I'm a teacher in Texas (a state with laws that are pretty hostile towards unions) and it might surprise folks to know that one of our required standards for high school US History (that is it must be taught and will be on the standardized test according to state law is (3B,C): Analyze economic issues such as industrialization, the growth of railroads, the growth of labor unions, farm issues, the cattle industry boom, the growth of entrepreneurship, and the pros and cons of big business; and analyze social issues affecting women, minorities, children, immigrants, and urbanization. (this is referring to 19th century labor movements, there is a separate standard for 20th century labor). America's anti-union slant is relatively recent, and in the industrial cities of the northeast and midwest, there is still a strong support for unions. Pride in one's union has always been a big thing among the working class in certain regions such as the upper midwest. The teamsters union (truckers) is one of the strongest in the country. The education we receive about unions is not super extensive, but it is there. The above standards include things like collective bargaining, striking, closed shop vs. open shop, and famous events in labor history like the Pullman strike, the formation of the AFL-CIO and the Knights of Labor, the Triangle Shirtwaist Fire, and Haymarket Square. Additionally kids study the New Deal, the Wagner Act, and later anti-labor actions such as the Taft-Hartley Act.
I would not say that our educational system suppresses the teaching of labor, it's more that labor and labor history is taught as history, and students disconnect it from their own experiences. Many do not understand that they can participate in unionization. Of course it's also very regional because many states, such as Texas, are at-will employment states (with so-called "right to work" laws which effectively prohibit closed shop), so sometimes even though they may know about unions they literally cannot participate. As a teacher, I often see other teachers in online discussions giving the advise "contact your union," but Texas does not have an actual teacher's union, it has a toothless organization that can help with mediation between employer and teacher, but that's about it. I would love to join a union but I can't, and if I tried to form a useful one, I would get fired.
So it is not necessarily a lack of education about labor history that is the issue. Paradoxically, many Americans are quite proud of our union history and unionization has an overall positive connotation among most middle and lower middle class Americans, yet often those same people vote for candidates who are opposed to unions. Of course, those candidates will never say they're expressly anti-union when campaigning in Pennsylvania or Ohio, and if they express anti-union sentiments it will be to pit industrial blue collar workers against say, Starbucks workers, portraying the latter as whiny 20-somethings or painting WGA strikers as spoiled rich people, in order to break solidarity. American labor (and all labor!) is very strong when united, which is why politicians have worked very hard to suppress it. But as with many issues, actual American attitudes about labor and unionization can contradict hard with our voting action, which is of course extremely frustrating!

ETA BECAUSE PEOPLE ARE GETTING SNARKY: i am asking it this specific way with these specific poll options (american vs non-american) because it's my understanding and experience that most US state public schools actively suppress any teaching of labor history in any concrete way to the point of editing textbooks. i'm not trying to be an american exclusionist here or say that there weren't non-american labor movements. i'm saying that as a historian with degrees i have noticed that there is a very different attitude towards teaching labor history in the united states than there is in other countries. for fuck's sake.

Fresh Pressed: Snow Strippers' Warehouse Rave This is Fresh Pressed, in which photographer Matt Weinberger takes us inside some of the rawest moments happening in NYC and beyond. Fresh Pressed is all about encountering the juicy ideas, aesthetics and people shaping culture through the lens of the city's many creative scenes.SXSW NYC Beat (3/18)The NYC (and LA) music scene took over this little corner of Austin at the SXSW NYC Beat concert at popular downtown venue "The Cave and The Creek." The showcase featured two stages, both sporting incredible lineups of musicians. The indoor stage was curated by Sunflower Bean and featured sets by The Life, Strange Ranger, Thus Love, Malice K, Hello Mary, Model/Actriz and Sunflower Bean themselves. The energy inside was booming, with a mix of music industry professionals and seasoned concertgoers vibing out.Things got pretty wild in the later sets, and, by the end of the night, as Sunflower Bean took the stage, the crowd was stirring up into a bountiful mosh pit of bodies smashing into one another. The outdoor stage featured sets by Eera, Mgna Crrrta, Club Eat, Damon Rush, Blaketheman1000, Snow Strippers, The Helpp and Isabella Lovestory. This side of the venue was more electronic-heavy and brought out a younger demographic of fans than those inside, with bubbly fans ripping cigarettes and jumping up and down as they popped to their favorite bops. Isabella Lovestory gave a particularly compelling performance to end the night, wrapping things up with a cherry bomb bang. The Helpp is no easy act to follow but Isabella managed to go beyond holding her own, delivering what felt like the perfect storybook ending to a night filled with great performers.Snow