Thus far, California online notaries have been behind the curve
With only two hours to find a notary public , I had no choice but to go online. Thankfully, there are online notaries who helped me finalize my son's school paperwork so that we would meet the deadline. The great thing about them is that they can be based anywhere; even though the notary helping me was in Texas and my son goes to school in California, it didn't matter! Being able to access an online notary was critical for me and I know that this is a valuable service that members of the special needs community I serve would largely benefit from as many are not able to meet with a notary public in person.
Notarization Play a Vital Role During Key Junctures
Notarizations are not something we think about daily, but they play a vital role during key junctures in our lives. Notarization is often required for finalizing legal or financial documents – like the power of attorney forms, medical directives, and immigration papers – among other things. While notarizations are important, they often come at rather inopportune times. And to make things worse, it can be difficult finding a notary on short notice. Thankfully, technology has advanced to the point where almost everything in our lives can be done online – but unfortunately for Californians struggling with this issue, state notaries are unable to perform online notarizations. California is one of the few states that has not passed legislation for remote online notarization, a service that would allow our state’s notaries to provide their services online. We are enthusiastic about passing this bill, but it is critical that we do so correctly. Assembly Bill 1093 (Jones-Sawyer) provides us with the opportunity to finally get online notarization right. The Legislature is progressing in working hard to bring online notarization to California and ensuring data security for both consumers and notaries should be our number one priority from here on out. If AB 1093 is to succeed, it must maintain the tradition of interstate recognition; otherwise, we run the risk of burdening individuals. If AB 1093 passes as it is currently written, it will break from tradition by no longer accepting the official acts of other states. This would be a major issue when dealing with time-sensitive personal matters that require notarizations, as people often cross state lines and wouldn't have time to comply with different laws. Meeting the two-hour deadline for my son's school would have been difficult enough, but if I had to also worry about whether or not Texas' state law for notarization would apply in California, it would have been impossible. Adding this extra layer of frustration would be harmful and unnecessary, particularly for elders and people with disabilities.
Licensed Notary in California Can Be Done Online
All residents of California can currently get documents licensed notarized online if the service is provided by a commissioned notary from another state that is authorized to do so in their respective state. AB 1093 would change this policy. Without interstate recognition, AB 1093 will force people to restart the notarization process from the beginning if they want their documents recognized in California. Time is a precious commodity that many cannot afford to waste, and this bill could cause more problems than it intends to solve. If, for instance, an elderly person in the family wants to finalize their estate before they die so that their loved ones will be financially protected, they first need to figure out the laws of the state where they're getting the notarization. If it turns out that the document won't be accepted in California, then the family may not find this out until it's too late. As an individual who would be impacted by AB 1093, I urge policymakers to consider everyone while drafting the bill and include interstate recognition. We have needed this for a long time, and now is the time to finally get it done right.

For most people the coronavirus has been a dramatic wake-up call, alerting them to feel the need to update or start their estate plans. Many people don’t have such plans, which include wills or trusts and powers of attorney for all their financial and medical purposes.
Dying or becoming incapacitated without having a will or trusts set into place can stir up major problems and cause monetary losses for your loved ones.
Since the pandemic began in late March, it has made estate planning an urgent priority for many clients, as a way of limiting their anxiety and planning for what could be potential deaths in the future.
This pandemic has left many thinking about their health and well-being. Roughly 52 percent of people aged 55 and older don’t have any will or other key estate plans set up. As the pandemic started targeting not only the elderly but younger generations, soon even people in their 20’s started urging to set up a will.
For those who are first responders, the elderly, healthcare workers, and the ones who are already battling health problems tend to be more motivated to update existing plans or establish estate plans for the first time.
The Rise in Online Wills
With the help of technology there are many DIY websites that one can choose to start planning their wills or trusts but many lawyers are cautioning that DIY wills can be considered invalid if they don’t meet all of the legal requirements of one’s state. People tend to turn to DIY wills because the cost is way cheaper then hiring an actual attorney. However, a vast majority of these websites are executed without any oversight from an attorney, leaving many wills to end up being considered invalid.
