For this study interface’s TikTok Audit Team partnered with the civil society organization AI Forensics on a study of the “Others Searched For” feature to understand if it exhibits similar tendencies. As we issued with der SPIEGEL, TikTok provides highly questionable search suggestions beyond false celebrity death rumors or other random search terms. The platform also suggests oddly specific and partially misleading search ideas that can lead users to believe questionable information or send them down contentious political rabbit holes.

"Amongst researchers and experts, it is still unclear how these search suggestions are generated. TikTok claims they are based on user-generated searches. This, however, does not explain the order of the suggested searches, their moderation, or the lack thereof. In a first exploratory analysis in Fall 2023, we tried to understand the extent of embedded personalization and found that the search suggestions on the search page are indeed highly personalized. The suggestions continuously vary across TikTok sessions, as they adapt to recently viewed videos. Still, we found that the most common search suggestions, which we measured by scraping the search suggestions from non-logged-in users, also often appeared in the list of search suggestions for logged-in users at the beginning of their sessions (e.g. when they opened a search feature for the first time that day)."

"While most Dog Whistle suggestions contain the word “deutschland” (’Germany’), so do the party queries such as “Sozialdemokratische Partei Deutschland” or “Alternative für Deutschland” in which we have come across what we would attribute to this label. While this may explain the presence of what we interpret as highly nationalist content in the “Others Searched For” suggestions, the easily-made conspiratorial associations are yet equally present and, nonetheless, pose an extreme threat to how we consume political information concerning party-specific contexts."

A place you should avoid

Wir sind jetzt dabei, den zweiten Teil unserer Reise durch die USA vorzubereiten. Die Flüge sind gebucht , Harpo hat auch ein Platz im Frachtraum ergattert, es kann losgehen. Am 27. März fliegen wir nach San Francisco, nehmen ein Mietwagen Richtung Sacramento und fahren am nächsten Tag nach Salt Lake City, um zunächst einmal Michelle Simpson zu besuchen, unsere alte Freundin aus Park City. Wir hätten also gerne ein Motel in der Nähe von Sacramento, wo wir auch mit Harpo unterkommen können. Das ist nicht ganz so einfach in den USA. Viele Hotels nehmen keine Hunde, andere werben damit, dass sie Pet friendly seien. Das ist schon mal gut, nicht so gut ist, dass sie sich ihre Freundlichkeit zum Teil fürstlich bezahlen lassen. 50 und mehr Dollar dafür, dass die Töle mit ins Zimmer darf sind da gar nichts. Zum Glück ist das nicht überall so, aber man muss aufpassen.

Das Haus einer bekannten Kette, bei der wir ganz gerne übernachten, machte auf den Bildern einen guten Eindruck Komma aber die Bewertungen auf TripAdvisor hatten es doch in sich. Man wundert sich fast, dass es Hotels auf solche Bewertungen einfach ankommen lassen und sich schon mal gar nicht dafür interessieren. Overall Rating

March 13, 2019 I'd give no stars if possible and more photos are to come too. My worst experience in a hotel in my entire 58 years on this earth. They disrespected my service to my country as a Veteran. The lady at front desk had no idea of what she was doing or talking about. They have rooms that are so nasty they should be condemned "but as long as the money rolls in who cares" appears to be their moto. Gave us the wrong room and I hobbled to room with my caregiver and the room was already taken and it was OMG like a dumpster and on the one bed was 3 YES 3 little babies I mean like 15 months oldest maybe and for the 3 seconds we stood there it almost made me sick the stink coming out of that room. The weed smell through the whole hotel is like nothing I've smelled before. As I said this is the worst experience I've ever had. I called corporate office and got disrespected again by a "supervisor" and I use that term loosely as possible. The only bright moment in this whole ride through hood trap was speaking to a Jennifer the boss of the incompetent "supervisor who disrespected me. If your a drug addict, gang member or just plain trash do stay here, you'll fit right in and be right at home. I have filed complaints with CPS, The Health Department etc. I've sent all the photos along with a email to every local news station also. This type of behavior cannot be allowed to exist. It's a breeding ground for everything not good for our City and neighbors

December 30, 2018 Super friendly staff. Those others must have been fired or something. The parking area and vicinity is patrolled at night and parking was no problem at all there was extra parking unlike other Red Roof locations here in Sac. There is like 10 fast food places within walking distance. (that's me though. For sure, Wendy's across the street. I went to Del Taco like less than a minute drive away. Patricia told me she has been here six months and was very nice letting me know about the veteran's discount. Thanks.