Strippers' Warehouse Rave (3/17)The Snow Strippers may be the next big thing. The band is a duo made up of members Tatiana Schwaninger and Graham Perez. They met in Florida back in 2018 and began making music together around the end of 2021. The duo produces an electronic, icy eargasm sound, making music that makes you want to dance. This is the kind of stuff that will make you bang your head with no shame as you ride a crowded L train to work. Graham had been producing music for a number of years, while Tati had no previous experience making music before they teamed up. Despite her lack of prior experience, she has the voice of a thousand snow angels. Their live set was a fun departure from the more refined sound you might hear when streaming their music online. In concert, Tati jumped around the stage, glitching into multiple dimensions of hype and glory, pulling the whole audience into dark recesses of happiness and fun. Alongside the Snow Strippers, Club Eat and Eera also took the stage and gave solid performances, providing the concertgoers with additional icy cold, refreshing beats to enjoy.You Missed It's Backyard Bash (3/17)The Kerwin Brothers have struck again, succeeding in throwing an absolutely epic party. With backyard tattoos, unlimited booze, oil wresting, free cigarettes, and a lineup that included High, The Dallas Cowboys, May Rio, Blaketheman1000, Nite Fire, Tagabow, Hotline TNT and The Frost Children, everything was in place for an incredible night to ensue. And ensue it did. Smashing beers and taking flash pics, the crowd of mostly local college students and NY/LA weekend visitors partied harder than a school of fish during summer vacation. In NYC, it's very rare to ever get to party in a backyard, so all of the NY locals had the time of their lives. Green grass turned to mud as the crowd jumped around to the electric sets by the many talented musical acts. The Dallas Cowboys stood out for their ability to get the crowd moving, and once the crowd was going, the energy didn’t stop for the rest of the night. They say everything is bigger in Texas and that rang true for the crowd's energy. Legendary nightlife photographer Mark Hunter, aka The Cobrasnake, claimed that it was potentially in the top 10 parties he had ever been to. Jack and Joe, you did it. Yeehaw and God bless Texas!Simone Films Oscars Watch Party @ Nine Orchard (3/12)Simone Films, founded by filmmakers Rebekah Sherman-Myntti and KJ Rothweiler, is a New York-based independent entertainment company doing things unlike any other production company in NYC right now. It's known within the downtown scene as a pillar in shaping a certain subset of the creative community. The company has achieved some degree of a cult following via its exciting events and through curating other scene-centered activities such as hosting a popular actors' studio for up-and-coming talent with teachers such as Michael Imperioli, Alex Ross Perry, Dolly Wells and Peter Vack. On this particular occasion, Simone Films threw a banger of a party, with drinks flowing, an abundance of popcorn and a bumping vinyl DJ set by Billy Jones, the owner of the popular music venue Baby’s All Right. The Oscars watch party was attended by actors, directors, musicians, podcasters, art shmos, indie sleaze queens, cinephiles and a slew of other creatures of the downtown scene. Some notable attendees included Bart Cortright, Makunda Angulo, Eugene Kotlyarenko, Lotfy Nathan and Marcelo Gaia. The owner of Nine Orchard, Andy Rifkin, also pulled up to the event. One thing is clear: Simone Films knows how to bring together a large group of exciting people. It wouldn’t be a surprise if a number of the attendees are at the Oscars in a few years, rather than watching it on TV.The Twink Next Door's Party Backstage @ Dallas BBQ (3/11)Texas-sized piña coladas, glitter and faux fur were all the rage behind the scenes at The Twink Next Door’s debut NYC runway show, unveiling his new collection as a tease of what’s to come as he plans on dropping his new clothing line, TWINK, this Friday. Inspired by icons like Julia Fox, Lady Gaga and Cruella DeVille, The Twink Next Door is bringing maximalist experimental fashion to the downtown NYC scene in stride. Throwing a fun, quirky, DIY aesthetic into the Wild West that is Dallas BBQ made for an undoubtedly memorable (albeit mildly chaotic), ultimately fabulous experience. The collection ate, and so did lots of the attendees. As far as I can tell, this BBQ stood for big, bold and queenly. Those fits were royally delicious. You Missed It Party @ Baby's All Right (3/4)Back in July of 2022, brothers Jack and Joe Kerwin started the popular newsletter "You Missed It" to create a digital scrapbook of the moment, capturing the exciting things happening in the broader emerging culturing landscape. Their first event was New Year's Eve at Baby's All Right where Big Klit played a show while nine months pregnant. At the second show, Ernest Rareberrg performed with a cast of 15 people. For their third and most recent event, the Taxidermists played an unreleased album followed up by popular musical acts Hello Mary and Momma. They also got Channel Beads, Harry Teardrop and Julia Cumming to DJ. Next week, You Missed It will be hosting a concert series in Austin, Texas at SXSW with two stages, one curated by Perfectly Imperfect and the other by Sunflower Bean. take my whole life, too buck x eddie, 1.4k, vermont verse for @extasiswings and @tylerhunklin because that cellist fic inspired me and chapel said !!!!!!!!!!! so here’s eddie learning to play the guitar because i only know how to play the ukulele and eddie would never choose that so close enough.
