This case involves actor Michael Rapaport, who has appeared in many popular TV shows and movies. Apparently he’s edgy in real life, which he demonstrated through a CBS Radio show.
Barstool Productions “has cultivated its brand around providing ‘unfiltered,’ ‘controversial,’ crass, and sometimes humorous views on” sports and pop culture. Barstool poached Rapaport from CBS, and they entered into a “talent agreement.”
8 months into the relationship, it melted down. Rapaport took the bait from a Twitter user and disparaged Barstool’s fanbase for embracing the nickname “stoolies”:
(Remarkably, Rapaport didn’t pick on the “pole” misspelling. It pains me every time I see it).
Barstool fired Rapaport the next day by text (classy).
Rapaport escalated the matter. He still had the login credentials to Barstool’s Twitter account (oops–if you fire someone, IMMEDIATELY terminate their login credentials) and posted a video there calling Portnoy (Barstool’s founder) a “dumb motherfucker,” a “dumb fuck,” and a “bitch.”
In response to that and other provocations, “the Barstool Defendants published dozens of tweets, blog posts, online articles, videos, podcasts, and radio shows that accused Rapaport of being racist, a fraud, a hack, a wannabe, and a liar, having herpes, and stalking and beating his former girlfriend.”
[Unsurprisingly, the judge ran out of patience for these clowns. For example, she writes: “Rapaport’s [evidentiary] objections extend to documents that Rapaport himself produced in discovery. These objections are not well taken and, quite frankly, are borderline sanctionable.”

Talent Agreement Breach
The Talent Agreement contained a morals clause. Dafuq? Barstool hired Rapaport to sling garbage, yet the contract provides an immediate out if Rapaport brings himself or Barstool “into public disrepute”? (See a dispute over a similar clause). I wonder how aggressively Rapaport’s counsel negotiated that clause. At minimum, the clause should have established a baseline level of permitted disrepute. After all, Barstool built its brand around “controversial” and “crass” content, and Rapaport’s controversial and crass content is exactly why Barstool poached him. In any case, the court holds the issue of whether Barstool could exercise that termination basis over to trial.
Rapaport also alleged that Barstool didn’t try hard enough to procure advertisers for his “rant videos” (seriously, that’s what the court called them), as required by the contract. Again, dafuq? How many advertisers want to be associated with rant videos? (If you are such an advertiser, please contact me–I’d happily take your money). Barstool responded that advertisers weren’t interested because Rapaport was “very unpredictable” and used the C-word “incessantly.” This issue gets kicked to trial too.
Also…Rapaport used the C-word all the time and Barstool didn’t think that violated the morals clause? Instead, Barstool only became upset when Rapaport insulted the “intelligence” of an audience that was loyal to someone who routinely drops C-bombs?
Defamation
Rapaport claimed that the Barstool team said Rapaport is “racist,” a “fraud,” a “hack,” a “wannabe,” and a “liar.” (They also called Rapaport a “loser,” one of Trump’s favorite insults). The court says “these labels represent nothing more than the Barstool Defendants’ subjective evaluations of Rapaport that are incapable of being objectively proven true or false.”
Accusations that Rapaport had herpes and engaged in criminal conduct are capable of a defamatory meaning. The court responds:
audiences would readily recognize the challenged statements as representing the (often overtly biased) viewpoints of the Barstool Defendants…the statements were largely laden with epithets, vulgarities, hyperbole, and non-literal language and imagery; delivered in the midst of a public and very acrimonious dispute between the Barstool Defendants and Rapaport that would have been obvious to even the most casual observer; and published on social media, blogs, and sports talk radio, which are all platforms where audiences reasonably anticipate hearing opinionated statements.
For example, Barstool did a “diss track” where they said terrible things about Rapaport. The court says:
The tone and apparent purpose of the diss track reinforce for audiences that the video is not intended to reflect an accurate factual assessment of Rapaport. Exaggerated, vitriolic words and imagery pervade the six-minute-plus video to attack all aspects of Rapaport’s life, including his career, popularity, relationships, appearance, age, and legal troubles. For example, alongside the obviously hyperbolic statements that Rapaport identifies as defamatory are similarly sensational assertions that Rapaport is a “fucking 10 gallon drum of curdled milk,” a “walking blob of jizz,” a “snake-oil salesman with nothing to sell,” and a “puddle of pudding,” and that he looks like “Larry Bird’s mom’s sister,” or a “chemo Yertle the Turtle.” The video also suggests that Rapaport has such poor rap skills that the speaker would rather “get a spinal tap” or “go out to Neverland Ranch and sit in Michael’s lap” than listen to him rap.
I’m not sure why the comparison t0 Larry Bird and his family was unflattering. Larry Bird is a basketball hall-of-famer and a good-looking man. Plus, he has more class in his pinky finger than all of the litigants in this case combined. Also, Barstool fired Rapaport for bringing public disrepute onto them, but they are also fine calling someone a “walking blob of jizz”….seriously?
The diss track also included several photoshopped images:

