Take charge of your data
If youâre concerned about protecting your personal data collected by corporations, then I have a new law for you.
The Texas Data Privacy and Security Act takes effect July 1.
On that date, Texans will gain a series of rights and benefits previously kept from us.
Let me show you an example of how it works.
You shop for groceries at XYZ, so the store knows what you buy.
Maybe that data is sold to a data broker who can tell from what you buy if youâre rich or poor and a whole lot more.
This disturbs you enough that you go to the XYZ website and tell the company you want access to all the data it has collected on you.
Once you download the data to your device, you can do one of four things:
You can edit the data.
You can correct the data.
You can ask that all data, past, present and future on you is deleted.
And finally, you can choose to do nothing.
If the company is slow in responding, you can file a complaint with a new crew of data lawyers operating out of the Texas attorney generalâs office.
Companies not responding will get a chance to address the problem. If theyâre slow, investigators come into play.
Bill sponsor and state Rep. Giovanni âGioâ Capriglione, R-Southlake, points out that with 1,000 customers, a $7,500 fine per customer adds up to $7.5 million in fines.
$11 million in funds
Gio says he believes his law will be a success because of the $11 million funded for it by the Legislature.
This shows that lawmakers werenât paying lip service to privacy, he says.
Out of $11 million, $7 million will pay for lawyers and investigators.
The other $4 million will pay for the creation of the state-run website where complaints can be filed.
Iâd like to tell you the name of the new website, but as of this writing, it has not been disclosed.
Here is the broad range of businesses it applies to, according to an analysis by the Akin Gump Strauss Hauer & Feld law firm.
Subject to this law is any company that conducts business in Texas or produces a product or service consumed by Texas residents.
Any company that processes or engages in the sale of personal data.
And any company that is not a small business as defined by the U.S. Small Business Administration.
Exceptions
Are there exceptions?
Of course.
Itâs almost a rule in Texas government that there are always exceptions.
Some of the exemptions allow the following to be collected: protected health data and records;
certain patient identifying information;
personal data subject to the Fair Credit Reporting Act;
student privacy and data collected for job applications and benefits.
More exemptions:
nonprofits;
state agencies and political subdivisions;
some financial institutions;
entities governed by HIPAA privacy laws; institutions of higher education;
electric utilities; power generation companies and retail electric providers.
In an interview, Gio recommended that I tell you to go to the major data collectors â Facebook/Meta, X/Twitter and Google â to request your data.

âIf you do that youâre going to be shocked at what information they collected,â he warned.
The Watchdog tried it.
Starting with Facebook, I easily found instructions to download my personal information.
But the download, which can take up to 24 hours, was not complete as of this writing.

Will the new law work?
Donât expect miracles on Day 1.
Setting up a new website by any government on deadline can be an ugly process.
Remember HealthCare.gov?
But if it does work and consumers request their data and companies work harder and spend more money to be data-friendly, this could be a privacy/data game changer.

Former Royal Chef Who Cooked For the Queen and Princess Di Now Based Right Here in Dallas
          Chef Darren McGrady has cooked for the royal family of the United Kingdom for 15 years, but more recently he has lived and worked in Dallas for years now. Delish.com has summed it up nicely in the short article attached to a video they did with him published on April 7th where he recreated the Queenâs favorite birthday cake. It reads:
âDarren McGrady was the personal chef to Queen Elizabeth II, Prince Philip, Princess Diana, Prince Charles, and Princes William and Harryâa family with notoriously specific food needsâfor 15 years. In 1998, he moved to the U.S.A. where he wrote best-selling cookbooks and founded Eating Royally, a fine-dining catering service based in Dallas, TX.âÂ
          The Dallas Morning News also picked up on this story in an article published July 9th. In it they say:Â
âThe Dallas-based chef, who once doted on Di, is now delivering his food to Southlake, beginning Tuesday, July 14. âThe Dallas area has really taken off with our drop-off menu and we are now expanding it,â McGrady said. Whether itâs watermelon salad with arugula, feta and mint dressing or lemon parmesan chilean sea bass, McGradyâs preparations are nods to his experience cooking for royalty and fine-dining tradition. At $41.50 per entree (which includes a choice from one of five salads), they also offer variety for at-home diners stuck in a culinary rut.â

AT&T outage and breach
Kristen Hanich, director of research at Addison-based research firm Parks Associates, said any number of potential issues could have been the cause.