Eddie’s not sure why he does it.
Well, that’s not true—they’re in Bobby’s backyard on a warm July night, the kids running around with sparklers, popping little plastic champagne bottles full of confetti over people’s heads when they’re not looking. Eddie’s standing near the grill with Michael and Bobby (he may not be able to cook but he’s from Texas, okay, he knows how to barbecue), recounting some of his funnier stories about being in the military (he can joke about it now, doesn’t feel like choking whenever he mentions it) when Buck’s bright laughter draws his gaze.
“So he starts singing this song and I swear I was so close to losing it,” Maddie says, “I had to pretend to be sick so I could run to the bathroom and laugh.”
He’s not sure what they’re talking about, but they look happy, relaxed, and then Buck says—
“I always wished someone would serenade me.”
And somehow, Eddie’s at a music store the next day in Burlington, buying a guitar.

Eddie’s never liked being an amateur. It’s not that he dislikes learning, or thinks he should be great at everything right away, but he feels too deeply the judging looks that people will give (whether they’re in his imagination or not is another story), so his original plan had been: buy a guitar online, hide it, practice like crazy until he could get a simple song out, sing to Buck.
He falls into a Buck-esque research spiral after they leave Bobby’s house that night, googling guitars on his phone and watching “learn to play” youtube videos until 3am, when Buck rolls over in his sleep and slides his hands over Eddie’s stomach and down lower, until Eddie drops his phone on the floor accidentally and then somehow it’s 4am and Buck is breathing hard against him and they both need a shower.
Regardless, he’d learned a few things: don’t buy a guitar online, and it’s really easy to play C and F major.
It comes in handy at the store; luckily, he’s not the only one there so he waves off the bored-looking clerk and looks over the wall of guitars, drawn to the two-tone ones; he reads the signs and tries to look like he knows what he’s doing but in the end he picks up one that proclaims it has a Sitka spruce top and mahogany back, strums the two chords he’d learned from trying to memorize a chord chart in the middle of the night, and buys it without looking at the price tag.
… he probably should have looked at the price tag.

Given Eddie’s abundance of free time, it’s pretty easy to hide what he’s doing, which is good, because he is objectively terrible at playing the guitar. His fingers feel clumsy; he’d never played an instrument before, favored extra history classes in high school over band, and he had thought that the easy rhythm he can find while dancing would transfer over, but strum patterns and counts get tangled up somewhere between his brain and his fingers and he ends up off-beat and confused halfway through a song. He tries doing things properly, working through a beginner’s book he bought online and hides in the bottom drawer of his desk, but just picking simple melodies and occasional chords frustrates him and he ends up shoving the guitar in the attic for two weeks before he gives in and does what he’d wanted to do all along—follow along with YouTube videos.
He spends three days looking up songs that only use a few basic chords and finally settles on a simplified version of Can’t Help Falling in Love With You, because Buck loves sappy and Eddie loves Buck, and no one needs to know how when he sings it, he thinks about the first time he saw Buck standing on the porch, crouching down to talk to Christopher, bright smile and laugh lighting up Eddie’s life.
For a simple song it takes him a frustratingly long time to learn it, but finally, he’s ready for the last part of the plan: sing it to Buck.
Oh, shit.
He has to sing it.

