Parliament passes Bill restoring States’ right to maintain OBC lists
Parliament on Wednesday passed a constitutional amendment aimed at restoring the rights of the States and the Union Territories to maintain their own list of socially and educationally backward classes (SEBCs), commonly known as Other Backward Classes (OBCs).
The Constitution (One Hundred and Twenty-Seventh Amendment) Bill, 2021 was passed unanimously by the Rajya Sabha, a day after the Lok Sabha passed it. In a break from its protests on the Pegasus issue and farm laws, the Opposition joined the discussion and supported the Bill. While the Bill received support from across party lines, at least 10 parties, including NDA’s Janata Dal (United), called for a caste-based census and 12 parties demanded the removal of the 50% cap on reservation.
Maratha reservation
On May 5, the Supreme Court held that the Maratha reservation granted by the Maharashtra government was unconstitutional and that the President alone was empowered to identify SEBCs. In his response to the discussion on the Bill, Social Justice and Empowerment Minister Virendra Kumar said the government understood the concerns over the 50% cap and that it should be revisited as it was decided 30 years ago.
From the Opposition, Congress leader Abhishek Manu Singhvi was the first speaker. He said the government was congratulating itself for correcting a mistake it made in 2018, referring to the 102 Constitutional Amendment that said the President, in consultation with the Governor, would notify SEBCs. The select committee had pointed out that the language of the Bill could be open to misinterpretation. This Bill was an empty promise since there was a cap of 50% on reservation and this cap couldn’t be changed till the caste census was done to reveal the actual numbers, he stated
“Why are you running away from a caste census? Your Chief Minister in Bihar, another Chief Minister in Odisha and your woman MP said you are going to do this. Why is the government keeping quiet today” he asked.
Plea for caste census
The Samajwadi Party’s Ramgopal Yadav forcefully argued for a caste census. He said there was a speculation that the Yogi Adityanath government of Uttar Pradesh would delist Yadav, Gujarat and Kurmi from the backward list. The BJP government, he said, was not bringing in the caste census only so that it could amend the backward list as per its wishes. There was need to raise the 50% cap on reservation, he observed.
The RJD’s Manoj K Jha said the speech by BJP’s lead speaker in the Lok Sabha Sanghamitra Maurya was no “Freudian slip”. “Every person who thinks for the welfare of the backward classes will make this demand,” he noted. The entire Bihar Assembly, he stressed, had sought time from Prime Minister Narendra Modi to urge him to bring caste census. “It is essential to know who are the ones who are forced to come to the cities looking for minor jobs? Who are the people who have to lift mud to earn a living.”
The TMC’s Derek O’Brien said the Bill was a result of incompetence of the government. “This government is not in the habit of listening to anyone. When legislation on GST was brought in, the Opposition had warned against the possible problems in its implementation. He added, “376 changes were made in GST!”
Shiv Sena member Sanjay Raut welcomed the Bill, but said it was incomplete, as the issue of 50% cap on reservation was not addressed.
The CPI’s Binoy Viswam said he supported the Bill, but opposed the “government’s politics”.
Former Prime Minister and JD(S) member H.D. Deve Gowda welcomed the Bill. He asked the government to see that reservation for women, which he had moved in his tenure, was provided.
Leader of the Opposition Mallikarjun Kharge also appreciated the Bill, but said it was unfortunate that the discussion in the House had been less about the Bill and more about “what Modiji did and what Nehruji did”, referring to attacks on the Congress by the treasury benches. “You must remove the 50% cap if you want to implement this. Just add one sentence that the States can give reservation over 50%. That will solve the problems,” he added.

The Lok Sabha on Tuesday passed the Constitution 127th Amendment Bill, 2021 with unanimous support from the House, and with this, the Lower House is expected to be adjourned sine die today.
The Rajya Sabha witnessed extraordinary scenes on Tuesday, with Opposition members, majority of whom dressed in black or sporting black bands, clambered onto the table in front of the Chair, protesting against the government for trying to push through a diluted debate on the farmers’ issue instead of going for a repeal of the three controversial farm laws. The protests are expected to continue today in the Upper House.

In the last session, the government 10% reservation for EWS over and above the existing system. Will the cap now be 60% now, he seeks clarification.
He says during his tenure, Rajya Sabha approved women reservation. It should be brought to Lok Sabha.
Karnataka provides 23% reservation to OBCs. Within that Muslims are also included and there was no opposition. Let the government clarify if such a reservation is possible after this Bill is passed.