âIt could be anything from authentication issues to hardware failure or cloud configuration errors or cyber or other reasons,â she said. âTime will tell, and we are closely monitoring the story.â
911 calls unaffected
Because of the outage, some emergency services had to use maps to get to their destinations because FirstNet went down, Matt Zavadsky, chief transformation officer at MedStar Mobile Healthcare, told NBC5.
âWhen the system went down at 2:30 ... area law enforcement, fire agencies, first responders all over lost connectivity with their field units,â Zavadsky said. âSo we had to revert to radio dispatching and actually using maps and ambulances to get to calls because the mapping systems werenât working because the cell system was down.â
Other North Texas police departments reported no impact from the wireless outage. A Dallas Police Department spokesperson said none of its 911 calls were affected.
By 1 p.m. Dallas time, FirstNet was fully operational again, said White House national security spokesman John Kirby.

AT&T: Millions of usersâ data leaked
Social security numbers, passwords among info released
Personal data from about 73 million current and former AT&T account holders has been leaked on the dark web, the telecom giant said Saturday.
The Dallas-based company said the data was released onto the dark web about two weeks ago, and officials are not sure yet whether the data originated from the company or one of its vendors.
âWith respect to the balance of the data set, which includes personal information such as social security numbers, the source of the data is still being assessed,â officials wrote in a news release.
AT&T officials said the company has launched an investigation with cybersecurity experts. In their initial analysis, staff found the data set appears to be from 2019 or earlier, affecting about 7.6 million current account holders and 65.4 million former account holders.
Company officials noted they donât have evidence at this point of unauthorized access to their systems.
âThe company is communicating proactively with those impacted and will be offering credit monitoring at our expense where applicable,â officials wrote.
Anyone who has been impacted will get an email or letter from the company.
AT&T officials said the incident had not had a material impact on the companyâs operations Saturday.
Impacted customers have received emails noting that their account passcode has been compromised and that they must reset it.
âIt appears the data is from more than 4 years ago and does not contain personal financial information or call history,â AT&T wrote to customers.
In the email, the company notes the information may have included customersâ full name, email address, mailing address, phone number, social security number, date of birth, AT&T account number and passcode.
AT&T offers services
If sensitive personal information was compromised, the company said it will provide âcomplimentary identity theft and credit monitoring services.â
The dark web leak comes a month after the company suffered a nationwide outage in its cellular service for a day.
The company blamed the outage on a coding error and not a cyberattack.
âThe real issue here is the fact that basically all the personal identifiable information that you would need to basically recreate a person in the cyberspace was leaked,â said Andrew Sternke, the CEO of Southlake-based DarkBox Security Systems.
In 2021, threat actor ShinyHunters claimed to be selling data on 70 million AT&T customers.
Officials with the telecom company then told the tech outlet BleepingComputer that the information did not come from them, and they could not âspeculate on where it came from or whether it is valid.â
Users on the hacking forum, BreachForums, appear to suggest the data breach is a repost of the initial leak from 2021, but AT&T officials have not confirmed the connection.
âThe real question is what happened between 2021 and now?â said Brett Callow, threat analyst with New Zealand-based cybersecurity firm Emsisoft.
T-Mobile breach
Breaches among telecommunications companies and with third-party vendors are not uncommon, Callow said.
Last year, T-Mobile said a âbad actorâ accessed personal data from 37 million customers. In 2022, the company agreed to pay $350 million to settle class-action lawsuits from a data breach disclosed in 2021 that affected a little over 40 million people.
Callow said service providers, like AT&T, can hold data for companies they provide services to.
Also, a provider like AT&T, he said, would have a massive number of vendors working for them in various ways.
In the case of AT&Tâs breach, data could potentially be used to commit identity-related fraud.
The crime of hacking AT&T or its vendor could lead to many other offenses, Callow said.
Sternke said two things people should do is check their credit file â a record of their credit history â and use two-factor authentication for every one of their accounts.
He also urged those who are impacted to change their password and use a password manager.
âThat will help keep track of your passwords by encrypting it and then you just need to know one main password to enter into your encrypted manager, and the password manager will automatically input your password into the account that you sign in.â
Customers should âabsolutelyâ sign up for the credit monitoring services offered, Callow said.
