Finally, the residents of Prateek Wisteria, a high-rise in Noida Sector 76, have a reason to celebrate. The maintenance of the society will now be handled by its Apartment Owners Association (AOA) as the developer—Prateek Group has finally accepted the 1800 flat owners’ long-standing demand.
The AOA started its first day in the office with good news for the residents as it decided to wave off two-months (February and March) maintenance charges. The members of the AOA said that right now they can afford the move as they have funds from the maintenance charges collected earlier.
Nisha Rai, secretary of AOA, said, “The developer has handed over the maintenance of the society to AOA and now it’s our responsibility to provide better services to the residents. The decision to wave off two months’ charges has been taken after analyzing the funds available with us.”
Listing out their key responsibility areas, the AOA members said that providing better facility at the two club houses and gyms, and overhauling the security on the premises are right at the top.
“We will work towards increasing the number of CCTV cameras and implement waste segregation system within two weeks. AOA would be fully operational from April 1 after the developer transfers all records and funds,” Rai added.
While most of the residents cheered AOA’s wave off offer, a section alleged that the association has not followed the guidelines prescribed under the UP Apartment Act.
Replying to this, Rai said, “This is absolutely wrong. Our AOA has been formed according to the UP Apartment Act and the Noida Authority is fully aware of this new development.”

Last week, two bitches jointly gave birth to 12 puppies on the premises of Prateek Wisteria in Sector 77 of Noida. The puppies were mercilessly thrown out — separated from their mothers even before they could be a month old.
After getting to know of the incident from certain residents, People for Animals (PFA) member Kaveri Rana Bharadwaj, a resident of Greater Noida, registered an FIR at Sector 49 police station against the AOA secretary of the society, the security agency and even the builder.
According to the complaint, the incident happened on November 19.
In response, Nisha Rai, the secretary, lodged an FIR against Bharadwaj and Pragati Khanna, who had accompanied Bharadwaj on the visit to the society, at the same police station under IPC Sections 289 [negligent conduct with respect to animals] and 506 [punishment for criminal intimidation].
Bharadwaj said, "When the residents informed me about the step taken by the AOA, I was shocked. So, I immediately spoke to the AOA secretary on the matter. She quite conveniently told me that she was just thinking about doing so because of the nuisance the puppies were creating. Later, a member of the society informed me that the puppies had already been thrown out.”
When Bharadwaj and Khanna visited the society area, they found that three of the 12 puppies were missing and the other nine were living on a vacant plot near the society.
"According to Supreme Court guidelines, no one can remove newborn animals from their homes, or separate them from their mother before two months," Bharadwaj explained.
The security guard at the gate, according to Bharadwaj, had admitted to the incident. She also provided video evidence of the conversation with the guard.

The ongoing fracas between the builder and the residents of Prateek Wisteria, a high rise in Sector 77, Noida, over maintenance fee hike has now come to a head. If the AOA fails to take over maintenance by month end, the builder will continue to provide services thereafter only if the charges are hiked by 20 paise.
Now, with only a few days left for month-end, the builder has also sent a notice to the AOA and the residents of the society stating the same.
However, the AOA is adamant that the builder refunds the IFMS (interest-free maintenance security) to the tune of Rs 10 crore — and the interest on it for the last four years — before the handover.
Members of the AOA also alleged that the builder is not holding meeting with the AOA and the residents as promised — neither is it replying to the notice sent by AOA about stopping the practice of debiting from the prepaid meter.
An AOA member said, “The builder hasn't been getting its accounts audited since the past four years. It has misappropriated funds, used maintenance staff for repairs and other works. We might also consider legal action.”
On September 3, the residents, along with the AOA, staged a protest against the builder in front of its office over the steep hike of maintenance charge by 16 per cent from September 1. While the old maintenance charge was Rs 2.35 per sq ft plus GST, the new amount at the time was pegged at Rs 2.75.
In response to the protest, the builder put a hold on the hike till September 15, and also asked the AOA to take over. But nonetheless it would increase the sum by 20 paise if it had to continue providing services after month-end.
The notice sent by the builder [as mentioned above] also spoke of how the protests held on September 3 disturbed customers who had come from long distances to the builder’s office. It also mentioned how the entire day was lost, and how the staff couldn’t work because of slogan shouting and use of abusive language during the protests.
The builder threatened legal action if protests of such manner were held in future.

The residents of high-rise societies of Ghaziabad, Noida and Greater Noida are demanding visitors’ parking on society premises. Residents want Noida and Greater Noida Authority to amend the building bylaws of 2010, so that 10 percent of the total parking is reserved for guests.
Amit Gupta, a resident of Prateek Wisteria in Sector 77, said, “In March this year, Noida Authority invited suggestions from residents to initiate changes in building bylaws to streamline parking issues in the city. According to the proposal, the authority wants to make it mandatory for all individual residential plot owners to have stilt parking to accommodate guest vehicles. In addition, the group housing developer will have to provide one parking space for every 50 sq m, as compared to the current norm of one parking space for every 80 sq m of space bought by residents.
Suppose, a builder buys a plot from Noida Authority that totals 2 lakh sq m. According to existing building bylaws norms, one parking space is to be allotted for every 80 sq m of space, thus for an area of 2 lakh sq m, there will be 2,500 parking slots (total area divided by 80 sq m). However, if the norms are revised, and a parking is allotted for every 50 sq m of space bought, the number of plots jumps to 4,000.
From the total parking available, residents want 10 per cent of the total parking to be reserved for visitors.
Alok Kumar, President of Federation of Ghaziabad AOAs, told City Spidey that it is important to reserve some parking for the guests, as Ghaziabad DM has already issued an order that no parking would be allowed outside the society. “So, some arrangement should be made by the builder and AOA of the society for the guest parking. We will soon be talking about the issue with concerned authorities in Ghaziabad,” Kumar confirmed.
Surprisingly, according to Manish Kumar, a resident of Noida Extension, building bylaws of Kanpur and Lucknow have this 10 percent reservation for visitors’ parking.
Often guests are forced to park on the slots meant for others, leading to unnecessary fights, lamented Preet Bharghav, a resident of Gaur City in Noida Extension.
To this, a resident of Sector 137 added, “Since guest vehicles are not allowed inside, they have to park near the markets. Several residents have lodged complaints with the police regarding theft of valuables from their cars.”