Education Minister Dharmendra Pradhan lauds the House for a constructive debate. Some members questioned the language of the 102nd Constitutional Amendment Act. It was drafted by the Select Committee. The then Minister had clearly said there will be two lists — one for state, one for Centre.
This is not a knee jerk reaction of our government. Noone should doubt our intention. Some members of DMK raised IITs were not following reservation. It was a news for me. Then we found out the reservation lapses if the vacancy was not filled up. Mr. Modi ensured the reservation does not get lapsed, he says.

Congress brought reservation for OBCs in Madhya Pradesh. The subsequent BJP governments didn’t take it up and the Supreme Court struck it down. Whereas Tamil Nadu fought well and ensured 69% reservation continues there, he says.
He seeks change in the roster within reservation with binary roster. Even animals are counted, why can’t OBCs be counted, he asks pitching for caste cesnsus. He also seeks reservation in promotion. Meritorious people should not be included in reservation but should be alloted in general category, he says.

Manoj Jha (RJD) terms it a historical moment when the House is unitedly supporting a Bill. He remembers former member and writer Tulsiram, a Dalit who faced discrimination while he was in school.

Mr. O’ Brien recalls that the government did away with reservation to Anglo-Indians based on a census that wrongfully said Anglo-Indian community comprises only 200 people.

Sushil Kumar Modi says a review petition was filed by the govt. withing 8 days of the judgment by the Supreme Court. “We have brought this Bill early, unlike Mr. Singhvi’s insinuation, as soon as our review petition was rejected.”
Quoting from the minority judgment Of Justices Bhushan and Najeeb, Mr. Modi clarifies the legislative intent of the Bill. Our intention was not to deprive the States, he says, adding the Supreme Court misinterpretated.
He says, “we supported the V.P. Singh decision of giving the OBC reservation. We gave constitutional recognition to Scheduled Tribes Commission. What did the Congress do?”

The wrong of 2018 being rectified, Bill long time coming: Singhvi
Abhishek Manu Singhvi of the Congress, says, “The path to hell is paved with good intentions. The Bill was a long time coming. But I also want to point out that the government is only correcting its big mistake of 2018.” Mr. Singhvi was making a reference to the 102nd amendment made in 2018.
The government committed a mistake and the government is congratulating itself for rectifying it now, he says.
An amendment was proposed in this House, many MPs also made some suggestions when it was sent to a select committee for recommendations, he says.
He says, “as feared, the Supreme Court faltered in the interpretation of the ambiguous language of the legislation.”
Speaking about the Maratha reservation issue, Mr. Singhvi says, the 50% cap on reservation cannot be followed as a strict rule. He gives the examples of States like Nagaland and Tamil Nadu which have more than 50% reservation. “The Supreme Court will not reconsider this. So, the government has to, and make the change.”
Mr. Singhvi brings up OBC seats lying vacant ingovernment employment.
He asks why Caste Census is being done away with. “We did it in 2011. Why not do it now in 2021?”
Suggesting an amendment to the Bill, Mr. Singhvi says, “This amendment is clarificatory. But unless it is applied restrospectively, no State list between 2018 and 2021 will be valid.”

Allow discussion for more than three hours: Kharge
Manoj Jha asks the Speaker to allot sufficient time even for the smaller parties, who have equal stakes, to speak about the “important amendments” suggested in the Bill.
Leader of Opposition Mallikarjun Kharge tells the Speaker, he has the power to change the decision taken by the Business Advisory Committee. “No one is going to oppose this Bill…Even if the discussion time is increased by two or three hours, the country or the House will not be at a disadvantage.”
Minister Piyush Goyal suggests that the House sit until all the day’s business is completed, even beyond 6 p.m. “If we need to increase the discussion to beyond three hours, then we need to be on agreement to this.”
Member Anand Sharma says, “It is not acceptable that the extension is conditional.”
Mr. Goyal responds and restates that the day’s business will have to be completed, and “it is only fair that we agree to sit beyond 6 p.m. for it.”

