"Bhat took leave for two days. Argued before this court and went back and was suspended," Sibal said.A five-judge bench headed by Chief Justice D Y Chandrachud took note of Bhat's suspension and asked Attorney General R Venkataramani and Solicitor General Tushar Mehta to talk to the J-K Lieutenant Governor and look into the matter."This should not happen. A person gets suspended in close proximity of arguing before this court ... it needs to be looked into," said the bench, also comprising Justices Sanjay Kishan Kaul, Sanjiv Khanna, BR Gavai and Surya Kant.Mehta said he had checked with the J&K administration, which informed that there were various reasons behind the lecturer's suspension including that he has been regularly filing petitions before different courts. "We can place before the court all the materials related to his suspension," Mehta said.Sibal, however, questioned the timing of the suspension. "Then, he would have been suspended earlier, why now. I have the suspension order of Bhat and it says that he has argued before this court and therefore the suspension. This is not fair. Home Minister Amit Shah on Tuesday asserted in Lok Sabha that Pakistan occupied Kashmir (PoK) and Aksai Chin are part of Jammu and Kashmir and said "we are ready to give our lives for it".
Moving a resolution for revoking provisions of Article 370 and the Jammu and Kashmir Reorganisation Bill 2019, Shah also said that there has been a long-standing demand for giving Union Territory status to Ladakh which was fulfilled by the Narendra Modi government.
"Kashmir is an integral part of India, there is no doubt about it. When I say Jammu and Kashmir, I include Pakistan Occupied Kashmir and Aksai Chin, both are included in the territorial boundaries of Jammu and Kashmir," the Home Minister said.
This piece was from the end of 2019, and claiming Aksai Chin is claiming a large part of territory on the Chinese side of the LAC.

Revocation of article 370: An equal India or a Power move?

Article 370, which has provided a special autonomous status to Kashmir till date, is being revoked by the Government of India. This not only has implications for the population of Kashmir but also for the rest of India. A short term result that can be predicted is the unrest and turmoil this decision will cause. Curfew has been declared in the region and tourists have been asked to come back. 
This decision received backlash for some obvious reasons. The house arrest of Former Chief Ministers Omar Abdullah and  Mehbooba Mufti asks for the approach of the Government to such a sensitive issue to be taken into question. Additional troops have been sent into the valley in the thousands that have caused major disruptions in the normal lives and have caused fear in the minds of the innocent. People are asked to stock up on essentials required to sustain for 4 months. 
The reasons for the revocation is to bring forth an equal nation with no special treatment. One might argue that the weakest ones need the most care. This move will also allow for other residents to buy real estate in the valley. The negative implications of this are never ending. The purchase of these lands by companies at lower prices will be a major cause for concern. A religious agenda by the existing government comes to light with this decision, one where they wish to give back the land to the Kashmiri Pandits and drive out the Pakistani refugees.

1. As a response to this revocation, Pakistani Dollar bonds fell to a month’s low after losing 1.7 cents in the dollar.
2. There will be a rise in economic development, since companies will rush to habituate the lands in J&K. The ones that move first will have the better advantage.

