New research by the Landworkers’ Alliance, Sustain and others has raised serious concerns about exploitation of Nepalese workers in the UK horticulture sector. The 60-page report, called “Debt. Migration and Exploitation”, examines the recruitment practices and working conditions of seasonal fruit and veg pickers employed under the UK government’s Seasonal Worker scheme. Some Nepalese workers are having to pay extortionate, illegal broker fees of around £4,300 to third-party recruitment agencies in their home countries to secure a visa. One young woman paid £12,000, according to worker testimony included in the study. This means after paying for accommodation, subsistence and travel costs, they are left out of pocket and pay more to come to the UK and work than the retained income they take home. The report includes an extended interview with a former Nepalese worker recruited to work in the UK via a Seasonal Worker scheme visa, who says around 70-80% of workers are paying illegal broker fees. The worker states: “Many people do not know how to use the internet for applications, how to use it properly, how the process works. There is a lack of information everywhere about recruitment, and a lack of education. The brokers are 10 steps ahead of the candidates. The brokers make them victims, they take people for fools." The report also includes a supply chain analysis carried out by the New Economics Foundation, of a fruit farm in Kent. It estimates migrant seasonal workers picking soft fruit receive an average of 7.6% of the total retail price of this farm’s produce. The supermarket receives 54.7% of the value, while the farm receives 26.2%. In 2022, Nepalese migrants accounted for 8% of Seasonal Worker scheme recruits. Ukraine supplied the most workers (20%), down from 90% in 2019 due to the ongoing conflict with Russia. The report concludes with key recommendations for the UK government, labour market enforcement bodies, supermarkets, trade unions and social movements. These include recruiting through one authorised department of the origin countries of workers, cutting out brokers and middlemen, and the establishment of information centres to spread correct information on the process. A UK government spokesperson said “The welfare of visa holders is of paramount importance, including in the Seasonal Workers scheme, and we are clamping down on poor working conditions and exploitation. We work closely with scheme operators who have responsibility for ensuring the welfare of migrant workers, requiring them to provide at least 32 hours paid employment per week and managing the recruitment process overseas. Applying From Within the UK Dependants already in the UK may be able to extend their stay if the main applicant is extending their visa or switch to a UK dependent visa from an eligible visa type (e.g., from a student visa to a UK Spouse visa).

However, switching to a dependent visa from a Visitor visa, Short-term study visa, Parent of a Child Student visa, or Seasonal Worker visa is not permitted; applicants in these categories must leave the UK and apply from their home country.

UK Dependent visa Duration

A dependent visa is typically granted for the same duration as the main applicant’s visa. Extending the Dependent Visa To prolong a dependent visa, applicants must show that the connection is still real, that the financial conditions have been satisfied, and that there is enough housing. The application can be made concurrently or later, but the visa period will be the same as the primary applicant's.

Indefinite Leave to Remain (ILR) for main applicant & dependants When the primary applicant applies for Indefinite Leave to Remain (ILR), dependents do not automatically obtain it. They must fulfil specified standards, such as residing in the UK as a dependent for 5 years, showing a genuine relationship, and spending no more than 180 days outside the UK in any 12-month period within the qualifying period. If a dependant is not yet eligible for ILR, they must extend their dependent visa. Dependent Children and ILR When both parents have ILR, their dependent children under 18 can apply for ILR concurrently. If only one parent has ILR, the child usually waits until both parents are settled, unless the parent with ILR has sole parental responsibility. Children who turn 18 must still meet dependency requirements when applying for ILR, not leading an independent life.

When the Main Applicant Becomes a British Citizen Dependants do not automatically become citizens. They must usually apply for ILR first and then meet naturalization requirements after holding ILR for 12 months (if applicable). Applying for a Student visa from within the United Kingdom

These are the processes you can expect to follow if you're already in the UK and are applying for a Student visa to study at City St George's.

Can I apply in the UK?

You must ensure that you are eligible to do so before you submit an application.

You cannot switch to a Student visa in the UK if you hold a visa in one of the following categories:.

a visit visa

a short-term student visa

a Parent of a Child Student visa

a seasonal worker visa

a domestic worker in a private household visa

permission outside the immigration rules

If you already hold a visa for City St George's, University of London and, have successfully finished the course for which the visa was issued and are now starting a new course at a higher (or in some cases the same) level you will need to t apply to extend this permission within 6 weeks of registering on the new programme, even if your current permission lasts longer than this, in order to comply with the immigration rules.

If you hold Student Route permission for a different institution you must apply for your Student permission extension  before you can register for your new course. You will be allowed to register temporarily provided that you can show evidence that you have made a valid Student extension application

You must also meet the academic progression requirements of the UK immigration rules. This means that you cannot apply to extend your Student immigration permission for a new course from within the UK until you have successfully completed the course and obtained the qualification for which your last CAS was issued and the course you will be studying should normally be at a higher level than the previous course. You can extend your visa in the UK in the situations below:

You have successfully completed a course and are extending for a new course at a higher level or the same level, or

You are enrolled on a PhD course and require more time to complete this course, or

You undertook resit exams and as a result need more time to complete your course, or you have resit exams - please note you can only remain sponsored on a Student visa for resits if you will be in full attendance on your programme, or

You are adding a placement or Study Abroad year, or

You are studying for a BSc/MEng and adding an MSci or MENg year

You have completed a Masters programme and wish to undertake a second Masters or progress to a PhD - but you have not yet received your final transcript or the degree certificate. In order to apply in the UK you will need to obtain formal confirmation  from your current university confirming that you have completed all the taught elements of your course and that you are highly likely to complete your current course successfully together with  the date on which the degree is expected to  be awarded.

The Immigration rules do not allow you to apply to extend your student visa from within the UK if there is a gap of more than 28 days between your current Student visa end date and the start date of your new course.

When and how to apply

The earliest that you can apply is 3 months before your course starts. You must apply before your current immigration permission  expires. Your new course must begin within 28 days of your current visa expiring subject to any temporary concessions in place (see above).
