Kirby and the Forgotten Land: OST Review✨
I was gonna save this for later, but I’ve been doing a lot more writing than drawing lately...might as well post something in the meantime.
So, I love video game music. ^^ I spend a lot of time collecting it, listening to it, and thinking about it (and making it). And the other day I went through the Forgotten Land OST and started writing out some of my thoughts on the tracks...and before long I ended up with all of this.
Please keep in mind that these are MY opinions...as in, subjective observations from just one human being. You may agree with some of the things I say, and you may disagree with others. This is normal and human, and not cause for alarm. ^^
***I highly recommend playing the relevant tracks on the OST while reading (especially if you haven’t listened to them outside the game yet). ^^ I always do this when I read about people’s thoughts on music; I find it helps me to understand their observations.***
My Personal Favorites:
Through the Tunnel: Cute and upbeat; the first theme I fell in love with. Just hearing that little snare+woodwind intro automatically brings a smile to my face~
Pitch-Black Horror: So unique and entertaining; on a first listen you never really know what it’s gonna do next, which fits the ‘scary haunted house’ theme nicely. ^^ Its sister track, Pitch-Black Valley, is honestly just as good, just with more acoustic instrumentation, if that floats yer boat. I’m partial to electronic sounds myself, so only Horror really gives me the goosebumps~
Burning, Churning Power Plant: Just…EXTREMELY cool and good. ^^ I honestly don’t even care that it’s not another remix of the classic Factory Inspection; this is a fantastic successor theme in its own right. Let the next factory themes copy this one!
Wild Results: I always start to dance whenever this plays. Never get tired of it, despite hearing it in the game a hundred times. Excellent, top tier A++++1000%
Most Popular (i.e. the ones I see other people talking about most often. I feel like I should at least give my thoughts on them…even if I didn’t particularly like them):
Roar of Dedede: Okay, okay, okay; I will admit that it’s VERY energetic and hype; was probably a blast to compose; really makes you want to get on your feet and cheer (maybe they’ll use it during that livestream Kirby concert later…they should). But I dunno, I still feel kinda ‘meh’ about it. ^^; I think it was because all the background stuff took center stage; Dedede’s theme itself is played with the tiniest li’l instrument sounds, almost as if they don’t want it to get in the way of the imposing drums and guitar riffs and orchestra hits. And I like those imposing sounds, but…I mean…shouldn’t it be both? ^^; Shouldn’t we also be rocking to the melody behind all the bells and whistles? Why so subtle…?
Meta Knight, Sword of the Surviving Guardian: It’s…good, I guess… ╯︿╰ I mean, it’s definitely the most interesting of the MK themes we’ve gotten so far, and I like its urgency. But somehow it stops feeling like ‘his’ whenever the trumpets aren’t playing; I think the instrumentation is a little more generic than it needed to be (honestly, Morpho’s theme sounds more like an MK theme than his own…). I will say that the melody is…promising. It’s tight, it’s memorable; it sounds like something that could be ‘his’, even if it didn’t fully deliver this time. I hope HAL will use it to finally give MK some kind of solid sound identity, because I feel like they get a little lost when it comes to him. All his battle themes are so different and none of them really stand out…it would be nice, after 12 years (Epic Yarn), to finally have another MK theme that I actually like.
Two Planets Approach the Roche Limit: Stone me if you wish-- I feel like it was basically the same thing Void Termina had going on, but 75% less effective (and I never really liked V/T’s theme that much either, so…yeah). It’s just so…ambient! :[ If you told me it was actually just background music they used for a cutscene, I’d believe you…and that’s not what I look for in a final boss theme. I don’t want ‘ambient’ at the climax of the game; I want ‘intense’ or at least ‘stirring and memorable’. I do like the intro, but everything after those first 30 seconds is pretty forgettable. :/ If there’s any track I’ll probably associate with Fecto Elfilis going forward, it’s The Fate of Two Worlds-- despite being little more than a 30-second loop, I feel like it contains much more genuine emotion. My dream F/E theme would be THAT, but more and BETTER.