The court says:
the context of this “diss track” video reasonably signals to viewers that the challenged statements are the prejudiced, opinionated viewpoints of the Barstool Defendants, not accurate factual assessments of Rapaport.
The court also says the Barstool team disclosed the basis of their “herpes” statement by showing these images:
Several times, the court vacillates between saying that the statements aren’t capable of defamation and saying the statements provided adequate support. To me, these photos suggest the Barstool team made a factual claim that Rapaport had herpes, but they provided their evidence supporting that claim, and that turned their characterization of the situation into non-actionable interpretation of the source data. It also negates actual malice. The court could have been more doctrinally precise here.
The Barstool team also made a “Fired Up” video. The court’s evaluation is similar to the diss track:
Just as no reasonable viewer would interpret the cartoon as asserting for a fact that Rapaport died as a result of having “Ding Dongs for Brains,” those same viewers would not understand the cartoon as factually asserting that Rapaport has herpes or that a lesion on his face speaks and serves as his producer.

while working on this blog post. This image reinforced why. Judy Collins’ song from the mid-1970s kept playing in my mind: “Send in the clowns. Don’t bother, they’re here.”
With respect to subsequent tweets, the court says “courts interpreting New York law have generally found that comments made on Twitter are more likely to be understood by audiences as statements of opinion than statements of fact” (citing, among others, Jacobus v. Trump). For example, the court says “Given that the escalating quarrel was apparent to anyone who came across the tweet, Clancy’s rejoinder that Rapaport is a ‘creepy herpes riddled failure’ is best understood as an intemperate epithet delivered in the heat of a series of charged personal attacks rather than as an objective factual observation that Rapaport is a failure, is creepy, and has herpes.” The court similarly says blog posts are viewed as typically the author’s opinion, citing Wexler v. Dorsey & Whitney.
Defamation Implications. I think the court’s approach reflects the modern jurisprudence of Internet defamation. Courts adjust their evaluation of fact-like statements to reflect the rough-and-tumble nature of online discourse. The more outrageous the claim, the more obvious that it’s hyperbolic. Other examples include LeBlanc v. Skinner (“terrorist”) and Finkel v. Dauber (bestiality accusations). In the heat of Internet beefs, courts apparently will let people say pretty much anything. I’m glad that defamation claims are hard to win online. I see too many thin-skinned plaintiffs using defamation to suppress truthful information. However, I wonder if defamation-free zones online have enhanced the coarseness of our discourse across our society. People say terrible things online and, sadly, find a market for it. I don’t think more law is the solution to that problem, but we can and should vote with our eyeballs to not reward people who produce trash content.
Closing note. Covering a beef like this brings me zero joy. I wanted all of the litigants to lose. Maybe they were actually well-matched for each other. As the maxim goes, you lie with dogs, you’re going to get fleas.