December 15, 2018 One star only because zero stars aren't an option. I wish I'd checked yelp before booking this piece of sh*t hotel. The lobby appeared clean and contemporary so I figured it was a decent enough place. We came to Sac to see the Nutcracker ballet and when we arrived back at the hotel we were quickly accosted by a turd selling heroin and crack. He even had the nerve to shove a bag of his drugs in my 12 year old daughter's face! To make matters worse, he came out of the office and when I called down there to report him the clerk refused to answer the phone. It appears that the staff is in on the drug selling shenanigans. I called the sherrif's office and reported it. After this I'm posting on Hotels.com, Traveladvisor.com, and contacting the better business bureau and Red Roof Inn's corporate office.

Roaches

November 23, 2018 Reserved a non smoking room but the room smelled badly of smoke. Could have delt with that but the room was filled with cockroaches. Went back to lobby and requested refund. Clerk was polite and processed refund with no issues. So no complaints of the employers. But can't stay in a place with so many roaches. Neighborhood is pretty sketchy too. Did not feel safe parking and staying there.

Very insulting staff and unprofessional lazy manager r December 19, 2017 I just want to start by saying I never write reviews but after the treatment my family received I had to make sure I start good or bad for all deserving businesses. We checked in and was a little surprised how unfriendly and very short (morning) front desk staff was. Tatiana I believe was knowledgeable of her job but short and not friendly. So checking into the room it was clear management didn't check rooms after staff or give *need to fix list for maintenance. There was black hair on bedsheet. Quilt had food stains and other stains I don't wanna know what they were on them. We also noticed black hair in shower. Tub was not clean at all. we called front desk not asking for anything but just telling them for their knowledge. Also, one bulb in living room out and needed few other maintenance things done. Painting, toilet kept stopping up and broken window lock. So my husband had went to grocery store second morning and called front desk to say no service and please don't knock on door because our 11 yr old 12 next week son was there and we told him not open door unless we called to tell him. She said ok, no problems. Third morning we left hotel from bank which is five minutes down the street and it was 1130. We lost track of time but only 30 minutes and told her we were staying. She gave me attitude and said ok but we needed to be there by noon to pay or we would be charged a late fee. Umm ok but we got there by noon. When we got back our son informed us manager had called room and asked him why he was alone and it was against the law. Shocked we went downstairs to find out the problem and asked why they didn't question us when we paid before going up to room. There were two girls who immediatly started scolding us and saying it was against the law and treating us like bad parents. We told them to check state laws because it's at parents discretion after a certain age. And a almost 12yr old was ok alone for 30 minutes to a hour. They then acted shocked and said well they wouldn't do it. So we went back to room and as time passed I couldn't stop thinking about it and spoke to my husband who said it's just those girls and the night shift employee was really nice (a young guy) and security team was also nice and professional we decided to see if anything else would happen as we had one more day on reservation. That night there were sketchy young people outside obviously high and loud. I called front desk and I guess when security is off two days it's party time. Also that night my son had his hand under mattress and pulled out some old candy wrappers. The next morning at breakfast we told Tatiana and she was rude and said maintenance checks all rooms and basically implied we had done it. We even said we didn't expect anything just wanted the management to know they need to walk thru rooms to check on employees. The rest of day went on without incident and we were supposed to check out next morning. So my husband had lost car key and we couldn't find it. We looked all over property and couldn't find it. We made another reservation on line and called front desk (Tatiana again) and told her we made a reservation on line and needed another day. I explained my husband lost keys and she said ok. Our insurance (Geico, and they are awesome) sent a tow truck to us and opened our car. They waited ten minutes for us to search car and leave with them to go and have another very expensive key made. We were at dealership having a key maid when Tatiana called and said they found a car key and it was to a Ford. I was happy but it was to late (not her fault) However, we got back at 12:49pm and went to office to get key. Tatiana said we didn't sign papers by noon and manager charging us $25 late fee. We said we had called before noon to inform them we needed another night and why. She said nope we were supposed to sign by noon and computer started flagging us and charging us late fee. She could've checked us out and had paper there for us to sign and checked us in after we got back. Again, not their problem and manager wasn't there but we could have her voicemail. We were upset and told them we were leaving and we would return to checkout. She said we had 30 minutes or she was keeping our whole deposit. We ran upstairs and five minutes Tatiana calls and says her manager had called Sheriff because we didn't checkout on time. I got really angry and felt like I was being treated extremely poorly by staff. She didn't care and we now only had $10 of our $60 deposit left. I asked why she said 30:and she yelled no, and hurry up. We been informed already of hotel policy's which I thought when I called at noon to tell her we were staying we covered that. She didn't say otherwise. I hung up on her and still hurried out thinking no way a chain like this would let their employees act like this. Then a knock at door and rude maintenance man and two housekeepers stood their until we left, never getting a deposit at all. We waited and manager never came. it was working hours. I know this was long but I will write this review everywhere, every week until refunded deposit and a apology I will stand on Watt Ave and stop business. People gotta know. and as we waited in parking lot a man came out yelling cause he was charged $20 for one dirty towel. Horrible service.