20 Bills passed this session, only OBC Bill passed after discussion
At a press conference after the adjournment of the Lok Sabha, Speaker Om Birla said it pained him that the Lok Sabha didn’t function smoothly this monsoon session.
“The House functioned for only 74 hours and 46 minutes. The total productivity was 22%,” he said.
A total of 20 Bills were passed in the session, of which only the OBC Bill was passed after discussion. The remaining Bills were passed in din without discussion, through voice vote.
“I always expect the MPs to maintain the dignity of the House. There have been debates, agreements and disagreements in the House but its dignity was never lowered,” he said.
Urging all MPs to follow the Parliamentary traditions, Mr. Birla said sloganeering and raising of placards are not a part of these traditions.

Venkaiah Naidu expresses anguish over yesterday’s events
Chairman Venkaiah Naidu calling the actions of some members as “acts of sacrilege”, says “I have no words to express my anguish and condemn the actions of yesterday. I slept a sleepless night.”
Mr. Naidu got emotional and said he was distressed to see the sacredness of the House being destroyed over a difference of opinion. “I am distressed as the way this sacredness was destroyed yesterday when some members sat on the table some others climbed on the tables of the house, perhaps to be more visible, was an act of sacrilege. I have no words to condemn the act as I spent a sleepless night,”
When a discussion on agriculture was listed in the list of business for the day, the opportunity was not taken by the members to air their grievances. “Even a discussion on the farm laws could have been taken up,” he says, expressing his displeasure and “anguish” over the last day’s events.

NEW DELHI: Farmer unions opposed to the central farm laws on Thursday rejected the government’s proposal to put implementation of the legislations on hold and decided to stick to their demand of “repeal of laws” as a condition to end their protests. The farmers are expected to convey this to the government during the 11th round of talks on Friday. During the 10th round of talks on Wednesday, the government offered to suspend the implementation of the contentious farm laws for up to 18 months and form a joint committee with farmer unions. It proposed that discussions would continue during this period so that a final solution could be worked out on all demands, such as repeal of the laws and legal guarantee on the minimum support price (MSP). In order to assure the unions that it would not backtrack from its assurance, the government also promised to submit an affidavit in this regard in the Supreme Court. However, the assurance failed to win the trust of the farmer unions. Though a section within the group of 40 unions was willing to give the government’s proposal a chance if the Centre agrees for putting the laws on hold for an indefinite period or for a longer period beyond 18 months, there was no consensus on this when they met to take a call on Thursday and therefore decided to reject it after their marathon meeting. Announcing the decision, the umbrella body of the unions, Samyukta Kisan Morcha (SKM), referred to sacrifice of 143 farmers who had lost their lives in this movement and said, “Their sacrifice will not go in vain and we will not go back without the repealing of these farm laws.” Noting the unanimous decision of the general body meeting of the SKM, farmer leader Darshan Pal of Krantikari Kisan Union said, “A full repeal of three central farm acts and enacting a legislation for remunerative minimum support price (MSP) for all farmers were reiterated as the pending demands of the movement.” “In the meeting with the government on Friday, we will demand repeal of the laws and legal guarantee to MSP,” said farmer leader Joginder Singh Ugrahan of Bhartiya KIsan Union (Ekta-Ugrahan). The general body of the SKM also decided to go ahead with the farmers’ Republic Day parade on Outer Ring Road in Delhi. Though Delhi and Haryana Police have, so far, not given them permission, the unions insisted on it saying no one can stop them from holding a peaceful march inside the Capital. Though the SKM has time and again denied having any direct contact with political parties during the ongoing protests, a few union leaders during the general body meeting are learnt to have noted how the opposition political parties have come forward to make this a pan-India movement. Thus, the leaders felt there was no point in compromising with the core demands at this juncture when the government appears to be on the backfoot. Political parties in states have openly come in support of the farmer protests. “A non- political agitation is now gaining support of political parties, specifically Samajwadi party in Uttar Pradesh, Shiv Sena and NCP in Maharashtra and RJD in Bihar. It will add political dimension to the protests during the budget session of Parliament,” said Sudhir Panwar, agriculture expert and former Planning Commission member of UP. Meanwhile, the Supreme Court-appointed committee on Thursday initiated consultations with farmer organisations of eight states — Kerala, Karnataka, Madhya Pradesh, Maharashtra, Odisha, Telangana, Tamil Nadu and Uttar Pradesh — through video conference and heard them on various issues relating to the farm laws. Ten out of 20 groups shortlisted on the first day of consultation joined the meeting virtually. These organisations are connected with the All India Kisan Coordination Committee (AIKSCC) – an umbrella body of pro-farm laws. All three committee members — Anil Ghanwat of Shetkari Sanghatana and agriculture experts Ashok Gulati and P K Joshi – attended the consultations and urged the participants to extend their free and frank opinion.