SRINAGAR: The “jungle raj” in Jammu and Kashmir ended on the "eve of 2020" and the grassroots level democracy was strengthened in the union territory by conduct of violence-free district development council (DDC) elections, Lieutenant Governor Manoj Sinha said on Sunday. Referring to the Centre's decision to revoke the special status of the erstwhile state, Sinha said in 2019, Prime Minister Narendra Modi had marked the beginning of a new era for Jammu and Kashmir. "The grass-roots democracy has been strengthened, fulfilling the hopes and aspirations of the common citizens. With the spirit of Kashmiriyat i.e. taking along all religions and creeds on development odyssey, we are achieving new milestones,” Sinha said in his Independence Day speech at Sher-e-Kashmir Cricket stadium here. He said the ‘Vajpayee principle of Jamhooriyat' was not allowed to flourish on the ground for decades in Jammu and Kashmir and there was a famous “collectorate tradition of democracy”. “The nominations of MLAs of four or five regions were held at his house. So, on one hand, there were elected representatives of the people and on the other, the representatives of Collector Sahib," he said. Sinha said in 2019, the prime minister marked the beginning of a new era for Jammu and Kashmir. "But, the eve of 2020 ended this 'Jungle Raj' and the entire Jammu and Kashmir participated in the fair, transparent and violence-free elections of DDC,” he said. The Centre had on August 5, 2019, ended the J-K's special status under Article 370 and bifurcated the state into union territories. Describing terrorism as a curse for peace and development, Sinha said the neighbouring country has been making a malicious attempt to instigate the youth, but a befitting reply would be given to those who mislead the youngsters through proxy war. “We want to assure all citizens that whoever is trying to mislead the young people through proxy war, shall be given a befitting reply. The neighbouring country, which does not care for its own people, has been making a malicious attempt to instigate some of our youth,” he said. The LG called upon such “misguided youngsters” that terrorism is a curse for peace and development. “By misguiding you from the path of peace and progress, inimical forces are denying you the life of peace and dignity on this pious soil,” he said. “With your ability, energy and unparalleled patience, Jammu and Kashmir shall have a prosperous future,” Sinha added. The LG paid tributes to the brave soldiers of Army, paramilitary forces and Jammu and Kashmir Police “who have kept the unity, integrity of India intact with their amazing valour, courage and sacrifice”. “I am proud that Jammu and Kashmir Police has received 257 gallantry awards including Ashok Chakra, Kirti Chakra and Shaurya Chakra on the eve of Independence Day. "I salute all the gallant heroes of Jammu and Kashmir Police. I also salute the family members of the bravehearts who sacrificed their lives while defending the sovereignty and integrity of the country,” he said. Sinha announced that the administration has decided that various places and institutions will be christened in the memory of freedom fighters, brave soldiers and personalities from different fields who have made invaluable contribution in the progress of Jammu and Kashmir. “This will inspire the coming generations to become their worthy successors. I am sure that the stories of those who have made sacrifices for this elixir of freedom will awaken a new and re-energised Jammu and Kashmir,” he said. The memories of Maqbool Sherwani, Brigadier Rajendra Singh, Deputy SP Ayub Pandit, Inspector Arshad Khan, Sub Inspector Altaf Ahmed, Mali Begum, Ghulam Mohammad Sadiq, Lassa Kaul, Kanta Wazir and that of Sarvanand Kaul Premi, Dinanath Adim, Constable Yasin Tali, Lt Umar Fayaz, Mohammad Deen Jagir, Punjab Singh, Padma Sachdev, Mahmuda Shah, Deputy SP Aman Thakur, Deputy SP Manjit Singh and all such people will be revived in the coming days, he said. Sinha said it is the administration's goal to make Jammu and Kashmir synonymous with success. “The next 25 years of Jammu and Kashmir are awaiting us with a new ray of hope and a fresh resolution for a new future,” he said. The LG said Independence Day-2021 is special for Jammu and Kashmir and the entire country because the celebration, resolve, energy and enthusiasm of today's new generation will shape the formidable base for the centenary celebration of Independence in 2047. “In our ancient tradition, the 75th year is considered to be the time of trendsetter. Singh, the son of Maharaja Hari Singh who signed the terms of Kashmir's accession in 1947, also said his personal opinion is that prima facie the revocation of special status under Article 370 seems "irreversible" but asserted that the matter was before the Supreme Court and it must be decided by the top court. In an interview with , the last Sadr-e-Riyasat and first governor of the erstwhile state also demanded that the Centre must provide a "financial-cum- developmental package" to the people whose livelihoods were badly affected during the last two years following the Centre's move to bifurcate Jammu and Kashmir into two Union Territories and revoke its special status. His remarks come a day after Modi held talks with top political leaders from Jammu and Kashmir and told them that the Centre's priority is to strengthen grassroots democracy there for which delimitation has to happen quickly for polls to be held. Reacting to the prime minister's meeting with 14 political leaders of Jammu and Kashmir, including four former chief ministers, Singh said, "I definitely think it is a very positive step. First of all, because everybody was involved and people who once were discarded as anti-national, they all came -- National Conference and Peoples Democratic Party both." NEW DELHI: The number of terrorist incidents in 2020, up to November 15, decreased by 63.93 per cent as compared to the corresponding period in 2019 in Jammu and Kashmir, according to the Ministry of Home Affairs (MHA). The Ministry informed that there was also a decrease in fatalities of Special Forces Personnel by 29.11 per cent and a decrease in casualties of civilians by 14.28 per cent in 2020 (up to November 15, 2020) as compared to the corresponding period in 2019. The home ministry while giving a brief about annual achievements also said that Adaptation of Central Laws and State Laws in the Union Territory of Jammu and Kashmir and the Union Territory of Ladakh is one of the key achievements of the Central government. “Orders were notified for adaptation of 48 Central Laws and 167 State Laws in respect of UT of J&K. Orders relating to adaptation of 44 Central Laws and 148 State Laws in UT of Ladakh were also notified,” MHA said. “The Jammu and Kashmir Reorganisation (Removal of Difficulties) Order, 2020 was notified on 31.03.2020. It removes difficulties with regard to section 75 of the Jammu and Kashmir Reorganisation Act, 2019 for administering oath to new judges appointed to the common High Court for Jammu and Kashmir and Ladakh. A Bench of Central Administrative Tribunal was established at Jammu on 08.06.2020,” MHA has said. The MHA also said that one-time financial assistance of Rs 5.5 lakh per family provided to 36,384 displaced families from Pakistan occupied Jammu and Kashmir and Chhamb under the Prime Minister Development Package. One-time financial assistance at the rate of Rs 5.5 Lakh per family for the 5,764 families of West Pakistan Refugees (WPRs) in Jammu and Kashmir is also being provided at par with displaced persons of PoJK and Chhamb, it said. In 2019, the Central government revoked Article 370 which gave special provisions to the erstwhile state of Jammu and Kashmir. The government bifurcated Jammu and Kashmir into two Union Territories- Jammu and Kashmir and Ladakh.