In middle school, Eddie’s choir teacher called them over to the corner of the room one at a time and had them sing a few lines so she could determine their voice classifications. Her face had been neutral while listening to him, but a few weeks later while they were singing The Lion Sleeps Tonight, she’d pulled Eddie and Robbie Martin to the side and said, “you know boys, no one will notice if you just mouth the words.”
Eddie mouthed the words.

So, Eddie makes a new plan. He needed one anyway, because it’s not like he could just pull Buck into the office after work and sing to him, no. Buck wants to be serenaded, and that demands certain things.
Like getting his son out of the house, for one. No offense to Christoper, but he doesn’t need his extremely sarcastic eleven year old around while he’s trying to be romantic.
That’s easy enough, though, given that Denny is at his house daily after school—a single text message to Karen and he’s got the house to himself Saturday night and most of the day Sunday.
He sucks it up and calls Sophia for advice on how to do the rest, hangs up on her after two minutes of her laughing and calls Adriana instead. He always knew she was his favorite sister (okay she wasn’t, but she certainly is now), because she squeals excitedly and he has to ask her to slow the rapid flow of words so he can actually understand her.
By the time Saturday morning rolls around, he’s ready. He spreads a picnic blanket out in the far corner of their yard, under the sugar maple trees and near the fire-pit Buck had dug out the summer before they got married, packs a picnic basket with snacks, and sends Chris over to Hen’s just after lunch. He spends the rest of the day with Buck; they drive a well-known route through the changing trees, holding hands and trading kisses across the center console whenever Eddie stops at a red light. He takes him out to his favorite farm-to-table restaurant in Waterbury, then brings him home and takes out his secret weapon: bourbon sours.

Buck is a happy but sloppy drunk, but Eddie’s learned over the years that there’s a point in Buck’s drinking that is optimal for him: happy and affectionate, his hands roaming all over Eddie’s body and his mouth spilling words of adoration.
That’s the place Eddie’s trying to find tonight.
It takes a few hours, time he spends making out with his husband while wrapped up in his arms, sprawled out across the blanket with their legs tangled together. Finally, after Buck spends at least five minutes talking about the perfect softness of Eddie’s bottom lip (five minutes because he’s kept interrupting himself to kiss Eddie), he excuses himself under the guise of getting water, grabs his guitar, and heads back outside.
Buck’s sitting up, leaning back to look at the stars—the view isn’t as good as it was in El Paso when he’d drive out of town and into the desert, but it’s decent enough, and it means Buck doesn’t see him coming until he sits down next to him. He’s not sure what to say so he doesn’t, just strums a few chords and when he knows he has Buck’s attention, he starts to sing.
His voice shakes, and he transitions to the wrong chord at one point and has to hope Buck doesn’t notice, but he gets through it. He stares down the whole time, both because he’s not great at finding his fingering without looking and because he’s terrified to look at Buck’s face and see a hint of judgement, or amusement, or—anything, really. So when he finished and finally looks up, he’s a little stunned to see tear tracks glinting off Buck’s cheeks in the low light of the dying fire.
“Eddie,” he whispers, “I love you so much.”
And then Buck’s moving the guitar, setting it down gently at the edge of the blanket, and pressing Eddie backwards as he straddles his hips and leans down to kiss him.
“I love you,” Buck whispers, and Eddie feels him everywhere, hands on his arms and waist, “I love you,” wet lips kissing across his jaw up to his lips, “I love you, Eddie, I love you.”
Eddie sings to him again.

For two decades, most of the LGBT movement’s highest-profile victories have come at the U.S. Supreme Court. In 2003 the justices issued a ruling legalizing gay sex that dissenting conservative Justice Antonin Scalia warned would set the stage for nationwide legalized gay marriage. Within 12 years, his prediction was realized. The court made marriage equality the law of the land—reflecting, and also accelerating, a sea change in straight Americans’ views and treatment of their LGBTQ family members and neighbors.
But next year the high court could deal LGBTQ people a painful blow: wiping out lower-court rulings that shield them from getting fired for who they are.
In a trio of cases this coming term—involving a child welfare worker, a skydiving instructor, and a funeral director—the Supreme Court will hear arguments on whether it’s legal for bosses to discriminate against LGBT employees. Contrary to what many Americans now assume, no federal law explicitly prohibits firing workers simply for being gay or transgender. Nor do the laws of most states—including some populous ones such as Texas and Ohio. (Only 21 states and Washington, D.C., have laws that explicitly prohibit private companies from firing workers for being gay or trans; another one restricts anti-gay firing but not anti-trans dismissals.)