On the eve of the upcoming Budget Session of Parliament, sparks flew at the customary all-party meeting on Thursday over the Citizenship (Amendment) Act, or CAA, and the National Register of Citizens (NRC), according to people present, indicating that the session is likely to see a slew of protests and disruptions.National Democratic Alliance (NDA) ally Shiromani Akali Dal, and the government’s steadfast supporter the Biju Janata Dal (BJD), turned the heat on the Bharatiya Janata Party (BJP) at the meeting, the people added, asking not to be identified. Akali leader Balwinder Singh Bunder said that the government should not pass any legislation that divides people, referring to the CAA without taking its name. And, in a reference to states not yet having received their share of money raised from the Goods and Services Tax for the past four months, BJD floor leader Pinaki Misra alleged that the Centre is not paying states their due and forcing them come to Delhi with a begging bowl.Prime Minister Narendra Modi, who joined the meeting midway, urged parties to discuss how India could harness the global situation to improve its economy. He also said that the government is ready to answer all issues in the House. Parliamentary affairs minister Pralhad Joshi announced that the government intends to bring 45 bills and two ordinances — on insolvency and coal mining — apart from seven financial bills in the Budget Session.The session starts on Friday in the backdrop of the continuing, widespread protests against the CAA. The CAA, passed in December in Parliament’s Winter Session, fast tracks the citizenship process to non-Muslim refugees from Pakistan, Bangladesh and Afghanistan who arrived in India before 2015. The Opposition-ruled assemblies of Kerala, Punjab, Rajasthan and West Bengal have already passed resolutions in their assemblies demanding the scrapping of the law, which has already been challenged in the Supreme Court. Opponents of the law insist it is discriminatory and unconstitutional because it leaves out Muslims and links faith to citizenship in a secular country. They say it could result in the expulsion or detentions of the Muslims unable to provide the documentation if the law is seen in the context of the proposed pan-India National Register of Citizens (NRC). A process to identify undocumented immigrants in Assam led to the exclusion of around 2 million people from the NRC last year. The government has since clarified there are no immediate plans for a pan-India NRC.Politicians across opposition parties said they will launch an “all-round” attack on the government on citizenship issues, lack of jobs and the state of economy. Almost all opposition parties, except the All India Anna Dravida Munnetra Kazhagam, demanded at the meeting that political leaders detained in Kashmir be released. Rashtriya Janata Dal (RJD) MP Manoj Jha tweeted, “The entire focus was on CAA protests, unemployment and the release of political detainees from Jammu and Kashmir.” The economy grew at 4.5% in the three months to September 2019, the lowest since March 2013. He also said that the “new BJP” would not understand the difference between majority government and majoritarian government. National People’s Party (NPP) leader Agatha Sangma demanded that north-east India should be exempted from CAA and NRC.In his concluding remarks, Modi welcomed the suggestions that the session should focus on the economic situation. “In this Budget Session, and in the beginning of the new year, if we can give a proper direction to the country’s economy it would be in the best interest of the country,” he said. Modi also added that “there should be an open discussion on all such issues”, while asking members for increasing the productivity of Parliament.The first two sessions of this house have been very productive. The Lok Sabha utilised 135% and 115% of its time in the Budget Session and Winter Session respectively. The Rajya Sabha, too, has utilised its full time for two consecutive sessions.Lok Sabha Speaker Om Birla called another all-party meeting on Thursday evening. He said, “All party leaders have assured that the House will run without disruptions. The House belongs to the people and so the House must run smoothly.” He said members cutting across party lines will be given sufficient time to speak on all issues.The Budget Session will end on April 3. The survey results also show that remaining 77 percent are still vulnerable and the containment measures need to continue with the same rigour, National Centre for Disease Control director Dr Sujeet Kumar Singh, told a press briefing. India doing relatively well, says Centre Amid the rising cases, Rajesh Bhushan, officer on special duty in the Union health ministry, told a press conference in Delhi, that 30 states and Union Territories have COVID-19 positivity rate lower than that of the national average which stands at 8.07 percent. According to PTI, stating that some states are doing more than 140 tests per million, Bhushan, said that the number of tests per million have to be brought down to a level of 140 tests per day per million, so that the "rate of positivity reduces and comes down to 10 percent first and then continue the testing process so that the rate of positivity further reduces to 5 percent or lower". The health ministry official also said that the COVID-19 deaths per million population in India stand at 20.4 per million which is amongst lowest in the world, Bhushan said. "We had been successful at the beginning in controlling the COVID, but in recent days especially in Bengaluru the COVID cases have increased.....I want to tell the people of the state that for the control of the virus, lockdown was not the solution. In the meanwhile, amid reports of black marketing and haording of Remdesivir, a drug used in the treatment of coronavirus infected patients, Karnataka's COVID-19 task force on Tuesday decided that the state government will regulate its supply to private hospitals. "Remdesivir which is currently available in the government hospitals will be supplied to private hospitals through the government. This will help curb black marketing of this drug," Medical Education Minister K Sudhakar's office said in a release. The government has also fixed the rate for COVID-19 tests in private labs at Rs 2,000 for government referred cases and 3,000 for self-reporting cases. Uddhav Thackeray led Maharashtra Vikas Aghadi coalition cleared the trust vote in Maharashtra assembly on Saturday but not before a dramatic intervention by the BJP at the start of the day’s proceedings and a subsequent walkout over alleged violation of established norms by the new government.As the assembly session began former chief minister Devendra Fadnavis raised three objections to the circumstances surrounding the trust vote and urged the pro-tem speaker to set things right before proceeding further.In his first point, Fadnavis said only Governor had the right to call the session for the trust vote and since no such order was issued by the Raj Bhavan, the validity of the session itself was under a cloud.“We were informed about the session at midnight. Government wanted to keep our members away from it,” Fadnavis said at one point.In his second point of order, Fadnavis said the correct procedures demanded the trust vote is conducted by a regular speaker and not a pro-tem speaker and sought a speaker is elected first. He added that coalition’s decision to change the pro-tem speaker was both unprecedented and illegal.“It has never happened in the history,” Fadnavis said. The ruling alliance replaced BJP’s Kalidas Kolambkar with NCP’s Dilip Walse Patil as the protem speaker ahead of the trust vote.In this third major point, Fadnavis questioned the validity of the oath taken by chief minister Uddhav Thackeray and his six ministers on November 27. He alleged the oaths were not taken as per constitutional guidelines.BJP had earlier today said it would petition the Governor over Chief Minister Uddhav Thackeray and his six ministers invoking names of party leaders, freedom fighters, Maratha king Shivaji etc “against the constitutional norms”, while taking oath. BJP also asked why Vande Matram was not played as per the tradition at the beginning of the proceedings. The pro-tem speaker said since the swearing in didn’t take place in the assembly, objections over it couldn’t be entertained in the House. On the issue of a pro-tem speaker presiding over the trust vote, he said it was in accordance with the Supreme Court order.The BJP walked out soon after, leaving the floor for the coalition to pass the trust vote without any hindrance. 58 more Vande Bharat Mission flights to land in Tamil Nadu, Centre tells HC
The Centre on Wednesday informed the Madras high court that 58 more Vande Bharat Mission flights are scheduled to land in Tamil Nadu returning stranded residents of the state from across the globe due to the COVID-19 induced lockdown.
"Of them, 41 will land in Chennai, 11 in Trichy, 4 in Coimbatore, and 2 in Madurai," additional solicitor general of India R Sankaranarayanan said. Recording it, a division bench of Justice M M Sundresh and Justice R Hemalatha cited a report published in an English daily. According to the article, three flights from Dubai and Abu Dhabi were reported to have landed in Chennai empty as there were no passengers to take the flights.
To this, senior advocate P Wilson representing DMK said that travel agents are booking the whole flight and later selling the tickets at high rates. Wilson further submitted that only because of court intervention more Vande Bharat Mission flights were provided which helped all the stranded passengers to reach their destinations till today.