For example, Barstool did a “diss track” where they said terrible things about Rapaport. The court says:
The tone and apparent purpose of the diss track reinforce for audiences that the video is not intended to reflect an accurate factual assessment of Rapaport. Exaggerated, vitriolic words and imagery pervade the six-minute-plus video to attack all aspects of Rapaport’s life, including his career, popularity, relationships, appearance, age, and legal troubles. For example, alongside the obviously hyperbolic statements that Rapaport identifies as defamatory are similarly sensational assertions that Rapaport is a “fucking 10 gallon drum of curdled milk,” a “walking blob of jizz,” a “snake-oil salesman with nothing to sell,” and a “puddle of pudding,” and that he looks like “Larry Bird’s mom’s sister,” or a “chemo Yertle the Turtle.” The video also suggests that Rapaport has such poor rap skills that the speaker would rather “get a spinal tap” or “go out to Neverland Ranch and sit in Michael’s lap” than listen to him rap.

Design
The Fire TV Stick is just a hair wider than the previous model, at 3.4 by 1.1 by 0.5 inches (HWD), but otherwise looks identical. It's a plain black plastic rectangle with an HDMI plug on one end and a micro USB port on one side. As a stick intended to plug into the back of your television, it doesn't need to look impressive or have any real controls or display.

Fire TV OS
Amazon uses a heavily modified version of Android in the Fire TV Stick, the same as you'll find in all other Fire TV devices. As an Amazon product, Amazon Prime users get a lot of benefits baked into the Fire TV Stick, even before installing any apps. Videos on Amazon can be accessed directly from the stick's interface, so you can just jump into anything you want to watch (if it's on Prime). You can access Amazon Music Unlimited (which is $9.99 for a monthly subscription, or $7.99 with Prime) to stream plenty of music through your television and any connected speakers. You can also access a limited amount of free music through Prime.
Since it's still basically an Android device there are a few esoteric techniques for sideloading your own .apk files and installing any app you want (to varying success based on integration with the remote control and other factors). I installed Crunchyroll (before a Fire TV app was added to the store) without a problem, but when I launched the app it appeared as a portrait-format smartphone app and didn't display an onscreen cursor, making it unusable. It's also a clunky solution we wouldn't recommend for anyone who isn't confident in their technical abilities and knows their way around a command line, but it does offer some freedom not available with a Roku or the Apple TV.
Alexa and Voice Search
Any shortcomings in the Fire TV app store are made up for by the powerful voice assistant and search functions. By holding the Microphone button down on the remote, you can search for movies, shows, and apps simply by speaking into it (you can't use it hands-free my saying "Alexa," like you can with Amazon Echo products). Because it's connected to your TV and isn't simply a speaker like the Amazon Echo, the Fire TV Stick can give you visual information in response to your Alexa requests, like the Amazon Echo Show (but without the touch screen controls).
Alexa can search based on show and movie titles, actor and director names, and broad genres and themes (though the more vague your requests are, the less reliable the results will be). The voice search feature spans across 90 different apps and services including Netflix and Hulu, and the Fire TV Stick keeps track of any subscriptions you might have and front-loads search results to highlight content available on those services. Search results still lean toward Amazon's own on-demand and instant video libraries when they're available, but it's a handy and comprehensive way to look for anything you might want to watch.
Besides voice search, you can get useful information and even have the Fire TV Stick perform certain tasks with your voice thanks to Amazon Alexa integration (the same voice assistant used in the Amazon Echo, which really adds a lot of convenience that the voice search functionality on Roku devices doesn't offer. You can check the weather, find out sports scores, bring up Wikipedia information, and even add items to your shopping list. You can also add skills to Alexa for additional features, like ordering a pizza through Domino's. Third-party skills vary wildly in functionality and usefulness, but they really add to what you can do with the Fire TV Stick. Alexa also lets you control smart home devices with your voice. A wide variety of connected lights, locks, themostats, and other home automation equipment works with Alexa. Holding a button down and speaking into a remote isn't quite as convenient as the hands-free voice activation of the Echo devices, but it's still a useful way to bring down the lights when watching a movie, or adjusting the temperature of the house without getting up.
Voice recognition is excellent. Even with my voice sounding hoarse from a cold, the Fire TV Stick understood all of my requests. It brought up search results for Agents of S.H.I.E.L.D., Gundam, and Voltron with no issue, gave me a weather forecast for the coming week, and told me when the upcoming presidential debate would be. It's impressively accurate and responsive for a $40 streaming device.
Performance is aided in part by a quad-core processor that significantly speeds things up over the previous model. Navigating menus isn't quite as fast as it is with the 4K-capable Fire TV box, and the stick can only output up to 1080p video, but it's an appreciable upgrade (with a much more reasonable price than the Fire TV). I had no issue flipping between different apps and quickly loading movies and shows.
Like all media streamers, especially ones that only use Wi-Fi, video quality depends on the speed and signal strength of your network.
Comparisons and Conclusions
If you want 4K support and a slightly better selection of streaming media services, the Roku Premiere+ is our Editors' Choice for 4K media streamers—but it's more than twice the price of the Fire TV Stick.