Government snatching limited opportunities from youth: Tarigami Srinagar September 16 : More than a year after the special status of Jammu and Kashmir under Article 370 was revoked; the government is yet to create even a single job. Instead it has withdrawn more than 1000 posts that were advertised under SRO 202 during the past two years. The government’s decision is unfortunate as instead of providing employment, it is even snatching the limited opportunities. The government should revoke its decision as soon as possible. On 28 August 2019, when Kashmir was under lockdown after the abrogation of Article 370, then governor Satya Pal Malik announced that 50,000 jobs would be made available for the youth in next three months. Similarly, in March, the government in the Parliament announced that it proposes to fill up 50,000 vacant posts in J&K. And when the government decided to issue domicile certificates in the midst of Covid19 pandemic, it claimed that the haste was because it was planning to hold a massive recruitment drive. However, all these promises have proved a hoax and the unemployed youth in Jammu and Kashmir continue to suffer immensely. They feel betrayed and annoyed by the repeated false promises. The BJP government had claimed that Article 370 was an impediment to J&K’s development and its abrogation will bring investment, jobs and prosperity to the region. The reality is different on ground from what was being said by the government. After last August clampdown, the economy of J&K has virtually collapsed as tourism, trade and other vital sectors have been badly hit and whole businesses have shattered. Those who were already earning their livelihood were deprived of it. Thousands of casual labourers, need-based daily-wagers, scheme workers and others were without wages for the last more than a year.Over 15000 young unemployed engineers who were earning their bread and butter by working through Self Help Groups SHG in various departments like R&B, PMGSY, PHE, PDD, etc for the last more than a decade and half, have been rendered jobless due to the J&K administration decision to abolish SHGs. Abdullah was released in March after the J&K government revoked his detention orders under Public Safety Act (PSA), more than seven months after he was detained. Former Jammu and Kashmir Chief Minister Omar Abdullah on Monday said that there is no justification for continued detention of former Chief Minister Mehbooba Mufti and other mainstream leaders detained after the abrogation of Article 370 and demanded that they must be set free. Abdullah, in a tweet, said: "Over the next few days the PSA detention orders of Mehbooba Mufti, Ali Mohammad Sagar, Shah Faisal and others are due to expire. There was no justification for their detention much less an extension." Abdullah was released in March after the J&K government revoked his detention orders under Public Safety Act (PSA), more than seven months after he was detained. Abdullah, his father Farooq Abdullah and Mehbooba Mufti were among the three Chief Ministers detained on August 5 last year after Article 370 was abrogated and the state bifurcated and downgraded to the status of a Union Territory. Booked under the stringent PSA, Mehbooba Mufti was initially kept at the Hari Niwas guesthouse in Srinagar and later shifted to a Tourism Department hut in the Chashma Shahi area. From there, she was shifted to a government quarter in the transport yard lane in Srinagar. She was shifted to her Gupkar Road official residence on April 7. The three terrorists killed by the Jammu and Kashmir Police at a toll plaza in Nagrota (near Jammu), were prepared for a stand-off with the police, officials said on Friday.Pakistan-manufactured morphine injection, IEDs and armour piercing bullets are among the recovery made by the police, which directly links these terrorists to Pakistan, the officials further said. The three terrorists belong to Pakistan-based terror group Jaish-e-Mohammad (JeM).The police had also recovered AK-47 rifles, magazines and grenades from the slain terrorists on Friday. Three detonators, RDX, six Chinese grenades and Rs 32,000 cash have also been recovered.

They were able to infiltrate through the rivers and other water bodies which flow between India and Pakistan, said the police. The terrorists then boarded a truck and were headed towards Srinagar when they were intercepted by the police at the Ban toll plaza during a security check at 5 am, they added.The terrorists opened fire when they were caught by the police, leaving one cop injured. All three were shot dead by the police in the gunfight which ensued at the toll plaza.“One terrorist was killed in the morning. Two others have been neutralised in the adjoining forest area. Their bodies are being brought up to the road,” J&K director general of police Dilbagh Singh told HT.

Among the other recoveries is detonators and wires.The police also said that they have arrested three people including truck driver Sameer Dar, who was ferrying the armed terrorists to Srinagar from Dayalachak in Hiranagar area of Kathua district.Dar is the cousin brother of Aadil Dar, the suicide bomber, who rammed his explosive-laden vehicle into a CRPF convoy in Pulwama on Jammu-Srinagar highway on February 14 last year in which 40 personnel were killed.The officials suspect that the terrorists might have planned to carry out attack at vital installations as well as security camps along the nearly 300-km highway as they were carrying wire cutters and bulletproof jackets.This was the first terror attack in Jammu since Article 370, which granted special status to the former state of Jammu and Kashmir, was revoked on August 5 last year.Nagrota is an Indian Army cantonment where seven soldiers, including two officers, were killed in November 2016 when terrorists dressed as policemen stormed a military camp.