Jharkhand BJP MLA CP Singh on Wednesday said he has been infected by coronavirus. In a tweet, the former state minister said he tested positive for COVID-19 and asked those who had been in touch with him recently to test their swab samples.
The senior BJP leader, who is in home isolation, also said that he would send a list of people whom he had met to the administration.
Singh is the third legislator in the state to have been detected with the highly infectious disease.

Mother, five sons die of coronavirus in Jharkhand
According to media reports, six members of a family have died due to COVID-19 in Katras in Jharkhand's Dhanbad district. The deceased include an 88-year-old woman and her five sons who died between 4 to 20 July. Now, the lady is survived by her only son who stays in Delhi.
The 88-year old lady, had come to Dhanbad to attend the marriage of her grand-son on June 27. She was admitted to a private hospital in Bokaro after she fell ill and died after her condition deteriorated further on 4 July, reports New Indian Express.
She tested positive after her sons performed the last rites following all customs and traditions. Soon, all the five brothers (falling in the age group of 60-70 years), who had taken part in her last rites, too succumbed to the deadly virus one after another.

Coronavirus LATEST Updates: Kerala chief minister Pinarayi Vijayan on Wednesday said a complete lockdown could be imposed in the state again as over 1,000 new cases of coronavirus were reported for the first time on Wednesday.
"We had previously implemented a complete lockdown in the state. We are aware of such viewpoints (complete lockdown).Although it has not been decided yet, I think we will have to consider it," he said.
The Manipur government will impose a "complete" lockdown in the state for 14 days, starting from 2 pm on Thursday, ANI reported.
Himachal Pradesh chief minister Jai Ram Thakur on Wednesday said he was going into self-quarantine after a deputy secretary in his office tested positive for coronavirus on Wednesday, PTI reported.