While it's OK to provide only limited functionality in a trial version, the appsshould be upfront about what the limitation is. Ich halte https://www.zeit.de/politik/deutschland/2019-09/bundestag-jubilaeum-70-jahre-parlament-reden-woerter-sprache-wandel zur Analyse von Worthäufigkeiten im deutschen Bundestag im Laufe der Jahrzehnte für ein tolles Tool. Schade ist nur, dass die Daten hinter der Suchmaske versteckt bleiben und nicht auch unter eine Offene Lizenz gestellt werden.

Ich dachte ich werde jetzt mal ganz meta und schreibe darüber WIE man die Seite crawlen könnte, ohne es selbst in die Tat umzusetzen. Nur kurz vorausgeschickt, ich bin kein Programmierer und es gibt sicher einige auf /de, die sich damit deutlich besser auskennen als ich.

So schön ich das Projekt finde, es auf diese Art zu durchforsten wäre den Aufwand wahrscheinlich nicht wert. Zudem könnte man sich die für die Suche verwendeten Bundestagsprotokolle lieber mit genug Zeit und Geduld selbst vornehmen.

Wie die Seite funktioniert, ist in Umrissen auf dem Blog der Zeit erschienen. In aller Kürze: Der User tippt Begriffe ein, Elastic Search macht Suchvorschläge, der User sendet den finalen request und Elastic Search sucht schlussendlich das Ergebnis aus der Datenbank und wirft es dem Nutzer als Graph, aus.

Über das Web Developer Tool des Browser könnt ihr auch nachsehen, WAS genau da eigentlich von Elastic Search zurück gespiegelt wird. Dazu öffnent man das Browser-Tool mit der Taste F12 (siehe Screenshot weiter unten), gibt einen Suchbegriff in die Suchmaske ein und sendet ihn ab. Was fällt auf? Erstens, zumindest zu dem kompletten Suchbegriff wird auch eine Seite namens https://parlamentsreden-api.zeit.de/complete?term=merkel mit den Suchalternativen ausgeworfen.

Darunter sind beispielsweise Suchvorschläge wie "merkel-doktrin", "merkel-plan" usw. (es wird ohne Beachtung der Großschreibung gesucht). Zweitens, und das ist wesentlich interessanter, befinden sich auf der Seite https://parlamentsreden-api.zeit.de/term?term=merkel alle Zahlen, die im Graph visualisiert werden, sowohl in absoluten als auch in relativen Zahlen. Werfen wir kurz mal einen Blick auf die Zahlen. Zu Merkel lauten diese:

Der Begriff wurde also bis hinein in die 90er selten verwendet, dann steigt die Kurve langsam nach oben. Ergibt Sinn, denn bei der Bundestagswahl am 2. Dezember 1990 errang Merkel erstmals ein Bundestagsmandat. Der Graph scheint auch in eine ähnliche Richtung zu gehen, sieht gut aus mit der Korrektheit der Daten!

