So, it’s been a year from today since I started Tumblr. So I thought that I should share a short bio about me. And FYI the dog in the photo does belong to me, her name is Sparky. Onto the bio:

Favorite Fruit: Banana and strawberry

Favourite book: Comet in Moominland, Moominvalley in November, The Exploits of Moominpapa (all three by Tove Jansson), All Sorts of Possible, The Dark Inside (both by Rupurt Wallis), Frozen in Time, the Shapeshifter series (both by Ali Sparkes), the Time Rider series (Alex Scarrow) and a whole lot more books (yeah, I'm a bookworm, DEAL WITH IT!).

Favourite movie: any Disney film, How to Train Your Dragon series (I haven’t seen the 3rd movie, so please don’t ask me about it), Coraline, The Nightmare Before Christmas and Bumblebee (the new Transformers movie). I also like the Marvel Cinematic Universe, the Harry Potter series and Wonder Woman.

Least favourite movie: Transformers Age of Extinction and Transformers The Last Knight. Don’t get me wrong, I love Transformers, but I HATE those two movies. Too many plot holes and the stories are all over the place. One second I’m thinking this is what the story is and then the next the movies literally make no sense. Not enough storyline because every five minutes there are nothing but battles and too many explosions. Not to mention, there is TOO👏MUCH👏FOCUS👏ON👏THE👏HUMANS! The film title says TRANSFORMERS!!!! If you’re going to make a movie around the franchise, make it so there is more focus about the cool transforming robots from another planet, rather then the humans. Sorry, I’m ranting when I shouldn’t be.

Favourite tv show: the Moomins (obviously), Stranger Things, Pokemon (or does that last one count as anime, I can't tell sometimes), Murdoch Mysteries (crime drama), Doctor Who, most of the Transformers series (so far Transformers Prime is my favourite). And I started watching Moominvalley and I love it 🥰

Least favourite tv show: Eastenders (too much shouting and arguing in my book), The Jeremy Kyle Show (again, too much shouting and half the time the problems seem to get worse rather then being solved) and X Factor (I honestly find it boring, sorry but all it is, is singing, that’s it, which is why I prefer Britain’s Got Talent because there’s more variety).

Favourite game: Skylanders (up until Trap Team because I don’t have the up to date games consoles for the rest of the games), the "Mario and Sonic at the Olympic Games" games, including the Winter games (up until 2012 because I don’t have the up to date games consoles for the rest of the games). I have recently just got into "Layton's Mystery Journey" and I love it.

Least favourite game: Sonic Boom Shattered Crystal, played one level and that is it because I found it too long and boring and I was very disappointed in it. Sorry to those that like the game, but it’s not my favourite.

Favourite flowers: Roses

Favourite animal: all except snakes and spiders.

Favourite beverage: don't drink alcohol, but I do love a good cup of tea and an excellent hot chocolate with whipped cream and marshmallows.

Favourite fictional character: Snufkin 😆. And Joxter (Snufkin's father in case you didn't know). I also have a soft spot for Ninny (the Invisible Child).

Number of blankets you sleep with: Normally 1 but it depends how cold it is.

Dream trip: Canada (technically it doesn’t count because I am going there this year, but whatever), Disney World in Florida, and Japan. I would also like to go to Finland because last time I was there was when I was 8 or 9. Not to mention, that is where Moominworld is.

Funfact: I usualy go by another username online, rather than my url here, and i just had the urge to google it.

What comes up is 2 of my wattpad fics, my wattpad reading list, a twitter thats last post is from 2012 that is not mine and is infact all writen in Japanese, and my ao3 account. So im kinda thinking if anyone ever googles it, they will think it belongs to either the Japanese person or not me since theres at least one other person with that username.

And everything on google images is either cross stitch from reddit, or cover art from wattpad. But heres the thing. One of my fics, from 2014, has a very reasent image, like from last year, on google images apparently?? And idk why??

WHEN YOU GO ON THE BOOKS SEARCH, yknow how it goes like search, images, video, news, it can go to books too, IT COMES UP WITH A LINK TO MY LAST UPLOADED FIC ON WATTPAD?!?! WHY?!?!? like if your gonna do that at least do ao3?!

And yet all i get when i google my url here is people misspelling fucking polka dot!

The Law Of Writing Fanfiction

Fanfiction, or the practice defined from Webster as “stories involving popular fictional characters that are written by fans and often posted on the Internet.”[1] has exploded in recent years, especially during the coronavirus pandemic. In fact, with slowed book production, many hungry readers flocked to sites like Wattpad, fanfiction.net, and Archive of Our Own to get their fix for new stories involving their favorite characters.[2] However, this practice of writing new works inspired by already existing media can be a controversial one. If an online author is simply using an already existing plot, characters and a few other details, yet creates an entirely original story, who does it belong to? Is it legal? Let’s dive into the fascinating legal world of fanfiction.

The first fanfiction was surprisingly not written on the internet. Interestingly, the first fanfiction was written in 1952. It was called “The Enchanted Duplicator” and it was written by Walt Willis and Bob Shaw. It was considered a “metafiction” but based on a different story known as “The Pilgrim’s Promise.” The story itself was published in a sci-fi magazine, and was arguable on the first fanfictions ever created.[3]

One thing that has to be made clear is that fanfiction is no small subculture. It is a massive part of the Internet. Over 60 billion words of fan fiction have been written and posted on Fanfiction.net, and the website boasts around 10 million members. Interestingly enough, the average age of these writers is around 15 ½, making it a community filled with young people.[4]

Today, most if not all fanfiction is read online. But what does this say about legality? For the most part, most of fanfiction falls under the category of “fair use.” But what is fair use? Fair use is defined as “ is a legal doctrine that promotes freedom of expression by permitting the unlicensed use of copyright-protected works in certain circumstances.”[5] According to Betsy Rosenblatt, a professor at U.C. Davis School of Law, most fanfiction is perfectly legal. “As a matter of copyright and trademark law, the sort of noncommercial, transformative works that fans make tend to fit quite well into the definitions of non-infringing fair use.”[6]

The opinions about fanfiction as a whole shift depending on who you are speaking to at any given moment. Some works of media encourage and love fanfiction, even setting forth guidelines for writers on how they can write while avoiding any legal troubles. Hasbro and Star Trek both have public guidelines on the Internet to help writers with their work, and making sure it stays in the legal green light.

However, not all authors are as glowed and chummed by these budding amateous on the interwebs. Famed vampire queen Anne Rice is famously against fanfiction, even going as far to completely discourage any and all fanfiction about her work. According to her official website, Rice states, “I do not allow fanfiction. The characters are copyrighted. It upsets me terribly to even think about fan fiction with my characters. I advise my readers to write your own original stories with your own characters. It is absolutely essential that you respect my wishes."[7]

So, from naysayers like Anne Rice to many tiny websites worldwide, it’s clear that the practice of fanfiction isn’t going anywhere. It is absolutely essential to be careful who and what you write about, and to review the material to be sure that your use falls under what is deemed “fair use.”