India recorded 37,148 COVID-19 cases in the last 24 hours, pushing its tally to 11,55,191 , while the total number of recoveries increased to 7,24,577, according to the Union health ministry's data issued at 8 am on Tuesday.
The toll due to the disease rose to 28,084 with 587 fatalities reported in a day, the data showed.
Of the total cases, based on the health ministry's figures, Maharashtra, the worst-affected state by the pandemic, alone accounts for nearly 27.5 percent, followed by Tamil Nadu (15 percent) and Delhi (10.7 percent) cases. These three states together account for more than half of India's total case load.
On Tuesday, Maharashtra's COVID-19 tally rose to 3,27,031 with the addition of 8,369 new cases, while 246 more patients succumbed, taking the fatality count in the state to 12,276, health department said.
Whereas in Tamil Nadu, 4,965 people tested positive on Friday, taking the infection count past the 1.80 lakh. Tamil Nadu on crossed 20 lakh in samples screened so far.
The state recorded 75 fresh COVID-19 deaths, including that of a 56-day old boy, during the day, taking the toll to 2,626, a health department bulletin said. The state has 51,344 active cases out of the total 1,80,643.
Delhi recorded 1,349 fresh COVID-19 cases on Tuesday, taking the caseload in the city to over 1.25 lakh, while the death toll mounted to 3,690 after 27 fatalities were recorded, authorities said.
The number of active cases stood at 15,288, marginally up from 15,166 on Monday.
Amid the rising cases, the Shri Amarnath Shrine Board (SASB) on Tuesday decided to cancel this year's pilgrimage to the 3,880-metre-high cave shrine in south Kashmir Himalayas.
India's COVID-19 fatality rate, however, has dropped significantly to 2.43 percent from 3.36 percent on 17 June, the Centre said on Tuesday, asserting the country has handled the pandemic "relatively well".
There are 4,02,529 active cases of the coronavirus infection currently in the country, while 7,24,577 people have recovered till now. Thus, 62.72 per cent people have recovered so far, the ministry said.
In the meantime, the National Green Tribunal Tuesday said that segregation of COVID-19 waste from others is a must to avoid further contamination adversely affecting public health.
Nearly a quarter Delhiites affected with COVID-19, finds sero survey
Amid the rising cases, the results of a sero-prevalence survey in Delhi showed that 23.48 percent people in the National Capital had developed antibodies for COVID-19 with experts stating that the National Capital is still far from herd immunity against the coronavirus.
The survey results also show that remaining 77 percent are still vulnerable and the containment measures need to continue with the same rigour, National Centre for Disease Control director Dr Sujeet Kumar Singh, told a press briefing.
Delhi has a population of nearly 2 crore. Eight out of Delhi's 11 districts have more than 20 percent of sero prevalence, Singh said.
A senior Delhi government official said the government will consult with public health experts and epidemiologists to determine if the future course of Delhi's strategy against COVID-19 should change in light of these survey results or not.
The sero survey was conducted from 27 June to 10 July, during which a total of 21,387 samples were tested by the NCDC in collaboration with the Delhi government.
Cases from states
Meanwhile, coronavirus cases in Gujarat crossed the 50,000 on Tuesday with a highest one-day spike of 1,026, around 300 of them from Surat district, the health department said.
The coronavirus death toll rose to 1,229 in Uttar Pradesh after the state reported 37 fatalities, a statement issued by the state government said on Tuesday. With as many as 2,128 fresh COVID-19 cases, the state's infection tally reached 53,288.
Kerala on Tuesday reported 720 fresh cases of COVID-19, taking the number of infected people in the state to 13,994, while 1,62,444 people are under observation in the state.
Of the new cases, 528 were infected from their contacts, Chief Minister Pinarayi Vijayan said.
The state of Madhya Pradesh recorded 785 new COVID-19 caseson Tuesday, taking the state-wide infection count to 24,095, while 18 more patients succumbed to the disease, health department officials said.
With 18 more people succumbing to the viral infection on Tuesday, the death toll went up to 756, they said.
Of them, four fatalities each were reported from Bhopal and Indore, while one each patient died in Morena, Jabalpur, Sagar, Ratlam, Dhar, Barwani, Datia, Hoshangabad, Jhabua and Guna, the officials said.
Among the new cases, the highest 149 cases were reported from Bhopal, followed by 72 in Raisen, 70 in Indore, 62 in Morena and 49 in Gwalior, they said.
Jammu and Kashmir saw 608 new COVID-19 cases on Tuesday, raising the tally in the Union Territory to 15,258 as nine fresh fatalities pushed the death toll to 263, officials said.
"Nine persons, who were COVID-19 positive, have died over the past 24 hours in Jammu and Kashmir," they said, adding all the nine deaths took place in the Kashmir Valley.
In Goa, COVID-19 cases crossed the 4,000 with the state now having 4,027 positive cases as on Tuesday with 174 new detections, the state Health department said.
The COVID-19 tally in Manipur crossed the 2,000-mark, with the detection of 90 new cases on Tuesday, a Health department bulletin said.