Plus, with only 37% of Americans having a will, according to Caring.com, there’s a massive opportunity to get more people to create one. Instead of having to find a lawyer and talk about death with someone you barely know, you can go through the entire process at home and, at a cost of between $39 and $399 or more, depending on the product, for much less than what a lawyer would charge (Bborzyko).
There are many DIY will websites out there but the ones that many people across the United States are using are Nolo’s Quicken WillMaker & Trust, US Legal Wills, Total Legal: Best Comprehensive Estate Plan, Trust & Will: Best for Ease of Use, and Rocket Lawyer: Best for Making Changes.
With all these different websites, they all offer users a cheap and easy way to create a legally binding will. It takes roughly 30 minutes for someone to detail all their end-of-life wishes in ensuring their property, possession, and children will go to the right people if the unthinkable ever happens.
Some of these websites have had over 50% to 143% week-over-week increase in people filling out wills.
Making a Will – Virtually
In most states these types of important documents require an adult over the age of 18 to witnesses and notarize, which is a procedure that usually takes place in person with signatures in front of a notary to be valid.
Some states on the other require witnesses who are “disinterest parties”, meaning the witness is not in line to inherit anything. Which this has not been easy to do because of the strict social distancing amongst people other than those in your household.
23 out of the 50 states have already allowed remote online notarization in which the notary and singer are in different locations and use two-way audiovisual communications to securely accomplish the electronic documents. These states include Kentucky, Florida, Minnesota, Michigan, Montana, Ohio, Nevada, Texas, Tennessee, Virginia, Utah, Wisconsin, and Washington.
With all the pressure from residents worried to prepare these estate planning documents, Arizona, Iowa, and Pennsylvania are now allowing remote online notarization for some of these documents.
There are numerous third-party software providers that have established protocols for building e-signatures into documents. The most established of the providers is DocuSign, which allows users to upload PDFs of documents onto its website or app and then add e-signatures in the appropriate location.
How Long Will This Last?
Many attorneys now offer remote conferencing for estate planning. This way they can also notarize online and compete the processing remotely, saving clients the trip to the office.
Not having a plan is never a “good plan”. In these challenging times it is better to start now in developing an estate plan or updating one already in place if needed to.
We do not know how long this pandemic will last, but what we do know is in the worst-case scenario our children, property, and possession will be in good hands.

5. Smart telescope startups vie to fix astronomy’s satellite challenge
The stakes involved are high, with projects like Starlink (the satellite branch of SpaceX) potentially being central to the future of global internet coverage, especially as new infrastructure implements 5G and edge computing. Notarize, the platform that enables digital notarizations, announced that it is adding 1,000 notaries to address demand as more Americans are ordered to shelter in place because of the COVID-19 pandemic, but still need to sign important documents.
The startup is partnering with the National Notary Association to verify notaries have been screened and have the necessary insurance or bonding. The service is available to Americans in all 50 states or abroad, but notaries must be physically located in Florida, Nevada, Texas or Virginia to join the platform (with plans to add more states later) and have a digital certificate before applying for Notarize.
Founder and CEO Pat Kinsel said Notarize is “experiencing unprecedented demand due to coronavirus. Consumers and businesses are turning to us en masse because they can’t complete critical transactions.”
He added that to scale quickly, Notarize is able to “leverage existing credentials from the National Notary Association that ensure people have commissions, insurance and background screenings. Notaries are stuck at home right now, looking for safe work. They can get onboarded in one to two days.”
Right before the spread of COVID-19 prompted shelter in place orders and social distancing mandates, there was an increased demand for mortgages because of low rates, with refinance applications growing 400% annually, according to CNBC. Now many of those loans can no longer be closed in-person. Kinsel says more than 2,000 lenders and title companies have contacted Notarize in the past week, and it is also opening the platform so they can add their own employees to serve transactions.
Notarize users also want to make sure critical documents are updated as they cope with the pandemic. “Beyond real estate, we’re seeing spikes in medical authorizations, people updating financial accounts and beneficiaries,” Kinsel said.