*Some states with laws prohibiting discrimination on the basis of orientation or gender identity are also in a federal circuit with a ruling that says the federal sex discrimination ban effectively prohibits discrimination based on orientation or gender identity.

Jimmie Beall learned that the hard way in 2003, when she was abruptly terminated from her position as a public school teacher in London, Ohio, a couple weeks after receiving a glowing evaluation. Beall, a lesbian who taught government to high schoolers, says she learned from local parents about rumors she was fired for being gay and was shocked to learn there was no law specifically prohibiting that. An email later surfaced from the superintendent to the school board alluding to Beall’s sexual orientation while discussing not bringing her back for another school year. “I thought, They can’t do that, because that would be illegal—there’s protection against discrimination,” says Beall. “It never occurred to me that there wasn’t.”
Despite the lack of explicit protection for LGBT workers, Beall filed a lawsuit arguing that because she was a public employee, firing her for her sexual orientation violated the Constitution. In 2006, after a new superintendent took over and a judge ruled Beall’s case could proceed, the school district agreed to settle the case and establish a nondiscrimination policy. But Beall says she assumed that before too long the state of Ohio or the federal government would prohibit anti-gay discrimination across the board. “I never imagined that, this many years later, we still would not have the same protections that everybody else already has.”
In recent years, some courts have ruled that the 1964 Civil Rights Act’s ban on sex discrimination also implicitly prohibits bias based on sexual orientation or gender identity. “When a male employee is fired because he has a husband, and he would not be fired if he were a woman who had a husband, then he was fired because of his sex,” says Jennifer Pizer, law and policy director for Lambda Legal Defense and Education Fund, a nonprofit that pursues LGBTQ civil rights cases. “When a trans woman was acceptable at work presenting as a man, but was fired when she presented her true gender, which is female, she was fired for being the wrong kind of woman.”
Citing past precedent that discrimination for not conforming to sex stereotypes is a form of illegal sex discrimination, several federal circuit courts have embraced such arguments, creating a patchwork of protections covering their jurisdictions. Next year the justices could either extend those protections nationwide or wipe them out. So in states that haven’t passed laws prohibiting anti-LGBT bias but have been covered by federal appeals court precedents restricting it—including Florida, Georgia, and Indiana—a Supreme Court ruling could give companies that don’t want LGBT people in the workplace a green light to fire them. “There won’t be a question mark anymore,” says Beall. “And because of that, I could see a whole lot more people discriminating.”
President Trump’s appointment of Justices Neil Gorsuch and Brett Kavanaugh, which made the Supreme Court more conservative than it’s been in a generation, could turn the tide. “My instincts suggest that this is an uphill battle,” says Anthony Michael Kreis, a visiting professor at Chicago-Kent College of Law who’s helped draft pro-LGBT legislation. The prospect of a loss at the Supreme Court raises the stakes for action in Congress, where Democratic allies have tried unsuccessfully for decades to pass a law that would explicitly ban anti-LGBT bias. “I don’t have a lot of confidence that the court will protect LGBTQ Americans from discrimination,” says Rhode Island Democratic Representative David Cicilline.
On May 17 the House finally passed the Equality Act, a sweeping bill Cicilline sponsored that would beef up the Civil Rights Act by prohibiting sexual orientation and gender identity bias in employment, as well as in education, credit, federal programs, housing, jury service, and public accommodations such as hotels and restaurants—even if the Supreme Court rules that the original law didn’t do any of those things. The bill’s supporters include more than 200 large employers such as Amazon.com, Apple, Coca-Cola, and Marriott. Facebook Inc. Chief Operating Officer Sheryl Sandberg said in an online post that the legislation “is true to what we’ve always valued at Facebook for our employees and the people who use our products around the world. No one should face discrimination because of who they are—and we hope Congress passes this legislation.”
After proposing narrower bills and fighting among themselves on questions such as whether to pursue the rights of gay employees separately from those of trans workers, liberal lawmakers and activists unified in 2015 behind the more-ambitious Equality Act, which they say better highlights and addresses the full spectrum of discrimination LGBT people still face. In a survey this year by the Public Religion Research Institute, 69% of Americans—including majorities in all 50 states—expressed support for legislation protecting LGBT people in hiring, public accommodations, and housing.