âHopefully that will mitigate those risks,â Callow said. Customers may also consider putting a block on their credit, which could stop fraud from happening, he said.

AT&T reported Saturday that personal data from millions of current and former account holders has leaked onto the dark web.
The Dallas-based company said the data â which it said appears to be from 2019 or earlier â was posted about two weeks ago, and that the company had not determined where it originated from.
Hereâs what we know:
How many people were affected?
The telecommunications giant said a preliminary analysis found the data set includes information from about 7.6 million current account holders and 65.4 million former ones, totaling about 73 million people.
Anyone who has been impacted will get an email or letter from the company.
In an email to customers, AT&T said that to the best of its knowledge the data does not contain personal financial information or call history.
However, it said the information released may have included full names, email addresses, phone numbers, Social Security numbers and AT&T account numbers and passcodes.
AT&T told customers in an email that it would provide complimentary identity theft and credit monitoring services if their sensitive personal information had been compromised.
What do I do if Iâm affected?
AT&T has already reset passcodes â personal identification numbers, or PINs, that are an extra security measure for account holders.
Officials are advising all customers to change their passcode as a precaution.
People should monitor their credit report and use two-factor authentication for every one of their accounts, said Andrew Sternke, CEO of Southlake-based DarkBox Security Systems.
âThe real issue here is the fact that basically all the personal identifiable information that you would need to basically re-create a person in the cyberspace was leaked,â Sternke said.

Itâs just a fact of life that we all have to live with,â said Mitch Thornton, executive director of the Darwin Deason Institute for Cybersecurity at Southern Methodist University. âAll you can do is protect yourself, your systems and your access to third-party accounts.â
AT&T said it will notify users who have been affected through mail or email.
The company has also said it has begun an investigation to determine what the cause of the data breach was and is offering affected customers complimentary identity theft and credit monitoring services.
But, in the meantime, hereâs some steps you can take to protect yourself and your private information.
The basics
Criminals who steal private data often sneak small purchases in between larger bills in the hopes users wonât notice it, Thornton said. Checking credit should be the first step most people will need to take, he said.
âMonitor your credit for suspicious activity. Donât just pay your credit card bills and whatnot without going through your transactions,â Thornton said. âOftentimes, these criminals will make a small purchase just to test if youâre monitoring your accounts. Youâd be surprised at the kinds of stuff you might find.â
Resetting passwords and applying two-factor authentication, a security system that requires two different forms of identification, should always be in place to be the most well protected.
But if users havenât already, doing both is crucial at a time like this.
Resetting a password every six months, while time-consuming, could save individuals a headache down the road, Thornton said.
âA lot of people choose not to do either of them, because itâs an inconvenience. Every time you log in, you have to do more work and people could forget passwords,â he said. âBut in cases like this, it could help you because the adversaries have your password, but they may not have your cellphone so they might not be able authenticate you fully.â
Though it might be a pain, applying credit freezes and locks could also be helpful. Though they both block individuals who have not been authorized to have access to credit reports, their main differences are in cost and how quickly it goes into effect.
Credit locks are typically a service that cost users between $10 to $25 and can be applied instantly, while credit freezes are usually free but can take longer to go into effect â sometimes up to five business days.
For users who are especially concerned, purchasing and using security software, while too late in the case of protecting data that AT&T stored, could prove to be helpful in the future, Thornton said.
âNo matter what security software you have on your end systems at home, it wouldnât have helped here because they didnât attack you, they attacked your data thatâs held by a third party,â he said. âHowever, I would always tell people for their home systems that they should use security software.â
Whatâs next?
AT&T account holders will need to watch their email inboxes and their mailboxes.
However, thereâs still a chance that cybercriminals will take advantage of that too, Thornton said.
âIf someone calls you up, or sends you an email that says, âHey, we think youâre one of the people who have been affected. You need to authenticate information so send us your password,â donât do that,â he said. âYou can always say you can provide it, but contact AT&T separately and ask them to verify that theyâre actually the ones contacting you.â
With private information out on the dark web, it raises the stakes for affected individuals and the need to take precautionary steps, Thornton said.
