller.  As a safety concern, the seller may agree to remedy the inspection report item to your satisfaction.  If that does not work out, approach the condo association or HOA.  Ideally, it would be best for the condo association or HOA to build fire partitions between all units, which is unlikely to happen.  Finally, if that fails, address it yourself.  
Looking at the three options, the first 2 are the least expensive approach.  The last option does require more funds on the part of the purchaser, but it also affords more control and peace of mind.  The last one let’s you make the decision on how and what the configured solution will look like.
Securing the Attic Opening
No matter who addresses the safety concern, there are a few items to keep in mind when securing the opening.  The goal is to make it almost impossible to use the access to gain entry to your home.  To do so, there is a 2-part approach that you may want to use.  Let’s address the attic side of the access first.
The access needs to framed and brackets used to secure the framing.  The brackets should be secured from the inside of the frame.  No hardware should be accessible from the outside of the secured access point.  A ��” piece of plywood or a 3/8” metal plate could then be secured to the framing from the inside, again, having no hardware accessible from the attic area.  The door would extend to the outer edges of the framing. Hinges and locks would be affixed on the inside of the frame and access panel.

Part-2 would then to frame the ceiling side of the access and add an additional door and lock with no hardware access from the attic.
Crawl Space Access Concerns
Concerns for the crawl space under all the units is the same as the attic when there is an access point in each living space.  Below is a picture of a condo building with a crawl space and the access to the next unit. It would not take a small person to make it through that opening.

This is how (picture on top) the building was designed, but access between units should not be a part of the architecture.  You can clearly see (picture on the bottom) through the opening to the joists of the adjacent unit.
In this case, a bolted piece of 3/8” metal or concrete fill would be appropriate.  If you were to use metal, ideally, it would be 2 pieces of metal, each bolted from their own side.  In this way, the one with the bolts could not unscrew them and gain access to the other side. Some may use fencing that is bolted to the concrete as well.
Why would we not use ¾” plywood and bolt that to the concrete in the crawl space?  One aspect of a crawl space that needs to monitored and controlled is moisture.  Fibrous material such as wood can deteriorate and break down over time.  It can also be subject to mold and wood destroying organisms like termites.  Although a metal plate can rust, it would take a really long time to do so to the point that it would compromise the security of the unit.
An inspector has a lot on his mind and on his check list while they are inspecting your new home.  In fact, it can be upwards of 1200 points of concern.  They are looking for defects, major and minor, they are looking for safety items as well. Some of those are not on any inspection test or discussed in any inspection class, they are from good experience in doing 100’s of inspections.  Just because common areas, such as the exterior, attics, and crawl spaces in condo and townhome complexes are on the list of items the HOA may be responsible for, does not mean the inspector should ignore them.  In fact, as you can see, it may be one of the scariest safety exposures that the inspector can find.

Anti-Trump Secret Service Agent Escapes Punishment
After a series of anti-Trump social media posts, Secret Service agent Kerry O’Grady was removed from her position as head of the Secret Service’s Denver district in March but remains on the payroll and with her extremely valuable

O’Grady wrote on her personal Facebook site in October that she would rather face “jail time” than take “a bullet” for Trump because she considered him a “disaster” for the country, especially as it relates to women and children.
Additionally, she updated her profile picture on Inauguration Day to an artist’s rendering of Princess Leia with the words, “A woman’s place is in the resistance.”
Secret Service officials usually take a hard line when it comes to investigations of personal misconduct that include non-paid leave and revocation of valuable security clearances.
Sean Bigley, a partner at Bigley Ranish, a firm specializing in security-clearance denials, said the Secret Service regularly places employees accused of wrongdoing on unpaid leave while they investigate the allegations.
“All the clients I have are on unpaid administrative leave,” he said. “Then they have to sit around for a year cooling their heels before anything is proven. It’s very punitive.”
One of his current clients has been on unpaid leave for three years while the Secret Service and the Department of Homeland Security Inspector General have investigated the charges and counter-charges in the case, he said.
“His life has completely imploded,” Bigley said of the client, who has lost his home and depleted his life savings as he waits for some type of resolution.
Clearly, the Secret Service is choosing to handle the O’Grady investigation is far different manner because they are afraid of stirring up the so-called #resistance.
O’Grady continues to get paid and retains security clearance while these tools are usually used ruthlessly by managers to discipline wrongdoers.
Cheri Cannon, a partner at the law firm Tully Rinckey, said Secret Service managers often impose unpaid leave and revoke a security clearance at the same time to force a person to quit rather than go through the lengthy appeals process to try to get their security clearance reinstated.
“If somebody wants to mess with your clearance, you are going to have to fight them for two years without pay,” she said, noting that there is no way for reinstated officers to get back pay.
The capricious nature of the Secret service’s disciplinary procedures is highlighted by previous incidents.
“It’s always amazing to me how some [disciplinary] issues are considered security-related and some aren’t. The only difference seems to be the person involved” and how well-connected they are to top agency officials, he said. “It doesn’t seem like there is any continuity.”
For instance, he cited a case involving two senior agents who drove into an active suspected bomb investigation on the White House grounds in early March of 2015 after a night of drinking. He said he believes the pair never had their security clearances revoked, even temporarily.
Apparently. O’Grady has an in with the honchos at the Secret Service. They can make things easy for her.
Retiring with a security clearance intact or after having it revoked can make or break future career prospects in a security-related field.
Several sources within the Secret Service community worry that O’Grady will retain her employment and simply be transferred another division of the Department of Homeland Security. Such a move would allow her to serve out her time until she can retire with a pension, a move the agency has used with at least one other official in the public crosshairs.