Das bedeutet einfach gesagt, dass die Daten sehr leicht auslesbar sind und sich leicht automatisiert in einen Datensatz von Pandas (oder gar Excel!) verwandeln liessen. Wie man die Seite abfragen würde? Hätte man eine Liste aller Suchbegriffe, würde man schlicht und einfach eine URL-Anfrage an https://parlamentsreden-api.zeit.de/term?term=SUCHBEGRIFF senden, eben beispielsweise "Rente" oder "Arbeitslosigkeit", die Ergebnisse lokal oder in einer Datenbank speichern und danach automatisiert auslesen und in eine Tabelle verwandeln.

Um es mal technisch zu sagen: Das Problem ist nicht das Out, die Daten lassen sich einfach auslesen, sondern das In. Ich frage mich, wie man an einen geeigneten Wörter-Korpus zum Auslesen der Begriffe kommt - schließlich muss sich auch das Skript bei automatisierten Anfragen an logischen Suchworten entlang hangeln. Abseits von der brute-force Methode, einfach so viele sinnvolle Buchstabenkombinationen des Alphabets wie möglich durchzugehen, fällt mir nur noch eine bessere Methode ein, nämlich Wikipedia.

Ein politikspezifischer Korpus zum Auslesen der Seite müsste auch "untypische" Wörter enthalten, die in einem normalen Korpus der am häufigsten verwendeten Wörter wahrscheinlich fehlen. Auf der der Seite https://de.wikipedia.org/wiki/Spezial:Alle_Seiten finden sich die Links zu über 2 000 000 Artikeln der deutschen Wikipedia. Entnähme man diese Liste (crawlen oder dem Wikipedia-Download entnehmen), könnte man sämtliche Artikelnamen als Basis zum Auslesen der Daten verwenden. Das schließt sich für mich aus, weil das Senden von mehr als zwei Millionen Anfragen an Zeit.de weder sinnvoll noch ratsam wäre. Dann lieber gleich zu den originalen Gesprächsprotokollen greifen.

EU websites’ use of Google Analytics and Facebook Connect targeted by post-Schrems II privacy complaints

A month after Europe’s top court struck down a flagship data transfer arrangement between the EU and the US as unsafe, European privacy campaign group, noyb, has filed complaints against 101 websites with regional operators which it’s identified as still sending data to the US via Google Analytics and/or Facebook Connect integrations.

Among the entities listed in its complaint are ecommerce companies, publishers & broadcasters, telcos & ISPs, banks and universities — including Airbnb Ireland, Allied Irish Banks, Danske Bank, Fastweb, MTV Internet, Sky Deutschland, Takeaway.com and Tele2, to name a few.

“A quick analysis of the HTML source code of major EU webpages shows that many companies still use Google Analytics or Facebook Connect one month after a major judgment by the Court of Justice of the European Union (CJEU) — despite both companies clearly falling under US surveillance laws, such as FISA 702,” the campaign group writes on its website.

“Neither Facebook nor Google seem to have a legal basis for the data transfers. Google still claims to rely on the ‘Privacy Shield’ a month after it was invalidated, while Facebook continues to use the ‘SCCs’ [Standard Contractual Clauses], despite the Court finding that US surveillance laws violate the essence of EU fundamental rights.”

We’ve reached out to Facebook and Google with questions about their legal bases for such transfers — and will update this report with any response.

Privacy watchers will know that noyb’s founder, Max Schrems, was responsible for the original legal challenge that took down an anterior EU-US data arrangement, Safe Harbor, all the way back in 2015. His updated complaint ended up taking down the EU-US Privacy Shield last month — although he’d actually targeted Facebook’s use of a separate data transfer mechanism (SCCs), urging its data supervisor, Ireland’s DPC, to step in and suspend its use of that tool.

The regulator chose to go to court instead, raising wider concerns about the legality of EU-US data transfer arrangements — which resulted in the CJEU concluding that the Commission should not have granted the US a so-called ‘adequacy agreement’, thus pulling the rug out from under Privacy Shield.

The decision means the US is now what’s considered a ‘third country’ in data protection terms, with no special arrangement to enable it to process EU users’ information.

More than that, the court’s ruling also made it clear EU data watchdogs have a responsibility to intervene where they suspect there are risks to EU people’s data if it’s being transferred to a third country via SCCs.