âYour data is already out and available on the dark web. Usually, that is sold from one criminal to another and the threat of identity fraud is much higher,â he said.
âI know itâs time-consuming, but I highly suggest taking steps to protect yourself.â

AT&T reveals data breach
â22 info was stolen this year, affecting 100M customers
Dallas-based telecommunications company AT&T revealed its second data breach of the year Friday morning, a leak that affects more than 100 million U.S. customers.
The cause of the breach was not a breakdown of its servers, the company said, but a malicious actor who illegally broke into an AT&T workspace from a remote platform.
According to Securities and Exchange Commission filings, AT&T first learned about the data breach on April 19 of this year after a âthreat actor claimed to have unlawfully accessed and copied AT&T call logs.â
This âthreat actorâ gradually siphoned the data from an AT&T workspace through a âthird-party cloud platformâ between April 14-25, during which time the company had begun an investigation into the breach with the help of external cybersecurity experts.
The data contains communication records from May 1 to Oct. 31, 2022, as well as on Jan. 2, 2023.
The concerned data was not taken on those dates, but from those dates after the fact.
The company said that nearly all AT&T wireless customers and customers of mobile virtual network operators hosted by AT&T servers, like Cricket Wireless or StraightTalk, could be impacted.
AT&T serves more than 100 million U.S. customers and a further 2.5 million businesses, the second-most behind Verizon.
Personal IDs safe
AT&T said that the leaked data does not include any personal identification information like Social Security numbers, age or credit card information, nor does it contain the content of phone calls and texts.
Instead, it includes records of communications during the affected periods, including the other phone numbers that a wireless number interacted with as well as call duration.
AT&T said that all affected customers will be notified if their data was involved in the breach.
AT&T said that âwhile the data does not include customer names, there are often ways, using publicly available online tools, to find the name associated with a specific telephone number.â
The company also said that it does not believe the breached data is publicly available and that it does not believe the breach is âreasonably likely to materially impact AT&Tâs financial condition or results of operations.â
Earlier breach
The companyâs first data breach of the year occurred roughly a month before the larger breach was uncovered.
Nearly 73 million current and former AT&T companies had Social Security numbers and names leaked onto the dark web, opening them up to potential identity fraud and other dangers.
Digital privacy is a growing issue and online users should be cautious of malicious parties looking to steal and use their data.
Recommended personal protection measures include credit freezes, multifactor account authentication and changing passwords to use number-letter-symbol arrangements.
Senators seeking answers from AT&T following massive hack
More than 100 million accounts compromised
WASHINGTON â Two U.S. senators on Tuesday asked AT& T to answer questions about a massive hacking incident in April that resulted in the illegal downloading of about 109 million customer accounts at the U.S. wireless company.
Sen. Richard Blumenthal, a Democrat who chairs a subcommittee on investigations, and Republican Sen. Josh Hawley sought details after AT& T disclosed on Friday its call logs were copied from its workspace on a Snowflake cloud platform covering about six months of customer call and text data from 2022 from nearly all its customers.
âThe stolen information can easily provide cybercriminals, spies, and stalkers a logbook of the communications and activities of AT& T customers over several months, including where those customers live and traveled â a stunning and dangerous breach of its customersâ privacy and intrusion into their personal lives,â the letter to AT& T CEO John Stankey said, asking if the wireless company will compensate consumers.
AT&T said it would respond directly to the senators.
âThere is no reason to believe that AT&Tâs sensitive data will not also be auctioned and fall into the hands of criminals and foreign intelligence agencies,â the senators added.
Snowflake did not immediately respond to a request for comment. In a separate letter to Snowflake, the senators raised concerns about other recent data breaches of Snowflake clients.
âThe recent AT&T disclosure â three months after the breach and following other announced breaches â raises concerns that we still do not know the full scope or impact of the campaign targeting Snowflake customers,â the senators wrote.
The FBI is investigating.
AT&T said at least one person has been arrested.
AT&Tâs breach is the latest big hack to hit a wide swath of Americans, coming on the heels of a ransomware attack on UnitedHealth Groupâs Change Healthcare unit in February that hit an estimated one-third of the country whose private data may have been exposed.
The FCC said it also has an ongoing investigation.
In March, AT& T said it was investigating a data set released on the âdark webâ and said its preliminary analysis showed it affected approximately 7.6 million current account holders and 65.4 million former account holders.