The coronavirus death toll in Himachal Pradesh increased to 11 after a 75-year-old woman died in Mandi on Tuesday as 33 fresh cases surfaced, taking the state's infection tally to 1,665.
Chhattisgarh's COVID-19 count rose to 5,731 on Tuesday with the addition of 133 COVID-19 cases in the last 24 hours, while the death toll climbed to 29, as the sample of an elderly woman who died earlier tested positive, a health official said.
Mumbai, neighbouring districts report 2,627 new cases; 107 die
Mumbai's COVID-19 tally rose to 1,03,262 on Tuesday with the addition of 995 new cases, while the toll increased to 5,814 after 62 more patients succumbed to the infection, the city civic body said.
In enighbouring Thane district, an addition of 1,323 cases took COVID-19 count to 70,513, while the toll swelled by 40 during the day to touch 1,967, an official said.
Kalyan led the list of new cases with 268 people testing positive, followed by 254 in Navi Mumbai, he said.
"Thane and Kalyan now have over 16,000 cases each while Navi Mumbai is fast approaching the 12,000 mark. Of the 70,513 cases, 33.28 percent is active," he added.
Among those who died was a 52-year-old constable from Hill Line police station under Thane commissionerate, he said.
Neighbouring Palghar added 309 cases during the day to take its count to 12,382 while five deaths increased the toll to 223.
India doing relatively well, says Centre
Amid the rising cases, Rajesh Bhushan, officer on special duty in the Union health ministry, told a press conference in Delhi, that 30 states and Union Territories have COVID-19 positivity rate lower than that of the national average which stands at 8.07 percent.
According to PTI, stating that some states are doing more than 140 tests per million, Bhushan, said that the number of tests per million have to be brought down to a level of 140 tests per day per million, so that the "rate of positivity reduces and comes down to 10 percent first and then continue the testing process so that the rate of positivity further reduces to 5 percent or lower".
The health ministry official also said that the COVID-19 deaths per million population in India stand at 20.4 per million which is amongst lowest in the world, Bhushan said.
"There are several countries where the deaths per million is 21 times or 33 times higher than in India. The global average stands at 77 deaths per million population," he said.
"So far, the nation has managed COVID-19 relatively well," Bhushan said.
He also shared a chart showing that the COVID-19 case fatality rate has declined from 3.36 percent on 17 June to 2.43 percent now.
Punjab's first plasma bank opens at Patiala
Punjab on Tuesday got its first plasma bank at Patiala's Rajindra Hospital where those who have recovered from the novel coronavirus can donate their blood plasma to help treat COVID-19 patients.
State's Medical Education and Research Minister OP Soni inaugurated the facility through video conference and said it will play a vital role in the fight against the pandemic.
Multiple trials of plasma therapy have been successfully conducted in the state that paved the way for the establishment of the plasma bank, he said.
Karnataka won't extend lockdown, to regulate supply of Remdesivir
Karnataka chief minister BS Yediyurappa also said that it will not be extending lockdown in Benglauru and other areas of the state, saying that "lockdown" is not the solution to control COVID-19 and stressed on social distancing and wearing of masks.
"We had been successful at the beginning in controlling the COVID, but in recent days especially in Bengaluru the COVID cases have increased.....I want to tell the people of the state that for the control of the virus, lockdown was not the solution. The solution is wearing masks and maintaining social distancing," Yediyurappa said.
In the meanwhile, amid reports of black marketing and haording of Remdesivir, a drug used in the treatment of coronavirus infected patients, Karnataka's COVID-19 task force on Tuesday decided that the state government will regulate its supply to private hospitals.
"Remdesivir which is currently available in the government hospitals will be supplied to private hospitals through the government. This will help curb black marketing of this drug," Medical Education Minister K Sudhakar's office said in a release.
The government has also fixed the rate for COVID-19 tests in private labs at Rs 2,000 for government referred cases and 3,000 for self-reporting cases.
Meanwhile, the West Bengal govt said Tuesday that there will be a complete lockdown in the state on 23, 25 and 29 July to fight the spread of COVID-19.
US accuses Chinese hackers in targeting of COVID-19 research
Days after authorities in the US, Canada and the United Kingdom accused a hacking group with links to Russian intelligence with trying to target research on the disease, the US Justice Department on Tuesday accused two Chinese hackers of stealing hundreds of millions of dollars of trade secrets from companies across the world and more recently targeting firms developing a vaccine for the coronavirus.
The indictment, says the hackers in recent months had researched vulnerabilities in the computer networks of companies publicly known for their work in developing vaccines and treatments, AP reported.
However, there was no immediate indication that the hackers had successfully obtained any COVID-19 research, despite efforts to snoop on the companies.