European data watchdogs swiftly warned there would be no grace period for entities still illegally relying on Privacy Shield — so anyone listed in the above complaint that’s still referencing the defunct mechanism in their privacy policy won’t even have a proverbial figleaf to hide their legal blushes.

noyb’s contention with this latest clutch of complaints is that none of the aforementioned 101 websites has a valid legal basis to keep transferring visitor data to the US via the embedded Google Analytics and/or Facebook Connect integrations.

“We have done a quick search on major websites in each EU member state for code from Facebook and Google. These code snippets forward data on each visitor to Google or Facebook. Both companies admit that they transfer data of Europeans to the US for processing, where these companies are under a legal obligation to make such data available to US agencies like the NSA. Neither Google Analytics nor Facebook Connect are essential to run these webpages and are services that could have been replaced or at least deactivated by now,” said Schrems, honorary chair of noyb.eu, in a statement.

Since the CJEU’s Schrems II ruling, and indeed since the Safe Harbor strike down, the US Department of Commerce and European Commission have stuck their heads in the sand — signalling they intend to try cobbling together another data pact to replace the defunct Privacy Shield (which replaced the blasted-to-smithereens (un)Safe Harbor. So, er… ).

Yet without root-and-branch reform of US surveillance law, any third pop by respective lawmakers at papering over the legal schism of US national security priorities vs EU privacy rights is just as surely doomed to fail.

The more cynical among you might say the high level administrative manoeuvers around this topic are, in fact, simply intended to buy more time — for the data to keep flowing and ‘business as usual’ to continue.

But there is now substantial legal risk attached to a strategy of trying to pretend US surveillance law doesn’t exist.

Here’s Schrems again, on last month’s CJEU ruling, suggesting that Facebook and Google could be in the frame for legal liability if they don’t proactively warn EU customers of their data responsibilities: “The Court was explicit that you cannot use the SCCs when the recipient in the US falls under these mass surveillance laws. It seems US companies are still trying to convince their EU customers of the opposite. This is more than shady. Under the SCCs the US data importer would instead have to inform the EU data sender of these laws and warn them. If this is not done, then these US companies are actually liable for any financial damage caused.”

And as noyb’s press release notes, GDPR’s penalties regime can scale as high as 4% of the worldwide turnover of the EU sender and the US recipient of personal data. So, again, hi Facebook, hi Google…

The crowdfunded campaign group has pledged to continue dialling up the pressure on EU regulators to act and on EU data processors to review any US data transfer arrangements — and “adapt to the clear ruling by the EU’s supreme court”, as it puts it.

Other types of legal action are also starting to draw on Europe’s General Data Protection Regulation (GDPR) framework — and, importantly, attract funding — such as two class action style suits filed against Oracle and Salesforce’s use of tracking cookies earlier this month. (As we said when GDPR came into force back in 2018, the lawsuits are coming.)

Now, with two clear strikes from the CJEU on the issue of US surveillance law vs EU data protection, it looks like it’ll be diminishing returns for US tech giants hoping to pretend everything’s okay on the data processing front.

noyb is also putting its money where its mouth is — offering free guidelines and model requests for EU entities to use to help them get their data affairs in prompt legal order. 

“While we understand that some things may need some time to rearrange, it is unacceptable that some players seem to simply ignore Europe’s top court,” Schrems added, in further comments on the latest flotilla of complaints. “This is also unfair towards competitors that comply with these rules. We will gradually take steps against controllers and processors that violate the GDPR and against authorities that do not enforce the Court’s ruling, like the Irish DPC that stays dormant.”

We’ve reached out to Ireland’s Data Protection Commission to ask what steps it will be taking in light of the latest noyb complaints, a number of which target websites that appear to be operated by an Ireland-based legal entity.

Schrems original 2013 complaint against Facebook’s use of SCCs also ended up in Ireland, where the tech giant — and many others — locates its EU EQ. Schrem’s request that the DPC order Facebook to suspend its use of SCCs still hasn’t been fulfilled, some seven years and five complaints later. And the regulator continues to face accusations of inaction, given the growing backlog of cross-border GDPR complaints against tech giants like Facebook and Google.

Ireland’s DPC has still yet to issue a single final decision on any of these major GDPR complaints. But the legal pressure for it and all EU regulators to get a move on and enforce the bloc’s law will only increase, even as class action style lawsuits are filed to try to do what regulators have failed to.