Welcome to the New World!: Believe it or not, I actually DO like this one. I didn’t really want to at first, but it’s so damn catchy. ^^ Plus, it’s got its melody inserted into a good third of the whole OST; you’re kind of trained to like it whether you want to or not. XD I’m curious about how it was produced, though…I want to think they just had the singer come in and sing gibberish (like for Splatoon music) but some of those syllables sound STRIKINGLY close to the Japanese words for the actual lyrics. And during some of the fast-tempo parts the vocals sound artificially cut together…it’s almost as if they used three different methods to make the song:
A: Have the singer sing gibberish
B: Have the singer sing slightly-garbled Japanese
C: Have the singer sing…something, then edit it into appropriate gibberish in post
But, like, why all three?? Why not just use one method?? Am I just hearing things??? This mystery is going to plague me for the rest of my life…>_<
Honorable Mentions:
HAL Room 2: This is a bit personal இ௰இ The Star Allies part was plenty nostalgic on its own, but then when it switches to the Kirby Fighters 2 theme இ௰இ இ௰இ I spent a lot of time listening to that while working on the DreamAll AU in my last semester of college இ௰இ இ௰இ இ௰இ and I just (;´༎ຶД༎ຶ`)
Morpho Knight: WAY better than the first one. ^^ It’s actually a lot of fun to listen to; I was very pleasantly surprised…and I hope this is how Morpho’s themes will be going forward: combinations of his own simple motif with the main theme of the game.
Abandoned Beach: Not only is this a great theme, I like how it’s placed early enough to teach you what the name of the game is for this OST: songs composed specifically to bring back memories of earlier songs. I think this is the most obvious one, being a clear rearrange of Float Islands-- most of the other themes that do this have much more subtle inspirations. A certain instrumentation, or a familiar motif or beat…if you’re a Kirby music buff, I encourage you to try to figure out what your favorite Forgotten Land soundtracks might have been based on. ;D
EVERY SINGLE WONDARIA THEME: They’re definitely ALL in my top 20 Forgotten Land themes. ^^ That whole area is so pleasant and fun and succeeds amazingly at making you feel nostalgic for a time and place you never lived in…and the music is a big part of that success. Years from now, I’m pretty certain these are going to be the tracks I remember most from this game.
All the Waddle Dee Town themes: Including the minigame themes! None of them are really stand-out favorites to me, but they’re still so cute, and they make you feel safe and warm. ^^ I love Waddle Dee Town! I want one in every game! I WANT ONE IN REAL LIFE TToTT

Efforts to Criminalize Ecocide In An Increasingly Climate-Conscious World

On July 1, 2002, the Rome Statute took effect, officially establishing the International Criminal Court (ICC).[1]The ICC’s jurisdiction extends to include both signatory and non-signatory State Parties and encompasses“the most serious crimes of concern to the international community as a whole,” namely, genocide, crimes against humanity, war crimes, and the crime of aggression.[2]Excluded from this list, however, is the crime of ecocide, or extensive environmental destruction. With the looming threat of climate change only intensifying in recent years, the question of whether or not to add the crime of ecocide to the ICC’s jurisdiction is increasingly relevant.
Arthur Galston’s first mention of the word “ecocide” in 1970 at the Conference on War and National Responsibility soon triggered decades of debate regarding its place in international law.[3] When discussions began in 1978 for the Draft Code of Crimes Against the Peace and Security of Mankind, which would later be entitled the Rome Statute, many nations initially demonstrated support for the criminalization of ecocide, specifically within the context of the United Nations Law Commission.[4] However, by the time the Rome Statute wasapproved in 1998, both ecocide and a section on “willful and severe damage to the environment” were excluded.[5] The document’s only acknowledgement of environmental harm restricted the Court’s jurisdiction over such offenses to that which occurs as a result of war.[6] The ability to prosecute for this crime was also limited with a single word modification from the 1977 Environmental Modification Convention (ENMOD). While Article 1 § 1 of the ENMOD treaty details the test for war-time environmental destruction as ‘widespread, or long-term or severe,’[7] Article 8 § 2 (b) of the Rome Statute 1998 alters the test, presenting it as ‘widespread, long-term and severe.’[8] Such a change requires alleged war-time environmental destruction to fulfill all three criteria, thus limiting the law’s applicability.