The company said the data set appeared to be from 2019 or earlier.

Class-action case says giant was negligent, left millions open to ID, financial fraud
AT&T now faces a legal fight after the phone numbers of over 100 million U.S. customers who used the companyâs wireless services between March and October 2022 were stolen in the companyâs second major data breach of 2024.
The case is a class-action lawsuit against the Dallas-based telecommunications giant, filed in the U.S. District Court for the Northern District of Texas late Friday by 15-year AT&T customer and named plaintiff Dina Winger.
The suit alleges AT&T wasnât transparent about the severity of the breach, didnât safeguard important data from malicious parties and earned âunjust enrichmentâ from customers after failing to protect their information.
âAs a direct and proximate result of AT&Tâs failure to exercise adequate and reasonable care and use commercially adequate and reasonable security measures, the [personally identifiable information] of Plaintiff and Class Members was accessed by ill-intentioned individuals who could and will use the information to commit identity or financial fraud,â the lawsuit reads.
âPlaintiff and Class Members face the imminent, certainly impending, and substantially heightened risk of identity theft, fraud, and further misuse of their personal data.â
AT&T declined to comment on the lawsuit.
Patrick Yarborough, a Houston-based lawyer representing Winger who helped file the case, confirmed Monday that this was the first lawsuit filed against AT&T in Dallas for the breach.
Should more plaintiffs sue the company, their cases could be lumped into Wingerâs class-action lawsuit.
Yarborough said he wouldnât be surprised if dozens more plaintiffs and law firms get involved in the future due to the scope of the data breach.
âThreat actorâ
AT&T revealed in a Securities and Exchange Commission filing on Friday that the cause of the breach was a âthreat actorâ who illegally accessed company workspaces on a third-party cloud platform in April.
The actor gradually siphoned nearly six months of call logs dating from May 1 to Oct. 31, 2022, as well as Jan. 2, 2023, compromising the phone numbers of nearly all AT&T customers.
AT&T said the breached channel is now closed and the stolen information isnât publicly available nor personally identifiable (through information like Social Security numbers, names or ages), but phone numbers can still be traced to individuals with easy-to-access online tools like Whitepages.
Wired reported Sunday that AT&T paid over $300,000 in Bitcoin to one of the hackers in May to delete the stolen data, which it confirmed with video evidence.
The hacker obtained the data by breaking into one of AT&Tâs cloud storage accounts hosted by software company Snowflake, Wired reported.
Snowflake also serves companies like Ticketmaster, Advance Auto Parts and international banking firm Santander. All
of those companies, plus roughly 150 others, were subject to breaches in April and May.
âLike most companies that deal with large amounts of data, we often use specialized and trusted cloud services platforms for various functions,â an AT&T spokesperson wrote in an email.
âThese platforms enable companies to work with large amounts of data in a centralized place. In this case, we had put a copy of the data on the third-party platform for analysis related to our business.â
Even if the primary dataset has been deleted, it remains unclear how many AT&T customersâ data is still vulnerable in unknown hands.
This has forced customers to protect themselves from identity fraud by freezing credit or closing financial accounts, among other time- and money-intensive measures, the lawsuit states.
The lawsuit says this puts an unjust burden on consumers who were guaranteed data security by AT&T, and warrants compensation.
âAT&T alone was, and is, in a position to protect against the harm suffered by Plaintiff and Class Members as a result of the Data Breach,â the lawsuit says.
Class-action benefits
Class-action lawsuits are the most popular and effective type of case when dealing with companies of AT&Tâs size or issues as wide-spanning as a data breach, said Carliss Chatman, an associate professor of law at Southern Methodist University.
This is because suing on behalf of a class of people rather than litigating on a case-by-case basis keeps costs down for both plaintiff and defendant and reduces logjams in the courts.
In this lawsuit, the proposed âclass membersâ include âall persons whose [personal identifying information] was accessed and/or acquired in the data incident.â
That means if the suit succeeds, any person who fits that definition is entitled to damages unless they opted out.
Establishing a class in cases like this where the harm â data theft â is clear is much easier than doing so in cases with many unique personal injuries, Chatman said.
âYou want it to be easy for a court to put a settlement matrix together. Thatâs your ultimate goal,â Chatman said.