But in Congress, like the Supreme Court, the fate of anti-discrimination protections now rests with conservatives. Republicans command a 53-47 majority in the Senate, and even if Democrats were to take back that chamber and the presidency, advancing the Equality Act would require either abolishing the Senate’s 60-vote filibuster rule or mustering enough GOP support to reach the 60 votes. The same day the Democratic-controlled House passed the Equality Act, Mike Lee, a Republican senator from Utah and a Judiciary Committee member, called it “counterproductive” legislation at a time when “Americans are becoming more tolerant every day” anyway. “It unnecessarily pits communities against each other and divides our nation when patience and understanding are so sorely needed,” he tweeted.
Conservative groups including the Heritage Foundation, the nonprofit that Trump said helped develop his roster of potential Supreme Court picks, are hoping LGBT activists get rebuffed by both the judiciary and the legislature. For the justices to rule that the Civil Rights Act already covers sexual orientation and gender identity “would be usurping the power of Congress,” says Emilie Kao, who directs Heritage’s Richard and Helen DeVos Center for Religion & Civil Society. If Congress did pass the Equality Act, she says, it could infringe on management prerogatives such as the ability to dictate what’s worn by an employee, including those who have “a belief that they are of the opposite sex.”
Oregon Democrat Jeff Merkley, who sponsored the Equality Act in the Senate and is working to secure GOP support, says he hopes the Supreme Court’s coming LGBT cases will help draw national attention to the bill: “The issue of having full opportunity in our society, of having full freedom, shouldn’t depend on the whims of a conservative court.”

When they’re done, remove them with tongs and put them on a plate to rest and absorb some of that fat.

Outcomes in federal court depend on jurors’ politics, location and worldview By KEVIN KRAUSE Staff Writer [email protected] Criminal trials involving political speech can have two very different outcomes depending on where they’re held. A jury in New York City, for example, could view online threats against particular members of Congress very differently than jurors in rural Texas. And that’s exactly what happened in two recent federal trials pitting free speech against safety and security. A Wichita Falls jury on May 3 acquitted a 28-year-old man on a charge of making threats against congressional Democrats on Facebook — a rare outcome in federal court. The jury deliberated for just 18 minutes before finding Gavin Weslee Perry not guilty of transmitting a threatening communication in interstate commerce. His trial, in a conservative and largely Republican county about two hours northwest of Dallas, took less than a day. Several days earlier, a federal jury in Brooklyn found Brendan Hunt guilty of threatening House Speaker Nancy Pelosi and other Democrats in Congress. Hunt, 37, of Queens, had posted a video in January in which he called for the “slaughter” of members of Congress before Joe Biden’s inauguration as president. Hunt added that he’d shoot and kill them himself if he could find a gun. Party affiliation is just one factor in the outcome of trials involving politically motivated speech, but a strong one, legal experts say. Nevertheless, lawyers when picking a jury should also consider influences such as attitudes toward free speech and the role of government, according to jury consultants. “I don’t know if it was politics, but they didn’t determine it to be a serious threat,” said Perry’s defense attorney, Frank Trotter. Trotter said that his client didn’t testify and that he didn’t call any defense witnesses. Perry, he said, never denied making the comments on Facebook. Their defense, he said, was that “it was just political hyperbole, not a threat.” Trotter said his client made the comments as part of a Facebook thread about politics. He called it a case of Perry wanting to “one-up” another commentator. Perry, a former Fort Worth resident, felt vindicated after the verdict, Trotter said, because he had been adamant from the beginning that he was only exercising his free speech rights. The U.S. attorney’s office in Dallas declined to comment on the outcome. Rants or threats? Freedom of speech is not absolute. Courts have ruled, for example, that fraud, obscenity, incitement to violence, perjury, libel and threats are not entitled to constitutional protection. But interpretation of the intent behind words can be tricky and is ultimately up to individual juries based on the evidence of each case. The government had made several plea offers to Perry, which included a sentence for time he already served behind bars, but he wanted to go to trial, Trotter said. Perry didn’t specifically threaten to harm the House speaker. Rather, he accused her of being part of a cult — a popular yet unfounded conspiracy theory making the rounds online. “Nancy Pelosi is a part of a satanic cult and so are the people who work closely with her,” Perry wrote on Facebook. “Dems of the establishment will be removed at any cost necessary and yes that means by death.” His other Facebook comment at issue did not