Akhilesh Yadav urged the Supreme Court to send in Army, if necessary, so that the situation doesnrsquo;t wriggle out of control during the gathering. ldquo;The BJP doesnrsquo;t believe in either the Supreme Court or the constitution. The party can go to any extent. The kind of environment there is in UP, especially in Ayodhya, the Supreme Court should take notice of it and send the Army if necessary,rdquo; said Samajwadi Party chief Akhilesh Yadav. The gathering will coincide with the two-day visit of Shiv Sena led by Sena chief Uddhav Thackeray. Sena has been BJPrsquo;s oldest ally and a staunch critic at the same time. According to NDTV, Ayodhya is decked up with high security arrangements mdash;160 inspectors, 700 constables, 42 companies of Provincial Armed Constabulary (PAC), Anti-Terrorism Squad (ATS), five companies of Rapid Action Force (RAF) along with commandos and drone cameras have already been deployed at the disputed site. The ruling party at the Centre, BJP is under intense pressure from the Hindutva groups to construct the Ram Temple at the razed site of Babri Masjid. If talks are anything to go by, Shiv Sena leader Sanjay questioned the delay in construction of Ram temple reminding everyone about the time taken to bring down the Babri Masjid on December 6, 1992. ldquo;We brought down the Babri mosque in 17 minutes, so how much time for a law? Ram-bhakts (devotees) removed the blot that had been there for years, within minuteshellip; toh kaagaz banane mein kitna waqt lagta hai (how much time does it take to draw up papers?),rdquo; Raut said. BJP MLA Surendra Singh also unleashed a warning. ldquo;If the situation so warrants, we will take law in our hands and ensure that the Ram temple is built at the very site mdash; constitutionally, legally or some other way,rdquo; Singh said.