The golden age of streaming sports isn't perfect, but it's still damn good
As the air turns colder and we approach the holidays, we also find ourselves knee-deep in one of the best times of the year for sports: The NBA and NHL are in full swing, college basketball is getting warmed up, college football is barreling toward Bowl Season, and the NFL season is getting hot as teams position for the playoffs. Plus, there's soccer and any number of other winter sports to catch should you be so inclined.
Thankfully, it seems that sports streaming has finally caught up to our needs.

Yes, we now live in an era when it's possible to keep track of all the important games as you're on the go between shindigs and holiday concerts. The advent of streaming sports has made it possible to never miss a moment instead of languishing in a bubble of, well, NO SPORTS.
What a time to be alive.
Out of the stone age
Watching a crystal-clear stream of almost any sporting event I could want on my phone is a far cry from the first — and only — way I encountered watching sports live on the go before the "streaming revolution."
That would be via the Sony Watchman, a brick-sized device that could tune in TV stations using an antenna to a screen that, in retrospect, seems barely the size of a postage stamp.

I remember looking over a friend's shoulder and squinting real hard to make out a college football game while on a school trip in the mid-1990s. Besides the small screen, we had to contend with the fickle nature of the antenna signal, which became even more fickle as we traveled miles and miles, going in and out of range.
Given the size of phone screens and the ability to stream in high definition on said phones, it feels like the Watchman is a relic of a long ago time, as old as the black-and-white television. But the product was around deep into the 1990s, only being discontinued in 2000.
That shows how quickly things have evolved in the 16 years since Major League Baseball offered their first-ever online stream of a baseball game. What was described as a "too choppy and too fuzzy" experience has given way to high definition streams of every baseball game at your fingertips.

Hell, the last two years alone have brought rapid evolution. In December 2016, I wrote about how streaming services still left much to be desired. Now I'm cordless, relying on an over-the-top (OTT) subscription and some league-specific subscriptions to bring me more sports than I could possibly watch to just about every platform I could imagine.
And it's paid off, giving me the chance to stay up to date and in the loop with the most important live sports events, no matter what family gathering or wedding reception I may find myself at.
Earlier this year, I was at a Major League Baseball game. A few of us split our attention between the live game in front of us and the perfect HD stream of a live NBA playoff game on someone's phone.
What a time to be alive.
The last stand of DVR-proof programming
The leaps in technology and the ease with which one can stream sports are certainly huge factors in why it's exploded. But just as important is the fact that sports remains the last bastion of DVR-proof programming.
For all the hand-wringing over, say, not being able to watch a Game of Thrones episode live, it's still possible to watch the episode hours after airing. It just takes a little self control to stay off social media and the internet.
But sports is still that ephemeral entertainment, something very much of the moment. As soon as a game is done, the analysis has started, and the cycle for the next match-up is already underway. Results are, literally, news: No one is going to hedge on sharing an NBA final because of a "spoiler alert."