single out any particular person for violence. Trotter said he thinks that worked in his client’s favor. “If you’re a dem or a part of the establishment in the Democrats’ side, I view you as a criminal and a terrorist and I advise everyone to Go SOS [shoot on sight] and use live rounds,” Perry wrote in March 2020. “Shoot to kill. This is a revolution.” There were no allegations that Perry was a member or proponent of any extremist group like the Proud Boys or Oath Keepers. And Trotter said his client didn’t own a car or a gun and wouldn’t have been able to travel to Washington or to Pelosi’s district office in San Francisco. Prosecutors, however, did not have to prove that Perry intended to carry out the threats. Jury instructions in the case said prosecutors had to prove that the defendant sent the message intending to communicate an actual threat or “with the knowledge that it would be viewed as a true threat.” That means a real threat and not a joke, “idle talk” or a “careless remark,” according to court records. And the threats would have to cause a “reasonable person” to fear being injured, records show. In the New York case, Hunt’s lawyers similarly had argued that their client wasn’t caught with weapons or any plans to actually commit violence and was just ranting online, according to published reports. They argued during the trial that his comments were political opinions. But the Brooklyn jury found otherwise. The jurors did not conclude that all of Hunt’s comments in the indictment constituted illegal threats; nor were they required to. Just one was sufficient to convict. Hunt’s Dec. 6 post on Facebook called Pelosi, Sen. Chuck Schumer, D-N.Y., and Rep. Alexandria Ocasio-Cortez, D-N.Y. “high-value targets,” prosecutors said. “They really need to be put down,” Hunt wrote. “These commies will see death before they see us surrender.” Another Hunt comment called on former President Donald Trump to hold a public execution of Pelosi, Schumer and Ocasio-Cortez, authorities said. “If you don’t do it, the citizenry will. We’re not voting in another rigged election. Start up the firing squads, mow down these commies, and let’s take America back,” Hunt wrote. After the April 28 verdict, Mark J. Lesko, acting U.S attorney for the Eastern District of New York, said his office would “not tolerate threats of violence against public officials who are entrusted with upholding the Constitution.” Two alleged Capitol rioters from North Texas also have been charged with making threats. But their trials are scheduled to be held in Washington, D.C., a liberal enclave very different from rural North Texas. Troy Anthony Smocks, 58, of Dallas allegedly wrote on Parler that patriots like him should launch an armed hunt for Democrats, tech executives and other “traitors” at the Capitol. And Garret Miller, 34, of Richardson is accused of storming the Capitol building and making death threats against members of Congress and Capitol Police. Miller called for the assassination of Ocasio-Cortez, and he threatened Schumer on Instagram, saying “we are coming for you,” the FBI says. Both men have pleaded not guilty and remain in custody awaiting trial. Different views Kacy Miller is the president and owner of CourtroomLogic Consulting, a Dallas-based jury consulting firm. She said politics is just one factor, in addition to the individual facts of each case. All facts being equal, it’s not surprising that a trial in Wichita Falls could have a different result than one in New York, she said. “People have different views on how the world works depending on where they live,” Miller said. “The tone and the tenor of what’s happening in society is important.” Trotter said he asked the jury pool during jury selection about their political affiliation. Just three said they were Democrats, and he struck all three from the panel, he said. But there are considerations beyond party identification, Miller said. Did jurors perceive the threat as intending or inciting harm or was it just “some wingnut spouting off and wanting to be heard?” Miller said it’s unwise to generalize and expect a juror to think a certain way based solely on their political leanings. Maybe a juror had a relative who was harmed in some way because of online threats, she said. Also, some people don’t use social media or follow politics, Miller said. Another factor in trials, she said, is the “courtroom dynamic,” meaning the attorneys’ delivery and interaction with witnesses. In the Perry trial, the 18-minute jury deliberation is revealing, Miller said. “That tells me everyone was unified in their opinion,” she said. Trotter acknowledged the likelihood that location played a role in the trial’s outcome. “You might be able to [convict] in Dallas or Austin,” he said. Trotter, however, said his client was not emboldened by the verdict to continue posting provocative sentiments online. “I talked to him about it. May flowers…without the showers

We’ve all heard the adage, “April showers bring May flowers!” We have the flowers this year, but April precipitation did not materialize. 2021 is lining up to be the third driest year in the history of California. And that means that we must be more diligent than ever to prepare our properties for a season of increased wildfires.
