On The Barrelhead The Cincinnati Post Office was established in 1794 and received soon after its first mail delivery, consisting of sixteen letters, two newspapers and a snuff box. Although no one was seriously injured, federal troops called in to disburse the 2,000 rioters drew swords and attached bayonets to their rifles until calm was restored.

During the coin-scarce Civil War, Shillito noted that his customers often used postage stamps as currency. Today, an 1862 Shillito “encased postage” coin can bring as much as $1,250 at auction.

All 1,750 pounds of taters arrived at their appointed destination by mid-afternoon.

Supreme Court Hears Oral Arguments on Religious Accommodation Case Alek Hedlund

The question of religious liberty has been an increasingly debated topic, as many cases surrounding the First Amendment right to religious expression have made their way to the Supreme Court. The majority-Conservative Supreme Court has been increasingly ruling in favor of religious liberties, as seen in cases such as Masterpiece Cakeshop and high school football coach Joseph Kennedy. One gray area, however, is how private employers and businesses are to allow individuals to practice their religion. Ultimately, a balance must be reached between the right of the individual to exercise their religious convictions, and the employer's right to operate their business the way they see fit within a free market economy.

With the passage of the Civil Rights Act in 1964, employers were prevented from engaging in discrimination against protected classes of individuals. Title VII of the Act specifically prevents discrimination on the basis of race, sex, or religion. Employers must "reasonably accommodate" and not discriminate against the expression of one's religion in the workplace [1]. However, the question remains as to how far employers have to reach to accommodate religious expression or belief. Does the absence of accommodation amount to a form of discrimination?

This question was addressed at the Supreme Court in the oral arguments surrounding Goff v. Dejoy on April 18th. Goff was an employee at a post office, who alleged that his religion required him to refrain from working on Sundays. A few years later, the post office contracted with another company, which required Sunday deliveries. Initially, the postal service attempted to allow Goff to observe the Sabbath, predominantly through other workers volunteering to cover Goff's shift. Additionally, they gave him the option to transfer to a different postal delivery branch which did not yet operate on Sundays. Eventually, however, the postal service was not able to find enough workers to cover Goff's Sunday shift. He was ultimately disciplined for failing to report to his Sunday shift, which led to his resignation and lawsuit against the company [1].

The predominant Supreme Court precedent relating to Title VII religious accommodation claims derives from Trans World Airlines v. Hardison. In this case, the Court determined that religious accommodations must be made by employers unless such accommodations place an undue hardship upon the business. Undue hardship was then defined as a "de minimus cost," meaning that the negative impact of the accommodation need not be substantial but could be minimal [1]. The District and Circuit court, respectively, dismissed the lawsuit, applying the de minimus standard and holding that Goff's accommodation amounted to an undue hardship [2].

Much of the oral arguments focused on Trans World Airlines v. Hardison. Attorneys for Goff requested that the Supreme Court overturn Hardison and apply a more stringent definition of "undue hardship" that goes further than de minimus, presumably an easy bar for most defendant employers to meet. Justice Neil Gorsuch seemed open to abandoning the de minimus analysis: "Maybe we could do some good days work, and put a period at the end of it, by saying that it is not the law," [2].

Ultimately, this case likely hinges on whether or not the Court will decide to uphold or reverse the Hardison decision. It is no surprise that Goff did not prevail at the lower courts, being that they are mandated to apply Supreme Court precedents. They applied to Goff's case the de minimus language and concluded that the inability to find employees to cover Goff's Sunday shift met the bar of minimal harm to the employer. Perhaps, however, the Supreme Court decides to reverse Hardison and apply a higher bar for employers to assert undue hardship. Then, it is possible that Goff could prevail. If the Court were to adopt Goff's request for the higher standard of "substantial difficulty or expense," it is most likely that he would win. It is difficult to imagine that one post office worker's inability to work a Sunday shift that rotates among employees amounts to a "substantial difficulty" for the employer. If no volunteers were available, the postal service could offer incentives such as overtime pay or time and a half to work the Sunday shift. This would solve the problem without incurring a substantial expense, as it is only one shift on one day of the week. Overall, with this particular Supreme Court bench being more favorable towards religious liberties, it will not be shocking if they abandoned Hardison and adopt new, more rigid language for employers to meet to combat Title VII claims.

He didn’t see any need to call the former Presidents in the wake of assassination attempts; “I think we’ll probably pass,” he said.