Earlier this summer the Commission acknowledged a lack of uniformly “vigorous” enforcement of GDPR in a review of the mechanism’s first two years of operation.

“The European Data Protection Board [EDPB] and the data protection authorities have to step up their work to create a truly common European culture — providing more coherent and more practical guidance, and work on vigorous but uniform enforcement,” said Věra Jourová, Commission VP for values and transparency then, giving the Commission’s first public assessment of whether GDPR is working.

We’ve also reached out to France’s CNIL to ask what action it will be taking in light of the noyb complaints.

Following the judgement in July the French regulator said it was “conducting a precise analysis”, along with the EDPB, with a view to “drawing conclusions as soon as possible on the consequences of the ruling for data transfers from the European Union to the United States”.

Since then the EDPB guidance has come out — inking the obvious: That transfers on the basis of Privacy Shield “are illegal”. And while the CJEU ruling did not invalidate the use of SCCs it gave only a very qualified green light to continued use.

As we reported last month, the ability to use SCCs to transfer data to the U.S. hinges on a data controller being able to offer a legal guarantee that “U.S. law does not impinge on the adequate level of protection” for the transferred data.

“Whether or not you can transfer personal data on the basis of SCCs will depend on the result of your assessment, taking into account the circumstances of the transfers, and supplementary measures you could put in place,” the EDPB added.

Google still claims to rely on the ‘Privacy Shield’ a month after it was invalidated, while Facebook continues to use the ‘SCCs’ [Standard Contractual Clauses], despite the Court finding that US surveillance laws violate the essence of EU fundamental rights.”

We’ve reached out to Facebook and Google with questions about their legal bases for such transfers — and will update this report with any response.

Privacy watchers will know that noyb’s founder, Max Schrems, was responsible for the original legal challenge that took down an anterior EU-US data arrangement, Safe Harbor, all the way back in 2015. His updated complaint ended up taking down the EU-US Privacy Shield last month — although he’d actually targeted Facebook’s use of a separate data transfer mechanism (SCCs), urging its data supervisor, Ireland’s DPC, to step in and suspend its use of that tool.

The regulator chose to go to court instead, raising wider concerns about the legality of EU-US data transfer arrangements — which resulted in the CJEU concluding that the Commission should not have granted the US a so-called ‘adequacy agreement’, thus pulling the rug out from under Privacy Shield.

The decision means the US is now what’s considered a ‘third country’ in data protection terms, with no special arrangement to enable it to process EU users’ information.

More than that, the court’s ruling also made it clear EU data watchdogs have a responsibility to intervene where they suspect there are risks to EU people’s data if it’s being transferred to a third country via SCCs.

European data watchdogs swiftly warned there would be no grace period for entities still illegally relying on Privacy Shield — so anyone listed in the above complaint that’s still referencing the defunct mechanism in their privacy policy won’t even have a proverbial figleaf to hide their legal blushes.

noyb’s contention with this latest clutch of complaints is that none of the aforementioned 101 websites has a valid legal basis to keep transferring visitor data to the US via the embedded Google Analytics and/or Facebook Connect integrations.

“We have done a quick search on major websites in each EU member state for code from Facebook and Google. These code snippets forward data on each visitor to Google or Facebook. Both companies admit that they transfer data of Europeans to the US for processing, where these companies are under a legal obligation to make such data available to US agencies like the NSA. Neither Google Analytics nor Facebook Connect are essential to run these webpages and are services that could have been replaced or at least deactivated by now,” said Schrems, honorary chair of noyb.eu, in a statement.

Since the CJEU’s Schrems II ruling, and indeed since the Safe Harbor strike down, the US Department of Commerce and European Commission have stuck their heads in the sand — signalling they intend to try cobbling together another data pact to replace the defunct Privacy Shield (which replaced the blasted-to-smithereens (un)Safe Harbor. So, er… ).

Yet without root-and-branch reform of US surveillance law, any third pop by respective lawmakers at papering over the legal schism of US national security priorities vs EU privacy rights is just as surely doomed to fail.

The more cynical among you might say the high level administrative manoeuvers around this topic are, in fact, simply intended to buy more time — for the data to keep flowing and ‘business as usual’ to continue.