Besides, experiencing these moments together as they happen is part of what makes sports a worthwhile pastime, even in this new digital age.
A 2016 study by the The Center for the Digital Future at USC Annenberg found that 90% of fans were willing to pay something for access to sports, while nearly two-thirds would pay for an over-the-top subscription. The study also confirmed that mobile devices were becoming more popular in how sports are watched, especially among younger viewers: "65% of GenZ and younger Millennial fans are consuming sports content on a mobile device."
Ratings site Statista found very similar results, showing 63% of sports viewers ages 18 to 24 watched on "non-TV platforms" while over half of viewers age 25 to 34 did the same. And ESPN saw a healthy uptick in numbers when they started including streaming in their overall ratings measurements.
The bottom line: If you offer it, people will want it. There's no waiting around to watch a ball game later.
How to enjoy it
The first step, of course, is access. To view anything is going to cost you money. But if you subscribe to either cable or an OTT service like Sling or YouTube TV, you've cleared a big obstacle. While options vary by provider and by each provider's subscription tiers, you'll find most sports channels widely available to watch on your mobile device using your subscriber login.
All four major sports leagues here in the United States — the NFL, NBA, NHL, and MLB — have stand-alone apps that offer various subscription levels for following action all year long. For soccer fans, there's also the Premier League Pass and subscription add-ons like Fox Soccer Plus. And new digital streaming platform Stadium is starting to gain a little traction with its own pay platform.
Plus, ESPN has finally launched its stand-alone ESPN Plus service, which includes access to tons of college sports, MLS and NHL games, and a deep library of documentaries and other programming (though not live streams of the official ESPN channels themselves).

But there are still free options! In an effort to keep audiences engaged and using their platforms, social media companies like Twitch, Facebook, and Twitter have begun adding sports streams. Both Facebook and Twitter have deals with Major League Baseball, and each has its own soccer deal: Facebook streams the Premier League in Asia and the Champions League in Latin America, while Twitter struck a deal with MLS.
And, of course, there's Amazon and their rights to the NFL's Thursday Night game for Prime subscribers, a highly coveted package that the company gained after out-bidding Twitter and YouTube. It's another example of how the NFL, as it battles headlines about declining TV ratings, is shifting its focus to streaming.
More options exist, far too many to list all of them. But streaming has become such an ubiquitous part of how we consume sports, teams and publishers include "how to stream" as part of their regular promotional efforts.

In 2018, it's pretty hard to not find a way to stream the sporting event of your choice straight to your mobile device.
The blackout problem
Of course, no system is perfect, and neither is the world of sports streaming. The biggest thing to be aware of is blackouts. While the outdated concept of the television blackout — not airing a team's home game in their local market — is meant to drive fans to actually attend the games, digital blackouts are a different beast.
If you've got a cable or an OTT subscription, you're probably OK, provided that OTT subscription includes the regional TV channels airing the games. But without those options, it gets a lot tougher.
Stand-alone subscription packages offered by the NBA, NHL, NFL, and MLB all black out in-market teams, leaving local fans in the dark or to find more nefarious means of viewing.
These digital blackouts are because the local stations paid a boatload of money for rights to your local team's game, and they want to make sure they keep eyeballs on their channels. The leagues don't really mind, because they're pocketing the money anyway.
Adding insult to injury for some fans is that fact the the leagues, particularly MLB, can make those markets notoriously far-reaching and frustrating. For example, Iowa is considered a blackout zone for six different teams (Chicago Cubs, Chicago White Sox, Kansas City Royals, Milwaukee Brewers, Minnesota Twins, and St. Louis Cardinals), meaning none of those teams are available via the MLB.TV app; you have to pay for a cable subscription to see the games of any of those teams.

And there are a handful of MLB teams, like the Baltimore Orioles and Washington Nationals, that are impossible to find on any streaming service thanks to those regional channels who really, really want to restrict viewers to simply watching on TV.
Tech hurdles also remain
Besides access, the biggest issue with sports streaming is, well, the streaming part. Without decent coverage, you're not going to have the data to actually stream the event, something that might be a particular issue while traveling. It's the Watchman antenna struggle all over again.
If there's good news here, it's that data coverage across the country is increasing, as are ways to grab a wifi signal. That said, even with good connectivity, it's pretty easy to blast through data limits if you don't have an unlimited plan.
And yet, despite these issues, things are still as good as they've ever been. The quality and cost of services are improving, and availability is more widespread, especially as it becomes clear that streaming everything is our eventual destination.
Meanwhile, old Watchmans rust away in basements across America, a forgotten reminder of a dark time when we didn't have nearly every sporting event available with just a few taps.