I have been weeding my property with every spare minute since February. It is essential to pull out weeds by the roots, else they return promptly. This is round three and the resulting garden is looking beautiful. I’ve been experimenting with mixing flowers of iridescent pinks with buttery yellows and pumpkin orange accented by sky blue and bold purple. The palette has taken on an Impressionistic essence of which Monet would be proud.
April and May have always been my favorite months because of the plethora of blooms, birds, and fragrances. The perfume of the jasmine permeates the morning air, the lilac scents the afternoon sunshine, while the wisteria and mock orange infuse the evening with glorious aromas. My two thornless Lady Banksia rose bushes with their profusion of creamy double-petaled flowers have commandeered thirty linear feet of a fence as well as twined to the tops of a plum and chestnut tree. The flowering cherry tree showcases puffy blossoms resembling pink snowballs. The mock orange tree’s white blooms are candy for the bees. The cerise flowers of the Western redbud tree offer a gorgeous contrast to the unfurling green leaves of the honey locust trees. Under a canopy of pines and surrounded by white calla lilies and lacy hemlock, a New Zealand hawthorn brightens the verdant scene with clouds of blush blooms. Bearded irises in a variety of colors are delicate and fragrant. Azaleas and camellias thrive in the shadow of the redwoods. Freesias, tulips, daffodils, calendulas, anemones continue their carnival of blooms. Despite the lack of rain, the spring display is splendor in the grass.
In many parts of the country, people wait until after Mother’s Day to start planting their vegetables but because of the warmth of this season, I advise that you get started soon. Getting children involved with planting vegetables and herbs will encourage them to eat what they plant. After researchers spent time with children in Central Texas who had gardens and gardening classes at their schools, they discovered that the nutrition of both parents and children improved. Also, those who participated began enjoying more vegetables.
If you are planning a vegetable patch, buy pint or quart size containers of your favorite vegetables. Don’t attempt to plant everything you see at the nursery. Only plant what you and your family love. For example, for my spring veggie garden, I’ve planted nine varieties of tomatoes as I’m a tomato snob. I only eat tomatoes in season and prefer only tomatoes that I, a friend, or a family member grows. Also planted are eggplant, zucchini, cucumbers, and peppers. Already growing are a plethora of herbs including basil, oregano, fennel, sage, thyme, dill, cilantro as well as leafy greens of arugula, sorrel, lettuce, and sugar snap peas, artichokes, onions, chives, strawberries, and broccoli.
Make sure that you rotate your crops from year to year so as not to deplete the soil. Most summer vegetables require a minimum of six hours of sunlight. Read and follow the instructions that come with your plant.
Another beautiful, long-flowering, and excellent fresh-cut for arrangements is the dahlia. Although they are supposed to be deer-resistant, the deer that graze around my property seem to find them delicious. I don’t advise dahlias to be planted in areas where you have marauders. Dahlias produce large, colorful blooms and are a welcome addition to any garden. Here’s how to get them started in your landscape:
1. Choose a well-drained area with plenty of sunlight.
2. Plant the tubers after the danger of frost have passed.
3. Dig a hole about a foot deep and amend with compost or potting soil.
4. Place the tuber flat and cover with the amended soil.
5. Make a patch of dahlias spaced 12-36” apart for maximum impact.
6. Water immediately.
7. After sprouting, pinch off the side buds to allow the central blowers to be larger.
8. Deadhead as flowers fade to maintain blooming.
Because of the arid times in which we are living, make sure to cut all tall wild grasses, trim limbs up from the ground six to ten feet to prevent fire laddering, and clear a safety zone around your home. Clean out gutters, remove debris, be cautious when barbecuing and careful around the fire pit. Keep gardens irrigated, watering early in the morning or early in the evening. Be diligent and responsible to help prevent a fire from igniting. Pray for rain yet be prepared for drought.
Mother’s Day is approaching and a welcome gift for mom can always be found in the garden. Consider a bubbling fountain, birdhouse, or colorful annuals to plant. Make a simple arrangement using flowers from the garden accompanied by a garden book that will be treasured always. Whatever you do, let your Mom know how much she means to you whether it is through a virtual visit or an in-person brunch, picnic, or walk. Moms love the little remembrances and deserve accolades, at least once a year!
Spring is the time to savor the beauty surrounding you. If you’ve ever been to Giverny in France, you will know that Monet was not exaggerating about his garden being his most beautiful work of art. He was inspired by nature and you can be too. Be an artist and create your masterpiece in your garden.