But there is now substantial legal risk attached to a strategy of trying to pretend US surveillance law doesn’t exist.

Here’s Schrems again, on last month’s CJEU ruling, suggesting that Facebook and Google could be in the frame for legal liability if they don’t proactively warn EU customers of their data responsibilities: “The Court was explicit that you cannot use the SCCs when the recipient in the US falls under these mass surveillance laws. It seems US companies are still trying to convince their EU customers of the opposite. This is more than shady. Under the SCCs the US data importer would instead have to inform the EU data sender of these laws and warn them. If this is not done, then these US companies are actually liable for any financial damage caused.”

And as noyb’s press release notes, GDPR’s penalties regime can scale as high as 4% of the worldwide turnover of the EU sender and the US recipient of personal data. So, again, hi Facebook, hi Google…

The crowdfunded campaign group has pledged to continue dialling up the pressure on EU regulators to act and on EU data processors to review any US data transfer arrangements — and “adapt to the clear ruling by the EU’s supreme court”, as it puts it.

Other types of legal action are also starting to draw on Europe’s General Data Protection Regulation (GDPR) framework — and, importantly, attract funding — such as two class action style suits filed against Oracle and Salesforce’s use of tracking cookies earlier this month. (As we said when GDPR came into force back in 2018, the lawsuits are coming.)

Now, with two clear strikes from the CJEU on the issue of US surveillance law vs EU data protection, it looks like it’ll be diminishing returns for US tech giants hoping to pretend everything’s okay on the data processing front.

noyb is also putting its money where its mouth is — offering free guidelines and model requests for EU entities to use to help them get their data affairs in prompt legal order. 

“While we understand that some things may need some time to rearrange, it is unacceptable that some players seem to simply ignore Europe’s top court,” Schrems added, in further comments on the latest flotilla of complaints. “This is also unfair towards competitors that comply with these rules. We will gradually take steps against controllers and processors that violate the GDPR and against authorities that do not enforce the Court’s ruling, like the Irish DPC that stays dormant.”

We’ve reached out to Ireland’s Data Protection Commission to ask what steps it will be taking in light of the latest noyb complaints, a number of which target websites that appear to be operated by an Ireland-based legal entity.

Schrems original 2013 complaint against Facebook’s use of SCCs also ended up in Ireland, where the tech giant — and many others — locates its EU EQ. Schrem’s request that the DPC order Facebook to suspend its use of SCCs still hasn’t been fulfilled, some seven years and five complaints later. And the regulator continues to face accusations of inaction, given the growing backlog of cross-border GDPR complaints against tech giants like Facebook and Google.

Ireland’s DPC has still yet to issue a single final decision on any of these major GDPR complaints. But the legal pressure for it and all EU regulators to get a move on and enforce the bloc’s law will only increase, even as class action style lawsuits are filed to try to do what regulators have failed to.

Earlier this summer the Commission acknowledged a lack of uniformly “vigorous” enforcement of GDPR in a review of the mechanism’s first two years of operation.

“The European Data Protection Board [EDPB] and the data protection authorities have to step up their work to create a truly common European culture — providing more coherent and more practical guidance, and work on vigorous but uniform enforcement,” said Věra Jourová, Commission VP for values and transparency then, giving the Commission’s first public assessment of whether GDPR is working.

We’ve also reached out to France’s CNIL to ask what action it will be taking in light of the noyb complaints.

Following the judgement in July the French regulator said it was “conducting a precise analysis”, along with the EDPB, with a view to “drawing conclusions as soon as possible on the consequences of the ruling for data transfers from the European Union to the United States”.

Since then the EDPB guidance has come out — inking the obvious: That transfers on the basis of Privacy Shield “are illegal”. And while the CJEU ruling did not invalidate the use of SCCs it gave only a very qualified green light to continued use.

As we reported last month, the ability to use SCCs to transfer data to the U.S. hinges on a data controller being able to offer a legal guarantee that “U.S. law does not impinge on the adequate level of protection” for the transferred data.

“Whether or not you can transfer personal data on the basis of SCCs will depend on the result of your assessment, taking into account the circumstances of the transfers, and supplementary measures you could put in place,” the EDPB added.