The lawsuit defines its class as âall persons whose [personally identifiable information] was accessed and/or acquired in the data incident.â
Class definitions are one of the most finicky parts of class-action lawsuits and often one of the first things to be contested, Yarborough said.
Combined with lengthy meetings with courts, fellow plaintiffs, fellow law firms and, in this instance, AT&T representatives, the case could last years.
A trial is far less likely than a settlement for most class-action lawsuits, Chatman said.
Itâs possible AT&T would settle quickly if the class is certified to avoid a lawsuit from shareholders or intrusions by Federal regulatory agencies.
AT&T said in its SEC filing that it does not expect the breach to âmaterially impactâ its financial condition.
Potentially big payout Chatman said that because lawyers front the cost of âhigh-risk, high-rewardâ class-action lawsuits, their payout upon settlement is substantial â often more than a third of the total sum.
If a settlement is reached with AT&T and the class is large enough, clients and attorneys could bag a hefty take-home prize.
But she said the resolution to the lawsuitâs allegations doesnât have to only be money.
âIf we were to say this cost everyone $100 a person, or if they say something like, âWe want AT&T to pay for privacy monitoring, or to pay to freeze everyoneâs credit reports, or to pay for people to have a service that monitors their credit, their privacy, whatever, in addition to the cash,â courts can do that, too.â
Whatever the resolution, the scale of the breach means a quick, cheap and easy fix is unlikely.
âI think this is a pretty unique case, and so itâs pretty hard to say how much [AT&T] should be accountable for,â Yarborough said.
âIf youâre talking about as many as 100 million people, itâs hard to even talk about what a settlement or a verdict would look like. But let me tell you, itâs in the B-billions. No question.â

Apple confirms its plans to close retail stores in the patent troll-favored Eastern District of Texas
Apple has confirmed its plans to close retail stores in the Eastern District of Texas â a move that will allow the company to better protect itself from patent infringement lawsuits, according to the Apple news site MacRumors which broke the news of the storesâ closures. Apple says that the impacted retail employees will be offered new jobs with the company as a result of these changes.
The company will shut down its Apple Willow Bend store in Plano, Texas as well as its Apple Stonebriar store in Frisco, Texas, MacRumors reported, and Apple confirmed. These stores will permanently close up shop on Friday, April 12. Customers in the region will instead be served by a new Apple store located at the Galleria Dallas Shopping Mall, which is expected to open April 13.
Apple did not comment on the storesâ dates of closure or the new storeâs opening.
However, itâs common for Apple to leave little downtown during retail stores transitions â though most closures are related to renovations or other reasons that arenât about trying to escape patent lawsuits.
The Eastern District of Texas had become a popular place for patent trolls to file their lawsuits, though a more recent Supreme Court ruling has attempted to crack down on the practice. The court ruled that patent holders could no longer choose where to file.
Apple has had to make big payouts to patent trolls in recent years:Â $625.6 million to patent holding firm VirnetX in 2016 over protocol patents; VirnetX won $368 million from Apple in 2013; and more recently $502.6 million over four communication patents.
VirnetX tends to be referred to as a âpatent trollâ because it makes most of its revenue by suing tech companies. In addition to Apple, it sued Microsoft over patents in Skype and has been in litigation with Cisco. Its cases and subsequent wins are often held up as another example of how patent law in the U.S. is in need of reform.
The Apple store closures could have had a notable impact on area jobs, had Apple not offered new positions to its retail staff.
Apple today employs 1,000 people in the Dallas-Fort Worth area, which has been an increase of 33 percent in the past five years.
The company also recently invested almost $30 million in its Dallas area stores.
Outside the metro, Apple is also investing in Texas with its $1 billion for the new campus in Austin, which will accommodate an additional 5,000 employees on top of the 6,200 already in the area.
A rep for Apple confirmed the storesâ closures in a statement, but wouldnât comment on the companyâs reasoning:
âWeâre making a major investment in our stores in Texas, including significant upgrades to NorthPark Center, Southlake and Knox Street. With a new Dallas store coming to the Dallas Galleria this April, weâve made the decision to consolidate stores and close Apple Stonebriar and Apple Willow Bend. All employees from those stores will be offered positions at the new Dallas store or other Apple locations.â