With knowledge of the potential dangers of the exclusion of ecocide from the ICC’s jurisdiction, British barrister Polly Higgins revitalized the debate regarding the criminalization of environmental harm at an international level in 2010. On her website dedicated to ecocide law, she highlights the inadequacies of voluntary provisions regarding climate change, particularly the Paris Agreement and the Sustainable Development Goals, by stating thatsuch documents are unenforceable against corporations and states.[9]Higgins continues byarguing that trade and commerce provisions, which fall under civil law, are also insufficient as there is limited remedy for ecosystem destruction and climate change, enforcement of State obligations is limited, andbusinesses tend to continue their harmful operations after a settlement is reached.[10]However, the ICC’s jurisdiction over ecocide crime would enable prosecution to occur according to an international standard, even if a State Party is unwilling or unable to do so themselves. To summarize the necessity of the Rome Statute’s inclusion of ecocide as a crime, Higgins’ website states that “existing laws, including international declarations, treaties and protocols, do not impose a universal legal requirement to uphold State and corporate responsibility for serious harm.”[11]Therefore, Higgins believed that adding a fifth law of ecocide to the ICC’s jurisdiction would be most effective in holding chief executives and government officials responsiblefor the environmental harm they cause.
In 2010, she submitted a draft law of ecocide to the United Nations Law Commission and defined ecocide crime as “acts or omissions committed in times of peace or conflict by any senior person within the course of State, corporate or any other entity’s activity which cause, contribute to, or may be expected to cause or contribute to serious ecological, climate or cultural loss or damage to or destruction of ecosystem(s) of a given territory(ies), such that peaceful enjoyment by the inhabitants has been or will be severely diminished."[12] By using the word “or” rather than “and” throughout the definition, Higgin’s draft of the law can be interpreted to apply to many circumstances. Later in the drafted law, she continues this use of the word “or” by returning to the test criteria for war-time environmental harm as described in the ENMOD by stating that “impact(s) must be widespread, long-term or severe” in order to classify as ecocide.
According to Article 121 § 3-4 of the Rome Statute, adoption of an amendment occurs after there is a two-thirds majority support from the State Parties with the amendment then taking effect for all State Parties one year after seven-eighths of them demonstrate ratification or acceptance of it to the Secretary-General of the United Nations.[13] Although the process of amending the Rome Statute appears daunting, Higgins appeared optimistic in a 2011 interview with Time Magazine in which she said, “This is definitely manageable. You’re looking at, in truth, under 100 people needing to put their minds to this—it just so happens they’re heads of state.”[14] However, with nine years passing since she first began to lobby at the United Nations for the new law, it is apparent that the process of convincing the State Parties to amend the Rome Statute has proven to be lengthy and challenging.
More recently, Higgins was faced with another, much more personal battle with a form of cancer that left her with only weeks to live. Following Higgins’ diagnosis, the Guardiancolumnist George Monbiot, highlightedher effortsby writing that such an addition to the Rome Statute “would radically shift the balance of power, forcing anyone contemplating large-scale vandalism to ask themselves: ‘Will I end up in the international criminal court for this?’ It would make the difference between a habitable and an uninhabitable planet”[15] According to the Carbon Majors Database, “25 corporate and state producing entities account for 51% of global industrial [greenhouse gas] emissions,”[16] thus raising the question of how these emissions and other contributions to pollution and climate change could be reduced if ecocide was a crime and executives and legislators were forced to consider the reality of being tried by the ICC prior to making potentially devastating decisions. As Higgins said after she was diagnosed, “There are millions who care so much and feel so powerless about the future, and I would love to see them begin to understand the power of this one, simple law to protect the Earth – to realise it’s possible, even straightforward.”[17] It was with the hope that such a solution to environmental harm is achievable that Higgins passed away on April 21, 2019, confident that her legal team would continue her work.
Higgins’ legacy remains in her diligent attempts toprove that the environmental destruction resulting from the decisions of corporations and politicians should be classified as “the most serious crimes of concern to the international community as a whole” and, consequently, should be added to the Rome Statute. Whether or not ecocide is considered one of the world’s most serious crimes remains contested and the amendment continues to lack the necessary support of State Parties. However, as pressure mounts for new and effective approaches to the issue of climate change, the ICC’s potential to disincentivize corporations and politicians from making environmentally harmful decisions will remain vocalized by those who succeed Higgins.
